Discrimination in the postmodern society can have many different causes and can affect people of different racial, ethnic, national or social backgrounds, such as communities of Asian or African descent, Roma people, indigenous peoples, Aboriginal people and people of different castes. Discrimination can also refer to people of different cultural, linguistic or religious backgrounds, people with disabilities or the elderly. Moreover, people can be discriminated because of their sexual orientation or preferences. Gender-based discrimination is also common, despite progress in many (...) countries. Women are also particularly prone to violent and abusive practices, and therefore often suffer from a double discrimination, both because of their race or origin and because of their gender, which is why feminist literature in recent years points to new acts or forms of discrimination against women. A major problem in the postmodern world is the discrimination that many people are subjected to, especially women and children, because they live in extreme poverty. These circumstances may force them to migrate and further contribute to a conceptual or social contamination, that may aggravate discriminatory tendencies in the societies where they migrate. The article aims to theoretically analyse the degree of functionality that the principle of non-discrimination based on gender, race, religion and sexual orientation has in the contemporary, postmodern, individualistic society. This article introduces the theological and philosophical thoughts of Lev Karsavin, who was one of the most creative representatives of Russian religious philosophy in the early 20th century. His conception was historically the last amongst the great systems of Russian metaphysics of all-unity. This conception gave an opportunity for developing an understanding of the relations between God and the world, and the act of creation as gift of God.

The relevance of the research reflects the unity of the requirements of the Beijing Philosophical Congress "Learning to be a man" and the anniversary report of the "Rome Club" "Come On! Capitalism, myopia, population and destruction of the planet", which the transformation processes of the socio-sphere are revealed from the standpoint the need for a radical breakdown of the spiritual and moral world of man and his worldview. The foundation of these transformations is the transition in education, as the hippocrine (...) of our knowledge, the source that quenches thirst in them to the "new Enlightenment" as a decisive factor in the learning of a person to be him. This determined the purpose and objectives of the article. The purpose of the article is to substantiate the natural and necessary character of the formation of the "new Enlightenment", to reveal the architectonics of its content. Research objectives : in the context of the goal to uncover the factors that determine the need for a transition in education to the "new Enlightenment", its qualitative difference from the Enlightenment of the 17th-18th centuries; to characterize the new content of "connectedness" in education based on the use of new information technologies; analyze the process of formation of a new spiritual and moral outlook of a specialist on the universal values of humanity; focus the learner’s attention on focusing knowledge of sustainable development as a determining factor of the global problems of mankind through the interrelation of academic disciplines; an important component presents the demand for the formation of a new integral thinking, innovative in its essence and qualitatively different from the analytical one. It is noted that the transition to the path of integral thinking contributes to the connection, coordination and organization into a single whole of the fragments of the object under study. Such thinking is characterized by stability, reliability, variability; it is original in its connections with science and education, and methodological influence on individual and social consciousness. Integral thinking reflects a qualitatively new level of intelligence. Research methods: to achieve the stated goal and constructive solution of the tasks, the article used the method of abduction, analysis and synthesis, historical and logical, synergistic approach. The results of the research: a new paradigm of education is represented – the noospheric-information one corresponding to the factuality of the “new Enlightenment”, as its ability to reproduce itself on a changing scale. The change in the scale of the socio-sphere is due to its globalization processes. The content of the “new Enlightenment” is explicated as a qualitatively new level of formation of students' sustainable knowledge based on the integral innovative type of thinking based on the information resources of society, the use of modern educational technologies, as well as on the values of society, as the quintessence of its wisdom and public intelligence. Conclusions. Thus, the formation of a "new Enlightenment" is natural and necessary. This follows from the requirements of the “learn to be human” program, as well as from the development of an internally ordered education process. “New Enlightenment” also has an attribute of uniqueness, since it does not have anything to compare with, identify; it is an objective, essential, unique phenomenon; it is single, relative, determined by the previous development of education. It is based on the processes of intellectualization, innovation, informational content, humanism and is capable of solving constructively the tasks facing society. (shrink)

