This book presents an analysis of how speakers of typologically diverse languages report present-time situations. It begins from the assumption that there is a restriction on the use of the present tense to report present-time dynamic/perfective situations, while with stative/imperfective situations there are no such alignment problems. Astrid De Wit brings together cross-linguistic observations from English, French, the English-based creole language Sranan, and various Slavic languages, and relates them to the same phenomenon, the 'present perfective paradox'. The proposed analysis is (...) founded on the assumption that there is an epistemic alignment constraint preventing the identification and reporting of events in their entirety at the time of speaking. This book discusses the various strategies that the aforementioned languages have developed to resolve this conceptual difficulty, and demonstrates that many of the features of their tense-aspect systems can be regarded as the result of this conflict resolution. It also offers cognitively plausible explanations for the conceptual structures underlying the interactions attested between tense and aspect. (shrink)

It has been argued that organizational structures (the way tasks are defined, allocated, and coordinated) can influence moral agency in organizations. In particular, low values on different structural parameters (functional concentration, specialization, separation, and formalization) are said to foster an organizational context (allowing for relating to the goals and output of the organization, moral deliberation, and social connectedness) that is conducive to moral agency. In this paper, we investigate the relation between the organizational structure and moral agency in the (...) case of a.s.r. (a large Dutch insurance company). While our empirical results fit the thesis that low values on structural parameters positively relate to moral agency, they also refine our understanding of the influence of structural parameters. In particular, our data suggest that the influence of functional concentration not only depends on whether it is low, but also on the type of criterion used for identifying business units; they suggest that the specific organizational context may put a limit to lowering design parameters and points at several non-structural factors that have an influence on the relation between structure and moral agency. In all, the paper contributes to a more detailed understanding of the conditions conducive to moral agency in organizations. (shrink)

We investigate the possibility to characterize (multi) functions that are Σ b i -definable with small i (i = 1, 2, 3) in fragments of bounded arithmetic T 2 in terms of natural search problems defined over polynomial-time structures. We obtain the following results: (1) A reformulation of known characterizations of (multi)functions that are Σ b 1 - and Σ b 2 -definable in the theories S 1 2 and T 1 2 . (2) New characterizations of (multi)functions that are (...) Σ b 2 - and Σ b 3 -definable in the theory T 2 2 . (3) A new non-conservation result: the theory T 2 2 (α) is not ∀Σ b 1 (α)-conservative over the theory S 2 2 (α). To prove that the theory T 2 2 (α) is not ∀Σ b 1 (α)-conservative over the theory S 2 2 (α), we present two examples of a Σ b 1 (α)-principle separating the two theories: (a) the weak pigeonhole principle WPHP (a 2 , f, g) formalizing that no function f is a bijection between a 2 and a with the inverse g, (b) the iteration principle Iter (a, R, f) formalizing that no function f defined on a strict partial order ( $\{0,\dots,a\}$ , R) can have increasing iterates. Symptomatic of the crisis of the current global political order are the millions of displaced that have fled their homes but are not allowed to enter the country in which they seek refuge. Instead, they are placed in camps. To understand the site of the camp and the bare life it produces, testimonies of refugees are indispensable. This essay aims to examine and listen to these testimonies by, first, introducing the notion of testimony and some of the characteristics of the (...) testimony of refugees; second, examining what it means to listen to testimony and which role is played therein by the narrative, literary structure of testimony; and, third, by interpreting the form of life to which the testimonies of the camp attest, which several witnesses describe as a life in “limbo.” This essay concludes with some brief remarks on the relation between experience, truth, and language in testimony. Literary trauma theory has traditionally been a humanist concern, and the concept of witnessing, so central to the theorization of trauma, has focused on human experience and relationships. This article stages an interdisciplinary intervention by conceptualizing trans-“species” trauma testimony as a literary encounter involving a double-layered witnessing; the human artist