While positive information in the context of clinical care can lead to placebo effects, negatively framed information can have negative or nocebo effects. Extant literature documents how doctor–patient encounters are fertile ground for suboptimal interactions leading to negative experiences for ethnoracial minority patients. In their _JME_ paper, Blease presents a critical perspective on the potential for patients’ access to their doctors’ clinical notes, ‘open notes’, to engender nocebo effects. 1 In this commentary, we affirm the central claim that nocebo effects (...) could emerge ‘via negative wording or framing of health information expressed by clinicians in documentation’. The advent of electronic health records (EHR) allowed patients the unprecedented opportunity to access personal clinical documentation, giving them a window into decision making around their health. The precarious rights of senior citizens, especially those who are highly educated and who are expected to counsel and guide the younger generations, has stimulated the creation internationally of advocacy associations and opinion leader groups. The strength of these groups, however, varies from country to country. In some countries, they are supported and are the focus of intense interest; in others, they are practically ignored. For this is reason we believe that the creation of a network of all these associations (...) is essential. The proposed network would act as a support for the already-existing policies of the United Nations’ High Commission for Human Rights, of independent experts, and of the Global Alliance for the Rights of Older People. All three have long ago recommended the creation of a recognized instrument for uniting presently scattered efforts. The proposed network, therefore, will seek to promote the international exchange of relevant expertise, and it will reinforce the commitments and actions that single countries are currently taking to meet these objectives. For example, informative public events can be organised to promote particular support initiatives and to provide an opportunity for new members of the network to be presented. The network will promote health for senior citizens, disease prevention, senior mobility, safe free time for seniors, alimentary education, protection against new risks and dangers, as well as equity in the services necessary for seniors to adopt new information and communication technologies. In the case of retired academic members, the network will promote equality with respect to continuing use of digital technologies (particularly email), continuing access to research libraries, and the guaranteed ability for seniors to fund their own research programs and to deliver free seminars. In his essay of 1936, Benjamin acquires the arguments of all those authors who, between the first and second decades of the Twentieth century, had described this art and his new aura: Paul Valéry, George Duhamel, Léon Pierre-Quint, Luigi Pirandello, (...) Bertolt Brecht, Rudolph Arnheim. It is an art for the mass that has a positive but also negative side in individual perception. Benjamin considers the new man – be it mass-man (the audience) or man-tool – recruitable for a coming revolution, but at the end of the essay he raises a question concerning the whole of contemporary art from the Dada movement to the present time: how could this completely renovated art possibly escape exploitation by those who produce it and drive it since then? The aim of this article is to reconstruct and pinpoint the peculiarities of Ismail Kadare’s idea of Europe. Kadare’s idea of Europe, it is argued, differs from the ideas of Europe embraced or presumed by intellectuals like Paul Valéry, Georg Simmel, Danilo Kiš, Václav Havel, Adam Michnik, or Milan Kundera, or from that of the European Union. For Kadare it is literature rather than the polis or its particular ideology that is the guardian of European values. Thus the European legacy, (...) in his view, is primarily Homeric rather than Socratic. I suggest first that the persecution of writers and the repression of literature in totalitarian regimes underlies Kadare’s idea of Europe. I then further characterize Kadare’s theme of persecution as a dialectic between regime and culture. Finally, I reconstruct Kadare’s narrative of Albania’s “return to Europe” as the struggle for recognizing Albania as the birthplace of European culture. (shrink)

