Recently there has been a trend of moving towards biological and neurocognitive based classifications of mental disorders that is motivated by a dissatisfaction with the syndrome-based classifications of mental disorders. The Research Domain Criteria (indicated with the acronym RDoC) represents a bold and systematic attempt to foster this advancement. However, RDoC faces theoretical and conceptual issues that need to be addressed. Some of these difficulties emerge when we reflect on the plausible reading of the slogan “mental disorders are brain disorders”, (...) that according to proponents of RDoC constitutes one of its main presuppositions. Some authors think that endorsing this idea commits RDoC to a form of biological reductionism. We offer empirical and theoretical considerations for concluding that the slogan above should not be read as a reductionist thesis. We argue, instead, that the slogan has a pragmatic function whose aim is to direct research in psychopathology. We show how this function might be captured in the framework of a Carnapian explication as a methodological tool for conceptual engineering. Thus, we argue that a charitable interpretation of the aims of the proponents of RDoC should be understood as an attempt at providing an explication of the concept of mental disorder in terms of brain disorder whose main goal is to provide a more precise and fruitful notion that is expected to have a beneficial impact on classification, research, and treatment of psychiatric conditions. In this new book, Marko Zlomislić argues that Slavoj Žižek's work does not contain any sort of radical emancipatory project, especially as it passes through the ideology of communism and Lacanian psychoanalysis. The evidence for the failure of communism is vast and includes the more than six hundred mass graves recently located in Žižek's homeland of Slovenia. Zlomislić demonstrates that the way out of the capitalist dilemma is not a repetition of communism but a return to the late medieval (...) notion of haecceity or "individual thisness" that was rejected by modernity. Haecceity, or the indescribable and indefinite here and now of the person, shows that the late medieval Franciscans were already "postmodernists." It is no wonder that the totalitarianism of the modernist Hegel is embraced by thinkers such as Žižek, Badiou, Hardt, Negri, and Laclau and was already rejected by Leibnitz, Kierkegaard, Nietzsche, Levinas, Deleuze, and Derrida. This important book shows that Žižek's work must be rejected because it does not uphold the dignity, worth, and uniqueness of the person. (shrink)

The concept of the ‘infodemic’ has become a popular explanation for the rejection of anti-COVID-19 crisis governance measures. In this paper, we argue that infodemic is an inherent property of society under free institutions misused to pursue an epistemically vicious political epistemology. Furthermore, we provide an alternative account of political epistemology of COVID-19 governance and popular resistance to it. Namely, we argue that 1) pandemics represent a complex problem, and some level of resistance to governance which restricts liberties while informed (...) by ongoing scientific and political learning processes is inevitable, and 2) the resistance is exacerbated by the history of technocratization of governance and the exclusionary socio-economic inequalities which condition political and epistemic deficiencies easily exploitable by the political entrepreneurs of right-wing populism, particularly under the conditions of social media which gamifies public discourse. Thus, we argue, the correct response to the cultures of rejection of anti-COVID-19 measures is to change the underlying political and economic conditions and not to limit speech or restrict franchise as the infodemic diagnosis suggests. Regress arguments have convinced many that reasoning cannot require beliefs about what follows from what. In this paper I argue that this is a mistake. Regress arguments rest on dubious (although deeply entrenched) assumptions about the nature of reasoning — most prominently, the assumption that believing p by reasoning is simply a matter of having a belief in p with the right causal ancestry. I propose an alternative account, according to which beliefs about what follows from what play a constitutive (...) role in reasoning. (shrink)

