This article examines how digital epidemiology and eHealth coalesce into a powerful health surveillance system that fundamentally changes present notions of body and health. In the age of Big Data and Quantified Self, the conceptual and practical distinctions between individual and population body, personal and public health, surveillance and health care are diminishing. Expanding on Armstrong’s concept of “surveillance medicine” to “quantified self medicine” and drawing on my own research on the symbolic power of statistical constructs in medical encounters, this (...) article explores the impact of digital health surveillance on people’s perceptions, actions and subjectivities. It discusses the epistemic confusions and paradoxes produced by a health care system that increasingly treats patients as risk profiles and prompts them to do the same, namely to perceive and manage themselves as a bundle of health and security risks. Since these risks are necessarily constructed in reference to epidemiological data that postulate a statistical gaze, they also construct or make-up disembodied “individuals on alert”. (shrink)

Since the end of the 20th century, patient autonomy does not only aim at protecting patients’ personal rights, but also to promote their active cooperation in the health system. In Germany, the legal development of patient autonomy goes hand in hand with the concerted establishment of patient counseling and training designed to produce „informed decision makers“. This article examines the practice of patient autonomy and its corresponding subject beyond the sphere of formal law. Therefore, it draws on (1) reports of (...) the German „Sachverständigenrates zur Begutachtung der Entwicklung des Gesundheitswesens“ and (2) a medical genetic counseling session. On the basis of an influential political-economic discourse on health policy and an advisory doctor-patient encounter it can be shown that the original goal of patient autonomy, namely the protection of personal freedom, tends to be perverted: Patient counseling and training increasingly requires that autonomy be exercised on the condition that it incorporate an expert-controlled rationality and exhibit the subject-position of an „informed decision maker“. This article is an attempt to overcome this theoretical bottleneck, first by critiquing the sub optimal approach to processual problems generated by conventional Western business theories, which can neither recognise their hidden background assumptions about space nor transcend them, and second, by explaining, within the framework of comparative analysis, how ba leads to a new processual and dynamic account of business life. Our overall aim is to demonstrate how a new processual notion of space enables a deeper, more integrated understanding not only of the nature of the firm, but also of the role managers play within firms. In the parlance of modern Japanese philosophy, the term Basho denotes a field of experience underlying all conceptions of reality, while remaining itself conceptually ungraspable. The Basho of Economics, then, refers to the economy s hidden experiential ground, which has never been explicitly scrutinized, as such, by mainstream economics. We uncover this ground by discerning the tacit presuppositions of classical and neo-classical theories from the perspective of modern Japanese philosophy. In particular, we draw attention to the traditional atomist assumptions implicit (...) in their equilibrium-centered models. By breaking through these assumptions, we reconstruct the economy as a functional and relational world of habitual and creative activity outside of the scope of mechanical laws.". (shrink)

This paper provides a formal description of two legal domains. In addition, we describe the generation of various artificial datasets from these domains and explain the use of these datasets in previous experiments aligning learning and reasoning. These resources are made available for the further investigation of connections between arguments, cases and rules. The present study examined the effects of mindfulness training on attention regulation in university students and whether the potential benefits of implementation are influenced by the yoga component of mindfulness-based interventions (MBIs) and/or by MBI homework practice. In a non-randomized trial with pre- and post-assessments, n = 180 university students were allocated to either mindfulness training (experimental groups), awareness activities (active control group), or no training (passive control group). Mindfulness was taught through two MBIs, one including yoga and the other (...) excluding yoga. Attention regulation was operationalized via behavioral indicators, namely sustained attention, cognitive flexibility, cognitive inhibition, and data-driven information processing. With the exception of speed in a cognitive flexibility task, the results indicated no systematic or differential advantage arising from mindfulness training, with or without yoga, regarding the aspects of attention regulation. There was no consistent influence of homework quantity or quality. The implications for mindfulness training in academic contexts are discussed. (shrink)

These essays bring Neo-Kantianism back into contemporary philosophical discourse.

