Suppose we have a persistent disagreement about a particular set of policy options, not because of an underlying moral disagreement, or a mere conflict of interest, but rather because we disagree about a crucial non-normative factual assumption underlying the justification of the policy choices. The main question in the paper is what political legitimacy requires in such cases, or indeed whether there are defensible answers to that question. The problem of political legitimacy in fact-dependent policy disagreements has received almost (...) no attention in political philosophy, which has focused mostly on value disagreements and proposed theories of legitimate coercive legislation in valuedependent disagreements. The paper presents an argument showing that under certain plausible assumptions regarding legitimacy, there are serious difficulties in identifying legitimate choices in fact-dependent policy disagreements. This may be unsurprising to political philosophers preoccupied with value-based disagreements, perhaps because it has been assumed that legitimacy-related concerns are irrelevant to fact-dependent policy disagreements. The paper argues that this response is premature. If we should care about legitimacy et al.l, then it is by no means clear why we should ignore issues of legitimacy in policy-disputes that depend on factual disagreements. The paper ends by defining a set of possibilities that merit further exploration in search of a theory of legitimacy in fact-dependent policy disagreements. (shrink)

G.A. Cohen and David Estlund claim that, because of their fact-dependent nature, constructivist theories of justice do not qualify as moral theories about fundamental values such as justice. In this paper, I defend fact-dependent, constructivist theories of justice against this fact-independency critique. I argue that constructivists can invoke facts among the grounds for accepting fundamental principles of justice while maintaining that the foundation of morality has to be non-empirical. My claim is that constructivists ultimately account for the (...) normativity of fact-dependent principles by referring to a fact-independent, moral conception of the person, which is not a principle of justice.1. In the literature on free will, fatalism, and determinism, a distinction is commonly made between temporally intrinsic (‘hard’) and temporally relational (‘soft’) facts at times; determinism, for instance, is the thesis that the temporally intrinsic state of the world at some given past time, together with the laws, entails a unique future (relative to that time). Further, it is commonly supposed by incompatibilists that only the ‘hard facts’ about the past are fixed and beyond our control, whereas the ‘soft facts’ (...) about the past needn’t be. A substantial literature arose in connection with this distinction, though no consensus emerged as to the proper way to analyze it. It is time, I believe, to revisit these issues. The central claim of this paper is that the attempts to analyze the hard/soft fact distinction got off on fundamentally the wrong track. The crucial feature of soft facts is that they (in some sense) depend on the future. Following recent work on the notion of dependence, however, I argue that the literature on the soft/hard distinction has failed to capture the sense of dependence at stake. This is because such attempts have tried to capture softness in terms of purely modal notions like entailment and necessitation. As I hope to show, however, such notions cannot capture the sort of asymmetrical dependence relevant to soft facthood. Arguing for this claim is the first goal of this paper. My second goal is to gesture towards what an adequate account of soft facthood will really look like. (shrink)

Consider Dretske's measles example (from page 74 in his Knowldege and the Flow of Information (MIT/Bradford: 1981) ): since the question of whether Alice's being one of Herman's children carries the information that she has the measles is a question about conditional probabilities, we must be careful about our specification of the condition, the antecedent. Although we are to suppose that it is a true generalization that all of Herman's children have the measles, since that is a coincidence, we can (...) just as well suppose that Alice is an only child with the measles. It is of course true that the conditional probability of Alice's having measles given that she has the measles is 1; but that is not relevant to the question Dretske raises. In Dretske's example, the question is whether Alice's being Herman's child carries the information that she has measles. And so the relevant condition in this example is simply Alice's being Herman's child. While it is in fact true that Alice has the measles, that isn't part of the condition: for the question is, "how probable is the one state of affairs given some other state of affairs,". (shrink)

The purpose of the book is to clarify the notion of existential dependence and cognate notions, such as supervenience and the notion of an internal relation. I defend the view that such notions are best understood in terms of the concept of metaphysical grounding, i.e. the concept of one fact obtaining in virtue of other facts, where ‘in virtue of’ has a distinctively metaphysical meaning.

