Ideal rods and clocks are defined as an infinitesimal symmetry of the spacetime, at least in the non-quantum case. Since no a priori geometric structure is considered, all the possible models of spacetime are obtained.

In analogy with Planck’s construction of fundamental quantities in gravitation, we construct fundamental quantities associated with (1) theories of electrodynamics in which the electromagnetic field has a maximum value (e.g. Born-Infeld theory), and (2) the Fermi interaction. This gives us a maximum intensity of the electromagnetic field, and also reveals a close relationship between the fundamental lengths associated with the gravitational and weak interactions, supporting the connection between these two interactions.

The United Nations Global Compact has generated a lively debate among academics, activists, and policy practitioners. Given the scope and ambition of this program, and the prestige of the United Nations associated with it, its supporters believe it will fundamentally reshape how businesses practice corporate social responsibility. Its critics view it as a flawed program because it does not impose verifiable obligations and does not compel its participants to adhere to their program obligations. We present an approach to study CSR (...) programs grounded in rational-choice institutionalist theory, building on previous work viewing CSR programs as clubs which can produce reputational benefits for members as well as positive societal externalities, provided that they incorporate institutional mechanisms to prevent member shirking. This perspective puts the focus squarely on the institutional rules of the UNGC and their impacts on member behavior. While we conclude that the UNGC has not yet demonstrated a capacity to generate across-the-board improvements in CSR performance beyond what member firms would have done otherwise, we are hopeful that its sponsors and leaders can undertake worthwhile changes in program design to align member incentives with program objectives. The controversy regarding the unit of selection is fundamentally a dispute about what is the correct causal structure of the process of evolution by natural selection and its ontological commitments. By characterizing the process as consisting of two essential steps--interaction and transmission--a singular answer to the unit question becomes ambiguous. With such an account on hand, two recent defenses of competing units of selection are considered. Richard Dawkins maintains that the gene is the appropriate unit of selection and Robert (...) Brandon, in response, argues that the individual organism is better suited to the role. This paper argues that by making explicit the underlying questions that each of these views addresses, the apparent conflict can be resolved. Furthermore, such a resolution allows for a more complete and realistic understanding of the process of evolution by natural selection. (shrink)

In the new physics and in the new field of cosmometry, 1 it is the fundamental pattern that results in the motion from which all is created. Everything starts with the point of infinite potential. The tetrahedron at the point gives birth to the cuboctahedron ; its motion and structure result in the creation of the torus structure. The torus structure is self-referencing on a moment by moment basis since all must pass through the center. But isn't self-referencing the (...) basis for consciousness? It is said that all of creation has awareness, but at different levels. We know plants are aware of threats and of death to other living creatures by the work of Cleve Backster. We know we influence random number generators from the PEAR studies at Princeton. We know baby chicks will influence the movement of robots programed to do a random walk from the work of Rene Peoc'h. Quantum physics has embraced geometry with the work in the equations which explain the Feynman diagrams where particles come in and out of existence; those equations form a structure called the Amplituhedron - which is a quarter of a star tetrahedron. We also know that the tetrahedron can form the star tetrahedron and that each point of the star tetrahedron can form its own star tetrahedron, which can go on infinitely. That is, there is infinity in the finite. As in the fractal and holographic universe, each point or tetrahedron is connected to every other point. If each point has awareness due to formation of the torus, then Hermes teaching of "As above, as below" has meaning in the torus structure. If the torus is the fundamental unit of self-reference, is that the fundamental unit from which consciousness arises? The torus or double torus appears to be fundamental to all of creation - from galaxies to planets to atoms to photons. (shrink)

The central thesis of this article is that measurement units are theoretical concepts because measurement presumes theoretical definition. New theoretical constructs can be defined in terms of algebraic combinations of previously defined measurement units. Physics has developed an impressive hierarchical knowledge structure on this basis. The unitless measures favored by psychology preclude the generation of such a knowledge hierarchy. It also leads to definitions of reliability and validity in correlational terms which can result in inaccurate measurement. Psychology has (...) long used time as a fundamental unit. Adoption of a second measurement unit would enable construction of a psychological knowledge hierarchy to begin. (shrink)

Turns-at-talk are fundamental units of participation in talk-in-interaction, and turn-constructional-units are the basic building blocks for turns. Possible completion of a TCU is, in principle, the possible completion of the turn, but multi-unit turns are not uncommon, and participants have practices for constructing multi-unit turns and for recognizing them in the course of their production. This article offers an account of one practice usable by speakers and recipients to convey and recognize the designed completion of a multi-TCU (...) turn and/or a multi-turn sequence in which ‘answering’ is being done: returning to, or ‘re-using’, a word or phrase from the start of the turn or sequence, whether articulated by same or different speaker, whether used to refer to same or different referents. This practice is one of the resources by which the overall structural organization of an interactional unit and its local realization are mutually realized. (shrink)

