This paper argues that professionals who make boundary-related decisions should be guided by relationship-based practice. In our roles as service users and professionals, drawing from our lived experiences of professional relationships, we argue we need to move away from distance-based practice. This includes understanding the boundary stories and narratives that exist for all of us – including the people we support, other professionals, as well as the organisations and systems within which we work. When we are (...) dealing with professional boundary issues, we should centre relationship-building skills that are central to many other aspects of our work. Skills that foster relationships at all levels – between professionals, service users, and services – need to be revalued. Our final recommendation is to create, develop, and foster safer spaces within and outside of organisations, as well as inter-professionally, for the discussion and exploration of boundary-related issues and practice. We are interested in hearing from those with experiences of being marginalised by boundaries so that they can inform a reshaping of our collective ideas around boundary related practices. To foster relationship-based practices in organisations, we have outlined several recommendations here; however, we recognize that these do not go far enough, and that collective action is needed to inform systemic change. This article begins with a brief survey of Kant’s pre-Critical and Critical approaches to theodicy. I maintain that his theodical response of moral faith during the Critical period appears to be a dispassionate version of what Leibniz called Fatum Christianum. Moral rationality establishes the existence and goodness of God and translates into an endless and unwavering commitment to following the moral law. I then argue that Religion within the Boundaries of Mere Reason offers a revision of Kant’s 1791 conception of (...) “authentic theodicy.” Kant comes to recognize that the ends of morality and virtue, as well as the action needed to respond to the noumenal evil at the heart of humanity, outstrip the “religion of good life conduct.” This leads Kant to argue in favor of a new form of moral life embedded in a religious community and based on the love of God and of one’s fellow humans. Such a life is rooted in the incorporation of a holy principle in our noumenal selves that he terms “divine blessedness.”. (shrink)

In biomedicine, practitioners often treat risk of disease as an illness in itself—suitable for monitoring and intervention. In some cases, increased diagnostics improve health outcomes by detecting problems early. Recently, however, science and technology studies scholars and medical practitioners have noted that the treatment of risk can also lead to unnecessary intervention and possible harm. Despite these findings, it is often hard to see changes in practice. Childbirth serves as an illuminating case because two models of health risk operate simultaneously—in (...) addition to the model valuing frequent intervention, there is another that seeks to mitigate risk by refusing medical surveillance. Based on interviews with birth providers and an analysis of professional documents, this article uses the case of fetal heart rate monitoring in American childbirth to demonstrate how some health providers are framing “intentional non-knowing” as a moral imperative to reduce medical risk. Studying the success and limitations of this “risk counterculture” illuminates how risk societies are changing in response to data suggesting that more information can have hurtful effects. This case integrates well-developed theories of knowledge production with less-developed theories of knowledge nonproduction, leading to a more fruitful discussion of the boundaries of responsible knowledge in risk management. The standard account of Kantian moral weakness fails to provide a psychologically realistic account of moral improvement. It assumes that moral strength is simply a matter of volitional resolve and weakness is a lack of resolve. This leaves the path to moral improvement unclear. In this paper, I reconstruct an alternative character-based account of Kantian moral weakness and strength. On this account, moral strength is the possession of sympathy and self-knowledge, key practical-epistemic virtues from Kant’s Doctrine of Virtue, and (...) moral weakness is a lack of these virtues. This identifies moral strength with a high degree of development, integrity, or fitness in one’s character, and not merely an ability to somehow try harder. Growing evidence suggests that natural environments – whether in outdoor or indoor settings – foster psychological health and physiological relaxation, indicated by increased wellbeing, reduced stress levels, and increased parasympathetic activity. Greater insight into differential psychological aspects modulating psychophysiological responses to nature-based relaxation videos could help understand modes of action and develop personalized relaxation interventions. We investigated heart rate variability as an indicator of autonomic regulation, specifically parasympathetic activity, in response to a 10-min video