witnessing nonhuman animals’ witnessing to the failings and crises brought about by human society. Focusing on a selection of contemporary Australian poems, a view emerges of poetic (...) witnessing and testimony that exceeds and complicates the sub-genre lenses of old such as “nature poetry,” “ecopoetry,” and “protest poetry.” I propose a new conceptual category that testifies to traumatic structures and consequences of human practices. I explore how this testimony proceeds through a two-way channel of witnessing in which nonhuman animals are active witnessing agents and not merely witnessed by humans. I concentrate on witnessing as primarily experiential, as a corporal, affective operation in which the senses figure centrally. I argue that when poets witness nonhuman animal experience in poetry, testimony advances as an ethical engagement in an act of solidarity and advocacy. Poetry offers productive potential in this respect due to its affinity for engagement with the senses, its capacity to communicate heightened affect, and its scope for expression, articulation, and evocations of meaning outside of conventional sense-making and the limits of rational understanding. This is the first musicological study entirely devoted to a comprehensive analysis of musical Holocaust representations in the Western art music tradition. Through a series of chronological case studies grounded in primary source analysis, Amy Lynn Wlodarski analyses the compositional processes and conceptual frameworks that provide key pieces with their unique representational structures and critical receptions. The study examines works composed in a variety of musical languages - from Arnold Schoenberg's dodecaphonic A Survivor from Warsaw to Steve Reich's minimalist Different (...) Trains - and situates them within interdisciplinary discussions about the aesthetics and ethics of artistic witness. At the heart of this book are important questions about how music interacts with language and history; memory and trauma; and politics and mourning. Wlodarski's detailed musical and cultural analyses provide new models for the assessment of the genre, illustrating the benefits and consequences of musical Holocaust representation in the second half of the twentieth century. This paper is one in a series of attempts on my part to think through one of the central challenges left to us by Merleau-Ponty’s sudden death in 1961: if we understand the turn, in his later writings, toward an ontology of the flesh as “a radical rethinking of the experience of belonging from within, [as] a phenomenology of being-of-the-world”, how are we to bear witness to such an experience? What modalities are called forth to do justice to this belonging? (...) The task accrues existential and ethical weight when, at stake in our analyses, are historical and social structures like coloniality that normalize experience, perception, and sense-making while marginalizing others. It is my contention, in this article, that when the phenomenological inquiry becomes critical the question of modality becomes ethically central; how we bear witness to experiences of marginalization and the operations of power that produce them matters in that it risks reifying the same normative structures that predicate the oppression of many. With these questions and considerations in mind, in this article, I return to silence and propose that the mobilization of what I call “deep silences” can be a powerful tool for a critical phenomenology that bears witness without capitulating to the imperative of transparency norming the modern/colonial world system. Deep silence, in fact, designates signifying practices that do not primarily operate within the bounds of logocentrism and speech as the foundational principles of meaning, or that rely upon conceptual, analytical, and instrumental thinking, mobilizing instead the somatic, affective, and sensual dimensions of existence. In this article, I am primary concerned with the sense-making effected by the aesthetic as an instance of deep silence. Specifically, I focus on the image- and ritual-centered photographic documentaries of Silvia Rivera Cusicanqui, which, I suggest, challenge the hegemonic normativity of modern/colonial aesthetics, introducing the reader to other sensibilities wherein the distinction between theory and practice has no purchase and the multiplicity of creative expressions is recognized. This paper combines methods of argumentation theory and artificial intelligence to extend existing work on the dialectical structure of crossexamination. The existing method used conflict diagrams to search for inconsistent statements in the testimony of a witness. This paper extends the method by using the inconsistency of commitments to draw an inference by the ad hominem argumentation scheme to the conclusion that the testimony is unreliable because of the bad ethical character for veracity of the witness.

