Based mainly on research conducted as part of a doctoral thesis (Guimond-Plourde, 2004), this paper introduces an epistemological and methodological framework based on the foundations and characteristics of a qualitative/interpretative approach rooted in hermeneutic phenomenology as conducive to disclosing the meaning that healthy adolescents, aged 15 to 17, attribute to the stress they experience in school and to their coping behaviour. Moving from the empirical to the phenomenal makes it possible to evoke a return to dimensions of meaning which (...) have been set aside or forgotten in the lived experience of stress-coping. By thus bringing stress-coping into focus in a new way, it enables us to glimpse the phenomenon anew, with the prospect of revealing what we haven't yet appreciated. A dual philosophical approach is outlined: a phenomenological perspective apprehends stress-coping as an existential phenomenon, while the hermeneutic focus is on interpreting the links between lived experience and meaning. The kind of knowledge generated by means of this approach offers a new way of understanding that focuses on the unique and personal nature of healthy adolescents' daily life at school and, as such, provides educators with a sensitive account of adolescents' experiences of stress in the school context. Her account of transformative experience holds that part of the value of living authentically is to experience our lives and preferences in whatever ways they evolve.

Graeme Laurie stepped down from the Chair in Medical Jurisprudence at the University of Edinburgh in 2019. This edited collection pays tribute to his extraordinary contributions to the field. Graeme has often spoken about the importance of 'legacy' in academic work and has forged a remarkable intellectual legacy of his own, notably through his work on genetic privacy, human tissue and information governance, and on the regulatory salience of the concept of liminality. The essays in this volume animate the (...) concept of legacy as lens of analysis for the study and practice of medical jurisprudence. In this light, legacy reveals characteristics of both benefit and burden, as both an encumbrance to and facilitator of the development of law, policy and regulation. Overall, the contributions reconcile the ideas of legacy and responsiveness and show that both dimensions are critical to achieve and sustain the health of medical jurisprudence itself as a dynamic, interdisciplinary and policy-engaged field of thinking. Across three studies, the authors examine the interactive effects of moral identity and the negative reciprocity norm in predicting revenge. The general argument is that moral identity provides the motivational impetus for individuals’ responses, whereas the normative framework that people adopt as a basis for guiding moral action influences the direction of the response. Results indicated that moral identity and the negative reciprocity norm significantly interacted to predict revenge. More specifically, the symbolization dimension of moral identity interacted with the negative (...) reciprocity norm to predict revenge when individuals were the targets of mistreatment, whereas the internalization dimension of moral identity interacted with the negative reciprocity norm to predict revenge when individuals were the observers of mistreatment. Theoretical implications related to the differences between the symbolization and internalization dimensions of moral identity, the importance of examining normative frameworks, and the functionality of revenge are discussed. Drawing on diverse historical cases, this paper describes and examines various aspects of a modality of scientific appraisal which has remained largely unexplored, theory pursuit. Specifically, it addresses the following issues: the epistemic and pragmatic commitments involved in theory pursuit, including how these differ from those characteristic of theory acceptance; how the research interests of scientists enter into their pursuit decisions; some of the strategies for the refinement and extension of a theory's empirical abilities which typify theory pursuit; and the (...) need to distinguish between individual and community rationality in contexts of pursuit. I argue for a property mereology and for mereological bundle theory. I then apply this theory to the one over many problem (universals) and puzzles concerning persistence and material constitution.