intervention in two consecutive (...) studies as well as heart rate. We hypothesized that a nature-based relaxation video elicits HRV increase and HR decrease, with response magnitude being affected by aspects of early life adversity and trait mindfulness. In Study 1, N = 60 participants watched a relaxation video intervention depicting different natural scenery. We analyzed changes in HR and respiratory sinus arrhythmia as a standard HRV measure, both based on 3-min segments from the experimental session, in multiple growth curve models. We found a decrease in HR and increase of RSA during the video intervention. Higher paternal care and lower trait mindfulness observing skills were associated with higher RSA values before but not during video exposure. In Study 2, N = 90 participants were assigned to three video conditions: natural scenery from Study 1, meditation video, or short clip from “The Lord of the Rings.” Again, HR decreased, and RSA increased during video segments, yet without expected group differences across different video types. We found higher parental care and lower parental overprotection to predict higher RSA at different times during the experiment. Interestingly, lower paternal overprotection predicted overall higher RSA. These results suggest a generic relaxation effect of video interventions on autonomic regulation that we discuss in light of different theories mapping restorative effects of natural environments. Further, psychological characteristics like aspects of early life adversity and trait mindfulness could contribute to individual differences in autonomic regulation. This study contributes to a better understanding of autonomic and psychological responses to relaxation videos. (shrink)

Pitting i-frame policies against s-frame policies inadvertently propagates a false dichotomy that fails to distinguish between effective i-frame policies that directly change behaviors and ineffective education-based i-frame policies that try to change people's hearts and minds. Engineering programs in the United States have been experimenting with diverse pedagogical approaches to educate future professional engineers. However, a crucial dimension of ethics education that focuses on the values, personal commitments, and meaning of engineers has been missing in many of these pedagogical approaches. We argue that a value-based approach to professional ethics education is critically needed in engineering education, because such an approach is indispensable for cultivating self-reflective and socially engaged engineers. This paper starts by briefly comparing (...) two prevalent approaches to ethics education in science and engineering: professional and philosophical. While we acknowledge that both approaches help meet certain ethics education objectives, we also argue that neither of these is sufficient to personally engage students in authentic moral learning. We make the case that it is important to connect ethics education to the heart, which is extensively driven by values, and present a value-based approach to professional ethics education. We provide some classroom practices that cultivate a safe, diverse, and engaging learning environment. Finally, we discuss the implications of a value-based approach to professional ethics education for curriculum design and pedagogical practice, including opportunities and challenges for engineering faculty eager to incorporate value-based inquiry into their classrooms. In evidence-based medicine (EBM), methodology has become the central means of determining the quality of the evidence base. The “gold standard” method, the randomised, controlled trial (RCT), imbues medical research with an ethos of disinterestedness; yet, as this essay argues, the RCT is itself a rhetorically interested construct essential to medical-professional boundary work. Using the example of debates about methodology in EBM-oriented research on complementary and alternative medicine (CAM), practices not easily tested by RCTs, I frame the problem (...) of method as a fundamentally rhetorical problem, situated within a boundary drama, and deeply rooted in the discursive practices of science and medicine. The genre of the RCT report, for example, idealises the research process and can tilt the course of arguments about CAM, while the notion of efficacy can function as a rhetorically mobile boundary object that can redefine the very terms of debate. I suggest herein that arguments about method in CAM debates can productively be read, metonymically, as expressions of more general anxieties in medicine about knowledge and evidence, community values, and professional boundaries; as such, these debates can illuminate some of the rhetorical dimensions of EBM. ABSTRACTSome political ads used in the 2016 U.S. election evoked feelings colloquially known as being moved to tears. We conceptualise this phenomenon as a positive social emotion that appraises and motivates communal relations, is accompanied by physical sensations, and often labelled metaphorically. We surveyed U.S. voters in the fortnight before the 2016 U.S. election. Selected ads evoked the emotion completely and reliably, but in a partisan fashion: Clinton voters were moved to tears by three selected Clinton ads, and Trump voters (...) were moved to tears by two Trump ads. Viewers were much less moved by ads of the candidate they did not support. Being moved to tears predicted intention to vote for the candidate depicted. We conclude that some contemporary political advertising is able to move its audience to tears, and thereby motivates support. (shrink)

