John Hill Burton, que o publicou pela primeira vez, em 1846, considera que Hume o teria escrito em 1727, logo após deixar o Edimburgh College. J. Y. T. Têm sido frequentes, na história recente do Brasil, os casos de interferência da religião em discussões públicas acerca de temas morais e, também, em decisões políticas. Isso frequentemente implica decisões polêmicas em temas que vêm recebendo cada vez mais atenção. Neste trabalho, teceremos alguns comentários sobre essa situação, tendo por ponto de partida a filosofia de David Hume.

O ficcionalismo, geralmente classificado como um tipo de nominalismo, apresenta como perspectiva precípua a tese de que os entes matemáticos são ficções. Para o ficcionalista, o discurso matemático é desprovido de conteúdo. Hartry Field, que é o principal defensor dessa concepção ontológica da matemática, contesta, em Science Without Numbers, a utilização de entes matemáticos na redação de teorias da física, alegando que a defesa mais plausível do realismo ontológico matemático é o argumento da indispensabilidade de Quine-Putnam. O ficcionalismo defendido por (...) Field nos permite, de acordo com Shapiro, classificá-lo no grupo filosofia-primeiro, ou seja, entre os filósofos que defendem que a filosofia deve ser responsável por legislar a respeito da prática matemática. Dessa forma, podemos considerar Field um revisionista epistemológico. Como se sabe, a dependência da ciência moderna em relação ao discurso matemático coloca a tese ficcionalista em xeque. Ainda assim, se partirmos dos pressupostos filosóficos da vertente formalista da filosofia da matemática, que concebe a matemática como constituída de um conjunto de regras sem significado que podem ser manipuladas de maneira puramente sintática, poderemos traçar importantes analogias entre matemática e ficção, tal como também entre metamatemática e metaficção. Para um formalista simpático à tese ficcionalista, o estatuto ontológico da matemática é semelhante ao das regras de um jogo de xadrez. (shrink)

Antonio Gramsci was an Italian Marxist thinker whose radical ideas on how to build an alternative world from below remain vigorously relevant today. Gramsci’s philosophy of praxis critically dissects the institutions of modern liberal democracy to reveal what is perhaps its deepest secret: it is the most successful political system in modernity at preserving an objective condition of domination while transforming it into a subjective conviction of freedom. Based on a careful reading of Gramsci's The Prison Notebooks, Marco (...) class='Hi'>Fonseca shows hegemony as more than leadership of elites over subaltern majorities based on "consent". Following Gramsci’s critique of citizenship, civil society and democracy, including the current project of neoliberal "democracy promotion" particularly in the Global South, he discloses a hidden process of hegemony that generates the preconditions for consent and, thus, successful domination. As the struggles from Zapatismo to Chavismo and from the Arab Springs to Spain’s Podemos show, liberation is not possible without counter-hegemony. This book will be of interest to activist scholars engaged in the study of Marxism, Gramsci, political philosophy, and contemporary debates about the renewal of Marxist thought and the relevance of revolution and Communism for the twenty-first century. O trabalho analisou as propostas legislativas do novo marco legal do setor mineral de 2013 a 2020 para descrever os seus avanços, retrocessos e tendências. No âmbito da vertente jurídico-descritiva de pesquisa, o estudo tem caráter diagnóstico, razão pela qual procedeu-se ao levantamento e análise de dados primários e secundários sobre o assunto sob a ótica da legística. Mesmo tendo sido aprovadas legislações sobre o tema, o novo marco legal do setor mineral não foi editado. Como tendência, observou-se (...) que os novos PLs apresentados para votação referem-se à questão socioambiental da mineração, que fará parte dos debates do PL 5807/2013. (shrink)

