Alfenvs Varvs of Cremona, a quondam friend of Catullus, studied law with the great Seruius Sulpicius—some of whose lectures he published—served to the advantage of Vergil as land commissioner in Cisalpine Gaul, became consul suffectus in 39 B.C., and provided Horace with the point of a joke. He seems also—hence this note—to have been the versifier whom Catullus calls Suffenus in c. 14 and 22. If he is, we have here a somewhat rare instance of Horace's adapting to his own (...) use a suggestion from Catullus. (shrink)

Many of the things we do, we do together with other people. Think of carpooling and playing tennis. In the past two or three decades it has become increasingly popular to analyze such collective actions in terms of collective intentions. This volume brings together ten new philosophical essays that address issues such as how individuals succeed in maintaining coordination throughout the performance of a collective action, whether groups can actually believe propositions or whether they merely accept them, and what kind (...) of evidence, if any, disciplines such as cognitive science and semantics provide in support of irreducibly collective states.The theories of the Big Four of collective intentionality -- Michael Bratman, Raimo Tuomela, John Searle, and Margaret Gilbert -- and the Big Five of Social Ontology -- which in addition to the Big Four includes Philip Pettit -- play a central role in almost all of these essays. Drawing on insights from a wide range of disciplines including dynamical systems theory, economics, and psychology, the contributors develop existing theories, criticize them, or provide alternatives to them.Several essays challenge the idea that there is a straightforward dichotomy between individual and collective level rationality, and explore the interplay between these levels in order to shed new light on the alleged discontinuities between them. The aim of this paper is to understand the functional role of mental representations and intentionality in skilled actions from a systems related perspective. Therefore, we will evaluate the function of representation and then discuss the cognitive architecture of skilled actions in more depth. We are going to describe the building blocks and levels of the action system that enable us to control movements such as striking the tennis ball at the right time, or grasping tools in manual action. Based (...) on this theoretical understanding the measurement of mental representations and related research results concerning mental representation in skilled action are presented in an overview. This leads to the question how mental representations develop and change during learning. Finally, to consolidate the functional understanding of mental representation in skilled action and interaction, we provide examples how to use the measurement of mental representation in humans to inform technical systems. The zone of latent solutions hypothesis provides an alternative approach to explaining cultural patterns in primates and many other animals. According to the ZLS hypothesis, non-human great ape cultures consist largely or solely of latent solutions. The current competing hypothesis for ape culture argues instead that at least some of their behavioural or artefact forms are copied through specific social learning mechanisms and that their forms may depend on copying. In contrast, the ape ZLS hypothesis does not require these forms (...) to be copied. Instead, it suggests that several social learning mechanisms help determine the frequency of these behaviours and artefacts within connected individuals. The ZLS hypothesis thus suggests that increases and stabilisations of a particular behaviour’s or artefact’s frequency can derive from socially-mediated form reinnovations. Therefore, and while genes and ecology play important roles as well, according to the ape ZLS hypothesis, apes typically acquire the forms of their behaviours and artefacts individually, but are usually socially induced to do so. The ZLS approach is often criticized—perhaps also because it challenges the current null hypothesis, which instead assumes a requirement of form-copying social learning mechanisms to explain many ape behavioural forms. However, as the ZLS hypothesis is a new approach, with less accumulated literature compared to the current null hypothesis, some confusion is to be expected. Here, we clarify the ZLS approach—also in relation to other competing hypotheses—and address misconceptions and objections. We believe that these clarifications will provide researchers with a coherent theoretical approach and an experimental methodology to examine the necessity of form-copying variants of social learning in apes, humans and other species. Contrary to Vaesen, we argue that a small number of key traits are sufficient to explain modern human tool use. Here we outline and defend the cultural intelligence (CI) hypothesis. In doing so, we critically re-examine the role of social transmission in explaining human tool use.