To understand the mechanism of boundary personnel opportunistic behaviors in collaborative R&D projects to reduce the risk of companies suffering from opportunism in collaboration. This study is conducted based on the context of collaborative R&D in the equipment manufacturing industry in Northeast China. This research mainly explored the mechanism of boundary personnel opportunistic intentions. Drawing on the theory of reasoned action, this study investigated the relationship between boundary personnel Guanxi, organizational loyalty, opportunistic attitudes, subjective norms, and (...) intentions. In addition, this research examined the moderating role of the degree of dependence on the collaborator. In total, 524 valid questionnaires were finally collected. The data analysis results suggested that Guanxi inhibits opportunistic attitudes and subjective norms. Organizational loyalty promotes opportunistic attitudes and subjective norms. Opportunistic attitudes and subjective norms positively predict intentions. Opportunistic attitudes mediate between organizational loyalty and opportunistic intentions. Opportunistic subjective norms mediate between Guanxi and opportunistic intentions. Opportunistic subjective norms also mediate between organizational loyalty and opportunistic intentions. Dependence on the collaborator positively moderates the relationship between opportunistic attitudes and intentions. Therefore, it can be argued that in collaborative R&D in the equipment manufacturing industry, the corporate could stimulate boundary personnel to build good Guanxi to eliminate opportunism. At the same time, companies should lead employees to show loyalty properly, which opportunism is not wise in collaborative R&D. Finally, enterprises should objectively understand and evaluate the dependence relationship between the two partners in collaborative R&D to adopt the right strategy. (shrink)

Aiming at the problem of low accuracy of edge detection of the film and television lens, a new SIFT feature-based camera detection algorithm was proposed. Firstly, multiple frames of images are read in time sequence and converted into grayscale images. The frame image is further divided into blocks, and the average gradient of each block is calculated to construct the film dynamic texture. The correlation of the dynamic texture of adjacent frames and the matching degree of SIFT features of (...) two frames were compared, and the predetection results were obtained according to the matching results. Next, compared with the next frame of the dynamic texture and SIFT feature whose step size is lower than the human eye refresh frequency, the final result is obtained. Through experiments on multiple groups of different types of film and television data, high recall rate and accuracy rate can be obtained. The algorithm in this paper can detect the gradual change lens with the complex structure and obtain high detection accuracy and recall rate. A lens boundary detection algorithm based on fuzzy clustering is realized. The algorithm can detect sudden changes/gradual changes of the lens at the same time without setting a threshold. It can effectively reduce the factors that affect lens detection, such as flash, movies, TV, and advertisements, and can reduce the influence of camera movement on the boundaries of movies and TVs. However, due to the complexity of film and television, there are still some missing and false detections in this algorithm, which need further study. (shrink)

Ensuring judicious privacy transfer is imperative for the application of BCI technology and pivotal for fostering economic and technological progress. This study adopts privacy transfer as the research perspective and employs an ethical matrix as the research method. It establishes BCI users as the central core interests, with marketers, developers, and medical personnel as stakeholders. Departing from the binary opposition of public and private in traditional privacy (...) theory, this article proposes ethical principles such as maximizing benefits, minimizing harm, and respecting independent decision-making power. It constructs a judgment matrix for the privacy transfer of BCIs, utilizing this matrix to identify ethical risks like privacy disclosure and hijacking. This study analyzes the reasons for risks, aiming to overcome dilemmas and construct an ethical matrix to explore privacy transfer boundary division methods suitable for BCI technology and tailored to different stakeholders. This book fills a critical niche that has long been overlooked. It specifically focuses on somatic practices to decrease stress and improve heart health. It will combine science, time-tested somatic mindfulness techniques, and patient stories to provide hope and help.

