La integración de la tecnología en el ámbito del derecho penal plantea desafíos significativos debido a la falta de regulación de la inteligencia artificial (IA), lo que podría comprometer los derechos fundamentales. Este estudio se centra en abordar estos desafíos y proponer soluciones mediante un análisis exhaustivo de la situación actual y las posibles implicaciones de la IA en el sistema jurídico penal. El objetivo principal de esta investigación es analizar los problemas, desafíos y oportunidades que surgen con la implementación (...) de la inteligencia artificial en el ámbito penal. Se busca identificar la necesidad de una regulación específica para la IA en el derecho penal, con el fin de proteger los derechos fundamentales de las personas y garantizar un sistema jurídico justo y equitativo. Para abordar esta problemática, se adoptó un enfoque metodológico cualitativo. Se llevó a cabo una revisión bibliográfica detallada para examinar los antecedentes, problemas y desafíos asociados con la IA en los sistemas jurídicos, especialmente en el ámbito penal. Además, se realizaron análisis de criterios y opiniones de expertos en derecho para obtener una comprensión más profunda de la situación y las posibles soluciones. Los resultados de este estudio revelan la necesidad urgente de establecer una normativa específica para regular la aplicación de la inteligencia artificial en el ámbito penal. Se destaca que la falta de regulación representa un riesgo significativo para los derechos fundamentales, especialmente en lo que respecta a la configuración de delitos con el apoyo de la IA. Además, se identifican diferentes dimensiones que deben abordarse en la regulación, incluyendo principios y reglas básicas del derecho, supervisión humana de los sistemas de IA y la promoción de la innovación responsable en este campo. Este artículo subraya la importancia de establecer una regulación efectiva para la inteligencia artificial en el ámbito penal. Esta regulación no solo protegerá los derechos fundamentales de las personas, sino que también promoverá un uso responsable y progresivo de la IA como una herramienta valiosa para los profesionales del derecho. Clarice Lispector puts forth nothing less than a complete philosophy of time in her writings, that is, a cohesive philosophical examination of what time is, of its physics and metaphysics, of how humans and animals perceive time, and even an innovative aesthetic theory in which time is the inspiring force giving rise to literary and artistic creation. Her view of time is unique in the Western philosophical canon, offering original solutions to many of time’s classic difficulties. For Lispector, time is (...) pure actuality. Reality is an unwavering present that never stops being, is fully material, and is ceaselessly attentive to itself. The present, matter, and attention form the unquestionable unit of the real and the core of Lispector’s philosophy of time. This article introduces a comprehensive definition of life projects. It begins with a broad conception of a project as a process comprising the formation, enactment, and maintenance of intentional structures and actions. This definition represents the integration of two theoretical traditions that considered a project either as a process prior to action or a set of actions aimed at the same goals. Next, we differentiate life projects from other types of projects. Then based on a broad conceptual framework, we define (...) a life project as an ongoing, evolving process to form, enact, and maintain intentional structures and actions that, altogether, comprise a long-term, meaningful, and prospective narrative capable of guiding decisions and behavior in daily life. This comprehensive definition integrates six different dimensions of life projects reported across 93 journal articles analyzed in a previous scoping review. We end by contrasting our definition to related concepts and discussing practical implications in career counseling. (shrink)

This research aims at a dialogue between Theology and Psychology in order to understand the Catholic faith and their possible mobilization within the psychic processo of assimilation and elaboration of mourning, using the clinical history of two Catholic bereaved patients followed up in psychoterapy in their first years of bereavement as a concrete object of analysis in a longitudinal study. The Project is part of a historical and philosophical literature on death and then supplies from the contribuitions of Jurgen Moltmann (...) in the Theology of Hope, the psychoanalyst John Bowlby’s productions and his sucessor, the psychiatrist Colin Parkes on data about the mourning and recovery. Conclusively, from the analysis of the theological content found, it was established that the fight arouses intense and profound theological transformation process that reached three categories: faith, God and the Communion of Saints,causing changes that potentially infer the recovery conditions of the bereaved, as well as their way of being and living after the loss, pointing to the need for a differentiated listening to the data found on faith, against human care in bereavement. Lament, mourning, and the transmissibility of a tradition in the aftermath of destruction are prominent themes in Jewish thought. The corpus of lament literature, building upon and transforming the biblical Book of Lamentations, provides a unique lens for thinking about the relationships between destruction and renewal, mourning and remembrance, loss and redemption, expression and the inexpressible. This anthology features four texts by Gershom Scholem on lament, translated here for the first time into English. The volume also includes original essays by (...) leading scholars, which interpret Scholem's texts