In this paper, my aim is to offer some comments on the study of Mu‘tazilite kalām, framed around the study of a particular episode in the Mu‘tazilite dispute about man – a question with a deceptively Aristotelian cadence that is not too difficult to dispel. Within this episode, my focus is on one of the major arguments used by the late Baṣrans to hold up their side of the dispute, and on the relationship between the mental and the physical which (...) emerges from it. The most interesting – and most surprising – aspect of this relationship is that the mental and the physical do not seem to be treated as distinct terms, thus creating the space for questions about how the two relate. The first person perspective seems to be identified with the physical body. My interest then is in the response of the reader to this surprising presentation – or rather, in a certain kind of reader response, and thus a certain kind of interpretive mode, whose value and viability it is part of my aim to help clarify. I argue that T.M. Scanlon's contractualist account of morality has difficulty accommodating our intuitions about the moral relevance of the number of people affected by an action. I first consider the "Complaint Model" of reasonable rejection, which restricts the grounds for an individual's rejection of a principle to its effects upon herself. I argue that it can accommodate our intuitions about numbers only if we assume that, whenever we do not know who will be affected, each individual may appeal only (...) to the _expected effects on her. This assumption, I suggest, leads to counterintuitive results in cases where, although we do not know who will be affected, we do know that _someone will be. I then consider two proposals to supplement the complaint model with a direct appeal to aggregation. I argue that both are open to serious objections. (shrink)

Es scheint, als hatten sich die Rechtsphilosophen und -theoretiker einer vertieften Auseinandersetzung mit dem Denker enthalten. Sophia Gluth hinterfragt diesen Umstand und beleuchtet, ob und wie theoretisierende Juristen mit Nietzsche umgegangen sind. Dabei deckt sie ein Phanomen auf, das bisher weder gesehen noch beschrieben wurde: die konstante Rezeption Friedrich Nietzsches in der Rechtswissenschaft. Untersucht werden die Rezeptionsansatze (...) vom Kaiserreich bis in die Gegenwart. This book defends an original and pluralist theory of when and why discrimination wrongs people, in particular, through unfair subordination, through the violation of their right to a particular deliberative freedom, or through the denial to them of access to a basic good.

Le modèle démocratique est fondé, entre autres, sur l'individu et une forme spécifique du pouvoir d'État. Cette conception est loin d'être partagée par toute la planète où dans la plupart des cas, le groupe a priorité sur l'individu et, pour ce qui est du pouvoir, l'exclusivité, l'occulte, l'arbitraire, etc. l'emportent sur la pluralité et le droit. Il s'agit donc, dans cet ouvrage, de questionner les représentations du monde, les valeurs, les institutions et les pratiques sociales qui sont à l'origine du (...) modèle politique occidental et les confronter avec d'autres représentations, d'autres valeurs, d'autres modes d'organisation sociale et politique. C'est un questionnement de l'intérieur qui cherche le sens caché des actions collectives et de leurs motivations. Ce type d'interrogation est frappé d'interdit de nos jours. Le discours universaliste dominant et les politiques qui lui sont associées nient la présence des différences culturelles de fond. L'argument massue évoqué pour étayer cet interdit est l'exploitation politique de cette problématique par les courants réactionnaires et xénophobes en Occident ou les dictateurs dans les autres contrées du monde. Car les différences, avec leurs cohortes de défis scientifiques et politiques sont bel et bien là. Leur occultation conduit les chercheurs et les politiques à des situations souvent intenables. The prevalence of the term post-truth suggests that we have, in the last few years, moved from being members of societies dedicated to truth to being members of ones that cannot agree on truth’s parameters and, even worse, have given up trying. But is this really what has happened? The author argues that, under the sway of the Enlightenment, truth has actually been unstable and a source of contention in public life ever since the founding moment for modern democracies in (...) the late eighteenth century; the ‘post’ in ‘post-truth’ elides this complex history even as it accurately describes some of the conditions of our moment. What that means, though, is that rather than attempt to turn the clock back to past models and practices for restoring the reign of truth, we should be looking for new, post-Enlightenment paradigms for how to define and locate truth in the context of democracy, as well as new mechanisms for making this possible. With its pessimistic vision and bleak message of world-denial, it has often been difficult to know how to engage with Schopenhauer's philosophy. Schopenhauer's arguments have seemed flawed and his doctrines marred by inconsistencies; his very pessimism almost too flamboyant to be believable. Yet a way of redrawing this engagement stands open, Sophia Vasalou argues, if we attend more closely to the visionary power of Schopenhauer's work. The aim of this book is to place the aesthetic character of Schopenhauer's standpoint (...) at the heart of the way we read his philosophy and the way we answer the question: why read Schopenhauer - and how? Approaching his philosophy as an enactment of the sublime with a longer history in the ancient philosophical tradition, Vasalou provides a fresh way of assessing Schopenhauer's relevance in critical terms. Aristotle's account of female nature has received mostly negative treatment, emphasising what he says females cannot do. Building on recent research, this book comprehensively revises such readings, setting out the complex and positive role played by the female in Aristotle's thought with a particular focus on the longest surviving treatise on reproduction in the ancient corpus, the Generation of Animals. It provides new interpretations of the nature of Aristotle's sexism, his theory of male and female interaction in generation, and his (...) account of inherited features. It also discusses a range of more general issues which can and should be re-examined in light of Aristotle's account of female animals: his methodology, hylomorphism, teleology and psychology. Aristotle on Female Animals will be valuable to all those interested in Aristotle's philosophy and the history of gender. (shrink)

