One of the underlying ethical values of the Patient Self-Determination Act (PSDA) is the legal right of patients to decide on their own medical care, i.e., to accept or refuse medical treatment. Yet, there is a growing concern that a patient's legal right to determine medical treatment might result in health care professionals violating their own personal and/or professional ethical values. I shall therefore briefly review the requirements of the PSDA and outline the consequences of this act for a particular (...) case. The application of the Act becomes problematic in this case because the health care professionals involved believe that the treatments involved are medically futile. I consider the potential conflict between autonomy and futility. The thesis defended is that patient autonomy is not an absolute moral right and that health care professionals are not only permitted, but are sometimes morally required, to withhold and/or withdraw futile treatments even if the patient or the patient's surrogate request (demand!) that the treatments be continued. The Supreme Court’s decision in New York State Rifle & Pistol Association Inc. v. Bruen undermines the ability of cities and states to regulate firearms safety. Nonetheless, we remain hopeful that firearm violence can decline even after the Bruen decision. Several promising public health approaches have gained broader adoption in recent years. This essay examines the key drivers of community firearm violence and reviews promising strategies to reverse those conditions, including community violence intervention (CVI) programs and place-based and structural interventions.

Bruening describes his book as "an attempt to capture the spirit of the man—not his works and his life considered in isolation from each other, but the person himself as one single human being." For the most part, however, life and works are separately presented, most of the biographical data being concentrated in the first chapter. Thereafter the works are treated one by one, in largely chronological order: "Notes on Logic" ; "Notes Dictated to Moore" ; Notebooks ; Prototractatus ; (...) Tractatus ; "Lecture on Ethics" ; Blue Book ; Brown Book ; Philosophical Investigations ; Philosophische Bemerkungen ; Philosophical Grammar ; Remarks on the Foundations of Mathematics ; Lectures and Conversations on Aesthetics, Psychology and Religious Belief ; Zettel ; On Certainty. Bruening does not explain his principles of selection. The direction of his interests is suggested by the ten pages on Lectures and Conversations, not written by Wittgenstein, as compared to the mere half page devoted to On Certainty, or by the four pages on a popular lecture on ethics as compared to the single page on Philosophische Bemerkungen. Longer treatments follow the course of the work being glossed and sample its topics, save in the case of the Investigations, where remarks are grouped under these five headings: "Reflections on the Tractatus," "Language Games and Forms of Life," "The Mind-Body Problem and Private Language," "The Nature of Philosophy," and "Seeing and Seeing As." Doubtless beginning readers such as Bruening usually has in view would have found more profit and interest in the coherent development of such themes than in running comments on work after work, especially if they had been shown inside Wittgenstein’s problems and been made to sense the struggle. This seldom happens, however, and the inaccuracies are numerous and sometimes serious. A select bibliography is appended.—G.L.H. (shrink)

In this study, I surveyed students' evaluative perceptions of instructor behavior and their possible influence on academic dishonesty. Slightly over 20% of 1,369 student respondents admitted to academic dishonesty in at least 1 class during 1 term at college. Students who admitted to acts of academic dishonesty had lower overall evaluations of instructor behavior than students who reported not committing academic dishonesty. Implications for student learning and the enhancement of academic integrity in the classroom are discussed.

This article continues a discussion the authors have had with Mats Wahlberg on evolutionary theodicies. We have previously suggested a theodicy where there are token unique goods that could only have been actualized through indeterministic evolution. Wahlberg objects that we cannot appeal to such goods, since given indeterminism, God cannot know that such goods will appear. In this article we respond by arguing that God can know well enough that certain kinds of token goods will appear, without knowing in detail (...) their specific character, or when they will happen. This book presents a new and radical interpretation of some of Martin Heidegger’s most influential texts. The unfamiliar interpretations all seek to question and unframe hasty assessments of the concepts and constellations of thoughts surrounding Heidegger’s notion of modern technology.

The introduction of the concept of capital inCapital– with the words ‘we find’ – has provoked a great deal of discussion about the precise relation between the categories of simple circulation and the concept of capital. In this article, I argue that Marx derives the concept of capital by way of an analysis of the immanent contradictions of money, and that this dialectical derivation can be understood as a conceptual movement in which the concepts of money and capital progressively change (...) their modal status. Furthermore, I examine the development of this transition to capital throughout Marx’s writings from the period 1857 to 1872, arguing that the same arguments can be found in all the relevant writings. Finally, the article provides a critical review of the literature on the transition to capital. (shrink)

While discovery of error provides personal gain for the entrepreneur, does this process automatically allocate value equitably among all stakeholders? We argue that the entrepreneurial process can be used to generate or maintain an entrepreneur’s personal wealth through the exploitation of a stakeholder group. Thus entrepreneurship can be both an equilibrating and a disequilibrating process and that both the visible hand of government and the decisions of an entrepreneur can speed or slow our movement toward value equilibrium. Speed toward value (...) equilibrium is likely to be important to a victimized stakeholder group and deserves further scholarly attention. (shrink)

