Cost-benefit analysis is commonly understood to be intimately connected with utilitarianism and incompatible with other moral theories, particularly those that focus on deontological concepts such as rights. We reject this claim and argue that cost-benefit analysis can take moral rights as well as other non-utilitarian moral considerations into account in a systematic manner. We discuss three ways of doing this, and claim that two of them (output filters and input filters) can account for a wide range of rights-based moral theories, (...) including the absolute notions of moral rights proposed by Hayek, Mayo, Nozick, and Shue. We also discuss whether the use of output filters and input filters can be generalized to cover other non-utilitarian theories, such as Kantian duty ethics and virtue ethics. (shrink)

Early in February 1978, we received the following letter from Lowry Nelson, Jr., professor of comparative literature at Yale University: Regarding the exchange between Professors Martin and Hartman in Critical Inquiry 4 : 397-416, I would like to comment on the use of the institutional adjective "Yale." Labels are naturally sticky and attaching them is a habit and for a time a convenience. It would be unfortunate if the label that reads "the Yale group" or "the Yale critics" (...) were to gain unchallenged currency. So far as I can see, there is nothing that could be called a "school" of criticism here and certainly there is no indoctrination of students of some touted orthodoxy. In literary criticism there is still, and I am confident there will continue to be, a great range of views and interests discussed generally with amicable forthrightness. Versions of Hegel and Freud, revivals of rhetoric, criticism as "literature," and etymological dabbling are not so very new or so very local. This still enlightened academic grove has not and will not become a lucus a non lucendo. (shrink)

In _The Moral Austerity of Environmental Decision Making_ a group of prominent environmental ethicists, policy analysts, political theorists, and legal experts challenges the dominating influence of market principles and assumptions on the formulation of environmental policy. Emphasizing the concept of sustainability and the centrality of moral deliberation to democracy, they examine the possibilities for a wider variety of moral principles to play an active role in defining “good” environmental decisions. If environmental policy is to be responsible to humanity and to (...) nature in the twenty-first century, they argue, it is imperative that the discourse acknowledge and integrate additional normative assumptions and principles other than those endorsed by the market paradigm. The contributors search for these assumptions and principles in short arguments and debates over the role of science, social justice, instrumental value, and intrinsic value in contemporary environmental policy. However, Rosemary Lowry and Martin Peterson have recently argued that, for instance, a pure time preference to go to the opera tonight rather than next month may be rationally permissible, even if the amounts of intrinsic value realized in both cases (...) are identical. Individuals with Acquired Brain Injury (ABI) suffer chronic impairment across cognitive, physical and psycho-social domains, and the experience of anxiety, isolation and apathy has been amplified by the COVID-19 pandemic. A qualitative evaluation was conducted of 14 individuals with ABI who had participated in series of COVID adapted group-based intervention(s) that had been designed to improve wellbeing. Eight themes were identified: Facilitating Safety, Fostering Positive Emotion, Managing and Accepting Difficult Emotions, Promoting Meaning, Finding Purpose and Accomplishment, Facilitating Social Ties, (Re)Connecting (...) to Nature, and Barriers to Efficacy. Findings are discussed with respects to recent theoretical developments in positive psychology and wellbeing science and support the use of online and outdoor interventions to enhance wellbeing in individuals living with ABI during the COVID-19 pandemic. This paper makes a unique contribution to second wave positive psychology (PP2.0) through the application of recent advances in wellbeing science to an ABI population during the COVID-19 pandemic. In doing so, this paper lays the foundation for new interventions that not only reduce impairment and distress, but also create opportunities for meaning and enhanced wellbeing in people living with chronic conditions and those individuals living with ABI in particular. Background: The advent of AIDS brought about a group of patients unwilling to accept crucial aspects of the methodological standards for clinical research investigating Phase 1 drugs, surgeries or devices. Their arguments against placebo controls in trials, which depended-at the time-on the terminal status of patient volunteers led to a renewed discussion of the ethics of denying patients with catastrophic illnesses access to last-chance experimental drugs, surgeries or devices. Sources of data: Existing ethics and health policy literature on the topic (...) of access to experimental drugs. Areas of agreement: The positions of those arguing for or against free access to experimental drugs for terminally ill patients are irreconcilable. Areas of controversy: At stake are questions about the kinds of personal sacrifices society can reasonably expect patients in clinical trials to make to ensure statistically predictive results. These would benefit by necessity a much larger number of current and future patients-the conflict is about individual versus public interests. It is also about the question of whether or not the state can legitimately prevent patients with terminal illnesses from unfettered access to experimental drugs, surgeries or devices in order to motivate them to participate in clinical trials. We review the ethical arguments for and against the provision of access to Phase 1 agents for terminally ill patients. Growing points: Finding a compromise between providing free or no access to Phase 1 drugs for terminally ill patients. Areas timely for developing research: We ought to investigate means to increase access to experimental drugs for terminally ill patients without sacrificing necessary clinical trials' sounds scientific methods. This paper takes the form of a reflective dialogue between three teachers of business ethics working in different continents. Originating as a conference debate, it takes as its theme the notion of ideological ‘neutrality’ and the role of the business ethics teacher. A position statement outlines an argument for ‘restraint’ as a modern day Aristotleian mean to protect student academic freedom. Two responses follow. The first of these provides a moderate advocacy position based on Socratic principles. The second response outlines (...) the notion of teaching as a relational process necessitating delayed disclosure and moral courage on the part of the teacher. Recently, philosophers and social scientists have turned their attention to the epistemological shifts provoked in established sciences by their incorporation of big data techniques. There has been less focus on the forms of epistemology proper to the investigation of algorithms themselves, understood as scientific objects in their own right. This article, based upon 12 months of ethnographic fieldwork with Russian data scientists, addresses this lack through an investigation of the specific forms of epistemic attention paid to algorithms by data scientists. (...) On the one hand, algorithms are unlike other mathematical objects in that they are not subject to disputation through deductive proof. On the other hand, unlike concrete things in the world such as particles or organisms, algorithms cannot be installed as the objects of experimental systems directly. They can only be evaluated in their functioning as components of extended computational assemblages; on their own, they are inert. As a consequence, the epistemological coding proper to this evaluation does not turn on truth and falsehood but rather on the efficiency of a given algorithmic assemblage. This article suggests that understanding the forms of algorithmic rationality employed in such inquiry is crucial for charting the place of data science within the contemporary academy and knowledge economy more generally. I revisit my article, “Why Immortality Is Not So Bad,” in which I argued that Bernard Williams’s thesis that immortality would necessarily be boring for any human being is false. Here I point out various ways in which Williams’s treatment of the issues has tilted and distorted the subsequent debates.

