The issue of public health ethics has received much attention in recent years and is seen as a new field, distinct from medical ethics. Faculty from the University of Virginia, Johns Hopkins School of Public Health, Georgetown University, the University of Minnesota, and others received a grant from the Greenwall Foundation to examine this new field of public health ethics and identify the unique principles that distinguish it from the study of medical ethics. In the course of that study, which (...) included exploring the field with public health practitioners, a number of distinguishing ethical principles emerged. The moral principles appropriate for public health officials included producing benefits; avoiding, preventing and removing harms; producing a maximum balance of benefits over harms; and distributing benefits and burdens fairly. A growing body of literature critical of ethics review boards has drawn attention to the processes used to determine the ethical merit of research. Citing criticism on the bureaucratic nature of ethics review processes, this literature provides a useful provocation for (re)considering how the ethics review might be enacted. Much of this criticism focuses on how ethics review boards _deliberate,_ with particular attention given to the lack of transparency and opportunities for researcher recourse that characterise ethics review processes. Centered specifically (...) on the conduct of ethics review boards convened within university settings, this paper draws on these inherent criticisms to consider the ways that ethics review boards might enact more communicative and deliberative practices. Outlining a set of principles against which ethics review boards might establish strategies for engaging with researchers and research communities, this paper draws attention to how _Deliberative communication_, _Engagement with researchers_ and the _Distribution of responsibility_ for the ethics review might be enacted in the day-to-day practice of the university human ethics review board. This paper develops these themes via a conceptual lens derived from Habermas’ (The theory of communicative action. Volume 1: Reason and the rationalization of society, 1984 ) articulation of ‘communicative action’ and Fraser’s (Social Text, 25(26), 56–80, 1990 ) consideration of ‘strong publics’ to cast consideration of the role that human ethics review boards might play in supporting university research cultures. _Deliberative communication_, _Engagement with researchers_ and the _Distribution of responsibility_ provide useful conceptual prompts for considering how ethics review boards might undertake their work. Biographical sketches show how six writers and public figures prepared for their deaths.

This is a comprehensive biography of Ludwig Prandtl (1875-1953), the father of modern aerodynamics. His name is associated most famously with the boundary layer concept, but also with several other topics in 20th century fluid mechanics, particularly turbulence (Prandtl's mixing length). Among his disciples are pioneers of modern fluid mechanics such as Heinrich Blasius, Theodore von Kármán and Walter Tollmien. Furthermore, Prandtl founded the Aerodynamische Versuchsanstalt (AVA) and the Kaiser-Wilhelm-Institut für Strömungsforschung in Göttingen, both of them seeds for the growth (...) of fluid mechanics in Germany. Yet Prandtl was also a representative of aeronautical research - from Imperial Germany via the Weimar Republic to the "Third Reich". Although not a party member, he assumed the role of a goodwill ambassador for Nazi Germany. This objective treatment of his career will be of interest to all scientists and historians wanting to learn more about Prandtl's influence and the early development of fluid- and aerodynamics. The threat of pornography to woman in particular and the society as a whole was their concern. Looking at advertisement, music videos and the World Wide Web the dealing with pornography seems even more easy since then. This evolves the question, whether we have to reconsider the arguments about pornography and its connection between sexuality and depersonalisation. (...) Levine (bio)For Diane C.Christa Wolf’s Kindheitsmuster, published in English as Patterns of Childhood, takes very little for granted—least of all the question of beginnings. The novel literally opens with the words of another: “Das Vergangene ist nicht tot; es ist nicht einmal vergangen,” a slightly altered translation of a line from Faulkner’s Requiem for a Nun: “The past is never dead. It’s not (...) even past.” 1 Lacking a proper opening and haunted by the specter of an unmastered and perhaps unmasterable past—of a “model childhood” spent in the East Prussian town of L. during the Third Reich, the text begins by questioning the very possibility of a clean break and a fresh start. This insistent question, raised in a variety of ways throughout the novel, is posed at the outset as a kind of textual stutter, as a perseverating question rehearsed from the beginning—and in lieu of simply beginning—as a series of false starts, as repeated attempts to start over, as a desperate struggle to restart a narrative paralyzed by the anticipation of difficulties still to come. “You lay aside stacks of tentatively filled pages, insert a fresh sheet in the typewriter, and start once again with Chapter 1. As in so many times during the last eighteen months, when you were forced to learn: the difficulties haven’t even begun [die Schwierigkeiten haben noch gar nicht angefangen].” 