Aristotle was the founder not only of logic but also of modal logic. In the Prior Analytics he developed a complex system of modal syllogistic which, while influential, has been disputed since antiquity--and is today widely regarded as incoherent. Combining analytic rigor with keen sensitivity to historical context, Marko Malink makes clear that the modal syllogistic forms a consistent, integrated system of logic, one that is closely related to other areas of Aristotle's philosophy. Aristotle's modal syllogistic differs significantly from (...) modern modal logic. Malink considers the key to understanding the Aristotelian version to be the notion of predication discussed in the Topics--specifically, its theory of predicables and the ten categories. The predicables introduce a distinction between essential and nonessential predication. In contrast, the categories distinguish between substantial and nonsubstantial predication. Malink builds on these insights in developing a semantics for Aristotle's modal propositions, one that verifies the ancient philosopher's claims of the validity and invalidity of modal inferences. While it acknowledges some limitations of this reconstruction, Aristotle's Modal Syllogistic brims with bold ideas, richly supported by close readings of the Greek texts. (shrink)

Ever since ?ukasiewicz, it has been opinio communis that Aristotle's modal syllogistic is incomprehensible due to its many faults and inconsistencies, and that there is no hope of finding a single consistent formal model for it. The aim of this paper is to disprove these claims by giving such a model. My main points shall be, first, that Aristotle's syllogistic is a pure term logic that does not recognize an extra syntactic category of individual symbols besides syllogistic terms and, second, (...) that Aristotelian modalities are to be understood as certain relations between terms as described in the theory of the predicables developed in the Topics. Semantics for modal syllogistic is to be based on Aristotelian genus-species trees. The reason that attempts at consistently reconstructing modal syllogistic have failed up to now lies not in the modal syllogistic itself, but in the inappropriate application of modern modal logic and extensional set theory to the modal syllogistic. After formalizing the underlying predicable-based semantics (Section 1) and having defined the syllogistic propositions by means of its term logical relations (Section 2), this paper will set out to demonstrate in detail that this reconstruction yields all claims on validity, invalidity and inconclusiveness that Aristotle maintains in the modal syllogistic (Section 3 and 4). We examine topological pairs (\Delta, \Sigma) which have computable type: if X is a computable topological space and f:\Delta \rightarrow X a topological embedding such that f(\Delta) and f(\Sigma) are semicomputable sets in X, then f(\Delta) is a computable set in X. It it known that (D, W) has computable type, where D is the Warsaw disc and W is the Warsaw circle. In this paper we identify a class of topological pairs which are similar to (D, W) and have (...) computable type: we prove that (\Delta, \Sigma) has computable type if \Delta can somehow be approximated by a 2-cell whose boundary circle approximates \Sigma. Moreover, we examine higher-dimensional analogues of such pairs. (shrink)

Helpless feeling caused by low self-confidence could turn an athlete using aggressive behavior as alternate behavior in the interaction with the opponent during a game. The level of the aggression can be seen in the injury rate in that particular sport. This research objective is to find out the relation between self-confidence and the appearance of the aggressive behavior in basketball player. It involves 64 athletes in West (...) Jakarta between 17 to 28 years old. Data that was measured by questionnaires has shown there is a negative association between self-confidence and aggressive behavior in basketball athlete.  . Die Untersuchung gliedert sich in drei durch eine Einführung und eine Schlussbetrachtung eingerahmte Hauptkapitel. Im ersten Hauptkapitel geht es um Kants Raum- und Zeitkonzeption in seiner vorkritischen Phase unter Berücksichtigung seiner Reaktion auf die zeitgenössische Kritik an seiner Konzeption von 1770. Dabei wird Kants komplexer Denkweg hin zu seiner Wende zum Verständnis von Raum und Zeit als reinen Anschauungen thematisiert. Hieran schließt sich im zweiten Hauptkapitel die Behandlung der prominenteren, systematisch ausgereiften Raum- und Zeitkonzeption in der Kritik der reinen Vernunft (...) an, wobei zunächst die unterschiedlichen Argumente aus der transzendentalen Ästhetik sukzessive und unter Einschluss der Forschungsliteratur diskutiert werden und Raum und Zeit als formale Anschauungen in der transzendentalen Analytik sowie als Ideen der Vernunft in der transzendentalen Dialektik zur Sprache kommen. Ein dritter Hauptteil widmet sich Kants Verständnis von Raum und Zeit in der Kritik der Urteilskraft, wo Kants Lehre neue Impulse erfährt und im Kontext der philosophischen Ästhetik, der Kultur sowie des Erhabenen relevant wird. Discussions of Ryle’s regress argument against the “intellectualist legend” have largely focused on whether it is effective against a certain view about knowledge how, namely, the view that knowledge how is a species of propositional knowledge. This is understandable, as this is how Ryle himself framed the issue. Nevertheless, this focus has tended to obscure some different concerns which are no less pressing—either for Ryle or for us today. More specifically, I argue that a version of Ryle’s regress confronts any (...) view according to which the intelligence manifested in action must be inherited from purely inner mental causes. I recommend an alternative account of the metaphysics of intelligent action, which avoids this commitment. (shrink)