This essay will address the ethical issues that have emerged in the first considerations of the newly emerging stem cell technology. Many of us in the field of bioethics were deliberating related issues as we first learned of the new science and confronted the ethical issues it raised. In this essay, I will draw on the work of colleagues who were asked to reflect on early stages of the research as the field debated the issues of consent, moral status, use (...) of animal tissues, abortion, use of fetal tissue, and the nature and goals of entrepreneurial research. In this new capacity, ethicists weighed the problem of privacy, the role of justice considerations, and the issues of the marketplace in science. At this point, it is clear that far more issues remain unresolved than are settled, that there is largely unexplored territory ahead, and that the single most important task that faces us as a field is a steady call for ongoing conversation and public debate. Scientists typically do something other than accept or reject their theories, they pursue them. Throughout the greater part of the nineteenth century numerous chemists devoted their research energy and resources to the development of Daltonian theory, declaring themselves willing to make use of the atomic theory in their research but reluctant or unwilling to accept it. When Frankland, for example, declared that he did not want to be considered a “blind believer” in the atomic theory and could not “accept it (...) as true”, but that he had been—and planned to continue—using it “as a useful ladder”, he had arrived at a decision shared by many of his colleagues that while the theory was not acceptable, it was promising and worthy of pursuit.1 And when Van’t Hoff measured the kinetic-molecular theory by its fruits in the 1880’s, he judged that it barely gave the then-current 4% interest rate, and so was an unpromising theory, unworthy of pursuit (van Nelsen 1960. p. 151). I have three general reasons for supporting naturalism. First, by taking naturalism seriously we can keep our philosophies up-to-date with scientific inquiry. Second, naturalism can emancipate us from transcendental pseudo-questions and (...) instead help us to deal with the empirical problems of everyday life. Third, with naturalism, we can free ourselves from a priori theories of morals and aesthetics and thus view the active part that normative and aesthetic concerns play in human praxis. Even if I endorse naturalism, I do not subscribe to scientism. 1 Rather, I submit to a pragmatist view that stresses the role of philosophy (and science) in dealing with the questions of our life practices. To practice medicine and ethics, physicians need wisdom and integrity to integrate scientific knowledge, patient preferences, their own moral commitments, and society's expectations. This work of integration requires a physician to pursue certain goals of care, determine moral priorities, and understand that conscience or integrity require harmony among a person's beliefs, values, reasoning, actions, and identity. But the moral and religious pluralism of contemporary society makes this integration challenging and uncertain. How physicians treat patients will depend on the particular beliefs (...) and values they and other health professionals bring to each instance of shared decision making. This book offers a framework for practical wisdom in medicine that addresses the need for integrity in the life of each health professional. Laurie Shrage attributes much of the long-standing controversy about abortion to Roe v. Wade and to the Supreme Court's controversial regulatory scheme in that 1973 decision. Shrage explores the origins of that scheme but argues for an alternate scheme - therapeutic abortions shorter than six months can protect women's interests and advance important public interests, but that reproductive rights campaigns should also focus on the social and economic conditions that prevent women having access to the abortion services they need. Many models of word recognition assume that processing proceeds sequentially from analysis of form to analysis of meaning. In the context of morphological processing, this implies that morphemes are processed as units of form prior to any influence of their meanings. Some interpret the apparent absence of differences in recognition latencies to targets (SNEAK) in form and semantically similar (sneaky-SNEAK) and in form similar and semantically dissimilar (sneaker-SNEAK) prime contexts at an SOA of 48 ms as consistent with this claim. (...) To determine the time course over which degree of semantic similarity between morphologically structured primes and their targets influences recognition in the forward masked priming variant of the lexical decision paradigm, we compared facilitation for the same targets after semantically similar and dissimilar primes across a range of SOAs. The effect of shared semantics on recognition latency increased linearly with SOA when long SOAs were intermixed (Exp. 1) and latencies were significantly faster after semantically similar than dissimilar primes at homogeneous SOAs of 48 ms (Exp. 2) and 34 ms (Exp. 3). Results limit the scope of form-then-semantics models of recognition and demonstrate that semantics influences even the very early stages of recognition. Finally, once general behavior across trials has been accounted for, we fail to provide evidence for individual differences in morphological processing that can be linked to measures of reading proficiency. This chapter explores how to understand the contributions of experience, especially with respect to the role of cognitive science, in developing and assessing metaphysical theories of reality. Further, it develops a methodological basis for the idea that, independently of work in experimental philosophy focused on explications of concepts, contemporary metaphysical theories with a role for experiential evidence can be fruitfully connected to empirical work in psychology, especially cognitive science. While there are different ways to flesh out the connection between cognitive (...) science and metaphysics, one way to understand the methodological issue concerns the evaluation of Moorean facts about the manifest. The chapter deals with Moorean facts about experience, in particular, with features of the manifest image that are drawn from ordinary experience. Critical ethical questions arise concerning whether studies among adolescents of new behavioral and biomedical HIV preventive interventions such as Pre-Exposure Prophylaxis should obtain parental permission. This paper examines the relevant regulations and ethical guidance concerning waivers of