For the past 40 years, the 14-day rule has governed and, by defining a clear boundary, enabled embryo research and the clinical benefits derived from this. It has been both a piece of legislation and a rule of good practice globally. However, methods now allow embryos to be cultured for more than 14 days, something difficult to imagine when the rule was established, and knowledge gained in the intervening years provides robust scientific rationale for why it is now essential to (...) conduct research on later stage human embryos. In this paper, I argue that the current limit for embryo research in vitro should be extended to 28 days to permit research that will illuminate our beginnings as well as provide new therapeutic possibilities to reduce miscarriage and developmental abnormalities. It will also permit validation of potentially useful alternatives. Through consideration of current ethical arguments, I also conclude that there are no coherent or persuasive reasons to deny researchers, and through them humanity, the knowledge and the innovation that this will generate. Building on appraisal theory of emotions and theories on moral emotions, we contend that ethical leadership triggers other-praising moral emotions directed at the supervisor and leads to feedback-seeking behavior. We further predict that the affective processes of ethical leadership have implications for workplace behaviors, namely organizational citizenship behavior directed at the supervisor and employee voice. We develop a new measure of supervisor-directed, other-praising moral emotions and test the validity of the measure. Then, we test and find support for the proposed (...) hypotheses using a sample of 231 full-time employees in China with a time-lagged survey design and structural equation modeling. Theoretical and practical implications for ethical leadership and moral emotions are discussed. (shrink)

Every woman lives by a code that informs how she treats others and herself, how much she expects of herself, and how far she is willing to go in order to find success. But are we sacrificing the deeper things for mere achievement? Nelson calls women to live out a powerful life code that will lead them to purposeful and successful lives-- and to do it with grace.