2 The temporal structure of this passage, found in the second paragraph of the novel, is worth commenting upon, for here the difficult question of how to begin seems to be folded back on itself, turned inside-out, as it were, and reposed as a question of difficulties that apparently have not yet even started. Within cognitive science, narratives are regarded as crucial and fundamental cognitive instruments or tools. As Roger Schank suggests, the identity of (sub-)cultures is to a considerable extent based upon the sharing of narrative structures (Schank. 1995.Tell me a story: Narrative and intelligence. Evanston, IL: Northwestern University Press.). According to Schank, culturally shared stories, as do many other stories, occur frequently in highly abbreviated form, as “skeleton stories” or “gists.” Collective identities are conveyed in and between cultures not only through verbal (...) discourse, but also by pictorial means. Many pictures and visual artworks have indeed been produced in order to establish and to consolidate a home-culture and to demarcate it from conceived extra-cultural counterparts.Some of my previous work on these lines has been concerned with demarcation efforts in visual media of “Jews” as extra-cultural, since the Middle Ages onwards, in the Third Reich’s iconography, as well as in modern, radicalized forms of anti-Semitic picturing in Arab media (Ranta. 2016. Die Ausstellung „Byzanz: Das Licht aus dem Osten“ (2001/2002) in Paderborn ist bereits die zweite in dem dortigen Diözesan-Museum, die sich der spätantiken und oströmischen Kultur widmet. Die erste Ausstellung fand um die Jahreswende 1996/1997 unter dem Titel „Frühchristliche Kunst in Rom und Konstantinopel“ statt. Beide Präsentationen decken somit die beiden Teilbereiche des universitären Studienfaches „Spätantik-frühchristliche Archäologie und Byzantinische Kunstgeschichte“ ab. Es kommt daher zwischen beiden Ausstellungen zu thematischen Überschneidungen im Bereich der Spätantike, die jedoch als Anknüpfungspunkte eines Fortsetzungskonzeptes zu (...) verstehen sind und nicht zu einer wiederholten Präsentation einunddeselben Exponates geführt haben. Interessant ist dagegen eine Verschiebung der Akzente: Während die erste Ausstellung ein gewisses Schwergewicht auf der reinen Kunstgeschichte und hierbei auf den Arbeiten der unterschiedlichen Bereiche der Plastik aufwies, stellt die Byzanz-Ausstellung die Alltagsgeschichte in den Vordergrund und veranschaulicht diese durch die Exponate. From the concentrated ghettos and camps delimited by walls and barbed wire to the open fields and camouflaged forests where victims were shot en masse, Anne Kelly Knowles et al. (...) argue, specific locations, patterns of migration, deportation and evacuation, and other spatial elements such as scale, were all central to the Nazi regime's creation of a "comprehensive geography of oppression."1 This is hardly surprising given the biopolitical logics and colonial fantasies underpinning Lebensraum ('living space'), the territorial concept guiding the genocidal aims of the Third Reich, which designated zones of life as well as the inverse on the European continent. The Holocaust was also experienced spatially by its victims, who were forced to navigate new (and at times familiar) sites and landscapes as those of genocide, and whose testimonies in the aftermath of the event conjured these very places in detail.In recent years, the spaces of the Holocaust have been variously revisited, reconstructed, and reimagined within Holocaust studies scholarship. As a broader part of the 'spatial turn' in the humanities, Holocaust scholars have increasingly employed spatial perspectives of the event to deepen our understanding of the environments in which the Holocaust took place and the transformation of these spaces over time—particularly in the fields of history and social science.2 While drawing on diverse modes of spatialisation from interdisciplinary perspectives, contributions from these fields have tended to privilege methods we might describe as variously 'forensic,' including mapping, model-making, and investigations of material traces of the past.3 This work has resulted in many significant insights, not only into the [End Page 1] contexts and structures of Nazi genocide and the perpetrator imaginings of space, but also the experiences of victims and survivors.4Another significant body of work has attended to space and culture within Holocaust contexts. From early on in the postwar period, particular locations and buildings became identified with the Holocaust, such as the notorious entrance guard house at Auschwitz-Birkenau, which appears on countless book covers as well as within films and artworks. Engaging with spatial insights and methodologies from the perspective of cultural and memory studies, scholars have attested to the production and mnemonic significance of these and less well-known sites, as well as the symbolic spatial worlds and experiences to which they give rise. These include Paul Jaskot and Gavriel Rosenfeld, who have turned respectively to Holocaust and post-Holocaust architectures as commonly