This daily diary study examined the within-person coupling between four emotion regulation strategies and both subjective well-being and perceived stress in daily life of geriatric nurses. Participants ( N = 89) described how they regulated their emotions in terms of cognitive reappraisal and suppression. They also indicated their subjective well-being and level of perceived stress each day over 3 weeks. At the within-person level, cognitive reappraisal intended to increase positive emotions was positively associated with higher subjective well-being and negatively associated (...) with perceived stress. Suppression of the expression of positive emotions was negatively associated with subjective well-being and positively associated with perceived stress. However, cognitive reappraisal intended to down-regulate negative emotions and suppression as a strategy to inhibit the expression of negative emotions were not associated with daily well-being or perceived stress. Off-days were rated as days with higher subjective well-being and lower perceived stress in contrast to working days. At the between-person level, individuals who reported more daily negative affect reported increased suppression of positive emotions, corroborating the within-person findings. Moreover, findings indicated that nurses with more years of experience in the job reported higher subjective well-being and less perceived stress. These results provide insights into important daily emotional processes of geriatric nurses, both at workdays and in their leisure time. (shrink)

This paper concerns the apparent fact — discussed by Sinan Dogramaci and Brian Weatherson — that inductive reasoning often interacts in disastrous ways with patterns of reasoning that seem perfectly fine in the deductive case. In contrast to Dogramaci's and Weatherson's own suggestions, I argue that these cases show that we cannot reason inductively about arbitrary objects. Moreover, as I argue, this prohibition is neatly explained by a certain hypothesis about the rational basis of inductive reasoning — namely, the hypothesis (...) that inductive reasoning is fundamentally reasoning about what normally happens. Effective and specifically targeted social and therapeutic responses for antisocial personality disorders and psychopathy are scarce. Some authors maintain that this scarcity should be overcome by revising current syndrome - based classifications of these conditions and devising better biocognitive classifications of antisocial individuals. The inspiration for the latter classifications has been embedded in the Research domain criteria approach (RDoC). RDoC - type approaches to psychiatric research aim at transforming diagnosis, provide valid measures of disorders, aid clinical practice, and improve health (...) outcomes by integrating the data on the genetic, neural, cognitive, and affective systems underlying psychiatric conditions. In the first part of the paper, we discuss the benefits of such approaches in comparison to the dominant syndrome-based ones and review recent attempts at building biocognitive classifications of antisocial individuals. Other researchers, how ever, have objected that biocognitive approaches in psychiatry are committed to an untenable form of explanatory. (shrink)

The philosophical literature on reasoning is dominated by the assumption that reasoning is essentially a matter of following rules. This paper challenges this view, by arguing that it misrepresents the nature of reasoning as a personal level activity. Reasoning must reflect the reasoner’s take on her evidence. The rule-following model seems ill-suited to accommodate this fact. Accordingly, this paper suggests replacing the rule-following model with a different, semantic approach to reasoning.