The status of risk factors and disease remains a disputed question in the theory and practice of medicine and healthcare, and so does the related question of delineating disease boundaries. I present a framework based on Bernard Lonergan’s account of emergent probability for differentiating (1) generically distinct levels of systematic function within organisms and between organisms and their environments and (2) the methods of functional, genetic, and statistical investigation. I then argue on this basis that it is possible to (...) understand disease in terms of biological or higher intra-level dysfunction, risk factors—including genetic risk factors—in terms of statistical inter-level conditioning of a given stage or developmental sequence of systematic functioning, and the empirical boundaries of disease in terms of the limits of both functional categorization (from an epistemic standpoint) and upper-level integration of lower-level processes and events (from an ontological standpoint). In this paper, we investigate the trust-based mechanisms underlying the relationship between ethical leadership and followers’ organisational citizenship behaviours (OCBs). Based on three-wave survey data obtained from 184 employees and their supervisors, we find that ethical leadership leads to higher levels of both affective and cognitive trust. In addition, we find support for a three-path mediational model, where cognitive trust and affective trust, in turn, mediate the relationship between ethical leadership and follower OCBs. That is to say, we (...) found that ethical leadership leads to the development of cognitive trust, which subsequently influences the development of affective trust. Affective trust, in turn, induces followers to exhibit OCBs as a means of reciprocating the leader’s favourable behaviour. Our findings suggest that both affective and cognitive trust plays an important role in the social exchange processes that underlie the relationship between ethical leadership and the discretionary behaviour of followers. Engineering sketches and drawings are the building blocks of technological design and production. These visual representations act as the means for organizing the design to production process, hence serving as a "social glue" both between individuals and between groups. The author discusses two main capacities such visual representations serve in facilitating distributed cognition in team design work As conscription devices, they enlist and organize group participation. As boundary objects, they facilitate the reading of alternative meanings by various groups involved (...) in the design process. The introduction of computer-aided design into this visual culture of engineering restructures relationships between workers in ways that can hamper the flexibility necessary for these crucial capacities to take place. Heron Heart is a poem born out of reflecting on the nature of existence during long stretches of isolation, where the boundary of what is and is not a living being was challenged—the nonhuman more alive than the human. It evokes the absurdity of the banal out of the confusion and beauty of sensory experience, with hints of nostalgia for a mythological world that never existed but is ever-present.

The boundary work approach has been established as one of the main ways to study controversies in science. However, it has been proposed that it does not meet the power dynamics of the scientific field sufficiently. This article concentrates on the intertwining of boundary work and power. It combines the boundary work approach developed by Thomas Gieryn and the analysis of power in the work of Pierre Bourdieu. Based on a literature review and an analysis of (...) a controversy over therapeutic touch, it finds four forms of boundary work: intradisciplinary, interdisciplinary, between science and society, and between science and other knowledge systems. The article shows how the different forms of boundary work reveal multiple power struggles, hierarchisations and tensions. The controversy appeared in Finnish nursing science when the Finnish Association of Sceptics gave its annual Humbug Award to a book on therapeutic touch. The book was based on a master’s thesis at the University of Tampere department of nursing science. The nursing scholars in the department reacted abruptly and banned certain books, which astonished the students, and a lively public debate followed. In the debate, nursing science was both defended and challenged. The framework of the study shows that the boundary work approach can be used to study different aspects of power. The article proposes that the framework could be used in other controversies as well to study the layers of power in boundary work. (shrink)

In _The Boundaries of Babel_, Andrea Moro tells the story of an encounter between two cultures: contemporary theoretical linguistics and the cognitive neurosciences. The study of language within a biological context has been ongoing for more than fifty years. The development of neuroimaging technology offers new opportunities to enrich the "biolinguistic perspective" and extend it beyond an abstract framework for inquiry. As a leading theoretical linguist in the generative tradition and also a cognitive scientist schooled in the new imaging technology, (...) Moro is uniquely equipped to explore this. Moro examines what he calls the "hidden" revolution in contemporary science: the discovery that the number of possible grammars is not infinite and that their number is biologically limited. This radical but little-discussed change in the way we look at language, he claims, will require us to rethink not just the fundamentals of linguistics and neurosciences but also our view of the human mind. Moro searches for