This book offers a definitive and wide-ranging overview of developments in behavioral finance over the past ten years. In 1993, the first volume provided the standard reference to this new approach in finance--an approach that, as editor Richard Thaler put it, "entertains the possibility that some of the agents in the economy behave less than fully rationally some of the time." In Minkowski spacetime, because of the relativity of simultaneity to the inertial frame chosen, there is no unique world-at-an-instant. Thus the classical view that there is a unique set of events existing now in a three dimensional space cannot be sustained. The two solutions most often advanced are that the four-dimensional structure of events and processes is alone real, and that becoming present is not an objective part of reality; and that present existence is not an absolute notion, but is (...) relative to inertial frame; the world-at-an-instant is a three dimensional, but relative, reality. According to a third view, advanced by Robb, Capek and Stein, what is present at a given spacetime point is, strictly speaking, constituted by that point alone. I argue here against the first of these views that the four-dimensional universe cannot be said to exist now, already, or indeed at any time at all; so that talk of its existence or reality as if that precludes the existence or reality of the present is a non sequitur. The second view assumes that in relativistic physics time lapse is measured by the time co-ordinate function; against this I maintain that it is in fact measured by the proper time, as I argue by reference to the Twin Paradox. The third view, although formally correct, is tarnished by its unrealistic assumption of point-events. This makes it susceptible to paradox, and also sets it at variance with our normal intuitions of the present. I argue that a defensible concept of the present is nonetheless obtainable when account is taken of the non-instantaneity of events, including that of conscious awareness, as that region of spacetime comprised between the forward lightcone of the beginning of a small interval of proper time t and the backward lightcone of the end of that interval. This gives a serviceable notion of what is present to a given event of short duration, as well as saving our intuition of the “reality” or robustness of present events. (shrink)

This article draws on Elias’s observations on the origins of political economy and sociology as well as his theory of involvement and detachment to supplement standard accounts of the history of sociology. It shows how, in the 1840s, sociology bifurcated into two tracks. Track I was the highly ‘involved’ partisan track associated with Marx and Engels and track II was the relatively ‘detached’, non-partisan track pursued by Saint-Simon, Comte, Lorenz von Stein and others. These two tracks continue to shape (...) contemporary sociology as basic orientations. The polarization of class conflict predicted in Marx’s theory is contrasted with the class interdependence model in Lorenz von Stein, in particular. Elias’s work is understood as a synthesis of later developments in track II in which he strongly reaffirmed the historical separation of sociology from philosophy. Elias’s work is presented as a central theory of society and as a promising alternative to the prevailing practice of theoretical eclecticism in sociology. (shrink)

Philosophers debate the death of philosophy as much as they debate the death of God. Kant claimed responsibility for both philosophy's beginning and end, while Heidegger argued it concluded with Nietzsche. In the twentieth century, figures as diverse as John Austin and Richard Rorty have proclaimed philosophy's end, with some even calling for the advent of "postphilosophy." In an effort to make sense of these conflicting positions—which often say as much about the philosopher as his subject—Isabelle Thomas-Fogiel undertakes the (...) first systematic treatment of "the end of philosophy," while also recasting the history of western thought itself. Thomas-Fogiel begins with postphilosophical claims such as scientism, which she reveals to be self-refuting, for they subsume philosophy into the branches of the natural sciences. She discovers similar issues in Rorty's skepticism and strands of continental thought. Revisiting the work of late-nineteenth and early-twentieth-century philosophers, when the split between analytical and continental philosophy began, Thomas-Fogiel finds both traditions followed the same path—the road of reference—which ultimately led to self-contradiction. This phenomenon, whether valorized or condemned, has been understood as the death of philosophy. Tracing this pattern from Quine to Rorty, from Heidegger to Levinas and Habermas, Thomas-Fogiel reveals the self-contradiction at the core of their claims while also carving an alternative path through self-reference. My heart was removed and replaced on May 17, 2006. No melodrama is intended here, just an unadorned factual statement. Transplants are transformative. In my case, that transformation led to bioethics.