A structure (M, $ ,...) is called quasi-o-minimal if in any structure elementarily equivalent to it the definable subsets are exactly the Boolean combinations of 0-definable subsets and intervals. We give a series of natural examples of quasi-o-minimal structures which are not o-minimal; one of them is the ordered group of integers. We develop a technique to investigate quasi-o-minimality and use it to study quasi-o-minimal ordered groups (possibly with extra structure). Main results: any quasi-o-minimal ordered group is abelian; any quasi-o-minimal (...) ordered ring is a real closed field, or has zero multiplication; every quasi-o-minimal divisible ordered group is o-minimal; every quasi-o-minimal archimedian densely ordered group is divisible. We show that a counterpart of quasi-o-minimality in stability theory is the notion of theory of U-rank 1. (shrink)

Statistical physics cannot explain why a thermodynamic arrow of time exists, unless one postulates very special and unnatural initial conditions. Yet, we argue that statistical physics can explain why the thermodynamic arrow of time is universal, i.e., why the arrow points in the same direction everywhere. Namely, if two subsystems have opposite arrow-directions at a particular time, the interaction between them makes the configuration statistically unstable and causes a decay towards a system with a universal direction of the arrow of (...) time. We present general qualitative arguments for that claim and support them by a detailed analysis of a toy model based on the baker’s map. (shrink)

This article addresses the famous 1910 debate between Vladimir F. Ern and Semyon L. Frank centered around the problem of identifying the distinguishing features of Russian philosophy. The debate was a continuation of Ern’s debates with Russian philosophers associated with the international journal Logos (Sergei I. Hessen, Fyodor A. Stepun, Boris V. Yakovenko, and others). The author shows that Ern’s understanding of an original Russian philosophy is organically related to his overall philosophical doctrine. As for Frank, his views during the (...) 1910s on the distinguishing features of Russian philosophy were different in nature. It is worth noting that in the 1920s articles written during his émigré period, Frank’s views on the distinguishing features of Russian philosophy undergo a decisive change. Frank’s new ideas about Russian philosophy turn out to be extremely close to those of his late opponent, both on the whole and in the details. At the same time, Frank’s overall philosophical views do not undergo as dramatic a change and develop in a fully evolutionary mode. The author attempts to identify the reason for these changes. We propose that a top priority of the cerebral cortex must be the discovery and explicit representation of the environmental variables that contribute as major factors to environmental regularities. Any neural representation in which such variables are represented only implicitly (thus requiring extra computing to use them) will make the regularities more complex and therefore more difficult, if not impossible, to learn. The task of discovering such important environmental variables is not an easy one, since their existence is only indirectly (...) suggested by the sensory input patterns the cortex receives – these variables are “hidden.” We present a candidate computational strategy for (1) discovering regularity-simplifying environmental variables, (2) learning the regularities, and (3) using regularities in perceptual and decision-making tasks. The SINBAD computational model discovers useful environmental variables through a search for different, but nevertheless highly correlated functions of any kind over non-overlapping subsets of the known variables, this being indicative of some important environmental variable that is responsible for the correlation. We suggest that such a search is performed in the neocortex by the dendritic trees of individual pyramidal cells. According to the SINBAD model, the basic function of each pyramidal cell is (1) to discover and represent one of the regularity-simplifying environmental variables, and (2) to learn to infer the state of its variable from the states of other variables, represented by other pyramidal cells. A network of such cells – each cell just attending to representation of its variable – can function as a sophisticated and useful inferential model of the outside world. (shrink)