and situate them in relation to other Weimar-era Jewish thinkers, including Walter Benjamin, Franz Rosenzweig, Franz Kafka, and Paul Celan, who drew on the textual traditions of lament to respond to the destruction and upheavals of the early twentieth century. Also included are studies on the textual tradition of lament in Judaism, from biblical, rabbinic, and medieval lamentations to contemporary Yemenite women's laments. This collection, unified by its strong thematic focus on lament, shows the fruitfulness of studying contemporary and modern texts alongside the traditional textual sources that informed them. Este trabajo explora una línea posible del diálogo entre Walter Benjamin y Hannah Arendt mediante la presentación de algunas intermitencias entre dos figuras relevantes de su pensamiento sobre la historia, la figura que Benjamin determina en su abordaje del Angelus Novus pintado por Paul Klee, y la figura de Er en los términos en que Arendt la elabora a partir de una parábola kafkiana. Retomamos ambas figuras con el objetivo de mostrar en ellas el intento filosófico de organizar un pensamiento (...) crítico que resista la esclerosis del concepto moderno y progresivo de historia: en un contexto en que el pasado pareciera diluirse en la impotencia de su presencia y el futuro se presenta como reproducción apocalíptica del desastre, sostenemos que Benjamin y Arendt convocan al Angelus Novus y al Er kafkiano como imágenes capaces de dislocar el anquilosamiento de la crítica y el flujo epistemológico implicado en la crisis moderna de la experiencia. What challenges does the political participation of children pose to the Philosophy of Childhood? What challenges does the Philosophy of Childhood pose to children's political participation? This text is inspired by the idea that “research is not about enumerating situations, but making researchers lose their sleep”. It is divided into two distinct parts. In the first, we introduce the theoretical framework that orients our research group and our work with children in the philosophical research community. We posit a link between (...) listening to children's voices, the conditions of listening, and the location of their political participation in public space. The second part is comprised of a creative illustrated narrative in the form of a dialogue. From the coast of what could be called the territory of political participation, two characters - Sentinel and Walker - discuss the waves of children that crash onto the territory. To what extent does creating space and time for listening to children open polyphonic movements and enable the construction of new forms of polis: poly(s)phonies? In what ways does the Philosophy of Childhood challenge itself in the creation of poly(s)phonies where the participation of children sets the tone? This article develops a conceptual framework of the dynamics of trust between parents and professionals in early childhood education and care. In contemporary Western society, the heightened risk awareness with respect to early childhood has led to an increased focus on the collaboration between home and daycare. Mutual trust is a core aspect of this collaboration, resulting in a trust imperative. Drawing on Knud Eilar Løgstrup, Noomi Matthiesen, Paula Cavada-Hrepich, and Lene Tanggaard argue here that trust is a spontaneous, (...) relational phenomenon rooted in practice and emerging in a normatively structured order. They develop a conceptual framework of trust that has two dimensions: a basic dimension and a competence dimension. The basic dimension is connected to the willingness of the other to do what is good and right according to the normative order, while the competence dimension has to do with the ability to do so. The authors contend that, while trust is a spontaneous and sovereign phenomenon outside of individuals' control, parents and professionals in daycare perform in ways that are recognized as more or less trust-worthy. They also perform in ways that signal they are trust-ful. However, these conscious performances can paradoxically reduce the possibility of spontaneous trust. (shrink)

This paper uses a sample of 1243 international firms for the period 2013–2017 to analyse the effect that a greater presence of women in management teams has on business behaviour in relation to labour and human rights, and the mediating role of improved performance in these rights on corporate transparency. The results show that gender diversity in management teams is positively associated with performance in relation to labour and human rights, and that such a performance acts as a mediating factor (...) by fostering a higher disclosure of information regarding these issues. The findings therefore seem to indicate that the presence of women in management teams acts as a driving force for enhanced social responsibility. (shrink)

A área da educação matemática com sua "tradicional neutralidade" gera ambientes de invisibilidade para as minorias sociais, como é o caso da comunidade LGBTQIAP+. Essa educação matemática heteronormativa oprime as pessoas que não se encaixam no padrão e propaga a discriminação. Para evitar a invisibilidade e opressão em relação a determinados grupos sociais é necessário que se trabalhe essas questões em sala de aula. O movimento da educação matemática crítica e a educação matemática para justiça social rompem com a ideia (...) da neutralidade da matemática e busca trazer ao debate temas sociais importantes, como é o caso da sexualidade e identidade de gênero, e se faz necessário questionar: quais as relações da comunidade LGBTQIAP+ com a educação matemática? Para buscar informações que contribuam com este questionamento é necessário olhar para as produções acadêmicas já existentes, portanto o presente