Legal theory usually distinguishes only two kinds of legal realism: the American and the Scandinavian. Another school of this theoretical perspective is German legal realism, which refers to scholars like Ihering, Weber, and Schelsky. According to German legal realism, the author outlines what legal theory can do to persuade modern jurisprudence to face the social reality of law, conceived as institutionalized normative communication. Weber’s improvised reply to Werner Sombart’s lecture on ‘Technology and Culture’, presented at the first meeting of the German Sociological Society in 1910, opens and closes with an appeal to uphold the principle of ‘value-freedom’ in academic discussions. Referring to the capitalist development of antiquity as an illustration, Weber argues for a factually precise conception of technology and against a Marxist definition in terms of economic causality or property relations. Turning to the influence of technology in the (...) development of formal aesthetic values, his primary emphasis is on how the modern metropolis gives rise to new forms of literature, painting, architecture and especially orchestral music. The editorial notes to this translation place Weber’s remarks in the context of his critical relationship to predecessors and contemporaries and within the thematic development of his career-long studies on the rise of occidental rationalism. With the collapse of the bipolar system of global rivalry that dominated world politics after the Second World War, and in an age that is seeing the return of "ethnic cleansing" and "identity politics," the question of violence, in all of its multiple ramifications, imposes itself with renewed urgency. Rather than concentrating on the socioeconomic or political backgrounds of these historical changes, the contributors to this volume rethink the _concept_ of violence, both in itself and in relation to the formation (...) and transformation of identities, whether individual or collective, political or cultural, religious or secular. In particular, they subject the notion of self-determination to stringent scrutiny: is it to be understood as a value that excludes violence, in principle if not always in practice? Or is its relation to violence more complex and, perhaps, more sinister? Reconsideration of the concepts, the practice, and even the critique of violence requires an exploration of the implications and limitations of the more familiar interpretations of the terms that have dominated in the history of Western thought. To this end, the nineteen contributors address the concept of violence from a variety of perspectives in relation to different forms of cultural representation, and not in Western culture alone; in literature and the arts, as well as in society and politics; in philosophical discourse, psychoanalytic theory, and so-called juridical ideology, as well as in colonial and post-colonial practices and power relations. I offer a stylized account of their common ideas and shared political sensibility, and argue that their primarily negative liberalism was a variety of what Judith Shklar called the `liberalism of fear' — which put the imperative to avoid cruelty and atrocity first. All three founded their liberalism on a `politics of knowledge' that was directed (...) primarily against Marxist philosophies of history and less against the idea of bureaucratic planning, as, in contrast, was the case with Friedrich von Hayek's thought. Moreover, all three subscribed to more or less explicit versions of value pluralism, and claimed that, in the circumstances of modernity, Weber's `clash of values' was exacerbated and required a particularly prudential approach to politics; this prudential management of value conflicts in turn was best entrusted to cultivated bureaucratic elites. All shared an image of a tolerant and humane society — essentially an idealized version of Britain — but said perhaps too little on the question how societies without the appropriate traditions of moderation and compromise were to be liberalized. This volume celebrates the life achievements of Jason W. Brown, who, along with Jean Piaget, Heinz Werner, Alexander Luria and the Wurzburg school, has significantly contributed to the development of a process-based theory of brain/mind capable of challenging the currently fashionable modularist or cybernetic approaches to understanding human thought and feeling. As a paradigm, Brown's microgenetic theory is thus applicable in both brain science (where Brown was inspired by the pioneering work of Schilder and Pick) and the philosophy of (...) mind (where the influence of Bergson, Whitehead, Cassirer, and Merleau-Ponty can be seen). The article starts from an examination of the authorship of the ‘Geleitwort’, the programmatic statement which appeared in the Archiv für Sozialwissenschaft when it came under new editors in 1904. Recently scholars have begun to view it as an important text by Max Weber recovered from obscurity, but this is a mistake. Examination of major contemporary works by Weber and Werner Sombart – the obvious co-author – as well as the first public disclosure of an entirely new (...) MS. by Weber, show that in all probability the text was drafted by Sombart and then revised fairly lightly by Weber. This story of a combined, if unequal, authorship leads into two broader seams of intellectual history: the relationship between Weber and Sombart, and the history of the Archiv as a journal. An unusual starting point thus casts fresh and unexpected light on some of the most central figures and episodes in German social science at the beginning of the 20th century, not least Weber's seminal essay on “Objectivity” in social science. ☆ This paper relies on intellectual interchange and the generosity of colleagues to a quite unusual degree. Analyzing (...) the cultural significance of modern ascetic rationalism, Weber initially wanted to extend the PE stepping back in time and study the historical development of methodical rational ways of life preceding the Reformation. Between publication of the PE essays and his death in 1920, Weber then specified his research agenda and elaborated on his earlier views. First these specifications and elaborations were made as a response to a series of writings by Ernst Troeltsch, particularly The Social Teachings of the Christian Churches and Groups, 2 and later while preparing a study on The Christianity of the Occident as part of his Collected Essays in the Sociology of Religion. The purpose of this essay is to provide an analysis of Weber’s views on medieval religion as they evolved between 1904–5 and 1920, and to [End Page 465] show how Weber linked his explorations of medieval religion to his larger intellectual agenda, appropriating and transcending ideas current in contemporary historical and religious scholarship.Furthermore, I hope to demonstrate that the conclusions of the few existing studies of Weber’s views on this topic have to be revised. The paper analyzes Max Weber’s concepts of rationality and rationalization as components of modernization processes in modern society. The author reconstructs Weber’s interpretation of “spiritual factors” of social development, which emerge in the ethos of Protestantism. The research demonstrates how Weber’s study of capitalism in terms of rationality corresponds with concepts of other classics of German sociology, such as Ferdinand Tönnies, Werner Sombart, Georg Simmel and others. The article emphasizes the relevance of Weber’s sociology for (...) XX— XXI centuries and how its basic concepts and methodological approaches have been further developed by scholars, including Ukrainian ones. Weber’s concept of rationality is applicable not only to the mental-epistemological sphere, it also acquires a social meaning. This approach has gained recognition in phenomenological sociology, theory of social systems, communicative theory and more. In addition to the formal rationality of the economy, modern social sciences use such concepts as social, aesthetic, ethical, environmental, and practical rationality. Weber’s “diagnosis of the age” is still a component of the “diagnosis” of modern society. The gap between values and interests remains an integral feature of the “risks and threats society” in the XXI century. This situation is especially evident in international relations, when “real politics” (Realpolitik), based on interests, becomes insensitive to “value postulates”. The author also discovers ways of value (moral and ethical) reclamation of modern society, particularly in the concepts of “ethical economy”, universalist ethics of discourse, global ethos and more. Max Weber’s reply to Werner Sombart’s lecture on technology and culture, presented at the first meeting of the German Sociological Society held in Frankfurt in 1910, is discussed in terms of its conventional and improvised character as a distinctive mode of ‘sociological’ speech. Emphasis is placed on the specific rhetorical circumstances that gave rise to these remarks, especially with regard to Weber’s status as an authorized speaker at the meeting, and their formulation as a response to Marxist (...) theories accepted or criticized by members of the audience. In characterizing the relationship between technology and culture specifically as a topic of sociological discourse, Weber’s comments therefore constitute a speech-act in their own right. They both conform to the protocols of ‘value-free’ academic debate upheld by the Society and experiment with this new genre and forum of intellectual discussion. Weber’s innovative aspirations are ultimately in tension with his efforts to routinize or even rationalize the scholarly vocation ( Beruf) of sociology as both an inward calling and an institutionalized profession that can speak critically to the most pressing and relevant issues of the day. One way to detect, monitor and prevent adverse events with the help of Information Technology is by using ontologies capable of representing three levels of reality: what is the case, what is believed about reality, and what is represented. We report on how Basic Formal Ontology and Referent Tracking exhibit this capability and how they are used to develop an adverse event ontology and related data annotation scheme for the European ReMINE project.

The engineering-based approach of synthetic biology is characterized by an assumption that ‘engineering by design’ enables the construction of ‘living machines’. These ‘machines’, as biological machines, are expected to display certain properties of life, such as adapting to changing environments and acting in a situated way. This paper proposes that a tension exists between the expectations placed on biological artefacts and the notion of producing such systems by means of engineering; this tension makes it seem implausible that biological systems, especially (...) those with properties characteristic of living beings, can in fact be produced using the specific methods of engineering. We do not claim that engineering techniques have nothing to contribute to the biotechnological construction of biological artefacts. However, drawing on Descartes’s and Kant’s thinking on the relationship between the organism and the machine, we show that it is considerably more plausible to assume that distinctively biological artefacts emerge within a paradigm different from the paradigm of the Cartesian machine that underlies the engineering approach. We close by calling for increased attention to be paid to approaches within molecular biology and chemistry that rest on conceptions different from those of synthetic biology’s engineering paradigm.