parental permission, and arguments for and against such waivers. Opponents of such waivers may argue that adolescent decision-making is “too immature” and that parents always have rights to decide how to protect their children. Yet requiring parental permission may put adolescents at risk, and/or (...) limit adolescent participation, jeopardizing study findings’ validity. This paper presents recommendations on when researchers and Institutional Review Boards should waive parental permission, and what special protections should be adopted for adolescents who consent for themselves, e.g., assuring adolescent privacy and confidentiality, screening for capacity to consent, and identifying adolescents who are at elevated risk from study participation. We also present a series of specific areas for future research to design tools to help make these assessments, and to inform researcher and IRB decisions. These recommendations can help ensure that research is conducted that can aid adolescents at risk for HIV, while minimizing risks and protecting these individuals' rights as much as possible. Irish Supreme Court upholds paramountcy of parental right to determine a child's best interests at the expense of the rights of children themselvesCan a court force on parents who are careful and conscientious a view of their child's welfare which is rational, but quite contrary to the parents sincerely held but non-rational beliefs? The Supreme Court of Ireland has recently held that it cannot do so, and that the Irish Constitution requires that the right of the family to determine its (...) own direction must be respected except in the most narrow of circumstances, such as an immediate threat to the life of the child or risk of serious injury. The ruling leaves the assessment of a child's best interests to the wide discretion of parents, but at the same time fails to offer a means to resolve potential conflicts between the rights of the family and the rights of the child.FACTS OF THE CASEIn North Western Health Board v W 1 an action was brought by a local health board against the parents of 14 month old Paul, seeking a declaration that their refusal to submit their son to the heel prick test for phenylketonuria was a failure to vindicate their son's rights and that it would be lawful to proceed without parental consent. Phenylketonuria is a metabolic condition which can lead to severe and untreatable mental impairment if not detected in its early stages, but a simple variation in diet can stave off this outcome. While Paul's parents did not doubt the veracity of this medical opinion, nor indeed the importance of the test, they refused to subject their son to the invasive heel prick, offering instead samples of urine or hair, such that the test could be carried out by non-invasive means. The right not to know is a contested matter. This can be because the inversion of the normal framing of entitlement to information about one's own health is thought to be illogical and inconsistent with self-authorship and/or because the very idea of claiming a right not to know information is an inappropriate appeal to the discourse of rights that places impossible responsibilities on others. Notwithstanding, there has been a sustained increase in this kind of appeal in recent years fueled in (...) large part by the rise and rise of the importance of personal autonomy in health care ethics, and by domestic and international health law. The right not to know has been acknowledged in at least two important international legal instruments. For example, the UNESCO Universal Declaration on the Human Genome and Human Rights, Article 5c provides: “The right of every individual to decide whether or not to be informed of the results of genetic examination and the resulting consequences should be respected.”. In the real world, there can be constraints on rational decision-making: there can be limitations on what I can know and on what you can know. There can also be constraints on my ability to deliberate or on your ability to deliberate. It is useful to know what the norms of rational deliberation should be in ideal contexts, for fully informed agents, in an ideal world. But it is also useful to know what the norms of rational deliberation should be (...) in the actual world, in non-ideal contexts, for imperfectly informed agents, especially for big, life-changing decisions. That is, we want to know how to deliberate as best we can, given the real-world limitations on what we can know, and given real-world limitations on how we are able to deliberate. In this paper, our concern is with the norms of rational deliberation in certain, important, non-ideal contexts, where the reasoning occurs from the agent’s first person, subjective point of view. The norms governing the process of deliberation for real people in the sorts of non-ideal contexts we’ll consider need to reflect the way that real agents, with an incomplete grasp on the facts and an imperfect ability to deliberate, can be expected to proceed. Our central contention is that framing and exploring the deliberative process from the first person perspective allows us to uncover and explore important, real-world constraints on boundedly rational agents deliberating from the subjective perspective. This article argues for the importance of conceptual clarity in the debate about the so-called right not to know. This is vital both at the theoretical and the practical level. It is suggested that, unlike many formulations and attempts to give effect to this right, what is at stake is not merely an aspect of personal autonomy and therefore cannot and should not be reduced only to a question of individual choice. Rather, it is argued that the core interests that (...) can be protected by the right not to know are better conceived of as privacy interests rather than autonomy interests. This not only helps us to understand what is in play but also informs regulatory, professional, and legal responses to handling information and taking decisions about whether or not to disclose information to persons about themselves. The practical implications of this conceptualization are explored in the context of feedback policies in health-related research. (shrink)

Figuring prominently in their decisions regarding which theories to pursue are scientists' appeals to the promise or lack of promise of those theories. Yet philosophy of science has had little to say about how one is to assess theory promise. This essay identifies several indices that might be consulted to determine whether or not a theory is promising and worthy of pursuit. Various historical examples of appeals to such indices are introduced.

