Freedom and the Rule of Law takes a critical look at the historical beginnings of law in the United States, and how that history has influenced current trends regarding law and freedom. Anthony Peacock has compiled articles that examine the relationship between freedom and the rule of law in America. The rule of law is fundamental to all liberal constitutional regimes whose political orders recognize the equal natural rights of all.

The article offers a reading of “Through the Panama” by Malcom Lowry in light of an intertext connected with Polish literature. Lowry mentions a short story “The Lighthouse Keeper of Aspinwall” by the Polish writer Henryk Sienkiewicz, the Nobel prize winner for the whole of his literary output. What Lowry stresses in his intertextual allusion is the perilous illumination that the eponymous lighthouse keeper experiences. The article contends that the condition of the lighthouse keeper anticipates that of the Lowry protagonist (...) who in “Through the Panama” fears death by his own book, or, to take Lowry’s other phrase, being “Joyced in his own petard.” Basing her analysis on Mieke Bal’s idea of a participatory exhibition where the viewer decides how to approach a video installation, and can do so by engaging with a single detail, Filipczak treats Lowry’s text as a multimodal work where such a detail may give rise to a reassessment of the reading experience. Since the allusion to the Polish text has only elicited fragmentary responses among the Lowry critics, Filipczak decides to fill in the gap by providing her interpretation of the lighthouse keeper’s perilous illumination mentioned by Lowry in the margins of his work, and by analyzing it in the context of major Romantic texts, notably the epic poem Master Thaddeus by Adam Mickiewicz whose words trigger the lighthouse keeper’s experience, and The Rime of the Ancient Mariner by Samuel Taylor Coleridge, whose text is quoted in the margins of “Through the Panama.” This choice allows to throw a different light on Lowry’s work which is also inhabited by echoes of futurist attitude to the machine and the Kafkaesque fear of being locked in one of the many locks of the canal “as if in experience.”. Isaac Levi has long criticized causal decisiontheory on the grounds that it requiresdeliberating agents to make predictions abouttheir own actions. A rational agent cannot, heclaims, see herself as free to choose an actwhile simultaneously making a prediction abouther likelihood of performing it. Levi is wrongon both points. First, nothing in causaldecision theory forces agents to makepredictions about their own acts. Second,Levi's arguments for the ``deliberation crowdsout prediction thesis'' rely on a flawed modelof the measurement of belief. Moreover, theability of agents (...) to adopt beliefs about theirown acts during deliberation is essentialto any plausible account of human agency andfreedom. Though these beliefs play no part inthe rationalization of actions, they arerequired to account for the causalgenesis of behavior. To explain the causes ofactions we must recognize that (a) an agentcannot see herself as entirely free in thematter of A unless she believes herdecision to perform A will cause A,and (b) she cannot come to a deliberatedecision about A unless she adoptsbeliefs about her decisions. FollowingElizabeth Anscombe and David Velleman, I arguethat an agent's beliefs about her own decisionsare self-fulfilling, and that this can beused to explain away the seeming paradoxicalfeatures of act probabilities. Colin Howson has recently argued that accuracy arguments for probabilism fail because they assume a privileged ‘coding’ in which TRUE is assigned the value 1 and FALSE is assigned the value 0. I explain why this is wrong by first showing that Howson’s objections are based on a misconception about the way in which degrees of confidence are measured, and then reformulating the accuracy argument in a way that manifestly does not depend on the coding of truth-values. Along the way, (...) I will explain how to formulate the laws of probability and rational expectation in a scale-invariant way, and how to properly understand the values of the credence functions that we use to represent rational degrees of confidence. The United States considers educating all students to a threshold of adequate outcomes to be a central goal of educational justice. The No Child Left Behind Act introduced evidence-based policy and accountability protocols to ensure that all students receive an education that enables them to meet adequacy standards. Unfortunately, evidence-based policy has been less effective than expected. This article pinpoints under-examined methodological problems and suggests a more effective way to incorporate educational research findings into local evidence-based policy decisions. It identifies (...) some things educators need to know and do to determine whether available interventions can play the right casual role in their setting to produce desired effects. It examines the value and limits of educational research, especially randomized controlled trials, for this task. (shrink)

This article traces the circumstances, which led to Plato becoming a great philosopher. Gradual unraveling of the article brings out more of young Plato and how he became a part of Socrates' circle. Doing philosophy meant trying to understand how to live the life of a just person: getting rid of illusions about what we know or what we think we want, and coming to see what living well really consists of. That is the manifesto Socrates enunciates in his speech (...) to the jurors in the Apology. That is the theme Plato makes him elaborate and defends on a massive scale in the Republic, the longest and most complex of all his works. Fundamental in what he took from Socrates is the idea that philosophy is an inquiry, and inquiry best pursued in conversation with someone else. (shrink)

SummaryWhen mathematical instrument-makers brought the craft to London from the continent in the mid-sixteenth century, the severity of the legislation obliged them to join a guild company. As there was no company specialising in their craft, they joined the company of their choice, a practice allowed by the so-called ‘custom of London’. Research has revealed many in the Grocers' Company, and their position there is compared with that of instrument-makers who joined the Clockmakers' Company after its incorporation in 1631. While (...) the Grocers' Company steadily declined from this date in its industrial function, the Clock-makers' Company strove to exert a tight trade control over its members, and this continued until the end of the eighteenth century. Numbers of apprentices bound in each company are compared, and instrument-makers in the Clockmakers' Company listed. Much of interest to our understanding of the origins and organisation of the instrument-making trade can be discovered through the examination of guild company records. (shrink)

This article considers the role played by communications infrastructure within the international legal imagination. It engages with contemporary debates regarding the power of corporate digital platforms and their model of information capitalism. An international legal historical perspective is adopted in order to contextualise international law’s present infrastructural turn and connect current debates over big tech with their precursors. The history of international legal engagement with the development of communications infrastructure reveals a recurring pattern of looking to technological infrastructure for solutions (...) to global problems. This can act to empower private actors and contribute to an ongoing absence of meaningful international legal regulation of communications. The contemporary interest in infrastructure, and its implications in terms of fostering the private power of big tech over global communications, is in many ways a return. But it could also take account of alternative visions for international law which were present at key moments during the League of Nations era and the Cold War. Connecting current debates with those earlier moments in international legal history can help to highlight and counter continuing patterns of technological solutionism within the international legal imagination. It is only fair to hold someone accountable for outcomes over which they have sufficient control. The evidence-based approach to education (“evidence-based education,” or EBE) promises to give educators sufficient control over their students’ outcomes by providing access to interventions that are effective according to scientific research. I argue that EBE fails to secure sufficient control because the research on which it relies doesn't establish that interventions are generally effective. If they are to be fair, accountability practices must reflect the (...) limited control educators have, even when using evidence-based interventions that have improved outcomes in other settings. I glean relevant insights by considering accountability for medical practitioners within the context of evidence-based medicine (EBM). (shrink)
