Central to these claims has been an assertion that women have been (...) inadequately represented as subjects of clinical studies and that as a result neither health conditions unique to women—e.g., menopause—nor women's manifestations of health problems affecting both sexes—e.g., heart disease—have been investigated sufficiently.The scientific community, including federal agencies that sponsor and regulate clinical studies, is increasingly responsive to these claims and is taking steps to raise the level of women's participation in clinical studies. Controversy and concern have surrounded these actions, however. Two of the claims that have been made are: (1) that women are more difficult to study than men because of their cyclical hormonal changes; and (2) that conducting gender-specific subgroup analyses would increase the size of study populations, raise the cost of studies, and thereby reduce the number of studies that could be performed with the limited resources available. In addition, controversy over the inclusion of women of childbearing potential and pregnant women has been particularly salient. Concerns have been expressed about avoiding potential harm to existing or potential fetuses and about the possible legal and financial ramifications of such harm. A further concern involves the perceived difficulties in enrolling women in studies and retaining them for the duration of the studies.Against this backdrop, the Office of Research on Women's Health at the National Institutes of Health (NIH) asked the Institute of Medicine (IOM) in October 1992 to establish the Committee on the Ethical and Legal Issues Relating to the Inclusion of Women in Clinical Studies. The Committee's charge was to: (1) consider the ethical and legal implications of including women, particularly pregnant women and women of childbearing potential, in clinical studies; (2) examine known instances of litigation regarding injuries to research subjects [End Page 55] and describe existing legal liabilities and protections; and (3) provide practical advice on these issues for consideration by NIH, institutional review boards (IRBs), and clinical investigators.The 16 Committee members came from diverse backgrounds: bioethics, law, epidemiology and biostatistics, public health policy, obstetrics and gynecology, clinical research, pharmaceutical development, social and behavioral sciences, and clinical evaluative sciences.1 Chaired by two of the authors of this article, Ruth Faden and Daniel Federman, and coordinated by the third, IOM Study Director Anna Mastroianni, the Committee met five times over a fourteen-month period, convened a one-and-one-half day invitational workshop, and commissioned several background papers. The Committee's deliberations were complicated by the announcement of new federal policies late in its term. Specifically, the Food and Drug Administration (FDA) issued guidelines (FDA 1993) to replace its 1977 guidelines, which prohibited the inclusion of women of childbearing potential in early phases of most clinical drug trials. In addition, Congress passed the NIH Revitalization Act of 1993 (P.L. 103-43), which contains provisions mandating the inclusion of women and racial and ethnic minorities in NIH-sponsored clinical research. In February 1994, the IOM Committee publicly issued its final report and recommendations, Women and Health Research: Ethical and Legal Issues of Including Women in Clinical Studies, publishing the workshop presentations and commissioned papers in a separate volume.Deliberations of the CommitteeA number of issues arose at the outset as the Committee considered its charge. A few members initially believed that verification of the underrepresentation of women relative to men in clinical studies as a whole was a prerequisite to providing policy recommendations. Nearly one year has passed since the release of the Committee’s final report and recommendations, and it seems an appropriate time to invite discourse and reflection on the influence and impact of the Committee and (...) its efforts. Our intent is to advance understanding of the Committee and its work, its place in the evolution of bioethics and public policy, as well as the broader legacy of restoring trust in the conduct of human subjects research.In 1993, President Clinton and Secretary of Energy Hazel O’Leary initiated an investigation of America’s involvement in radiation experiments on its citizens during the Cold War. The investigation resulted in the appointment of the Committee in January 1994. Some issues raised by these radiation experiments were brought to the attention of the nation by revelations contained in a Pulitzer Prize-winning series of newspaper stories about plutonium injections carried out by the government on allegedly unsuspecting subjects during the Cold War. The Committee faced a broad mandate, which included piecing together the history of Cold War radiation experiments and human subjects research, as well as recommending remedies for past wrongs and mechanisms to ensure that such wrongs could not be repeated in the future.This issue of the Journal consists of articles and accompanying commentaries on historical, philosophical, policy, and political aspects of the Committee’s