Data protection law has a linear logic, in that it purports to trace the lifecycle of personal data from creation to collection, processing, transfer, and ultimately its demise, and to regulate each step so as to promote the data subject’s control thereof. Big data defies this linear logic, in that it decontextualizes data from its original environment and conducts an algorithmic nonlinear mix, match, and mine analysis. Applying data protection law to the processing of big data does not work well, (...) to say the least. This Article examines the case of big medical data. A survey of emerging research practices indicates that studies either ignore data protection law altogether or assume an ex post position, namely that because they are conducted after the data has already been created in the course of providing medical care, and they use de-identified data, they go under the radar of data protection law. These studies focus on the end-point of the lifecycle of big data: if sufficiently anonymous at publication, the previous steps are overlooked, on the claim that they enjoy immunity. I argue that this answer is too crude. To portray data protection law in its best light, we should view it as a process-based attempt to equip data subjects with some power to control personal data about them, in all phases of data processing. Such control reflects the underlying justification of data protection law as an implementation of human dignity. The process-based approach fits current legal practices and is justified by reflecting dignitarian conceptions of informational privacy. (shrink)

This Article discusses the first steps of Israeli copyright law, dating it back to Ottoman times, which is earlier than thus far discussed in the literature. The account provides an early case of legal globalization through colonialism. The imposition of copyright law in Palestine enables us to observe the difficulties of applying an uninvited legal transplant and to trace its dynamics. The discussion queries the fate of copyright law in Mandate Palestine from two perspectives. First, the Colonial-Imperial point of view: (...) I ask why the British government imposed copyright law in the newly administered territory only a month after the establishment of the civil administration in 1920 and then replaced it in 1924. The answers are to be found in the general imperial agenda, its Palestine agenda, as well as the nature of copyright and the personal background of those involved. Second, from the local point of view, I trace the first steps of copyright law within the Hebrew community and especially within the literary circle in the 1920s. The local needs of the literary field concerned the author-publisher relationship, attribution, the integrity of the work and international transactions. However, the answers to these problems were not found in the law but rather in private ordering, namely contracts and social norms. (shrink)

A vast literature establishing a “business case” for corporate social responsibility appears to find that usually they do. However, as argued herein, the business case literature has established only that firms usually benefit from responding to the demands of their primary stakeholders. The nature of the relationship between the interests of business and those of broader society, beyond a subset of powerful primary stakeholders, remains an open (...) question despite this vast literature. This article develops a set of propositions that highlight constraints on firms’ ability to profit from CSR and outlines a set of managerial challenges on which researchers must focus their attention to truly determine whether and when firms can profit by responding to the needs of society. Metaethical constitutivists attempt to explain reasons or normativity in terms of what is constitutive of agency. Michael Smith has recently defended a novel form of constitutivism that he argues provides a rational foundation for morality. This article develops three main objections centered on (1) the normative significance of Smith’s conception of ideal agency, (2) whether that conception begs the question in favor of the rationality of moral requirements, and (3) whether Smith’s constitutivism provides a plausible account of the content (...) of moral requirements. The idea is that sometimes we are interested in the truth on some issue not for any ulterior purpose, but simply because we are curious about that issue. In a case of weak-willed action the agent acts-freely, deliberately, and for a reason-in a way contrary to his best judgment, even though he thinks he could act in accordance with his best judgment. The possibility of such actions has posed one problem in moral philosophy, the exact nature of the problem it poses another. In this essay I offer an answer to the latter problem: an explanation of why a plausible account of free, deliberate and purposive action seems to (...) preclude the possibility of weak-willed action. I then try to resolve the first problem by developing this account in a way which allows for this possibility. The possibility of weak-willed action is made problematic by an account which sees free, deliberate and purposive action as involving the conclusion of a piece of practical reasoning. Solving the problem does not require us to abandon this conception but, rather, to notice certain special features of the relation between premises and conclusion in such reasoning. (shrink)

