This review shows that there is now a solid scientific evidence base for the “expert” evaluation of disputed confession cases in judicial proceedings. Real-life cases have driven the science by stimulating research into “coercive” police questioning techniques, psychological vulnerabilities to false confession, and the development and validation of psychometric tests of interrogative suggestibility and compliance. Mandatory electronic recording of police interviews has helped with identifying the situational and personal “risk factors” involved in false confessions and how these interact. It is (...) the combination of a detailed evaluation and analysis of real-life cases, experimental work, and community (and prison/police station) studies that have greatly advanced the science over the past 40 years. In this review, the story of the development of the science during this “golden era” is told through the three established error pathways to false confessions and wrongful convictions: misclassification, coercion, and contamination. A case study of a major miscarriage of justice is used to highlight the key issues at each stage of the error pathways and it shows the continued resistance of the judiciary to admit mistakes and learn from them. Science is a powerful platform from which to educate the police and the judiciary. (shrink)

In this brief commentary the author concentrates on the treatment perspectives of Mealey's model. The main weakness of the model is that it does not provide a satisfactory theoretical connection between treatment and different types of target behavior. Even within the primary-secondary distinction, there are large individual differences that should not be overlooked in the planning of treatment.

We discuss two examples of media and public fascination with the interrelated themes of history, identity and heredity, pointing out.

We identify a realist position which emphasises the need to account for how humans judge politically, contra moralist tendencies to limit its exercise to rational standards, but which fails to provide a sufficient conception of its structure and potential. Limited appeals to political judgement render the realist defence of the political elusive and compromise the endeavour to offer a meaningful alternative to (...) the moralist tendency to displace politics. The potential and limitations of realist discussions on judgement are made visible in relation to proto-realists Judith Shklar and Isaiah Berlin. In seeking to enrich the realist conception of the political, the article introduces the displacement critique found in the neglected Arendtian ‘realism’. It also provides the foundations for a distinctly realist account of political judgement which, we argue, requires elaboration along two dimensions: the social coding of political judgement and the political capacities that help judgement build a suitable political sphere. This article contributes to debates on complicity in injustice and violence by deepening the recent efforts to map out an ethics of responsiveness to complicity. The ethics of responsiveness aims to increase the affective engagement of people who disproportionately benefit from domination, exploitation, and exclusion, with the impact of their complicity on others. It articulates different strategies for tackling the dispositions that help the privileged disavow complicity. To extend the responsiveness approach, this article builds on Hannah Arendt’s theorisation of the (...) relationship between politics, reality, and responsibility. A turn to Arendt helps us respond to the political problem of an erosion of the frameworks of judgement and action across society that enable critical engagement with complicity. I argue that the problem adds a burden on the privileged to strengthen and protect the institutions and processes that allow us to come to terms with reality together by developing a disposition towards ‘world-in-formation.’. Research carried out during recent decades has revealed our genome not only to be a unique mine of information about health, disease and the human condition, but also about the origin and dispersal history of the species. In this context, the genome is simply an additional source of information about human history, epistemologically no different from other historical sources. However, media and public interpretation of genetic studies of human history are complicated by the wider connotations of genes as the determinants (...) of hereditary features and identity. We discuss two examples of media and public fascination with the interrelated themes of history, identity and heredity, pointing out some implications of historical research using genetic data in the context of our own ongoing study of Inuit groups in Greenland and Victoria Island, Canada. This article explores subversion as a practice of resistance and draws on the example of subversive radio for illustration. Radio became an important site of power struggles in the twentieth century, often placed in the service of both resistance and oppression. An examination of subversive acts in radio broadcasting, I argue, helps shift the focus away from the myths of heroic resistance, directing attention to the uncertainties encountered by the subversive actor. To make this argument, I build on Frantz Fanon’s (...) influential work on the resistant potential of radio and engage with literature on subversion and everyday resistance. The article illustrates the ambiguity of subversion on the case study of Radio Bantu, a broadcaster of ethnic-specific radio programmes established by the South African apartheid regime. (shrink)

