Zusammenfassung Zur ordnungsgemäßen Durchführbarkeit des Spielbetriebs setzen die deutschen Profisportligen Li­zenzierungsverfahren ein. Dabei stehen insbesondere zur Eindämmung der Rattenrennen-Proble­matik und zur Sicherstellung der finanziellen Stabilität der teilnehmenden Klubs und damit zum Vermeiden negativer Externalitäten die finanzwirtschaftlichen Anforderungen im Fokus. In den ver­gangenen Jahren kam es trotz dieser Vorkehrungen in den fünf größten deutschen Profisportligen im Basketball, Eishockey, Fußball, Handball sowie Volleyball mehrfach zu finanziellen Schieflagen. Vor dem Hintergrund wird in diesem Beitrag die finanzwirtschaftliche Lizenzierung der Profisport­ligen anhand von sechs Haupt- (...) und 62 Subkriterien strukturiert und umfassend analysiert. Ziel die­ser vergleichenden Untersuchung ist die Herausarbeitung von Gemeinsamkeiten und Unterschieden sowie die Ableitung von Stärken und Schwächen. Aus sportökonomischer Perspektive werden auf dieser Basis Verbesserungsmöglichkeiten der Lizenzierungsverfahren entwickelt. (shrink)

Zusammenfassung Um die Öffnung der Bundesliga gegenüber Investoren möglichst wettbewerbsneutral zu gestalten und den Einfluss von externen Geldgebern auf einen Profi-Fußballclub zu beschränken, wurde die sogenannte 50-plus-1-Regel in die Satzung des DFB aufgenommen. In diesem Beitrag wird umfassend analysiert, welche Konstellationen mit beherrschendem Einfluss nicht von dieser Regelung erfasst werden. Ziel dieser Analyse ist der anschließende Vorschlag eines alternativen Konzeptes, welches die vorgebrachten Zielsetzungen konsequent realisieren könnte. Zur Durchführung der Regulation werden außerdem konkrete Handlungsempfehlungen ausgesprochen. Empirical evidence indicates that conscious states, distinguished by the presence of phenomenal qualities, are closely linked to synchronized neural activity patterns whose dynamical characteristics can be attributed to self-organized criticality and phase transitions. These findings imply that insight into the mechanism by which the brain controls phase transitions will provide a deeper understanding of the fundamental mechanism by which the brain manages to transcend the threshold of consciousness. This article aims to show that the initiation of phase transitions and the (...) formation of synchronized activity patterns is due to the coupling of the brain to the zero-point field (ZPF), which plays a central role in quantum electrodynamics (QED). The ZPF stands for the presence of ubiquitous vacuum fluctuations of the electromagnetic field, represented by a spectrum of normal modes. With reference to QED-based model calculations, the details of the coupling mechanism are revealed, suggesting that critical brain dynamics is governed by the resonant interaction of the ZPF with the most abundant neurotransmitter glutamate. The pyramidal neurons in the cortical microcolumns turn out to be ideally suited to control this interaction. A direct consequence of resonant glutamate-ZPF coupling is the amplification of specific ZPF modes, which leads us to conclude that the ZPF is the key to the understanding of consciousness and that the distinctive feature of neurophysiological processes associated with conscious experience consists in modulating the ZPF. Postulating that the ZPF is an inherently sentient field and assuming that the spectrum of phenomenal qualities is represented by the normal modes of the ZPF, the significance of resonant glutamate-ZPF interaction for the formation of conscious states becomes apparent in that the amplification of specific ZPF modes is inextricably linked with the excitation of specific phenomenal qualities. This theory of consciousness, according to which phenomenal states arise through resonant amplification of zero-point modes, is given the acronym TRAZE. An experimental setup is specified that can be used to test a corollary of the theory, namely, the prediction that normally occurring conscious perceptions are absent under experimental conditions in which resonant glutamate-ZPF coupling is disrupted. In addition to obviating the use of synthetic agrochemicals and emphasizing farming in accordance with agro-ecological guidelines, organic farming acknowledges the integrity of plants as an essential element of its natural approaches to crop production. For cultivated plants, integrity refers to their inherent nature, wholeness, completeness, species-specific characteristics, and their being in balance with their (organically farmed) environment, while accomplishing their “natural aim.” We argue that this integrity of plants has ethical value, distinguishing integrity of life, plant-typic integrity, genotypic integrity, (...) and phenotypic integrity. We have developed qualitative criteria to ethically evaluate existing practices and have applied these criteria to assess whether current plant breeding and propagation techniques violate the integrity of crop plants. This process has resulted in a design of a holistic, scientific approach of organic plant breeding and seed production. Our evaluation has met considerable criticism from mainstream (crop) scientists. We respond to the following questions: (1). Can ethics be incorporated into objective crop sciences? (2). What is the nature of the intrinsic value of plants in organic farming? We argue that criteria to take integrity into account can only be assessed from a holistic perspective and we show that a holistic approach is needed to design such ethical notions in a consistent way. The ethical notions have been further elaborated by formulating human responsibility and respect towards crop plants. Responsibility and respect can only be shown by providing crop plants the right to be nurtured and to express natural behavior at all levels of integrity. (shrink)