The world is undeniably full of injustice. Many feel that much political philosophy is practically impotent and engaged instead in overly abstract theorising insufficiently sensitive to the realities of the world. One response to this concern is David Miller’s influential model of evidence-based political philosophy, which claims to be sensitive to empirical evidence from the social sciences, takes seriously people’s opinions, and defends the role of facts in grounding normative principles. Using various examples from the field of global justice, one (...) of Miller’s key areas of work, I show that Miller’s method is unconvincing on two levels. His theoretical argument for fact-dependence is flawed, and his practical argument for an opinion-sensitive political theory is either guilty of status quo bias or, in an attempt to escape it, becomes self-defeating. While the paper is primarily critical, I endeavour also to draw out the implications of my critiques for the role of the ‘real world’ in theorising. (shrink)

This essay provides an opinionated survey of some recent developments in the literature on ontological dependence. Some of the most popular definitions of ontological dependence are formulated in modal terms; others in non-modal terms (e.g., in terms of the explanatory connective, ‘because’, or in terms of a non-modal conception of essence); some (viz., the existential construals of ontological dependence) emphasise requirements that must be met in order for an entity to exist; others (viz., the essentialist construals) focus on conditions that (...) must be satisfied in order for an entity to be the very entity it is at each time at which it exists; some are rigid, in the sense that they concern a relation between particular entities; others are generic, in the sense that they involve only a relation between an entity and some entities or other, which bear certain characteristics. I identify three potential measures of success with respect to which these different definitions of ontological dependence can be evaluated and consider the question of how well they in fact meet these desiderata. I end by noting that certain challenges face even the most promising essentialist construals of ontological dependence. (shrink)

This is a brief exploration of the notion of an objective fact. The form of objectivity at issue is distinct from epistemic objectivity or objectivity about truth. It is an ontological form of objectivity. Objective facts may obtain whether or not we know, believe or are aware of them. They depend upon objects, for example, on the properties that objects have or the relationships into which objects enter. Setting scepticism to one side, there is a perfectly mundane sense in (...) which we may come to have knowledge or fail to have knowledge of such facts. We must perceive objective facts from a perspective, but this does not enter into the facts. Nor does the fact that we must describe facts using language mean that facts are language-dependent. Linguistic expressions frequently make reference to the situation in which they are uttered. In fact, there are expressions whose whole point of use is to relate to their context of utterance. It is such expressions that this article is primarily about. However, rather than presenting the richness of pertinent phenomena (cf. Anderson & Keenan 1985), it concentrates on the theoretical tools provided by the (standard) two-dimensional analysis of context dependence, essentially originating with Kaplan (1989)--with a little help from Stalnaker (...) (1978) and Lewis (1979a, 1980), and various predecessors including Kamp (1971) and Vlach (1973). The current article overlaps in content with the account in Zimmermann (1991), which is however much broader (and at times deeper).. (shrink)

According to the response-dependence view of moral responsibility, a person is morally responsible just in case, and in virtue of the fact that, she is an appropriate target for reactive attitudes. This paper raises a new puzzle regarding response-dependence: there is a mismatch between the granularity of the reactive attitudes and of responsibility facts. Whereas the reactive attitudes are comparatively coarse-grained, responsibility facts can be quite fine-grained. This poses a challenge for response-dependence, which seeks to ground facts about responsibility (...) in facts about the reactive attitudes. Specifically, reactive attitudes are not enough for grounding facts about degrees of moral responsibility. The responsedependence view thus requires significant revisions or supplementations. We direct different attitudes towards states of affairs depending on where in time those states of affairs are located. Call this the type asymmetry. The type asymmetry appears fitting. For instance, it seems fitting to feel guilt or regret only about states of affairs that are past, and anticipation only of states of affairs that are future. It has been argued that the type asymmetry could only be fitting if there are tensed facts, and hence that since it is fitting, (...) there are tensed facts. In this paper I argue that tensed facts are not necessary to ground the fittingness of the type asymmetry, and thus we have no reason, arising from the fittingness of the asymmetry, to posit such facts. I also argue for a stronger conclusion: even if these facts obtain they are no part of what grounds the fittingness of the type asymmetry. These facts are explanatorily redundant. (shrink)

