Achieving a good clinical trial design increases the likelihood that a trial will take place as planned, including that data will be obtained from a sufficient number of participants, and the total number of participants will be the minimal required to gain the knowledge sought. A good trial design also increases the likelihood that the knowledge sought by the experiment will be forthcoming. Achieving such a design is more than good sense—it is ethically required in experiments when participants are at (...) risk of harm. This paper argues that doing a power analysis effectively contributes to ensuring that a trial design is good. The ethical importance of good trial design has long been recognized for trials in which there is risk of serious harm to participants. However, whether the quality of a trial design, when the risk to participants is only minimal, is an ethical issue is rarely discussed. This paper argues that even in cases when the risk is minimal, the quality of the trial design is an ethical issue, and that this is reflected in the emphasis the Belmont Report places on the importance of the benefit of knowledge gained by society. In this paper I will develop a lambda-term calculus, lambda-2Int, for a bi-intuitionistic logic and discuss its implications for the notions of sense and denotation of derivations in a bilateralist setting. Thus, I will use the Curry-Howard correspondence, which has been well-established between the simply typed lambda-calculus and natural deduction systems for intuitionistic logic, and apply it to a bilateralist proof system displaying two derivability relations, one for proving and one for refuting. The basis will be the natural deduction (...) system of Wansing's bi-intuitionistic logic 2Int, which I will turn into a term-annotated form. Therefore, we need a type theory that extends to a two-sorted typed lambda-calculus. I will present such a term-annotated proof system for 2Int and prove a Dualization Theorem relating proofs and refutations in this system. On the basis of these formal results I will argue that this gives us interesting insights into questions about sense and denotation as well as synonymy and identity of proofs from a bilateralist point of view. Restorative or Retributive Justice South African Episcopal Archbishop Desmond Mpilo Tutu's account of the gritty practicality of reconciliation versus retribution in his book, No Future Without Forgiveness, focuses long overdue attention on Restorative Justice, a law reform movement probably better known in international than in American legal circles. A persuasive assertion of Restorative (...) Justice advocates in their critique of increasingly retributive practices such as mandatory minimum sentencing, mandatory arrest, death penalty, juvenile incarceration, "three strikes" legislation, no parole, diminished prisoner services, to name a few, is that reintegrating offenders back into a community is a much more effective deterrence to anti-social violence than punishment alone. They have also observed that communitarian ideals and practices, more visible in traditional cultures1 are more conducive to Restorative goals ofreconciliation and reintegration than are practices of retributive justice rooted in ideals of individual rights. Therefore, such adjudicatory practices should serve as models for preferable alternatives. 1An examination ofrestorative justice under code-based systems of law (European, Roman Law) might also reveal more affinities since the focus ofthese systems is to define the permissible, rather than the impermissible. Code-based law begins with the commons; rightsbased law begins with the individual. 80Sara Osborne However, Western-style retributive justice remains the primary model for international law and Restorative Justice is the prophetic "outsider" voice. So, it is appropriate to ask to what extent and under what conditions are Western retributive justice systems able to incorporate or accommodate adjudicatory practices ofnon-Western or traditional cultures? How critical a factor is religion? These questions will appear wherever Western Law struggles to bring more cultural diversity under a unifying umbrella and they deserve close scrutiny. René Girard's insights into the relationship between law, religion, culture and violence are helpful in identifying practical implications ofthe restorative vision and systemic weaknesses ofretribution, and perhaps illuminating a third way. The metaphor of an organ transplant may be useful: without a genetic match between host and donor both risk destruction. It is the thesis of this paper that that genetic material is a very inclusive conceptualization of "religion" which I have named "Ultimate Authority," drawing on Girard's mimetic theory for the theoretical analysis. In other words, "religion" is indeed, always and everywhere, a critical factor in culture-specific institutions ofjustice. A Girardian understanding ofthe relationship between Ultimate Authority and criminaljustice systems indicates that while there are valuable lessons to be learned from trans-cultural dialogue, wholesale transplants may not be possible, or even advisable because conditions essential for comparable success do not exist in Western legal culture. This paper first presents some background about Restorative Justice, followed by an outline ofRené Girard's mimetic theory to define "Ultimate Authority." The second half of the paper describes alternative adjudicatory processes which have attracted the attention of Restorative Justice advocates and concludes with suggestions about future directions for criminal justice policy discussion. Restorative Justice is a movement which drew its initial energy from Civil Rights era non-violent social action. It has found avid supporters among those whose activism for socialjustice is faith-based as well as those whose activism is rooted in more secular communitarian ideologies. Perhaps because of its international following, a significant contribution ofthe movement has been to initiate trans-cultural dialogue about criminal justice, fostering an increased use of alternative dispute resolution techniques, primarily mediation. Restorative Justice doctrine insists that all crime is personal, evidence ofa broken relationship between victim, offender, and community. Restoring "right relationship" between all parties is both a moral and legal obligation; "justice" to be just must go well beyond addressing the specifics of the act which effected the break. In contrast, the focus of The Role ofAn Ultimate Authority81 retributive justice appears abstract, procedural, and narrow in pursuit of impartiality or neutrality, the ideal of Blind Justice.2 Howard Zehr, a consultant on criminal justice and a Canadian Mennonite who wrote the classic Restorative Justice primer, Changing Lenses: A New Focusfor Crime andJustice, describes the retributive criminaljustice process as "a drama between two abstractions," meaning a criminal and a victim, where the "victim" is even further abstracted... Sara T. Fry maintains that care is a central concept for nursing ethics. This requires, among other things, that care is a virtue rather than a mode of being. But if care is a central virtue of ethics and medical ethics then the claim that care is a central concept for nursing ethics is trivial. Otherwise, it is implausible.