What exactly is reasoning? While debate on this question is ongoing, most philosophers seem to agree on at least the following: reasoning is a mental process operating on contents, which consists in adopting or revising some of your attitudes in light of others. In this paper, I argue that this characterisation is mistaken: there is no single mental phenomenon that satisfies both of these conditions. Instead, I characterise two distinct mental phenomena, which I call ‘deducing’, on the one hand, and (...) ‘reasoning’ or ‘inference’ on the other, to play each of these roles. Recognising this division of labour is essential to developing a better understanding of our rational economy. (shrink)

According to a thesis famously associated with Anscombe'sIntention, knowledge is a necessary condition of intentional action: when acting intentionally, we know what we are doing. Call this the Agential Knowledge thesis. The Agential Knowledge thesis remains, of course, controversial. Furthermore, as even some of its proponents acknowledge, it can appear puzzling: Why should acting intentionally require knowing what you are doing? My aim in this paper is to propose an explanation and defence of the Agential Knowledge thesis, based on the (...) idea that acting intentionally is exercising control, in a relevant sense. My argument rests on two things: first, articulating a modal conception of the relevant sense of control, and, secondly, arguing that agential knowledge is distinctively practical. As I explain, the truth of the Agential Knowledge thesis opens promising paths for future work in the philosophy of action. (shrink)

In this study, we examine the influence of senior leadership on firms’ corporate social responsibility. We integrate upper echelons research that has investigated either the influence of the CEO or the top management team on CSR. We contend that functional experience complementarity between CEOs and TMTs in formulating and implementing CSR strategy may underlie differentiated strategies in CSR. We find that when CEOs who have predominant experience in output functions are complemented by TMTs with a lower proportion of members who (...) have experience in output functions, there is a pronounced effect on the community, product, and diversity dimensions of CSR. In turn, when output-oriented CEOs are complemented by output-oriented TMTs, we observe an effect on the employee relations dimension of CSR. Interestingly, we find no influence of CEO-TMT complementarity on the environment dimension of CSR. In general, our empirical results support the relevance of the interaction between CEOs and their TMTs in defining their firms’ CSR profile. (shrink)

In this essay, the author outlines his re-construction of Spinoza’s ontological monism by re-presenting the system of Ethica, ordine geometrico demonstrata , in an “intuitive” model of the Perfect Diamond, called NATURADEUS. So, for example, ordo et connexio idearum et rerum , is presented to the inner eye in the forms of two parallel structures, of rays and of facets within the NATURADEUS, respectively. The conceptual background of the proposed model is mostly analytic, the author essays to develop some ideas (...) of Jonathan Bennett’s Spinoza’s metaphysics (especially “transattributive mode identity”), with strong emphasis on ethical issues of ontological monism or pantheism. This essay is written as a dialogue between master Bruno and his student John (physically absent at the moment). In his essay ‘Transparency, Belief, Intention’, Alex Byrne (2011) argues that transparency—our ability to form beliefs about some of our intentional mental states by considering their subject matter, rather than on the basis of special psychological evidence—involves inferring ‘from world to mind’. In this reply I argue that this cannot be correct. I articulate an intuitive necessary condition for a pattern of belief to count as a rule of inference, and I show that the pattern involved in transparency does not (...) meet that condition. As a result, I conclude that transparency does not involve inference. (shrink)

We provide a novel Bayesian justification of inference to the best explanation. More specifically, we present conditions under which explanatory considerations can provide a significant confirmatory boost for hypotheses that provide the best explanation of the relevant evidence. Furthermore, we show that the proposed Bayesian model of IBE is able to deal naturally with the best known criticisms of IBE such as van Fraassen?s?bad lot? argument.

The recurring claim that the construct of psychopathy is value laden often is not qualified in enough detail. The chapters in this part of the volume, instead, investigate in depth the role and significance of values in different aspects of the construct of psychopathy. Following these chapters, but also by offering a background to them, we show how certain values are involved in the characterisation of psychopathy, inform societal needs satisfied by this construct, and have a central role in determining (...) whether psychopathy is a mental disorder. Moreover, we relate this description to our criticism of the view that the entrenchment of the notion of psychopathy with values in principle renders it irreconcilable with sound psychiatric theory and practice. However, we also recognize that the value-ladenness of psychopathy leaves open other important challenges. Meeting them needs addressing interdisciplinary interrelated issues that have empirical, normative, and theoretical dimensions. (shrink)