In some medical cases there is a moral distinction between killing and letting die, but in others there is not. In this paper I present an original and principled account of the moral distinction between killing and letting die. The account provides both an explanation of the moral distinction and an explanation for why the distinction does not always hold. If these explanations are correct, the moral distinction between killing and letting die must be taken seriously in medical contexts. Defeasibly, (...) when an agent kills she takes responsibility, but when an agent lets die she does not take responsibility. Therein lies the moral distinction between killing and letting die. The distinction, however, is defeated when an agent is already responsible for the surrounding situation. In such cases, killing does not involve taking any further responsibility and letting die does not avoid taking any responsibility. Medical examples are frequently complicated because patients' autonomous choices impact upon medical practitioners' surrounding responsibility. (shrink)

Algorithmic predictions are promising for insurance companies to develop personalized risk models for determining premiums. In this context, issues of fairness, discrimination, and social injustice might arise: Algorithms for estimating the risk based on personal data may be biased towards specific social groups, leading to systematic disadvantages for those groups. Personalized premiums may thus lead to discrimination and social injustice. It is well known from many application fields that such biases occur frequently and naturally when prediction models are applied to (...) people unless special efforts are made to avoid them. Insurance is no exception. In this paper, we provide a thorough analysis of algorithmic fairness in the case of insurance premiums. We ask what “fairness” might mean in this context and how the fairness of a premium system can be measured. For this, we apply the established fairness frameworks of the fair machine learning literature to the case of insurance premiums and show which of the existing fairness criteria can be applied to assess the fairness of insurance premiums. We argue that two of the often-discussed group fairness criteria, independence (also called statistical parity or demographic parity) and separation (also known as equalized odds), are not normatively appropriate for insurance premiums. Instead, we propose the sufficiency criterion (also known as well-calibration) as a morally defensible alternative that allows us to test for systematic biases in premiums towards certain groups based on the risk they bring to the pool. In addition, we clarify the connection between group fairness and different degrees of personalization. Our findings enable insurers to assess the fairness properties of their risk models, helping them avoid reputation damage resulting from potentially unfair and discriminatory premium systems. The aim of this paper is to show that Graham Priest's dialetheic account of semantic paradoxes and the paraconsistent logics employed cannot achieve semantic universality. Dialetheism therefore fails as a solution to semantic paradoxes for the same reason that consistent approaches did. It will be demonstrated that if dialetheism can express its own semantic principles, a strengthened liar paradox will result, which renders dialetheism trivial. In particular, the argument is not invalidated by relational valuations, which were brought into paraconsistent logic (...) in order to avoid strengthened liar paradoxes. (shrink)

