There are several three-valued logical systems that form a scattered landscape, even if all reasonable connectives in three-valued logics can be derived from a few of them. Most papers on this subject neglect the issue of the relevance of such logics in relation with the intended meaning of the third truth-value. Here, we focus on the case where the third truth-value means unknown, as suggested by Kleene. Under such an understanding, we show that any truth-qualified formula in a large range (...) of three-valued logics can be translated into KD as a modal formula of depth 1, with modalities in front of literals only, while preserving all tautologies and inference rules of the original three-valued logic. This simple information logic is a two-tiered classical propositional logic with simple semantics in terms of epistemic states understood as subsets of classical interpretations. We study in particular the translations of Kleene, Gödel, ᴌukasiewicz and Nelson logics. We show that Priest’s logic of paradox, closely connected to Kleene’s, can also be translated into our modal setting, simply by exchanging the modalities possible and necessary. Our work enables the precise expressive power of three-valued logics to be laid bare for the purpose of uncertainty management. (shrink)

Incomplete penetrance and variable expressivity are non‐Mendelian phenomena resulting in the lack of correlation between genotype and phenotype. Not withstanding the diversity in mechanisms, differential expression of homologous alleles within cells manifests as variations in penetrance and expressivity of mutations between individuals of the same genotype. These phenomena are seen most often in dominantly inherited diseases, implying that they are sensitive to concentration of the gene product. In this framework and the advances in understanding the role of microRNA (miRNA) (...) in fine‐tuning gene expression at translational level, we propose miRNA‐mediated regulation as a mechanism for incomplete penetrance and variable expressivity. The presence of miRNA binding sites at 3′ UTR, co‐expression of target gene–miRNA pairs for genes showing incomplete penetrance and variable expressivity derived from available data lend support to our hypothesis. Single nucleotide polymorphisms in the miRNA target site facilitate the implied differential targeting of the transcripts from homologous alleles. (shrink)

In The Medieval Hebrew Translation of Avicenna’s _Kitāb al-Najāt_ presents an analysis and critical edition of the fourteenth-century Hebrew version of a major Arabic philosophical text, focusing on the psychology. It also includes an appendix featuring the section on metaphysics.

In this paper we formulate a version of Second Incompleteness Theorem. The idea is that a sequential sentence has ‘consistency power’ over a theory if it enables us to construct a bounded interpretation of that theory. An interpretation of V in U is bounded if, for some n , all translations of V -sentences are U -provably equivalent to sentences of complexity less than n . We call a sequential sentence with consistency power over T a pro-consistency statement for T (...) . We study pro-consistency statements. We provide an example of a pro-consistency statement for a sequential sentence A that is weaker than an ordinary consistency statement for A . We show that, if A is $${{\sf S}^{1}_{2}}$$ , this sentence has some further appealing properties, specifically that it is an Orey sentence for EA . The basic ideas of the paper essentially involve sequential theories. We have a brief look at the wider environment of the results, to wit the case of theories with pairing. (shrink)

Full proofs of the Gödel incompleteness theorems are highly intricate affairs. Much of the intricacy lies in the details of setting up and checking the properties of a coding system representing the syntax of an object language (typically, that of arithmetic) within that same language. These details are seldom illuminating and tend to obscure the core of the argument. For this reason a number of efforts have been made to present the essentials of the proofs of Gödel’s theorems without getting (...) mired in syntactic or computational details. One of the most important of these efforts was made by Löb [8] in connection with his analysis of sentences asserting their own provability. Löb formulated three conditions (now known as the Hilbert-Bernays-Löb derivability conditions), on the provability predicate in a formal system which are jointly sufficient to yield the Gödel’s second incompleteness theorem for it. A key role in Löb’s analysis is played by (a special case of) what later became known as the diagonalization or fixed point property of formal systems, a property which had already, in essence, been exploited by Gödel in his original proofs of the incompleteness theorems. The fixed point property plays a central role in Lawvere’s [7] category-theoretic account of incompleteness phenomena (see also [10]). Incompleteness theorems have also been subjected to intensive investigation within the framework of modal logic (see, e.g.[4], [5]). In this formulation the modal operator takes up the role previously played by the provability predicate, and the derivability conditions on the latter are translated into algebraic conditions (the so-called GL, i.e., Gödel–Löb, conditions) on the former. My purpose here is to present a framework for incompleteness phenomena, fully compatible with intuitionistic or constructive principles, in which the idea of a coding system is retained, only in a 2 simple, but very general form, a form wholly free of syntactical notions. As codes we shall take the elements of an arbitrary given nonempty set, possibly, but not necessarily, the set of natural numbers.. (shrink)

