The World Medical Association's Declaration of Helsinki offers guidelines to doctors engaged in biomedical research with human subjects. The fundamental distinction of the Declaration is between clinical research combined with professional care and non-clinical scientific research. If hospital patients are the experimental subjects, then the former research must be carried out by the patient's own doctor, whereas the latter research must not be; it must be carried out by other doctors. The relevance of the distinction between the patient's own doctor (...) and other doctors is challenged and an alternative conception of the patient-doctor relationship is drawn, together with an alternative justification, based on the work of Hans Jonas, of the use of patients in research. Finally, the political nature of the patient-doctor relationship is mentioned, and it is claimed that the alternative conception of this relationship developed in the paper is more in line with the ethical principles of the Hippocratic tradition. Robert Hoffman's note, ‘Scientific Research and Moral Rectitude’ , 475–7), is a highly misleading introduction to this important topic. Hoffman points out that there are some people who ‘believe that the researcher's claim to freedom of inquiry should be upheld only if his discovery does not adversely affect mankind or any significant segment thereof’ , and his aim is to reject this belief. But such people are right, as can be shown by some counter-arguments and examples. But first a slight (...) qualification is necessary, for, as Hoffman points out, it is impossible before an inquiry to state categorically that its outcome will adversely affect mankind. But it may be possible to estimate whether it is likely to affect mankind adversely, and it is surely reasonable to hold that a researcher's claim to freedom of inquiry should not be upheld if it is likely that the inquiry will adversely affect mankind. If a nuclear physicist interested in particle fusion wishes to carry out research which is likely to lead to an uncontrolled nuclear explosion, no one would seriously uphold his right to carry out this research in a laboratory situated in a densely populated area. And to reply that he still has a right to carry out this research alone on a desert island would be to concede, not to circumvent, the claim that scientific research ought to be under the critical eye of moral responsibility. The critic of science would not in any case accept this reply, since he believes not unreasonably that nuclear explosions adversely affect mankind wherever on earth they occur. (shrink)