Lawyers in many jurisdictions are ageing, and yet there is little information concerning the age profile of the legal profession. This paper presents the first consideration of the age profile of lawyers outside of the US, showing that Australian lawyers are ageing and delaying retirement. These findings have serious implications. Problems associated with a growing proportion of older lawyers include an increasing risk of lawyers suffering from age-related cognitive and physical impairment, and the related rise of complaints and malpractice claims (...) against older lawyers. It is also clear that the Australian legal profession is unprepared to address these problems. The legal profession has ignored important gender-specific implications of ageing, such as female lawyers experiencing menopause and the lower savings of female lawyers moving into retirement. Regulatory regimes have not considered the impact of the profession's ageing profile, and there is no mandatory reporting of lawyers suffering from age-related impairment or provisions should a lawyer die. The profession also has not provided strategies to positively transition lawyers into retirement, and there is a lack of flexible working arrangements and succession planning, especially in firms located outside urban centres. Scientific knowledge has not stabilized in the current, early, phase of research and development of nanotechnologies creating a challenge to ‘upstream’ public engagement. Nevertheless, the idea that the public should be involved in deliberative discussions and assessments of emerging technologies at this early stage is widely shared among governmental and nongovernmental stakeholders. Many forums for public debate including focus groups, and citizen juries, have thus been organized to explore public opinions on nanotechnologies in a variety of countries over the past (...) few years. In Switzerland the Centre for Technology Assessment (TA-Swiss) organized such a citizen panel in fall 2006. Drawing from an ethnographic study of this panel called ‘publifocus on nanotechnologies, health, and environment’ this paper looks at the ways members of a stakeholder group deal with the epistemic uncertainty in their deliberation of nanotechnologies. By exploring the statements of the participants in the stakeholder discussion group, this paper reconstructs the narratives that constitute the epistemic foundations of the participants’ evaluations of nanotechnologies. This research empirically investigated the CSR practices of 84 Botswana and Malawi organizations. The findings revealed that the extent and type of CSR practices in these countries did not significantly differ from that proposed by a U. S. model of CSR, nor did they significantly differ between Botswana and Malawi. There were, however, differences between the sampled organizations that clustered into a stakeholder perspective and traditional capitalist model groups. In the latter group, the board of directors, owners, and shareholders were (...) important stakeholders that appeared to be restricting extended stakeholder CSR activities in the Malawi and Botswana organizations. The sampled managers recognized the economic benefits of CSR practices and were not at odds with social objectives. (shrink)

In two experiments, we investigated how people interpret and reason with realistic conditionals in the form of inducements (i.e., promises and threats) and advice (i.e., tips and warnings). We found that inducements and advice differed with respect to the degree to which the speaker was perceived to have (a) control over the consequent, (b) a stake in the outcome, and (c) an obligation to ensure that the outcome occurs. Inducements and advice also differed with respect to perceived sufficiency and necessity, (...) as well as the degree to which these statements were perceived to be effective in changing the behaviour described in the antecedent of the conditional. Multiple regression analyses indicated that perceived control over the consequent, necessity, and sufficiency emerged as the best predictors of (a) the degree to which statements were perceived to be effective in changing the behaviour of the addressee, and (b) inference patterns on a conditional arguments task. Across Black Spaces gathers a diverse array of essays and interviews by American philosopher George Yancy. Within this multidisciplinary framework are a series of public intellectual essays that drew international media acclaim for their spotlight on vicious racial tensions in American academia and society at large.

What counts as health or ill health? How do we deal with the fallibility of our own bodies? Should illness and disease be considered simply in biological terms, or should considerations of its emotional impact dictate our treatment of it? Our understanding of health and illness had become increasingly more complex in the modern world, as we are able to use medicine not only to fight disease but to control other aspects of our bodies, whether mood, blood pressure, or cholesterol. This article argues, first, that the fundamental structure of the skeptical argument in Kripke’s book on Wittgenstein has been seriously misunderstood by recent commentators. Although it focuses particularly on recent commentary by John McDowell, it emphasizes that the basic misunderstandings are widely shared by other commentators. In particular, it argues that, properly construed, Kripke offers a fully coherent reading of PI #201 and related passages. This is commonly denied, and given as a reason for rejecting Kripke’s reading of Wittgenstein’s text. (...) Second, it is pretty universally accepted that Kripke’s Wittgenstein is a ‘non-factualist’ about ascriptions of meaning. The article argues that, when Kripke’s discussion is rightly understood and the content of ‘non-factualism’ is clarified, there is an important sense in which the skeptical solution is not committed to non-factualism. This paper analyses the use of metaphor in discourses around the “superweed” Palmer amaranth. Most weed scientists associated with the US public agricultural extension system dismiss the term superweed. However, together with the media, they indirectly encourage aggressive control practices by actively diffusing the framing of herbicide resistant Palmer amaranth as an existential threat that should be eradicated at any cost. We use argumentative discourse analysis to better understand this process. We analyze a corpus consisting of reports, policy briefs, and (...) press releases produced by state extension services, as well as articles from professional and popular magazines and newspapers quoting extension specialists and/or public sector weed scientists or agronomists. We show how the superweed discourse is powered by negative metaphors, and legitimizes aggressive steps to eradicate the weed. This discourse reinforces the farmers’ techno-optimism master frame, contributes to deskilling of farmers and sidelines ethical concerns. (shrink)
