There are some arguments supporting the pessimistic meta-induction, coming from the direction of quantum theory (A. Kukla and J. Walmsley), from the direction of Laudan’s list with successful but false theories, and from the specific direction of the phlogiston theory (whom Kukla Walmsley, and S. Psillos consider to be false). Against these arguments we believe we can successfully oppose, in the first case the interactive quantum realism of I. Niiniluoto, in the second case the realism of the theoretical theoretical constituents (...) responsible for the empirical success of the theories of S. Psillos, and in the third case the analysis of the phlogiston theory done by V. Verronen, R. Vihalemm and E. McMullin (who suggested that this theory was simultaneously insufficiently mature and approximately true). Our conclusion does not necessary prove that the perspective of the scientific realism is true, but rather that the pessimistic meta-induction attack against it proves to be unconvincing. (shrink)

The article discusses some facts of C. G. Jung's direct appeal to the ideas of I. Kant. The main part of the article is preceded by statistical data on the mention of various philosophers in the Collected Works of Jung. It is not surprising that Kant leads in the number of links to his ideas or personality in Jung’s heritage. Then I show examples of the mention of Kant in Jung’s correspondence, which allow understand the fundamental philosophical background of analytical (...) psychology better. For this purpose in particular I give excerpts from which it becomes clear that the creator of the analytical psychology, unlike his predecessor C. G. Carus, never hypostasized the collective unconscious, because Jung believed that this is a thing in itself. Also by correspondence it is clear that Jung grasped Kant’s criticism of the rational proofs of existence of God well. Then I point out how apriorism is manifested in analytical psychology. Also I explain briefly how to understand that archetypes and instincts are necessary a priori conditions for the formation of psychic experience. In conclusion, the reasons are given for which Kant and Jung rejected the fundamental possibility of the existence of psychology in the status of strict science. -/- В статье рассматриваются некоторые факты прямого обращения К. Crosslinguistically, the same modal words can be used to express a wide range of interpretations. This crosslinguistic trend supports a Kratzerian analysis, where each modal has a core lexical entry and where the difference between an epistemic and a root interpretation is contextually determined. A long-standing problem for such a unified account is the equally robust crosslinguistic correlation between a modal’s interpretation and its syntactic behavior: epistemics scope high (in particular higher than tense and aspect) and roots low, a fact (...) which has led to proposals that hardwire different syntactic positions for epistemics and roots (cf. Cinque’s hierarchy). This paper argues that the range of interpretations a modal receives is even more restricted: a modal must be keyed to certain time-individual pairs, but not others. I show that this can be captured straightforwardly by minimally modifying the Kratzerian account: modals are relative to an event—rather than a world—of evaluation, which readily provides a time (the event’s running time) and (an) individual(s) (the event’s participants). I propose that this event relativity of modals can in turn explain the correlation between type of interpretation and syntactic position, without stipulation of an interpretation-specific height for modals. In this article, I critically reassess Iris Marion Young's late works, which centre on the distinction between liability and social connection responsibility. I concur with Young's diagnosis that structural injustices call for a new conception of responsibility, but I reject several core assumptions that underpin her distinction between two models and argue for a different way of conceptualising responsibility to address structural injustices. I show that Young's categorical separation of guilt and responsibility is not supported by the writings of Hannah (...) Arendt, which Young draws on, and that it is also untenable on independent systematic grounds. Furthermore, I argue that several of Young's other criteria fail to clearly demarcate two distinct phenomena. I therefore propose to transcend Young's distinction between two models in favour of a related, but conceptually different distinction between two forms of responsibility: interactional and structural. Embracing this terminology facilitates the conceptualisation of the general features of responsibility that are shared by both forms, including their retrospective and prospective time-direction and their applicability to individual, joint and group agency. The distinction between interactional and structural responsibility also yields a more compelling general account of the role of background structures, and of blame within ascriptions of political responsibility. This paper discusses the interaction of aspect and modality, and focuses on the puzzling implicative effect that arises when perfective aspect appears on certain modals: perfective somehow seems to force the proposition expressed by the complement of the modal to hold in the actual world, and not merely in some possible world. I show that this puzzling behavior, originally discussed in Bhatt (1999, Covert modality in non-finite contexts) for the ability modal, extends to all modal auxiliaries with a circumstantial modal (...) base (i.e., root modals ), while epistemic interpretations of the same modals are immune to the effect. I propose that implicative readings are contingent on the relative position of the modal w.r.t. aspect: when aspect scopes over the modal (as I argue is the case for root modals), it forces an actual event, thereby yielding an implicative reading. When a modal element scopes over aspect, no actual event is forced. This happens (i) with epistemics, which structurally appear above tense and aspect; (ii) with imperfective on a root modal: imperfective brings in an additional layer of modality, itself responsible for removing the necessity for an actual event. This proposal enables us to solve the puzzle while maintaining a standardized semantics for aspects and modals. (shrink)