Many social practices treat citizens with cognitive disabilities differently from their nondisabled peers. Does John Rawls's theory of justice imply that we have different duties of justice to citizens whenever they are labeled with cognitive disabilities? Some theorists have claimed that the needs of the cognitively disabled do not raise issues of justice for Rawls. I claim that it is premature to reject Rawlsian contractualism. Rawlsians should regard all citizens as moral persons provided they have the potential for developing the (...) two moral powers. I claim that every citizen requires specific Enabling Conditions to develop and exercise the two moral powers. Structuring basic social institutions to deny some citizens the Enabling Conditions is unjust because it blocks their developmental pathways toward becoming fully cooperating members of society. Hence, we have a duty of justice to provide citizens labeled with cognitive disabilities with the Enabling Conditions they require until they become fully cooperating members of society. (shrink)

Attending to the rich entanglements of scientific and critical theory, contributors to this issue scrutinize phenomena in nature to explore new territory in feminist science studies. With a special focus on relating theory to method, these scholars generate new feminist approaches to scientific practice. Contributors probe this relationship by way of topics from poetics of human-jellyfish interactions to a feminist reconsideration of a well-known thought experiment in thermodynamics. Two contributors analyze plant-insect encounter research to spin their own symbiotically inflected account (...) of “affective ecologies.” Technologies of human memory storage and retrieval lead one writer to interrogate how our understandings of memory and amnesia are currently under revision. Another contributor tracks the lively evolutionary and morphological theories that textile artisans manifest in material models of sea creatures. Efforts to include women in the canon have long been beset by reactionary gatekeeping, typified by the charge “That's not philosophy.” That charge doesn't apply to early and mid‐analytic female philosophers—Welby, Ladd‐Franklin, Bryant, Jones, de Laguna, Stebbing, Ambrose, MacDonald—with job titles like lecturer in logic and professor of philosophy and publications in Mind, the Journal of Philosophy, and Proceedings of the Aristotelian Society. It's hopeless to dismiss their work as “not philosophy.” But comparable reactionary gatekeeping affects them, this paper argues, (...) typified by the labels “bad philosophy” and “derivative philosophy.” Virtue and vice epistemology help explain why these women have been neglected and why their own approaches are epistemically virtuous. Their contemporaries and historians are deficient in scholarly virtues in labelling these women's work “bad” or derived from male mentors with no or specious justification. Their disparaged qualities—intellectual humility, modesty, critical self‐reflection, disclosing biases—are often epistemic virtues. (shrink)

This paper analyses the main perceptions of capitalism and crises from a mainstream and heterodox perspective. Broadly defined within the neoclassical structure, the mainstream approaches support the idea of long-term stability of capitalism and describe crises as exogenous events. The heterodox perceptions, on the contrary, perceive crises as an internal feature of capitalism and propose to reframe the global economy within the limits of the socio-environmental systems. Despite the historical recurrence of crises, the neoclassic capitalist framework and the related mainstream (...) perceptions are still dominating the international economic debate. Most of the crises have then been addressed with reforms oriented to adjust some elements of the system without changing the overall economic structure. On the contrary, limited numbers of initiatives have been implemented to reorganise the economy according to the heterodox perspectives. Within this context, further analysis would be needed to investigate the feasibility of the proposed heterodox solutions. By discussing the main perceptions of capitalism and crises and by considering the ethical implications of the mainstream and the heterodox approaches, the present paper contributes to the existing debate around stability of capitalism and provides a starting point for analysis oriented to investigate the feasibility of alternative economic structures. This paper argues that challenges that are grand in scope such as "lifelong health and wellbeing", "climate action", or "food security" cannot be addressed through scientific research only. Indeed scientific research could inhibit addressing such challenges if scientific analysis constrains the multiple possible understandings of these challenges into already available scientific categories and concepts without translating between these and everyday concerns. This argument builds on work in philosophy of science and race to postulate a process through which non-scientific notions become (...) part of science. My aim is to make this process available to scrutiny: what I call founding everyday ideas in science is both culturally and epistemologically conditioned. Founding transforms a common idea into one or more scientifically relevant ones, which can be articulated into descriptively thicker and evaluatively deflated terms and enable operationalisation and measurement. The risk of founding however is that it can invisibilise or exclude from realms of scientific scrutiny interpretations that are deemed irrelevant, uninteresting or nonsensical in the domain in question-but which may remain salient for addressing grand-in-scope challenges. The paper considers concepts of "wellbeing" in development economics versus in gerontology to illustrate this process. (shrink)

