Much of the ontology made in the analytic tradition of philosophy nowadays is founded on some of Quine’s proposals. His naturalism and the binding between existence and quantification are respectively two of his very influential metaphilosophical and methodological theses. Nevertheless, many of his specific claims are quite controversial and contemporaneously have few followers. Some of them are: (a) his rejection of higher-order logic; (b) his resistance in accepting the intensionality of ontological commitments; (c) his rejection of first-order modal logic; and (...) (d) his rejection of the distinction between analytic and synthetic statements. I intend to argue that these controversial negative claims are just interconnected consequences of those much more accepted and apparently less harmful metaphilosophical and methodological theses, and that the glue linking all these consequences to its causes is the notion of extensionality. Cyber warfare has changed the scenario of war from an empirical and a theoretical viewpoint. Cyber war is no longer based on physical violence only, but on military, political, economic and ideological strategies meant to exploit a state’s informational resources. This means that a deeper understanding of what cyber war is requires us to adopt an informational approach. This approach may enable us to account for the two-dimensional nature of cyber war, to revise the notion of violence on which war (...) is premised and to understand to what extent the traditional ideas of ‘just war’ may apply to the scenario of cyber warfare. There has been a rising trend in cosmopolitan moral theory to seriously take into consideration the human's rootedness in, and partiality toward, particular cultures, places, peoples and traditions. This essay suggests that reframing our theorizing on cosmopolitanism from one that primarily addresses an ethico-political set of questions to one that addresses questions related to moral psychology, personal and collective identity formation and the ways in which civilizations and cultural communities cultivate an ethos may assist in the task of generating a (...) rooted form of cosmopolitanism. Conceptualizing cosmopolitanism as an ethos entails a shift from considering our moral obligations to distant others toward a focus on the types of dispositions and character traits necessary to forge a sense of intercultural solidarity. Through an analysis of the ideas of ‘diaspora’, ‘proximity’, ‘partiality' and the ‘foreign’, it will be suggested that through our rootedness in particularity, and our ability to be partia.. In his recent analysis of multiculturalism, Tom Beauchamp has argued that those who implement multicultural reasoning in their arguments against common morality theories, such as his own, have failed to understand that multiculturalism is neither a form of moral pluralism nor ethical relativism but is rather a universalistic moral theory in its own right. Beauchamp’s position is indeed on the right track in that multiculturalists do not consider themselves ethical relativists. Yet, Beauchamp tends to miss the mark when he argues (...) that multiculturalism is in effect a school of thought that endorses a form of moral universalism that is akin to his own vision of a common morality. As a supporter of multiculturalism, I would like to discuss some aspects of Beauchamp’s comments on multiculturalism and clarify what a multicultural account of public bioethics might look like. Ultimately, multiculturalism is purported as a means of managing diversity in the public arena and should not be thought of as endorsing either a version of moral relativism or a universal morality. By simultaneously refraining from the promotion of a comprehensive common moral system while it attempts to avoid a collapse into relativism, multiculturalism can serve as the ethico-political framework in which diverse moralities can be managed and in which opportunities for ethical dialogue, debate and deliberation on the prospects of common bioethical norms are made possible. David Hollenbach, working within the context of human rights theory, has developed the notion of "indigenous pluralism" as a means of coping with the problems that arise when different religious traditions hold distinct or incompatible interpretations of human rights. It will be argued that indigenous pluralism is a theoretically and practically useful concept for bioethics as well and hence should be incorporated into bioethical methodology and processes of bioethical policy formation. Subsequently, the notion of indigenous pluralism will be discussed in (...) relation to determinations of death as a means of illustrating this concept's applicability to bioethical inquiry. The present paper aims at addressing a crucial legal conflict in the information society: i.e., the conflict between security and civil rights, which calls for a “fine and ethical balance”. Our purpose is to understand, from the legal theory viewpoint, how a fine ethical balance can be conceived and what the conditions for this balance to be possible are. This requires us to enter in a four-stage examination, by asking: (1) What types of conflict may be dealt with by means (...) of balancing? (2) What is meant by balancing? Is it a metaphor that hides and dissimulates discretionary powers and subjective decisions or a rational instrument that helps us cope with conflicts between fundamental values and interests? (3) What models of balancing are available to us? Are these models irreducible to each other? What can provide us with a common understanding of different models of balancing? (4) How can the crucial issues of rational controllability, predictability, and homogeneity of legal decisions be dealt with? Our paper will try to answer those questions by trying to reconstruct the act of balancing in terms of a rational legal reasoning, which relies upon information. In fact, every judicial decision contains some information that is delivered to the legal system: that information may serve as the basis for future evaluations, decisions, and actions, and thus influence the way we recognize and hence we protect our values, interests, and rights. In this perspective, our examination will attempt to understand those questions in informational terms. This informational treatment can provide us with a more universalistic understanding of those issues and offer us a novel way to conceptually deal with them. To this aim, we will avail yourself of Luciano Floridi’s philosophy of information: notably, we believe his constructionist conception of epistemology is crucial, based on the Maker’s Knowledge approach and his solution of the upgrading problem (i.e., from information to knowledge) in terms of a network theory of account. The informational approach will help us having a better understanding of the balance between competing interests. (shrink)