Socrates wrote nothing; Plato's accounts of Socrates helped to establish western politics, ethics, and metaphysics. Both have played crucial and dramatically changing roles in western culture. In the last two centuries, the triumph of democracy has led many to side with the Athenians against a Socrates whom they were right to kill. Meanwhile the Cold War gave us polar images of Plato as both a dangerous totalitarian and an escapist intellectual. And visions of Plato have proliferated at the heart of (...) postmodern critiques of the very idea of metaphysics and politics. Plato's Progeny begins with an account of modern responses to the trial of Socrates and the controversial question of Socrates' relation to Plato. At its centre are two chapters exploring the idea of Platonic origins in and for philosophy, and of Platonic foundations for philosophical politics. Exploring unfamiliar as well as familiar invocations of Plato, Melissa Lane argues that twentieth-century ideological battles have obscured the importance of Socratic individualism, the nature of Platonic ethics, and the value of Platonic politics. The aim of this inquiry is to investigate Heidegger's ontology of technology. We will show that this ontology is aporetic. In Heidegger's key technical essays, ?The question concerning technology? and its earlier versions ?Enframing? and ?The danger?, enframing is described as the ontological basis of modern life. But the account of enframing is ambiguous. Sometimes it is described as totally binding and at other times it appears to allow for exceptions. This oscillation between, what we will call total enframing and (...) partial enframing, is underscored in the work of two influential scholars of Heidegger's later thought, Hubert Dreyfus and Iain Thomson. We will show that like Heidegger, Dreyfus and Thomson unwittingly perpetuate this dilemma that ultimately covers up the aporetic structure of enframing. (shrink)

No part ot Plato's writings has been more debated than the three similes in Books VI.-VII. of the Republic, and still there is a diversity of opinion about their meaning. I believe that most of these difficulties arise from certain assumptions about their purpose which need revision. The current view applies the Cave to the Line, as Plato seems to direct, and this application, which is itself attended by considerable difficulties, leads to an assimilation of the two figures till they (...) seem to have much the same content and purpose. Again, as this makes the lower line appear to be the phenomenal world, it is thought that the simile of the sun foreshadows the theme of the Line by hinting at a connexion between the intelligible and the sensible which is made more explicit in the Line. Thus the group of similes seem mainly intended to show the dependence of Becoming upon Being. This paper will argue that such a view depends upon the misrepresentation of the symbolism adopted by Plato, that two antithetical groups of symbols are confused with one another, and that symbols are even identified with antitypes. Owing to these misinterpretations the Form of the Good has been mistaken for a material cause; both the Line and the Cave have been thought to reveal Plato as embarrassed by a dualism between sense and intellect, and the purpose of the Cave in particular, since the error is cumulative, has been completely obscured. This paper will attempt to substitute for current accounts another interpretation which will relate the three similes closely with the political arguments of Book VI., and with the Platonic education which is set forth in close connexion with them. In classical American pragmatism, fallibilism refers to the conception of truth as an ongoing process of improving human knowledge that is nevertheless susceptible to error. This paper traces appearances of fallibilism in Jewish thought in general, and particularly in the halakhic thought of Eliezer Berkovits. Berkovits recognizes the human condition’s persistent mutability, which he sees as characterizing the ongoing effort to interpret and apply halakhah in shifting historical and social contexts as Torat Ḥayyim. In the conclusion of the article, broader (...) questions and observations are raised regarding Jewish tradition, fallibility, and modernity, and the interaction between Judaism and pragmatism in the history of ideas. In the wake of both the semiotic and the psychoanalytic revolutions, how is it possible to describe the object of religious worship in realist terms? Semioticians argue that each object is known only insofar as it gives birth to a series of signs and interpretants (new signs). From the psychoanalytic side, religious beliefs are seen to belong to transference energies and projections that contaminate the religious object with all-too-human complexes. In Nature's Religion, distinguished theologian and philosopher Robert S. Corrington weaves (...) together the concept of infinite semiosis with that of the transference to show that the self does have access to something in nature that is intrinsically religious. Corrington argues that signs and our various transference fields can and do connect us with fully natural religious powers that are not of our own making, thereby opening up a path past the Western monotheisms to a capacious religion of nature. The article proposes that the hypothetical framework of Kierkegaard's "Philosophical Fragments" is determined by the question 'How is it possible for one to become a disciple?' An account of this framework is provided by employing an original interpretation of the concept 'the Moment'. This enables an understanding of 'the condition' by means of a contrast between 'Universalist' and 'Particularist' perspectives. Moreover, it is only when the insights offered by both perspectives are combined that the answer to the determining question of (...) the Fragments becomes apparent. (shrink)