A shared presumption among practice-dependent theorists is that a principle of justice is dependent on the function or aim of the practice to which it is supposed to be applied. In recent contributions to this debate, the condition of epistemic uncertainty plays a significant role for motivating and justifying a practice-dependent view. This paper analyses the role of epistemic uncertainty in justifying a practice-dependent approach. We see two kinds of epistemic uncertainty allegedly playing this justificatory role. What we call ‘normative (...) epistemic uncertainty’ emerges from dealing with the problem of value uncertainty in justifying applied principles when our higher-level principles are open-textured, that is, when their content is too vague or unclear to generate determinate prescriptions. What we call ‘descriptive epistemic uncertainty’ emerges from dealing with uncertainty about empirical facts, such as the problem of moral assurance, that is, the problem that the requirements of justice cannot go beyond arrangements that we can know with reasonable confidence that we can jointly establish and maintain. In both cases, practice-dependent theorists conclude that the condition of epistemic uncertainty justifies a practice-dependent approach, which puts certain restrictions on theorizing regulative principles and has wide-ranging practical implications for the scope of justice. Our claim in this paper is that neither kind of epistemic uncertainty justifies a practice-dependent approach. (shrink)

In a series of papers, Jesper Kallestrup and Duncan Pritchard argue that the thesis that knowledge is a cognitive success because of cognitive ability (robust virtue epistemology) is incompatible with the idea that whether or not an agent’s true belief amounts to knowledge can significantly depend upon factors beyond her cognitive agency (epistemic dependence). In particular, certain purely modal facts seem to preclude knowledge, while the contribution of other agents’ cognitive abilities seems to enable it. Kallestrup and Pritchard’s arguments are (...) targeted against views that hold that all it takes to manifest one’s cognitive agency is to properly exercise one’s belief-forming abilities. I offer an account of the notion of cognitive ability according to which our epistemic resources are not exhausted by abilities to produce true beliefs as outputs, but also include dispositions to stop belief-formation when actual or modal circumstances are not suitable for it (precautionary cognitive abilities). Knowledge, I argue, can be accordingly conceived as a cognitive success that is also due to the latter. The resulting version of robust virtue epistemology helps explain how purely modal facts as well as other agents’ cognitive abilities may have a bearing on the manifestation of one’s cognitive agency, which shows in turn that robust virtue epistemology and epistemic dependence are not incompatible after all. The answer to philosophical questions will often depend on the position one takes regarding the fact-value problem. It is, therefore, not surprising that, in the tradition of western philosophy, the past 200 years or so record an animated discussion of it. In the present collection the debate is continued by representatives of various "schools" in contemporary western thought. A number of philosophers from non-western cultures, too, enter into it. The contributions do not all reflect on the same theme, nor (...) do they use the same approach. Essays written by philosophers sympathetic to the analytical tradition are followed by reflections on the part of those inspired by phe nomenology. A third group of contributions is by non-western thinkers, who are more likely to approach the problem in terms of culture. Their engage ment with the issue clearly shows, among other things, that it is almost exclusively in the western tradition that the fact-value distinction is often understood as an outright dichotomy. The occasion for the publication of this collection is Dr. Cornelis Anthonie van Peursen's retirement as Professor of Philosophy. This year he leaves the Free University, Amsterdam; until 1982 he was professor at the University of Leyden as well. In the Netherlands and beyond he has become known for his concern with constructive comparison of diverging philosophical trends and the cross-cultural fertilization of thought. Characteristic of his career are his efforts to render the results of academic philosophizing understand able to a broader audience. (shrink)

The dominant view about the nature of aesthetic value holds it to be response-dependent. We believe that the dominance of this view owes largely to some combination of the following prevalent beliefs: 1 The belief that challenges brought against response-dependent accounts in other areas of philosophy are less challenging when applied to response-dependent accounts of aesthetic value. 2 The belief that aesthetic value is instrumental and that response-dependence about aesthetic value alone accommodates this purported fact. 3 The belief that (...) response-dependence about aesthetic value alone accommodates the widely acknowledged anthropocentricity of aesthetic value. 4 The belief that response-dependence about aesthetic value alone accommodates aesthetic normativity. We argue that each of these beliefs is false, and that the dominance of response-dependent accounts of aesthetic value is therefore largely without foundation. (shrink)