How do children learn the meanings of propositional attitude verbs? We argue that children use information contained in both syntactic distribution and pragmatic function to zero in on the appropriate meanings. Specifically, we identify a potentially universal link between semantic subclasses of attitude verbs, their syntactic distribution and the kinds of indirect speech acts they can be used to perform. As a result, children can use the syntax as evidence about the meaning, which in turn constrains the kinds of pragmatic (...) enrichments they do and do not make in understanding these verbs in conversation. In this conceptual paper, we propose that both skill set development and mindset development would be desirable dimensions of negotiation training. The second dimension has received little attention thus far, but negotiation mindsets, i.e., the psychological orientations by which people approach negotiations, are likely to have a considerable influence on the outcome of negotiations. Referring to empirical and conceptual mindset studies from outside the negotiation field, we argue that developing mindsets can leverage the effectiveness of skills and knowledge, increase learning (...) transfer, and lead to long-term behavioral changes. We introduce an integrative negotiation mindset that comprises three inclinations which complement each other: a collaborative, a curious, and a creative one. We also discuss activities that help people to develop and enhance this mindset both in and out of the classroom. Our general claim is that by moving beyond the activities of conventional negotiation training, which focuses on skills and knowledge, mindset-oriented negotiation training can increase training effectiveness and enable participants to more often reach what we define as sustainable integrative agreements. In this article, I set out Suárez's conception of the demon's obstinacy. For Suárez, the demons’ obstinacy is a divine punishment. It is the result of the free and awful choice to turn away from God that the demons have decided to make, the main consequence of which is the loss of the freedom to will and to do the good. Taking up Aquinas’s conception, Suárez considers that the demonic nature is irredeemably corrupt and obstinate in evil. Demons are provided (...) only with a miserable freedom, consisting of the possibility to choose between different evils. Perpetually sinful and eternally constrained to remain so, they are condemned to wretchedness, to complacency in evil, and to the unremitting torments of hell. (shrink)

Consumer boycotts have become a frequent form of social protest in the digital age. The corporate malpractices motivating them are varied, including environmental pollution, lack of minimum labour standards, severe mistreatment of animals, lobbying and misinformation campaigns, collaboration or complicity with illegitimate political regimes, and systematic tax evasion and tax fraud. In this article, I argue that organised consumer boycotts should be regarded as a legitimate and purposeful instrument for structural change, provided they conform to a number of normative criteria. (...) In order to show this, the practice and empirical context of consumer boycotts are first outlined. I then lay out and refute three general objections to this practice. Although each of these objections fails, their discussion generates insights concerning the normative standards with which boycotters must comply if they want their campaigns to be both legitimate and successful. These normative criteria are detailed along the lines of two guiding principles, proportionality and transparency. In the final step, I elaborate on structural change as the deeper purpose of consumer boycotts. (shrink)