Usually, it is our own fault: the value of our work, so the story has gone, is threatened from within, whether by submission to esoteric theories on the one hand, or by dissipation into the banalities of cultural studies on the other. In lieu of an abstract, here is a brief excerpt of the content:BELSEY ON LANGUAGE AND REALISM by Noel Carroll Like much contemporary literary theory, Catherine Belsey's influential Critical Practice1 is antirealist, where "antirealism" refers both to the rejection of a putative literary style and to the espousal of an epistemological stance, the latter ostensibly grounded in a theory of language, adapted from Ferdinand Saussure. Moreover, these two antirealisms are connected in that stylistic antirealism is, in part, advanced (...) as a consequence of epistemological —or perhaps more aptly "linguistic"— antirealism. Belsey's theory is avowedly political, designed to challenge the operation of ideology in literature, particularly realist literature. That is, though Belsey discusses literature of several different periods and of different genres, her primary preoccupation is with something she calls expressive realism, a tendency perhaps best exemplified by the nineteenth-century novel and still pursued by our less experimental writers. Purportedly, expressive realism is underwritten by at least two tenets: (1) realism insofar as it presumes that literature can accurately represent reality, and (2) a variant of expressionism insofar as it presumes we have access to the thoughts and intentions of authors {CP, p. 7). In this note, I shall concentrate exclusively on the linguistic arguments— which Belsey calls "Post Saussurean" — that are mobilized to discredit the first presumption of literary realism, its claim to represent reality. For Belsey, a major problem with expressive realism is that this sort of literature presents itself or is taken as an accurate reflection of reality. Belsey sometimes makes this point by saying that such literature purports to be an accurate representation of reality. At other moments, that which such literature claims to reflect accurately is said to be experiences of reality. But these alternative claims are also segued by 124 Noel Carroll125 saying that what is reflected are experiences of reality which are recognized to be true. Given the text, the variant of the reflection theory that appears to occupy Belsey most is the notion that literature reflects reality — that is, holds a mirror up to nature, as Hamlet might have it. This raises Belsey's political hackles because she believes that a commitment to the plausibility of the goal of reflecting life accurately invests realist literature with the aura of a socially unmediated, transhistorical, "natural" account of human life rather than an ideologically constructed one. In order to forestall this supposedly political repercussion, Belsey, taking advantage of her expanded version of Saussurean linguistics, charges that realism misconstrues the relationship between literature and the world. Indeed, ana this is the crux of her postSaussurean argument, the error here can be traced to something deeper, viz., a misconstrual of the relation between language and the world, of which the pretensions of literary realism are merely but an instance. Stated baldly, Belsey aspires to debunk literature's claims to realism by denying language's claims to realism. This may seem rather like killing a fly by using a cannon. And, in any case, one would have thought that questions about the representational efficacy of language were logically independent of the issue of the ideological operation of literary realism. However, Belsey, like many contemporary literary theorists, mistakenly believes that one contests literary realism by propounding epistemological reservations about language. Belsey claims that her linguistic antirealism derives from Saussure's putative discovery that "far from providing a set of labels for entities which exist independently in the world, language precedes the existence of independent entities, making the world intelligible by differentiating between concepts" {CP, p. 38). That language always precedes the existence of that to which it refers is a truly astounding discovery. And we should wish to know how Saussure, according to Belsey's interpretation, came upon it. For Saussure, language is a system of signs. Signs are composed of two elements: a material element— a sound-image or graphic image— called a signifier, and a conceptual element, what in different jargons is referred to as a meaning, an intension, or a connotation, and which in Saussure's terminology is called a signified. The metaphor of inscription on the body and the constitution of the body through those inscriptions have been widely used in recent attempts to theorize the body. Michel Foucault calls the body the ‘inscribed surface of events’ (Foucault, 1984: 83) and Elizabeth Grosz argues that the ‘female (or male) body can no longer be regarded as a fixed, concrete substance, a pre-cultural given. It has a determinate form only by being socially inscribed’ (Grosz, 1987: 2). The body becomes plastic, inscribed (...) with gender and cultural standards. While Foucault assumes the existence of a pre-inscriptive body, many theorists reject that idea and argue that ‘there is no recourse to a body that has not always already been interpreted by cultural meanings’ (Butler, 1990: 8). The constitution of the body rests in its inscription; the body becomes the text which is written upon it and from which it is indistinguishable. Starting from Catherine Belsey's suggestion that to ‘give the metaphor literal significance … is to … isolate it for contemplation’ (Belsey, 1988: 100), I discuss this metaphor of inscription, using cosmetic surgery as one literal example. While some theorists reject the pre-inscriptive body, the popular discourses advocating changing one's body assume unproblematically the existence of a body prior to these ‘elective’ procedures and reinforce the mind/body dualism which recent theory has sought so insistently to reject. I examine how popular discourses of body modification enforce a disciplinary regime (in Foucault's sense) and impose degrees of both literal and figurative inscription. Juxtaposing these two perspectives, I explore how both discourses efface the materiality of the body and the social contexts within which bodies are experienced and constructed. While the rhetoric surrounding cosmetic surgery denies the physical process and the economic constraints, so theories of the body which stress the body's plasticity also deny the materiality of that process and the cultural and social contexts within which the body is always placed. This paper describes the topological aspect of a logic-based, artificial intelligence approach to formalising the qualitative description of spatial properties and relations, and reasoning about those properties and relations. This approach, known as RCC theory, has been under development for several years at the University of Leeds. The main rationale for this project is that qualitative descriptions of spatial properties and relationships, and qualitative spatial reasoning, are of fundamental importance in human thinking about the world: even where quantitative spatial data (...) are most important, they must be attached to the components of a perceived spatial structure if we are to make use of them. RCC theory covers other qualitative aspects of spatial description and reasoning, but the topological properties and relations of spatially extended entities are fundamental to our work. The topological formalisms used by mathematicians are, in general, not well suited to the task of formalising the kinds of ‘common-sense’ or ‘everyday’ qualitative spatial description and reasoning which are our primary interest. Nevertheless, we must come to grips with the concepts of topology as practised by mathematicians if we are not to risk constantly ‘reinventing wheels’. (shrink)

In this short paper I propose that the sensorimotor approach to perception is a tree yielding two distinct theoretical fruits. One fruit is sensorimotor reductionism. The other is sensorimotor integrationism. In this paper I try to explain what makes these fruits different.