Отже, пов’язана з процесами глобалізації перебудова міжнародних відносин, вихід на світову арену недержавних учасників міжнародних стосунків ставлять перед дипломатією завдання її активного залучення в процес створення нового світового порядку. Водночас силові розв’язання міжнародних проблем виявляються все більш недієвими та небезпечними. A relation on a linearly ordered structure is called semi-bounded if it is definable in an expansion of the structure by bounded relations. We study ultimate behavior of semi-bounded relations in an ordered module M over an ordered commutative ring R such that M/rM is finite for all nonzero r $\epsilon$ R. We consider M as a structure in the language of ordered R-modules augmented by relation symbols for the submodules rM, and prove several quantifier elimination results for semi-bounded relations (...) and functions in M. We show that these quantifier elimination results essentially characterize the ordered modules M with finite indices of the submodules rM. It is proven that (1) any semi-bounded k-ary relation on M is equal, outside a finite union of k-strips, to a k-ary relation quantifier-free definable in M, (2) any semibounded function from $M^{k}$ to M is equal, outside a finite union of k-strips, to a piecewise linear function, and (3) any semi-bounded in M endomorphism of the additive group of M is of the form x $\mapsto \sigmax$ , for some $\mapsto \sigma$ from the field of fractions of R. In many films, story is presented in an order different from chronological. Deviations from the chronological order in a narrative are called anachronies. Narratological theory and the evidence from psychological experiments indicate that anachronies allow stories to be more interesting, as the non-chronological order evokes curiosity in viewers. In this paper we investigate the historical dynamics in the use of anachronies in film. Particularly, we follow the cultural attraction theory that suggests that, given certain conditions, cultural evolution should conform to (...) our cognitive preferences. We study this on a corpus of 80 most popular mystery films released in 1970–2009. We observe that anachronies have become used more frequently, and in a greater proportion of films. We also find that films that made substantial use of anachronies, on average, distributed the anachronies evenly along film length, while the films that made little use of anachronies placed them near the beginning and end. We argue that this can reflect a functional difference between these two types of using anachronies. The paper adds further support to the argument that popular culture may be influenced to a significant degree by our cognitive biases. (shrink)

The first article of the cycle “The role of skeptical evidence in the First and Second ‘Meditations’” compares the Cartesian and Sextus Empiricus’ concepts of doubt in, respectively, “Metaphysical meditations” and “Outlines of Pyrrhonism”. The article starts with the current state of the problem “Descartes and skepticism” and admits the existence of consensus about Cartesian perception of skeptical tradition: Cartesius (1) was influenced by all skeptical movements, known in his time, and (2) created a generalized notion that contains elements of (...) both Academic and Pyrrhonian origin. This consensus is the source of many contemporary studies on how different skeptical doctrines influenced certain parts of Cartesian philosophy. This article attempts to analyze possible Descartes’ use of Sextus Empiricus’ notion of phenomenon. Sextus clearly states in “Outlines of Pyrrhonism” that one cannot doubt phenomenon as something perceived directly. The article proves that (a) Sextus’ thesis about the “sensory” nature of phenomenon is metaphorical, so far as it includes (without distinction) both sensuality and the experience of thinking; (b) the phenomenon is realized through a wide range of passive states of mind that all have irresistible force of influence; (c) the impact of phenomena is always mediated by our self, because all skeptical phrases are strictly correlated with the first person singular. Some researchers distinguish Sextus’ isostenia, as one of such insurmountable states, from Cartesian doubt at the First Meditation, which is allegedly based on a purely volitional decision. The article proved that this argument is artificial, since Descartes’ volitional decision is caused by initial inability to take the dubious as if it were certain. Thus, Cartesian approach can be considered a specific kind of isostenia. Such parallelism is a reason to assume a key role of Sextus’ understanding of insurmountable power of phenomena in Cartesian anti-sceptical argumentation. The Crimea Conference is by all means an extremely complex historical event. Any attempt to estimate its role and significance without analyzing its ethical components would unavoidably result in unduly simplifying the historical reality of the time, as well as in forming erroneous assumptions that would necessarily be used in the analysis of the causes of Cold War. A thorough examination will show that as far as the ‘ethical’ issues are concerned, there are significant developments with regard to general methodology, (...) as well as its application to the sources. Generations of historians who have addressed the issue of Yalta Conference, although they have not been able to form a scientific, distinct ‘ethical’ tradition so far, have developed all the necessary prerequisites for its establishment. This is evident in the possibility of segmenting the issue in two parts on the one hand, and on the other in the availability of sufficient sources, structured databases, and selected outstanding works. Still, there are no studies about the Yalta Conference so far that address exclusively ethical issues concerning ‘good’ and ‘evil,’ ‘morality,’ ‘duty,’ and ‘honor.’ Although historiographical approaches are to a large extent dependent upon ethical viewpoints, in the case of Yalta agreements so far there have been no techniques available, so as to connect historical accounts with ideology, and historical facts with their philosophical background. In a sense, the situation is quite the same as it is with the study of prehistory: although there is an abundance of data and facts that can be primarily processed, there are no methodological guidelines, nor any devices to classify and explain them. This is also typical for any question raised about the ethics of the Yalta agreements in February 1945. (shrink)