In Roger Pielke Jr.’s The Honest Broker (2007) he discusses different roles a scientist can adopt when giving advice to policymakers. The honest broker role focuses on clarifying and expanding the scope of choice for others. This role has the virtues of being sensitive to known problems with experts being partisan by stealth, dominating policy decisions by controlling knowledge input, and reducing the scope of considerations deemed relevant to decision-making. Yet I argue that to the extent the honest broker role (...) involves expanding the scope of choice, an array of problems arises. These include ambiguity about which and whose consensus ought to guide scientists in their decisions about what role to adopt, an implicit tendency to insulate politics from science, and a possible replication of the anti-pluralism of political populism. Drawing upon Phillip Pettit’s critique of Isaiah Berlin’s account of freedom as non-interference, I argue that the honest broker role for scientists inherits the problems afflicting accounts of freedom as the non-restriction of options: namely, the problems of adaptive preference formation and ingratiation. On this basis I suggest not advising scientists to be honest brokers, because doing so might fail to help them be reflexive scientists. (shrink)

The aim of the paper is to give an account of Peter Winch's conception of persuasion. According to Winch, persuasive arguments are those carried out in order to let an interlocutor with a different world picture, and thus a different epistemology, see the point of our practices and beliefs. This involves convincing him of the fact that his way of thinking is neither unique nor better than other ones. Furthermore, given that there is no guarantee that one can arrive at (...) a complete understanding of alien practices, persuasion may, in some cases, aim at the impossible. (shrink)