This paper considers the question of whether the influential distinction between levels of explanation introduced by David Marr can be used as a general framework for contemplating levels of explanation in cognitive sciences. Marr introduced three levels at which we can explain cognitive processes: the computational, algorithmic, and implementational levels. Some argue that Marr’s levels of explanation can only be applied to modular cognitive systems. However, since many psychological processes are non-modular, it seems that Marr’s levels of explanation cannot explain (...) such psychological processes. To show that the latter claim is not convincing, the paper draws upon an influential paradigm from cognitive sciences that is based on the principle of free energy. Based on this paradigm, the paper argues that even non-modular psychological processes can be computationally analyzed and algorithmically implemented. The conclusion of the paper is that, at least under the assumption that the func- tion of the mind is to minimize free energy, Marr’s levels of explanation can be successfully used as a general framework for understanding psychological processes at different levels of description. The harm usually associated with psychopathy requires therapeutically, legally, and ethically satisfactory solutions. Scholars from different fields have, thus, examined whether empirical evidence shows that individuals with psychopathic traits satisfy concepts, such as responsibility, mental disorder, or disability, that have specific legal or ethical implications. The present paper considers the less discussed issue of whether psychopathy is a disability. As it has been shown for the cases of the responsibility and mental disorder status of psychopathic individuals, we argue that it (...) is undecided whether psychopathy is a disability. Nonetheless, based on insights from disability studies and legislations, we propose that interventions to directly modify the propensities of individuals with psychopathic tendencies should be balanced with modifications of the social and physical environments to accommodate their peculiarities. We also suggest how this social approach in some practical contexts that involve non-offender populations might be effective in addressing some of the negative effects of psychopathy. (shrink)

The role of intuition in understanding in general and in scientific understanding in particular is still very much a subject of a lively philosophical discussion. The role of intuition in thought experimenting is much disputed in its own right, and the arguments range from those that deny any substantial role of intuition in the final inference that the thought experiment is meant to illustrate (eg. Norton or Williamson) to the pivotal role some form of intuition might play (eg. Brown or (...) Miščević). So far, mostly Platonists were defenders of intuition, but in his recent book, Miščević takes on a formidable task to mount a defense of intuition as seen from a naturalist-evolutionist point of view and within his mental modelling approach to thought experiments. I will, while acclaiming certain – and considerable – merits of his approach, nevertheless, insist that certain aspects of intuitive comprehending as it is meant to be going on in the process of thought experimenting remains inexplicable in the naturalist scheme such as Miščević’s. The more mysterious (not to say Platonist) aspects of intuition will, hopefully, be revealed through the analyses of the two very famous thought experiments of Einstein which also figure quite importantly in his scientific opus. I will also have something to say about a few related problems as addressed by Miščević in his book regarding the description of thought experiment and more general imaginative enactments in thought, as well as on whether there is an essential difference between scientific (primarily physical) and metaphysical thought experiments and other thought experiments or related modes of thinking. Recently it has been argued that certain neuropsychological findings on the decision-making, instrumental learning, and moral understanding in psychopathic offenders offer reasons to consider them not criminally responsible, due to certain epistemic and volitional impairments. We reply to this family of arguments, that collectively we call the irresponsibility of the psychopath argument. This type of argument has a premise that describes or prescribes the deficiencies that grant or should grant partial or complete criminal exculpation. The other premise contends that neuropsychological (...) evidence shows that psychopaths have incapacitates that are sufficient to ascribe complete or partially exculpatory deficiencies. The focus of our criticism is this latter premise. We argue that it requires that psychopathy should correlate significantly with certain rational incapacities that manifest across contexts. We show that the available neuropsychological data do not support the claim that psychopaths have such general exculpatory incapacities. (shrink)