Abstract Under the influence of Hilary Putnam’s collapse of the fact/value dichotomy, a resurging approach that challenges the movements of American pragmatism and discourse ethics, I tease out in the first section of my paper the demand for the warranted assertibility hypothesis in Putnam’s sense that may be possible, relying on moral realism to get rid of ‘rampant Platonism’. Tracing back to ‘communicative action’ or the Habermasian way that puts forward the reciprocal understanding of discourse instigates the idea of (...) life-world as composed of ‘culturally transmitted and linguistically organized stock of interpretative patterns’, this section looks for whether Habermas’ psychoanalysis of prolonged discussion can accord with Putnam’s thick ethical terms or not. The last section of the paper pitfalls Putnam’s stance to accepting Habermas’ ‘discourse ethics’ that centers around the context of entangling ‘rational thoughts’ to ‘communication’, but he introduces the idea of fallibilism in a rational query that also attacks the Habermasian metaphysical idea of the validity of ethical statements that goes towards the truth. My next attempt is to see whether Putnam’s objective dictum towards morality that resonates the collapse of fact/value dichotomy from a universalistic stand can successfully evade Rorty’s naive realism (structured by linguistic representation) and Habermas’ ‘sociologism about values’ (a kind of minimalist ethics depending on solidarity) respectively. This sort of claim insists on a universalizable pattern of culture-relative value. I consider that the idea of a fact/value dichotomy engages with the inextricable entanglement between the normative and descriptive content, besides the epistemic values having exclusively intertwined with the structure of factual discourse that intends towards collapsing the fact/value dichotomy, a subjective universalizability predilection. An increasingly popular approach to reconciling divine foreknowledge with human freedom is to say that, because God’s beliefs depend on what we do, we are free to do otherwise than what we actually do despite God’s infallible foreknowledge. This paper develops a new challenge for this dependence response. The challenge stems from a case of backward time travel in which an agent intuitively lacks the freedom to do otherwise because of the time-traveler’s knowledge of what the agent will do, and (...) this is so despite the fact that the time-traveler’s knowledge depends on what the agent will do. In this commentary piece, I argue that Asay’s accounts of truth and truthmaking in A Theory of Truthmaking give no role to the idea that truth depends on being. In fact, some of the positions taken in the book are in tension with this idea that has been central to truthmaker theory. I consider how three aspects of Asay’s account relate to the idea that truth depends on being.

While the Value-Free Ideal of science has suffered compelling criticism, some advocates like Gregor Betz continue to argue that science policy advisors should avoid value judgments by hedging their hypotheses. This approach depends on a mistaken understanding of the relations between facts and values in regulatory science. My case study involves the morning-after pill Plan B and the “Drug Fact” that it “may” prevent implantation. I analyze the operative values, which I call zygote-centrism, responsible for this hedged drug label. (...) Then, I explain my twofold account of value-ladenness, involving the constitutive role of value judgments in science and the social function of facts as political tools. Because this drug fact is ineliminably value-laden in both senses, I conclude that hedged hypotheses are not necessarily value-free. (shrink)