Lorenzo Magnani’s book is a broad and deep meditation on the theme of violence. For the author, the theoretical and methodological problem lies not in trying to find a privileged access to the issue of violence, but rather to raise this issue to the status of an independent, chiefly philosophical subject. This requires a strategic twofold move: on the one hand, one needs a strong and comprehensive philosophical hypothesis about violence; on the other, it is necessary to bring to a (...) theoretical unity the plurality or, to put it differently, the fragmentation of analyses consecrated to the issue of violence—and this result is achieved precisely thanks to a comprehensive philosophical hypothesis. This review discusses Harold Berman’s, Law and Language, published by Cambridge University Press in 2013. It locates this short book in relation to Berman’s extensive body of publications in international and comparative law, and asks what contribution the book’s recent, posthumous publication can make to current debates over approaches to forensic linguistics. Particular attention is given to Berman’s conceptualisation of law as a ‘living language’, as well as to his coining of the term ‘communification’ to describe the value of legal-lay (...) dialogue in building a public sense of community and in sustaining the legitimacy of legal systems. This book provides a detailed discussion of the theoretical and practical implications of the change driven by ICTs. Such a change is often much more profound than an emphasis on information technology and society can capture, for not only does it bring about ethical and policy vacuums that call for a new understanding of ethics, politics and law, but it also "re-ontologizes reality", as propounded by Luciano Floridi's philosophy and ethics of information. The informational turn is transforming our understanding of (...) reality by challenging the conventional ways we have of thinking about our world and our identities in terms of stable and enduring structures and beliefs. The information age we inhabit brings to completion our self-understanding as informational systems that produce, process, and exchange information with other informational systems, in an environment that is itself made up of information. The present volume provides us with a better understanding of the normative nature and role of information, helping us to grasp the sense and extent to which informational resources serve as "constraining affordances" guiding our behaviours. It does so by delineating the background against which we build our beliefs about reality, make decisions, and behave, through our interactions with a multi-agent system that is increasingly dependent on ICTs. The book will be of interest to a vast audience, ranging from information technologists, ethicists, policy makers, social and legal scholars, and all those willing to embrace the following three tenets: we construct our world and ourselves informationally; by constructing our world and ourselves we thereby become aware of our limits; it is precisely these limits that make us become human beings. This article examines some of the most relevant issues concerning P2P systems so as to take sides in today's strongly polarized debate. The idea is to integrate a context-based perspective with an ontological representation of informational norms; thanks to a procedural outlook which is presented in terms of burden of proof More particularly, we examine three ''roads." First, the topological approach to complex social networks allows us to comprehend the laws according to which information is distributed through P2P systems and (...) how a "short route" has joined, and sometimes replaced, the traditional "long route" between creator, business, and the public. The second road is the context-based perspective elaborated by Helen Nissenbaum, and developed by Francis Grodzinsky and Herman Tavani: The goal is to determine the norms that govern such an informational flow as norms of appropriateness and distribution. The final road is the informational viewpoint on ethics proposed by Luciano Floridi with the idea that standard ethical theories cannot easily be adapted to deal with the new informational issues emerging with digital technology. While empirical evidence on the impact of P2P systems is still quite controversial, it is crucial to determine on whom the burden of proof falls in a given context, on censors or advocates, by singling out both the default norms and exceptions in the use and development of P2P software. This book discuss the meaning and implications of the social and ethical implications of the notion of social responsibility in healthcare in six major world religions — Buddhism, Christianity, Confucianism, Hinduism, Islam, & Judaism. This collection of papers is based on a four-day workshop where bioethics experts from various religious traditions gathered. They discussed the ways in which their respective traditions could, or could not, uphold the tenets of Article 14 of UNESCO's Universal Declaration of bioethics and Human Rights. The (...) different papers presented in this book are based on this interchange of ideas at the workshop. The book explores the potential points of convergence among the various perspectives presented, as well as a discussion on the ways in which their moral differences may be managed. The managing of these moral differences through international socio-ethical mechanisms, contributes significantly to the UNESCO Universal Declaration of Bioethics and Human Rights’ goal of simultaneously respecting religio-cultural pluralism while upholding a commitment to human rights. The paper examines the open problems that experts of space law shall increasingly address over the next few years, according to four different sets of legal issues. Such differentiation sheds light on what is old and what is new with today’s troubles of space law, e.g., the privatization of space, vis-à-vis the challenges that AI raises in this field. Some AI challenges depend on its unique features, e.g., autonomy and opacity, and how they affect pillars of the law, whether on (...) Earth or in space missions. The paper insists on a further class of legal issues that AI systems raise, however, only in outer space. We shall never overlook the constraints of a hazardous and hostile environment, such as on a mission between Mars and the Moon. The aim of this paper is to illustrate what is still mostly unexplored or in its infancy in this kind of research, namely, the fourfold ways in which the uniqueness of AI and that of outer space impact both ethical and legal standards. Such standards shall provide for thresholds of evaluation according to which courts and legislators evaluate the pros and cons of technology. Our claim is that a new generation of sui generis standards of space law, stricter or more flexible standards for AI systems in outer space, down to the “principle of equality” between human standards and robotic standards, will follow as a result of this twofold uniqueness of AI and of outer space. This article aims to show the objections made by Arthur Schopenhauer (1788-1860) to Immanuel Kant’s doctrine of right (1724-1804). Based on the main Schopenhauer’s work we’ll be able to explain the five points of disagreement between Schopenhauer and Kant: (i) Kant tries to separate right sharply from ethics; (ii) the definition (Bestimmung) of the concept of right; (iii) the right to property (what is the basis of this right and if its exists outside the State); (iv) the purpose of the (...) State; and (v) the right to punish. (shrink)

Disagreement over what exists is so fundamental that it tends to hinder or even to block dialogue among disputants. The various controversies between believers and atheists, or realists and nominalists, are only two kinds of examples. Interested in contributing to the intelligibility of the debate on ontology, in 1939 Willard van Orman Quine began a series of works which introduces the notion of ontological commitment and proposes an allegedly objective criterion to identify the exact conditions under which a theoretical discourse (...) signals an assumption of existence. I intend to present the concept of ontological commitment and the Quinean criterion, to expose and evaluate some of the many criticisms to which the criterion has subject and to situate it in the context of Quine’s philosophy. As a product of such analyses, I hope to contribute to the discussion on the application and relevance of the notion of ontological commitment. (shrink)