In this paper, I develop an epistemological argument for freedom from poverty, building on Gerald Gaus’ work on political and moral disagreement in New Diversity Theory (NDT). NDT argues that diversity and disagreement are fundamental to political and moral learning. In this paper, I address Gaus’ central arguments in NDT, and focus on what I argue to be the key epistemological distinction of his account—namely, the argument that the relevant diversity, which is conducive to political and moral learning and should (...) therefore be protected by an institutional order, should not be defended or defined by reference to its performance with regards to discovery of true beliefs, but by reference to the independent epistemic value of protection of disagreeing, redundant and distant investigators. I develop a restatement of this argument from the perspective of institutional epistemology, and show that (along with constitutional liberties, polycentric self-governance and markets) freedom from poverty must be considered an institutional “device” conducive to such a conception of diversity. While Gaus rejects redistributive policies at the level of an institutional order, it is precisely his account of the epistemic powers of diversity and disagreement which provides the strongest defense of minimal redistribution. ABSTRACT This paper analyzes the use of language in the construction of identity in the constitution of an anti-state group, which is a part of the sovereign citizen movement in Austria. The group, called ‘Staatenbund Österreich’, had been active for several years before the government charged them with high treason. The group believes that the government is illegitimate – an assumption which allows them to legitimize their behavior. The movement, which is spreading across the globe, has started in the US (...) in the 1970s, and yet, it is still impossible to estimate the actual danger they pose, even though they have been reported to become increasingly violent. The present paper investigates the constitution of the ‘Austrian Commonwealth’ in order to find out how they manage to create an identity for their group, how they legitimize themselves and their claims, and how their language use compares to other extremist groups. Evolution and life phenomena can be understood as results of history, i.e., as outcomes of cohabitation and collective memory of populations of autonomous entities across many generations and vast extent of time. Hence, evolution of distinct lineages of life can be considered as isomorphic with that of cultures. I argue here that cultures and culture-like systems – human culture, natural languages, and life forms – always draw from history, memory, experience, internal dynamics, etc., transforming themselves creatively into new patterns, never (...) foreseen before. This is possible thanks to the fact that all forms of life are descendants of life. Ontogeny and speciation in various lineages draw from continuous re-interpretation of conservative genetic/generic “texts”, as well as from changes of the interpretative process itself. The result is continuous appearances of new lineages-cultures and/or communities-cultures, in a semiotic process of re-interpretation and inventing new ways of living. The topic is developed here on the backgrounds of ideas presented by R. A. Rappaport in “Ritual and religion in the making of humanity” and J. Flegr in “Frozen evolution”. (shrink)

The issue whether psychopathic offenders are practically rational has attracted philosophical attention. The problem is relevant in theoretical discussions on moral psychology and in those concerning the appropriate social response to the crimes of these individuals. We argue that classical and current experiments concerning the instrumental learning in psychopaths cannot directly support the conclusion that they have impaired instrumental rationality, construed as the ability for transferring the motivation by means-ends reasoning. In fact, we defend the different claim that these experiments (...) appear to show that psychopaths in certain circumstances are not aware of the relevant means for their ends. Moreover, we suggest how further empirical research could help to settle the issue. (shrink)

The “histone code” conjecture of gene regulation is our point of departure for analyzing the interplay between the (quasi)digital script in nucleic acids and proteins on the one hand and the body on the other, between the recorded and organic memory. We argue that the cell’s ability to encode its states into strings of “characters” dramatically enhances the capacity of encoding its experience (organic memory). Finally, we present our concept of interaction between the natural (bodily) world, and the transcendental realm (...) of the digital codes. (shrink)

