The paper is written in response to those who fail to recognize the relation between a patient's mental competency and her state of pain. Some clinicians claim that a proper diagnosis can only be made in the absent of analgesia. Rather, the patient's state of pain directly affects her mental competency and thus her ability to give valid consent. Clinicians should rethink their approach to diagnosis when the patient is in pain.

Big Data Analytics promises to help companies and public sector service providers anticipate consumer and service user behaviours so that they can be targeted in greater depth. The attempts made by these organisations to connect analytically with users raise questions about whether surveillance, and its associated ethical and rights-based concerns, are intensified. The articles in this special themed issue explore this question from both organisational and user perspectives. They highlight the hype which firms use to drive consumer, employee and service (...) user engagement with analytics within both private and public spaces. Further, they explore extent to which, through Big Data, there is an attempt to expand surveillance into the emotional registers of domestic, embodied experience. Collectively, the papers reveal a fascinating nexus between the much-vaunted potential of analytics, the data practices themselves and the newly configured intimate spheres which have been drawn into the commercial value chain. Together, they highlight the need for conceptual and regulatory innovation so that analytics in practice may be better understood and critiqued. Whilst there is now a rich variety of scholarship on Big Data Analytics, critical perspectives on the organising practices of Big Data Analytics and its surveillance implications are thin on the ground. Combined, the articles published in this special theme begin to address this shortcoming. (shrink)

The emergence of Big Data has added a new aspect to conceptualizing the use of digital technologies in the delivery of public services and for realizing digital governance. This article explores, via the ‘value-chain’ approach, the evolution of digital governance research, and aligns it with current developments associated with data analytics, often referred to as ‘Big Data’. In many ways, the current discourse around Big Data reiterates and repeats established commentaries within the eGovernment research community. This body of knowledge provides (...) an opportunity to reflect on the ‘promise’ of Big Data, both in relation to service delivery and policy formulation. This includes, issues associated with the quality and reliability of data, from mixing public and private sector data, issues associated with the ownership of raw and manipulated data, and ethical issues concerning surveillance and privacy. Chalmers (The Conscious Mind, Oxford Unversity Press, Oxford 1996) has argued for a form of property dualism on the basis of the concept of a zombie (which is physically identical to normals), and the concept of the inverted spectrum. He asserts that these concepts show that the facts about consciousness, such as experience or qualia, are really further facts about our world, over and above the physical facts. He claims that they are the hard part of the mind-body issue. He (...) also claims that consciousness is a fundamental feature of the world like mass, charge, etc.He says that consciousness does not logically supervene on the physical and all current attempts to assert an identity between consciousness and the physical are just as non-reductive as his dualism. They are simply correlations and are part of the problem of the explanatory gap. In this paper, three examples of strong identities between a sensation or a quale and a physiological process are presented, which overcome these problems. They explain the identity in an a priori manner and they show that consciousness or sensations (Q) logically supervene on the physical (P), in that it is logically impossible to have P and not to have Q. In each case, the sensation was predicted and entailed by the physical. The inverted spectrum problem for consciousness is overcome and explained by a striking asymmetry in colour space. It is concluded that as some physical properties realize some sensations or qualia that human zombies are not metaphysically possible and the explanatory gap is bridged in these cases. This article explores the emergence of standards and regulation associated with the provision of Closed Circuit Television (CCTV) surveillance systems in the United Kingdom. It argues that despite the intrusive and controlling nature of CCTV technology there is limited formal intervention in the form of legislation, governing its introduction and use. Instead government has sought to influence the regulation of the technology indirectly through its ability to shape and govern policy networks in the policy arena. Bernard Williams’ Shame and Necessity (1993) was an influential early contribution to what has become a broader movement to rehabilitate shame as a moral emotion. But there is a tension in Williams’ discussion that presents an under-appreciated difficulty for efforts to rehabilitate shame. The tension arises between what Williams takes shame in its essence to be and what shame can do—the role that shame can be expected to play in ethical life. Williams can—and we argue, should—be read as avoiding the (...) difficulties stemming from this tension, but this requires a reevaluation of several of his central claims about shame’s role in ethical thought and experience. For instance, his broad claims that the “structures of shame” can “give a conception of one’s ethical identity” (93), and that shame “mediates … between ethical demands and the rest of life” (102), cannot be taken at face value. What emerges is a view that is in a sense less ambitious, but also more in tune with the spirit of Williams’ larger project. There may also, we suggest, be a more general lesson: We should be suspicious of the temptation to seek some special affinity between shame and ethical life, lest we distort our understanding of both. The title of this presentation encompasses three issues: (1) an enigmatic theme (the play of signs and signs of play); (2) a model of doing something, such as unraveling a puzzle; and (3) a methodology dealing with a probable case. Considering that the order of analysis runs in the opposite direction to the order of experience, my first task is to reverse the title. Then, its three parts become: (1) an eidetic and empirical conjunction that implies a taste for evidence; (...) (2) a rigorous model of analysis that implies a relationship between ontology (what I know) and epistemology (how I know); and (3) a case that brings an enigmatic theme. My title, based in the theme of our 42nd Annual Meeting, provided an experience peculiar to a non-native English speaker: how to interpret and use the word “play”. I really felt like I was a living exemplar of one of Professor Lanigan’s favorite examples: what dictionaries and encyclopedias say or do not say. Lanigan said that “dictionaries tell you how to use the words (forms, ideas) but not what word to use” and “encyclopedias tell you what facts to use (structure, experience), but not how to use them” (1992: 208–209). That was my situation with the word “play”. Webster’s dictionary gave me around fifty different meanings for the word “play”. Which one should I choose? I am sure that I made the best choice, as I will demonstrate throughout this presentation, organized around these three ideas that in an inverse order would be theory, method, and case. (shrink)

