The article attempts to show the way in which the notions of “natural law” and “cosmic harmony” have been applied by Western scholars in the interpretation of traditional Chinese thinking about the role of law in society, the extent to which the Western interpretations can be supported by the Chinese sources, and , more specifically, the degree to which official Chinese thought subscribed to a correlation between the occurrence of natural disasters and acts of maladministration or injustice on the (...) part of the emperor and state. Generally it is argued that the extent to which Chinese statesmen and administrators actually believed that errors in the infliction of legal punishment or the sentencing of offenders would produce aberrant natural phenomena has been exaggerated by Western scholars. The Legalists were a group of statesmen and writers in China (mainly fourth and third centuries BC) who advocated in their practice and writings the use of law as the principal instrument of government. They understood law in the Austinian sense of orders, stipulating punishments or rewards, issued by the ruler to his subjects. Emphasis was placed upon the fact that punishments should be severe and deterrent, that official should be accountable under the law for the correct performance of their (...) duties, that laws should be clear and certain, and that there should be a strict separation between law and morality, in the sense that law should take no account of moral desiderata but should itself furnish the sole source of what was right conduct. Although the great imperial codes from the T’ang to the Ch’ing (eighth to twentieth centuries) enshrined the basic values of Confucian orthodoxy, they were also strongly influenced, especially in their technical construction and the specification of officials’ duties, by Legalist doctrines. We explore the formal foundations of recent studies comparing aural pattern recognition capabilities of populations of human and non-human animals. To date, these experiments have focused on the boundary between the Regular and Context-Free stringsets. We argue that experiments directed at distinguishing capabilities with respect to the Subregular Hierarchy, which subdivides the class of Regular stringsets, are likely to provide better evidence about the distinctions between the cognitive mechanisms of humans and those of other species. Moreover, the classes of the (...) Subregular Hierarchy have the advantage of fully abstract descriptive (model-theoretic) characterizations in addition to characterizations in more familiar grammar- and automata-theoretic terms. Because the descriptive characterizations make no assumptions about implementation, they provide a sound basis for drawing conclusions about potential cognitive mechanisms from the experimental results. We review the Subregular Hierarchy and provide a concrete set of principles for the design and interpretation of these experiments. (shrink)

The data may assist in improving services, responding to concerns, celebrating excellent service, or determining that desired standards are being achieved. Australian hospitals utilise a range of techniques to collect patient feedback, and to use that patient feedback as part of continuous improvement. Whilst every hospital in Australia is expected to provide excellent medical care and treatment, private hospitals regularly purport to offer (...) some form of 'distinctive care', and options for patients that do not usually exist in public hospitals. Most often, private hospital patients are contributors to private health insurance, which is expensive, and additional 'out of pocket' expenses are the norm. Patients, therefore, often have particular expectations of a private hospital, which may include their choice of doctor, surgeon or anaesthetist; a private room and ensuite bathroom; a high standard of food choices; being kept well-informed with regard to their treatment; flexible hours and arrangements for visitors; a longer stay; and personalised care. Books and articles about the acceleration of daily life are themselves accelerating. A theoretical basis for expecting the inevitability of these trends has been traced in the writings of major sociologists including Durkheim, Marx, Weber and Sorkin. As deTocqueville observed more than 150 years ago, “The American is always in a hurry.” Economists have also weighed in on these issues of time compression, perhaps starting with Linder’s insightful treatise The Harried Leisure Class, predicting the frantic pace of modern life and (...) leisure. As specialized work led to higher rates of productivity, accelerated consumption led to an acceleration of the pace of life and a harried leisure class. Much of what Linder discussed in regard to time scarcity was perceived scarcity. Interestingly, his conclusions were not that people would work longer, but rather that they would attempt to increase the yield on a unit of time in all areas of life—minimizing activities such as singing or political debate, which could not easily have their yield on time spent increased. The value of efficiency and increased productivity, carried to extremes, he argued, produced a kind of decadence in which the goal of economic growth is never questioned. More recently, economists have played down the seriousness of concerns over a speeded up lifestyle, characterizing it in large part as “Yuppie Kvetch.” Not that higher income couples are making irrational decisions, they are simply facing the inevitable constraints on their ability to enjoy their wealth. This article reviews various of these philosophical issues in the context of US national survey data concerning trends in the time pressures and stress in the activities of Americans over the last 30+ years. It focuses both on the measurable amounts of free time Americans have and on the specific activities done in that free time. It also reviews survey data on Americans’ perceptions of and attitudes toward time and stress. It brings together data from different survey sources that often show conflicting trends and conclusions. (shrink)

