This review examines Burke's phenomenological analysis of normative femininity, examining how femininity is implicated in both historical and present racial violence. It lauds Burke's analysis of the temporality of gendered experience—in the Beauvoirean tradition of feminist phenomenology—but it criticizes Burke for coming up short in the critical aspect of their project. It closes with some methodological reflections about doing effect critical phenomenology.

Gender, race, and sexuality are not just identities; they are also systems of social organization – i.e., systems of privilege and oppression. This article addresses two main ways privilege and oppression (e.g., racism, misogyny, heteronormativity) are relevant topics in and for philosophical aesthetics: (i) the role of the aesthetic in privilege and oppression, and (ii) the role of philosophical aesthetics, as a discipline and a body of texts, in constructing and naturalizing relations of privilege and oppression (i.e., white heteropatriarchy). (...) The first part addresses how systems of privilege and oppression use the aesthetic. I will discuss various ways race, gender, and sexuality, as both embodied identities and broader social institutions, work with and through “the aesthetic”. The second part addresses racism and (hetero) sexism in the discipline of aesthetics. Both in its history and its present practice aesthetics’apparent neutrality on questions of privilege and oppression is actually evidence of its investment in systems of privilege and oppression. Contrapower sexual harassment occurs when the target of harassment possesses greater formal organizational power than the perpetrator. Traditional conceptualizations of power underlying sexual harassment have either focused on location within organizational hierarchies or sociocultural status differences between men and women. We suggest the utility of simultaneously considering the influence of gender, race, and class on power dynamics at organizational, sociocultural, and interpersonal or individual levels. Using qualitative data obtained from 8 focus groups, 20 interviews, and 1 in-depth case study, we (...) examine how gender, race, and class influence varied sources of power available to perpetrators and targets in workplace contrapower situations. Race, Class, Gender, and Sexuality: The Big Questions is a welcome addition to the crop of anthologies on “contemporary issues.” In the past, the tag “contemporary issues” meant abortion, pornography, euthanasia, affirmative action, and the other usual suspects. Anthology after anthology dealt with these same life-and-death issues, often reproducing the same articles. But that has changed in the last couple of years as interest in topics such as sexuality, gender, race, nationalism, and multiculturalism has reanimated the field.

Being the victim of a microaggression, that is, a relatively minor act of hostility that targets someone's (marginalized) social identity, can be distressing, but so can merely being in doubt over whether one has been the victim of such aggression. To address this last problem, Regina Rini has proposed a novel understanding of microaggressions that is meant to eliminate such doubts. On her “Ambiguous Experience Account,” whenever members of marginalized groups believe they might have been subjected to a microaggression, a (...) microaggression will have been committed even if the would‐be perpetrator was not motivated by prejudiced aggression. This article challenges this account on grounds of being incompatible with people's lived experiences, including those of the would‐be victims, and argues that we should instead accept the conventional account on which microaggressive acts must be consciously or unconsciously motivated by prejudiced aggression. At the same time, it shows that those falsely suspected of having committed microaggressions will still merit blame sometimes for having failed to signal that their behavior was respectful of others, which lessens the concerns that Rini's conceptual engineering seeks to address. I conclude by drawing out some implications for the debate on microaggressions and attributional ambiguity. (shrink)