I have had the fortune to find a way to unite theology and science. It is and has been a bit overwhelming. My aim was to integrate science and hermeneutics but I ended up with a theory that integrates pretty much everything. In this paper I focus the fundamental principle that seems so simple that it could taken for a tautology but it is not. The principle, or, rather, the basic assumption, is that an ontologically homogeneous domain does not (...) cause an ontologically homogeneous domain. By this device all ontologically homogeneous domains are causally closed in relation to other ontologically homogeneous domains. Ontologically heterogeneous domains, on the other hand, are permitted to cause and to be caused by ontologically homogeneous domains. The very first ontologically homogeneous domain, also, is permitted to be caused by an ontologically heterogeneous domain. Science, therefore, would concern inquiries into all ontologically homogeneous and heterogeneous domains except for the first ontologically heterogeneous domain. The first ontologically heterogeneous domain would be the field of interest for theology. Consecutive ontologically homogeneous domains could be the platonic mathematical universe, the physical universe and ourselves as subjects. (shrink)

Our concept of the universe and the material world is foundational for our thinking and our moral lives. In an earlier contribution to the URAM project I presented what I called 'the ultimate organizational principle' of the universe. In that article (Grandpierre 2000, pp. 12-35) I took as an adversary the wide-spread system of thinking which I called 'materialism'. According to those who espouse this way of thinking, the universe consists of inanimate units or sets of material such as (...) atoms or elementary particles. Against this point of view on reality, I argued that it is 'logic', which exists in our inner world as a function of our mind, that is the universal organizing power of the universe. The present contribution builds upon this insight. Then I focussed on rationality; now I am interested in the responsibility that is the driving force behind our effort to find coherence and ultimate perspectives in our cosmos. It is shown that biology fundamentally differs from physics. Biology has its own fundamental principle, which is formulated for the first time in history in a scientific manner by Ervin Bauer. This fundamental principle is the cosmic life principle. I show that if one considers the physical laws as corresponding to reality, as in scientific realism, than physicalism becomes fundamentally spiritual because the physical laws are not material. I point out that the physical laws originate from the fundamental principle of physics which is the least action principle. I show that the fundamental principle of physics can be considered as the "instinct of atoms". Our research has found deep and meaningful connections between the basic principle of physics and the ultimate principles of the universe: matter, life and reason. Therefore, the principle of least action is not necessarily an expression of sterile inanimateness. On the contrary, the principle of physics is related to the life principle of the universe, to the world of instincts behind the atomic world, in which the principles of physics, biology, and psychology arise from the same ultimate principle. Our research sheds new light to the sciences of physics, biology, and psychology in close relation to the basic principles. These ultimate principles have a primary importance in our understanding of the nature of Man and the Universe, together with the relations between Man and Nature, Man and the Universe. The results offer new foundations for our understanding our own role in the Earth, in the Nature and in the Universe. Even the apparently inanimate world of physics shows itself to be animate on long timescales and having a kind of pre- human consciousness in its basic organisation. This hypothesis offers a way to understand when and how the biological laws may direct physical laws, and, moreover, offers a new perspective to study and understand under which conditions can self-consciousness govern the laws of biology and physics. This point of view offers living beings and humans the possibility of strengthening our natural identity, and recognising the wide perspective arising from having access to the deepest ranges of our own human resources and realising the task for which human and individual life has been created. I consider two attempts to combine realism with pluralism about the units of selection: Sober and Wilson’s combination of “model” and “unit” pluralism, and Sterelny and Griffiths’ “local pluralism”. I argue that both of these attempts fail to show that realism and pluralism are compatible. Sober and Wilson’s pluralism turns out, on closer inspection, to be a kind of monism in disguise, while Sterelny and Griffiths’ local pluralism involves a combination of realism and anti-realism about interactors, and the (...) class='Hi'>units of selection, that is fundamentally unstable. My conclusion is that one must choose whether to be a realist or a pluralist in this area: one cannot be both. In this essay, I start by addressing the question of “has Islamophobia reached a tipping point in the United States”? Then I apply Lacanian social theory, drawing on Slavoj Žižek’s analysis of anti-Semitism through the seven veils of fantasy, to Islamophobia in an effort to conceptualize the complex psychosocial phenomenon as a fundamental fantasy, which ideologically sustains the ‘war on terror’ discourse. Finally, I end with a brief remark on the possibility of Islamophobia as a counter-discourse.