David Chalmers appears to assume that we can meaningfully discuss what goes on in human heads without paying any attention to the words in which we couch our statements. This paper challenges this assumption and argues that the initial problem is that of metalanguage: if we want to say something clear and valid about us humans, we must think about ourselves outside conceptual English created by one particular history and culture and try to think from a global, panhuman point of (...) view. This means that instead of relying on untranslatable English words such as 'consciousness' and 'experience' we must try to rely on panhuman concepts expressed in cross-translatable words such as THINK, KNOW, and FEEL (Wierzbicka, 2018). The paper argues that after 'a hundred years of consciousness studies' it is time to try to say something about us (humans), about how we think and how we differ from cats and bats, in words that are clear, stable, and human rather than parochially English. Open peer commentary on the article “Towards a PL-Metaphysics of Perception: In Search of the Metaphysical Roots of Constructivism” by Konrad Werner. Upshot: In his target article, Werner focuses his efforts on finding a metaphysical paradigm in which it would be suitable to embed - as he puts it - some movements in contemporary philosophy and cognitive science, and especially radical constructivism and the embodied cognition approach. In my commentary, I shall briefly discuss the question of metaphysical grounding or embedding (...) of radical constructivism, and make an attempt to show that the author has failed to explain what this grounding is supposed to be, and that radical constructivism has to remain characteristically an anti-metaphysical doctrine. Of course, I do appreciate the ingenious efforts to find the metaphysical grounding of radical constructivism, as far as the question of cognitive access to and the knowability of reality is concerned, but I would like to undermine the key tenet of the article that radical constructivism is in the pressing need of a metaphysics of some sort. Exploring history pertinent to evolutionary developmental biology (hereafter, Evo-devo) is an exciting prospect given its current status as a cutting-edge field of research. The first and obvious question concerns where to begin searching for materials and sources. Since this new discipline adopts a moniker that intentionally juxtaposes ‘evolution’ and development’, individuals, disciplines, and institutional contexts relevant to the history of evolutionary studies and investigations of ontogeny prompt themselves. Each of these topics has received attention from historians and thus there is (...) both primary and secondary material from which to draw. For example, many historians have documented the historical trajectories of genetics and embryology, their split, and various relations (or lack thereof), especially in the first three decades of the 20th century. BackgroundAs moral case deliberations (MCDs) have increasingly been implemented in health care institutions as a form of ethics support, it is relevant to know whether and how MCDs actually contribute to positive changes in care. Insight is needed on what actually happens in daily care practice following MCD sessions. This study aimed at investigating the impact of MCD and exploring how ‘impact of MCD’ should be conceptualized for future research.MethodsA multiple-case study was conducted in a care organization for people with (...) intellectual disabilities and/or acquired brain injury, by observing MCD sessions as ‘cases’, followed by interviews with health care professionals concerning the follow-up to these cases, and a focus group with involved MCD facilitators. A conceptual scheme concerning the possible impact formed the basis for analysis: (1) individual moral awareness; (2) the actions of health care professionals; (3) collaboration among health care professionals; (4) the concrete situation of the client; (5) the client’s quality of care and life; (6) the organizational and policy level.ResultsAccording to interviewees, their moral awareness and their collaboration, both among colleagues and with clients’ relatives, improved after MCD. Perceived impact on client situation, quality of care/life and the organizational level varied among interviewees or was difficult to define or link to MCD. Three aspects were added to the conceptual scheme concerning the impact of MCD: (a) preparations and expectations prior to the MCD session; (b) a translational step between the conclusions of the MCD session and practical events in the following period, and (c) collaboration with clients’ relatives. A negative impact of MCD was also found on misunderstandings among participants and disappointment about lack of follow-up.ConclusionsConcretizing and conceptualizing the ‘impact’ of MCD is complicated as many factors play a role either before or during the transition from MCD to practice. It is important to consider ‘impact’ in a broad sense and to relate it to the goals and context of the MCD in question. Future studies in this field should pay additional attention to the preparations, content and process involved in ethics support, including clients’ and relatives’ experiences. (shrink)

Health care professionals often face moral dilemmas. Not dealing constructively with moral dilemmas can cause moral distress and can negatively affect the quality of care. Little research has been documented with methodologies meant to support professionals in care for the homeless in dealing with their dilemmas. Moral case deliberation is a method for systematic reflection on moral dilemmas and is increasingly being used as ethics support for professionals in various health-care domains. This study deals with the question: What is the (...) contribution of MCD in helping professionals in an institution for care for the homeless to deal with their moral dilemmas? A mixed-methods responsive evaluation design was used to answer the research question. Five teams of professionals from a Dutch care institution for the homeless participated in MCD three times. Professionals in care for the homeless value MCD positively. They report that MCD helped them to identify the moral dilemma/question, and that they learned from other people’s perspectives while reflecting and deliberating on the values at stake in the dilemma or moral question. They became aware of the moral dimension of moral dilemmas, of related norms and values, of other perspectives, and learned to formulate a moral standpoint. Some experienced the influence of MCD in the way they dealt with moral dilemmas in daily practice. Half of the professionals expect MCD will influence the way they deal with moral dilemmas in the future. Most of them were in favour of further implementation of MCD in their organization. (shrink)