Proactive policing strategies produce a range of harms to African Americans in poor urban communities. We know little, however, about how aggressive policing is experienced across gender by adolescents in these neighborhoods. The authors argue that important insights can be gained by examining the perspectives of African American youths and draw from in-depth interviews with youths in St. Louis, Missouri, to investigate how gender shapes interactions with the police. The comparative analysis reveals important gendered facets of African American adolescents' experiences (...) with and expectations of law enforcement. Young men described being treated routinely as suspects regardless of their involvement in delinquency and also reported police violence. Young women typically described being stopped for curfew violations but also expressed concerns about police sexual misconduct. This study highlights the differential harms of urban policing for African American young women and men and highlights the need for systematic attention to the intersections of race and gender in research on criminal justice practices. ABSTRACT It used to be said that shame culture waned in early modernity, but there is a growing body of historiography on the vital role that recognition and the opinion of others continued to play. Honour mattered; for some it was the mark and the maker of your true self. While philosophers like Hobbes, Locke, Mandeville, Hume, Smith, and Rousseau disagreed in their evaluations of the phenomenon, they were united in thinking that the great engine of recognition whirred like furious (...) clockwork through human society. When one listens to voices from the margins of power, however, to formerly enslaved black women and men, and white women, one hears a different story – that the machine is broken. I argue that, albeit from incomparable positions, they articulate a theory of misrecognition in the face of systematic power. Sensitive to the entanglements of epistemology and naturalised inequality, they offer a politics of vision that deconstructs the punitive lenses of gender and race which render people invisible and misunderstood, and in so doing they try to write themselves into view. They offer an account of the mysterious intractability of hegemonic ways of seeing that poses a challenge to both the putatively laissez-faire economy of recognition of their enlightened contemporaries, and to the emancipatory teleology of modern recognition theorists. Abstract:This article unveils the gendered, racialized, and silent sexual dimensions at play in the criminalization of Milagro Sala, the charismatic and controversial female indigenous leader of the Organización Barrial Tupac Amaru in Argentina. It argues this organization was able to contest narrow definitions of women's welfare used in local state bureaucracies in terms of certain redistribution and recognition, while fostering complex and controversial state-movement relations in terms of transparency and accountability. In important ways, Tupac Amaru politicized the “undeserving poor.” Women (...) who did not conform to the moral prescriptions that patrol the conduct of poor women were the backbone and the leadership of the organization. Drawing on interviews, fieldwork materials, and documents gathered between 2009 and 2017, this paper shows that the main problems created by the criminalization of the organization were not only the arbitrary detention of Sala. Equally significant, the criminalization also brought about sudden negative changes in poor women and LGBT popular sectors' living conditions, employment opportunities, and access to health care, alongside the overall erosion of minimal gains in social and economic rights. It ultimately undermined the legitimacy of rights-based demands of popular and indigenous sectors in a multi-ethnic society. (shrink)