La pena natural es una situación paradójica que se puede presentar cuando el autor de un delito, al cometerlo o a causa de éste, ha sufrido un daño igual o mayor al que padecería si el juez de la causa le aplicara la pena estatal prevista para tal conducta. Se da con frecuencia al juzgar ciertos accidentes viales, cuando el acusado ya carga el peso de ser quien, por imprudencia, mató a su pareja o familiar cercano, por ejemplo. Pero ¿en (...) qué situaciones y cómo cabe recurrir a la pena natural? En esta investigación, Manuel Serrano explora las diversas aristas y posturas en pugna que atraviesan este tema, donde se cruzan cuestiones como la idea de la “culpa compensada”, la prohibición de aplicar castigo doble por un mismo hecho (non bis in idem) y la clemencia judicial. El autor desmonta la estructura conceptual de la pena natural, estudia jurisprudencia argentina y recorre producciones teóricas de juristas que se han preocupado por este asunto complejo, profundo y poco abordado del derecho penal. This study intends to show that the question whether faith can be justified without proofs can be resolved by importing ideas from Kierkegaard’s and Plantinga’s affirmative take on the matter. There is a deep similarity between the way they understand belief in God and belief in Christianity: for both the first is considered universal human knowledge and the second seen as a gift from God. Against the charge that such an understanding is irrational Plantinga offers an externalist epistemological model which (...) allows those beliefs to be warranted. The authors also share the modern idea that there is an objective truth, combining it with the postmodern stance that no method exists which would guarantee access to it. A specific contribution on Kierkegaard’s part to the understanding of the rationality of transitions toward a Christian stage of existence is to show in detail the way in which such transitions are mediated through inwardnes - a perspective akin to Michael Polanyi’s scientific epistemology. One can see in both authors not only a deep commonality of ideas, but also a remarkable way in which their understandings augment each other. Whereas Plantinga’s inquiry contributes to the rational plausibility of a “Justified Faith without Reasons” project, Kierkegaard’s venture balances such a logical-analytic effort with a deep existential inquiry. Accusations of hypocrisy are a recurring theme in the public debate on climate change, but their significance remains poorly understood. Different motivations are associated with this accusation, which is leveled by proponents and opponents of climate action. In this article, I undertake a systematic assessment of climate hypocrisy, with a focus on lifestyle and political hypocrisy. I contextualize the corresponding accusation, introduce criteria for the conceptual analysis of climate hypocrisy, and develop an evaluative framework that allows us to determine its (...) moral significance. I argue that different instances of climate hypocrisy are problematic to different degrees, depending on how detrimental they are to an agent's attainment of environmental integrity. The resulting framework helps clear the confusion caused by disinformation campaigners, by distinguishing objectionable uses of the climate hypocrisy charge from constructive ones motivated by genuine concern for integrity. Among others, the recent work of Janine Idziak presents Andrew of Neufchateau (†1400) as a fervent advocate of “divine command ethics,” a promoter of radical voluntarism, according to which moral values depend solely on the divine will. One example that illustrates this theory is the “hatred of God” (odium Dei ), often discussed in the fourteenth century. Since moral values depend on the divine will, it can be morally good to hate God if that is his command. Andrew has been (...) seen and is still seen today as a supporter of this view. Trait Selective Abortions (TSA) have come under critique as a medical practice that presents potential disabled infants as burdens and lacking the potential for meaningful lives. This paper, using the author’s background as a disabled person, contends that the philosophy underpinning TSAs reflects liberal society’s lack of a theory of needs. The author argues for a care ethics based approach informed by disability analyses to engage with TSAs.

This paper is devoted to the study of some subvarieties of the variety Q of Q-Heyting algebras, that is, Heyting algebras with a quantifier. In particular, a deeper investigation is carried out in the variety Q subscript 3 of three-valued Q-Heyting algebras to show that the structure of the lattice of subvarieties of Q is far more complicated that the lattice of subvarieties of Heyting algebras. The international #MeToo campaign against sexual harassment constitutes the most prominent contemporary campaign against sexual harassment worldwide. It exposed the issue by undermining the ‘culture of silence’ prevailing in several contexts, including political institutions. This article analyses one specific variant of #MeToo, the campaign MeTooEP that emerged in the European Parliament. MeTooEP is unique in many ways: it was the first collective action against sexual harassment in parliaments emerging in the #MeToo aftermath and it was the first collective action within (...) the EP led by members of the staff, which eventually drove some internal policy changes. Using a unique, large interview dataset, the analysis shows how the actors behind MeTooEP were crucial in shaping the campaign. Their knowledge of institutional rules, practices and daily presence in the EP facilitated their advocacy and transformed the Parliament into an enabling platform for their actions. With the help of Feminist Institutionalism, the analysis demonstrates how the formal and informal institutional EP bodies with their rules and regulations shaped MeTooEP in ways that constrained and empowered it. A satisfactory construal of the subject matter of free will debates must allow for disagreements along two axes. First, it must allow for the possibility of higher order disagreements, or disagreements about what concepts, phenomena, or practices an account of free will is supposed to capture or explain. Second, it must allow for the fact of variation in the extent to which theories are bound by antecedent pre-philosophical thought, talk, and practices. A promising way of accommodating these two thoughts is (...) to treat free will in broadly functionalist terms. On the account proposed here, free will is a power that makes sense of everyday responsibility practices. This construal is not widely shared, but it allows for the possibility that we might have false beliefs about the nature of free will, while still making sense of central philosophical debates about free will. The variety O2 of double Ockham algebras consists of the algebras (A ∨, ∧, f,g 0,1) of type (2,2,1,1,0,0) where (A; ∨, ∧,f, 0,1) and (A; ∨, ∧,g 0,1) are Ockham algebras. In [16], M. Sequeira introduced several subvarieties of O2. In this paper we give a construction of free double Ockham algebras on a partially ordered set. We also describe free objects for the subvarieties of O2 considered in [16].