The Problem of Doxastic Shift may be stated as a dilemma: on the one hand, the distribution of nominal complements of the form `the ψ that p’ strongly suggests that `that’-clauses cannot be univocally assigned propositionaldenotations; on the other hand, facts about quantification strongly suggest that `that’-clauses must be assigned univocal denotations. I argue that the Problem may be solved by defining the extension of a proposition to be a set of facts or, more generally, conditions. Following the trend of sharing, and associating being on-line with being 'on-life', many people are now demanding the ownership and control of their data across all processing phases, including the erasure of their presence on the web. In Europe, recent proposals for regulation include an explicit 'Right to be Forgotten'; this right stated in the European Commission Proposal for Regulation COM 2011/12 does not emerge without controversy. It is being criticised on several grounds, including clashing with other rights, such as (...) freedom of expression, as well as setting the terrain for censorship. Besides the purely legal aspects of the proposed provisions, the chapters of this volume discuss how those legal provisions correspond in practice to worldviews and how individual and collective memory must be governed. They look into the deeper consequences of such provisions to construction of identity, culture and community formation, and how such a right affects how, what and why individuals, groups and societies remember and forget. P-hacking or data dredging involves manipulation of the research data in order to obtain a statistically significant result. The reasons behind P-hacking and the consequences of the same are discussed in the present manuscript.

The basic (negative and positive) methodological maxims of three currents of philosophy of science (logical empiricism, falsificationism, and postpositivism) are formulated. Many of these maxims (stratagems) are controversial, e.g., the stance about the nonsense of metaphysics, and that of its indispensability. The restricted validity of these maxims allows for their unification. Within the framework of most of them there may be a relationship of (synchronic, or diachronic) subordination of the contradicting desiderata. In this vein ten stratagems are formulated.

Context: The theory of radical constructivism offers a tool for the evaluation of knowledge in general: especially with regard to its epistemic and ontological character. This applies in particular to knowledge that is non-cognitive, such as, e.g., ethical convictions. Problem: What impact can radical constructivism have on the topic of ethics? Specifically, how can ethical issues be resolved within a radical-constructivist epistemic approach? Method: I extend the theory of radical constructivism to include also items of non-cognitive knowledge. This makes it (...) possible to discuss ethical issues, which are non-cognitive, in a constructivist epistemic and ontological perspective. Some arguments against this conception of “strictly personal ethics” are discussed. Results: Radical constructivism is neutral on ethical issues, and thus cannot be invoked to endorse any particular ethical position. However, this causes no problem for the theory: the individual knower will construct her own ethical values and convictions, as part of her store of non-cognitive knowledge, in interaction with her environment (including other individuals. Hence ethical values cannot be argued in cognitive terms; and this elevates the knower into a position of personal responsibility with respect to ethical issues. Constructivist content: I focus on the role played by radical constructivism in the approach to cognitive vs. non-cognitive knowledge. The construction of knowledge (of any kind) emerges as a strictly personal enterprise. For instance, in the context addressed here, constructed non-cognitive knowledge forms a basis for the individual knower’s ethical position. (shrink)

Presentation of the thesis that Kumāril Bhaṭṭa and Dharmakīrti, 7th cent., Sanskrit philosophers, were Assamese by birth, contrary to the traditional belief that they are from South India.

The COVID-19 pandemic has been a data-political spectacle. Data are omnipresent in prediction and surveillance, and even in resistance to governmental measures. How have citizens, whose lives were suddenly governed by pandemic data, understood and reacted to the pandemic as a data-political phenomenon? Based on a study carried out in Denmark, we show how society became divided into those viewing themselves as supporters of the governmental approach to the COVID-19 pandemic, and those who oppose it. These groups seem to subscribe (...) to very different truths. We argue, however, that both sides share a positivist ideal and think that data and facts ought to rule. Both sides have also come to acknowledge that data are not unambiguous, and both cast increasing doubts on political uses of data. Though the people agreeing with, and the people opposing, the government strategy are in many ways surprisingly similar with respect to epistemic norms, they differ in what they perceive as dangerous or desirable, and in who they believe are telling the “truth” about the pandemic. These different perceptions result in different types of pandemic-related activism. Resistance against restrictions is often understood as inspired by conspiracy theories and in some countries anti-restrictions activism has turned violent. In our case, however, we suggest that when looking at similarities and differences across both groups, the gap between those opposing and those agreeing with the government approach is not as unbridgeable as might be suggested by their beliefs in differing truths and the emerging societal division.