Reform of the federal income tax system has become a perennial item on the domestic policy agenda of the United States, although there is considerable uncertainty over specifics. Indeed the recent report of the President's Advisory Panel on Federal Tax Reform recommended not one but two divergent policy directions. In Fundamental Tax Reform, top experts in tax policy discuss a wide range of issues raised by the prospect of significant tax reform, identifying the most critical questions and considering whether (...) the answers are known, unknown--or unknowable. Leopold first discusses the conservation of natural resources in the southwestern United States in economic tenns, stressing, in particular, erosion and aridity. He then concludes his analysis with a discussion of the moral issues involved, developing his general position within the context of P. D. Ouspenky’s early philosophy of organism.

Aldo Leopold’s draft essay “Some Fundamentals of Conservation in the Southwest” from 1923 shows that his initially expressed moral concerns were primary to his view of conservation. In addition, this early essay also challenged dominant perceptions of environmental degradation in the southwestern United States in the 1920s. For these reasons, it provides a framework for examining conservation as a moral issue in South and West Africa, especially in the nations of South Africa and Ghana, building on J. Baird Callicott’s summaries (...) of Yoruba and San environmental ethics in Earth’s Insights . In the context of poverty, traditional community taboos may have already supplied the social norms of conservation that Leopold desired, but they are marginalized by modernization. As in Leopold’s essay, mainstream perceptions of environmental degradation viewed through the lens of political ecology suggest that international market forces may be more ecologically disruptive than traditional peasant agriculture. Land ethics similar to Leopold’s are implicit within the political philosophies of two of the regions’ most respected recent leaders, Nelson Mandela , who promoted land reform, and Kwame Nkrumah , who promoted pan-Africanism over neocolonialism. Community-based solutions to conservation issues illustrate the successes, failures, and the challenging complexity of modernization in these subregions. (shrink)

Language and norms are both fundamental to human society. A social account of language evolution must take into account the normative context in which language acquisition, use, and change occur. However, at the same time, norms in human society are directly affected by language and the linguistic skills of individuals. My aim in this chapter is to explore the evolutionary consequences of this bi-directional interaction. I discuss how it can help explain central linguistic notions including imperatives, questions, possessives, modal (...) vocabulary, categorization, and performatives, and how it helps explain unique features of human normativity. ABSTRACT The Universal Draft Declaration on Bioethics and Human Rights seeks to provide moral direction to nations and their citizens on a series of bioethical concerns. In articulating principles, it ranks respect for human rights, human dignity and fundamental freedoms ahead of respect for cultural diversity and pluralism. This ranking is controversial because it entails the rejection of the popular theory, conventionalist ethical relativism. If consistently defended, this theory also undercuts other United Nations activities that assume member states and (...) people around the world can reach trans‐cultural judgments having moral authority about health, pollution, aggression, rights, slavery, and so on. To illustrate problems with conventionalist ethical relativism and the importance of rejecting it for reasons of health, human rights, human dignity and fundamental freedoms, the widespread practice of female genital circumcision or cutting is discussed. These surgeries are virtually a test case for conventionalist ethical relativism since they are widely supported within these cultures as religious and health practices and widely condemned outside them, including by the United Nations. This historical study aims to explain how the transition from student nurse service to fully qualified “graduate nurse” service in the United States in the 20th century affected assumptions about fundamental patient care in hospital wards and provide historical context for current apprenticeship programs. Through analysis of documents from 1920 when student nurse service, a nurse apprentice model, was the norm to 1960 when the nurse apprentice model was waning in favor of registered nurse service, this study found that (...) the replacement of student nurses with registered nurses led to weakened standardization of fundamental bedside care and the introduction of large numbers of unlicensed nursing assistants. While student nurses could perform all the functions of fully qualified graduate nurses, nursing assistants could not, resulting in a separation of fundamental nursing care from the professional nurse role and changes in assumptions and attitudes toward fundamental care. These changes had a negative effect on fundamental nursing care. New apprenticeship programs provide opportunities for improvement. (shrink)