work that are important to bioethics. U.S. researchers and scholars often point to two legal factors as significant obstacles to the inclusion of pregnant women in clinical research: the Department of Health and Human Services’ regulatory limitations specific to pregnant women's research participation and the fear of liability for potential harm to children born following a pregnant woman's research participation. This article offers a more nuanced view of the potential legal complexities that can impede research with pregnant women than has previously been reflected in the literature. (...) It reveals new insights into the role of legal professionals throughout the research pathway, from product conception to market, and it highlights a variety of legal factors influencing decision-making that may slow or halt research involving pregnant women. Our conclusion is that closing the evidence gap created by the underrepresentation and exclusion of pregnant women in research will require targeted attention to the role of legal professionals and the legal factors that influence their decisions. Public health ethics, like the field of public health it addresses, traditionally has focused more on practice and particular cases than on theory, with the result that some concepts, methods, and boundaries remain largely undefined. This paper attempts to provide a rough conceptual map of the terrain of public health ethics. We begin by briefly defining public health and identifying general features of the field that are particularly relevant for a discussion of public health ethics.Public health is primarily concerned with (...) the health of the entire population, rather than the health of individuals. Its features include an emphasis on the promotion of health and the prevention of disease and disability; the collection and use of epidemiological data, population surveillance, and other forms of empirical quantitative assessment; a recognition of the multidimensional nature of the determinants of health; and a focus on the complex interactions of many factors—biological, behavioral, social, and environmental—in developing effective interventions. : During the nearly 10 years since its introduction, preimplantation genetic diagnosis (PGD) has been used predominantly to avoid giving birth to a child with identified genetic disease. Recently, PGD was used by a couple not only to test IVF-created embryos for genetic disease, but also to test for a nondisease trait related to immune compatibility with a child in the family in need of an hematopoetic stem cell transplant. At its core, public health introduces tensions between individuals' autonomy and the need to account for the perspectives and needs of communities and populations. It further raises social justice issues, including fair allocation of limited resources. This article examines and elaborates on these tensions and their resolutions using specific public health examples. Experiences in the 1980s and 1990s with HIV/AIDS provide a particularly rich collection of issues that brought ethical issues in public health to the public's attention, and in so (...) doing challenged previously held assumptions about the appropriate consideration of individual rights in the context of population health objectives. However, in the context of patient populations demanding better therapies, potential medical advances, and greater attention to issues of social justice, Kahn, Mastroianni, and Sugarman set out to reconceptualize the principle of justice in human subjects research to address these urgent concerns. Their worthy cause, developed out of collaboration on the White House Advisory Committee on Human Radiation Experiments, aims to demonstrate how previously unaddressed notions of justice now require greater consideration in research. The Milgram obedience studies are widely presented in psychology textbooks as integral to understanding the behavior of Holocaust perpetrators. Recent appraisals of the Milgram legacy have not challenged this view. Discussions of the Holocaust in the historical literature are often cited by psychologists to support the claim of the centrality of the Milgram studies to understanding the Holocaust. More recent historical literature presents a different view of the Holocaust, one that directly questions the relevance of Milgram's obedience studies in understanding (...) the Holocaust. This view has not been well represented in discussions of Milgram in psychology, and is discussed here. The nature of the evidence for the ecological validity of the Milgram studies, and the broader issue of the role of the Milgram studies as "scientific parables" are also discussed. The debate over the objects of episodic memory has for some time been stalled, with few alternatives to familiar forms of direct and indirect realism being advanced. This paper moves the debate forward by building on insights from the recent psychological literature on memory as a form of episodic hypothetical thought (or mental time travel) and the recent philosophical literature on relationalist and representationalist approaches to perception. The former suggests that an adequate account of the objects of episodic memory will (...) have to be a