Do the changes that have taken place in the structures and methods of the production of scientific knowledge and in our understanding of science over the past fifty years justify speaking of an epochal break in the development of science? Gregor Schiemann addresses this issues through the notion of a scientific revolution and claims that at present we are not witnessing a new scientific revolution. Instead, Schiemann argues that after the so-called Scientific Revolution in the sixteenth and seventeenth centuries, (...) a caesura occurred in the course of the nineteenth century that constituted a departure from the early modern origins of science. This change was characterized by the loss of certainty on the part of the scientists, by the steadily increasing importance of scientific communities (rather than individuals), and by the systematic intertwinement of scientific and societal development. As to present science, Schiemann admits that important changes have occurred, but he denies the conflation of nature and culture: even the OncoMouse is a natural organism, though a seriously damaged one. We are currently witnessing a fundamental structural transformation of the scientific public sphere, characterized by processes of specialization, metrification, internationalization, platformization and visibilization. In contrast to explanations of this structural transformation that invoke a technological determinism, we demonstrate its historical contingency by drawing on analytic concepts from organization theory and the case of the Open Access transformation in Germany. The digitization of academic journals has not broadened access to scientific output but narrowed it down even further in (...) the course of the ‘serials crisis’. For a long time, research institutions were not able to convince large academic publishers to adopt less restrictive forms of access to academic journals. It was only through the emergence of new and in part illegal actors (shadow libraries and preprint servers) that the existing path could be broken, and an Open Access path constituted. Following this analysis, we discuss consequences of the Open Access transformation for the public spheres of science and democracy. We conclude that Open Access publishing can only help to transform both communicative spaces towards the normative ideal of a public sphere when complemented by systematic support for non-profit publication infrastructures. The philosophy of science has lost its self-confidence, witness the lack of advanced textbooks in contrast to the abundance of elementary textbooks. Structures in Science is an advanced textbook that explicates, updates, accommodates, and integrates the best insights of logical-empiricism and its main critics. This `neo-classical approach' aims at providing heuristic patterns for research. The book introduces four ideal types of research programs and reanimates the distinction between observational laws and proper theories. It explicates various patterns of explanation by subsumption (...) and specification as well as structures in reductive and other types of interlevel research. Its analysis of theory evaluation leads to new characterizations of confirmation, empirical progress, and pseudoscience. Partial analogies between progress in nomological research and progress in explicative and design research emerge. Finally, special chapters are devoted to design research programs, computational philosophy of science, the structuralist approach to theories, and research ethics. (shrink)

We investigate the development of terms during cut-elimination in first-order logic and Peano arithmetic for proofs of existential formulas. The form of witness terms in cut-free proofs is characterized in terms of structured combinations of basic substitutions. Based on this result, a regular tree grammar computing witness terms is given and a class of proofs is shown to have only elementary cut-elimination.

The Jehovah’s Witnesses cases of the late 1930s and early 1940s presented some of the first instances of American Supreme Court’s attempts to grapple with the challenges of a multicultural society. Taken as a whole, these cases represented a favorable position towards minorities’ claims, even to some extent a path breaking one. The Jehovah’s Witnesses cases were a precursor of the Court’s growing involvement in the protection of minorities’ rights, which colored the entire second half of the 20th century. They (...) further introduced a new language, and new judicial forms into constitutional jurisprudence—the language of balancing and balancing tests. In all these aspects the Jehovah’s Witnesses cases seem to have shown the early sings of multicultural ideology in Supreme Court jurisprudence. However, not all Jehovah’s Witnesses cases showed the same kind of judicial willingness to protect minorities’ interests from the will of the majority, and not all involved the new judicial rhetoric of balancing. What explains these different judicial responses in cases which are similar in their facts and close to each other in time? In this Article I will attempt to distinguish between three types of Jehovah’s Witnesses cases and argue that the different judicial responses in each of them indicates a different structure of the multicultural conflict, and a different structure of the multicultural claims in each of them. The last two decades have witnessed a crescendo of allegations that clinical translation is rife with waste and inefficiency. Patient advocates argue that excessively demanding regulations delay access to life‐saving drugs, research funders claim that too much basic science languishes in academic laboratories, journal editors allege that biased reporting squanders public investment in biomedical research, and drug companies (and their critics) argue that far too much is expended in pharmaceutical development.But how should stakeholders evaluate