The relation between gender and aesthetics is central to any formulation of feminist aesthetics, and yet the meanings of these terms are continually contested and revised. Both gender and aesthetics carry diverse, interdisciplinary significations, which are shaped by complex histories of disagreements. When the term “aesthetic” was first introduced in the eighteenth century by the German philosopher Alexander Baumgarten, it did not refer to artistic production but rather to the mode of knowledge gained through the senses. Aesthetics today can have (...) at least three different meanings: (1) a general theory of artistic practices; (2) a theory of reception, focused upon how we appreciate or judge natural beauty and artworks; and (3) a theory of sensibility shaping our experience, practice, and knowledge. In this last sense aesthetics does not have to refer to art at all, but is rather concerned with the role of different senses, such as touch, sight, taste, smell, or with different affects: pleasure, pain, or disgust (Korsmeyer 2012). One could make an argument that the affective turn in feminist and queer theory today is also implicitly informed by this third historical meaning of aesthetics, even if theorists themselves do not engage aesthetics directly (Ahmed 2004; Berlant 2011). Gender is also a contested category in feminist philosophy and theory (Chanter 2007); in general it refers to social and political determinations and regulations of biological sex and sexual practices, but there is no consensus on the relationship of gender to power, the body, sexuality, or sensibility. Following feminist theories of intersectionality, introduced by black feminists (Crenshaw 1991), I assume in this chapter that the category of gender is relational, political, and historical; that is, that its significance and its relation to embodiment are shaped by desire and power relations, which also determine the meaning of class, race, labor, environment, and other political phenomena. Discrimination in the postmodern society can have many different causes and can affect people of different racial, ethnic, national or social backgrounds, such as communities of Asian or African descent, Roma people, indigenous peoples, Aboriginal people and people of different castes. Discrimination can also refer to people of different cultural, linguistic or religious backgrounds, people with disabilities or the elderly. Moreover, people can be discriminated because of their sexual orientation or preferences. Gender-based discrimination is also common, despite progress in many (...) countries. Women are also particularly prone to violent and abusive practices, and therefore often suffer from a double discrimination, both because of their race or origin and because of their gender, which is why feminist literature in recent years points to new acts or forms of discrimination against women. A major problem in the postmodern world is the discrimination that many people are subjected to, especially women and children, because they live in extreme poverty. These circumstances may force them to migrate and further contribute to a conceptual or social contamination, that may aggravate discriminatory tendencies in the societies where they migrate. The article aims to theoretically analyse the degree of functionality that the principle of non-discrimination based on gender, race, religion and sexual orientation has in the contemporary, postmodern, individualistic society. But the very strength and frequency of her abjurations of the title of philosopher is a sign that, like Freud, Beauvoir (who wrote several straightforwardly philosophical essays, including the monograph-length Ethics of Ambiguity and Pyrrhus et Cınéas) was motivated not so much by modesty or self-abnegation but by a desire to distance herself from what counted, at least in the middle of this century, as philosophy.For most of the past 50 years, English-speaking readers of Beauvoir have simply accepted her portrayal of her relationship to philosophy. On the ordinary view, The Second Sex, while an important historical touchstone for “feminist theory” is not, or not quite, a philosophical piece of writing, and those of her publications that merit that title are mere apologetics for Sartrean existentialism. But in the years since Beauvoir’s death in 1986 allowed for the release of her voluminous and revealing letters to Sartre, more and more feminist philosophers have been taking a second look at The Second Sex and Beauvoir’s other essays and fiction as they try to engage productively both with non-academic feminist work and with the philosophical mainstream. As a result, the difficult question of just how to assess Beauvoir’s relationship both to philosophy in general and to Sartre in particular has become pressing and is at the center of the four books under review here.The authors of these books are each committed, in their own sometimes strikingly different ways, to two theses: first, that to understand Beauvoir’s place in the history of philosophy one must study her appropriations of the work of philosophers other than just Sartre and, second, that at the heart of Beauvoir’s enterprise in all of her work is a desire to think about how to create and sustain reciprocity between an existentially committed self and an equally autonomous other.The most historically oriented and, on my view, meticulous exploration of Beauvoir’s relationship to her philosophical influences is Lundgren-Gothlin’s superb Sex and Exıstence, which chronicles Beauvoir’s indebtedness to and interest in, especially, Hegel and Marx. Lundgren-Gothlin, a philosophically trained Swedish intellectual historian, shows decisively that one cannot make philosophical sense of The Second Sex as long as one reduces its philosophical dimension to boilerplate Sartreanism. Indeed, given Sartre’s antipathy toward Marx and his ambivalence about Hegel in Beıng and Nothingness, Lundgren-Gothlin’s work raises serious questions about the extent to which Beauvoir’s considered views in The Second Sex are even compatible with those of the early... The “born this way” narrative remains a popular way to defend nonnormative genders and sexualities in the United States. While feminist and queer theorists have critiqued the narrative's implicit ahistorical and essentialist understanding of sexuality, the narrative's incorporation by the state as a way to regulate gender identity has gone largely underdeveloped. I argue that transgender accounts of this narrative reorient it amid questions of temporality, race, colonialism, and the nation-state, thereby allowing for a critique that does justice to (...) the enmeshment of categories of difference. Michel Foucault’s _History of Sexuality_ has been one of the most influential books of the last two decades. It has had an enormous impact on cultural studies and work across many disciplines on gender, sexuality, and the body. Bringing a new set of questions to this key work, Ann Laura Stoler examines volume one of _History of Sexuality_ in an unexplored light. She asks why there has been such a muted engagement with this work among students of colonialism for (...) whom issues of sexuality and power are so essential. Why is the colonial context absent from Foucault’s history of a European sexual discourse that for him defined the bourgeois self? In _Race and the Education of Desire, _Stoler challenges Foucault’s tunnel vision of the West and his marginalization of empire. She also argues that this first volume of _History of Sexuality_ contains a suggestive if not studied treatment of race. Drawing on Foucault’s little-known 1976 College de France lectures, Stoler addresses his treatment of the relationship between biopower, bourgeois sexuality, and what he identified as “racisms of the state.” In this critical and historically grounded analysis based on cultural theory and her own extensive research in Dutch and French colonial archives, Stoler suggests how Foucault’s insights have in the past constrained—and in the future may help shape—the ways we trace the genealogies of race. _Race and the Education of Desire_ will revise current notions of the connections between European and colonial historiography and between the European bourgeois order and the colonial treatment of sexuality. This paper develops a critique of Foucault's treatment of child sexual abuse in relation to his theory of the relationship between discourse and experience.