The relevance of the problem under study is due to the need to improve the practical skills and competencies of students in the course of training in order to prepare them for competition with other job seekers in employment. In this regard, this article is aimed at identifying the expediency of students’ participation in competitive selections and grants as a factor that creates conditions for effective practice-oriented learning. The leading method for the study of this problem is a pedagogical experiment, (...) which allows us to comprehensively consider the relationship between students’ participation in competitions and their further self-realization and development as young professionals. The article presents the results of monitoring the behavior of students who received an offer to participate in the university-wide competitive selection of student projects, implemented as part of the Program for Supporting Applied Research and Development of Students and Postgraduates of Petrozavodsk State University. The materials of the article can be useful for teaching staff in building a scheme for teaching students and services involved in the recruitment of personnel for large and medium-sized companies that require young professionals to have practical work skills, teamwork skills and creativity. This article serves as an introduction to central ideas and thoughts formulated by Valery Podoroga. The author undertakes a task of interpreting “anthropogram,” a key tool and procedure developed in Podoroga’s analytical anthropology. In order to clarify this notion, the article discusses a highly original conception of mimesis, first introduced in Podoroga’s book of the same name, as well as Podoroga’s own method of analysis, based on the experience of Russian literature. Examining the important function that the concept of death (...) has in Podoroga’s systematic, the author points to essential links between the philosopher’s mental strategy and the ideas of Russian formalism and deconstruction. The death becomes directly related to the mimetic capacity and deprived of its negative component. This is one more way to overcome metaphysics: to turn death into an analytical tool, which in the space of literature revives the archaic layer of sensuality, where thought and action come to be indistinguishable, and a sign of their plexus is anthropogram. The research is devoted to the morphology that V.N. Ilyin developed in the work Static and Dynamics of Pure Form and other archival texts. Morphology is central to the philosophy of V.N. Ilyin, but it remains an unexplored subject. The article’s author explores the morphology of the philosopher from a historical and philosophical point of view. In addition to apparent influences (G.W. Leibniz, E. Husserl, N. Lossky), the article’s author revealed the connection of V.N. Ilyin’s ideas with the history of (...) Western European philosophy and his attitude to medieval thinkers. The author considered how V.N. Ilyin understood and assessed his modern philosophy and its results by the middle of the twentieth century. V.N. Ilyin especially paid attention to phenomenology and its connection with morphology, analyzing phenomenology's influence on existential philosophy. In addition to phenomenology, V.N. Ilyin highly appreciated the intuitism of H. Bergson and N. Lossky. The third main philosophical direction in the twentieth century for V.N. Ilyin was religious philosophy (Neo-Thomists and followers of H. Bergson), which aimed at creating axiology, a new system of values. V.N. Ilyin sought to combine various philosophical ideas in the project of morphology based on logic and scientific methodology. He stated the need to reform formal logic and create “metalogic” that would be more consistent with the philosophical tasks of the twentieth century. The morphology of V.N. Ilyin is based on the idea of synthesis and focuses on creating universal science. The comparison of various philosophical ideas of the twentieth century with morphology makes it possible to understand better his philosophical worldview, the course of his reflections, and the meaning of the morphological project. Modern cognitive approach represents the interdisciplinary branch of scientific reflection uniting researchers of knowledge, studying laws of purchase, transformation, representation, storages and reproduction of the information. People react to own experience, instead of "objective" reality. Cognitive map of the world according to which we operate, our feelings, belief and life experience create. We have no direct access to a "objective" reality, therefore our cognitive map is for us this unique "real" reality. Cognitive science widely uses methodology of synergetic approach successfully (...) describing processes of self‐organizing. On the other hand, the synergetic addresses to modelling cognitive systems both the separate individual and collective cognitive processes. Therefore there are bases tospeak about formation cognitive‐synergetic scientific program ‐ the approach which is under construction on principles of modern nonlinear thinking. (shrink)

