This paper analyses the use of metaphor in discourses around the “superweed” Palmer amaranth. Most weed scientists associated with the US public agricultural extension system dismiss the term superweed. However, together with the media, they indirectly encourage aggressive control practices by actively diffusing the framing of herbicide resistant Palmer amaranth as an existential threat that should be eradicated at any cost. We use argumentative discourse analysis to better understand this process. We analyze a corpus consisting of reports, policy briefs, and (...) press releases produced by state extension services, as well as articles from professional and popular magazines and newspapers quoting extension specialists and/or public sector weed scientists or agronomists. We show how the superweed discourse is powered by negative metaphors, and legitimizes aggressive steps to eradicate the weed. This discourse reinforces the farmers’ techno-optimism master frame, contributes to deskilling of farmers and sidelines ethical concerns. (shrink)

Lawyers in many jurisdictions are ageing, and yet there is little information concerning the age profile of the legal profession. This paper presents the first consideration of the age profile of lawyers outside of the US, showing that Australian lawyers are ageing and delaying retirement. These findings have serious implications. Problems associated with a growing proportion of older lawyers include an increasing risk of lawyers suffering from age-related cognitive and physical impairment, and the related rise of complaints and malpractice claims (...) against older lawyers. It is also clear that the Australian legal profession is unprepared to address these problems. The legal profession has ignored important gender-specific implications of ageing, such as female lawyers experiencing menopause and the lower savings of female lawyers moving into retirement. Regulatory regimes have not considered the impact of the profession's ageing profile, and there is no mandatory reporting of lawyers suffering from age-related impairment or provisions should a lawyer die. The profession also has not provided strategies to positively transition lawyers into retirement, and there is a lack of flexible working arrangements and succession planning, especially in firms located outside urban centres. Practical wisdom (hereafter simply ‘wisdom’), which is the understanding required to make reliably good decisions about how we ought to live, is something we all have reason to care about. The importance of wisdom gives rise to questions about its nature: what kind of state is wisdom, how can we develop it, and what is a wise person like? These questions about the nature of wisdom give rise to further questions about proper methods for studying wisdom. Is the study of (...) wisdom the proper subject of philosophy or psychology? How, exactly, can we determine what wisdom is and how we can get it? In this chapter, we give an overview of some prominent philosophical answers to these questions. We begin by distinguishing practical wisdom from theoretical wisdom and wisdom as epistemic humility. Once we have a clearer sense of the target, we address questions of method and argue that producing a plausible and complete account of wisdom will require the tools of both philosophy and empirical psychology. We also discuss the implications this has for prominent wisdom research methods in empirical psychology. We then survey prominent philosophical accounts of the nature of wisdom and end with reflections on the prospects for further interdisciplinary research. (shrink)

Epistemic injustice occurs when someone is wronged in their capacity as a knower.[1] More and more attention is being paid to the epistemic injustices that exist in our scientific practices. In a recent paper, Fabien Medvecky argues that science communication is fundamentally epistemically unjust. In what follows we briefly explain his argument before raising several challenges to it.

ABSTRACT:This paper examines the norms that should guide policies aimed at promoting happiness or, more broadly, well-being. In particular, we take up the question of which conception of well-being should govern well-being policy, assuming some such policies to be legitimate. In answer, we lay out a case for ‘pragmatic subjectivism’: given widely accepted principles of respect for persons, well-being policy may not assume any view of well-being, subjectivist or objectivist. Rather, it should promote what its intended beneficiaries see as good (...) for them: pleasure for hedonists, excellence for Aristotelians, etc. Specifically, well-being policy should promote citizens’ ‘personal welfare values’: those values—and not mere preferences—that individuals see as bearing on their well-being. Finally, we briefly consider how pragmatic subjectivism works in practice. While our discussion takes for granted the legitimacy of well-being policy, we suggest that pragmatic subjectivism strengthens the case for such policy. (shrink)