neurobiological correlates of "the boundaries of Babel" -- the constraints on the apparent chaotic variation in human languages -- by using an original experimental design based on artificial languages. He offers a critical overview of some of the fundamental results from linguistics over the last fifty years, in particular regarding syntax, then uses these essential aspects of language to examine two neuroimaging experiments in which he took part. He describes the two neuroimaging techniques used, but makes it clear that techniques and machines do not provide interesting data without a sound theoretical framework. Finally, he discusses some speculative aspects of modern research in biolinguistics regarding the impact of the linear structure of linguistics expression on grammar, and more generally, some core aspects of language acquisition, genetics, and evolution. Modern states claim rights of jurisdiction and control over particular geographical areas and their associated natural resources. Boundaries of Authority explores the possible moral bases for such territorial claims by states, in the process arguing that many of these territorial claims in fact lack any moral justification. The book maintains throughout that the requirement of states' justified authority over persons has normative priority over, and as a result severely restricts, the kinds of territorial rights that states can justifiably claim, and (...) it argues that the mere effective administration of justice within a geographical area is insufficient to ground moral authority over residents of that area. The book argues that only a theory of territorial rights that takes seriously the morality of the actual history of states' acquisitions of power over land and the land's residents can adequately explain the nature and extent of states' moral rights over particular territories. One of the most distinctive features of the tradition of philosophy on this continent has been the insistence that lived experience is the ultimate source of knowledge, (...) and, more importantly, amelioration of individual and collective community experience is the ultimate criterion for validation of knowledge relations. Dr. Ira Harkavy and the Netter Center at which he works represent a version of that ideal made institutionally manifest.In his 2022 Coss Lecture, Harkavy offers a vision for how the ideal of knowledge generation grounded in community experience and serving community priorities could be institutionalized in major US research universities. Furthermore, he makes the case that this transformation of research universities would revitalize our collective commitment to democratic citizenship and governance. It is an appealing vision, earnestly offered. In what follows, I celebrate the merits of this vision but raise concerns that it does not adequately consider questions about the ontology of experience. I review some of those questions and offer suggestions about what an updated ontology of experience, one that could revitalize democracy in the manner Harkavy says is needed, would look like.Experiential Basis for My ResponseA short personal introduction will provide context for (and perhaps lend credibility to) my response comments. I am a Professor of Education at the University of Oregon with affiliate appointments in the Department of Philosophy and in the Department of Ethnic Studies. My empirical research [End Page 81] focuses on how we prepare anti-racist educators to work in public schools (Pratt and Rosiek; Rosiek, “School Segregation”; Mitchell and Rosiek; Sconiers and Rosiek). My area of theoretical specialization is the development of new qualitative methodologies for research on educational equity. The latter involves working out the implications of different epistemologies and ontologies for educational inquiry and practice. Specifically, I have spent most of my career looking at the way teachers’ classroom experiences can be a valid source of general knowledge about educational practice and policy (Rosiek and Atkinson; Rosiek and Gleason).Both branches of my scholarship exist in a dialectic with my community activism around educational equity issues. My largest project to date was a ten-year study of the racial resegregation of a public school district, looking at how students and teachers navigated its aftermath (Rosiek and Kinslow). My most recent project involved two years of working with teachers all over the world to identify the ways they addressed equity challenges during the pandemic and to identify the institutional conditions that helped or hindered such work (DeRosia et al.). In a less academic context, I have worked with local educational activist organizations in my home community to support the needs of immigrant families and students, to create safer spaces for LGBTQIA students, and to get more equity-minded school board members elected.I share all of this just to clarify that I am familiar with the challenge of putting university expertise in the service of community improvement and, more specifically, promoting equity in educational institutions. In “On Drawing Lines on a Map” (1995), I suggested that the different ways we have of drawing lines on maps open up a new perspective on ontology, resting on a distinction between two sorts of boundaries: fiat and bona fide. “Fiat” means, roughly: human-demarcation-induced. “Bona fide” means, again roughly: a boundary constituted by some real physical discontinuity. I presented a general typology of boundaries based on this opposition and showed how it generates a corresponding typology of the (...) different sorts of objects which boundaries determine or demarcate. In this paper, I describe how the theory of fiat boundaries has evolved since 1995, how it has been applied in areas such