special case of an account of the objects of episodic hypothetical thought more generally. Mental state reasoning or theory-of-mind has been the subject of a rich body of imaging research. Although such investigations routinely tap a common set of regions, the precise function of each area remains a contentious matter. With the help of functional magnetic resonance imaging (fMRI), we sought to determine which areas are involved when processing mental state or intentional metarepresentations by focusing on the relational aspect of such representations. Using non-intentional relational representations such as spatial relations between persons and between (...) objects as a contrast, the results ascertained the involvement of the precuneus, the temporal poles, and the medial prefrontal cortex in the processing of intentional representations. In contrast, the anterior superior temporal sulcus and the left temporo-parietal junction were implicated when processing representations that refer to the presence of persons in relational contexts in general. The right temporo-parietal junction, however, was specifically activated for persons entering spatial relations. The level of representational complexity, a previously unexplored factor, was also found to modulate the neural response in some brain regions, such as the medial prefrontal cortex and the right temporo-parietal junction. These findings highlight the need to take into account the critical roles played by an extensive network of neural regions during mental state reasoning. (shrink)

Ancient ethical theories, based on the notions of virtue and happiness, have struck many as an attractive alternative to modern theories. But we cannot find out whether this is true until we understand ancient ethics--and to do this we need to examine the basic structure of ancient ethical theory, not just the details of one or two theories. In this book, Annas brings together the results of a wide-ranging study of ancient ethical philosophy and presents it in a way that (...) is easily accessible to anyone with an interest in ancient or modern ethics. She examines the fundamental notions of happiness and virtue, the role of nature in ethical justification and the relation between concern for self and concern for others. Her careful examination of the ancient debates and arguments shows that many widespread assumptions about ancient ethics are quite mistaken. Ancient ethical theories are not egoistic, and do not depend for their acceptance on metaphysical theories of a teleological kind. Most centrally, they are recognizably theories of morality, and the ancient disputes about the place of virtue in happiness can be seen as akin to modern disputes about the demands of morality. The philosophical debate around the nature of moods has mostly focused on their apparent undirectedness: unlike mental states such as perceptual experiences, thoughts, and emotions, moods do not seem to be directed at any specific object, and indeed they do not seem to be directed at anything at all. In this paper, I want to draw attention to a different feature of moods, one that is as important and in need of explanation as their apparent undirectedness, but which has been (...) overlooked by most participants in the debate: the fact that moods involve a particularly marked salience of the subjective aspect of experience. I argue that any adequate theory of moods should account for this fact. I call this the “subjective salience desideratum.” In the bulk of the paper, I articulate and motivate the desideratum, show that extant theories of moods do not satisfy it, and offer a preliminary overview of possible (yet unexplored) theories that have the subjective salience desideratum at their core. On a common characterization, moral luck occurs when factors beyond agents’ control affect their moral responsibility. The existence of moral luck is widely contested, however. In this paper, I present a new challenge for deniers of moral luck. It seems that some factors beyond agents’ control—such as moral principles about blame- and praiseworthiness—clearly affect moral responsibility. Thus, moral luck deniers face a dialectical burden that has so far gone unnoticed. They must either point to a relevant difference between factors like (...) moral principles and the kind of factors that according to them do not affect moral responsibility or show how they can avoid having to point to such a difference. I argue that no obvious way to meet the challenge presents itself and that it thus amounts to a serious worry for deniers of moral luck. (shrink)