Kurt Gödel’s Incompleteness theorem is well known in Mathematics/Logic/Philosophy circles. Gödel was able to find a way for any given P (UTM), (read as, “P of UTM” for “Program of Universal Truth Machine”), actually to write down a complicated polynomial that has a solution iff (=if and only if), G is true, where G stands for a Gödel-sentence. So, if G’s truth is a necessary condition for the truth of a given polynomial, then P (UTM) has to answer first that (...) G is true in order to secure the truth of the said polynomial. But, interestingly, P (UTM) could never answer that G was true. This necessarily implies that there is at least one truth a P (UTM), however large it may be, cannot speak out. Daya Krishna and Karl Potter’s controversy regarding the construal of India’s Philosophies dates back to the time of Potter’s publication of “Presuppositions of India’s Philosophies” (1963, Englewood Cliffs Prentice-Hall Inc.) In attacking many of India’s philosophies, Daya Krishna appears to have unwittingly touched a crucial point: how can there be the knowledge of a ‘non-cognitive’ mokṣa? [‘mokṣa’ is the final state of existence of an individual away from Social Contract]—See this author’s Indian Social Contract and its Dissolution (2008) mokṣa does not permit the knowledge of one’s own self in the ordinary way with threefold distinction, i.e., subject–knowledge-object or knower–knowledge–known. But what is important is to demonstrate whether such ‘knowledge’ of non-cognitive mokṣa state can be logically shown, in a language, to be possible to attain, and that there is no contradiction involved in such demonstration, because, no one can possibly express the ‘experience-itself’ in language. Hence, if such ‘knowledge’ can be shown to be logically not impossible in language, then, not only Daya Krishna’s arguments against ‘non-cognitive mokṣa’ get refuted but also it would show the possibility of achieving ‘completeness’ in its truest sense, as opposed to Gödel’s ‘Incompleteness’. In such circumstances, man would himself become a Universal Truth Machine. This is because the final state of mokṣa is construed as the state of complete knowledge in Advaita. This possibility of ‘completeness’ is set in this paper in the backdrop of Śrī Śaṅkarācārya’s Advaitic (Non-dualistic) claim involved in the mahāvākyas (extra-ordinary propositions). (Mahāvākyas that Śaṅkara refers to are basically taken from different Upaniṣads. For example, “Aham Brahmāsmi” is from Bṛhadāraṇyaka Upanisad, and “Tattvamasi” is from Chāndogya Upaniṣad. Śrī Śaṅkarācārya has written extensively. His main works include his Commentary on Brahma-Sūtras, on major Upaniṣads, and on ŚrīmadBhagavadGītā, called Bhāṣyas of them, respectively. Almost all these works are available in English translation published by Advaita Ashrama, 5 Dehi Entally Road, Calcutta, 700014.) On the other hand, the ‘Incompleteness’ of Gödel is due to the intervening G-sentence, which has an adverse self-referential element. Gödel’s incompleteness theorem in its mathematical form with an elaborate introduction by R.W. Braithwaite can be found in Meltzer (Kurt Gödel: on formally undecidable propositions of principia mathematica and related systems. Oliver & Boyd, Edinburgh, 1962). The present author believes first that semantic content cannot be substituted by any amount of arithmoquining, (Arithmoquining or arithmatization means, as Braithwaite says,—“Gödel’s novel metamathematical method is that of attaching numbers to the signs, to the series of signs (formulae) and to the series of series of signs (“proof-schemata”) which occur in his formal system…Gödel invented what might be called co-ordinate metamathematics…”) Meltzer (1962 p. 7). In Antone (2006) it is said “The problem is that he (Gödel) tries to replace an abstract version of the number (which can exist) with the concept of a real number version of that abstract notion. We can state the abstraction of what the number needs to be, [the arithmoquining of a number cannot be a proof-pair and an arithmoquine] but that is a concept that cannot be turned into a specific number, because by definition no such number can exist.”.), especially so where first-hand personal experience is called for. Therefore, what ultimately rules is the semanticity as in a first-hand experience. Similar points are voiced, albeit implicitly, in Antone (Who understands Gödel’s incompleteness theorem, 2006). Reference [12] introduced a novel formula to formula translation tool that enables syntactic metatheoretical investigations of first-order modallogics, bypassing a need to convert them first into Gentzen style logics in order torely on cut elimination and the subformula property. In fact, the formulator tool,as was already demonstrated in loc. cit., is applicable even to the metatheoreticalstudy of logics such as QGL, where cut elimination is unavailable. This paper applies the formulator approach to show the independence of the axiom schema (...) ☐A → ☐∀ A of the logics M3and ML3 of [17, 18, 11, 13]. This leads to the conclusion that the two logics obtained by removing this axiom are