Firms engage in corporate social responsibility (CSR) because they consider that some kind of competitive advantage accrues to them. We contend that resource-based perspectives (RBP) are useful to understand why firms engage in CSR activities and disclosure. From a resource-based perspective CSR is seen as providing internal or external benefits, or both. Investments in socially responsible activities may have internal benefits by helping a firm to develop new resources and capabilities which are related namely to know-how and corporate culture. In (...) effect, investing in social responsibility activities and disclosure has important consequences on the creation or depletion of fundamental intangible resources, namely those associated with employees. The external benefits of CSR are related to its effect on corporate reputation. Corporate reputation can be understood as a fundamental intangible resource which can be created or depleted as a consequence of the decisions to engage or not in social responsibility activities and disclosure. Firms with good social responsibility reputation may improve relations with external actors. They may also attract better employees or increase current employees’ motivation, morale, commitment and loyalty to the firm. This article contributes to the understanding of why CSR may be seen as having strategic value for firms and how RBP can be used in such endeavour. (shrink)

The co-evolutionary concept of Three-modal stable evolutionary strategy of Homo sapiens is developed. The concept based on the principle of evolutionary complementarity of anthropogenesis: value of evolutionary risk and evolutionary path of human evolution are defined by descriptive (evolutionary efficiency) and creative-teleological (evolutionary correctly) parameters simultaneously, that cannot be instrumental reduced to others ones. Resulting volume of both parameters define the trends of biological, social, cultural and techno-rationalistic human evolution by two gear mechanism ˗ gene-cultural co-evolution and techno- humanitarian balance. (...) The resultant each of them can estimated by the ratio of socio-psychological predispositions of humanization/dehumanization in mentality. Explanatory model and methodology of evaluation of creatively teleological evolutionary risk component of NBIC technological complex is proposed. Integral part of the model is evolutionary semantics (time-varying semantic code, the compliance of the biological, socio-cultural and techno-rationalist adaptive modules of human stable evolutionary strategy). El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

Nelas assume-se uma matriz filosófica que valoriza, por um lado, o modo como as ideias se transformam em articulação com os seus efeitos e, por outro, como elas são solidárias com os contextos históricos.

The goal of the paper is to offer an explanation why Frege has changed his Begriffsschrift account of identity to the one presented in Über Sinn und Bedeutung.The main claim of the paper is that in order to better understand Frege’s motivation for the introduction of his distinction between sense and reference, which marks his change of views, one should place this change in its original setting, namely the broader framework of Frege’s fundamental preoccupations with the foundations of arithmetic and (...) logic. The Fregean thesis that mathematics is contentful, and its defense against formalism and psychologism, provides us an valuable interpretative key. Thus, Fregean senses are not just the mere outcome of some profound reflections on language, rather they play an important role in the articulation of Frege’s program in the foundations of arithmetic. In my presentation I understand anger as an emotion that, in addition to its relationship to time, is also subject to cultural rules and is therefore related to probability and predictability. With the use of selected references from the theory of emotions (ranging from antiquity to the present day) I identify several consistent fundamental assumptions about this emotion and reconstruct a discourse of “just” anger. Viewed from the perspective of such extra-literary concepts of anger (particularly Thomas Aquinas' ‘De passionibus animae’) (...) Willehalm's outbursts of anger at the French court can be seen not only as an “illegitimate”, universally condemned act, through which the margrave unnecessarily puts at risk his legitimate claim to the king's support; equally, the very forbearance and expressions of solidarity which he is successively shown after his intemperate behaviour in Munleun can also be reinterpreted in light of the Aristotelian-Thomistic model of anger. Jeutner argues that the reasonable person is, at heart, an empathetic perspective-taking device, by tracing the standard of the reasonable person across time, legal fields and countries. Beginning with a review of imaginary legal figures in the legal systems of ancient Egypt, Greece, and Rome, the book explains why the common law's reasonable person emerged amidst the British industrialisation under the influence of Scottish Enlightenment thinking. Following the figure into colonial courts, onto battlefields and into self-driving cars, the book contends (...) that the reasonable person invites judges, jury-members, and lawyers to take another person's perspective when assessing their own or another person's conduct. The perspective of another is taken by means of empathy, by feeling what others might feel in a particular situation. Thus construed, the figure of the reasonable person can help us make more accurate judgments in a diverse world. (shrink)