The Internet presents opportunities for corporations to efficiently build their brands online and to enhance their global reach. But there are threats as well as opportunities, since anti-branding and free-riding activities are easier in cyberspace. One such threat is theunauthorized incorporation of a trademark into a domain name. This can lead to trademark dilution and cause consumer confusion. But some users claim a right to use these trademarks for the purpose of parody or criticism. Underlying these trademark conflicts is the (...) familiar tension between property rights and free speech rights. While some trademark scholars are reluctant to consider a trademark as property, we find strong support for the property paradigm in Hegel’s philosophy. Assuming that a trademark is an earned property right, we propose that a trademark owner should be allowed to control the permutations of its trademark incorporated into domain names unless a reasonable person would not confuse that domain name with the company’s mark. But we also conclude that there must be latitude to employ a domain name for negative editorial comment, so long as the source and purpose of that domain name is plainly apparent. (shrink)

Stimulated by these three brilliant target essays this commentary raises a few questions about the universality of the “emotions,” the cultural psychology of “natural kinds,” and the analytic deconstruction of the idea of an emotion.

For many adolescent Kenyan males genital reshaping is a self-defining experience of enormous positive significance. The same can be said for many Kenyan females. These adolescents, male and female, do not think their bodies have been “mutilated.” Quite the contrary, by their lights the surgical procedure removes a defect of nature and is the means by which a desired state of physical integrity and social maturity is achieved. By their lights the procedure gets rid of unseemly fleshy encumbrances and protrusions (...) and helps them erase unwanted physical traces of childhood bisexuality, thereby making their genitals look smooth and clean and more gender appropriate. Imitation is said to be the sincerest form of flattery. Socially, the proposition may well be true. But in the world of ideas it is false: to the extent that two incompatible traditions use the same words or symbols to articulate different visions of legal or social organization, imitation begets confusion, not enlightenment. The effects of that confusion, moreover, are not confined to the world of ideas, but spill over into the world of politics and public affairs. Words are more (...) than tools of description: they work also as tools of persuasion and transformation. Let a term have a favorable connotation in one context, and its imitative use can mislead people into thinking that a major departure from established practice is merely the extension or updating of an old principle to deal with new circumstances. The RIAA v. Verizon case offers an opportunity to analyze the scope of an Internet service provider’s responsibility to help deter copyright infringement. In this case, the RIAA served Verizon with a subpoena requesting the identity of two users who were making available copyrighted recordings for downloading on peer‐to‐peer networks. The main axis of discussion is whether or not Verizon has a moral obligation to reveal the names of these individuals. Should Verizon cooperate with the RIAA or should it seek (...) to shield the identity of these users in order to protect their anonymity and privacy? A secondary theme concerns Verizon’s prospective responsibility to curtail infringement. We will argue that Verizon and other ISPs have a limited obligation to assist copyright holders by disclosing the identity of infringers, but we contend that any prospective responsibility is constrained by law and technological capability. The founder of American pragmatism, C.S. Peirce, lived as an eccentric, but thought as a dedicated communitarian. In Reading Peirce Reading, Richard Smyth demonstrates that Peirce's early essays presuppose a very distinctive perspective on the history of philosophy. One important mark of a major philosopher, Smyth argues, is that the philosopher causes us to read the history of thought in new ways. Smyth shows not only that Peirce passes that test, but that Peirce's philosophical practice actually did conform to (...) his communal ideal for inquiry. Ame Naess, John Rodman, George Sessions, and others, designated herein as ecosophers, propose an egalitarian anti-anthropocentric biocentrism as a basis for a new environmental ethic. I outline their “hands-off-nature” position and show it to be based on setting man apart. The ecosophic position is thus neither egalitarian nor fully biocentric. A fully egalitarian biocentric ethic would place no more restrictions on the behavior of human beings than on the behavior of any other animals. Uncontrolled human behavior might lead to the (...) destruction ofthe environment and thus to the extinction of human beings. I thus conclude that human interest in survival is the best ground on which to argue for an ecological balance which is good both for human beings and for the whole biological community. (shrink)

In the aftermath of the events of September 11, 2001, Stanley Katz (who now chairs the editorial board of this journal) invited the intellectual community to reflect on its own history of involvement in public affairs and to make good on its mistakes. This essay examines a single case of intellectuals involving themselves in public affairs and some of the difficulties in saying and evaluating exactly what happened. Critical attention is given to Anthropological Intelligence, a book by David Price published (...) in 2008, which concerns the involvement of anthropologists in wartime activities during World War II and argues that even that “just war” left an indelible stain on the moral fabric of the discipline.