The article is a summary of recent experimental data on anchoring heuristic and models that seek to explain it. Anchoring heuristic represents one of the mechanisms of decision making in situations of limited information or time, by using a comparison standard called – an anchor. Given the supposed wide usage of this heuristic, authors explore the unconscious character of the heuristic and ways of making its biasing effects less prominent. Apart from the standard experimental design in which anchor is directly (...) connected to the judgment in question, evidence shows that people can be anchored indirectly, even when the anchor is perceived unconsciously. Newest data show that anchoring effect should be explained by two distinct processes. In the concluding remarks, authors consider broader implications of anchoring for the field of social cognition.U članku se opisuju noviji eksperimentalni nalazi vezani uz heuristiku sidrenja kao i modeli koji ih objašnjavaju. Heuristika sidrenja označava jedan od načina na koji ljudi donose odluke u nedostatku informacija i/ili vremena, a podrazumijeva korištenje standarda usporedbe kako bi se došlo do željene procjene. S obzirom na pretpostavljenu široku upotrebu ove heuristike, u članku se istražuju teoretska objašnjenja, razjašnjavaju razlozi zbog kojih je utjecaj te heuristike nedostupan svijesti te kako umanjiti njome izazvanu pristranost u razmišljanju. Osim standardnog nacrta kojim se ispituje ovaj fenomen opisani su i dokazi prema kojima sidro može vršiti svoj utjecaj i kad se ne dovodi u direktnu vezu s procjenom, čak i kada je percipirano nesvjesnim putem. Najnoviji skup istraživanja pak pokazuje da se heuristika sidrenja, prvotno zamišljena kao jedinstveni mehanizam, zapravo može podijeliti na dva bitno različita procesa. Zaključno se razmatraju kakve bi implikacije ovaj razvoj u istraživanjima mogao imati za područje socijalne kognicije općenito. (shrink)

This paper examines the social theory of Lester Frank Ward, one of the most significant representatives of early American social theory, with particular attention to his conception of the state, which can be described as Hegelian. The first part of the paper gives a brief overview of early American social theory: its basic features, the issues that were the focus of attention during this period in the development of sociology in the US, and its most significant representatives. The basic features (...) of Ward’s social theory are then presented and examined in more detail. It is pointed out that it is: conceptual and essentially based on the natural sciences; based on the distinction between pure and applied sociology; systematic; supportive of progressive and pro-social reforms. It was directed against the individualist tradition. His theory was based on the belief that the human mind can direct social progress and that the order based on social inequalities, which is a product of the laissez-faire doctrine, cannot guarantee freedom and prosperity. The fundamental institution capable of doing so is the state. Therefore, the central part of this paper is devoted to his conception of the state and makes a comparison with Hegel’s theory of the ethical state contained in Hegel’s philosophy of objective spirit – philosophy of law and philosophy of history. It concludes by pointing out that Ward’s theory indicated the general direction of development of social circumstances towards the era of collectivism, and was also atypical of American social theory in some of its features. Neste artigo, examinaremos a noção de juízo sensível, isto é, o aspecto judicativo que se pode encontrar nos atos da sensação, aspecto esse irredutível ao juízo intelectual. Usaremos como fio condutor uma comparação e contraste entre esse aspecto judicativo e aquele que se encontra na segunda operação do intelecto. Mostraremos que o sentido julga na medida em que reflete parcialmente sobre si mesmo, de modo proporcional àquele em que ocorre uma reflexão completa no complexo predicativo. Esses diferentes tipos de reflexão (...) determinam as diferentes maneiras pelas quais se diz que o intelecto é verdadeiro e que os sentidos são verdadeiros. Com isso, verificaremos que o juízo sensível é indissociável da apreensão sensível na medida em que é constitutivo da própria natureza cognitiva dos sentidos, pois é a fonte do que se pode chamar uma certa consciência sensível. The emergence of novelty in the realm of the living remains, despite the long tradition of evolutionary biology, unwelcome, calling for explanation by old, established knowledge. The prevailing neodarwinian evolutionary paradigm approaches living beings as passive outcomes of external (and extraneous, hence “blind”) formative forces. Many teachings opposing Darwinism also take the existence of eternal, immutable and external laws as a necessary prerequisite. Ironically enough, authors who oppose Darwinian theory, and admit that living beings possess a “self”, often accentuate internal, (...) ideal and eternal harmony,which is incompatible with historical changes; moreover such harmony is again imposed by external, atemporal “laws”. I describe here a third approach embodied by the names of two unrelated scholars, Stuart Kauffman (biology, physics) and Juri Lotman (semiotics, culturology). Their approach suggests thatthe evolution of organisms, minds, cultures — is a continuous negotiation (semiosis) of ‘laws’, driving to ever broader spaces of freedom and constantly larger autonomy of existence.
