Knowledge of the ethical and legal basis of medicine is as essential to clinical practice as an understanding of basic medical sciences. In the UK, the General Medical Council requires that medical graduates behave according to ethical and legal principles and must know about and comply with the GMC’s ethical guidance and standards. We suggest that these standards can only be achieved when the teaching and learning of medical ethics, law and professionalism are fundamental to, and thoroughly integrated both vertically (...) and horizontally throughout, the curricula of all medical schools as a shared obligation of all teachers. The GMC also requires that each medical school provides adequate teaching time and resources to achieve the above. We reiterate that the adequate provision and coordination of teaching and learning of ethics and law requires at least one full-time senior academic in ethics and law with relevant professional and academic expertise. In this paper we set out an updated indicative core content of learning for medical ethics and law in UK medical schools and describe its origins and the consultative process by which it was achieved. At first blush, one might conclude that these practice patterns show that patients and their doctors have weighed the risks associated with twins against the benefits of swiftly completing their families and decided that the risks are worth taking. That is, their requests for twins must represent their free and informed choices. But there are reasons to be skeptical of this interpretation, including that the preferences of many patients seem to be very strongly shaped, if not sometimes completely constrained, by concerns about costs—costs that mainly result from the routine exclusion of in vitro fertilization from health insurance coverage. It is quite possible, we believe, that these cost concerns actually undermine the autonomy of fertility patients, pushing many of them to take risks with their health and the health of their hoped‐for future children. Suppose that John asks, ‘Is the window open?’ and Mary replies, ‘The window is open.’ Then John and Mary have produced two distinct utterances, and in doing so, they have performed two different kinds of speech act. But clearly there is something that these utterances have in common. According to the standard theory of speech acts, in these utterances different illocutionary forces have been applied to the same propositional content. Similarly, if John and Mary both believe that roses are red, (...) the same propositional content is attributed to their individual mental states.The propositional contents of utterances and beliefs have traditionally been identified with propositions. In turn, propositions have been characterized as language-independent particulars that can be re-identified in different contexts. In his 1987 book _Conditionals, Frank Jackson presents an argument to the effect that the indicative conditionals of natural language have the same truth conditions as the material conditional of truth-functional logic. This Jackson refers to as the "paradox of indicative conditionals." I offer a solution to this paradox by arguing that some conditionals that appear to be in the indicative mood are actually subjunctives, to which the paradox does not apply. The article provides an example of the application of the techniques and results of historical linguistics to traditional problems in the philosophy of language. It takes as its starting point the dispute about the nature of facts that arose from the 1950 Aristotelian Society debate between J. L. Austin and P. F. Strawson. It is shown that, in some cases, expressions containing the noun fact refer to actions and events; while in other cases, such expressions do not have a referring (...) function at all. Thus, nothing corresponding to Strawson's 'pseudomaterial correlate' need be postulated in order to account for the reference of the noun fact. It is suggested that many philosophically problematic expressions may be better understood by tracing their historical evolution in natural language. (shrink)

By looking at artful objects we can hypothesize why the human mind both produces them and responds to them, and derive from such hypotheses ideas about the nature of human consciousness, including its power to make present in the mind that which is absent from view. (...) In particular, the art of Shakespeare, being both verbal and formal, both articulates the peculiar burdens of human consciousness and demonstrates art's response to these burdens. His play Troilus and Cressida serves as an example, exhibiting and exploring the discordancies human consciousness is liable to, and at the same time incorporating those discordancies into a greater harmony through the formal structures of art. Corruption involves greed, money, and risky decision-making. We explore the love of money, pay satisfaction, probability of risk, and dishonesty across cultures. Avaricious monetary aspiration breeds unethicality. Prospect theory frames decisions in the gains-losses domain and high-low probability. Pay dissatisfaction (in the losses domain) incites dishonesty in the name of justice at the individual level. The Corruption Perceptions Index, CPI, signals a high-low probability of getting caught for dishonesty at the country level. We theorize that decision-makers adopt avaricious love-of-money aspiration (...) as a lens and frame dishonesty in the gains-losses domain (pay satisfaction-dissatisfaction, Level 1) and high-low probability (CPI, Level 2) to maximize expected utility and ultimate serenity. We challenge the myth: Pay satisfaction mitigates dishonesty across nations consistently. Based on 6500 managers in 32 countries, our cross-level three-dimensional visualization offers the following discoveries. Under high aspiration conditions, pay dissatisfaction excites the highest- (third-highest) avaricious justice-seeking dishonesty in high (medium) CPI nations, supporting the certainty effect. However, pay satisfaction provokes the second-highest avaricious opportunity-seizing dishonesty in low CPI entities, sustaining the possibility effect—maximizing expected utility. Under low aspiration conditions, high pay satisfaction consistently leads to low dishonesty, demonstrating risk aversion—achieving ultimate serenity. We expand prospect theory from a micro and individual-level theory to a cross-level theory of monetary wisdom across 32 nations. We enhance the S-shaped Curve to three 3-D corruption surfaces across three levels of the global economic pyramid, providing novel insights into behavioral economics, business ethics, the environment, and responsibility. Background: Medical tourism involves patients travelling internationally to receive medical services. This practice raises a range of ethical issues, including potential harms to the patient's home and destination country and risks to the patient's own health. Medical tourists often engage the services of a facilitator who may book travel and accommodation and link the patient with a hospital abroad. Facilitators have the potential to exacerbate or mitigate the ethical concerns associated with medical tourism, but their roles are poorly understood. -/- (...) Methods: 12 facilitators were interviewed from 10 Canadian medical tourism companies. -/- Results: Three themes were identified: facilitators' roles towards the patient, health system and medical tourism industry. Facilitators' roles towards the patient were typically described in terms of advocacy and the provision of information, but limited by facilitators' legal liability. Facilitators felt they played a positive role in the lives of their patients and the Canadian health system and served as catalysts for reform, although they noted an adversarial relationship with some Canadian physicians. Many facilitators described personally visiting medical tourism sites and forming personal relationships with surgeons abroad, but noted the need for greater regulation of their industry. -/- Conclusion: Facilitators play a substantial and evolving role in the practice of medical tourism and may be entering a period of professionalisation. Because of the key role of facilitators in determining the effects of medical tourism on patients and public health, this paper recommends a planned conversation between medical tourism stakeholders to define and shape facilitators' roles. If K is an index of relative voting power for simple voting games, the bicameral postulate requires that the distribution of K -power within a voting assembly, as measured by the ratios of the powers of the voters, be independent of whether the assembly is viewed as a separate legislature or as one chamber of a bicameral system, provided that there are no voters common to both chambers. We argue that a reasonable index – if it is to be used (...) as a tool for analysing abstract, ‘uninhabited’ decision rules – should satisfy this postulate. We show that, among known indices, only the Banzhaf measure does so. Moreover, the Shapley–Shubik, Deegan–Packel and Johnston indices sometimes witness a reversal under these circumstances, with voter x ‘less powerful’ than y when measured in the simple voting game G1 , but ‘more powerful’ than y when G1 is ‘bicamerally joined’ with a second chamber G2 . Thus these three indices violate a weaker, and correspondingly more compelling, form of the bicameral postulate. It is also shown that these indices are not always co-monotonic with the Banzhaf index and that as a result they infringe another intuitively plausible condition – the price monotonicity condition. We discuss implications of these findings, in light of recent work showing that only the Shapley–Shubik index, among known measures, satisfies another compelling principle known as the bloc postulate. This book presents the framework for a new, comprehensive approach to cognitive science. The proposed paradigm, enaction, offers an alternative to cognitive science's classical, first-generation Computational Theory of Mind. _Enaction_, first articulated by Varela, Thompson, and Rosch in _The Embodied Mind_, breaks from CTM's formalisms of information processing and symbolic representations to view cognition as grounded in the sensorimotor dynamics of the interactions between a living organism and its environment. A living organism enacts the world it lives in; its embodied (...) action in the world constitutes its perception and thereby grounds its cognition. _Enaction_ offers a range of perspectives on this exciting new approach to embodied cognitive science. Some chapters offer manifestos for the enaction paradigm; others address specific areas of research, including artificial intelligence, developmental psychology, neuroscience, language, phenomenology, and culture and cognition. Three themes emerge as testimony to the originality and specificity of enaction as a paradigm: the relation between first-person lived experience and third-person natural science; the ambition to provide an encompassing framework applicable at levels from the cell to society; and the difficulties of reflexivity. Taken together, the chapters offer nothing less than the framework for a far-reaching renewal of cognitive science. How does an object persist through change? How can a book, for example, open in the morning and shut in the afternoon, persist through a change that involves the incompatible properties of being open and being shut? The goal of this reader is to inform and reframe the philosophical debate around persistence; it presents influential accounts of the problem that range from classic papers by W. V. O. Quine, David Lewis, and Judith Jarvis Thomson to recent work by contemporary philosophers. (...) The authors take on the question of persistence by examining three broad approaches: perdurantism, which holds that change over time is analogous to change over space; exdurantism, according to which identity over time is analogous to identity across possible worlds; and endurantism, which holds that ordinary objects persist by enduring. Throughout the Works and Days (WD), Hesiod reaffirms and promotes his audience’s belief in the reality of the supernatural — that is, the gods of Olympus, whose power the poet clearly takes seriously, given the somber warnings that populate the final calendrical portion of the piece. Drawing on S.I. Johnston’s recent The Story of Myth, as well as the work of folklorists K. Hänninen and G. Bennett, I outline the techniques Hesiod employs to render believable the influence of the (...) divine in both the distant past and the contemporary period. Hesiod constructs a story world familiar to his audience in order to bolster the credibility of the supernatural events, both mythical and contemporary, that he reports. When speaking of the gods’ influence in his own time, Hesiod remains firm on the fact of the gods’ continued intervention only in concrete, mundane phenomena experienced by each of his audience members. Otherwise, the poet tends toward vague language, leaving his audience to come to their own conclusion about the influence of the divine. To encourage a positive conclusion, Hesiod creates an analogy between abstract concepts, such as Strife, and the anthropomorphic gods of myth. Using these strategies, Hesiod imbues WD with belief in divine influence in the world, past and present. (shrink)