Metabolic dysfunction is a ubiquitous underlying feature of many neurological conditions including acute traumatic brain injuries and chronic neurodegenerative conditions. A central problem in neurological patients, in particular those with traumatic brain injuries, is an impairment in the utilization of glucose, which is the predominant metabolic substrate in a normally functioning brain. In such patients, alternative substrates including ketone bodies and lactate become important metabolic candidates for maintaining brain function. While the potential neuroprotective benefits of ketosis have been recognized for (...) up to almost a century, the majority of work has focused on the use of ketogenic diets to induce such a state, which is inappropriate in cases of acute disease due to the prolonged periods of time (i.e., weeks to months) required for the effects of a ketogenic diet to be seen. The following review seeks to explore the neuroprotective effects of exogenous ketone and lactate preparations, which have more recently become commercially available and are able to induce a deep ketogenic response in a fraction of the time. The rapid response of exogenous preparations makes their use as a therapeutic adjunct more feasible from a clinical perspective in both acute and chronic neurological conditions. Potentially, their ability to globally moderate long-term, occult brain dysfunction may also be relevant in reducing lifetime risks of certain neurodegenerative conditions. In particular, this review explores the association between traumatic brain injury and contusion-related dementia, assessing metabolic parallels and highlighting the potential role of exogenous ketone and lactate therapies. The title of this special topic in RMM is borrowed from a 1978 paper of Hillel Steiner in which he argues against Robert Nozick's invisible hand conception of the emergence of the state. Steiner believes that central institutions of social order such as money and government need some form of conscious endorsement by individuals to emerge and to persist over time. -/- Tony de Jasay's critique (in Philosophy 85, 2010) of Bob Sugden's plea for a Humean version of contractarianism (see (...) RMM, Vol 0) motivated us, to take this old – but still central – theme of the debate on the origin of social order as one starting point in a new attempt to evaluate the idea of a social contract). -/- Within the 35 years since the publication of Hillel Steiner's paper different advances have been made in economics and philosophy that may well shed some new light on some of the fundamental issues in the debate about a contractarian conception of social order. These make us confident that a new attempt to explore the contractarian idea is well worthwhile. -/- Those who first motivated this project, Hillel Steiner, Anthony de Jasay, and Robert Sugden, as well as a number of other renowned scholars confirmed to contribute. The special topic will actually start with a previously unpublished paper by Hillel Steiner, originally written in 1986, in which he extends and elaborates on his argument about money from the 1978 paper, and with an original article by Anthony de Jasay, in which he further clarifies his worries. A response by Robert Sugden will follow. Further contributions will discuss the matter by reference to the roots of the debate in seventeenth and eighteenth century philosophy or to recent advancements in economics, the behavioral sciences or in social philosophy. Some of the contributions confirmed are already in a very elaborated stage and ready to be published soon. There is a wide disparity in contemporary practice in this regard, which points to a need for greater clarity and consistency in our thinking about ethics within education. Ethics in Education attempts to meet this need, and will be a valuable resource for students, teachers and researchers in education, health and social sciences. Social, legal and health-care changes have created an increasing need for ethical review within end-of-life care. Multiprofessional clinical ethics committees (CECs) are increasingly supporting decision-making in hospitals and hospices. This paper reports findings from an analysis of formal summaries from CEC meetings, of one UK hospice, spanning four years. Using qualitative content analysis, five themes were identified: timeliness of decision-making, holistic care, contextual openness, values diversity and consensual understanding. The elements of an engaged clinical ethics in a hospice context is (...) not generally acknowledged nor its elements articulated. Findings from this study have the potential to explain some of the most challenging ethical problems and to contribute to their resolution. It may also guide future deliberation and raise CEC members' awareness of the recurrent issues and values of their CEC practice. (shrink)