the efficiency of translation and proposed (...) reforms to drug development? Effective reforms require an accurate model of the systems they aspire to improve—their components, their proper functions, and their pathologies. However, there is currently no explicit and well‐developed model of translation for evaluating such criticisms.In what follows, we offer an explicit model of clinical translation. Many discussions of clinical translation and its pathologies presume that its main output is tangible: new drugs, vaccines, devices, and diagnostics. We disagree. We argue that the principal output of clinical translation is information—in particular, information about the coordinated set of materials, practices, and constraints needed to safely unlock the therapeutic or preventive activities of drugs, biologics, and diagnostics. To develop this information calls for a process far different from a simple linear progression of clinical trials; it requires exploratory sampling of many different elements in this set. Our model points to some limitations and liabilities of influential proposals for reforming research. It also reveals some underrecognized opportunities for improving the efficiency of clinical translation. (shrink)

Arabic legal documents from early Islamic Egypt are attested in Arabic papyrus collections. These exhibit a formulaic structure that is clearly distinct from those of the Byzantine Greek tradition of legal documents, which continued to be written in the first Islamic century. The Islamic Arabic documents reflect a legal formulaic tradition that had its origins in the Ḥijāz of Arabia. This article examines the background of this Ḥijāzī tradition, with particular focus on the opening formula and the witness clauses. As inpatient nurses spend the majority of their work time caring for patients at the bedside, they are often firsthand witnesses to the devastating outcomes of inadequate preventive healthcare and structural injustices within current social systems. This experience should obligate inpatient nurses to be involved in meeting the social justice needs of their patients. Many nursing codes of ethics mandate some degree of involvement in the social justice needs of society, though how this is to be achieved is not (...) detailed in these general guidelines. Acknowledging an explicit obligation for inpatient nurses to address the social justice issues of their patients would facilitate better overall understanding of social justice issues and reduce preventable admissions. If implementation of such an obligation is done with care, having inpatient nurses participate in justice projects could also mitigate compassion fatigue, allow for better job satisfaction among these nurses, and provide a sense of revitalization in nurses’ role as health promoters. The paper aims to present a reading of the question of Testimony rising in Derrida's later works (from Faith and Knowledge to Poetics and Politics of Witnessing): the experience of Testimony as the irreducible condition of the relation to the Other, of every possible link among living human singularities and, thus, of the thinking of a community to come. This thinking is able to divert the community from the economy grounding and structuring it within our political tradition governed by (...) the metaphysics of presence, which demands the sacrifice of the Other in its multiple theoretical and practical forms. We intend to read this proposal and to point out its rich perspectives by bringing it into the articulation of an ethical-political archi-writing. So we suggest going back to Derrida's early analyses of phenomenology and to De la grammatologie in order to present a reading of archi-writing as the irreducible condition of the relation to otherness and, thus, of the experience through which a living human singularity constitutes itself, a singularity different from the one our tradition compels us to think of within the pattern of the absolute presence to the self, free from the relation to the other. The role played by witnesses of bullying in nursing settings remains little studied, despite their potential relevance in explaining the onset and development of bullying. The objective of this study was to develop a model to account for witnesses’ intention to help and helping behaviour in response to bullying in a nursing setting. Three hundred and thirty‐seven witnesses completed self‐report measures of variables predicting intention to help and helping behaviour. A full structural model was constructed using structural equation (...) modelling. The intention to help victims was elicited by tension, group identity, support to peers’ initiative to intervene and absence of fear of retaliation. However, engagement in helping behaviour was only predicted by the absence of fear of retaliation. This study shows that witnesses of bullying in nursing settings do not remain impassive, but their experienced discomfort and intention to help victims is not sufficient to predict helping behaviour. Fear of possible retaliation if intervening in favour of victims constitutes a crucial factor explaining witnesses’ hesitation to help victims. Several implications for the implementation of policies directed at eradicating bullying in nursing settings are discussed. (shrink)