incomplete, both with respect to their natural Kripke structures and to arithmetical interpretations. In particular, the so modified ML3 is, similarly to QGL, an arithmetically incomplete first-order extension of GL, but, unlike QGL, all its theorems have cut free proofs. Most lovable Father, I was recently presented with Learned Ig- norance, which consists of three books (each incomplete in itself) and which is written in a sufficiently elegant style. It begins with the words “Admirabitur, et recte, maximum tuum et iam probatissimum ingeni- um” and ends “Eo aeternaliter fruituri qui est in saecula benedictus. Amen.” Having looked over [this work], (...) I feel called upon to write Un- known Learning. Here—by means of [a view] opposed to the points which the aforementioned Learned Ignorance deals with (in my judgment, harmfully) in regard to God, the universe, and Jesus Christ— an entrance opens unto the powers of the Lord so that we may be mindful of His justice.3 Those who lack the knowledge of this justice have disobediently established their own, as the apostle says in Romans 10.4 The promise of eternal life will perhaps lighten the burden of this work which I have undertaken. In a note appended to the translation of “On consistency and completeness” (), Gödel reexamined the problem of the unprovability of consistency. Gödel here focuses on an alternative means of expressing the consistency of a formal system, in terms of what would now be called a ‘reflection principle’, roughly, the assertion that a formula of a certain class is provable in the system only if it is true. Gödel suggests that it is this alternative means of expressing consistency that (...) we should be interested in from a foundational point of view, and he gives a result that shows certain reflection principles to be underivable in extensions of elementary number theory under conditions significantly weaker than the Hilbert-Bernays derivability conditions. In this paper I shall discuss the background to Gödel's result and the foundational significance he claims for it. Along the way, I shall present a new proof of the result which places it in an even more general context than the one considered by Gödel in the 1960s. (shrink)

Complexes of two or more proteins form many, if not most, of the intracellular “machines” that execute physical and chemical work, and transmit information. Complexes can form from stochastic post‐translational interactions of fully formed proteins, but recent attention has shifted to co‐translational interactions in which the most common mechanism involves binding of a mature constituent to an incomplete polypeptide emerging from a translating ribosome. Studies in yeast have revealed co‐translational interactions during formation of multiple major complexes, and together with (...) recent mammalian cell studies, suggest widespread utilization of the mechanism. These translation‐dependent interactions can involve a single or multiple mRNA templates, can be uni‐ or bi‐directional, and can use multi‐protein sub‐complexes as a binding component. Here, we discuss benefits of co‐translational complex assembly including accuracy and efficiency, overcoming hidden interfaces, localized and hierarchical assembly, and reduction of orphan protein degradation, toxicity, and dominant‐negative pathogenesis, all serving to improve cell fitness. Only exceptionally do we find?traces? of (...) this concept in philosophical works. Among them are the works of Aristotle, which need to be freed from modern, distorting interpretations. Thus, in the translations of Aristotle, the Greek???????, used for the traditional transferring the category of possibility, lost its meaning of force ; in its turn,?force? lost relation to?violence? and?necessity?. Violence is understood as a kind of necessity, which is associated with the suppression of one?s?own decision?, freedom, something that?prevents desire? and contrary to?common thinking,? as well as the absence of?good?. The article argues for the possibility of translation manuals having an implicit internal structure. This structure is composed of specific methodological assumptions and techniques. Using the (N)-type and (G)-type distinction developed by Fuller for the study of scientific behavior, it is shown that these are incomplete characterizations of translation manuals. A more complete characterization must involve an analysis of how the presence or absence of methodological rules influences the interpretation of specific research questions. It is further argued (...) that while Quine's original indeterminacy thesis cannot be completely rejected, in some cases it can be modified to reflect the importance of the methodological constraints. Finally, it is suggested that the more critical analysis of translation manuals will benefit the on-going debates in the study of scientific behavior. (shrink)