overlooked sites of history and memory. Drawing attention to the construction of Holocaust space, Jaskot shows how reading architecture 'as process' rather than static structures laden with symbolic meaning reveals unique histories of forced labor in which "the goals of the SS intersected with victims' experience."5 Rosenfeld demonstrates the ways in which spaces built in response to Nazi genocide after 1945 have been variously "imbued with Jewish significance" by their users and creators, resulting in the rise to prominence of Jewish-identified architects.6 Along similar lines, Michael Meng's work has explored the ways in which Jews and gentiles interact with ruined synagogues, cemeteries and Jewish districts as important remnants of pre-war Jewish life in the post-war period in German and Polish cities.7Studies such as those noted above have tended to focus on cities and public buildings, as well as state and civic policy. But as the spatial histories and geographies of the Holocaust have helped to show, extermination often took place in rural settings (mostly located in Central and Eastern Europe), such as the killing fields where Jews were shot en masse; the forests where victims hid and were hunted by Germans and local collaborators; or the open spaces of the dissolving Reich through which former concentration camp inmates were forced to march during the final year of the war—sites in which, owing to less contained spatial dynamics, violence played out differently.8These kinds of sites, which are sparsely documented and often simply thought of... Most interpreters of Heidegger’s reflections on the body maintain that—whether early, middle, or late in the Gesamtausgabe—Dasein’s or the mortal’s openness to being/beyng is the ground of the fleshly or bodily (das Leibliche), but not the reverse. In this paper, I argue that there is evidence from Heidegger’s own oeuvre demonstrating that this relationship is instead mutually reciprocal. That is to say, I contend that corporeal variability is constitutive of Dasein’s openness to being just as Dasein’s openness to being is (...) constitutive of its corporeal variability. Understood in this way, Heidegger’s thinking puts forward what I call a corpoietic understanding of the body and of the meaning of ability. I show that, despite the ableist assumptions at play in much of Heidegger’s work, such an understanding is nevertheless grounded in the idea of access, a central concept in philosophy of disability and disability studies. After developing this idea of ability as access, I close by addressing the larger political stakes of using Heidegger’s work to think about embodiment and disability given the Third Reich’s mass slaughter of people with disabilities. Die Reedition der von den Verfassern nunmehr Excerpta Vaticana et Laurentiana genannt wird, findet ihre Begründung darin, dass der Erstherausgeber, der berühmt Rechtshistoriker Contardo Ferrini offenbar auf eine Kollationierung beider Codices verzichtet hat und im Übrigen, aus welchen Gründen auch immer, bei der Edition selbst nicht unwesentliche Versehen verschuldet hat. Der Codex Vaticanus Palatinus ist wohl in der ersten Hälfte des 14. Jahrhunderts entstanden, der Codex Laurentianus 80.6 in der ersten Hälfte des 15. Jahrhunderts. Grundsätzlich sind die Verfasser der Meinung, (...) die mit zahlreichen plausiblen Argumenten vorgetragen wird, dass der Schreiber des Codex Laurentianus 80.6, ein gewisser Stephanus of Medea, als Vorlage den heutigen Codex Vaticanus Gr. 19 vor sich liegen hatte, und als intelligenter Kopist verschiedene Emendationen vorgenommen hat. Eine große Mehrheit der Fragmente der Excerpta Vaticana et Laurentiana von 1–193 muss einem Juristen Anatolius zugeschrieben werden. Jene Person, die sie zusammengestellt hat, muss ein altes Manuskript mit der Summa Codicis des Anatolius verwendet haben. In dieser Summa waren die Termini technici immer noch in lateinischer Sprache verfasst. Zur Selektion der Texte führen die Verfasser an, dass überdurchschnittlich großes Interesse dem Strafrecht und dem Familienrecht gewidmet ist, während etwa Eigentumserwerb, Erbrecht und große Teile des Obligationenrechtes kaum Behandlung finden. Die Exzerpierung der Summa Codicis muss aus diesem Grunde von jemand vorgenommen worden sein, der eine besondere Affinität gerade zu diesen Bereichen des Rechtes hatte. Nach diesen grundsätzlichen und grundlegenden Ausführungen, die ich allesamt nicht nur begrüße, sondern voll mittragen möchte, widmen sich die Verfasser kurz aber prägnant der Person des Anatolius (24–30). Ein Anatolius wird zusammen mit sieben anderen Antecessores in der Constitutio Omne genannt, sowie in der Constitutio Tanta vom 16. Dezember 533 als einer der vier Professoren, denen die Kompilation der Digesten anvertraut worden war. Er bekleidete die Funktion eines Magister Officiorum und wurde aus diesem Grunde als Vir Illustris bezeichnet. Anatolius entstammte einer Juristenfamilie aus Beirut und lehrte dort selbst als Professor. Zachariae von Lingenthal (Griechische Bearbeitung des Codex 70) und Van der Waal (Comentar 111) hatten die Ansicht vertreten, dass es zwei Anatoli gegeben habe: Der eine Mitglied der justinianischen Kompilation, der andere der Autor des Codex-Kommentares. Dem gegenüber vertreten die Autoren die Ansicht, dass Anatolius ein einziger gewesen sei, der, nachdem er maßgeblich an der Kompilation in Konstantinopel mitgearbeitet hatte, etwa zwischen 530 und 533 als Lehrer nach Beirut zurückgekehrt sei, um dort an einer der prestigeträchtigsten Universitäten des Reiches die neue juristische Studienordnung durchzusetzen und ruhmreich zu begründen. Die Autoren lösen die Quellenproblematik derart, dass sie davon ausgehen, dass Anatolius das Buch 4 seines Kommentares noch in Konstantinopel vollendet und mit dem 8. Buch des Kommentares in Beirut wieder begonnen hat. Die klare und deutliche Argumentationsweise der Autoren, unpolemisch aber doch tiefgreifend, sollte in Zukunft übernommen werden. (shrink)