The term ‘phenomenology’ has become almost as over-used and emptied of meaning as that other word from Continental Philosophy, namely ‘existentialism’. Yet Husserl, who first put forward the phenomenological method, considered it a rigorous alternative to positivism, and in the hands of Merleau-Ponty, a disciple of Husserl in France, phenomenology became a way of gaining a disciplined and coherent perspective on the world in which we live. When this study originally published in 1977 there were only a few books in (...) English on Merleau-Ponty’s philosophy. It introduced the reader and suggested how his thought might throw light on some of the assumptions and presuppositions of certain contemporary forms of Anglo-Saxon philosophy and social science. It also demonstrates how phenomenology seeks to unite philosophy and social science, rather than define them as mutually exclusive domains of knowledge. (shrink)

This essay engages the work of Italian feminist philosopher Adriana Cavarero and her concept of the narratable self. Her relational humanism, rooted in our exposure to others, offers an ontology of uniqueness whose critique of abstraction, masculinism, and identity politics still resonates today where the meaning of a unique “you” is negotiated in embodied exchanges that may offer care or wounds. Cavarero develops an altruistic ethics that cultivates this humanism. I argue that her work should be extended to better capture (...) the political purchase of the narratable self that interacts dynamically and often ambiguously with the “we” of collective politics. Putting her work into conversation with the nineteenth‐century abolitionist and women's rights advocate Sojourner Truth, I suggest that Cavarero's work illuminates Truth as a philosopher of the narratable self. Moreover, Truth's work extends Cavarero's concerns with exposure that may do violence or offer care by making explicit the challenges of narration in the context of inequality, especially in terms of race and class. Exposure as an ontological and phenomenological condition then needs to take account of a broader publicity of textual, individual, and collective exposure to others to develop the critical, ethical, and political purchase it offers. This article represents an attempt to organize, critique, and extend research findings on gender differences in business ethics. The focus is on two dependent variables—ethical judgment and behavioral intent. Differences in findings between student and professional groups are noted and theoretical implications are discussed. The new research provided for this article contains two benchmark studies undertaken with identical stimuli and identical measures. These studies were followed by two additional studies, using the same measures but different stimuli, as a partial replication (...) and extension of the first two. Findings suggest that little difference exists between the genders on behavioral intent for professional groups and only minimal differences for the ethical judgment measures. Student results, however, produced more substantial differences for behavioral intention. (shrink)

This study considers two problems: the extent to which feminist opinions are distinct from feminist identity and the generalizability of these separate constructs across gender and time. Using pooled cross-sectional data from the six National Election Study surveys conducted from 1972 through 1992, the author employs a series of measurement and structural equation models to evaluate the validity and reliability of various feminist orientations and to estimate the relationships among feminist identity, feminist opinion, and individual characteristics associated with feminism. In this article, I respond to Laury Naranch’s and Mary Caputi’s discussion of my book Power and Feminist Agency in Capitalism (2017). In response to Naranch, I clarify how the political subject-in-outline translates into collective political action through the figure of the Chicana working-class woman. I also explain why the proletariat, more so than the precariat, implies a radical political imaginary if we rethink this concept in the context of my idea of the political subject-in-outline. I also clarify that my (...) chapters on Marx expose how Adorno and Marx have problematic imaginations of the working-class woman, which counter their otherwise radical imaginary. In response to Caputi, I clarify the meaning of capitalism in my book and underline that we need a rigorous critique of capitalism to counter the rise of the Far Right. I also explain why the fluid subject does not have agency and why the subject-in-outline is a better way to theorize transformative feminist agency. I also clarify that my conception of feminist political subjectivity does not assume a privileged vantage point outside power structures. (shrink)