Institutions are normative social structures that are collectively accepted. In his book Making the Social World, John R. Searle maintains that these social structures are created and maintained by Status Function Declarations. The article’s author criticizes this claim and argues, first, that Searle overestimates the role that language plays in relation to institutions and, second, that Searle’s notion of a Status Function Declaration confuses more than it enlightens. The distinction is exposed between regulative and constitutive rules as being primarily a (...) linguistic one: whereas deontic powers figure explicitly in regulative rules, they feature only implicitly in constitutive rules. Furthermore, he contends that Searle’s collective acceptance account of human rights cannot adequately account for the fact that people have these rights even when they are not recognized. Finally, It is argued that a conception of collective intentionality that involves collective commitment is needed in order to do justice to the normative dimension of institutions. (shrink)

We enter here upon a history of conversational traffic between the respective departments of philosophy and law in the old academy of liberalism, where lawyers hear much from philosophers, yes-and philosophers hear from lawyers, too, in what has fruitfully been a both-ways exchange. Our philosophical protagonist is John Rawls. This book comprises a study of the rise and workings, within the Rawlsian political-liberal philosophy, of the idea of a country's higher-legal constitution as a public platform for the justification of political (...) coercion. A study of Rawls on constitutionalism can help us, I believe, in scoping out and managing a cluster of constitutional lawyers' debates-interminable ones, it seems, in the constitutional-democratic precincts of our times-that I will catalogue soon below. But conversely, I believe, those seeking the best and truest readings of Rawls might have something to learn from the controversies of the lawyers. My approach to Rawls has accordingly been that of a critically leavened (while no doubt broadly sympathetic) exegesis, while with the legal-discursive materials I take more of a diagnostic turn. My hope is that a treatment of these two discourses in relation to each other will prove an aid to both political-philosophical and legal-practical reflection. (shrink)

Count Me In (CMI) was launched in 2015 as a patient-driven research initiative aimed at accelerating the study of cancer genomics through direct participant engagement, electronic consent and open-access data sharing. It is an example of a large-scale direct-to-patient (DTP) research project which has since enrolled thousands of individuals. Within the broad scope of ‘citizen science’, DTP genomics research is defined here as a specific form of ‘top-down’ research endeavour developed and overseen by institutions within the traditional human subjects research (...) context; in novel ways, it engages and recruits patients with defined diseases, consents them for medical information and biospecimens sharing, and stores and disseminates genomic information. Importantly, these projects simultaneously aim to empower participants in the research process while increasing sample size, particularly in rare disease states. Using CMI as a case study, this paper discusses how DTP genomics research raises new questions in the context of traditional human subjects research ethics, including issues surrounding participant selection, remote consent, privacy and return of results. It aims to demonstrate how current research ethics frameworks may be insufficient in this context, and that institutions, institutional review boards and investigators should be aware of these gaps and their role in ensuring the conduct of ethical, novel forms of research together with participants. Ultimately, a broader question is raised of whether the rhetoric of participatory genomics research advocates for an ethic of personal and social duty for contributing to the advancement of generalisable knowledge about health and disease. Der Be¬griff "Diversität" transportiert - und das macht ihn für die Staatswissenschaften besonders interessant - eine komplexe, überwiegend noch diffuse Demokratietheorie, in der sich Gesellschafts- und Verfassungstheorie treffen. Der Autor zeigt die theoretischen und dogmatischen Folgen für den modernen Verfassungsstaat auf. Die These lautet, dass eine diverse Gesellschaft notwendig mit Identitätspolitik einhergehe, in deren Folge identitäre Gruppen nach einem "exklusionsfreien Konsens" verlangen. So belegt z. B. die Entpolitisierung (...) gesellschaftlicher Konflikte, dass die Politik gegenüber Diversitätsansprüchen aus der Gesellschaft aufgeschlossen ist. Nicht mehr nur politische Minderheiten begreifen sich als identitäre Gruppen, auch Mehrheiten haben begonnen, diesen Schritt zu gehen. This paper focuses on a distinction between two kinds of information in verb meanings: a highly structured, templatic part of the meaning, based on aspectual properties of the verb, and apart of the meaning which contributes to filling gaps in the templatic information. The two kinds of information differ in the nature and degree of connections to encyclopedic world knowledge. This demarcation between the two kinds of information is related to the semantics/ pragmatics distinction, and may be clearly articulated using (...) Krifka's formalization of a homomorphism from objects to events. Motion verbs, for which the concept of distance plays a crucial role in the gap-filling information, are shown to be special in a number of ways, due to the special properties of distance as encoded in the world knowledge of the speaker. In capitalism human beings act as if they are mere animals. So we hear repeatedly in the history of modern philosophy. Indifference and Repetition examines how modern philosophy, largely coextensive with a particular boost in capitalism’s development, registers the reductive and regressive tendencies produced by capitalism’s effect on individuals and society. Ruda examines a problem that has invisibly been shaping the history of modern, especially rationalist philosophical thought, a problem of misunderstanding freedom. Thinkers like Descartes, Kant, Hegel, and Marx claim (...) that there are conceptions and interpretations of freedom that lead the subjects of these interpretations to no longer act and think freely. They are often unwillingly led into unfreedom. It is thus possible that even “freedom” enslaves. Modern philosophical rationalism, whose conceptual genealogy the books traces and unfolds, assigns a name to this peculiar form of domination by means of freedom: indifference. Indifference is a name for the assumption that freedom is something that human beings have: a given, a natural possession. When we think freedom is natural or a possession we lose freedom. Modern philosophy, Ruda shows, takes its shape through repeated attacks on freedom as indifference; it is the owl that begins its flight, so that the days of unfreedom will turn to dusk. (shrink)