Background: how mind functions is subject to continuing scientific discussion. A simplistic approach says that, since no convincing way has been found to model subjective experience, mind cannot exist. A second holds that, since mind cannot be described by classical physics, it must be described by quantum physics. Another perspective concerns mind's hypothesized ability to interact with the world of quanta: it should be responsible for reduction of quantum wave packets; physics producing 'Objective Reduction' is postulated to form the basis (...) for mind-matter interactions. This presentation describes results derived from a new approach to these problems. It is based on well-established biology involving physics not previously applied to the fields of mind, or consciousness studies, that of critical feedback instability. -/- Methods: 'self-organized criticality' in complexity biology places system loci of control at critical instabilities, physical properties of which, including information properties, are presented. Their elucidation shows that they can model hitherto unexplained properties of experience. -/- Results: All results depend on physical properties of critical instabilities. First, at least one feed-back or feed-forward loop must have feedback gain, g = 1: information flows round the loop impress perfect images of system states back on themselves: they represent processes of perfect self-observation. This annihilates system quanta: system excitations are instability fluctuations, which cannot be quantized. Major results follow: -/- 1. Information vectors representing criticality states must include at least one attached information loop denoting self-observation. -/- 2. Such loop structures are attributed a function, 'registering the state's own existence', explaining -/- a. Subjective 'awareness of one's own presence' -/- b. How content-free states of awareness can be remembered (Jon Shear) -/- c. Subjective experience of time duration (Immanuel Kant) -/- d. The 'witness' property of experience – often mentioned by athletes 'in the zone' -/- e. The natural association between consciousness and intelligence -/- This novel, physically and biologically sound approach seems to satisfactorily model subjectivity. -/- Further significant results follow: -/- 1. Registration of external information in excited states of systems at criticality reduces external wave-packets: the new model exhibits 'Objective Reduction' of wave packets. -/- 2. High internal coherence (postulated by Domash & Penrose) leading to a. Non-separable information vector bundles. b. Non-reductive states (Chalmers's criterion for experience). -/- 3. Information that is: a. encoded in coherence negentropy; b. non-digitizable, and therefore c. computationally without digital equivalent (posited by Penrose). -/- Discussion and Conclusions: instability physics implies anharmonic motion, preventing excitation quantization, and totally different from the quantum physics of simple harmonic motion at stability. Instability excitations are different from anything hitherto conceived in information science. Using the Canadian peacekeeping context, I reflect on President Bush's use of the phrase “axis of evil” in the New World Order. 1 argue that this phrase reveals an epistemology structured by notions of the civilized North and (...) the barbaric South. We look for a converse to a result from [N. Thapen, A model-theoretic characterization of the weak pigeonhole principle, Annals of Pure and Applied Logic 118 175–195] that if the weak pigeonhole principle fails in a model K of bounded arithmetic, then there is an end-extension of K interpretable inside K. We show that if a model J of an induction-free theory of arithmetic is interpretable inside K, then either J is isomorphic to an initial segment of K , or (...) K is isomorphic to an initial segment of J and in this case the weak pigeonhole principle fails in K. This result is formulated in terms of a theory of bounded arithmetic with a greatest element. We go on to consider structures defined by oracles, and use the probabilistic witnessing theorem for to give a general criterion for what can be proved about these using the weak pigeonhole principle. We also show that the injective WPHP is not provable in this theory in the relativized case. (shrink)

This paper explores the ethical challenges involved in the ways public representation structures our experiences of atrocities and facilitates an adequate awareness of and response towards the suffering of others. It points out that such an analysis should not exhaust itself in answering what makes public representations of human suffering ethically suspicious and intolerable, but should rather extend this task by clarifying how the public forms sentiments about their social and political reality by elucidating under which conditions public representation promotes (...) broader political agendas. One of the central tenets of human rights advocacy is the widespread conviction that exposure to images and stories of human rights abuse has a mobilizing effect on western audience whose exposure to such knowledge can motivate them to intervene and prevent future atrocities. In order to assess the basic implications of such a conviction we must answer at least three principal clusters of questions. First, how do public representations of atrocities affect individuals and their capacities to conceive and respond to social injustices and the suffering of others? Under what circumstances may agents respond effectively to shocking content? Second, how do social powers operate within the field of perception in order to control how the viewing public is affected? And how do these effects inform and galvanize political support or opposition regarding concrete historical events? Finally, what can be said about the responsibilities of visual representation? Whose agency is it that images inform, and what reforms are necessary to make representations of suffering ethically effective means to encourage better acknowledgment of individual and collective responsibilities that would motivate the public to meet its moral and political obligations? This paper ultimately suggests that in order for politically implicated images to have an immediate critical effect on individuals and their agency, they need to cultivate alternative modes of perception.Article first published online: 21 DEC 2015. We give a formalism for approximate isomorphism in continuous logic simultaneously generalizing those of two papers by Ben Yaacov [2] and by Ben Yaacov, Doucha, Nies, and Tsankov [6], which are largely incompatible. With this we explicitly exhibit Scott sentences for the perturbation systems of the former paper, such as the Banach‐Mazur distance and the Lipschitz distance between metric spaces. Our formalism is simultaneously characterized syntactically by a mild generalization of perturbation systems and semantically by certain elementary classes of two‐sorted (...) structures that witness approximate isomorphism. As an application, we show that the theory of any ‐tree or ultrametric space of finite radius is stable, improving a result of Carlisle and Henson [8]. (shrink)