Since last year, major initiatives have been undertaken by the chair of theoretical philosophy at the University of Tübingen in order to enhance the reception of analytic metaphysics in the European landscape. Here we review the 2013 summer workshop, intended to be the first of an annual series, on “Existence, Truth and Fundamentality”, the invited speakers being Graham Priest (Melbourne), Stephan Leuenberger (Glasgow), Dan López de Sa (Barcelona), Francesco Berto (Aberdeen), Friederike Moltmann (Paris – Pantheon Sorbonne) and Jason Turner (Leeds). (...) The workshop’s scope is fairly large, focusing on three different aspects of contemporary research in metaphysics. However, the underlying idea of organizers Thomas Sattig and Alessandro Torza consisted in exploring their interconnections and even new areas which possibly share the same problem spectrum. Also, they thought of bringing together both young and senior protagonists of the contemporary debate. In this sense, the main thread followed by the speakers consisted in enquiring the ideas of fundamentality, dependence and grounding with respect to ontology (Berto, López de Sa, Turner) and the truthmaking debate (Priest, Moltmann, Leuenberger), thus pretty much in line with some latest tendencies in metaphysics, such as, prima inter paria, the works of Kit Fine. When we say that something is more fundamental than something else, we move into a non-conventional (for the standards of 20 th century philosophy) metodological framework, hardly focusing on the question about what there is, and rather tackling the issue of how fundamentally there is what there is, or how the existence of something is required as a ground for the existence of other things. Here is how Jonathan Schaffer explains the methodological transition in his influential “On What Grounds What” (2009): -/- Among the many assumptions Quine and Carnap share is that metaphysical questions are existence questions, such as whether numbers exist. They only disagree on the further issue of whether such questions are meaningful (at least as the metaphysician might pose them). But why think that metaphysical questions are existence question of this sort? Return to Aristotle’s Metaphysics. There are virtually no existence question posed. The whole discussion is about substances (fundamental units of being). At one point Aristotle pauses to ask if numbers exist, and his answer is a brief and dismissive yes. [. . . ] For Aristotle, the question about numbers is whether they are transcendent substances or grounded in concreta. The question is not whether numbers exist, but how. (Schaffer, 2009, p. 347) -/- The conference opened with Graham Priest’s intriguing and peculiar review of Buddhist cornerstone “The Fundamental Verses of the Middle Way” (Mūlamadhyakamakārikā) by Nāgārjuna (ca. 150-ca. 250 AD), seen as a unrecognized forerunner of multi-valued semantics and dialetheism. Priest shows that Nagarjuna’s thought indeed has valuable analytic grip (contrary to the traditional mystical dismiss of his works altogether) and is even in accord to some formal schemas rejecting both the laws of excluded middle and non-contradiction. Dan López de Sa was interested in the topic of grounding, raising concerns about how to explain the kind of “reality” exemplified by what is not fundamental, but rather derivative on something else. He proposes a conceptual and non-primitive analysis of grounding as linked to fundamentality and derivation, and argues that the view can be advocated along with the acceptance that at least something is not fundamental. Subsequently, he illustrates an impressive range of applications linked to contemporary debates in meta-ontology, truthmaking and philosophy of time. Stephan Leuenberger discussed a semantics for “total logic”, a variant of first order logic which is claimed to have several applications with respect to the issue of excluding negative existentials from the scope of theories accounting for a given ’totality’ of facts. For example, materialism is the claim that everything there is can be traced back to physical facts or to truth implied by those facts. What about the claim that “There are no angels”? According to Leuenberger, ordinary logic falls prey of modal arguments (if it is possible that there are angels, by modus tollens, that it is not metaphysically necessary that everything there is is physical). So, there is space for the introduction of a new operator, the totality operator, claiming of what enters its scope that “that’s the whole truth”. Consequently, total logic’s semantics tackles David Chalmers’ well-known conceivability-based argument in favour of zombie’s (subjects producing behaviour but experiencing no qualia) possible existence. Friederike Moltmann presented a massive array of natural language-based examples on the role played by case-constructions, such as “it is the case that Caesar crossed the Rubicon”, “the case of the stolen statue”, “the case in which it might rain”, and so forth. She suggests that we should take surface phenomena of our language very seriously with regard to the determination of ontological categories and truth-makers. Cases are provided by many natural languages with their own existence predicates (“to occur” and “to present itself ”), and these do not apply to other kind of entities, such as objects and events. Trying to derive a substantive thesis on their nature, she claims that they are filtered entities, a structure taking into account some features of the corresponding objects and events and preserving their relational pattern. Jason Turner discussed meta-ontological concerns against the claim that ontological debates are defective. Analysed the structure of a metaphysical theory and identified two different forms of defectiveness that can occur in ontological questions, the defection from without and the defection from within, the author provided an original solution in order to avoid such difficulties. He argued thus in favor of a logical constancy, a translation principle thanks to it would be possible reconceive an ontological defection. Lastly, Francesco Berto’s talk closed the workshop with a sagacious discussion of meinongian quantification. He substains that Meinongians and Quineans experience no conceptual equivocation. Even if the former claims that “There are things that do not exist”, something that the latter contrasts with the interpretation of existential quantifiers as all-including, they still rely upon the same concept of “existence” and they understand each other when they are outside the ontology room, so that it cannot be that they lack competence. Subsequently, Berto deals with the objection that Meinongians commit analytic falsehood in separating the meaning of “to be” from that of “exists”. The Quinean has no independent evidence for analytic equivalence aside from her emphatic stress on the “is” in “there is”. Meinongians, however, can retort to linguistic considerations and claim that existence predicates display fairly different functions. -/- As for what regards our internal division of the “philosophical labor”, Fabio Ceravolo reviewed Moltmann and Berto’s talks; whereas Mattia Cozzi took care of Priest’s and Leuenberger’s, and Mattia Sorgon of those given by López de Sa and Turner. Conclusively, we would like to thank Thomas Sattig and Alessandro Torza for all of their organizational efforts and the kind welcome they reserved to us. This paper argues for a fundamental theological re‐interpretation of Vatican II ecclesiology that acknowledges not one but two principal ecclesiologies inspired by the Council documents. Ecclesiastical authorities and some theologians have acknowledged that communion ecclesiology is the principal ecclesiology of Vatican II. However, this conception does not sufficiently account for the full range of relations with the Other that is a distinctive development in the Church's self‐understanding inaugurated by Vatican II; such an understanding is better represented by an ecclesiology (...) of friendship. I thus argue there are two ecclesiologies reflected in the Council documents: communion ecclesiology and another to be developed based on mutual relations and friendship with the Other. The latter is distinctively Ignatian in spirit; further, these two ecclesiologies are not fundamentally opposed to each other but are united in the missions of the Son and the Spirit. (shrink)