Historically developed along gender lines and arguably the most sex segregated of institutions, U.S. prisons are organized around the assumption of a gender binary. In this context, the existence and increasing visibility of transgender prisoners raise questions about how gender is accomplished by transgender prisoners in prisons for men. This analysis draws on official data and original interview data from 315 transgender inmates in 27 California prisons for men to focus analytic attention on the pursuit of “the real deal”—a concept (...) we develop to reference a dynamic related to how gender is accomplished by transgender inmates. Specifically, among transgender inmates in prisons for men, there is competition for the attention and affection of “real men” in prisons: the demonstrable and well-articulated desire to secure standing as “the best girl” in sex segregated institutional environments. Our empirical examination sheds light on the gender order that underpins prison life, the lived experience of gender and sexuality for transgender inmates in prisons for men, and how that experience reveals new aspects of the workings of gender accountability. Recently claims have been made for radical new insights in the field of invertebrate immunology that involve memory, specificity and/or maternal transfer of immunocompetence. For evidence these claims rely on phenomena, such as survival or reproductive capacity, observed at the level of the whole organism. The allure of these apparently revelatory hypotheses is that they are contrary to established views of innate immunity. They draw implicit analogy to adaptive responses in jawed vertebrates and the terminology used creates an incomplete and (...) misleading picture. We argue that the case for adaptive immunity in invertebrates based only on such phenomena is weak and flawed, as it can only be upheld if supported by descriptions of the underlying mechanisms. We caution against a reliance on this approach as a means of advancing this field—highlighting, as an example, some negative commercial implications of adopting this approach. This paper discloses and questions two assumptions on happiness that are implied by medical and technological proposals for mood enhancement. The first assumption holds that happiness consists of the indiscriminate maximization of positive and minimization of negative emotions. Second, mood enhancement implies the belief that an effortless enhancement of positive emotions will increase happiness. These assumptions are questioned by investigating the validity of the common sense slogan ‘No pain, no gain’. Support for this claim is found in literature on adversity (...) and happiness, effort and happiness, and in evolutionary psychology. From these research domains it is shown that adversity, pain, bother or effort should not always be regarded as negative experiences to be avoided in the pursuit for happiness. In some cases they can contribute to a person’s quality of life. By questioning the indiscriminate and effortless enhancement of positive emotions and avoidance of negative ones, this perspective suggests a different view on happiness than the one generally assumed by proponents of mood enhancement. Membership in a protein domain database does not a domain make; a feature we realized when generating a consensus view of protein fold space with our consensus domain dictionary (CDD). This dictionary was used to select representative structures for characterization of the protein dynameome: the Dynameomics initiative. Through this endeavor we rejected a surprising 40% of the 1,695 folds in the CDD as being non‐autonomous folding units. Although some of this was due to the challenges of grouping similar fold topologies, (...) the dissonance between the cataloguing and structural qualification of protein domains remains surprising. Another potential factor is previously overlooked intrinsic disorder; predictions suggest that 40% of proteins have either local or global disorder. One thing is clear, filtering a structural database and ensuring a consistent definition for protein domains is crucial, and caution is prescribed when generalizations of globular domains are drawn from unfiltered protein domain datasets. Recently, scholars across disciplines raised ethical, legal and social concerns about the notion of human intervention, control, and oversight over Artificial Intelligence (AI) systems. This observation becomes particularly important in the age of ubiquitous computing and the increasing adoption of AI in everyday communication infrastructures. We apply Nicholas Garnham's conceptual perspective on mediation to users who are challenged both individually and societally when interacting with AI-enabled systems. One way to increase user agency are mechanisms to contest faulty or flawed AI (...) systems and their decisions, as well as to request redress. Currently, however, users structurally lack such mechanisms, which increases risks for vulnerable communities, for instance patients interacting with AI healthcare chatbots. To empower users in AI-mediated communication processes, this article introduces the concept of active human agency. We link our concept to contestability and redress mechanism examples and explain why these are necessary to strengthen active human agency. We argue that AI policy should introduce rights for users to swiftly contest or rectify an AI-enabled decision. This right would empower individual autonomy and strengthen fundamental rights in the digital age. We conclude by identifying routes for future theoretical and empirical research on active human agency in times of ubiquitous AI. (shrink)

The noisy computation hypothesis of developmental dyslexia (DD) is particularly appealing because it can explain deficits across a variety of domains, such as temporal, auditory, phonological, visual and attentional processes. A key prediction is that noisy computations lead to more variable and less stable word representations. A way to test this hypothesis is through repetition of words, that is, when there is noise in the system, the neural signature of repeated stimuli should be more variable. The hypothesis was tested in (...) an functional magnetic resonance imaging experiment with dyslexic and typical readers by repeating words twelve times. Variability measures were computed both at the behavioral and neural levels. At the behavioral level, we compared the standard deviation of reaction time distributions of repeated words. At the neural level, in addition to standard univariate analyses and measures of intra-item variability, we also used multivariate pattern analyses (representational similarity and classification) to find out whether there was evidence for noisier representations in dyslexic readers compared to typical readers. Results showed that there were no significant differences between the two groups in any of the analyses despite robust results within each group (i.e., high representational similarity between repeated words, good classification of words vs. non-words). In summary, there was no evidence in favor of the idea that dyslexic readers would have noisier neural representations than typical readers. (shrink)