Which function is computed by a Turing machine will depend on how the symbols it manipulates are interpreted. Further, by invoking bizarre systems of notation it is easy to define Turing machines that compute textbook examples of uncomputable functions, such as the solution to the decision problem for first-order logic. Thus, the distinction between computable and uncomputable functions depends on the system of notation used. This raises the question: which systems of notation are the relevant ones for determining whether a (...) function is computable? These are the acceptable notations. Acceptable notations for natural numbers are ones that we can count with. Acceptable notations for logical formulas are the ones that we can use in inference and logical analysis. And so on. This criterion makes computability a relative notion—whether a function is computable depends on which notations are acceptable, which is relative to our interests and abilities. I argue that this is not a problem, however, since there is independent reason for taking the extension of computable function to be relative to contingent facts. Similarly, the fact that the use criterion makes a mathematical distinction depend on practical concerns is also not a problem because it dovetails with similar phenomena in other areas of computability theory, namely the roles of notation in computation over real numbers and of Extended Church’s Thesis in complexity theory. Moral dependence is taking another person's assertion or "testimony" that C as a reason to believe C (where C is some moral claim), such that whatever justificatory force is associated with the person's testimony endures or remains as one's reason for believing C. People are justified in relying on one another's testimony in non-moral matters. The dissertation takes up the question whether the same is true for moral beliefs. My method is to divide the topic into three somewhat separate questions. (...) First, there is the epistemological question, what if anything gives me reason to believe that another person's moral claim is likely to be true. Second, there is the psychological question, whether moral dependence is, in fact, part of the rational explanation of why people hold the moral beliefs they do. Third, there is the moral question, whether a person can be a good moral agent while being morally dependent. I answer these questions as follows. First, in response to the epistemological question, I argue that there is a justification for moral dependence based on identifying people who are good moral deliberators. I also argue that there is an unreliable justification for moral dependence based on cooperation and trust. This latter, trust-based justification is unreliable because it is possible to trust and cooperate with those who are morally bad. Second, in response to the psychological question, I argue that moral dependence is part of the rational explanation of moral belief. This is true even though there is some reason to hold that a testimonial justification cannot rationally explain moral belief when there is also a non-testimonial justification available for that same belief. I also argue that moral dependence rationally explains moral development, both because it explains how children come to believe the particular things they do, and also because it can explain how children come to employ new forms of moral justification. Third, in response to the moral question, I argue that autonomy limits moral dependence, but that relying on moral testimony can also bring one to be more aware of what is morally important. In this paper I argue for the incompatibility of three claims, each of them quite attractive to a theist. First, the doctrine of deep dependence: the universe depends for its existence, in a non-causal way, on God. Second, the doctrine of true transcendence: the universe is wholly distinct from God; God is separate and apart from the universe in respect of mereology, modes, and mentality. Third, the doctrine of robust creaturely freedom: some creature performs some act such that he could (...) have done other than he in fact did. After laying out the claims, I show that their conjunction has its adherents—most clearly, the medieval Jewish philosopher, Maimonides. I then argue in detail that the claims are in fact incompatible. I conclude with a discussion of which of the claims is best jettisoned, drawing in part on the work of the Absolute Idealist, Mary Calkins. (shrink)

This paper calls for a paradigm shift in studying academic dependency, towards the paradigm of brokered dependency. Using Chinese academia as an example, I demonstrate how the neocolonial condition of academic dependency is always mediated through blockage-brokerage mechanisms. The two most salient blockage-brokerage mechanisms of dependency in the Chinese context are linguistic barrier and authoritarian malepistemization, and the effects of the latter consist of three layers: institutional, informational and incorporational. On top of their domestic impacts, those (...) mechanisms jointly exacerbate spectacularized postcoloniality in anglophone-hegemonic global academic publishing. The paradigm of brokered dependency not only represents a more nuanced approach to the study of academic dependency, but also underscores the fact that the dismantling of the neocolonial condition cannot be conceived and pursued in isolation from comprehending and confronting the authoritarian condition, especially when the latter pertains under the disguise of anticolonialism. Ontological dependence and grounding are two important items in the metaphysician’s toolbox: both notions can be used to formulate important philosophical claims and to define other notions that play a central role in philosophical theorising. Philosophical inquiry about ontological dependence and (especially) grounding has been very lively over the past few years, making it difficult to write a short review article on any of them, let alone a short review article on both. I try to reach a good compromise between (...) a discussion of each notion taken separately and a discussion of how they relate to one another. I begin by introducing the notions and discussing a number of their connections with modality (Sections 9.1 and 9.2), starting with grounding for systematic reasons (some important concepts of ontological dependence are defined in terms of grounding). I then further the discussion of how the notions are connected to each other, by arguing against the view that (partial) grounding is equivalent to (the converse of) ontological dependence between facts (Section 9.3). Finally, I discuss their respective roles in the theory of fundamentality (Section 9.4). (shrink)

Contemporary industrialized societies have been confronted with the fact and consequences of women's increased participation in paid employment. Whether this increase has resulted from women's desire for equality or from changing economic circumstances, women and men have been faced with a crisis in the organization of work that concerns dependents, that is, those unable to care for themselves. This is labor that has been largely unpaid, often unrecognized, and yet is indispensable to human society.