Der Transhumanismus ist ein beliebtes Thema der Medien und wird in Tages- und Wochenzeitungen sowie im Fernsehen gerne aufgegriffen. Außerdem gibt es inzwischen viele Filme, die den Transhumanismus thematisieren, z. B. die Dokumentation „Endlich unendlich“ (2021, Regie: Stephan Bergmann). Der Transhumanismus wurde in Österreich auch Gegenstand einer Verschwörungserzählung, über die der Bayrische Rundfunk aufgeklärt hat. Auf den Wahlplakaten der „Partei (...) für Gesundheitsforschung“ ist der Transhumanist Aubrey de Grey abgebildet, der ein in Cambridge lebender Brite ist, aber auf Plakaten in Deutschland dargestellt wird. Diese und weitere Entwicklungen machen es notwendig, sich mit dem Transhumanismus aus wissenschaftlicher Perspektive auseinanderzusetzen. Was ist der Transhumanismus? Alle sprechen von Transhumanismus, aber was der Transhumanismus letztlich ist, bleibt häufig unklar. Der Transhumanismus (TH) ist eine philosophisch-technologische Bewegung des 20. und 21. Jahrhunderts, die es sich zum Ziel setzt, mittels neuer Technologien den Menschen grundlegend zu transformieren. Wichtig ist dabei, dass sich der TH nicht mit den Optimierungsbestrebungen in der Gesellschaft oder technologischem Fortschritt gleichsetzen lässt. Vielmehr verstehe ich unter TH die Gruppe, die sich um die Organisation Humanity+ in Kalifornien versammelt und die Personen, die sich explizit alsVertreter*innen des TH verstehen. Der TH hat eine ganz eigene Agenda, eigene Institutionen, Organisationen und Publikationsorgane.4 Zu den Themen und Visionen gehören die Lebensverlängerung von mehreren Hundert Jahren bis zur Unsterblichkeit, Kryonik (das Einfrieren des Körpers, der wieder aufgetaut werden soll, wenn nach transhumanistischer Vorstellung Unsterblichkeit ermöglicht werden kann), umfassendes Enhancement und die Verschmelzung von Körper und Technik sowie Beseitigung allen Leids, aller Krankheiten und Aufhebung des Alterns. Der TH strebt danach, mittels Technik neue Sinnesfähigkeiten zu erlangen und neue (virtuelle) Erfahrungswelten zu erschließen. Außerdem wird von vielen Transhumanist*innen auch die hochspekulative Vision des Mind Uploading vertreten, die streng genommen dem Posthumanismus zugeordnet werden muss Gemäß dieser Vision soll durch das maschinelle Lesen des Gehirns der ganze Mensch auf ein externes Medium hochgeladen werden können. Die Vision des Mind Uploadings ist aus naturwissenschaftlicher Perspektive hochumstritten, ist aber ein sehr beliebtes Motiv, das auch außerhalb des TH Wirkung zeigt und in viele Science-Fiction- Filme Eingang gefunden hat (z.B. die Amazon Serie „Upload“, 2020, Regie: Greg Daniels). Das Bestreben des TH, den Menschen grundlegend zu transformieren, wirft zunächst die Frage auf, wie der TH den Menschen überhaupt versteht. Dieser Frage nach dem Menschenverständnis des TH habe ich mich in meinem Buch „Über-Menschen. Philosophische Auseinandersetzung mit der Anthropologie des Transhumanismus“ gewidmet. Philosophische Anthropologie bezeichnet die wissenschaftlichen, philosophischen Reflexionen auf den Menschen. Welches Menschenverständnis vertritt der TH und lässt sich unsere Anthropologie auf dieser Grundlage weiterentwickeln? Das Buch gliedert sich in drei Teile: Teil 1 führt zuerst in die Bewegung des TH ein, worauf Teil II aufbaut, der sich mit dem Menschenverständnis des TH beschäftigt. Teil III betrachtet schließlich heutige Optimierungsbestrebungen in der Gesellschaft sowie neue Ansätze für die Technikanthropologie (z. B. Kritischer Posthumanismus und Neuer Materialismus). Die nachfolgenden Kapitel dieses Aufsatzes sind ein Ausschnitt aus Teil II, der Untersuchung des transhumanistischen Menschenverständnisses. Dieser Aufsatz widmet sich dem „genetisch codierten Menschen“ im TH, also der transhumanistischen Sicht auf den Menschen als jemanden, die*der vollständig von ihren*seinen Genen bestimmt ist. Der genetische Diskurs ist nur einer von fünf im TH dominanten Diskursen, die das transhumanistische Menschenverständnis ausmachen. Zu den anderen Diskursen bzw. transhumanistischen Bestimmungen des Menschen gehören: der Diskurs um die „Natur des Menschen“, der Maschinendiskurs – die Bestimmung des Menschen als Maschine –, der neurowissenschaftliche Diskurs – die Gleichsetzung des Menschen mit dem Gehirn bzw. Neuronalem und zuletzt die metaphysischen Verhältnisbestimmungen von Geist und Körper (PUZIO, Über-Menschen, Kap. 4). Diese transhumanistischen Bestimmungen des Menschen werden am Ende ausgewertet. Ohne die Ergebnisse dieses Kapitels im Detail vorwegnehmen zu wollen, kann für die Gesamtuntersuchung des TH gesagt werden, dass das transhumanistische Menschenverständnis sich als hochproblematisch erweist. Die transhumanistischen Argumentationsstrukturen sind nicht tragfähig und der TH behauptet sich auf die Naturwissenschaften zu berufen, widerspricht allerdings den aktuellen Ergebnissen der Naturwissenschaften. Dies wird in den nachfolgenden Kapiteln gut deutlich werden. Der TH hat ein reduktionistisches Menschenverständnis und reduziert den Menschen beispielsweise auf „Information“. Viele Ausführungen sind diskriminierend z. B. gegenüber Kranken, Alternden und Menschen mit Behinderungen und letztendlich wird sogar jeder Mensch, auch der gesunde junge Mensch, gegenüber der Maschine abgewertet, die aus transhumanistischer Sicht den Menschen weit übertrifft. Im weiteren Verlauf der Arbeit werden sogar „ideologische Elemente“ im TH identifiziert. Daher wird in der Arbeit abgelehnt, den TH als Grundlage für die Weiterentwicklung der Anthropologie zu verwenden und stattdessen werden im letzten Teil der Arbeit alternative Ansätze für die Technikanthropologie präsentiert. Wie bereits erwähnt, richtet sich die Kritik am TH jedoch nicht gegen die heutige Optimierung in der Gesellschaft, die ebenfalls im letzten Teil der Arbeit diskutiert wird. Optimierungsbestrebungen hat es schon immer gegeben