Aristotle was the founder not only of logic but also of modal logic. In the Prior Analytics he developed a complex system of modal syllogistic which, while influential, has been disputed since antiquity--and is today widely regarded as incoherent. Combining analytic rigor with keen sensitivity to historical context, Marko Malink makes clear that the modal syllogistic forms a consistent, integrated system of logic, one that is closely related to other areas of Aristotle's philosophy. Aristotle's modal syllogistic differs significantly from (...) modern modal logic. Malink considers the key to understanding the Aristotelian version to be the notion of predication discussed in the Topics--specifically, its theory of predicables and the ten categories. The predicables introduce a distinction between essential and nonessential predication. In contrast, the categories distinguish between substantial and nonsubstantial predication. Malink builds on these insights in developing a semantics for Aristotle's modal propositions, one that verifies the ancient philosopher's claims of the validity and invalidity of modal inferences. Die Untersuchung gliedert sich in drei durch eine Einführung und eine Schlussbetrachtung eingerahmte Hauptkapitel. Im ersten Hauptkapitel geht es um Kants Raum- und Zeitkonzeption in seiner vorkritischen Phase unter Berücksichtigung seiner Reaktion auf die zeitgenössische Kritik an seiner Konzeption von 1770. Dabei wird Kants komplexer Denkweg hin zu seiner Wende zum Verständnis von Raum und Zeit als reinen Anschauungen thematisiert. Hieran schließt sich im zweiten Hauptkapitel die Behandlung der prominenteren, systematisch ausgereiften Raum- und Zeitkonzeption in der Kritik der reinen Vernunft (...) an, wobei zunächst die unterschiedlichen Argumente aus der transzendentalen Ästhetik sukzessive und unter Einschluss der Forschungsliteratur diskutiert werden und Raum und Zeit als formale Anschauungen in der transzendentalen Analytik sowie als Ideen der Vernunft in der transzendentalen Dialektik zur Sprache kommen. According to a thesis famously associated with Anscombe'sIntention, knowledge is a necessary condition of intentional action: when acting intentionally, we know what we are doing. Call this the Agential Knowledge thesis. The Agential Knowledge thesis remains, of course, controversial. Furthermore, as even some of its proponents acknowledge, it can appear puzzling: Why should acting intentionally require knowing what you are doing? My aim in this paper is to propose an explanation and defence of the Agential Knowledge thesis, based on the (...) idea that acting intentionally is exercising control, in a relevant sense. My argument rests on two things: first, articulating a modal conception of the relevant sense of control, and, secondly, arguing that agential knowledge is distinctively practical. As I explain, the truth of the Agential Knowledge thesis opens promising paths for future work in the philosophy of action. (shrink)

The recurring claim that the construct of psychopathy is value laden often is not qualified in enough detail. The chapters in this part of the volume, instead, investigate in depth the role and significance of values in different aspects of the construct of psychopathy. Following these chapters, but also by offering a background to them, we show how certain values are involved in the characterisation of psychopathy, inform societal needs satisfied by this construct, and have a central role in determining (...) whether psychopathy is a mental disorder. Moreover, we relate this description to our criticism of the view that the entrenchment of the notion of psychopathy with values in principle renders it irreconcilable with sound psychiatric theory and practice. However, we also recognize that the value-ladenness of psychopathy leaves open other important challenges. Meeting them needs addressing interdisciplinary interrelated issues that have empirical, normative, and theoretical dimensions. (shrink)

Gilbert's kisceral argumentation is, roughly speaking, about arguing based on intuitions. In the forefront of such a (rhetorical) model are arguers and audiences, who resolve disagreements using kisceral arguments. Intuitions as reasons were more important in pre-modern law, when the law was not as explicit, precise, and determinate as today. Law influenced by religion or religious law was a typical example. In our much more secular modern era, intuitions are more or less subordinated to the (legal) logical mode of arguing. (...) Attempts to explain behavior genetically face two major problems: the application of the concept of genetic coding and the theoretical possibility of decomposing behavior. This paper argues that using the notion of genetic coding is appropriate in explanations of protein synthesis but inadequate and even misleading in the context of explanations of behavior. Genes should be regarded as disparate components of mechanisms that account for behavior rather than as codes for behavioral phenotypes. Such mechanistic explanations, however, presuppose the possibility of (...) decomposing behavioral phenotypes, which is strongly disputed by researchers holding an interactionist view of behavior. It is argued that these researchers fail to distinguish etiological from constitutive decomposition, and that their objections apply to the former but not to the latter kind. Constitutive decomposition might identify genes as disparate components and open up the possibility of explaining behavior mechanistically by isolating causal paths from genes to behavior. Finally, research on the single gene disorder phenylketonuria is introduced to illustrate and test these views. In response to Albrecht et al.’s (J Agric Environ Ethics 26(4):827–845, 2013) discussion on the ethics of assisted migration, we emphasize the issues of risk and scientific uncertainty as an inextricable part of a comprehensive ethical evaluation. Insisting on a separation of risk and ethical considerations, although arguably common in many policy contexts, is at best misguided and at worst damaging.