The conflation of two fundamentally distinct issues has generated serious confusion in the philosophical and biological literature concerning the units of selection. The question of how a unit of selection of defined, theoretically, is rarely distinguished from the question of how to determine the empirical accuracy of claims--either specific or general--concerning which unit(s) is undergoing selection processes. In this paper, I begin by refining a definition of the unit of selection, first presented in the philosophical literature by William Wimsatt, (...) which is grounded in the structure of natural selection models. I then explore the implications of this structural definition for empirical evaluation of claims about units of selection. I consider criticisms of this view presented by Elliott Sober--criticisms taken by some (for example, Mayo and Gilinsky 1987) to provide definitive damage to the structuralist account. I shall show that Sober has misinterpreted the structuralist views; he knocks down a straw man in order to motivate his own causal account. Furthermore, I shall argue, Sober's causal account is dependent on the structuralist account that he rejects. I conclude by indicating how the refined structural definition can clarify which sorts of empirical evidence could be brought to bear on a controversial case involving units of selection. (shrink)

ABSTRACT When Manchester United Football Club publicly announced the signing of Alexis Sanchez in 2018, it was done through a short video that purported to demonstrate the rich traditions and history of the club, its deep connection with its fanbase, and the strength of its support. However, locating this video within the broader social order where elite football clubs like MUFC essentially operate as for-profit corporations shows how it functions as an instantiation of the market-oriented discourse and rhetoric that has (...) penetrated sport in general. Taking up a Multimodal Critical Discourse Studies perspective, and via an analysis of the semiotics of sound, intertextuality, and the visual, this article shows how MUFC positions itself sympathetically and in so doing conceals its pursuit of profit. It shows how values of solidarity, organicity, and camaraderie are communicated and associated with MUFC and how the viewer is structured into identifying with MUFC instead of supporters as a collective group. Finally, it discusses how these tropes are aestheticized whilst outwardly claiming to deny that very pursuit, thereby masking the reconstrual of club-supporter relations as fundamentally exploitative brand–consumer relations. The eminent 20th-century Polish philosopher Tadeusz Kotarbiński (1886–1981) is the author of a novatory philosophy of combating global suffering. Kotarbiński’s theory states that although humans are by nature rational, and additionally endowed with goodwill, human life nonetheless offers an endless stream of pain and suffering. Some of this suffering results from the essence of the human condition and can not be helped, mostly, however, it is the effect of the meanderings of the human mind and can be eliminated by education. (...) More than by anything else, the human mind is brought to err by so-called phantasmats, or emotion-laden intellectual mirages, mainly of a religious, national and political nature. Such phantasmats are the source and fundament of humanity’s divisions into hostile cultures, nations and political systems, which in turn gives rise to conflict between civilizations, countries and ideologies, inadvertently accompaniedby mounting mistrust, suspiciousness, xenophobia, hatred, armaments—and ultimately war. All this means an ocean of suffering for countless individuals. Both in philosophy and praxis Kotarbiński strove to eliminate all sources of suffering, including that stemming from differences in culture, development, nationality, and politics. He believed in the motivating powers of reason and the creative powers of persuasion, and consequently sought to attain his goal by rationalization, or focusing solely on the logic-driven and common experiencing of the human fate in a bid to eradicate cultural, national and political difference. Thus united, humanity would melt into one big human state devoted to lingering inevitable suffering. Arthur Schopenhauer's The Two Fundamental Problems of Ethics consists of two groundbreaking essays: 'On the Freedom of the Will' and 'On the Basis of Morals'. The essays make original contributions to ethics and display Schopenhauer's erudition, prose-style and flair for philosophical controversy, as well as philosophical views that contrast sharply with the positions of both Kant and Nietzsche. Written accessibly, they do not presuppose the intricate metaphysics which Schopenhauer constructs elsewhere. This is the first English translation of these works (...) to re-unite both essays in one volume. Systems of units still fail to attract the philosophical attention they deserve, but this could change with the current reform of the International System of Units. Most of the SI base units will henceforth be based on certain laws of nature and a choice of fundamental constants whose values will be frozen. A TRADITIONAL VIEW OF UTILITY AND RIGHTS According to a conventional view, no project could be more hopelessly misconceived than the enterprise of attempting a utilitarian derivation of fundamental rights. We are all familiar – too familiar, perhaps – with the arguments that support this conventional view, but let us review them anyway. We may begin by recalling that, whereas the defining value of utilitarianism – pleasure, happiness or welfare – contains no mention of the dignity or autonomy of (...) human beings, it is this value which utilitarianism in all its standard forms invokes as the criterion of right action. Worse, insofar as utilitarian policy must have as its goal the maximization of welfare conceived as an aggregate summed over the utilities of everyone affected, legal and political utilitarianism seems bound to have a collectivist bias, trading on the dangerous fiction of a social entity and ignoring the distinctness of separate selves with their several incommensurable claims. It seems that, if individuals can appear in the utilitarian calculus at all, it will only be as ciphers, abstract place-holders for units of welfare. For, as an aggregative value, utility must be indifferent to distribution, and insensitive to the preeminently distributive considerations marked by claims about