One hundred and eleven participants interacted with one of four entities: an AIBO robotic dog, Legobot, Dog or Cat. It was found that participants tended to rate the Dog as more capable than the other entities, and often spoke to it more than the robotic entities. However, participants were not positively biased toward live entities, as the (...) Cat often was thought of and spoken to similarly to the AIBO robot. Results are consistent with a model in which both appearance and interactivity lead to the development of beliefs about a live or robotic entity in an interaction. Recent work in cognitive neuroscience on the child's Theory of Mind (ToM) has pursued the idea that the ability to metarepresent mental states depends on a domain-specific cognitive subystem implemented in specific neural circuitry: a Theory of Mind Module. We argue that the interaction of several domain-general mechanisms and lower-level domain-specific mechanisms accounts for the flexibility and sophistication of behavior, which has been taken to be evidence for a domain-specific ToM module. This finding is of more general interest since it (...) suggests a parsimonious cognitive architecture can account for apparent domain specificity. We argue for such an architecture in two stages. First, on conceptual grounds, contrasting the case of language with ToM, and second, by showing that recent evidence in the form of fMRI and lesion studies supports the more parsimonious hypothesis. 1. The authors assess the collaboration between the University of California, Berkeley’s Community Assessment of Renewable Energy and Sustainability program and the Pinoleville Pomo Nation, a small Native American tribal nation in northern California. The collaboration focused on creating culturally inspired, environmentally sustainable housing for tribal citizens using a codesign methodology developed at the university. The housing design process is evaluated in terms of both its contribution to Native American “cultural sovereignty,” as elaborated by Coffey and Tsosie, and as a potential (...) example of the democratization of scientific practice. It has been shown that acting in a game-like task improves preschoolers’ working memory when tested in a reconstruction task. The game context and the motor activity during the game would provide goal cues bringing support to the memory processes. The aim of the present study was to test this hypothesis by examining preschoolers’ working memory performance in a game-like task compared to an exercise-like task, which offers less goal cues. In the present study, 5-year-olds had to maintain a series (...) of fruits and vegetables while acting in a game-like task or remaining static during the same task presented in a school-exercise context. Memory performance was tested either through oral recall or reconstruction of the series of memory items. Despite the fact that memory performance did not differ between the two conditions whatever the type of memory tests, performance was worst in the game-like than in the exercise condition when the exercise was presented first. No difference emerged between conditions when the game condition was performed first. This result suggests that preschoolers were able to take advantage of acting in the game-like condition to integrate some task requirements, which were beneficial for performing the exercise condition. For years a debate has raged within the various literatures of philosophy, psychiatry, and psychology over whether, and to what degree, the concepts that characterize psychopathology are social constructions that reflect cultural values. While the majority position among philosophers has been normativist, i.e., that the conception of a mental disorder is value-laden, a vocal and cogent minority have argued that psychopathology results from malfunctions that can be described by terminology that is objective and scientific. While there is a significant amount of research investigating managerial ethical judgments, a limited amount examines consumer judgments of unethical corporate behavior and its impact on the marketplace. This study examines how consumers' commitment to a company impacts not only their ethical judgment of corporate behavior but also the outcomes of that judgment. The authors test hypotheses with data from 334 consumers and find that consumers' level of commitment attenuates the level of perceived fairness. More specifically, highly committed consumers may (...) forgive companies for behaviors when perceived harm is low, but become progressively dissatisfied as the level of perceived harm increases. Results of the study point to the importance of considering ethical behavior from a consumer perspective. If corporate actions are perceived as unethical, the company stands to lose favor with their most committed customers. Considering that more time, effort and investment is required to gain a new customer as to retain an old, this study shows that engaging in behavior perceived as unethical by consumers risks alienating the most committed customers. Dans les structures résidentielles du handicap, les éducateurs sociaux et les infirmiers sont de plus en plus amenés à travailler ensemble au sein d’équipes socio-éducatives. Basé sur les travaux de la sociologie des groupes professionnels et de la collaboration interprofessionnelle, cet article analyse la collaboration interprofessionnelle entre des éducateurs sociaux et des infirmiers dans les institutions du handicap (...) en Suisse romande, ceci à partir des regards croisés des professionnels concernés et des directions. Les entretiens apportent un éclairage sur les processus de redéfinition des territoires d'intervention entre les professions d'éducateur social et d'infirmier, par la mise en évidence de deux logiques institutionnelles de division du travail qui se développent dans les structures consultées, distinction formelle et non-distinction, des enjeux qu'elles soulèvent, ainsi que de la manière dont les professionnels se les approprient. If our knowledge of human cognition were based solely on research with participants younger than the age of 2 years, there would be no basis for the relational reinterpretation hypothesis, and Darwin's continuity theory would be safe as houses. Because many of the shortcomings cited apply to human infants, we propose how a consideration of cognitive development would inform the relational reinterpretation hypothesis.