It has been argued that reduction procedures are closely connected to the question about identity of proofs and that accepting certain reductions would lead to a trivialization of identity of proofs in the sense that every derivation of the same conclusion would have to be identified. In this paper it will be shown that the question, which reductions we accept in our system, is not only important if we see them as generating a theory of proof identity but is also (...) decisive for the more general question whether a proof has meaningful content. There are certain reductions which would not only force us to identify proofs of different arbitrary formulas but which would render derivations in a system allowing them meaningless. To exclude such cases, a minimal criterion is proposed which reductions have to fulfill to be acceptable. (shrink)

pSara Ahmed’s emWillful Subjects/em develops an account of willfulness as a site of simultaneous oppression and resistance: a diagnosis attributed to particular (not-quite-)subjects and to modes of behavior that are thereby diminished, pathologized, and controlled, and a “diagnosis” that may be positively affirmed as a way of living and doing otherwise. This essay puts Ahmed’s work on willfulness in conversation with María Lugones’ decolonial feminism, particularly her theory of active subjectivity. With Lugones, we offer, one can better understand the resistant (...) potential of willfulness, not simply as the willful subject possessing an oppositional “will of her own” (which risks reinscribing a unitary notion of the self), but rather, as exercising a different kind of subjectivity altogether—one that relies on multiplicity and arises through relationships across non-dominant difference. Extending the connections that Ahmed herself draws between willfulness and “madness,” we further explore the willful elements in experiences relating to mental illness and cognitive disability, categories of experience that we understand to be important (and undertheorized) aspects of what Aníbal Quijano has termed “the coloniality of power.”/p. _The Promise of Happiness_ is a provocative cultural critique of the imperative to be happy. It asks what follows when we make our desires and even our own happiness conditional on the happiness of others: “I just want you to be happy”; “I’m happy if you’re happy.” Combining philosophy and feminist cultural studies, Sara Ahmed reveals the affective and moral work performed by the “happiness duty,” the expectation that we will be made happy by taking part in that which (...) is deemed good, and that by being happy ourselves, we will make others happy. Ahmed maintains that happiness is a promise that directs us toward certain life choices and away from others. Happiness is promised to those willing to live their lives in the right way. Ahmed draws on the intellectual history of happiness, from classical accounts of ethics as the good life, through seventeenth-century writings on affect and the passions, eighteenth-century debates on virtue and education, and nineteenth-century utilitarianism. She engages with feminist, antiracist, and queer critics who have shown how happiness is used to justify social oppression, and how challenging oppression causes unhappiness. Reading novels and films including_ Mrs. Dalloway_, _The Well of Loneliness_, _Bend It Like Beckham_, and _Children of Men_, Ahmed considers the plight of the figures who challenge and are challenged by the attribution of happiness to particular objects or social ideals: the feminist killjoy, the unhappy queer, the angry black woman, and the melancholic migrant. The loss of the federally protected constitutional right to an abortion is a threat to the already tenuous autonomy of pregnant people, and may augur future challenges to their right to refuse unwanted obstetric interventions. Even before Roe’s demise, pregnancy led to constraints on autonomy evidenced by clinician-led legal incursions against patients who refused obstetric interventions. In Dobbs v. Jackson Women’s Health Organization, the Supreme Court found that the right to liberty espoused in the Constitution does not extend to a (...) pregnant person’s right to an abortion. With Roe’s demise, the right to request specific types of care has been vitiated. The same argument underpinning that holding may now become ballast for attacks on the traditionally more robust right, the right to refuse. Here we discuss how the elevation of fetal and embryonic rights may lead to a cascade of medical intrusions and deprivations of liberty against pregnant persons, and offer an argument opposing these improprieties. A general method for generating contraction- and cut-free sequent calculi for a large family of normal modal logics is presented. The method covers all modal logics characterized by Kripke frames determined by universal or geometric properties and it can be extended to treat also Gödel-Löb provability logic. The calculi provide direct decision methods through terminating proof search. Syntactic proofs of modal undefinability results are obtained in the form of conservativity theorems.