An inspection into the contemporary theory of knowledge shows that a new methodological stance, that is, the so called evolutionary epistemology or, equivalently, evolutionary theory of knowledge, which is a version of “naturalistic” turn has been established. This stance tends to consider various philosophical problems from concrete scientific positions and by means of scientific knowledge. This interdisciplinary enterprise has determined as its purposes the researches of biological preconditions of human knowledge and the explanation of its features on the basis of (...) the modern synthetic theory of evolution.The paper discusses the ideas of K. Lorenz, G. Vollmer, D.T. Campbell, H.R. Maturana, F.J. Varela. Especially, the paper concerns the thesis that the reality cognizable by man is the reality designed, created during his personally involved communicative activity. In this perspective, the question “What is the object of knowledge?” becomes inappropriate. The reliability of knowledge consists in being able to behave adequately in individual enterprising and in co-operation with other subjects. (shrink)

Recently (2010–2011) new criminal legislation to combat illegal income and corruption was passed and publicly discussed in Lithuania. Within the list of the new legal measures, special attention should be paid to criminalisation of illicit enrichment, establishment of a model of extended property confiscation, reinforcement of responsibility for corruption-related offenses, a provision that not only property but also personal benefits may constitute a bribe. It can be seen from the explanatory letters attached to the draft laws and the political debate (...) that the new regulation is expected to achieve decisive breakthrough in the fight against corruption and illegal income. However, without any doubt as to the necessity to fight against those social evils, the author presents critical evaluation of the reform by applying the test of principles of criminal law, legal language and practical effectiveness. By making critical conclusions that the new criminal legislation deliberately lightens the prosecution’s goal of incrimination and the burden of proof, the author warns about the purposive instrumental nature of the new laws, which are balancing on the threshold of legitimacy. In the article the author reveals crucial shortcomings of the new legislation: in some aspects it lacks legal certainty, in other aspects it ignores the principles of guilt, presumption of innocence and proportionality as well as the conception of criminal law as a last resort (ultima ratio). As a result, the new legal means against illegal income and corruption leave space for applying inadequate repression beyond their intended purpose, in addition, they criminalise human conduct that is insufficiently dangerous and create preconditions for senseless criminal prosecutions and violation of human rights. The modern Lithuanian legal doctrine recognises that criminal liability is a last resort (ultima ratio) protecting the society from various law violations. This idea has got deep roots in criminology and is obviously based on the position of rational approach towards the state criminal policy. However, it is not clear whether it is of obligatory legal status to the legislature and the courts. This article attempts to present the idea of a last resort as a concept based on the constitutional (...) principles of the rule of law, justice, proportionality and rationality in the legislation and case law. The author concludes that the main precursors of the ultima ratio principle are the German legal doctrine of protection of legal goods (Rechtsgüterschutz) and Harm principle respected in the common law tradition, as well as the need for protection of human rights in the democratic world. These concepts raise the duty of the legislator to justify the act of criminalisation by legitimate purpose and to comply with certain constitutional limits of application of criminal law. The idea of criminal liability as a last resort is recognised both in the jurisprudence of the Constitutional Court (obiter dictum) and in the practice of the Supreme Court of Lithuania reasoning particular decisions in criminal cases, especially delimiting criminal and other types of legal liability. The author concludes that the fact of discrepancy of criminal law to ultima ratio test can be one of the arguments in support of its objection to the Constitution and even the European Convention on Human Rights and Fundamental Freedoms. At the same time, the author of the article has found that many norms of the Criminal Code are in conflict with the idea of a last resort. (shrink)