This chapter focuses on a critical analysis of particular theoretical frameworks in psychiatry in their interplay with issues of race and gender. Analysis shows that theoretical perspective is one of the most important factors in play in working toward the goal of eliminating racism and sexism from psychiatry. To this end, four types of theoretical frameworks are considered: naturalism, social constructionism, relativism and antirelativism, and phenomenology. Also considered are efforts to show the compatibility of two different frameworks. Each framework is (...) explored and critiqued regarding its potential to expose and correct racist and sexist attitudes that are incorporated into research and treatment in psychiatry. Included are discussions of the relevance of realism and antirealism in evaluating theoretical frameworks, as well as evaluation of theoretical claims regarding the roles of biology, genetics, the medical model, and culture in either sustaining or counteracting racism and sexism in psychiatry, including psychoanalysis. Finally, Husserlian phenomenology is suggested as a philosophical framework for psychiatry that can transcend the limitations of the other frameworks discussed. Phenomenology enables psychiatry, including psychology and psychoanalysis, to constitute itself as a science that transcends both constructionist relativism and naturalistic reductionism. (shrink)

A survey of 525 undergraduates found that 40 percent of the women and 28.7 percent of the men had been sexually harassed by a college professor or instructor. Most incidents were gender harassment. While women reported significantly more gender harassment than did men, there were no gender differences in the frequency of unwanted sexual attention or sexual coercion. At least one incident of sexual harassment by a professor was experienced by 30 percent of the Blacks, 30 percent of the Hispanics, (...) 33 percent of the Asians, 30 percent of the students of other minority groups, and 39 percent of the whites. Again, most of the experiences were gender harassment. Among those respondents who had experienced at least one incident of sexual harassment, almost all answered “never” to the question “Have you ever been sexually harassed by a college professor or instructor?” We conclude with some suggestions, particularly the need to improve measurement of the harassment experiences of men and of nonwhite women. This book investigates the Ancient Stoic thinkers’ views on gender and sexuality. A detailed scrutiny of metaphysics, ethics and political philosophy reveals that the Stoic philosophers held an exceptionally equal view of men and women’s rational capacities. In its own time, Stoicism was frequently called ‘ the manly school’ of philosophy, but this volume shows that the Stoics would have also transformed many traditional notions of masculinity. Malin Grahn-Wilder compares the earlier philosophies of Plato and Aristotle to (...) show that the Stoic position often stands out within Ancient philosophy as an exceptionally bold defense of women’s possibilities to achieve the highest form of wisdom and happiness. The study of gender and ethnicity (or, equally, sexuality and race) is complicated by the basic ambiguity regarding the meaning and signifying capacity of each of these designations. A phenomenological approach aids in explicating the specific social, cultural and historical terms in which the designations of gender and ethnicity come to have different meanings and signifying capacities. Such an explication reveals variously contested boundaries of knowledge-production, and allows for a return to concrete world where meaning, culture, and history are (...) embodied. The present work examines the study of gender and ethnicity as it has developed in relation to the postmodern and postcolonial challenges leveled against social science, and argues for an interdisciplinary and decolonial phenomenology that neither ignores the existential and embodied reality as experienced by those who are designated objects of scientific study, nor valorizes the experience of social objectification or dehumanization. The present work argues that an interdisciplinary and decolonial phenomenology, provides the basis for a full recognition of the intersubjective conditions in which human recognition (and non-recognition) are possible, as well as a critical approach in assessing how the relationship between experience and perspective leads to the truly insightful understanding emerging in this particular time and this particular place. While Michel Foucault’s writings have been taken up extensively to explore gender and sexuality, until recently there was little work drawing on Foucault’s writings to discuss race. In part, this was because Foucault seemed to have said almost nothing about race, aside from some comments on Nazism and eugenics in the final pages of Part V of The History of Sexuality, volume 1. With the 1997 and 1999 publication of two series of lectures that Foucault delivered at the (...) Collège de France between 1974 and 1976, Abnormal and “Society Must Be Defended” (both appearing in English translation in 2003), Foucault scholars have, however, become aware that he made more extensive and provocative observations about race than had previously been believed. Both of these lecture series gives a genealogical account of the ways in which modern, biological forms of racism emerged at a certain point in history, stressing the contingency of this emergence and its enmeshment in power struggles and modern forms of power. This paper provides an account of what Foucault argues about race and racism in the Collège de France lectures, and, more briefly, presents two of the most extended treatments of race coming from Foucauldian perspectives that have appeared in the wake of these texts. Nietzsche’s Revolution argues that Nietzsche is a revolutionary who aims to liberate modernity by overthrowing Christianity. Although Nietzsche’s terrified inability to follow through on this revolutionary project causes him to retreat into a retrograde essentialism of race and gender that betrays his own revolutionary promise, Nietzsche’s complicity in this failure bequeaths this revolution to us, his future readers, who can take it up in the form of poststructuralist queer theory and politics. Jurisprudence is the prudence of jus, law's consciousness and conscience. Throughout history, when thinkers wanted to contemplate the organisation of society or the relationship between authority and the subject, they turned to law. All great philosophers, from Plato to Hobbes, Kant, Hegel, Marx and Weber had either studied the law or had a deep understanding of legal operations. But jurisprudence is also the conscience of law, the exploration of law's justice and of an ideal law or equity at the bar (...) of which state law is always judged. Jurisprudence brings together 'is' and 'ought', the positive and the normative, law and justice. But after a long process of decay, legal theory is today characterised by cognitive and moral poverty. Jurisprudence has become restricted and academically peripheral, a guidebook to technocratic legalism and a legitimation of the existent. Critical jurisprudence returns to the classical tradition of a general philosophy of law and adopts a much wider concept of legality. It is concerned both with posited law and with the law of the law. All legal aspects of the economic, political, emotional and physical modes of production and reproduction of society are part of critical jurisprudence. This widening of scope allows a radical rethinking of the nature of rights, justice, sovereignty and judgement. A political philosophy of justice today must examine the political economy of law; transitions from Empire to nation; ideological and imaginary constructions through which we understand ourselves and relate to others; ways in which gender, race or sexuality create forms of identity that both discipline bodies and offer sites of resistance. Law's complicity with political oppression, violence and racism has to be faced before it is possible to speak of a new beginning for legal thought, which in turn is the necessary precondition for a theory of justice. Critical Jurisprudence offers an ethics of law against the nihilism of power and an aesthetics of existence for the melancholic lawyer. (shrink)