In this paper, we explore the possibility of applying traditional and modern aesthetical theories to logical and mathematical proofs, with the goal of better understanding the intuitive concept of mathematical beauty. This informal concept takes a central role in the work of logicians and mathematicians and can be thought of as their main motivation. In the present paper, we try to define concepts connected to mathematical beauty or beauty in mathematical proofs, so that we may lay the foundations for a (...) more precise definition of mathematical beauty which would be obtained through a detailed survey among logicians and mathematicians, presented in a future paper. In this paper, I develop an epistemological argument for freedom from poverty, building on Gerald Gaus’ work on political and moral disagreement in New Diversity Theory (NDT). NDT argues that diversity and disagreement are fundamental to political and moral learning. In this paper, I address Gaus’ central arguments in NDT, and focus on what I argue to be the key epistemological distinction of his account—namely, the argument that the relevant diversity, which is conducive to political and moral learning and should (...) therefore be protected by an institutional order, should not be defended or defined by reference to its performance with regards to discovery of true beliefs, but by reference to the independent epistemic value of protection of disagreeing, redundant and distant investigators. I develop a restatement of this argument from the perspective of institutional epistemology, and show that (along with constitutional liberties, polycentric self-governance and markets) freedom from poverty must be considered an institutional “device” conducive to such a conception of diversity. While Gaus rejects redistributive policies at the level of an institutional order, it is precisely his account of the epistemic powers of diversity and disagreement which provides the strongest defense of minimal redistribution. Regress arguments have convinced many that reasoning cannot require beliefs about what follows from what. In this paper I argue that this is a mistake. Regress arguments rest on dubious (although deeply entrenched) assumptions about the nature of reasoning — most prominently, the assumption that believing p by reasoning is simply a matter of having a belief in p with the right causal ancestry. The harm usually associated with psychopathy requires therapeutically, legally, and ethically satisfactory solutions. Scholars from different fields have, thus, examined whether empirical evidence shows that individuals with psychopathic traits satisfy concepts, such as responsibility, mental disorder, or disability, that have specific legal or ethical implications. The present paper considers the less discussed issue of whether psychopathy is a disability. As it has been shown for the cases of the responsibility and mental disorder status of psychopathic individuals, we argue that it (...) is undecided whether psychopathy is a disability. Nonetheless, based on insights from disability studies and legislations, we propose that interventions to directly modify the propensities of individuals with psychopathic tendencies should be balanced with modifications of the social and physical environments to accommodate their peculiarities. We also suggest how this social approach in some practical contexts that involve non-offender populations might be effective in addressing some of the negative effects of psychopathy. (shrink)

The philosophical literature on reasoning is dominated by the assumption that reasoning is essentially a matter of following rules. This paper challenges this view, by arguing that it misrepresents the nature of reasoning as a personal level activity. Reasoning must reflect the reasoner’s take on her evidence. The rule-following model seems ill-suited to accommodate this fact. Accordingly, this paper suggests replacing the rule-following model with a different, semantic approach to reasoning.