The iltifāt (reference switching) is one of the arts of high literary value, widely practiced in the Qurʾān. This art takes place in the form of switching to another person, verb mode, number, preposition or sentence type contrary to the necessity of the situation, while continuing the word as a certain person, verb mode, number, preposition or sentence type. The art of iltifāt adds certain meanings to words such as certainty, continuity and movement. It keeps the curiosity, desire, excitement and (...) shiver alive. Similar to those who read the Qurʾān, those who read the translation of the Qurʾān are expected to be able to notice these meanings as much as possible and feel the literary pleasure of this art. There are important structural differences between Arabic and Turkish. In addition, the text that needs to be translated into Turkish is Holy Qurʾān, which has a divine infinite dimension, and it is a limited human mind attempts to translate it. This situation requires an advanced level of caution and diligence in transferring the art of iltifāt to the translations of Qurʾān. The issue of the art of iltifāt and the transfer of this art to the translations of the Qurʾān has also been studied in scientific research in different world languages such as Arabic, English and Indonesian. As far as we can determine, the only study in Turkish that examines the reflection of the iltifāt in the Qurʾān is the article titled "The Translation Problem of the Art of iltifāt in the Translation of the Qurʾān" by Haşim Özdaş. In the mentioned article, five different Qurʾān translations of eight verses from different types of the art of iltifāt were examined. It has been claimed that there is no art of iltifāt in Turkish language and literature, and that the translation of the art of iltifāt in the verses into Turkish is an obstacle to understanding the verses and leads to a wrong or incomplete understanding. As a solution, while the verses are being given and translated, it is suggested that the art of iltifāt in the verses be ignored. In this research article, the cases of the translations of the Qurʾān reflecting the art of iltifāt, as an example of iltifāt between māzī (past tense) and muzāriʻ (present tense) verbs modes in the verses are discussed. In addition, it discusses the opinions that say there is no art of iltifāt in the Turkish language, that the exact transfer of the art of iltifāt found in the Qurʾān to the translations of the Qurʾān causes wrong or incomplete understanding, therefore, the art of iltifāt should be ignored when the verses are being translated. As a result, the present study argues that the art of iltifāt is also a subject of Turkish rhetoric, which should be reflected in the translations of the Qurʾān as much as possible, and the transfer of the art of iltifāt in the translations of the Qurʾān does not constitute an obstacle to understanding the verses, on the contrary, the reference to this art in the verses will contribute to the realization of the divine purpose and wisdom. The data sources of the research were created from 6 verses and their 22 different translations, using various sampling methods. The data collected from these were analysed using the comparative text analysis method on the basis of the inductive approach. Qualitative data was converted into quantitative data, processed in the SPSS application, and the findings were presented as numerical figures in tables. At the end of the research, it was determined that iltifāt between māzī and muzāriʻ verbs modes studied in the science of rhetoric was also a subject of grammar as the phenomenon of time shifts in verbs. It was seen that the art of iltifāt was applied in an average of 800 places in the Qurʾān, and the iltifāt between māzī and muzāriʻ verbs modes accounted for 6.9% (55 pieces) of this amount. Most of these fifty-five iltifāts were iltifāt from the māzī verb mode to the muzāriʻ verb mode (63.6%), while the amount of iltifāt the muzāriʻ verb mode to the māzī verb mode was less (36.4%). In the analysed translations of the Qurʾān, it was determined that the iltifāt between māzī and muzāriʻ verbs modes was not reflected at a rate of 90.9%, and the art of iltifāt was completely abandoned in 14 of the 22 translations. It was concluded that the reason why the art of iltifāt in the verses was not reflected in the translations of the Qurʾān was the belief that this art was not found in Turkish and that the transfer of this art leads to wrong and incomplete understanding. In the research, it was proposed to increase the number of scientific studies in which various translation strategies and techniques were tested in the transfer of the art of iltifāt in the verses in the translations of the Qurʾān. In this respect, this research article is expected to pave the way for more research on the issue of transferring the arts used in the Qurʾān and to be useful for future translations of the Qurʾān. Bacteria use trans‐translation to rescue stalled ribosomes and target incomplete proteins for proteolysis. Despite similarities between tRNAs and transfer‐messenger RNA (tmRNA), the key molecule for trans‐translation, new structural and biochemical data show important differences between translation and trans‐translation at most steps of the pathways. tmRNA and its binding partner, SmpB, bind in the A site of the ribosome but do not trigger the same movements of nucleotides in the rRNA that are required for codon recognition (...) by tRNA. tmRNA‐SmpB moves from the A site to the P site of the ribosome without subunit rotation to generate hybrid states, and moves from the P site to a site outside the ribosome instead of to the E site. During catalysis, transpeptidation to tmRNA appears to require the ribosomal protein bL27, which is dispensable for translation, suggesting that this protein may be conserved in bacteria due to trans‐translation. These differences provide insights into the fundamental nature of trans‐translation, and provide targets for new antibiotics that may have