O presente trabalho analisa a crise da legalidade sobre os aspectos da falência da legitimidade do Estado e da crise do Estado de Direito. Os poderes estabelecidos carecem de representatividade junto à população, que não credita mais à lei um meio de expressão da justiça. A hipótese averiguada demonstra que os pressupostos e técnicas da Legística possuem meios para o restabelecimento da credibilidade da lei no processo legislativo. Utilizou-se o método jurídico-dedutivo na pesquisa bibliográfica, com marco teórico na teoria (...) do Estado de Direito, de Jacques Chevallier e na Legística, que visa impulsionar a produção eficiente e eficaz da norma jurídica. Resumo:É pretendido, neste pequeno texto, mostrar como Leibniz se insere de modo bem peculiar na tradicional discussão filosófica acerca da liberdade do agente num mundo governado pelo princípio de razão suficiente. A questão posta por Arnauld, em carta de 13 de março de 1686, além de forçar Leibniz a dar esclarecimentos sobre a solução que adotou, também é importante por carregar certos resquícios do modo pelo qual Aristóteles abordou este tema. Também deve ser notado que, apesar da ruptura que a (...) solução leibniziana faz com a tradição aristotélica, vários outros pontos da filosofia de Aristóteles são aceitos para a construção e resolução do problema. La metafisica di tradizione aristotelica e scolastica, lungo il corso del XVI secolo, ha vissuto un periodo di grande approfondimento. In questo lasso di tempo gli autori di quella che poi sarebbe stata definita "Seconda Scolastica" avanzarono soluzioni nuove, seppure presentate come tradizionali, alle questioni che nei secoli precedenti avevano costituito l'impalcatura dell'intero aristotelismo. In particolare, fu il tentativo dei primi Dottori della Compagnia di Gesù di rendere "moderna", e quindi adeguata ai tempi, la tradizione aristotelica, quello che nei secoli (...) a seguire avrebbe manifestato maggiore pervasività. All'alba della storia dell'Ordine Toledo, Perera e Fonseca con i commenti alle opere dello Stagirita, ma anche con l'organizzazione di un nuovo metodo di docenza e con la stesura di veri e propri manuali di studio, diedero vita ad un vero e proprio paradigma che avrebbe coinvolto tutte le espressioni culturali possibili dalla letteratura, all'arte fino al teatro. The bibliographical history offers an interesting point of view for a better understanding of the rise and development of ontology, as an autonomous discipline, in early modern thought. After Luther’s interdict, the metaphysics was neglected in many protestant academies and excluded from the disciplinary classifications (§§ 1-2). The return of metaphysics, at the end of the 16thcentury, coincided, in many cases, with the affirmation of the new scholastic paradigm of ontology (§ 3). An illustrious precedent of this paradigm was constituted (...) by the Jesuit Francisco Suárez and his Disputationes metaphysicae (§ 5). The Jesuit models - not only that by Suárez, but also those by Benet Perera and Pedro da Fonseca - represented the standard on which Calvinists and Lutherans built their own metaphysics in an ontological way. This paper provides a conspicuous number of case studies in which the passage from metaphysics to ontology becomes definitively clear: this debate takes place throughout the first handbooks, treatises, magisterial and doctoral disputations (§ 6) proposed by the Calvinist and Lutheran authors. The aim of this paper is to account for the (metaphorical) movement of the property of being present (or presentness) within the so-called Moving Spotlight Theory (MST). I will be leveraging the key argument by Emanuele Severino’s masterpiece, 'La Gloria' (2001), according to which it is impossible that a (maximal consistent) state of affairs begins to appear and lasts forever in our experience. After a brief overview of the MST’s main tenets (§1.1), I argue that Severino’s ontology might be interpreted (...) as a sort of MST (§1.2), following the hint by Federico Perelda (2017). Thereafter, I briefly recall Severino’s original argument in his own jargon, also proposing English lexical and conceptual translations of the main Italian phrases (§1.3). Then, I propose both a semi-formalization of Severino’s argument (§2.1) and a full formalization by means of temporal logic (§2.2). Finally, I assess all the three versions of the argument, concluding that my formalization might account for the movement of presentness in a non-metaphorical way (§2.3). (shrink)

This article offers a reading of internet-based activism or ‘hacktivism’ as a phenomenon that cannot be confined to the instrumental use of information technologies. It focuses on a subset of hacktivism – the distributed-denial-of-service (DDoS) attack for political ends – that aims at making an internet host unavailable to its intended users. Since the early 2000s these attacks have been increasingly conducted by means of botnets – networks of infected computers that send bogus requests to a target website without the (...) consent of their users. The capacity of botnets to engender a more-than-human politics is analyzed from two distinct theoretical angles. First, drawing from Deleuze and Guattari, the hacktivist DDoS is discussed as an assemblage of signifying and a-signifying components, voluntary and involuntary actions. Second, Gilbert Simondon’s notions of transindividuation and transduction allow for a conceptualization of hacktivism as a sociotechnical assemblage with a high degree of indetermination. (shrink)