Who is in the best position to know a person's sex, do we each have a true sex, and is a person's sex an alterable characteristic? When a person's sex assignment changes, has the old self disappeared and a new one emerged; or, has only the public presentation of one's self changed? "You've Changed" examines the philosophical questions raised by the phenomenon of (...) sex reassignment, and brings together the essays of scholars known for their work in gender, sexuality, queer, and disability studies, feminist epistemology and science studies, and philosophical accounts of personal identity. My mother, born in Danzig in 1908 and raised in Frankfurt, died in 1993 in Ithaca, New York. She was Jewish, but she never attended a synagogue or celebrated Jewish holidays. My father, born in Leipzig in 1906 and raised in Jena, died in Ithaca in 1979. He was not Jewish. In the United States, they became members of the Society of Friends.My parents emigrated to the United States in May 1938 with my two older brothers, who were no longer allowed to attend nursery school because of their half-Jewish status. My grandmother stayed behind, at her own request, and my parents made every effort to bring her to the United States. But she died in Frankfurt in December 1940. This tragedy pervaded my childhood and still haunts me as I play her music with her annotations or set the table on tablecloths that she embroidered. I also photograph her things: the bandages that she knitted and labeled, letters that she wrote, and the childhood letters she saved of her only daughter, my mother.My mother saved things: keys to every cabinet and drawer, suitcases, and doors. All her eyeglasses. She dug up the dahlias in the fall, stored them in a baby bathtub, and replanted them in the spring. She was an enthusiastic gardener. She was a violinist and her mother a pianist. The albums of music are now crumbling and brittle. Her music friends continue to use her music. The tablecloths, dozens of them, are mended and stained. I use a large square damask tablecloth as a bed sheet.I am always amazed at the things they brought with them when they emigrated by ship: furniture, rugs, books, linens, letters, toys, photographs, dishes, pots and pans. Then I remember that they could not bring money, so they brought everything else: including a box of bandages, one labeled in an early script: “a clean breast cloth from the beginning of the 19th century.” The label is sewn onto the linen cloth.After my mother’s death, I went through boxes of photographs. I found one yellow Kodak envelope, labeled in my mother’s handwriting: “Helmut’s ‘Weltreise.’” In the envelope were photographs of Daddy’s trip to America in 1937 when he was searching for a job and a place to move with his little family. He traveled by boat through Cuba, Mexico, and the Panama Canal to California and back across the United States by train. The photograph is labeled on the verso, in his handwriting, “meine kleine Freundin, Patricia Hays”—this is not my mother. My mother was in Frankfurt, waiting to hear where they would go, and during that time she lost her third baby.My mother wrote letters almost every day, and she kept a carbon copy on onionskin of each of her letters. She started writing letters as early as 1913. Most of the letters are in German. I don’t speak or write German, yet I feel compelled to store these relics of times past. Despite the numerous benefits associated with forgiveness, many individuals find it difficult to forgive. This is especially true in organizations, where forgiveness is rare and can be under-valued. Across two studies, we explore how to facilitate forgiveness within organizational contexts and in the aftermath of workplace unfairness. We examine whether individuals can reduce the “injustice gap” that can be created by violations and enhance forgiveness through expressive writing interventions—guided writing techniques that can be self-administered. Participants wrote about their reactions to (...) a fictional scenario or an actual workplace experience. Results indicate that expressive writing was associated with higher reported perceived resolution. Whereas negative emotions mediated this relationship in Study 1, positive emotions and perceived injustice mediated this relationship in Study 2. Perceived resolution also mediated the relationship between expressive writing and forgiveness. Theoretical, methodological, and practical implications are discussed. (shrink)