The context for this is a gap between what is often allowed as rational and what is embraced as certain in the life of faith. The last two decades have witnessed a wide-ranging and global discussion of the theory and structure of human and constitutional rights. This debate initially focused on the principle of proportionality and subsequently on the related ideas of the ‘culture of justification’ and the ‘right to justification.’ There is now a far-reaching agreement that both proportionality and justification in human and constitutional rights law are concerned with the reasonableness, alternatively the justification in terms of public reason, of the act under consideration. Bonhoeffer writes... from a position of social power and privilege and argues from that place that the acknowledgment of guilt is definitive for the church. My theology of public witness defines the church as the body called to repentance—as the body called, in the words of Bonhoeffer, to accept guilt or take responsibility for social sin.(9)McBride shows that “repentance” carries various connotations in Bonhoeffer’s writings. In Discipleship, he “links metanoia with the church’s conformation to the crucified Christ (a prevalent theme throughout his theology).” In Ethics, he links “repentance to the church’s this-worldly activity when he defines the church’s repentance as preparing this ‘penultimate’ world for its redemptive transformation.” In Letters and Papers from Prison, he defines metanoia as “living completely in” this world’s tasks, questions, successes and failures, experiences, and perplexities, taking seriously the suffering of God in the world (14). “As the acceptance of divine judgment, repentance participates in the unfolding of redemption. Thus, it is... energized by hope for the world and humanity, animated by joyful expectation as much as lament, and oriented toward future transformation as much as past and present sin” (107). Interpreting repentance through the person of Christ directly challenges the common understanding that repentance primarily concerns one’s individual standing before God; instead, as participation in Christ, repentance constitutes existence for others. Her interpretation is far richer and more insightful than I can represent in a short review.McBride bases her argument on three dimensions of Bonhoeffer’s theology: Christology, this-worldliness, and ecclesiology (12). By “Christology,” she is pointing to “nothing other than the crucified Christ who accepts responsibility for sin” (139). By “this-worldliness,” we can also point to Christology, in Bonhoeffer’s incarnational theme of entering into the full dimensions of human life. McBride’s ecclesiology urges “that the church’s presence in public life be conformed to Christ’s mode of being in the world” (54).In his Ethics (134–45) Bonhoeffer wrote a profound confession of his own, the churches’ and nation’s guilt that was taken up by some churches and church groups after the war’s end, and then by President Richard von Weizsäcker and Chancellor Willy Brandt. This public repentance has been the key to healing within Germany and in its relation with other nations.McBride credits Larry Rasmussen and John de Gruchy for inspiring us to develop new implications of Bonhoeffer’s theological ethics for our different contexts. This paper draws on cognitive psychological theory to explain the role of emotion in the decision-making process of four reluctant, vulnerable witnesses to wrongdoing, who were persuaded to blow the whistle on matters of substantial public interest. It proposes a theoretical explanation for the role of emotion on whistle-blower or witness decision-making, based on the Iterative Reprocessing Model and drawing on appraisal-based theories of cognitive psychology. It concludes that the decision to speak is preceded by an intense emotional episode, probably (...) due to changes in the witnesses’ coping and legitimacy appraisal structures. In response to distant suffering, global civil society is being consumed by a generalized witnessing fever that converts public spaces into veritable machines for the production of testimonial discourses and evidence. However, bearing witness itself has tended to be treated as an exercise in truth-telling, a juridical outcome, a psychic phenomenon or a moral prescription. By contrast, this article conceives of bearing witness as a transnational mode of ethico-political labour, an arduous working-through produced out of the struggles of groups (...) and persons who engage in testimonial tasks in order to confront corresponding perils produced by instances of situational or structural violence; it is the work of witnessing, the normative and political substance generated through the performance of patterns of social action, which matters. Using Celan's allegory of the poem as a message in a bottle, I consider bearing witness as a web of cosmopolitan testimonial practices structured around five dialectically related tasks and perils: giving voice to mass suffering against silence (what if the message is never sent or does not reach land?); interpretation against incomprehension (what if it is written in a language that is undecipherable?); the cultivation of empathy against indifference (what