und sie werden nun durch neue Technologien weiter verändert, sie sind aber nicht mit der Bewegung des TH gleichzusetzen. Das Kapitel ist eingebettet zwischen dem Maschinendiskurs (Mensch als Maschine) mit seinen Ausführungen zu Information und Kybernetik und dem neurowissenschaftlichen Diskurs („Der Mensch ist ihr*sein Gehirn“). Es wird im Folgenden der genetische Diskurs im TH untersucht, also wie der TH den Menschen vollständig auf Gene zurückführt, und dies schließlich kritisch geprüft. Sind „gute Gene“ alles? Kann der Mensch vollständig über ihre*seine Gene bestimmt werden? Und was hat es mit der trügerischen „genetischen Information“ auf sich? Zunächst wird der genetische Diskurs im TH dargestellt, also die genetischen Ausführungen des TH präsentiert (Kap. 2), danach wird der Blick auf den Gebrauch der genetischen Metaphern im TH gerichtet (Kap. 3) und zuletzt werden die genetischen Vorstellungen des TH kritisiert (Kap. 4). Der Aufsatz schließt in Kap. 5mit einer (vorläufigen) Zusammenführung der Ergebnisse und einem Ausblick. (shrink)

Most recent philosophical theories of consciousness account for it in terms of representation, the bulk of the debate revolving around whether (suitably) representing something is sufficient for consciousness (as per first-order representationalism) or some further (meta-)representation is needed (as per higher-order representationalism and self-representationalism). In this paper, I explore an alternative theory of consciousness, one that aims to explain consciousness not in terms of representation but in terms of the epistemically and metaphysically direct relation of acquaintance. I call this the (...) Inner Acquaintance Theory of consciousness (IAT). Roughly, on IAT, what makes a mental state conscious is its subject being acquainted with it. Though not wholly unprecedented, IAT is still at the fringe of consciousness debates and remains largely underexplored. The main goal of this paper is to take some steps toward developing the details of IAT, illustrate its potential explanatory power, and put it forward as a plausible alternative to representational theories, with the hope that this will contribute to shifting IAT closer to the center of the debate. Here is how I proceed. In §2 I introduce a notion—inner awareness—that is crucial both to contextualize and to understand IAT. In §3 I provide some preliminary motivation for exploring IAT. In §4 I explain the notion of acquaintance and illustrate some of the features that are typically attributed to it in the literature. The details of IAT are then shaped through four main decision points. I address them in §§5-8, where I suggest a particular choice at each decision point, thereby progressively building up a view that I consider particularly promising. (shrink)

This paper explores the relationship between a prominent version of the relational view of memory and recent work on forms of unsuccessful remembering or memory errors. I argue that unsuccessful remembering poses an important challenge for the relational view. Unsuccessful remembering can be divided into two kinds: misremembering and confabulating. I discuss each of these cases in light of a recent relational account, according to which remembering is characterized by an experiential relation to past events, and I argue that experiential (...) relations do not adequately distinguish between remembering and unsuccessful remembering. This is because there are, on the one hand, cases of remembering that do not instantiate the relevant experiential relations, and, on the other hand, cases of confabulation and misremembering that do instantiate the relevant experiential relations. I conclude by suggesting that any successful relationalist attempt to explain remembering needs to come to grips with unsuccessful remembering. (shrink)

For most people, animals are the most significant aspects of the nonhuman world. They symbolize nature in our imaginations, in popular media and culture, and in campaigns to preserve wilderness, yet scholars habitually treat animals and the environment as mutually exclusive objects of concern. Conducting the first examination of animals' place in popular and scholarly thinking about nature, Anna L. Peterson builds a nature ethic that conceives of nonhuman animals as active subjects who are simultaneously parts of both nature (...) and human society. Peterson explores the tensions between humans and animals, nature and culture, animals and nature, and domesticity and wildness. She uses our intimate connections with companion animals to examine nature more broadly. Companion animals are liminal creatures straddling the boundary between human society and wilderness, revealing much about the mutually constitutive relationships binding humans and nature together. Through her paradigm-shifting reflections, Peterson disrupts the artificial boundaries between two seemingly distinct categories, underscoring their fluid and continuous character. (shrink)

She argues that exercising a virtue involves practical reasoning of the kind we find in someone exercising an everyday practical skill, such as farming, building, or playing the piano. This helps us to see virtue as part of an agent's happiness or flourishing.