This article studies the response of the US disability community to the prevalent assumption that disabled people do not have a future, in the form of the disability rights movement. It provides an exploratory discussion of the key role played by utopianism in the response. In doing so, the article adds to critical theorizing on the importance of utopia to the oppression of non-dominant groups and to transcending that oppression. I use utopian studies scholarship to interpret the activities leading up (...) to the passing of the Americans with Disabilities Act in 1990 as a minor utopia, characterized by an ambiguous, grounded, and provisional effort to imagine alternative ways of being. I articulate the central role played by a positive vision of disability and disabled people for this inversion of the historically negative relationship between utopia and disability. The article turns to disability activists to show that the movement countered exclusionary utopian approaches by acting as if it had a right to envision and enact a different, better future for all from the perspective of disability and disabled people. Because they are right under our nose, taken-for-granted, and essential to every person everywhere, personal names have often eluded the theoretical and analytical scrutiny they deserve. To what extent do naming practices exemplify or parallel the biopolitics of bodily inscriptions and markings such as tattoos, birthmarks, and presumed racial signatures? To what extent do names represent “technologies of the self” in the broadest sense, as both means of domination and empowerment, facilitating collective surveillance and subjugation, and the individual fashioning of (...) identity and subjectivity? Partly drawing upon indigenous contexts in the North American Arctic, this commentary discusses personal names and genealogies in relation to other technologies of belonging. Practices of naming, it is argued, are not only key elements of identification and personhood, embodied in the biosocial habitus much like other biomarkers, also they situate people in genealogies, social networks, and states. Clashes, I suggest, between different traditions and practices of naming, especially in the context of slavery and empires, illuminate with striking clarity the relevance of names as technologies of exclusion, subjugation, and belonging. Generally, the testimony of intoxicated witnesses has been considered relatively unreliable, but recent research has nuanced the knowledge base regarding these vulnerable witnesses.PurposeTo demonstrate the application of recent research findings regarding intoxicated witnesses to the statements made by a key witness to the murder of Olof Palme, Sweden's prime minister, in 1986. An additional purpose was to illustrate the use of a nuanced calculation of blood alcohol concentration for researchers.MethodsThe Palme murder has been debated since the crime was committed and (...) no one has yet been sentenced. One of the witnesses was intoxicated and to estimate a range for his BAC at the time, a comprehensive BAC calculation was conducted in this study to illustrate important factors to consider in these types of cases.ResultsThrough the demonstration of the use of a nuanced BAC formula and by applying recent research results from studies on intoxicated witnesses, it was estimated that the possible BAC of the witness in the Palme-case at the time of the witnessed crime ranged between BAC = 0 to BAC = 0.13, depending on the type of alcoholic beverage consumed and whether the witness was a social or heavy drinker. This puts the witness either well within the span of maintained completeness as well as maintained accuracy rate, or slightly exceeding this span into the BAC-range of reduced completeness but maintained accuracy rate. He was questioned immediately, and thereafter repeatedly, and he reported similar information throughout the interviews, which is in line with previous results on information maintenance over repeated interviews among intoxicated witnesses.ConclusionThe current case example shows how recent research on intoxicated witnesses can be applied in praxis, illustrating important factors for legal practitioners to consider when interpreting information from intoxicated witnesses. It also provides legal practitioners and researchers with an example of a structured approach to more nuanced BAC-calculations. (shrink)

Por una parte analizaremos las características de la magia seiðr y de sus practicantes desde el punto de vista de su importancia en el entramado social y mitológico de la cultura nórdica antigua. Por otra, y mediante el análisis de algunas escenas de la Saga de Gísli Súrsson, intentaremos demostrar que la inclusión de ciertos motivos mágico-religiosos de origen precristiano en las Sagas de islandeses respondía al triple intento de crear un (...) modelo explicativo de la realidad, de servir para elevar el tono trágico del relato y de caracterizar de manera negativa a los que tenían que ver con su uso. Secondly, by means of the analysis of certain scenes in The Saga of Gísli Súrsson, i aim to demonstrate that the inclusion of magic-religious motifs in the Sagas of icelanders has a triple objective: to provide a model to help understand apparently inexplicable phenomena, to intensify the tragic tone of the (...) plot and finally to depict those involved in the performance of seiðr in a very negative light.