trabalho busca mapear teses e dissertações de programas de pós-graduações no Brasil que abordam a temática da comunidade LGBTQIAP+ e a educação matemática. No que se refere à metodologia, utilizou-se como base o trabalho de Biembengut referente ao mapeamento de produções acadêmicas. Foram identificadas e analisadas 5 produções. Foi possível identificar que essa discussão ainda é muito recente nos âmbitos acadêmicos. Contudo, é de extrema urgência preparar professores para trazer a temática para as aulas de matemática, considerando que trabalhar os saberes matemáticos de modo correlato a questões sociais é relevante no processo de formação dos alunos, tanto em conhecimento matemático quanto como um cidadão ético, respeitoso e educado, bem como auxilia a promover um ambiente de ensino que transcende os padrões e o modo de vida restrito, contribuindo com a transformação social. Resumen: La variación lingüística es un fenómeno presente en casi todos los idiomas. Su interés para los estudios traductológicos es incuestionable. En el presente trabajo pretendemos investigar cómo se resuelven los problemas que plantea la variación lingüística para la traducción literaria chino-español. Con tal objetivo, hemos elegido la obra La casa de té y sus dos versiones de español como corpus de análisis. Partiendo de la hipótesis de que en la traducción de los elementos de la variación lingüística de esta (...) obra se recurre a la estandarización como solución traductora preferente, hemos analizado el corpus para obtener datos tanto cualitativos como cuantitativos. Los resultados nos permiten confirmar la hipótesis general, así como identificar las características específicas y problemas que presenta la traducción de la variación lingüística del chino al español. Abstract: Linguistic variation is a phenomenon present in almost all languages. Its importance for translation studies is unquestionable. In this paper, we intend to investigate how the problems posed by linguistic variation are solved for Chinese-Spanish literary translation. To this end, we have chosen the work Teahouse and its two Spanish versions as the corpus of analysis. Based on the hypothesis that in the translation of the elements of linguistic variation in this work, standardization is used as the preferred translation solution, we analyzed the corpus to obtain both qualitative and quantitative data. The results allow us to confirm the general hypothesis, as well as to identify the specific characteristics and problems presented by the translation of linguistic variation from Chinese into Spanish. In this article, the author describes sweeping changes in the gender system and offers explanations for why change has been uneven. Because the devaluation of activities done by women has changed little, women have had strong incentive to enter male jobs, but men have had little incentive to take on female activities or jobs. The gender egalitarianism that gained traction was the notion that women should have access to upward mobility and to all areas of schooling and jobs. But persistent (...) gender essentialism means that most people follow gender-typical paths except when upward mobility is impossible otherwise. Middle-class women entered managerial and professional jobs more than working-class women integrated blue-collar jobs because the latter were able to move up while choosing a “female” occupation; many mothers of middle-class women were already in the highest-status female occupations. Abstract:This essay excavates the “spherical” and “global” ontological optics that have emerged from Martin Heidegger's thought considered in the context of the whole earth image and global climate change, focusing on the work of Timothy Ingold and Timothy Morton. Probing the boundaries of Morton's perspective in particular, I show how his global vision of Being ultimately reinscribes a fundamentally anthropocentric position in which the human “interior” is privileged and universalized while the inhuman “exterior” is either violently incorporated or altogether rejected. (...) I then propose an alternative vision of Being, one which avows a planetary optics while simultaneously emphasizing the unseen and unknown roiling beyond the boundaries of both spherical and global perspectives. I conclude by suggesting that this alternative vision can begin to be cultivated through attending to the works of Georges Bataille, whom a growing host of contemporary theorists have begun to identify as a resource for an ecological perspective that negotiates both the articulation and the transgression of the ontological and perspectival limits that separate the anthropocentric interior and the inhuman exterior. Bataille's exorbitant vision of Being sublates the dialectic of spherical and global perspectives, joining a consciousness of the limits of earth-bound human seeing-being to the ecstatic experience of a dynamic planet in the midst of an unfathomable cosmos. Higher energy prices and the growing concern about global warming have led to a number of policy goals and targets designed to curb global warming and/or the development of alternative sources of energy. However, the Tinbergen Rule states that for each and every policy target there must be at least one policy tool. If there are fewer tools than targets, then some policy goals will not be achieved. Further complicating the public policy environment are the facts that some policy tools (...) affect more than one target, some tools help achieve more than one target, and others, while meeting one target, make meeting other targets more difficult. Also, some targets are more efficient than others. If policy makers are going to be able to effectively meet their environmental and energy goals, a series of policy tools need