While the causal contributions of so-called ‘automatic’ processes to behavior are now widely acknowledged, less attention has been given to their normative role in the guidance of action. We develop an account of the normativity of automaticity that responds to and builds upon Tamar Szabó Gendler's account of ‘alief’, an associative and arational mental state more primitive than belief. Alief represents a promising tool for integrating psychological research on automaticity with philosophical work on mind and action, but Gendler errs in (...) overstating the degree to which aliefs are norm-insensitive. This paper argues that education itself, properly understood, is intimately concerned with an individual’s being in the world, and therefore is ineluctably environmental. This is guaranteed by the ecstatic nature of consciousness. Furthermore, it is argued that a central dimension of this environment with which ecstatic human consciousness is engaged, is that of nature understood as the ‘self-arising’. Nature, so conceived, is essentially other and is epistemologically mysterious, possessing its own normativity, agency, and intrinsic value. As such, engagement with nature (...) presents opportunities for consciousness quintessentially to go beyond itself, to be inspired and refreshed, and to receive non-anthropogenic standards in the form of intimations of what is fitting and what is not. It will be argued that these are fundamental to the orientation of human being, providing primordial intimations of the nature of reality and truth. Given their centrality to the idea of a person’s becoming educated, the elucidation of these and the issues to which they give rise must be central to the philosophy of education and in this sense it becomes deeply ecological. This essay is a reply to Martha Nussbaum's “Capabilities and Disabilities.” It endorses Nussbaum's critique of the social‐contract tradition and proposes that it might be productively contrasted with Michael Walzer's critique of John Rawls in Spheres of Justice. It notes that Nussbaum's emphasis on surrogacy and guardianship with regard to people with severe and profound cognitive disabilities poses a challenge to disability studies, insofar as the field tends to emphasize the self‐representation of people with disabilities and to concentrate primarily (...) on the aesthetic and political representation of physical disability. This paper defends the view that, in certain actual circumstances that aren’t uncommon for educated westerners, an awareness of the facts of religious disagreement doesn’t make theistic belief irrational. The first section makes some general remarks about when discovering disagreement (on any topic) makes it rational to give up your beliefs: it discusses the two main possible outcomes of disagreement (i.e., defeat of one’s disputed belief and demotion of one’s disputant), the main kinds of evidence that are relevant to demoting (...) one’s disputant, and the kinds of epistemic assessment involved in demoting a disputant. The second section argues that in cases of disagreement about theism, the theist’s evidence for theism and for the reliability of her theistic belief is often strong enough to support steadfastness in the face of disagreement. The third section argues that the theist’s evidence for the reliability of her disputant’s atheistic beliefs is often weak enough to allow her to rationally demote her atheist interlocutor and it explains how this demotion can occur in a sensible and appropriate way. The final section focuses on theists whose disagreement-based doubts about theism persist, despite the defenses offered on behalf of theism against such doubts. It concludes that these persistent doubts could in some cases result in defeaters for theistic belief, even if the doubts are irrational, but that the gift of faith can compensate for this. (shrink)

The emotions of guilt, shame, disappointment and grief, and the bodily states of pain and suffering, have something in common, at least phenomenologically: they are all unpleasant, they feel bad. But how might we explain what it is for some state to feel bad or unpleasant? What, in other words, is the nature of negative affect? In this paper I want to consider the prospects for evaluativist theories, which seek to explain unpleasantness by appeal to negative evaluations or appraisals. In (...) particular, I want to consider versions of evaluativism that seek to explain negative affect in terms of a kind of negative perceptual experience. These views thus attempt to explain feeling bad in terms of seeing bad. Now the most prominent evaluativist accounts of negative affect have been developed in the pain literature, and so my paper will primarily be focused on the question of whether evaluativism can provide a plausible account of the painfulness or unpleasantness of pain. I will argue that evaluativism faces serious objections on this score. Since my conclusions can be extended to cover negative affect more generally, however, we have good reason to reject evaluativist accounts of the negative affect involved in emotional experience. My arguments will thus have implications for those interested in the nature of emotional valence. I'll conclude with some brief remarks about the shape that a ‘relational’ account of painfulness in particular, and of negative affect in general, should take, in light of these criticisms of evaluativism. In my view, such views should appeal, not to negative evaluations to explain feeling bad, but to dislike. (shrink)

ABSTRACT:Despite sustained attention to ethical leadership in organizations, scholarship remains largely descriptive. This study employs an empirical approach to examine the consequences of ethical leadership on leader promotability. From a sample of ninety-six managers from two independent organizations, we found that ethical leaders were increasingly likely to be rated by their superior as exhibiting potential to reach senior leadership positions. However, leaders who displayed increased ethical leadership were no more likely to be viewed as promotable in the near-term compared to (...) those who displayed less ethical leadership. Our findings also show ethical culture and pressure to achieve results are important contextual factors that moderate the relationships between ethical leadership and leader promotability to senior leadership roles. These "technological futurisms" have arisen from significant advances in the fields of nanotechnology, biotechnology and information technology and are drawing growing scrutiny from the philosophical and theological communities. This text seeks to contextualize the growing literature on the cultural, philosophical and religious implications of technological growth by considering technological futurisms such as transhumanism in the context of the long (...) historical tradition of technological dreaming. We are continually trying to make sense of our world through the stories we tell and are told, but in our search for coherence, we often sacrifice our freedom and the rich randomness of life. Through an analysis of all these writings, this book convincingly argues that they were composed by a single individual, Antiphon the Athenian. Michael Gagarin sets close readings of individual works within a wider discussion of the fifth-century Athenian intellectual climate and the philosophical ferment known as the sophistic movement. This enables him to demonstrate the overall coherence of Antiphon's interests and writings and to show how he was a pivotal figure between the sophists and the Attic orators of the fourth century. In addition, Gagarin's argument allows us to reassess the work of the sophists as a whole, so that they can now be seen as primarily interested in logos (speech, argument) and as precursors of fourth-century rhetoric, rather than in their usual role as foils for Plato.