as property law and political geography, and how it is being used in contemporary work in formal and applied ontology, especially within the framework of Basic Formal Ontology. To address substandard working conditions in global value chains, companies have adopted private regulatory systems governing worker rights. Scholars agree that without onsite factory audits, this private regulation has limited impact at the point of production. Companies, however, audit only a subset of their suppliers, severely restricting their private regulatory attempts. Despite the significance of the placement of suppliers inside or outside firms’ “responsibility boundaries” and despite scholars’ having called for more research into how firms prioritize what suppliers to audit, (...) few, if any, systematic studies have examined the topic. This is problematic, as the placement of firms’ responsibility boundaries determines what suppliers and workers are included in firms’ private regulatory attempts. Based on a study of 12 Swedish firms and the theory of moral disengagement, this paper starts to fill this research gap by exploring how firms’ responsibility boundaries are placed. The paper illustrates how firms’ responsibility boundary placement is best described as a patchwork with firms defining and delimiting their responsibilities differently. The paper also demonstrates that three supplier types are particularly likely to be placed inside firms’ responsibility boundaries, while a fourth type is likely be placed outside. (shrink)

Heart disease is the deadliest disease and one of leading causes of death worldwide. Machine learning is playing an essential role in the medical side. In this paper, ensemble learning methods are used to enhance the performance of predicting heart disease. Two features of extraction methods: linear discriminant analysis and principal component analysis, are used to select essential features from the dataset. The comparison between machine learning algorithms and ensemble learning methods is applied to selected features. The different (...) methods are used to evaluate models: accuracy, recall, precision, F-measure, and ROC.The results show the bagging ensemble learning method with decision tree has achieved the best performance. The capacitive voltage transformer is a special measuring and protecting device, which is commonly applied in high-voltage power systems. Its measurement accuracy is affected seriously by the stray capacitances of the capacitance voltage divider to ground and other charged parts. In this study, based on the boundary element method, a mathematical model was established firstly to calculate the stray capacitance. Then, the voltage distribution of the CVD was obtained by the CVD’s equivalent circuit model. Next, the effect of (...) stray capacitance on the voltage distribution and the voltage difference ratio of CVD was analysed in detail. We finally designed three types of shield and optimized their structure parameters to reduce VDR. The results indicated that the average deviation rate between calculated and experimental measured voltages is only 0.015%; that is to say, the method has high calculation precision. The stray capacitance of the CVD to ground is far larger than that of the CVD to the high-voltage terminal. It results in the inhomogeneous distribution of voltage and the increase of VDR. For the test CVT, its VDR exceeds the requirement of class 0.2. Among all of the three types of shield, the C type reduced the VDR of the test CVT the most. After optimizing the structure parameters of C-type shield, the VDR is further reduced to 0.08%. It is not only in accord with the requirement of class 0.2 but also has an adequate margin. (shrink)

This study constructs a mechanism of the influence of Guanxi between boundary spanners on opportunistic behaviors in collaborative innovation projects based on the theory of reasoned action model. The study conducts a survey in the automobile industry in Changchun, Jilin Province, China, and analyzes the research data using the structural equation model. The findings show that Guanxi has a negative an significant influence on opportunistic behavior attitudes and subjective norms., Guanxi has the greater influence on subjective norms than (...) attitudes. Then, opportunistic behavior attitudes and subjective norms positively influence intentions. The influence of subjective norms is stronger. The attitudes and subjective norms of opportunistic behaviors also play mediation roles. Furthermore, opportunistic behavior intentions have a positive and significant influence on behaviors. In short, the study’s findings reveal a mechanism of Guanxi between boundary spanners influencing opportunistic behaviors of boundary spanners. It also provides a reference for corporate managers to govern opportunistic behaviors of collaborator while inhabiting opportunistic behaviors of their own boundary spanners. (shrink)