Il contributo sostiene che una versione lunga e composita del Viaggio notturno del profeta e della sua ascensione, attribuita a Ibn ‘Abbas attraverso una figura più tarda conosciuta come al-Bakri, è diventata molto popolare e largamente diffusa nel tredicesimo secolo. Qui si propone una traduzione del viaggio celeste di Muhammad a partire da un importante manoscritto inedito di Istanbul copiato nella penisola araba verso la fine del tredicesimo secolo. Questa traduzione si propone come strumento per gli studiosi interessati alla tradizione (...) islamica delle ascensioni celesti e per chi si occupa delle possibile influenze musulmane sull’opera di Dante. Nonostante non si dimostri che Dante avesse avuto accesso diretto a questa fonte nel momento in cui componeva la divina commedia, ci sono prove sufficienti che le versioni di questo racconto fossero diffuse in diverse parti del Mediterraneo, prima e durante la vita di Dante. L’autore fa propria la recente ipotesi interpretativa di Bencheikh che sottolinea il ruolo fondamentale della versione di Bakri del Mi’râj per la composizione dell’ormai noto Libro della Scala, tradotto in latino e lingua francese antico in al-Andalus nella seconda metà del tredicesimo secolo.This article argues that a long and composite version of the narrative of Muhammad's night journey and ascension, one often ascribed to Ibn 'Abbas via a later figure known as al-Bakri, became especially popular and widely distributed in the thirteenth-century CE. It offers a translation of the Tour of Paradise section from a particularly important unpublished Istanbul manuscript preserving this version, copied in the Arabian peninsula near the end of the thirteenth-century. This translation could serve as a resource to scholars who are interested in the history of Islamic ascension narratives, and interested in the question of possible Muslim influences on Dante's Divine Comedy. While the author of this article does not argue that Dante must have been aware of this particular manuscript as he composed his masterwork, he claims that there is enough evidence to suggest that versions of this narrative circulated in different parts of the Mediterranean before and during Dante's lifetime. He supports the earlier conjecture by Bencheikh that the Bakri versions were likely foundational to the composition of the now famous "Book of Muhammad's Ladder" that was translated into Latin and Old French in al-Andalus / Spain in the second half of the thirteenth-century. In his "May Belief Outstrip Evidence?" (1916) Durant Drake argues that beliefs may sometimes permissibly outstrip evidence. Drake's novel idea is that epistemic reasons are not the final arbiter of the justificatory status of beliefs. In this short note I motivate Drake's idea by suggesting an analogy between the epistemic justification of belief and the moral justification of intention.

Puede decirse, sin ir demasiado lejos, que la obra del sociólogo francés de Pierre Bourdieu ha sido una de las más brillantes e imaginativas del panorma de las ciencias sociales en la segunda mitad del siglo XX. Este libro trata de sacar a la luz la forma en la que las herramientas de su sociología fueron creadas. No obstante, este texto no comienza con un realto de sus obras, sino de su vida. Pierre Bourdieu no nace intelectual, se hace en (...) un contexto que -en su caso, especialmente durante sus primeros años de su vida- tiene poco de tal. Se trata, pues, de una investigación histórica de la figura de un intelectual que evita dos caminos ya trillados: la vía externalista, que toma a los eventos históricos, sociales o económicos como fuente de toda explicación de la vida intelectual y científica, y la vía internalista, que cosidera que sus miembros viven en una esfera aislada y ajena a toda influencia exterior. Está última vía es la que se suele transitar cuando un pensador ha legado una obra que despierta admiración. Para ello, el autor emplea algunas de las ideas que Randall Collins delineo en su opus magnum Sociología de las filosofías, quizá uno de los libros que mejor ha sabido captar las dinámicas que gobiernan el mundo intelectual. Más concretamente, el autor de este libro hace suya la idea de que son las interacciones cara a cara las relaciones fundamentales que gobiernan la vida intelectual. (shrink)

Quiconque a visité la Chambre de la Signature, au Vatican, et s’est attardé devant « L’École d’Athènes » de Raphaël garde en mémoire l’image significative qu’offrent, au centre de la composition, les personnages d’Aristote et de Platon. C’est l’image, en raccourci, d’un dialogue poursuivi vingt années durant par le maître de l’Académie et son disciple de Stagire, l’un des plus féconds sans doute qu’ait jamais comptés l’histoire de la pensée philosophique. La première rencontre entre les deux hommes eut lieu (...) probablement au cours de l’année 366/5 avant notre ère. Ils vécurent ensemble, à Athènes, dans un commerce quasi constant, pour ainsi dire jusqu’à la mort de Platon, au mois de mai 347. Cependant, le maître avait laissé pour toujours son empreinte sur l’esprit du disciple. Au point que le lecteur attentif d’Aristote peut avoir l’impression de souvent trouver dans ses œuvres, comme disait Th. Gomperz, le « Platonicien » et l’« Asclépiade » confrontés l’un à l’autre sur toutes les grandes questions de la philosophie. Le difficile accord, parfois constaté dans le Corpus Aristotelicum, entre les thèses recommandées respectivement par l’héritier de l’Académie et le champion d’une philosophie nouvelle pose incontestablement le problème le plus redoutable que doit affronter l’exégèse.