rights. So, if whatever has utility can be broken down into units or elements which are subject to measurement or at least comparison by a common standard, then it will always be possible that a very great loss of welfare for one man or a few men can be justified if it produces a great many small increments of welfare for a vast multitude of men. Citizens United v. Federal Election Commission is a 2010 US Supreme Court decision that fundamentally transformed federal election financing. As a result, we have seen a drastic increase in the amount of so-called soft money that wealthy individuals and corporations contribute to political campaigns. Following a brief overview of the case and the precedent that formed the basis for the ruling, this chapter concerns philosophical stakes of the decision and what precisely it says about the public today and the role (...) of philosophy within it. I argue that there are three basic issues here. First is the issue of corruption. Second is the question of propaganda and the potential dangers the Citizens United case might pose for a democratic polity. Finally, I examine the dangers this poses for a democratic polity. The eighteenth-century American founders believed that religion is special and deserves special constitutional protection, and that all peaceable faiths must be drawn into the constitutional process and protection. The founders introduced six constitutional principles for the protection of religious freedom: freedom of conscience, free exercise of religion, religious pluralism, religious equality, separation of church and state, and no state establishment of religion. Since the 1940s, the United States Supreme Court has upheld these religious freedom principles in more than 170 cases, (...) albeit unevenly of late. Moreover, in recent years religious freedom has come under sharp popular and academic attack, particularly as religious pathologies have come to light and religious freedom claims have clashed with sexual liberty claims. This article calls for a return to the first principles of religious freedom for all, at home and abroad, and for a new balance between religious freedom and other fundamental rights claims. The philosophical significance attached to the construction of systems of units has traditionally been confined to the notion of convention, while their adoption was considered to be the exclusive province of the history and sociology of science. Against this tradition, a close articulation between history, philosophy, and sociology of science is needed in order to analyse the recent reform of the International system of units. In the new SI, units are redefined on the basis of certain (...) class='Hi'>fundamental constants of nature, established by physical theories, whose values are fixed without uncertainty. The purpose of this article is to show that the redefinition of SI units, far from being a convention, involves a holistic reconstruction of our concepts of quantities from accepted theoretical laws. Fixing the values of the defining constants stabilizes these laws within the framework of physics through a twofold adjustment procedure that ensures both a semantic coordination between theory and world and an intersubjective coordination between human agents required by social activities. This double adjustment implies a treatment of uncertainties that results in closely entwining the pursuit of truth as correspondence and truth as coherence which turn out to be complementary, thus highlighting the anthropological underpinnings of scientific realism. Electronic commercial transactions have become a vital part of digital economies around the world. However, the countries need to upgrade their policy frameworks and related legal provisions amid a fragile cyber security environment. The authentication of electronic signatures is a complex phenomenon that needs attention for authentication and recognition. This research presents a comparative analysis of the two countries Jordan and the United Arab Emirates. This study analyzes the related legal statutes to figure out differences and compatibility with reference to (...) their recognition and ability to execute safe electronic transactions in the minimum time. Two legislative enactments have been analyzed in this study that is Jordanian electronic transactions law of 2015 and the United Arab Emirates Electronic transactions and trust services law of 2021. The study concludes that UAE laws are better recognized to verify and authenticate the electronic-signature-based commercial transaction in comparison with the enactments of Jordan in terms of categorizing different levels of security of the electronic signatures and legal preventive measures in case of falsification of data, content, and signatures and breach of the trust. What makes a high-quality biomarker experiment? The success of personalized medicine hinges on the answer to this question. Unfortunately, as many commentators have now emphasized, the quality of most biomarker experiments to date has been quite low. Although the technical side of this problem has received considerable attention, the philosophical issues remain largely unexplored. This chapter reviews fundamental ethical controversy surrounding the ongoing effort to revise the Uniform Determination of Death Act in the United States. Instead of focusing on the process of the revision itself, the chapter explores the underlying ethical debate over brain death that has been ongoing for many decades and finally culminated in this revision. Three issues are focused: the requirement for consent and personal exemptions before applying brain death for the diagnosis of death; redefining the areas of the (...) brain that have ceased to function in the definition of brain death; and codifying the American Academy of Neurology as the authority to issue the standards of the diagnosis of brain death. The chapter concludes that allowing the personal choice of death determination gives a pragmatic compromise to the disputed definition and practice of diagnosing brain death. So long as all risks and imperfections of the diagnosis are accepted through the consenting process, there is nothing ethically objectionable to continuing the current practice of diagnosing brain death as a successful tool to facilitate heart-beating organ donation without violating the dead-donor rule. By contrast, precluding personal choice and imposing legal restrictions to consent and exemptions would further erode public trust. (shrink)