This paper considers the question of whether the influential distinction between levels of explanation introduced by David Marr can be used as a general framework for contemplating levels of explanation in cognitive sciences. Marr introduced three levels at which we can explain cognitive processes: the computational, algorithmic, and implementational levels. Some argue that Marr’s levels of explanation can only be applied to modular cognitive systems. However, since many psychological processes are non-modular, it seems that Marr’s levels of explanation cannot explain (...) such psychological processes. To show that the latter claim is not convincing, the paper draws upon an influential paradigm from cognitive sciences that is based on the principle of free energy. Based on this paradigm, the paper argues that even non-modular psychological processes can be computationally analyzed and algorithmically implemented. The conclusion of the paper is that, at least under the assumption that the func- tion of the mind is to minimize free energy, Marr’s levels of explanation can be successfully used as a general framework for understanding psychological processes at different levels of description. The issue whether psychopathic offenders are practically rational has attracted philosophical attention. The problem is relevant in theoretical discussions on moral psychology and in those concerning the appropriate social response to the crimes of these individuals. We argue that classical and current experiments concerning the instrumental learning in psychopaths cannot directly support the conclusion that they have impaired instrumental rationality, construed as the ability for transferring the motivation by means-ends reasoning. In fact, we defend the different claim that these experiments (...) appear to show that psychopaths in certain circumstances are not aware of the relevant means for their ends. In §24 of the Transcendental Deduction, Kant remarks that his account of the capacity of the understanding to spontaneously determine sensibility explains how empirical self-knowledge is possible through inner-sense. Although most commentators consider Kant's conception of empirical self-knowledge through inner sense to be either a failure or at least drastically under-developed, I argue that (just as Kant claims) his account of the capacity of the understanding to determine sensibility - the "productive imagination" - can ground an attractive account of self-knowledge. (...) The account of inner sense I propose, however, may seem to conflict with some of Kant's views on time. We provide a novel Bayesian justification of inference to the best explanation. More specifically, we present conditions under which explanatory considerations can provide a significant confirmatory boost for hypotheses that provide the best explanation of the relevant evidence. Furthermore, we show that the proposed Bayesian model of IBE is able to deal naturally with the best known criticisms of IBE such as van Fraassen?s?bad lot? argument.

This article aims to show that it is impossible to put Cicero’s testimonies regarding The Fabius Argument in a consistent inferential order. Either we must suppose that additional premises are tacitly assumed in the text or we must com-pare it with other sources, which leads to inconsistencies in the proof’s reconstruction. Cicero’s reconstruction of the progression of the argument has formal shortcomings, and the paper draws attention to some of these deficiencies. He interpreted sources in a revised and intentionally simplified (...) way, with the aim of undermining the views of his opponents, casting them as inconsistent and similar to views held by Diodorus. Rather than being a consistently interpreted argument faithfully transcribed from the Stoic sources, Cicero’s Fabius Argument is ultimately anti-Stoic. (shrink)

Recently there has been a trend of moving towards biological and neurocognitive based classifications of mental disorders that is motivated by a dissatisfaction with the syndrome-based classifications of mental disorders. The Research Domain Criteria (indicated with the acronym RDoC) represents a bold and systematic attempt to foster this advancement. However, RDoC faces theoretical and conceptual issues that need to be addressed. Some of these difficulties emerge when we reflect on the plausible reading of the slogan “mental disorders are brain disorders”, (...) that according to proponents of RDoC constitutes one of its main presuppositions. Some authors think that endorsing this idea commits RDoC to a form of biological reductionism. We offer empirical and theoretical considerations for concluding that the slogan above should not be read as a reductionist thesis. We argue, instead, that the slogan has a pragmatic function whose aim is to direct research in psychopathology. We show how this function might be captured in the framework of a Carnapian explication as a methodological tool for conceptual engineering. Thus, we argue that a charitable interpretation of the aims of the proponents of RDoC should be understood as an attempt at providing an explication of the concept of mental disorder in terms of brain disorder whose main goal is to provide a more precise and fruitful notion that is expected to have a beneficial impact on classification, research, and treatment of psychiatric conditions. In the paper, I examine the conditions that are necessary for the correct characterization of the phenomenon of self-deception. Deflationists believe that the phenomenon of self-deception can be characterized as a kind of motivationally biased belief-forming process. They face the selectivity problem according to which the presence of a desire for something to be the case is not enough to produce a self-deceptive belief. Intentionalists argue that the solution to the selectivity problem consists in invoking the notion of intention. According (...) to them, self-deception involves intentional distortion of one's own belief-forming process. In this paper, I defend the claim that intentionalists also face the problem of selectivity. Accordingly, I argue that this objection cannot be used to determine which theory of self-deception is superior. Furthermore, I argue that limiting folk-psychological explanations to reason-based explanations might be responsible for the resilience of the selectivity problem. In that context, as an additional explanatory factor, I emphasize personality traits that, along with motives, play an important role in the psychological explanation of human behavior. In the rest of the paper, I explore how such an expanded view of the folk-psychological explanation can be used to better capture individual cases of self-deception. (shrink)