On March 11, 2020 the World Health Organization classified COVID‐19, caused by Sars‐CoV‐2, as a pandemic. Although not much was known about the new virus, the first outbreaks in China and Italy showed that potentially a large number of people worldwide could fall critically ill in a short period of time. A shortage of ventilators and intensive care resources was expected in many countries, leading to concerns about restrictions of medical care and preventable deaths. In order to be prepared for (...) this challenging situation, national triage guidance has been developed or adapted from former influenza pandemic guidelines in an increasing number of countries over the past few months. In this article, we provide a comparative analysis of triage recommendations from selected national and international professional societies, including Australia/New Zealand, Belgium, Canada, Germany, Great Britain, Italy, Pakistan, South Africa, Switzerland, the United States, and the International Society of Critical Care Medicine. We describe areas of consensus, including the importance of prognosis, patient will, transparency of the decision‐making process, and psychosocial support for staff, as well as the role of justice and benefit maximization as core principles. We then probe areas of disagreement, such as the role of survival versus outcome, long‐term versus short‐term prognosis, the use of age and comorbidities as triage criteria, priority groups and potential tiebreakers such as ‘lottery’ or ‘first come, first served’. Having explored a number of tensions in current guidance, we conclude with a suggestion for framework conditions that are clear, consistent and implementable. This analysis is intended to advance the ongoing debate regarding the fair allocation of limited resources and may be relevant for future policy‐making. (shrink)

The precarious rights of senior citizens, especially those who are highly educated and who are expected to counsel and guide the younger generations, has stimulated the creation internationally of advocacy associations and opinion leader groups. The strength of these groups, however, varies from country to country. In some countries, they are supported and are the focus of intense interest; in others, they are practically ignored. For this is reason we believe that the creation of a network of all these associations (...) is essential. The proposed network would act as a support for the already-existing policies of the United Nations’ High Commission for Human Rights, of independent experts, and of the Global Alliance for the Rights of Older People. All three have long ago recommended the creation of a recognized instrument for uniting presently scattered efforts. The proposed network, therefore, will seek to promote the international exchange of relevant expertise, and it will reinforce the commitments and actions that single countries are currently taking to meet these objectives. For example, informative public events can be organised to promote particular support initiatives and to provide an opportunity for new members of the network to be presented. The network will promote health for senior citizens, disease prevention, senior mobility, safe free time for seniors, alimentary education, protection against new risks and dangers, as well as equity in the services necessary for seniors to adopt new information and communication technologies. In the case of retired academic members, the network will promote equality with respect to continuing use of digital technologies (particularly email), continuing access to research libraries, and the guaranteed ability for seniors to fund their own research programs and to deliver free seminars. Moral or ethical questions are vital because they affect our daily lives: what is the best choice we can make, the best action to take in a given situation, and ultimately, the best way to live our lives? Health ethics has contributed to moving ethics toward a more experience-based and user-oriented theoretical and methodological stance but remains in our practice an incomplete lever for human development and flourishing. This context led us to envision and develop the stance of a “living (...) ethics”, described in this inaugural collective and programmatic paper as an effort to consolidate creative collaboration between a wide array of stakeholders. We engaged in a participatory discussion and collective writing process known as instrumentalist concept analysis. This process included initial local consultations, an exploratory literature review, the constitution of a working group of 21 co-authors, and 8 workshops supporting a collaborative thinking and writing process. First, a living ethics designates a stance attentive to human experience and the role played by morality in human existence. Second, a living ethics represents an ongoing effort to interrogate and scrutinize our moral experiences to facilitate adaptation of people and contexts. It promotes the active and inclusive engagement of both individuals and communities in envisioning and enacting scenarios which correspond to their flourishing as authentic ethical agents. Living ethics encourages meaningful participation of stakeholders because moral questions touch deeply upon who we are and who we want to be. We explain various aspects of a living ethics stance, including its theoretical, methodological, and practical implications as well as some barriers to its enactment based on the reflections resulting from the collaborative thinking and writing process.