I have sketched the well-known distinction between facts and evidence not to defend or attack it , but rather as a preface to a key episode in the history of the conceptual categories of fact and evidence. My question is neither, “Do neutral facts exist?” nor “How does evidence prove or disprove?” but rather, “How did our current conceptions of neutral facts and enlisted evidence, and the distinction between them, come to be?” How did evidence come to be incompatible (...) with intention, and is it possible to imagine a kind of evidence that is intention-laden?It is my claim that partial answers to these questions lie buried in the sixteenth- and seventeenth-century literature on prodigies and miracles. I shall argue that during this period prodigies briefly became the prototype for a new kind of scientific fact, and that miracles briefly exemplified a form of evidence patent to the senses and crucially dependent on intention. Both conceptions diverge sharply not only from current notions of facts and evidence, but also from medieval views on the nature of prodigies and miracles. Prodigies were originally closely akin to portent, divine signs revealing God’s will and things to come; miracles were more intimately associated with the private experience of grace than with the public evidence of the senses. Prodigies were transformed from signs into nonsignifying facts, and miracles into compelling evidence, as part of more sweeping changes in natural philosophy and theology in the mid-seventeenth century. Although at first glance, “facts” are the paradigms of straightforwardness, something about facts seems to invite perpetual controversy and dichotomizing. Innumerable bifurcations on the topic have included "Facts vs. Theories”, “Facts vs. Appearance”, "Facts vs. Values", ... and, popular nowadays, "(Real)Facts vs. Fake Facts". This paper most aligns with the facts vs. theories model, so far as whatever facts are, theories seem to be constructed stories that are necessary for connecting and interpreting the facts. Yet the boundary between the two (...) is fluid and fuzzy: Fact in one context is theory in another, depending on what is being accepted or contested at the time. This paper’s views are compatible with—but neutral on the plausibility of having—an optimism like Peirce’s that scientific inquiry may nonetheless converge towards a consensus. This paper analyzes legal fact-argumentation in the framework of the argumentation-based litigation game by Xiong :16–19, 2012). Rather than as an ontological one, an ALG treats a legal fact as a fact-qua-claim whose acceptability depends on the reasons supporting it. In constructing their facts-qua-claims, parties to an ALG must interact to maintain a game-theoretic equilibrium. We compare the general interactional constraints that the civil and common law systems assign, and detail what the civil, administrative, and criminal codes (...) of mainland China require of the suitor, the respondent, and the trier to establish their respective S-, R- and T-facts. No absolute distinction exists, and pure `brute facts' do not exist in law because of the socialisation of physical world and juridification of the social world.; also, the effect of evidentiary constraints. We introduce generalized quantifiers, as defined in Tarskian semantics by Mostowski and Lindström, in logics whose semantics is based on teams instead of assignments, e.g., IF-logic and Dependence logic. Both the monotone and the non-monotone case is considered. It is argued that to handle quantifier scope dependencies of generalized quantifiers in a satisfying way the dependence atom in Dependence logic is not well suited and that the multivalued dependence atom is a better choice. I explore the Because Constraint—the idea that moral facts depend on natural facts and that moral judgements ought to respect the dependence of moral facts on natural facts. I consider several issues concerning its clarification and importance.

Norms explained as grounds of practical judgment, using example of queue. Some norms informal, inexact, depend on common understanding ; some articulated in context of two-tier normative order: `rules', explicit or implicit. Logical structure of rules displayed. Informal and formal normative order explained, `institutional facts ' depend on acts and events interpreted in the light of normative order. Practical force of rules differentiated; either `absolute application' or `strict application' or `discretionary application', depending on second-tier empowerment. Discretion can be guided by (...) values, principles standards. This paper takes it as a premise that a distinction between matters of fact and of law is important in the causal inquiry. But it argues that separating factual and legal causation as different elements of liability is not the best way to implement the fact/law distinction. What counts as a cause-in-fact is partly a legal question; and certain liability-limiting doctrines under the umbrella of “legal causation” depend on the application of factual-causal concepts. The contrastive account of (...) factual causation proposed in this paper improves matters. This account more clearly distinguishes matters of fact from matters of law within the cause-in-fact inquiry. It also extends the scope of cause-in-fact to answer some questions currently answered by certain doctrines of legal causation—doctrines that, it is argued, are more naturally seen as applications of our ordinary causal concept than as noncausal liability-limiting devices. Theories of the liberal tradition have relied on independence as a norm of personhood. Feminist theorists such as Eva Kittay in Love's Labor have been instrumental in critiquing normative independence. I explore the role of corporeal vulnerability in Kittay's account of personhood, developing a comparison to the role it plays in Thomas Hobbes's Leviathan. Kittay's crucial contribution in Love's Labor is that once we acknowledge the facts of corporeal vulnerability, we must not only acknowledge but also affirm dependency in (...) a genuinely inclusive affirmation of personhood. While endorsing Kittay's “dependency critique,” I discover difficulties that beleaguer Kittay's development of new norms of personhood. I trace these to a dependency of Kittay's account on a crucial premise of the liberal model it resists. I argue that in order to affirm dependency in a manner that departs more thoroughly from the criticized aspects of liberal personhood, we must cease to position it in a dichotomy of power and vulnerability. I suggest that attending to the corporeality of vulnerability can aid us in developing the terms of a discourse affirming relational personhood while undermining that dichotomy. (shrink)