This paper presents two studies on the development and validation of a ten-item scale of epistemic vice and the relationship between epistemic vice and misinformation and fake news. Epistemic vices have been defined as character traits that interfere with acquiring, maintaining, and transmitting knowledge. Examples of epistemic vice are gullibility and indifference to knowledge. It has been hypothesized that epistemically vicious people are especially susceptible to misinformation and conspiracy theories. We conducted one exploratory and one confirmatory observational survey study on (...) Amazon Mechanical Turk among people living in the United States. We show that two psychological traits underlie the range of epistemic vices that we investigated: indifference to truth and rigidity. Indifference manifests itself in a lack of motivation to find the truth. Rigidity manifests itself in being insensitive to evidence. We develop a scale to measure epistemic vice with the subscales indifference and rigidity. The Epistemic Vice Scale is internally consistent; has good convergent, divergent, and discriminant validity; and is strongly associated with the endorsement of misinformation and conspiracy theories. Epistemic vice explains additional variance in the endorsement of misinformation and conspiracy theories over and above demographic and related psychological concepts and shows medium to large effect sizes across outcome measures. We demonstrate that epistemic vice differs from existing psychological constructs, and show that the scale can explain individual differences in dealing with misinformation and conspiracy theories. We conclude that epistemic vice might contribute to “postfactive” ways of thinking. (shrink)

This paper compares metaphysical nihilism, as it occurs in analytic metaphysics, with the solution to the puzzle of nothing by the Italian philosopher Emanuele Severino.

In contemporary analytic philosophy metaphysical nihilism is the thesis according to which there might be nothing, i.e. a possible world with no concreteobjects in it, but that can contain abstract objects. After summarizing the set of premises from which analytic metaphysics deals with nothing, I propose a set of premises that could fit continental metaphysics. Then I propose a new set of premises for the question of nothing that derives from a synthesis of the two above mentioned sets. By means (...) of this new set, I try to show that nothing as a possible world with no objects at all is not a self-contradictory entity and I propose an argument for proving that an empty possible world exists. One crucial part of the Aristotle´s discussion of the principle of non-contradiction in Metaphysics IV 4 is his notion of semainein hen, which must be carefully distinguished from the closely connected notion of semainein kath´ henos. The Aristotelian proof is located at 1006b28-34 and it is argued that it does not suppose any bit of essentialism nor does it contain any petitio principii; some improvements are further proposed to the current translations.

A view that emancipates free will by means of quantum indeterminism is frequently rejected based on arguments pointing out its incompatibility with what we know about quantum physics. However, if one carefully examines what classical physical causal determinism and quantum indeterminism are according to physics, it becomes clear what they really imply–and, especially, what they do not imply–for agent-causation theories. Here, we will make necessary conceptual clarifications on some aspects of physical determinism and indeterminism, review some of the major objections (...) against libertarian conjectures, and show that there is no conceptual incompatibility preventing us from taking a ‘quantum-libertarian’ approach to the problem of free will. In particular, we will illustrate the possible role of self-causation (causa sui) as a potential solution to otherwise apparently incompatible or even paradoxical statements concerning free will and quantum indeterminism. This paper focuses on two passages of Aristotle’s Metaphysics, one in Z 3, the other in H1, in which Aristotle seems to assert that the hupokeimenon is said in three ways, as matter, form, and the compound of matter and form. From these two passages it is often said that subjecthood is a criterion for being substance. A consequence of this is that, if form is to be substance, and form is substance, namely first substance, it has to comply with (...) the subject-criterion. This paper challenges this reading, purporting to show that these two passages need not commit Aristotle to the subject-criterion, and that there are good reasons not to commit him to it. (shrink)