Must good deeds be rewarded and wrongdoers punished? Would God be unjust if He failed to punish and reward? And what is it about good or evil actions and moral identity that might generate such necessities? These were some of the vital religious and philosophical questions that eighth- and ninth-century Mu'tazilite theologians and their sophisticated successors attempted to answer, giving rise to a distinctive ethical position and one of the most prominent and controversial intellectual trends in medieval Islam. The Mu'tazilites (...) developed a view of ethics whose distinguishing features were its austere moral objectivism and the crucial role it assigned to reason in the knowledge of moral truths. Central to this ethical vision was the notion of moral desert, and of the good and evil consequences--reward or punishment--deserved through a person's acts. Moral Agents and Their Deserts is the first book-length study of this central theme in Mu'tazilite ethics, and an attempt to grapple with the philosophical questions it raises. At the same time, it is a bid to question the ways in which modern readers, coming to medieval Islamic thought with a philosophical interest, seek to read and converse with Mu'tazilite theology. Moral Agents and Their Deserts tracks the challenges and rewards involved in the pursuit of the right conversation at the seams between modern and medieval concerns. (shrink)

The Supreme Court’s reversal of the right to abortion has significantly changed reproductive rights in the United States, and adversely affected the lives of potentially pregnant persons. The political fragility of the privacy right to abortion also raises questions about the practice and epistemic rules of American constitutionalism itself. In this essay, I situate the history of privacy under the Fourteenth Amendment’s due process clause in the tradition of legal reasoning. With Ludwig Wittgenstein’s On Certainty, I argue that the majority (...) in Dobbs v. Jackson (2022) departs from this tradition. The upshot of this departure is that we now have a new interpretive language game battling a long established language game of interpretation–battling, that is, a constitutional tradition–in a contest to redefine how disagreement is transacted among justices and between the people and their government. This book makes the case for Marsilio Ficino, a Renaissance philosopher and priest, as a canonical thinker, and provides an introduction for a broad audience. Sophia Howlett examines him as part of the milieu of Renaissance Florence, part of a history of Platonic philosophy, and as a key figure in the ongoing crisis between classical revivalism and Christian belief. The author discusses Ficino's vision of a Platonic Christian universe with multiple worlds inhabited by angels, daemons and pagan gods, as (...) well as our own distinctive role within that universe - climbing the heights to talk with angels yet constantly confused by the evidence of our own senses. Sophia Vasalou investigates the 'virtues of greatness' in the Islamic world. Examining the virtue of magnanimity in ancient philosophical ethics and the 'greatness of spirit' in the Arabic tradition, she traces the genealogy of these ideals, explores the influences that shaped them, and highlights the contemporary relevance of these ideals.

This essay unpacks a seeming paradox: a concept used to formulate, promote, and legitimate oppressive ideologies—a concept used to formulate mistaken, because they were typological, biological theories about human diversity—is, it seems, the same concept that now promises to deliver wonderful, socially sensitized, innovative results in social and genetic epidemiology. But how could that be? How could scientists expect a concept as problematic as ordinary race to deliver useful scientific results? I propose that there is a process for retranslating Ballungen (...) race concepts in appropriate ways to make them fit and work within social scientific and bioscientific contexts. (shrink)