to be developed. There is growing evidence to support the claim that we react differently to robots than we do to other objects. In particular, we react differently to robots with which we have some form of social interaction. In this paper I critically assess the claim that, due to our tendency to become emotionally attached to social robots, permitting their harm may be damaging for society and as such we should consider introducing legislation to grant social robots rights and protect them from (...) harm. I conclude that there is little evidence to support this claim and that legislation in this area would restrict progress in areas of social care where social robots are a potentially valuable resource. While Aristotle's account of the happy life continues to receive attention, many of his claims about virtue of character seem so puzzling that modern philosophers have often discarded them, or have reworked them to fit more familiar theories that do not make virtue of character central. In this book, Paula Gottlieb takes a fresh look at Aristotle's claims, particularly the much-maligned doctrine of the mean. Testimony is a source of knowledge. A speaker asserts what a hearer may therefore come to know. Assertion has widely been treated as the exclusive or at least the paradigmatic vehicle for testimony. I argue that we testify not only by asserting something, but also by taking something for granted within some other utterance. In philosophy of language, this is called semantic presupposition. The very reasons leading theorists of testimony have for thinking that assertion can be testimony are equally reasons (...) for thinking semantic presupposition can be testimony. (shrink)

Monotone modal logics have emerged in several application areas such as computer science and social choice theory. Since many of the most studied selfextensional logics have a conjunction, in this paper we study some distributive extensions obtained from a semilattice based deductive system with monotonic modal operators, and we give them neighborhood and algebraic semantics. For each logic defined our main objective is to prove completeness with respect to its characteristic class of monotonic frames.

Stigma taints individuals with a spoiled identity and loss of status or discrimination. This article is the first to examine the stigma attached to abortion and surrogacy and consider how law may stigmatize women for failing to conform to social expectations about maternal roles. Courts should consider evidence of stigma when evaluating laws regulating abortion or surrogacy to determine whether these laws are based on impermissible gender stereotyping.

Forgiveness as a positive response to wrongdoing is a widespread phenomenon that plays a role in the moral lives of most persons. Surprisingly, Kant has very little to say on the matter. Although Kant dedicates considerable space to discussing punishment, wrongdoing and grace, he addresses the issues of human forgiveness directly only in some short passages in the Lectures on Ethics and in one passage of the Metaphysics of Morals. As noted by Sussman, the TL passage, however, betrays some ambivalence. (...) Kant establishes a duty of virtue to be forgiving (TL, 6:460), yet he immediately warns against its excess: meek toleration of recurrent wrongs could manifest a lack of self-respect and a violation of a duty to oneself (TL, 6:461). Sussman claims that this ambivalence ultimately arises from the fact that forgiveness sits uncomfortably in Kant’s moral thought. First, forgiveness has an ‘ineluctably elective aspect’ that makes it, to a certain extent, arbitrary and dependent on particular features of the forgiver’s psychology and, as such, in tension with Kant’s central claims that human beings are autonomous agents capable of determining their own moral status. Second, according to Sussman, Kant’s moral retributivism, i.e. ‘the particular moral position that every moral wrong against another deserves punishment of the wrongdoer’ seems to be in tension with the possibility of a ‘truly redemptive forgiveness’. Moreover, forgiveness also seems to be in tension with a passage of the Religion in which Kant argues that the moral guilt from our original evil disposition cannot be understood as a debt or liability that can be compensated, erased, transferred or otherwise wiped out by others (Rel, 6:72). Thus, to the extent that forgiveness might be thought to involve the forgoing of moral guilt, it seems incompatible with Kant’s views on culpability and punishment. This chapter seeks to clarify Kant’s views on forgiveness in order to show that, although not often appreciated, personal forgiveness plays an important role in the lives of ordinary human agents as understood by Kant. In particular, I aim to show there is a conception of forgiveness available to Kant that is not incompatible with Kant’s views of punishment and culpability. In Section 1, I argue that, for Kant, far from being merely ‘elective,’ forgiveness is, under certain conditions, morally required. I provide a brief summary of an interpretation of Kant’s theory of forgiveness that I have defended in recently published work , in order to argue that Kant’s duty to be forgiving should be understood as an imperfect duty of virtue which is conditional on repentance. Kant is not ambivalent about this duty because he maintains that when the relevant conditions are not met, we have a perfect duty to ourselves not to forgive unrepentant wrongdoers. The TL passage thus identifies two different duties. In Section 2, I show that forgiveness, as conceptualised by Kant, does not require the forgoing of punishment or the overcoming of moral guilt and that this could, in fact, be seen as an attractive feature of Kant’s position.