Inspired by the literature on extended/scaffolded mind, a debate concerning the contribution of extra-bodily resources to our (extended) emotions is recently gaining traction. Within this debate, inspired by the literature on cognitive artifacts introduces the notion of “affective artifacts”, indicating those objects that exert persistent effects on our feelings, possibly altering our self. However, by focusing on feelings, this notion neglects other facets of emotional episodes. Following Scarnatino’s tripartition between feeling, appraisal, and motivational theories of emotion, I present three varieties (...) of affective artifacts: Feeling, Evaluative and Motivational Artifacts. In some cases of disagreement it seems that neither party is at fault or making a mistake. This phenomenon, so-called faultless disagreement, has recently been invoked as a key motivation for relativist treatments of domains prone to such disagreements. The conceivability of faultless disagreement therefore appears incompatible with traditional realists semantics. This paper examines recent attempts to accommodate faultless disagreement without giving up on realism. We argue that the accommodation is unsatisfactory. However, the examination highlights that “faultless” is multiply ambiguous. (...) Debates on situated affectivity have mainly focused on tools that exert some positive influence on affective experience. Far less attention has been paid to artifacts that interact with the expression of affect, or to those that exert some negative influence. To shed light on that shadowy corner of our affective social lives, I describe the workings of an atypical socio-affective artifact, namely, sunglasses. Drawing on insights from psychology and other social sciences, I construe sunglasses as a social shield that helps (...) us block spontaneous emotional expressions, as well as affecting other social processes that heavily depend on the eye region: gaze direction detection, identity recognition, and the sense of intimacy afforded by eye contact. The paper presents and discusses the Hubble tension with respect to recent results in cosmology. I shall argue that the measurements from the James Webb Space Telescope and TRGB stars calibrations allow us to infer that the estimates of H0 with late universe methods are robust. Building on from robustness analysis, I conclude that the resolution of the tension cannot be expected to come from new systematics, but rather from new physics.