Geoffrey Hawthorn has written a substantial new conclusion for the second edition of his widely acclaimed critical history of social theory in England, France, Germany and the USA from the eighteenth century to the present. Hawthorn begins with the 'prehistory' of the subject and traces, particularly in the thought of Rousseau, Kant and Hegel, the emergence of certain fundamental distinctions and assumptions whose existence is often overlooked in studies of the traditional 'founding-fathers' of sociology like Marx, Dukheim and Weber.

China, India, Brazil and other major Third World nations have long refused to sign the Nuclear Non‐proliferation Treaty. This position might at first sight appear to be without any question morally unjustified and even irrational. Yet their claim that the treaty is ‘discriminatory’ merits the serious attention which it has not received. Only if certain aspects of this claim are accepted by the nuclear weapons signatories does a moral and rational onus to sign become unquestionable.

The paper attempts to account for the confusion over the validity of the concept of schizophrenia in terms of two closely related aspects of conceptual indeterminacy. Firstly, it is identified on the basis of a breakdown in intelligibility, but what constitutes such a breakdown is indeterminate. Secondly, the concept sits between the categories of natural disease or illness on the one hand, and character trait or moral failing or gift on the other. This entails an indeterminacy in attempting to define (...) the role that physiological explanation could have. Light may be thrown on the concept by exploring a distinction between a life story in which the schizophrenic condition emerges as the conclusion of the story and a causal process in which the condition is the end result or final consequence. In 1838, Sir Philip Egerton described a new type of fossil footprint from the Triassic sandstones of Tarporley, Cheshire, which he called Chirotherium herculis. The following year he reported a second find of the same type of footprints in Chester. The subsequent history of the Tarporley footprints is outlined and the possibility that two footprints from the second find are included in the collections of the Grosvenor Museum, Chester, is considered. The existence of a tracing made in 1839 when the (...) footprints were found provides proof that they do not correspond to the Grosvenor Museum's specimens. (shrink)

Thomas Hobbes denied both that opinion provides access to truth and that it ought to be protected from political manipulation. Hobbes knew that his contempt for opinion put him at odds with the classical tradition of political philosophy. What he could not have known was that it also would put him at odds with modern, liberal democracy, which protects opinions—the opinions of the public—that it cannot invest with truth value.

Deliberative democracy is a noble project: an attempt to make citizens philosophize. Critics of deliberative democracy usually claim either that the proposed deliberation threatens an existing moral consensus or, instead, that deliberation is impossible amid power imbalances that oppress the weak. But another problem is that combining democracy and deliberation is inherently an attempt to engage publicly in a private activity—where sensitivity to each interlocutor may require a special form of address. Can this be done? Yes, in some contexts. The (...) tradition of esoteric writing has demonstrated that it is possible to layer one's discourse in such a way that all citizens can partake at a level that suits them. But writing for a public is not really deliberation among equals; it is leadership by the writer of the readers. Transgress the margin to which ornament is properly confined, as artists in virtually every medium available in nineteenth-century France did, and a series of crucial binary distinctions collapses, threatening not only the center, but ornament itself, which is defined by its limits, its position on a well-defined edge.What distinguished nineteenth-century French literature was, from Gordon’s point of view, a sustained interest, among critics as well as artists, in cultivating the creative possibilities opened up by compromising the boundary between ornament and its other. So fertile and successful has this project proven to be that today’s postmodernity has not come to an end of it, continuing to discover its most interesting possibilities on the margin. He is interested in Gramscis thoughts on politics, social science, and religion but tells us that he is not concerned directly with the content of these. Such details are best worked out after we know what he means by religion, science and politics (5). He thinks that Gramscis conceptual framework must be identified first so that one can then proceed to find more order in the Notebooks (5). There follows an extended (...) discussion of what Gramsci says about his method and the method of Croce, Bukharin, and Machiavelli.