This book continues from where the authors' previous book, Structural Proof Theory, ended. It presents an extension of the methods of analysis of proofs in pure logic to elementary axiomatic systems and to what is known as philosophical logic. A self-contained brief introduction to the proof theory of pure logic is included that serves both the mathematically and philosophically oriented reader. The method is built up gradually, with examples drawn from theories of order, lattice theory and elementary geometry. Geometric theories are presented as contraction- and cut-free systems of sequent calculi with mathematical rules following a prescribed rule-scheme that extends the scheme given in Negri and von Plato. Examples include cut-free calculi for Robinson arithmetic and real closed fields. As an immediate consequence of cut elimination, it is shown that if a geometric implication is classically derivable from a geometric theory then it is intuitionistically derivable.

The axiomatic presentation of modal systems and the standard formulations of natural deduction and sequent calculus for modal logic are reviewed, together with the difficulties that emerge with these approaches. Generalizations of standard proof systems are then presented. These include, among others, display calculi, hypersequents, and labelled systems, with the latter surveyed from a closer perspective.

A case study provides the basis for consideration of the purpose of business ethics teaching, the importance of reflection and the evaluation of ethics teaching. The way in which personal reflection and an increased capacity for ethical action can be encouraged and openly identified as aims of the course is discussed. The paper considers changes in the design and delivery of the international management ethics and values course taught at the University of South Australia as part of the undergraduate management (...) degree in Australia, Singapore and Hong Kong. As a result of student and teaching staff responses, and course evaluations, the course design, teaching and assessment has moved steadily toward an aim which explicitly refers to behaviour, without losing the significant conceptual base. Ways in which opportunities can be provided to enhance the development of a reflective capability are considered, including narrative, role models, ethical reflection, journal‐keeping and practice. The changes required a change in assessment practice. The difficulties of assessing intention and commitment to ethical action, whether in an individual course or across the curriculum, are discussed. (shrink)

Proofs and countermodels are the two sides of completeness proofs, but, in general, failure to find one does not automatically give the other. The limitation is encountered also for decidable non-classical logics in traditional completeness proofs based on Henkin’s method of maximal consistent sets of formulas. A method is presented that makes it possible to establish completeness in a direct way: For any given sequent either a proof in the given logical system or a countermodel in the corresponding frame class (...) is found. The method is a synthesis of a generation of calculi with internalized relational semantics, a Tait–Schütte–Takeuti style completeness proof, and procedures to finitize the countermodel construction. Finitizations for intuitionistic propositional logic are obtained through the search for a minimal derivation, through pruning of infinite branches in search trees by means of a suitable syntactic counterpart of semantic filtration, or through a proof-theoretic embedding into an appropriate provability logic. A number of examples illustrates the method, its subtleties, challenges, and present scope. (shrink)

‘Intersectionality’ has now become a major feature of feminist scholarly work, despite continued debates surrounding its precise definition. Since the term was coined and the field established in the late 1980s, countless articles, volumes and conferences have grown out of it, heralding a new phase in feminist and gender studies. Over the past few years, however, the growing number of critiques leveled against intersectionality warrants us as feminists to pause and reflect on the trajectory the concept has taken and on (...) the ways in which it has traveled through time and space. Conceptualizing intersectionality as a traveling theory allows for these multiple critiques to be contextualized and addressed. It is argued that the context of the neoliberal academy plays a major role in the ways in which intersectionality has lost much of its critical potential in some of its usages today. It is further suggested that Marxist feminism offers an important means of grounding intersectionality critically and expanding intersectionality’s ability to engage with feminism transnationally. This article examines where Kant stands on the question of the redistribution of wealth and income both nationally and globally. Kant is rightly seen as a radical reformer of the world order from a political standpoint seeking a republican, federative worldwide system; can he also be seen as wanting to bring about an equally dramatic shift from an economic perspective? To answer this question we have first of all to address the question of whether he is an egalitarian or an (...) inegalitarian at the national level. Certainly there are certain social and material inequalities within a civil society Kant is prepared to accept and there are some he is not. This would imply that he would affirm certain inequalities at an international level and that there are others upon which he would recommend action. Thus the question arises as to whether or not it is appropriate for Kantians to regard the current enormous inequalities in wealth and income between individuals living in different parts of the globe as scandalous and in need of change. The paper throughout relates the problem of distributive justice within the state to the problem of distributive justice amongst states, arguing that this approach is warranted by Kant's own method. Particular attention is paid to how Kant's own approach to political philosophy may be deployed to underpin a change to a distinctive type of international distributive justice. (shrink)