decrease cross‐reactivity with eukaryotic ribosomes. In 1993, an astonishing discovery was made at a tomb in Guodian in Hubei province (east central China). Written on strips of bamboo that have miraculously survived intact since 300 B.C., the "Guodian Laozi," is by far the earliest version of the _Tao Te Ching_ ever unearthed. Students of ancient Chinese civilization proclaimed the text a decisive breakthrough in the understanding of this famous text: it provides the most conclusive evidence to date that the text was the work of multiple (...) authors and editors over hundreds of years, rather than the achievement of a single individual writing during the time of Confucius. Robert Henricks now presents the first English translation of the "bamboo slip Laozi." Differing substantially from other versions we have of the text, the Guodian Laozi provides us with clues on how and when the text came into being. As Henricks's translation shows, many chapters are missing in this form of the text, and some chapters remain incomplete. All of this seems to suggest that the _Tao Te Ching_ was not yet "complete" when these slips were copied. In his translation, Henricks focuses attention on lines in each of the chapters that vary from readings in other editions. In addition, he shows how the sequence of chapters in this form of the text is totally unrelated to the sequence readers commonly see in the "standard" form of the text, i.e., in other translations. Here are just a few of the noteworthy features of this new _Tao Te Ching:_ • A lucid introduction to the Guodian Laozi, offering background on the archaeological interpretation of the discovery • Line-by-line comparisons of the Guodian Laozi against the Mawangdui and Wang Bi editions • Extensive notes on each chapter describing the unique elements of the Guodian Laozi in comparison with other versions • Transcriptions for each chapter, noting both the ancient and modern form of the characters in the chapter • An appendix featuring the official biography of Laozi written by Sima Qian, the Grand Historian of China, as well as Henricks's commentary and notes on this biography This groundbreaking work will lead to a reassessment of the history and significance of this well-known and critical work as well as a reevaluation of the role it played in the development of Taoism in early China. Students of ancient Chinese civilization proclaimed the text a decisive breakthrough in the understanding of this famous text: it provides the most conclusive evidence to date that the text was the work of multiple authors and editors (...) over hundreds of years, rather than the achievement of a single individual writing during the time of Confucius. Robert Henricks now presents the first English translation of the "bamboo slip Laozi." Differing substantially from other versions we have of the text, the Guodian Laozi provides us with clues on how and when the text came into being. As Henricks's translation shows, many chapters are missing in this form of the text, and some chapters remain incomplete. All of this seems to suggest that the _Tao Te Ching_ was not yet "complete" when these slips were copied. In his translation, Henricks focuses attention on lines in each of the chapters that vary from readings in other editions. In addition, he shows how the sequence of chapters in this form of the text is totally unrelated to the sequence readers commonly see in the "standard" form of the text, i.e., in other translations. Here are just a few of the noteworthy features of this new _Tao Te Ching:_ • A lucid introduction to the Guodian Laozi, offering background on the archaeological interpretation of the discovery • Line-by-line comparisons of the Guodian Laozi against the Mawangdui and Wang Bi editions • Extensive notes on each chapter describing the unique elements of the Guodian Laozi in comparison with other versions • Transcriptions for each chapter, noting both the ancient and modern form of the characters in the chapter • An appendix featuring the official biography of Laozi written by Sima Qian, the Grand Historian of China, as well as Henricks's commentary and notes on this biography This groundbreaking work will lead to a reassessment of the history and significance of this well-known and critical work as well as a reevaluation of the role it played in the development of Taoism in early China. This book aims to bring together all the evidence relevant for understanding Plato's Atlantis Story, providing the Greek text of the relevant Platonic texts (the start of Plato's Timaeus and the incomplete Critias), together with a commentary on language and content, and a full vocabulary of Greek words. This essential work also offers a new translation of these texts and a full introduction. The book has two special objectives. The introduction offers a full-scale interpretative reading of the Atlantis (...) story, focused on the philosophical meaning of the story and the significance of Plato's presentation, and responding to recent scholarly discussion of these questions. In conjunction with the new translation, this introduction provides a point of entry to a fascinating story for a wide range of readers. The introduction also discusses the question whether the story had a factual basis, and assesses possible links with Minoan Crete. Secondly, the Greek text (the Oxford Classical text) and commentary are juxtaposed and presented in "bite-size" chunks making it