Taking issue with those who see recent social transformations as an extension of modernity, the author contends that social theory must confront an epochal change from the modern era to a new era of globality, in which human beings can conceive of forces at work on a global scale, and in which they espouse values that take the globe as their reference point. The book begins by assessing the problems of writing about modernity, showing how narratives of an endlessly self-perpetuating (...) modern age were intrinsic to the "modern project," the attempt by Enlightenment philosophers to transform the everyday world in accord with science and logic under the auspices of the nation-state. Now we are beginning to realize that the nation-state and the modern project cannot renew themselves endlessly through expansion. Instead, the author contends, the age has culminated in its own dissolution, and globality has supplanted modernity as the basis for action and social organization. In theorizing the global age, he considers the worldwide environmental consequences of aggregate human activities, the reconception of human security in the age of nuclear weapons, technological advances in communication systems, the rise of a global economy, and the growing reflexivity of global consciousness, as people and groups begin to refer to the globe as the frame for their beliefs. The book concludes by examining the consequences of the Global Age thesis for politics, identifying a new popular construction of the state that the author terms "performative citizenship." In the modern age, the nation-state was the central power and citizens were beneficiaries of that power, with rights and duties. In the global age, citizens respond to the lack of central power by creating, or performing, the state themselves. The global managerial class uses the skills learned in the bureaucracy of the nation-state to bring pressure on national governments in the interests of global economic, environmental, or human-rights issues. Consciousness is, perhaps, the aspect of our mental lives that is the most perplexing for both psychologists and philosophers. Daniel Dennett has described it as 'both the most obvious and the most mysterious feature of our minds' and attempts at definition often seem to move in circles. Thomas Nagel famously remarked that 'without consciousness the mind-body problem would be much less interesting. With consciousness it seems hopeless.'. These observations might suggest that consciousness - indefinable and mysterious - falls outside the (...) scope of rational enquiry, defying both scientific and philosophical investigation. In reality, however, the topic has been a focus of psychological investigation since William James and is increasingly vital in philosophical research.