This article focuses on the problem of criminal liability for unlawful engagement in economic activities, analyses the emergence and development of this norm in criminal law and the ways of its optimal explanation. Special attention is paid to the problem of identification of illegality of activities, based on specific tax and economic regulation. The study concludes that criminal liability must be limited to a violation of fundamental requirements for the legality of business, and does not include particular abuses occurring in (...) legal business. The author also deals with the criteria of delimitation of criminal and administrative liability for unlawful engagement in economic activities. Under Article 202(1) of the Criminal Code of the Republic of Lithuania, application of criminal liability is limited by two alternative conditions: either a person illegally undertakes activity in entrepreneurial way or on a large scale. According to the paper, the above-mentioned regulation lacks clarity and leads to the risk of unfounded prosecutions. The author gives practical examples, where on the basis of inexplicable criterion of an entrepreneurial way, criminal charges are filed in respect of petty economic activities. Such practice is incompatible with the purposes and principles of criminal law. The paper proposes to delete the criterion of an entrepreneurial way from the definition, leaving the possibility of criminal liability only in case of large scale illegal economic activity. The article also substantiates the conclusion that prohibited business activities provided for in Article 202(2) of the Criminal Code actually defies logical explanation and should be removed from the regulation. At the end of the article, the author offers a sample of optimal legal wording of unlawful engagement in economic activities in criminal law. (shrink)

Evasion of value added tax (VAT) is a pressing criminal justice problem; however, there still are no theoretical studies on the specific nature of this offense and the basis of its legal evaluation. This article is an attempt to explain the preconditions of the origin of this type of fraud and its connection with the Value Added Tax Law, to formulate the conceptual understanding of the offense, to reveal the important aspects of its legal evaluation and to discuss relevant examples (...) from the case-law. The preconditions of VAT fraud lie in the legal nature of tax administration and the particularity of VAT regulation creating opportunities to abuse the right of deducting the overpayment from the budget or reducing the tax payable. The system of tax crimes stipulated in the Criminal Code is not sufficient to properly assess the impact and danger of VAT fraud. The judicial practice considering VAT deception as property fraud is theoretically justified and welcome. (shrink)

Автор аналізує чинне законодавство України та формулює необхідність його вдосконалення, зауважуючи, що головною запорукою успіху законотворчої діяльності держави в царині розбудови законодавства щодо політичних партій є активна участь громадян у суспільно-політичному житті країни, залучення громадськості до обговорення стану й перспектив розвитку законодавства, принаймні того, що безпосередньо регулює реалізацію громадянських прав і свобод.

Moral absolutes were perceived, by Solov'ëv, in a dual manner: a) from the side of content, of psychology, as when we speak of feelings, emotions, etc.; and b) under a formal aspect, as “ideas,” i.e. logically. Neither of these can be treated without relating to moral absolutes astrue, and without a rationalbelief in their truth, a truth that cannot be logically proved. In my opinion, our time has become keenly aware of the universally human value of Vladimir Solov'ëv's ethics, of (...) its humanist nature, oriented towards the everyday and the ideal tasks of man, and of the concrete direction of his philosophy of “practical idealism”.