In higher eukaryotes, ‘replication factories’ coordinate DNA synthesis within local clusters of chromatin domains. Recent experiments(1,2) have confirmed the complexity of these clusters and established that the organization of sites labelled during S phase persists throughout the cell cycle. This implies that domain clusters are critical elements of an hierarchy that is fundamental to both nuclear and chromosome structure.

This paper analyses the development of the specialism of adolescent and young adult (AYA) cancer care via a Foucauldian lens to consider how knowledge and awareness have grown since questions were first raised about unmet needs of AYAs with cancer. The AYA specialism has gathered momentum over the last 30 years in the United Kingdom (UK) and is fast gathering pace internationally. Fundamental to this process has been the combined contribution from nursing and other health professionals, researchers, policy‐makers and (...) philanthropists. From an initial process of problematisation, through a gradual growth in empirical knowledge and resultant shifts in health policy, a new nexus of expertise has emerged that enabled AYA cancer care to become recognised as distinct from either child or adult oncology. Different stakeholders contributed to the discourses that have underpinned this development—a process likely to continue as it expands further. This paper draws on examples from the growth of the AYA specialism, the emergence of new professional roles and a growth in research. It illustrates how the coalescing of multiple perspectives allowed new discourses and, ultimately, new practices to be established that now have global impact. (shrink)

Moral distress is a fundamental problem in the nursing profession that affects nurses. Critical care nurses are more susceptible to this problem due to the nature of their work. Moral distress may, in turn, lead to several undesirable consequences. This study aimed to determine the relationship between moral distress and intention to leave the ward among critical care nurses. This descriptive-correlational study was conducted by census method on all eligible nurses who worked in Coronary Care Unit and Intensive Care (...) Unit of AhVaz hospitals, Iran. Data was collected by Corley’s moral distress questionnaire and a researcher-made questionnaire to investigate the intention to leave the ward. Questionnaires were completed through self-report and data were analyzed using a t-test and Pearson correlation coefficient. The results showed that there was a direct association between moral distress and intension to leave the ward in critical care nurses. Also, the intensity of moral distress and the intention to leave the ward were significantly higher in ICU nurses. Given the high exposure of critical care nurses with moral distress and its association with leaving the ward, it seems that devising strategies to reduce or control moral distress and its negative consequences are necessary, particularly in ICU nurses. The United Nations' (UN) adoption of a Declaration on the Rights of Indigenous Peoples is intended to mark a fundamental ethical turn in the relationships between indigenous peoples and the community of sovereign states. This moment is the result of decades of discussion and negotiation, largely revolving around states' discomfort with notion of indigenous self-determination. Member states of the UN have feared that an ethic of indigenous self-determination would undermine the principles of state sovereignty on which the UN is (...) itself grounded. However, such fears are the result of very poor understandings of the ethical principles under which the relations between indigenous peoples and nation-states already have been formed under centuries of European colonialism. The principle of self-determination embraced in this Declaration does not diverge from colonial norms; it entrenches these norms as international policy. Without doubt, indigenous peoples are more likely to benefit than suffer from states' observance of the Articles within this Declaration. Reducing the challenge of indigenous peoples' rights to the notion of self-determination set out in this document, though, misses an extraordinarily important opportunity to critically investigate the ethic of rights that has produced an opposition between nation-states and indigenous peoples to begin with. A true turn in the ethics of this relationship would see not simply the institution of a right to self-determination but, rather, indigenous peoples' right to first determine the nature of self for themselves. This contribution compares entries on Friedrich Froebel and the kindergarten in German and United States’ histories of education from 1857 to 1933. In the American histories, Froebel appears as the great “hero” of education of the 19th century, whereas in the German histories, Pestalozzi is the “hero.” This difference in the perspectives goes back to fundamental differences in the political culture and political traditions of the two countries, which differed greatly as to the shaping of the public and private (...) spheres. Consequently, there were also different views on public education. In the immigration society of the United States, it was important to integrate children with various language and cultural backgrounds. As families could not do this alone, public kindergartens were needed. In Germany, in contrast, Froebel’s idea of the kindergarten was seen as an attack on family ties, and Pestalozzi was highly esteemed, because he made home education central. The American interest in “making citizens” produced Froebel as the hero; the German interest in leaving the education of young children to mothers and in the family lauded Pestalozzi. This case study of the reception of Froebel in Germany and the United States illustrates the high context-dependence of the construction of educational “heroes.”. (shrink)