I do so by affording William Maker’s under-appreciated account of Hegel’s realism more of the attention and scrutiny it deserves—not least because it involves a distinctively simple and elegant account of the famously obscure move from logic to nature in Hegel’s system. It is the author's contention that much of the current philosophical discussion of animal welfare is misdirected now that it is possible to measure to some extent what animals think and feel and how much they can appreciate their quality of life. The (...) book deals with farm animals, pets, wild animals and laboratory animals and dicusses their environmental requirements, fear and stress, their response to pain, injury, disease and death, behaviour and aggression, and the implications of biotechnology and genetic engineering. Finally, the book tries to reconcile reverence for life with the inescapability of killing and reviews the prospects of preserving and enhancing quality of life for animals through legislations, education, economic and moral incentives. Narratives of hope are omnipresent in democratic life, but what can they tell us about the structure and orientation of politics? While common, they are often reduced to an all-compassing understanding that overlooks hope's various forms and implications. Democratic theory, however, lacks the theoretical language to attend to these distinctions. The aim of this essay is thus to define a collective and political account of hope and recover the normative basis of a democratic theory of hope. Drawing on the literature (...) on hope and juxtaposing it with extracts from Harvey Milk's ‘The Hope Speech,’ I first distinguish its collective experience before turning to Hannah Arendt. While Arendt rejects a politics of hope that turns away from the world, exploring how she thinks with and against hope provides a theoretically fruitful approach that elevates the in-betweenness of its worldly expression. From that standpoint, I relate the work and experience of hoping with others to her notions of natality, action and promises. These three conceptual touchstones provide the normative basis of a democratic theory of hope and help situate a collective sense of possibility inherent in democratic politics. (shrink)

John Webster provides a major scholarly analysis, the first in any language, of the final sections of the Church Dogmatics. He focuses on the theme of human agency in Barth's late ethics and doctrine of baptism, placing the discussion in the context of an interpretation of the Dogmatics as an intrinsically ethical dogmatics. The first two chapters survey the themes of agency, covenant and human reality in the Dogmatics as a whole; later chapters give a thorough analysis of Church (...) Dogmatics IV/4 and the posthumously published text The Christian Life. A final chapter examines the significance of Barth's work for contemporary accounts of moral selfhood. The book is important not only for a detailed analysis of a neglected part of Barth's oeuvre, but also because it casts into question much of what has hitherto been written about Barth's ethical dogmatics. Some people of colour feel shame in response to racist incidents. This phenomenon seems puzzling since, plausibly, they have nothing to feel shame about. This puzzle arises because we assume that targets of racism feel shame about their race. However, I propose that when an individual is racialised as non-White in a racist incident, shame is sometimes prompted, not by a negative self-assessment of her race, but by her inability to choose when her stigmatised race is made salient. I argue (...) that this can make sense of some shame responses to racism. My account also helps to highlight some of the emotional and cognitive costs of racism that have their root in shame as well as a new form of hermeneutical injustice and distinctive communicative harms, contributing to a fuller picture of what is objectionable about racism. The separating and isolating tendencies of measuring practices can lead educators to lose sight of the aims and purposes of education. These end purposes can be used to guide and ensure that the activities of educators are educational, and therefore, Biesta recommends there is a need for educators to reconnect with them. This article. explores this notion of a ‘reconnection’ and argues that if educators are to challenge any potentially miseducative measuring practices, then this reconnection must require educators to value (...) and desire particular end purposes. Desires are recognised to be existential in character and are identified as being necessary for initiating actions. It is argued here that this aspect of desires is important for understanding the significance of a ‘reconnection’ because without it the purposes of education may remain only as abstract philosophical ideals. To make a difference and to challenge the isolating and miseducative tendencies of some measuring practices, educators must come to value particular purposes of education, and in addition, they must exercise the courage to enact them. This can be made possible because educators strongly care for and desire the actualisation of the purposes to which they are connected. (shrink)

Liberal thinkers of the eighteenth and nineteenth centuries were alert to the political costs and human cruelties involved in European colonialism, but they also thought that European expansion held out progressive possibilities. In Progress, Pluralism, and Politics David Williams examines the colonial and anti-colonial arguments of Adam Smith, Immanuel Kant, Jeremy Bentham, and L.T. Hobhouse. Williams locates their ambivalent attitude towards European conquest and colonial rule in a set of tensions between the impact of colonialism on European states, the possibilities (...) of progress in distant and diverse places, and the relationship between universalism and cultural pluralism. In so doing he reveals some of the central ambiguities that characterize the ways that liberal thought has dealt with the reality of an illiberal world. Of particular importance are appeals to various forms of universal history, attempts to mediate between the claims of identity and the reality of difference, and the different ways of thinking about the achievement of liberal goods in other places.