The first hurdle to overcome in approaching the complex topic of the relation between language and consciousness is terminology. So let me begin, in good philosophical style, by explaining the senses in which I use the three lexical terms in the title. Luckily I need not explain those of the three grammatical words the, of, and on: there is probably a minor library of semantic literature devoted to that. I need not, since I both know their meanings pre-theoretically, and know (...) that my readers, as users of English, know them. The significance of this simple fact concerning the meaning of all everyday words, in everyday constructs, is something that I will return to, since it plays a central role in the argument in Section 2. However, with abstract, theoretically loaded nominalizations such as dependence, language, and most of all consciousness, we need to beware since we cannot assume common knowledge -- myriads of misunderstandings arise since we mean somewhat different 'things' by them. I start with the easiest, by which I mean specifically ' dependence of language on consciousness', explaining only afterward what I mean by the latter terms. Mathematically, gauge theories are extraordinarily rich --- so rich, in fact, that it can become all too easy to lose track of the connections between results, and become lost in a mass of beautiful theorems and properties: indeterminism, constraints, Noether identities, local and global symmetries, and so on. -/- One purpose of this short article is to provide some sort of a guide through the mathematics, to the conceptual core of what is actually going on. Its focus is on (...) the Lagrangian, variational-problem description of classical mechanics, from which the link between gauge symmetry and the apparent violation of determinism is easy to understand; only towards the end will the Hamiltonian description be considered. -/- The other purpose is to warn against adopting too unified a perspective on gauge theories. It will be argued that the meaning of the gauge freedom in a theory like general relativity is (at least from the Lagrangian viewpoint) significantly different from its meaning in theories like electromagnetism. The Hamiltonian framework blurs this distinction, and orthodox methods of quantization obliterate it; this may, in fact, be genuine progress, but it is dangerous to be guided by mathematics into conflating two conceptually distinct notions without appreciating the physical consequences. What is not s0 clear, however, is how this indebtedness is t0 bc understood: What precisely docs it mean t0 say that the political theories 0f Hegel and Rousseau share the same first principlc? In this paper I intend t0 follow up 0n this interpretive suggestion 0f Hcgcl’s by claborating, much more explicitly than he himself docs, thc sense in which R0usscau’s political thought is founded 011 thc principle 0f the "frcc wiil." While accomplishing this task will put us in a better position t0 clarify thc obscurc philosophical strategy behind Hcgcl’s 0wn social theory, my primary interest here is t0 illuminate thc foundations 0f R0usscau’s political thought, especially its account 0f the connection between freedom and the general will. I argue that it is necessary t0 distinguish two ways in which Rousseau takes the general will t0 secure, or realize, thc freedom of individual citizens, namely, by functioning as an embodiment as well as a precondition of such freedom. Understanding both 0f these points will lead us t0 scc: that R0usscau’s thought rests 0n two distinct, though not incompatible, accounts 0f how citizens whose actions are constrained by thc general will are in fact subject 0nly to their 0wn wills and therefore free in their 0bcdience to thc general will. This book presents the first systematic account of dependency care in a liberal theory of justice. Despite the fact that receiving dependency care is necessary for human survival, the practices with which we meet society’s care needs are seldom recognized for their functional role. Instead, norms about gender and race obscure and shape expectations about whose needs for care are legitimate as well as about whose caregiving labor more advantaged members of society will receive. These opaque arrangements (...) must be made visible if we are to remedy skewed intuitions and judgements about care. Freedom to Care develops a modified form of social contract theory with which to evaluate society’s caregiving arrangements. Building on work by feminist liberals and care ethicists, it reframes debates about care to move beyond gender with an inequality-tracking framework that can be employed in any culture. Because care provision has been enmeshed in the subordination of women and people of color, eliminating the invisibility of these forms of labor yields a critical liberal theory of justice with feminist and anti-racist aims. Within the standard structuralist approach, the theoretical description of a system by means of an empirical theory T is regarded as an extension process in which partial models are extended into models of T by supplementing suitable T-theoretical functions. Thereby, it is taken for granted that the base sets, on which these functions or relations are defined, can be assumed as given independently of the theory in question. My aim in this paper is to show that, in many cases, this (...) assumption is not justified. I will argue that this fact—which may be seen as a mere technical complication on first sight—turns out to have profound consequences for core concepts of the structuralist framework: First, the concept of intended applications has to be reconsidered. Second, the extension process has to be described in a more differentiated and complex way. Third, the theory-dependent determination of base sets has major implications concerning the defense mechanisms of empirical theories against conflicting observational data. (shrink)