In _The Boundaries of Babel_, Andrea Moro tells the story of an encounter between two cultures: contemporary theoretical linguistics and the cognitive neurosciences. The study of language within a biological context has been ongoing for more than fifty years. The development of neuroimaging technology offers new opportunities to enrich the "biolinguistic perspective" and extend it beyond an abstract framework for inquiry. As a leading theoretical linguist in the generative tradition and also a cognitive scientist schooled in the new imaging technology, (...) Moro is uniquely equipped to explore this. Moro examines what he calls the "hidden" revolution in contemporary science: the discovery that the number of possible grammars is not infinite and that their number is biologically limited. This radical but little-discussed change in the way we look at language, he claims, will require us to rethink not just the fundamentals of linguistics and neurosciences but also our view of the human mind. Moro searches for neurobiological correlates of "the boundaries of Babel" -- the constraints on the apparent chaotic variation in human languages -- by using an original experimental design based on artificial languages. He offers a critical overview of some of the fundamental results from linguistics over the last fifty years, in particular regarding syntax, then uses these essential aspects of language to examine two neuroimaging experiments in which he took part. He describes the two neuroimaging techniques used, but makes it clear that techniques and machines do not provide interesting data without a sound theoretical framework. Finally, he discusses some speculative aspects of modern research in biolinguistics regarding the impact of the linear structure of linguistics expression on grammar, and more generally, some core aspects of language acquisition, genetics, and evolution. In this paper, we identify the way in which various forms of legal personhood can be differentiated from one another by comparing these entities with a—not too farfetched—hypothetical situation in which intelligence spontaneously evolves within the internet: spontaneous intelligence. In these terms, we consider the challenges that may arise where SI as an entity: has no owner, no designer, and no controller; has evolved into existence as a non-human created intelligence; is autonomous; has no physical form; and, although it exists (...) around the world, exists in no particular jurisdiction. Based on this refined notion of SI, we consider issues related to the recognition of such an entity’s legal personhood. By briefly exploring the attribution of legal personality to various entities—including, humans, corporations, artificial intelligence and higher forms of animal life—we differentiate SI from these other forms of intelligence whilst illustrating it shares most characteristics with human intelligence and not, as may intuitively be thought, with various forms of AI. After critically evaluating the classification of these various forms of intelligence, we briefly suggest some ramifications of these differences and suggest that the approach adopted may assist in drawing more effective boundaries between the entities that are already recognised as legal persons, as well as between sub-categories of entities, such as various forms of AI. There is a basic distinction, in the realm of spatial boundaries, between bona fide boundaries on the one hand, and fiat boundaries on the other. The former are just the physical boundaries of old. The latter are exemplified especially by boundaries induced through human demarcation, for example in the geographic domain. The classical problems connected with the notions of adjacency, contact, separation and division can be resolved in an intuitive way by recognizing this two-sorted ontology of boundaries. Bona fide boundaries (...) yield a notion of contact that is effectively modeled by classical topology; the analogue of contact involving fiat boundaries calls, however, for a different account, based on the intuition that fiat boundaries do not support the open/closed distinction on which classical topology is based. In the presence of this two-sorted ontology it then transpires that mereotopology—topology erected on a mereological basis—is more than a trivial formal variant of classical point-set topology. This article addresses the role of science and science advisory bodies in modeling practices for the support of policy-making procedures in the Netherlands in the field of health care. The authors show, based on a detailed investigation of a prestigious interdisciplinary modeling project in which an economic care model was developed for governmental use, that science advisory bodies are entangled with the policy actors they advise in what we call boundary configurations. Boundary configurations are strongly situated interconnections (...) between science advisory institutes and policy institutions that share a specific approach to problem definitions and methods and that are embedded in specific social, discursive, and material elements. Importantly, as the case study shows, such boundary configurations shape the kind of science, and related, the kind of social and political theories about the world, that is effectuated in modeling practices. In this case study, the boundary configuration in which economic experts and policy makers participated contributed to the articulation of health care in terms of a market-based policy program for the health care sector. The problem at the heart of “Stemming the Standard-of-Care Sprawl: Clinician Self-Interest and the Case of Electronic Fetal Monitoring,” an article by Kayte Spector-Bagdady and colleagues in the November-December 2017 issue of the Hastings Center Report, is the persistence of a suboptimal standard of care long after evidence-driven approaches would dictate a change. That problem is not simply defensive medicine, or what the authors call “standard-of-care sprawl.” Instead, it is that, in some cases, the standard of care lags behind (...) best practices. It gets stuck. The authors point to the genesis of the stickiness problem in their passing reference to a core truth: “The problem is that standard of care is not synonymous with best or evidence-based medicine.” In my view, we might best understand the persistence of ineffective and even harmful medical interventions by acknowledging the regulatory vacuum in which such practices thrive. It is by default, not by design, that the profession relies on medical malpractice law to set the boundaries on acceptable practice. (shrink)
