The consumption of halal food may be seen as an expression of the Muslim identity. Within Islam, different interpretations of ‘halal’ exist and the pluralistic Muslim community requests diverse halal standards. Therefore, adaptive governance arrangements are needed in the halal food market. Globalization and industrialization have complicated the governance of halal food. A complex network of halal governors has developed from the local to the global level. In this paper, we analyze to what extent halal certification bodies in the Netherlands (...) address the needs of the Muslim community and how they are influenced by international halal governance. The Netherlands serves as a case study with its growing Muslim community and its central position in international trade. The data comes from literature review and eleven qualitative semi-structured interviews with the most prominent actors in the Dutch halal governance system. Our analysis shows that the halal governance system in the Netherlands is weakly institutionalized and hardly adaptive to the needs of a heterogeneous Muslim community. Improvements are needed concerning stakeholder engagement, transparency, accessibility, impartiality and efficiency. (shrink)

Religion within the Boundaries of Mere Reason remains one of the most opaque of Kant's published writings. Though this opacity belongs, partly, to the text itself, a key claim of this article is that this opacity stems also from the narrow lenses through which his readers view this text. Often read as part of Kant's moral philosophy or his universal history, the literature has thus far neglected a different vantage point on the Religion, one that does not refute the utility (...) of these lenses but complements them. This paper places the Religion alongside parts of Kant's corpus that it is less typically paired with, namely his natural history writings—in particular, his writings on the concept of race and the development of the human races. I argue that by doing so, we can shed much light on Kant's infamous claim that there is a radical evil in the human species. More precisely, we will come to appreciate that this evil is not, as it is usually understood, a static property or fixed characteristic of human beings. Instead, radical evil concerns a dynamic, changing defect in human nature that increasingly threatens our aspirations to collective moral perfection. (shrink)

Despite the centrality of the term within the title, the meaning of ?care? in residential child care remains largely unexplored. Shifting discourses of residential child care have taken it from the private into the public domain. Using a care ethics perspective, we argue that public care needs to move beyond its current instrumental focus to articulate a broader ontological purpose, informed by what is required to promote children's growth and flourishing. This depends upon the establishment of caring relationships enacted within (...) the lifespaces shared by children and those caring for them. We explore some of the central features of caring in the lifespace and conclude that residential child care is best considered to be a practical/moral endeavour rather than the technical/rational one it has become. Bloomsbury, 2021. 376pp.Far from “mourning” the demise of theory, this timely and thoughtfully curated essay collection testifies to its “renewed vitality,” its compelling presence “across (...) fields, domains of life, and geocultural boundaries,” and its power to build an ever-expanding world community of practioners who are forming what has come to be known as a “theory commons” (ix). As the collection’s editors point out, theory’s new lease on life hinges on ensuring both the democratic workings of this “world discourse formation” (1) and on the responsible theorizing of the very notion of community in “a world threatened by all kinds of anti-communal actions and reactions, from runaway globalization to exacerbated tribalism and tunnel-vision politics” (x). Working on the margins, specifically, out of a Romanian “lab” called The Critical Theory Institute (CTI), which opened its doors in early 2000, the contributors seek to revise the “standard history of theory,” one whose “Western origins, authority, and cultural compass ” strike them as “exceedingly reductive” (3). This project of geotheoretical repositioning and recalibration aims to recast theory as a “quintessentially cross-linguistic, cross-cultural, trans- and intercontinental undertaking” (4). As such, it carries on the project, launched in a previous volume, Romanian Literature as World Literature (2018), of fashioning an alternative to the nation-state paradigm that has long shaped literary and intellectual histories. In both of these works, Romanian critics and theorists have tuned into a wide range of voices, and tapped into a shared conceptual and methodological apparatus—itself the product of “an ethno-linguistic medley of traditions” (8). This approach informs what editors see as the “epoch-making” (17) discursive paradigm that has taken shape in globally networked post-Cold War societies (17), a viral model of cultural influence that fosters an ontology of “contact, contagion, of infection, dissemination, and horizontal accumulation” (15).To give us a sense of theory’s complex genealogy and evolution, the editors reference the Bulgarian critic Galin Tihanov, who has attributed [End Page 122] important developments in contemporary theory to the achievements of theorists (Nikolai Trubetskoi, Roman Jakobson, Vladimir Propp, and Georg Lukács) and schools of thought (Russian Formalism and the Prague Linguistic Circle). In “Traveling Theory” (1983) and “Traveling Theory Reconsidered” (2000), Edward Said called attention to the migratory nature of contributions made, for instance, by Georg Lukács, whose theories moved across different European locales in this period. There has been an ongoing debate about the best approach in environmental ethics. Bryan Norton believes that “weak anthropocentrism” will yield the best results for public policy, and that it is the most defensible position. In contrast, I have argued that an ecocentric, holistic position is required to deal with the urgent environmental problems that face us, and that position is complemented by the ecosystem approach and complex systems theory. I have called this approach “the ethics of integrity,” and in (...) this paper I show why this perspective suggests better solutions to difficult cases, for which “weak anthropocentrism” fails to provide an answer. There is an urgent need for novel protection strategies to sustainably secure crop production under changing climates. Studying microbial effectors, defined as microbe‐derived proteins that alter signalling inside plant cells, has advanced our understanding of plant immunity and microbial plant colonisation strategies. Our understanding of effectors in the establishment and beneficial outcome of plant symbioses is less well known. Combining functional and comparative interaction assays uncovered specific symbiont effector targets in highly interconnected plant signalling networks and revealed the potential of (...) effectors in beneficially modulating plant traits. The diverse functionality of symbiont effectors differs from the paradigmatic immuno‐suppressive function of pathogen effectors. These effectors provide solutions for improving crop resilience against climate stress by their evolution‐driven specification in host protein targeting and modulation. Symbiont effectors represent stringent tools not only to identify genetic targets for crop breeding, but to serve as applicable agents in crop management strategies under changing environments. Songs that combine happy music and sad, violent, or morally disturbing lyrics raise questions about the relationship between music and lyrics in song, including the question of how such songs affect the listener, and of the ethical implications of listening – and perhaps singing along with – such songs. To explore those perplexing cases in which the affective impact of music and lyrics seem entirely incompatible, we first examine how song music – and the sympathetic musical affects it elicits – (...) can influence listener attention to lyrics. We propose that ‘happy’ music and mood in particular may discourage close attention to the semantic contents of lyrics in some cases, and impart a ‘positive glow’ to them in others. We also mine the kinds of moral questions to which emotional and imaginative immersion in fiction can give rise for their potential applicability to songs with disturbing narratives. We then explore how performance and performer may influence the understanding and interpretations of lyrics. This investigation of the complexities of such songs will use Tom Jones’ murder ballad “Delilah” as a template, taking into account both its impact and its presentation. (shrink)