In his essay ‘Transparency, Belief, Intention’, Alex Byrne (2011) argues that transparency—our ability to form beliefs about some of our intentional mental states by considering their subject matter, rather than on the basis of special psychological evidence—involves inferring ‘from world to mind’. In this reply I argue that this cannot be correct. I articulate an intuitive necessary condition for a pattern of belief to count as a rule of inference, and I show that the pattern involved in transparency does not (...) meet that condition. Should offenders with psychopathy or those exhibiting extreme forms of antisocial behav- iour be considered criminally responsible? The current debate seems to have reached a stalemate. Several scholars have argued that neuropsychologi- cal data on individuals with psychopathy might be relevant for determining their criminal responsibil- ity. However, relying on such data has not produced a consensus among legal scholars and philosophers on whether individuals with psychopathy should be excused from responsibility. We offer a diagnosis about why this debate has (...) reached a standoff. We argue that part of the problem is that psychopathy, being a syndrome-based category, is too heterogeneous and thus offers low prospects for being integrated with neuropsychological data that might support significant conclusions about the criminal responsibility of individuals with psychopathy. Moreover, the construct of psychopathy was not originally devised to discriminate criminally accountable from unac- countable antisocial individuals. To overcome these difficulties and advance the debate, we extend a currently less discussed theoretical framework for bridging biopsychology and the law that focuses on neuropsychological constructs, domains, and processes that directly measure capacities of offenders that are relevant for criminal responsibility, without necessarily relying on mediating syndrome-based constructs. The novelty of our contribution is that the biopsy- chological bases of exculpation can be further devel- oped and used for determining more fine-grained cat- egorisations of antisocial personality types. We show how this framework provides guidelines for inter- disciplinary research that can significantly advance our understanding of the preconditions for criminal responsibility and help the legal practice of ascribing or withholding it. In this study, we examine the influence of senior leadership on firms’ corporate social responsibility. We integrate upper echelons research that has investigated either the influence of the CEO or the top management team on CSR. We contend that functional experience complementarity between CEOs and TMTs in formulating and implementing CSR strategy may underlie differentiated strategies in CSR. We find that when CEOs who have predominant experience in output functions are complemented by TMTs with a lower proportion of members who (...) have experience in output functions, there is a pronounced effect on the community, product, and diversity dimensions of CSR. In turn, when output-oriented CEOs are complemented by output-oriented TMTs, we observe an effect on the employee relations dimension of CSR. Interestingly, we find no influence of CEO-TMT complementarity on the environment dimension of CSR. In general, our empirical results support the relevance of the interaction between CEOs and their TMTs in defining their firms’ CSR profile. (shrink)

In this article I discuss and evaluate the selectivity problem as a problem put forward by Bermudez (1997, 2000) against anti-intentionalist accounts of self-deception. I argue that the selectivity problem can be raised even against intentionalist accounts, which reveals the too demanding constraint that the problem puts on the adequacy of a psychological explanation of action. Finally I try to accommodate the intuitions that support the cogency of the selectivity problem using the resources from the framework provided by an anti-intentionalist (...) account of self-deception. Does rationality require us to take the means to our ends? Intuitively, it seems clear that it does. And yet it has proven difficult to explain why this should be so: after all, if one is pursuing an end that one has decisive reason not to pursue, the balance of reasons will presumably speak against one's taking the means necessary to bring that end about. In this paper I propose a novel account of the instrumental requirement which addresses this problem. (...) On the view I develop, the instrumental requirement is normative not because agents have reasons to comply with it, but because it is a normative standard intrinsic to intentional action—i.e., it is a standard that partly spells out what it is to exercise one's agency well. Recently it has been argued that certain neuropsychological findings on the decision-making, instrumental learning, and moral understanding in psychopathic offenders offer reasons to consider them not criminally responsible, due to certain epistemic and volitional impairments. We reply to this family of arguments, that collectively we call the irresponsibility of the psychopath argument. This type of argument has a premise that describes or prescribes the deficiencies that grant or should grant partial or complete criminal exculpation. The other premise contends that neuropsychological (...) evidence shows that psychopaths have incapacitates that are sufficient to ascribe complete or partially exculpatory deficiencies. The focus of our criticism is this latter premise. We argue that it requires that psychopathy should correlate significantly with certain rational incapacities that manifest across contexts. We show that the available neuropsychological data do not support the claim that psychopaths have such general exculpatory incapacities. (shrink)