Contrary to Guala, I claim that several mechanisms can explain punishment in humans. Here I focus on reputation-based cooperation – and I explore how it can lead to punishment under situations that may or may not be perceived as being anonymous. Additionally, no particular mechanism stands out in predicting an excess of punishment under constrained lab conditions.

Scott Aiken and Thomas Dabay contend that a satisfactory account of truth is both infallibilist and antiskeptical. Externalist correspondence theories, they say, preserve the infallibility of the truth-relation yet invite skeptical qualms. In tying truth to experience, pragmatist theories resist skeptical challenges, but embrace a fallibilism that renders their account of truth inconsistent and even incoherent. While agreeing with Aiken and Dabay that externalist accounts are vulnerable to skepticism, I dispute each of the four arguments they offer against pragmatist fallibilism. (...) Though partially successful against Peirce’s more popular view that truth is the final belief of a community of inquirers, their arguments are wholly ineffective against Dewey’s account of truth as warranted assertability. This article describes the important structural characteristics of a recently developed game-theoretic model of deterrence, summarizes the major deductions drown from it, and discusses its implications for both the theory of deterrence and the current strategic relationship of the superpowers. The model shows that a credible threat and a power advantage are neither necessary nor sufficient conditions for stable deterrence. It also suggests that, even under ideal conditions, deterrence is an intricate and fundamentally fragile relationship that rests, ultimately, upon the (...) preferences and perceptions of key decision-makers rather than upon the nature and composition of each side’s strategic arsenal. This chapter focuses on one of the common fallacies in Western philosophy called 'genetic fallacy' (GnF). One commits the GnF when advocating for a conclusion based solely on origin. This is a fallacy of relevance—irrelevance, really—because the origin of a claim may be irrelevant to its truth‐value. That is to say, providing an account of the genesis of a claim, its history or origin, may be informative and helpful; however, it need not determine the truth‐value of the claim. Therefore, when (...) one draws a conclusion regarding the truth‐value of a claim based solely on the origin of the claim, then one may have committed the GnF. In the ethical language of “means and ends” reasoning, GnF helps to highlight the problematic nature of the utilitarian‐style disconnect between the justice of actions and the goodness of their consequences.