Using longitudinal, ethnographic data, the authors examine how the pursuit of self-sufficiency in the context of welfare reform may unintentionally encourage some women to develop alternative dangerous dependencies on abusive or potentially abusive men. In this article, the authors document how women ended up relying on men who have been abusive to them either for instrumental assistance or for more direct financial assistance as they struggled to move from welfare to work. The authors also document how some extremely disadvantaged and (...) vulnerable women became enmeshed in even more dangerous dependencies as they hit time limits and fell through public and private safety nets into drug addiction and sex work. The authors frame this discussion of dangerous dependencies with the recognition that dependency relations are necessary and inevitable components of carework. They argue that the discourse of self-sufficiency should acknowledge the fact that careworkers are productive citizens to the same extent as paid laborers and grapple with the question of the means through which they can support that productivity when personal resources are limited and paid labor is temporarily or permanently impossible. According to Wright’s Judgement-Dependent account of intention, facts about a subject’s intentions can be taken to be constituted by facts about the subject’s best opinions about them formed under certain optimal conditions. This paper aims to defend this account against three main objections which have been made to it by Boghossian, Miller and implicitly by Wright himself. It will be argued that Miller’s objection is implausible because it fails to take into account the partial-determination claim in this account. Boghossian’s objection (...) also fails because it is based on an unjustified reductionist reading of Wright’s account. However, Wright’s own attempt to resist Boghossian’s objection seems to display a shift from his Judgement-Dependent account to an Interpretationist account of self-knowledge, in which case Wright’s new account would face the same problem which he himself has previously put forward in the case of Davidson’s Interpretationist account of self-knowledge. Nonetheless, I will argue that Wright does not need to make such a move because Boghossian’s objection is not applicable to his account. (shrink)

The practice-dependent approach to justice has received a lot of attention in post-millennium political philosophy. It has been developed in different directions and its normative implications have been criticized, but little attention has been directed to the very distinction between practice-dependence and practice-independence and the question of what theoretically differentiates a practice-dependent account from mainstream practice-independent accounts. The core premises of the practice-dependent approach, proponents argue, are meta-normative and methodological. A key feature is the presumption that a concept of justice (...) is dependent on the function or aim of the social practices to which it is supposed to be applied. Closely related to this meta-normative thesis is an interpretive methodology for deriving principles of justice from facts about existing practices, in particular regarding their point and purpose. These two premises, practice-dependent theorists claim, differentiate their account since they are not accepted by practice-independent accounts and they justify different principles of justice than practice-independent accounts. Our aim in this article is to refute both and, demonstrating that practice-independent accounts may indeed accept the meta-normative and methodological premises of the practice-dependent accounts, and that we are given no theoretical reason to think that practice-dependent accounts justify other principles of justice for a practice than do practice-independent accounts. In other words, practice-dependent theorists have not substantiated their claim that practice-dependence is theoretically differentiated from mainstream accounts. When practice-dependent proponents argue for other principles of justice than mainstream theorists, it will be for the usual reason in normative theory: their first-order normative arguments differ.