In this new book, Marko Zlomislić argues that Slavoj Žižek's work does not contain any sort of radical emancipatory project, especially as it passes through the ideology of communism and Lacanian psychoanalysis. The evidence for the failure of communism is vast and includes the more than six hundred mass graves recently located in Žižek's homeland of Slovenia. Zlomislić demonstrates that the way out of the capitalist dilemma is not a repetition of communism but a return to the late medieval (...) notion of haecceity or "individual thisness" that was rejected by modernity. Haecceity, or the indescribable and indefinite here and now of the person, shows that the late medieval Franciscans were already "postmodernists." It is no wonder that the totalitarianism of the modernist Hegel is embraced by thinkers such as Žižek, Badiou, Hardt, Negri, and Laclau and was already rejected by Leibnitz, Kierkegaard, Nietzsche, Levinas, Deleuze, and Derrida. This important book shows that Žižek's work must be rejected because it does not uphold the dignity, worth, and uniqueness of the person. (shrink)

The work tends to point out the deficiency of some opinions claiming simplified presentation of the promise as the act that directly rise obligation for the promisor. Promises, either in the moral or legal sphere, are based on communication and so form an order of dependent steps that indicates their procedural nature. These characteristics may differ to a lesser extent, depending on the legal systems, moral norms of the society and its technical level and its needs. In all these cases, (...) however, the procedural characteristics of promises, especially in conditional promises, as well as the promises in contractual relations, persists. In our analysis we wish to show that the consistent conception of promise has to take into account a step of acceptance. In their 2010 paper, Dizadji-Bahmani, Frigg, and Hartmann argue that the generalized version of the Nagel–Schaffner model that they have developed is the right one for intertheoretic reduction, i.e. the kind of reduction that involves theories with largely overlapping domains of application. Drawing on the GNS, DFH presented a Bayesian analysis of the confirmatory relation between the reducing theory and the reduced theory and argued that, post-reduction, evidence confirming the reducing theory also confirms the reduced theory and evidence confirming the (...) reduced theory also confirms the reducing theory, which meets the expectations one has about theories with largely overlapping domains. In this paper, I argue that the Bayesian analysis presented by DFH faces difficulties. In particular, I argue that the conditional probabilities that DFH introduce to model the bridge law entail consequences that run against the GNS. However, I also argue that, given slight modifications of the analysis that are in agreement with the GNS, one is able to account for these difficulties and, moreover, one is able to more rigorously analyse the confirmatory relation between the reducing and the reduced theory. This paper attempts to show that there are in fact many forms of determinism, most of which are familiar, and that these can be differentiated according to their particular components. Recognizing the composite character of determinism is thus central to demarcating its various forms.

Effective and specifically targeted social and therapeutic responses for antisocial personality disorders and psychopathy are scarce. Some authors maintain that this scarcity should be overcome by revising current syndrome - based classifications of these conditions and devising better biocognitive classifications of antisocial individuals. The inspiration for the latter classifications has been embedded in the Research domain criteria approach (RDoC). RDoC - type approaches to psychiatric research aim at transforming diagnosis, provide valid measures of disorders, aid clinical practice, and improve health (...) outcomes by integrating the data on the genetic, neural, cognitive, and affective systems underlying psychiatric conditions. In the first part of the paper, we discuss the benefits of such approaches in comparison to the dominant syndrome-based ones and review recent attempts at building biocognitive classifications of antisocial individuals. In their paper “Is psychopathy a mental disease?”, Thomas Nadelhoffer and Walter Sinnott-Armstrong argue that according to any plausible account of mental disorder, neural and psychological abnormalities correlated with psychopathy should be regarded as signs of a mental disorder. I oppose this conclusion by arguing that at least on a naturalistically grounded account, such as Wakefield’s ‘Harmful Dysfunction’ view, currently available empirical data and evolutionary considerations indicate that psychopathy is not a mental disorder.