According to the received account of guilt in the philosophical literature, one cannot feel guilt unless one takes oneself to have done something morally wrong. But ordinary people feel guilt in many cases in which they do not take themselves to have done anything morally wrong. In this paper, I focus on one kind of guilt without perceived wrongdoing, guilt about being merely causally responsible for a bad state-of-affairs. I go on to present a novel account of guilt that explains (...) guilt about mere causal responsibility, according to which guilt represents part of the self as bound up with what is bad. (shrink)

What is the relation between small-scale collaborative plans and the execution of those plans within interactive contexts? I argue here that joint attention has a key role in explaining how shared plans and shared intentions are executed in interactive contexts. Within singular action, attention plays the functional role of enabling intentional action to be guided by a prior intention. Within interactive joint action, it is joint attention, I argue, that plays a similar functional role of enabling the agents to act (...) in a collaborative way such that their actions are rationally guided by a prior shared intention. This understanding of joint attention – as having a key functional role of enabling the rational guidance of joint intentional action by a prior shared intention – allows for an alternative understanding of the kind of minimal cooperation that infants can engage in. On this understanding, infants’ capacity to engage in joint actions is already an incipient capacity to engage in rational and intentional joint actions, albeit a capacity that is necessarily scaffolded by an adult rational co-partner. Common knowledge is ubiquitous in our lives and yet there remains considerable uncertainty about how to model or understand it. Standard analyses of common knowledge end up being challenged by either regress or circularity which then give rise to well-known paradoxes of practical reasoning, such as the Two Generals’ Paradox. This paper argues that the nature and utility of common knowledge can be illuminated by appeal to Wittgenstein’s Hinge Epistemology. It is argued that those things that we standardly think of (...) as being common knowledge in our lives are the same as those that Wittgenstein identified as hinge certainties. This identification of common knowledge with hinge certainties allows us to resolve the regress problem for common knowledge and explain how the Two Generals’ Paradox arises. (shrink)

It is hard to see why the head and other brain-containing parts of a person are not themselves persons, or at least thinking, conscious beings. Some theorists have sought to reconcile us to the existence of thinking person-parts. Others have sought to avoid them but have relied on radical theories at odds with the metaphysic implicit in ordinary ways of thinking. This paper offers a novel, conservative solution, one on which the heads and other brain-containing parts of persons do exist (...) but are neither persons, thinkers, nor conscious beings. It is a commonplace in economics that we should disregard sunk costs. The sunk cost effect might be widespread, goes the conventional wisdom, but we would be better off if we could rid ourselves of it. In this paper, I argue against the orthodoxy by showing that the sunk cost effect is often beneficial. Drawing on discussions of related topics in dynamic choice theory, I show that, in a range of cases, being disposed to honor sunk costs allows an agent (...) to mimic a resolute chooser, someone who adopts the best plan at the outset of a decision problem and sticks with it, even when resoluteness is unfeasible. I discuss several kinds of cases in which honoring sunk costs coincides with resolute choice. (shrink)

Our aim in this paper is to present the distinct ways in which Wolff, Baumgarten, and Kant understand the relationship between necessitation, constraint, and reluctant action in an effort to illustrate the subtle ways in which their conceptions of obligation differ from each another. Whereas Wolff conceives of natural or moral obligation as incompatible with constraint, Baumgarten holds that constraint and reluctant action are, in some instances, compatible with natural obligation. Kant departs from Baumgarten by conceiving of obligation as necessarily (...) involving constraint: as Kant’s reply to Schiller’s famous objection reveals, obligation must take on the character of constraint to reluctant action on account of the fact that human beings possess inclinations that always threaten to impel them in directions that oppose morality.