This article is an attempt to examine Christoph Menke’s critical theory of modern bourgeois law through the lenses of analytic jurisprudence. We therefore scrutinize some core concepts from his Critique of Rights in order to gain a better understanding of the so-called “new law” which is presented as a theoretical alternative to the allegedly defective law of ius proprium-rights [Eigenrechte]. In the first part, we sharpen Menke’s concept of normativity with a reason-based approach and by using the metaethical notions of (...) formal and robust normativity. This sets the stage for analyzing his brand-new concept of counter-rights [Gegenrechte] in the second part. We identify a whole archipelago of meanings for it and group them by considering potential mereological relations between ius proprium-rights and counter-rights. Our mapping turns out to be fruitful in shedding new light on an already known dilemma for the concept of counter-rights. The final section delivers a sketch of the implementation challenge for counter-rights: How can we achieve a “new law”? We distinguish several conceptions of a corresponding utopia and criticize Menke for resorting to a construction that is based on a fiction. (shrink)

Though a familiar (...) idea, Todorov uses this premise to provide a richly detailed map of the intellectual currents of the age, illuminating in the process the dangers inherent in the age's acceptance of this pact.The price to be paid for human free will would become apparent only in the following centuries—a separation from God, leading to secularism and materialism; a separation from other humans, culminating in a loss of sociality and a fall into radical isolation; ultimately, a loss of self, its unity dispersed into an "anomalous collection of impulses." Todorov delineates the age's four responses to this bargain, and the acquisition of human autonomy. They account for the four families whose interrelations characterize modernity: the conservative, which considers the three-fold price of autonomy too high, rejecting it for the authority of tradition; the scientistic—a diverse set of responses derived from modern science, historicism, Marxism, Darwinism, all of which deny the existence of human freedom and emphasize some form of determinism based on the laws of nature, reason, or history; the individualist, for which the "loss" of God, society, and self represents merely an extension of human liberation; and the humanist, which, while valuing human autonomy, does not want to [End Page 425] pay its price. Believing it can maintain communal existence, shared values, and responsible selfhood while acting out of an autonomous will, the humanist family wants to have its cake and eat it too, a desire Todorov clearly shares.Todorov delineates the views of these four families through close readings of their representative figures. Limiting himself to French authors, he includes Bonald and Tocqueville as conservatives; Condorcet, Diderot, the Encyclopedists as scientistic types; Pascal, La Rochefoucauld, De Sade, and Helvetius as individualists. Among the humanists, who are his focus, he emphasizes Montaigne, Descartes, Montesquieu, Rousseau, Constant, and Tocqueville again. While for me the primary value of Imperfect Garden is its contribution to the history of ideas of French humanism from the seventeenth to the nineteenth centuries, Todorov himself has a larger, more ideological goal. His interest is not primarily historical, but typological. He wants to crystallize the insights of his authors, distilling an ideal type whose characteristics include the ability of humans to initiate their own actions, which he calls the "autonomy of the 'I'," the ability to make another person the end of one's acts, which he calls the "finality of the 'you'," and the belief that every human has these abilities, that is, the "universality of the 'they'." Together they constitute an anthropology based on sociality, which insures the compatibility of human autonomy with social existence, shared values, and the stability of the self. He associates this "type" with a politics which provides the institutional structure for the exercise of these abilities. This latter point, the compatibility of humanism with democratic political structures, is the subtext running through the book. Humanism is, for Todorov, the modern family most compatible with democracy, just as democracy is the political institution most able to retain the positive aspects of human autonomy (pp. 29–32). This is his defense of humanism, subjected, as it currently is, to challenges which suggest the devil is trying to collect on the debt.Todorov argues his case by taking up each of the "losses" supposedly suffered when the moderns asserted the autonomy of human will. Paper, (...) € 34,80.These two new anthologies on Cassirer attest to the new attention that is being paid to what has often been referred to as "the last neo-Kantian." While interest in Cassirer's oeuvre as a whole, specifically his draft of a philosophy of symbolic forms as a philosophy of culture, has awoken again in the last decade on the European continent—mainly in Germany, but also in France and Italy—it is a pleasant surprise to see him also being well received in the Nordic European countries, as the volume edited by Foss and Kasa demonstrates. Both volumes—successfully, it should be noted—make the case that Cassirer can and in fact ought to play an important role for what goes on in contemporary philosophy and its projects, be they historical, hermeneutical, sociological, linguistic or other. These two books do a good job of demonstrating that Cassirer was unrightfully forgotten and deserves to be reconsidered, especially now that his complete works have and continue to become accessible in critical edition. This novel scholarship is not only about a reassessment of Cassirer's original achievements, as attempted in Foss/Kasa, but also about placing him in the