This paper provides a proof-theoretic study of quantified non-normal modal logics. It introduces labelled sequent calculi based on neighbourhood semantics for the first-order extension, with both varying and constant domains, of monotone NNML, and studies the role of the Barcan formulas in these calculi. It will be shown that the calculi introduced have good structural properties: invertibility of the rules, height-preserving admissibility of weakening and contraction and syntactic cut elimination. It will also be shown that each of the calculi introduced (...) is sound and complete with respect to the appropriate class of neighbourhood frames. In particular, the completeness proof constructs a formal derivation for derivable sequents and a countermodel for non-derivable ones, and gives a semantic proof of the admissibility of cut. Decolonial/anti-colonial Black, Indigenous and Mestiza feminist movements and scholar-activists foreground how the oft-touted apocalypse that the Covid-19 pandemic heralds is not new, nor does it signify the great rupture into chaos that those from within modernity-coloniality often claim it to be. Rather Covid-19 is preceded by and will be out-lived by the apocalyptic anti-life onto-epistemological logics that are foundational to the production of hetero-patriarchal capitalist- coloniality. However, one would commit the violence of reproduction of the epistemological logics and rationalities constitutive (...) of the current system if the story ended there. We have survived and our survival points to the urgent necessity and responsibility of social theory to listen to the story of the pandemic from a Black/Indigenous genealogy and to begin the sense-making of the Covid-19 pandemic, from prior to this particular virus, outside, against and beyond the politics of knowledge of critical social theory itself. Thus, I invite you to journey to an affirmative re-enfleshment of reason and theory-making in relation to and dialogue with Black, Indigenous, and subaltern Mestiza feminist movements in southwest Colombia and in southeast so-called Australia in the unceded lands of the Awabakal and the Worimi. I explore this through the metaphor, the materiality, the cosmology and the herstory of the mangrove swamps a knowing-being otherwise visible to the dehumanising gave of Whiteness and bring to thought three stories of a politics of knowledge of/as the Black/racialised and feminised body/flesh. To do this is to suggest that the co-creation of pathways which are life affirming and life making beyond and out of the post-Covid 19 conjuncture involves an epistemological-political project which decolonises and feminises the containments of reason and knowing being of coloniality/modernity. A relation between two secrets, known in the literature as nondeducibility , was originally introduced by Sutherland. We extend it to a relation between sets of secrets that we call independence . This paper proposes a formal logical system for the independence relation, proves the completeness of the system with respect to a semantics of secrets, and shows that all axioms of the system are logically independent.

The article proposes Logic of Secrets in Collaboration Networks, a formal logical system for reasoning about a set of secrets established over a fixed configuration of communication channels. The system’s key feature, a multi-channel relation called independence, is a generalization of a two-channel relation known in the literature as nondeducibility. The main result is the completeness of the proposed system with respect to a semantics of secrets.

The main result of this paper is a normalizing system of natural deduction for the full language of intuitionistic linear logic. No explicit weakening or contraction rules for -formulas are needed. By the systematic use of general elimination rules a correspondence between normal derivations and cut-free derivations in sequent calculus is obtained. Normalization and the subformula property for normal derivations follow through translation to sequent calculus and cut-elimination.

A proof-theoretical analysis of elementary theories of order relations is effected through the formulation of order axioms as mathematical rules added to contraction-free sequent calculus. Among the results obtained are proof-theoretical formulations of conservativity theorems corresponding to Szpilrajn’s theorem on the extension of a partial order into a linear one. Decidability of the theories of partial and linear order for quantifier-free sequents is shown by giving terminating methods of proof-search.

Contraction-free sequent calculi for intuitionistic theories of apartness and order are given and cut-elimination for the calculi proved. Among the consequences of the result is the disjunction property for these theories. Through methods of proof analysis and permutation of rules, we establish conservativity of the theory of apartness over the theory of equality defined as the negation of apartness, for sequents in which all atomic formulas appear negated. This paper supports the need for health professionals to be trained in argumentation theory, by illustrating the challenges that they face in interacting with patients and according to the different models of consultation that patients prefer. While there is no ideal model of consultation that can be promoted universally, the ability to construct arguments in support of health professionals’ points of view, as well as the ability to engage in critical discussion with patients, translate in essential skills for reaching patients’ (...) agreement when communication develops through the interpretative model or the informed decision model or, eventually, shared decision-making. Bernard Rollin argues that it is permissible to change an animal's telos through genetic engineering, if it doesn't harm the animal's welfare. Recent attempts to undermine his argument rely either on the claim that diminishing certain capacities always harms an animal's welfare or on the claim that it always violates an animal's integrity. I argue that these fail. However, respect for animal dignity provides a defeasible reason not to engineer an animal in a way that inhibits the development of those (...) functions that a member of its species can normally perform, even if the modification would improve the animal's welfare.