The ‘rules’ or ‘norms’ model of society is a misleading abstraction and ‘practices’ better captures the fact that living in society is not simply a matter of rules but of the practical mastery of the cues and expectations of others. The locus of explanation shifts from culture as a determinant in the social system to a more pragmatic understanding of the ongoing effects of (...) practices. Deep neural networks (DNNs) are not just inadequate models of the visual system but are so different in their structure and functionality that they are not even on the same playing field. DNN units have almost nothing in common with neurons, and, unlike visual neurons, they are often fully connected. At best, DNNs can label inputs, while our object perception is both holistic and detail preserving. A feat that no computational system can achieve.

Majumder (bio)Human pluripotent stem cell research, meaning research into cells that can multiply indefinitely and differentiate into almost all the cells of the body, has become a minefield in which science, ethics, and politics have collided over the last decade in the United States. President Barack Obama entered this highly charged (...) territory when he indicated during his campaign that once in office he would issue an executive order expanding federally funded human embryonic stem cell (hESC) research and introduce rigorous oversight of it (Obama 2008a & b). Candidate Obama stated that he would require that the hESC lines involved were derived with donor consent from early embryos that otherwise would be discarded following in vitro fertilization (IVF) treatment. However, in contrast with the policy of President George W. Bush, he would do so without regard to the date of their derivation. He added that he would call upon the director of the National Institutes of Health (NIH) to develop guidelines for federally funded hESC and other pluripotent stem cell research that would draw from the guidelines developed in 2005 by the National Academies of Science (NAS) for privately funded research (National Research Council 2005).A similar policy was written into the 2008 version of the Stem Cell Research Enhancement Act, which reiterates the policy enunciated in earlier versions of this bill, passed twice by the Congress but vetoed by President Bush each time (House of Representatives, 110th Congress 2008).1 Depending on how one reads the 2008 version of the act, it could also apply in certain respects to hESC research that is not federally funded. We proceed on the assumption that the act applies at least to federally funded stem cell research. Therefore, it appears that the president or the Congress, or both, will approve of an expanded policy of federal funding of hESC research, as well as other forms of human pluripotent stem cell research. [End Page 79]This policy would make the guidelines developed by a committee appointed by NAS, a prestigious private body of American scientists and related experts, the primary basis for the development of new federal guidelines for oversight of hESC research in the United States. This would have certain advantages in that those familiar with the relevant scientific issues are likely to address them accurately and stem cell investigators are apt to accept restrictions on their research written by fellow scientists and ethics and policy experts whom they perceive as strong supporters of stem cell research. However, it also would have certain disadvantages. Chief among these is that the NAS committee appointed to write guidelines for this research, in its concern to see stem cell science move forward after a period in which many scientists and others maintained that it had been unduly restricted, might have overlooked or deferred consideration of some pressing ethical and policy issues. We maintain that this is the case—although we also maintain that the NAS guidelines provide a responsible foundation for developing NIH guidelines for stem cell research. Consequently, we propose that an NIH task force charged by the director of NIH with writing new guidelines for hESC and other stem cell research should revise and expand the NAS guidelines in ways that we propose below, as well as others that it considers necessary, and make it obligatory for those seeking federal funding of such research to follow these new guidelines.We highlight certain areas in which an ethical case can be made for strengthening the existing NAS guidelines and certain areas in which more fundamental ethical reflection—and building on that, additional guideline/policy development—seems warranted. Since this assumption has important consequences for the theory of knowledge — knowledge cannot be synthesised but only further differentiated — its plausibility is tested against two aspects that characterise any theory of knowledge: knowledge production and knowledge application.