This paper treats of Husserl’s phenomenology of happiness or eudaimonia in five parts. In the first part, we argue that phenomenology of happiness is an important albeit relatively neglected area of research, and we show that Husserl engages in it. In the second part, we examine the relationship between phenomenological ethics and virtue ethics. In the third part, we identify and clarify essential aspects of Husserl’s phenomenology of happiness, namely, the nature of the question concerning happiness and the possibility of (...) a phenomenological answer, the power of the will, the role of vocation, the place of obligation, the significance of habituation, the necessity of selfreflection and self-criticism, the importance of sociability and solidarity, the impact of chance and destiny, and the specter of regret. In the fourth part, we establish the inextricable linkage between Husserl’s metaethics and his metaphysics. In the fi ft h part, we provide a provisional exploration of his conception of the connection between happiness and blessedness. We acknowledge that there is an extensive literature on Husserl’s phenomenological ethics, and our study has benefitted greatly from it, but we also suggest that our holistic approach critically clarifies his description of happiness, virtue, and blessedness by fully recognizing that his phenomenological metaethics is embedded in his phenomenological metaphysics. We compare a number of influential approaches to human communication with the aim of understanding what it means for interpersonal communication to be a form of social action. In particular, we discuss the large-scale social normativity advocated by speech act theory, the view of communication as small-scale social interaction proper of Gricean approaches, and the intimate connection between communication and cooperation defended by Tomasello. We then argue in favor of a small-scale view of communication capable of accounting for the normative (...) effects of communicative acts; to this purpose, we introduce the concept of interpersonal normativity and analyze its relationship with communicative intentions. The conventional interpretation that Pierre Duhem condemned outright any type of thought experiment in Ernst Mach’s sense should be, at least in large part, rejected. Although Duhem placed particular emphasis on the perils of thought experiments that Mach had overlooked or at least underestimated, he retained the core idea of Mach’s theory, according to which thought experiments cannot break free from the ultimate authority of real-world experiments. This similarity between Duhem’s and Mach’s views about thought experiments is not the only (...) one. Just as there was in Duhem’s criticism of “expériences fictives” a tendency leading him to give voice to one of Mach’s basic empiricist claims, so also there was in Mach’s interpretation of thought experiments a tendency in the direction of Duhem’s conventionalism. If Mach’s and Duhem’s conceptions of thought experiments are compared, there results an importantly similar, although not identical, tension that should properly be taken into account in the more general comparison between Mach and Duhem. Many approaches to quantum gravity -the theory that should account for quantum and gravitational phenomena under the same theoretical umbrella- seem to point at some form of spacetime emergence, i.e., the fact that spacetime is not a fundamental entity of our physical world. This tenet has sparked many philosophical discussions: from the so-called empirical incoherence problem to different accounts of emergence and mechanisms thereof. In this contribution, I focus on the partial order relation of causal set theory and argue that (...) causation can be characterized as an a-temporal constraint over the kinematic space defined by the theory. The relation constrains the growth of a new element/event with respect to the other elements/events of a given set. Therefrom, the flow of time emerges from the collection of the possible growths of the given set, where each possibility is characterized by a classical probability assigned by the dynamics of the theory. Humans have been using fire for hundreds of millennia, creating an ancestral expansion toward the nocturnal niche. The new adaptive challenges faced at night were recurrent enough to amplify existing psychological variation in our species. Night-time is dangerous and mysterious, so it selects for individuals with higher tendencies for paranoia, risk-taking, and sociability. During night-time, individuals are generally tired and show decreased self-control and increased impulsive behaviors. The lower visibility during night-time favors the partial concealment of identity and opens more (...) opportunities for disinhibition of self-interested behaviors. Indeed, individuals with an evening-oriented chronotype are more paranoid, risk-taking, extraverted, impulsive, promiscuous, and have higher antisocial personality traits. However, under some circumstances, such as respiratory pandemics, the psychobehavioral traits favored by the nocturnal niche might be counter-productive, increasing contagion rates of a disease that can evade the behavioral immune system because its disease cues are often nonexistent or mild. The eveningness epidemiological liability hypothesis presented here suggests that during the COVID-19 pandemic, the evening-oriented psychobehavioral profile can have collectively harmful consequences: there is a clash of core tendencies between the nocturnal chronotype and the recent viral transmission-mitigating safety guidelines and rules. The pandemic safety protocols disrupt much normal social activity, particularly at night when making new social contacts is desired. The SARS-CoV-2 virus is contagious even in presymptomatic and asymptomatic individuals, which enables it to mostly evade our evolved contagious disease avoidance mechanisms. A growing body of research has indirectly shown that individual traits interfering with social distancing and anti-contagion measures are related to those of the nocturnal chronotype. Indeed, some of the social contexts that have been identified as superspreading events occur at night, such as in restaurants, bars, and nightclubs. Furthermore, nocturnal environmental conditions favor the survival of the SARS-CoV-2 virus much longer than daytime conditions. We compare the eveningness epidemiological liability hypothesis with other factors related to non-compliance with pandemic safety protocols, namely sex, age, and life history. Although there is not yet a direct link between the nocturnal chronotype and non-compliance with pandemic safety protocols, security measures and future empirical research should take this crucial evolutionary mismatch and adaptive metaproblem into account, and focus on how to avoid nocturnal individuals becoming superspreaders, offering secure alternatives for nocturnal social activities. The paper considers the absorber theory of radiation by (Wheeler and Feynman 1945) and (Wheeler and Feynman 1949) and advances the idea that the theory is grounded on the philosophical intuition of overall processes. Such intuition consists of having to consider advanced and retarded radiation as well as the interaction between absorbers and emitter. I discuss the discrepancy between microdynamic time-symmetry and the asymmetry of the experimental evidences. In doing so, I consider (Price, 1991)'s reformulation of the theory and argue (...) that it overlooks the philosophical intuition. I then compare the overall process idea with some accounts of holism and ultimately suggest that it also played an important role in Feynman's later works. (shrink)

Vice epistemology studies the qualities of individuals and collectives that undermine the creation, sharing, and storing of knowledge. There is no settled understanding of which epistemic vices exist at the collective level. Yet understanding which collective epistemic vices exist is important, both to facilitate research on the antecedents and effects of collective epistemic vice, and to advance philosophical discussions such as whether some collective epistemic vices are genuinely collective. I propose an empirical approach to identifying epistemic vices in corporations, analyzing (...) a large dataset of online employee reviews. The approach has parallels to the methodology for identifying the big-five personality traits. It surfaces epistemic vices that are attributed to corporations by its own members and reduces the number of vices to the minimum required to describe differences between corporations. This approach yields a new taxonomy of epistemic vices for corporations. While two vices identified have close correlates in the existing literature, four others have not been identified at all or only in aspects. Two of these vices are ‘genuinely’ collective in the sense that they can only be attributed to collectives. (shrink)