easy to use and helpful especially for students using the book to improve their Greek. The notes provide full grammatical and linguistic help as well as pointers on the philosophical content and presentation, supported by the translation and complete vocabulary of Greek terms. Elements of Ethics examines Meinong's value theory from an epistemological standpoint and gives a critical exposition of Meinong's first attempts at a deontic logic; special consideration is given to the Law of Omission. For that purpose his theory of the a priori is examined, which is entwined with his theory of objects. The book begins with an epistemological and ontological consideration and simplification of Meinong's universe. In consequence of the mathematical development of his time, especially non-Euclidean geometries, Meinong developed the (...) notion of precision objects and precision concepts. They are discussed along with the so-called `incomplete objects' and problems associated with them. These discussions are relevant for understanding various technical terms, particularly concepts of values and valuations. These discussions also assist in assessing the possibility of knowing these concepts a priori, and in understanding the logical relationships between them and actual valuations. We find in Meinong's ethical writings a mixture of experiential and a priori knowledge. A translation is included of the fragment Ethische Bausteine (Elements of Ethics), together with Meinong's own notes and those of the editors of the text. Vocabulary and Index are attached. (shrink)

There's Something about Gödel is a bargain: two books in one. The first half is a gentle but rigorous introduction to the incompleteness theorems for the mathematically uninitiated. The second is a survey of the philosophical, psychological, and sociological consequences people have attempted to derive from the theorems, some of them quite fantastical.The first part, which stays close to Gödel's original proofs, strikes a nice balance, giving enough details that the reader understands what is going on in the proofs, without (...) giving so many that the reader feels overburdened. Perhaps he skimps too much on details, as when he decides not to explain how to convert recursive definitions into explicit ones. Also, I wish he had talked about Löb's theorem. But these are small complaints.The second half discusses a sampling of what one reads about Gödel's theorems in philosophy journals and in the popular press, and here Berto often finds himself exasperated, especially by …. In the eleventh of his Antiquarian Letters, Gotthold Ephraim Lessing discusses a phrase from Lucian's description of the painting by Zeuxis called A Family of Centaurs: ‘at the top of the painting a centaur is leaning down as if from an observation point, smiling’. ‘This as if from an observation point, Lessing notes, obviously implies that Lucian himself was uncertain whether this figure was positioned further back, or was at the same time on higher ground. We need to recognize the (...) logic of ancient bas-reliefs where figures further to the back look over those at the front, not because they are actually positioned above them but because they are meant to appear as if standing behind.'1 · 1. Alexius Meinong is best known for his theory of intended objects. At once an adjunct to a Brentanian phenomenological psychology, Meinong’s Gegenstandstheorie is also a system of metaphysics, an ontology and extraontology, and a philosophical semantics offered from the standpoint of an intentionalist philosophy of language. By requiring that every thought intend an existent, subsistent, or beingless object, Meinong infamously opens his extraontology to incomplete and impossible objects like the golden mountain and round square. Yet Meinong’s value theory or (...) Werttheorie, built upon his object theory, is a vitally if not equally important part of his philosophy. (shrink)

In 1813 Isaak von Sinclair published a poem entitled “The New Acquaintance.” It recounts a meeting between himself, his friend Friedrich Hölderlin, and one other unidentified guest whom Sinclair awaited with keen anticipation. Because of Hölderlin’s well established friendship with Hegel it has been assumed in the past that the unknown acquaintance was in fact Hegel. However, at the time to which the poem refers, Hegel was a relatively obscure and unknown figure with no reputation. If we are therefore to (...) accept that the poem does indeed allude to Hegel then we must assume that Sinclair, as early as 1813, had recognized Hegel’s genius and wanted retrospectively to associate his name with the newly rising star of German philosophy. In that case we must ask why he refrained from mentioning Hegel by name or at least making the character of the unknown unambiguously clear? In translating this poem for the first time into English I offer for consideration another candidate as the “acquaintance,” namely, Wilhelm Heinse. (shrink)

The basic problem affecting humanitarian law today remains that of its implementation. As of now, requests made by individuals before national courts to assess the compatibility of certain acts with international humanitarian law failed. The present case study and commentaries focus on the decision of a German civil court sitting Bonn to deny the victims of a NATO air raid the right to sue Germany and claim compensation for alleged violations of international humanitarian law.