context of twentieth-century philosophy. Leinkauf's volume, in particular, attempts to take stock of the history of philosophy and its meaning for us today—projects that were of paramount interest to Cassirer. It is only logical, hence, to compare his method to Dilthey's, whose manner of doing historiography is framed as a critique of historical reason.Leinkauf's anthology appears in the already well-established Cassirer-Forschungen with Meiner Publishers; as is known, Meiner also edits the critical Cassirer edition and the Collected [End Page 504] Works. Foss's and Kasa's volume, however, is an entirely novel venture into a philosopher who has been only little acknowledged in the Scandinavian countries—perhaps with the exception of Sweden to which the Cassirers emigrated and (after a brief stay in England) became naturalized after the Nazis' seizure of power. This seeming unfamiliarity with Cassirer also explains why the articles in the Norwegian volume are more general and intended to orient Cassirer in the intellectual landscape of these Northern countries that have traditionally been more inclined towards Anglo-American and Eastern-European philosophy. This, however, by no means diminishes the importance of this volume. Indeed, in terms of systematic philosophical approaches presented here, the essays in this volume are, with few exceptions, somewhat more lively and fresher than some of the rather staid historical studies of the German anthology. To be fair, the Leinkauf volume has a decidedly more specific agenda, namely, to locate Cassirer's attempts to interpret modernity, especially his studies of the Renaissance period, in a larger project of a historiography of modernity as a whole; a project that has been so much at the forefront in many philosophical endeavors in the late-twentieth and beginning twenty-first century. Cassirer is contrasted, as the title indicates, with another influential attempt at the same task, namely by Wilhelm Dilthey. This is especially interesting since Dilthey, being a generation older, took no notice of Cassirer's work, and Cassirer, in turn, gave only little attention to Dilthey's work, since his writings on the subject were published later. Thus, the anthology closes a gap both in Cassirer and Dilthey scholarship.What both books have outwardly in common, however, is the fact that they both are collections of papers given at conferences, in Potsdam and Trondheim, respectively. The contributors of the German volume are St. Otto, R. A. Makkreel, M. Mulsow, G. Cacciatore, E. Rudolph, H. Holzhey, U. Renz, G. Scholtz, and G. Hartung. The increasing availability of brain data within and outside the biomedical field, combined with the application of artificial intelligence (AI) to brain data analysis, poses a challenge for ethics and governance. We identify distinctive ethical implications of brain data acquisition and processing, and outline a multi-level governance framework. This framework is aimed at maximizing the benefits of facilitated brain data collection and further processing for science and medicine whilst minimizing risks and preventing harmful use. BackgroundThe association between language and mental health may be connected to several aspects of language. Based on the known associations, emotional vocabulary could be an important contribution to mental health and act as a risk, protective or resilience factor for mental health in general. As a preliminary test of this hypothesis, an assessment of emotional vocabulary was constructed and used among youths in school age. Cross-sectional associations and prediction models with parent-reported youth mental health as outcome were examined for emotional (...) vocabulary as well as general vocabulary, non-verbal problem solving and social communication, controlled for age, gender and subsamples.ResultsEmotional vocabulary, general vocabulary and non-verbal problem solving were directly associated with each other and similarly associated with age and gender. However, they were not significantly associated with social communication skills or mental health in the expected direction. Only social communication skills showed significant negative associations with behavioral mental health problems, suggesting these skills to be potential resources related to mental health.ImplicationFuture research should investigate whether behavioral problems may be prevented or improved by developing better social communication skills among community school-age youths. However, our results suggest that merely expanding emotional vocabulary is not likely to produce such effects unless this is integrated with improving social communication. (shrink)

Ethical thought experiments such as the trolley dilemma have been investigated extensively in the past, showing that humans act in utilitarian ways, trying to cause as little overall damage as possible. These trolley dilemmas have gained renewed attention over the past few years, especially due to the necessity of implementing moral decisions in autonomous driving vehicles. We conducted a set of experiments in which participants experienced modified trolley dilemmas as drivers in virtual reality environments. Participants had to make decisions between (...) driving in one of two lanes where different obstacles came into view. Eventually, the participants had to decide which of the objects they would crash into. Obstacles included a variety of human-like avatars of different ages and group sizes. Furthermore, the influence of sidewalks as potential safe harbors and a condition implicating self-sacrifice were tested. Results showed that participants, in general, decided in a utilitarian manner, sparing the highest number of avatars possible with a limited influence by the other variables. Derived from these findings, which are in line with the utilitarian approach in moral decision making, it will be argued for an obligatory ethics setting implemented in ADVs. (shrink)