if, after being read, it is discarded?); remembrance against forgetting (what if it is distorted or erased over time?); and prevention against repetition (what if it does not help to avert other forms of suffering?). Generally, the testimony of intoxicated witnesses has been considered relatively unreliable, but recent research has nuanced the knowledge base regarding these vulnerable witnesses.PurposeTo demonstrate the application of recent research findings regarding intoxicated witnesses to the statements made by a key witness to the murder of Olof Palme, Sweden's prime minister, in 1986. An additional purpose was to illustrate the use of a nuanced calculation of blood alcohol concentration for researchers.MethodsThe Palme murder has been debated since the crime was committed and (...) no one has yet been sentenced. One of the witnesses was intoxicated and to estimate a range for his BAC at the time, a comprehensive BAC calculation was conducted in this study to illustrate important factors to consider in these types of cases.ResultsThrough the demonstration of the use of a nuanced BAC formula and by applying recent research results from studies on intoxicated witnesses, it was estimated that the possible BAC of the witness in the Palme-case at the time of the witnessed crime ranged between BAC = 0 to BAC = 0.13, depending on the type of alcoholic beverage consumed and whether the witness was a social or heavy drinker. This puts the witness either well within the span of maintained completeness as well as maintained accuracy rate, or slightly exceeding this span into the BAC-range of reduced completeness but maintained accuracy rate. He was questioned immediately, and thereafter repeatedly, and he reported similar information throughout the interviews, which is in line with previous results on information maintenance over repeated interviews among intoxicated witnesses.ConclusionThe current case example shows how recent research on intoxicated witnesses can be applied in praxis, illustrating important factors for legal practitioners to consider when interpreting information from intoxicated witnesses. It also provides legal practitioners and researchers with an example of a structured approach to more nuanced BAC-calculations. (shrink)

We want to consider anew the question, which is recurrent along the history of philosophy, of the relationship between rationality and mathematics, by inquiring to which extent the structuration of rationality, which ensures the unity of its function under a variety of forms (and even according to an evolution of these forms), could be considered as homeomorphic with that of mathematical thought, taken in its movement and made concrete in its theories. This idea, which is as old as philosophy itself, (...) although it has not been dominant, has still been present to some degree in the thought of modern science, in Descartes as well as in Kant, Poincaré or Einstein (and a few other scientists and philosophers). It has been often harshly questioned, notably in the contemporaneous period, due to the failure of the logistic programme, as well as to the variety of “empirical” knowledges, and, in a general way, to the character of knowledges that show them as transitory, evolutive and mind-built. However, the analysis of scientific thought through its inventive and creative processes leads to characterize this thought as a type of rational form whose configurations can be detailed rather precisely. In this work we shall propose, first, a quick sketch of some philosophical requirements for such a research programme, among which the need for an harmonization, and even a conciliation, between the notions of rational (or rationality), of intuitive grasp and of creative thought. Then we shall examine some processes of creative scientific thought bearing on the knowledge and the understanding of the world, distinct from mathematics although keeping tight relations with them. Contemporary physical theories are privileged witnesses in this respect, for in them the rational thought of phenomena makes an intrinsic use of mathematical thought, which contributes to the structuration of the formers and to the expression of their concepts (which entails the physical contents of the latter). The General Theory of Relativity and the Quantum Theory are exemplar to this, as they directly reveal what can be called the “drag of physical thought par the mathematical form”, which makes possible to overcome the limitations of the physical knowledge previously adquired. This article examines the nature and structure of witness and defendant narrative accounts in the evidential portions of courtroom trials, using the O.J. Simpson, Oklahoma Bombers and Louise Woodward trials as a database. The article proposes a means of distinguishing narrative from non-narrative accounts, using Labov's definition of the `minimal narrative' as a starting point, and puts forward a modified model of narrative structure. A range of narrative structures are explored, and the model is used to analyse a series of (...) representative example narratives taken from the trial data. Different types of narrative fragmentation produced by multiple tellers of the same narrative are also examined, along with the frequent disjunction between `tellers' and `knowers'. Lastly, the article explores the relationship between narrative structures and narrative fragmentation and the discourse strategies used by lawyers in direct and cross-examination. (shrink)