Ronald de Sousa is one of the few analytic philosophers to have explored the ineffability of emotion. Ineffability arises, for de Sousa, from attempts to translate experience, which involves non-conceptual content, into language, which involves conceptual content. As de Sousa himself rightly notes, such a characterization construes all perceptual experience as ineffable and does not explain what might set emotional ineffability apart. I build on de Sousa’s insights regarding what makes emotional ineffability distinctive by highlighting that in the case of (...) emotion the content in question is, crucially, evaluative. Evaluative content has normativity that makes the ineffability of emotion both particularly salient as well as particularly relevant, as the way in which an object is valuable is felt to be merited despite the experience’s ineffability. After proposing an improved working definition of emotional ineffability, I move to the question of how language and emotional experience interact, and whether these interactions can be evaluated in any systematic way. While de Sousa is pessimistic regarding the prospects of such an evaluation, I argue that if we move beyond an individual level of analysis it is possible to characterize cases where the ineffability of emotion leaves members of particular social groups vulnerable to a range of epistemic and affective injustices. I argue that we can similarly characterize cases where the ineffability of emotion holds radical potential to challenge and transform unjust social arrangements. I end by proposing that the representational content of emotion involves what I call ‘modal complexity’ and that this makes emotions particularly well-suited to play such radical roles. (shrink)