This paper argues that focusing on Aristotle’s theory of generation as primarily ‘hylomorphic’ can lead to difficulties. This is especially evident when interpreting the association between the male and sentient soul at GA 2.5. If the focus is on the male’s contribution as form and the female’s as matter, then soul becomes divided into nutritive from female and sentient from male which makes little sense in Aristotle’s biological ontology. In contrast, by seeing Aristotle’s theory as ‘archēkinētic’, a process initiated by (...) the male, the development of nutritive and sentient capacities emerges as intertwined, neither capacity originating in only one sex. In 2014, SAGE Publications retracted 60 articles authored by Taiwanese researchers due to suspected peer-review fraud. This scandal led to the resignation of the Minister of Education at the time since he coauthored several retracted works. Issues regarding the lack of transparent decision-making processes regarding authorship were further disclosed. Motivated by the scandal, we believe that this is one of the first empirical studies of questionable authorship practices in East Asian academia; we investigate Taiwanese researchers’ perceptions of QAPs. To meet (...) this purpose, a self-reported survey was developed. Four hundred and three local researchers, including research faculty, postdoctoral researchers, and Ph.D. students, participated in the survey. Four major findings resulted. First, the underlying causes of Taiwanese doctoral students’ engagement in QAPs were attributable to their desire to achieve particular academic-related successes and their feeling of reciprocal obligation to support other researchers. Second, the underlying motives for Taiwanese research associates’ engagement in QAPs were attributable to their attempts to achieve particular career successes and of the desire to consolidate their professional networks. Third, the participants generally agreed that QAPs had a long history among local academics but were rarely reported. Fourth, participants’ backgrounds had significant effects on their responses regarding particular authorship issues; however, their gender did not have a significant effect. QAPs are a critical issue in Taiwanese academia; therefore, we discussed the implications of the current findings including subsequent instruction and future research. (shrink)

Grace de Laguna’s philosophical work was bold and original. She was also able to connect together seemingly disparate strands of the pragmatic, metaphysical and psychological research going on around her, as Joel Katzav shows in his paper. This commentary gives some historical background to her academic career in an attempt to explain how she could have been forgotten as a philosopher. Social and institutional factors led to her work not being recognized when she wrote and thus sinking into obscurity in (...) philosophical circles afterwards. Although her work was initially widely read, her research seems not to have had any continuing direct impact on later developments in philosophy. However, it is crucial to restore her thought to its rightful place in the history of our subject. (shrink)

ABSTRACT Alice Ambrose is best known as Wittgenstein’s student during the 1930s. Her association with probably the most famous philosopher of the twentieth century contributes to her obscurity. Ambrose is referred to in historiography of this period as ‘follower’ or ‘disciple’ but never considered in her own right as a philosopher. The neglect of her place in the history of philosophy needs to be resisted. This paper explores some of Ambrose’s most interesting ideas from the early 1950s, when she developed (...) and expanded some of Wittgenstein’s inchoate suggestions and contributed to on-going debates about how to do philosophy and the role of language in the discipline. By combining an analysis of the 1950 paper “The Problem of Linguistic Inadequacy” and the 1952 paper “Linguistic Approaches to Philosophical Problems”, it will be seen that Ambrose rejects the idea that ordinary language can be improved and begins to develop the view that philosophical language adapts to usage. Thus, Ambrose does not blindly follow Wittgenstein but breaks with his idea that there is something inherently wrong with the way philosophers communicate. The paper also seeks to show how marginalized philosophers become obscured in the history of the subject through the example of Ambrose. (shrink)

That only those who have mastered language can be virtuous is something that may strike us as an obvious truism. It would seem to follow naturally from, indeed simply restate, a view that is far more commonly held and expressed by philosophers of the virtues, namely that only those who can reason can be virtuous properly said. My aim in this paper is to draw attention to this truism and argue its importance. In doing so, I will take the starting (...) point for my reflections from a couple of concrete occasions in which the desire to offer a foothold to the language of the virtues encounters an obstacle that might be described as a recalcitrance of language: certain intuitions that seem decidedly linguistic get in the way to suggest that this vocabulary is out of place or out of order. Taking my cue from the discomfort of our linguistic intuitions, what I will be suggesting is that certain difficulties do indeed attend our use of the vocabulary of the virtues, and that there is a particular way of understanding their inevitability, one which is closely connected to the context of moral education. My hope is that reflecting on these difficulties and on the task of moral education with which they are associated can help us illuminate and recover the insight that a mastery of language may be indispensable for a mastery of virtue.