Let me suggest why. Instead of marginalizing or bracketing out consideration of divine agency, Barth presupposes God’s past, present, and future action; God’s inalienable subjectivity and indissoluble over-againstness in relationship (irreducible, for example, to ecclesial action); and God’s ongoing judgment of good and evil, and thus of moral thought and practice. These presuppositions determine the method, structure, content, and purpose of his theology and ethics. His concept of grace consists of God accomplishing the good in our place and on our behalf, a perspective more substantive than supplementary in nature. Finally, his eschatological view of human freedom involves resistance and responsibility—the freedom to resist evil (having been delivered from the determination of evil by grace) and the freedom to witness to God’s action in faith, love, and hope in the world. Barth’s work serves the field of Christian ethics well, burdened as we are by unprecedented global awareness with its challenges and uncertainties.Two new books on Barth’s theology and ethics seek to increase our understanding of his work and engage contemporary Christian moral thought and practice. Gerald McKenny’s The Analogy of Grace is now the indispensable guide to Barth’s ethics. His exposition is comprehensive, critical, and contextual as it relates Barth’s dogmatics to current academic work in Christian ethics and moral philosophy. The tradeoff, however, is that it pays insufficient attention to the ecclesial, cultural, and political contexts for embodying Barth’s ethics. McKenny makes an important contribution to our understanding of Barth’s work. By closely reading primary texts and secondary literature, McKenny shows that many of Barth’s critics and friends continue to misunderstand [End Page 192] him by resolving the unresolvable, airbrushing ambiguities and thus converting Barth’s “strange” ethics into a more conventional moral theory. McKenny argues that it is precisely the strangeness of Barth’s theology—with all its implications—that continues to challenge and contribute constructively to contemporary Christian ethics.What is so strange and significant about Barth’s work? For McKenny, it is Barth’s claim that “God resolves on the good from eternity in the determination of humanity in Jesus Christ to commission and service as active witnesses of God’s glory; fulfills it in time in the incarnation, life, death, resurrection, and ascension of Jesus Christ, who performs this commission and service in place of all of humanity; and summons, empowers, and directs human beings in every time to correspond to this fulfillment in their conduct” (288). Thus, our action should be modeled on God’s action; it should be an analogy of grace. “The telos of God’s grace is realized,” McKenny concludes, “when human beings in their action become the image of God” (208). The Analogy of Grace traces the way Barth develops this ontological and analogical vision as McKenny differentiates Barth’s work from modern theories that presuppose that people are relatively capable of knowing and doing the good.McKenny suggests that there is a possible deficiency in the way Barth’s account of divine agency determines the form and content of his theology and ethics. Barth’s consistent opposition to moral theories that emphasize observable signs of moral progress in either self or society results in the “liability” of the “extraordinarily qualified affirmation he gives to visible human goodness” (223). McKenny asks if Barth “does justice to the work of the Holy Spirit in our lives” and “can make sense of the participation of our action in God’s action or of the way in which the Holy Spirit accomplishes this participation” (223). Expertise, authority, and testimony refer to aspects of one of the most important elements of communication and cognition. Argumentation theory recognises various forms of what we call the argumentum ad alia pattern, in which speakers appeal to what others have said, including Position to Know scheme, Witness Testimony scheme, Expert Opinion scheme and the classical ad verecundiam. In this paper we show that ad alia involves more than merely an inferential step from what others (a person in position to know, (...) a witness, an expert) have said, and that studying this type of argumentation requires going beyond the argument structure of propositional contents to account for different speech activities. We also demonstrate that using the words of others, attacking what has been said, and reasoning from how others reason constitute a rich repertoire of communication strategies which we need to model in order to be able to analyse them manually and to process them computationally. It should perhaps be stressed at once that to reject the "attributive" view of truth does not imply that the predicative use of the word "true" is illegitimate or in some sense ungrammatical. It would indeed be absurd to make such a claim. At the same time, it is important to bear in mind that the predicative use of "true" gives no justification for interpreting truth as an attribute or as a characterizing feature of an object, even if the concept (...) of an object is widened to include linguistic items. It is useful to remember that the adverb "truly" as well as the adjective "true" can occur as part of grammatical predicates. Furthermore, "true" can occasionally be replaced by the substantive with ease. Thus we say "What he said is true" and also "He spoke the truth." Witnesses in court swear to speak "the truth, the whole truth, and nothing but the truth." The elasticity of common usage which allows one to express the same thought now with the help of the adjective and now with the help of the noun much too frequently tends to be ignored in discussions about truth. Yet this elasticity itself is a clear warning against interpreting truth too rashly as an attribute. (shrink)

Haneke’s film Funny Games is a reflection on the nature of pain and representation. I argue that the film closely follows Elaine Scarry’s arguments about the structure of torture. Further, by refusing to appeal to categories of generalization such as ‘sadism’ and ‘psychopathy’, Haneke undermines the process of finding meaning in violence. Haneke positions his audiences as more than just witnesses to torture, but active participants in cruelty.