The articles of the Convention of Human Rights and Biomedicine connect any medical intervention with the »informed consent« of the patient out of respect to Human Dignity by physicians as weil as for treatments and research projects. Nevertheless it becomes apparent that the observation of this principle looses its significance for patients who are incapacitated because of temporal or permanent incompetance to represent their own interests or who are too young to do so. In these cases other attributes of Human (...) Dignity and their observation have to replace the »informed consent«. For inclusion of patients who can't give their consent in clinical studies the MRK formulated strict conditions which exceed the legal prerequisites in Germany. Here clearly the investigation has to benefit each patient directly. The MRK widens this condition to investigations which may not benefit the patient himself, but serve a group of patients with the same illness or solve problems related to the desease. The deciding bodies will have to inform themselves very carefully not only about the facts for urgent research with incapacitated patients, but also must define terms like »no direct benefit « before German Law will allow adaptation to and ratification of the MRK. Dieser permanente Wandel verlaeuft in unserer Wahrnehmung immer rasanter. Auch bei einem Blick in die Vergangenheit scheinen Umbrueche, neue Ideen und Erfindungen zu ueberwiegen und in staendigen Wertverschiebungen zu resultieren. Aber was ist mit den bestaendigen Dingen? Nicht nur Veraenderungen schaffen Werte, sondern auch Bestaendigkeit. Dabei stellt sich nicht nur die Frage, welche Werte (...) durch Kontinuitaet entstehen, sondern auch welche Werte sie bedingen. Traditionen sind identitaetsstiftend. Sie gehoeren zum kulturellen Gedaechtnis, bilden oftmals eine Basis fuer Innovationen und haben dadurch eine eigene Bedeutung im Hinblick auf Veraenderungen. Kontinuitaeten zu erkennen, ist in einer Welt im stetigen Wandel ein schwieriges Unterfangen und auch im Rueckblick nicht unproblematisch, vor allem wenn die Akteure selbst nicht mehr zu sprechen sind. The potential to collect brain data more directly, with higher resolution, and in greater amounts has heightened worries about mental and brain privacy. In order to manage the risks to individuals posed by these privacy challenges, some have suggested codifying new privacy rights, including a right to “mental privacy.” In this paper, we consider these arguments and conclude that while neurotechnologies do raise significant privacy concerns, such concerns are—at least for now—no different from those raised by other well-understood data collection (...) technologies, such as gene sequencing tools and online surveillance. To better understand the privacy stakes of brain data, we suggest the use of a conceptual framework from information ethics, Helen Nissenbaum’s “contextual integrity” theory. To illustrate the importance of context, we examine neurotechnologies and the information flows they produce in three familiar contexts—healthcare and medical research, criminal justice, and consumer marketing. We argue that by emphasizing what is distinct about brain privacy issues, rather than what they share with other data privacy concerns, risks weakening broader efforts to enact more robust privacy law and policy. Molteplici sono gli interrogativi etici emergenti. È lecito usare farmaci e tecnologie non solo per curare malattie, ma anche per potenziare capacità fisiche, mentali ed emotive? È lecito estendere la vita biologicamente ad ogni costo fino alla ‘immortalità terrena’? È lecito selezionare e (...) alterare le caratteristiche genetiche degli individui? È lecito impiantare protesi meccaniche nel cervello per migliorare la mente? È lecito usare farmaci o stimolazioni neurologiche per cancellare ricordi? È lecito costruire computer che imitano la mente e che la sostituiscano? È lecito costruire robot che interagiscano con umani e tra loro? Il modo in cui risponderemo a queste domande sarà determinante non solo per il presente, ma anche per il futuro dell’umanità. Il volume si articola in due parti. While various definitions of moral distress have been proposed, some agreement exists that it results from illegitimate constraints in clinical practice affecting healthcare professionals’ moral agency. If we are to reduce moral distress, instruments measuring it should provide relevant information about such illegitimate constraints. Unfortunately, existing instruments fail to do so. We discuss here several shortcomings of major instruments in use: their inability to determine whether reports of moral distress involve an accurate assessment of the requisite clinical and logistical facts (...) in play, whether the distress in question is aptly characterized as moral, and whether the moral distress reported is an appropriate target of elimination. Such failures seriously limit the ability of empirical work on moral distress to foster appropriate change. (shrink)

Child Law starts with the question "Who is the Child?" In direct contrast to the CRC, which calls for putting the interests of the child first in all policies dealing with children, it appears that the interests of others are the major consideration de facto. In law, children's right to protection is severely limited by the presence of a maximum age limit, with no consideration of the starting point: current and ongoing scientific research has demonstrated the effects of this non-consideration (...) in a number of abnormalities and diseases, not only in children, but in adults and the elderly. The WHO has published a number of studies to that effect, and the 2012 Report on Endocrine Disruptors more than confirms this claim. This and other scientific insights that have largely been ignored show the flaws and inadequacies of the legal regimes intended to protect children, in a number of areas, from the basic public health to the right to normal development; child labor law conventions; in conflict situations; as a result of climate and other events; children as illegal migrants; and as inmates in prison camps.