Media reflect and affect social understandings, beliefs, and values on many topics, including the lives of autistic and disabled people. Media analysis has garnered attention in the field of disability studies, which some scholars and activists consider a promising approach to discussing the experiences of – and for promoting social justice for – autistic people, who remain underrepresented on scripted television. Additionally, existing portrayals often rely on stereotyped representations of disabled individuals as objects of pity, objects of inspiration, or villains. (...) Television may also serve as a primary source of public knowledge about disabled people and the concept of disability. It is therefore essential that such portrayals avoid stigma and stereotyping. We take a disability studies lens to critically analyze and compare representations of diverse people, who may sometimes be conflated in the popular imaginary, across television series about autistic characters, those with cerebral palsy, and a character with fetal alcohol spectrum disorder. We employ an intersectional analytic framework to problematize representations of autistic and disabled people, using television, feminist, and critical disability studies literatures. We analyze how the formal structure of television storytelling can either enable or disable its characters, as well as how portrayals of disability that display a sensitivity to concerns raised by critical disability discourse do not necessarily display the same sensitivity when they intersect with marginalized experiences of gender, sexuality, race, and class. This paper concerns a project to right a wrong, an epistemic as well as social wrong. The wrong? Science was to serve all humankind; that is what Francis Bacon and the other founders of modern science had promised and what a long line of their successors had signed on to. But by the twentieth century it had become clear that this science was regularly serving some of humankind far more than others and was even, quite frequently, actually harming those others (...) rather than helping them. The problem lay with the knowledge that science offered about those others: the damaging ‘information’ that was really ignorance in disguise. But the problem also lay with the systematic ignorance science allowed, even encouraged, about those others: the helpful, uplifting knowledge about them that the science could have offered but did not. And the project to right the wrong? A transformation of the science-provided pattern of knowledge and ignorance engineered to achieve a more egalitarian result (what I call an epistemological-agnotological reengineering project). Of course, there are many groups of others relevant here. I will focus my attention in the present paper on only two of them: women, and men of colour (especially Black men).. (shrink)

This ambitious philosophical anthology combines analyses and surveys of contemporary theorising on social identity.

One of the most pertinent sites of investigation in Fanon studies is the question of how Fanon theorizes the imbrication of gender with that of race and colonialism. For many, his silence or disavowals, whether explicit or implicit, allow an uncritical masculinism to slip into his theories of subjectivity, subjugation, and revolution. This article contributes to these discussions by arguing that for Fanon, gender and race are colonial technologies rather than natural sites of experience. Bringing together Fanon's recently translated clinical (...) writings and his political essay on the revolutionary roles of Algerian women in the war against French colonization, it is possible to see how Fanon theorizes the French imposition of gender norms as attempts to engineer the social reproduction of a marginalized and racialized population. In short, gender is an implicitly racialized technology in French colonial society whose aim is the naturalization of political and sexual arrangements of power that justify the continuation of French occupation. Fanon works to demystify gender and race as technologies so that the colonized may seize them in the interest of their own liberatory invention. (shrink)