The notion of the highest good used to occupy a primary role in ethical theorising, but has largely disappeared from the contemporary landscape. The notion was central to both Aristotle's and Kant's ethical theories, however--a surprising observation given that their approaches to ethics are commonly conceived as being diametrically opposed. The essays in this collection provide a comprehensive treatment of the highest good in Aristotle and Kant and show that, even though there are important differences in terms of content, there (...) are also important similarities in terms of the structural features of Aristotle's and Kant's value theories. By carefully analysing Aristotle's and Kant's theories of the highest good, a team of experts in the field shed light on their respective ethical theories and highlight the richness, complexity, and fruitfulness of the notion of the highest good. Microvascular development is determined by the interplay between tissue cells and microvascular endothelial cells. Because the pancreatic islet is an organ composed mainly of endothelial and endocrine cells, it represents a good model tissue for studying microvascular development in the context of a tissue. In this review, we will describe the special morphology of islet capillaries and its role in the physiologic function of islets: secretion of insulin in response to blood glucose levels. We will speculate on how islet‐secreted VEGF‐A (...) generates a permeable endothelium that allows insulin to pass quickly into the blood stream. In addition, we speculate on how endothelial cells might form a capillary lumen within the islets. At the end, we look at the islet microvasculature from a medical point of view, thus describing its critical role during type I diabetes and islet transplantation. The extent to which machine metaphors are used in synthetic biology is striking. These metaphors contain a specific perspective on organisms as well as on scientific and technological progress. Expressions such as “genetically engineered machine”, “genetic circuit”, and “platform organism”, taken from the realms of electronic engineering, car manufacturing, and information technology, highlight specific aspects of the functioning of living beings while at the same time hiding others, such as evolutionary change and interdependencies in ecosystems. Since these latter aspects are (...) relevant for, for example, risk evaluation of uncontained uses of synthetic organisms, it is ethically imperative to resist the thrust of machine metaphors in this respect. In addition, from the perspective of the machine metaphor viewing an entity as a moral agent or patient becomes dubious. If one were to regard living beings, including humans, as machines, it becomes difficult to justify ascriptions of moral status. Finally, the machine metaphor reinforces beliefs in the potential of synthetic biology to play a decisive role in solving societal problems, and downplays the role of alternative technological, and social and political measures. In natural kind debates, Boyd's famous Homeostatic Property Cluster theory (HPC) is often misconstrued in two ways: Not only is it thought to make for a normative standard for natural kinds, but also to require the homeostatic mechanisms underlying nomological property clusters to be uniform. My argument for the illegitimacy of both overgeneralizations, both on systematic as well as exegetical grounds, is based on the misconstrued view's failure to account for functional kinds in science. I illustrate the combination of these (...) two misconstruals with recent entries into the natural kind debate about emotions. Finally, I examine and reject Stich's "Kornblith-Devitt method" as a potential justification of these misconstruals. (shrink)

This paper reports research on the influence of corporate and individual characteristics on managers'' social orientation in Germany. The results indicate that mid-level managers expressed a significantly lower social orientation than low-level managers, and that job activity did not impact social orientation. Female respondents expressed a higher social orientation than male respondents. No impact of the political system origin (former East Germany versus former West Germany) on social orientation was shown. Overall, corporate position had a significantly higher impact on social (...) orientation than did the characteristics of the individuals surveyed. (shrink)

Plato's Philebus contains an intricate difficulty. Plato seems to hold both (a) that all pleasures are processes of becoming, a crucial premise in the argument that no pleasure is good (53c?55c) and (b) that some pleasures contribute in their own right to the goodness of the best life (64c?67b). Since it seems also plausible that only things which are good can contribute to the goodness of the best life in their own right, Plato's view seems to be inconsistent. Interpreters usually (...) reject either (a) or (b). As Plato seems firmly committed to both (a) and (b), I propose a third way of dealing with the inconsistency. The apparent inconsistency highlights a vital contrast between what is independently good (good per se), what is dependently good (good through participating in what is independently good), and what is derivatively good (good through standing in a certain relation to dependent goods). I argue that while pleasure's being a process of becoming marks it out as derivatively good, some kinds of pleasure are also dependent goods in virtue of their objects ? irrespective of their being processes of becoming. This chapter proceeds from the standard picture of the relation between intuitions and experimental philosophy: the alleged evidential role of intuitions about hypothetical cases, and experimental philosophy’s challenge to these judgments, based on their variation with philosophically irrelevant factors. I will survey some of the main defenses of this standard picture against the x-phi challenge, most of which fail. Concerning the most popular defense, the expertise defense, I will draw the bleak conclusion that intuitive expertise of the envisaged kind is (...) largely a myth. Next, I will consider the mischaracterization objection, which has mainly been developed by Deutsch and Cappelen on the basis of textual evidence: that philosophers do not appeal to intuitions as evidence for their case judgments, but instead argue for them. This would render the x-phi challenge mostly irrelevant, due to its focus on intuitions about hypothetical cases. I will then consider a few instructive replies to the mischaracterization objection, which are all unconvincing on further inspection. Finally, I will discuss some potential normative consequences of the mischaracterization objection, and I will argue that it recommends a shift away from the excessive focus on intuitions about cases in metaphilosophy and experimental philosophy, towards more work on the role of argumentation in the method of cases. More speculatively, I claim that philosophers should always argue for their case judgments, even if they have strong intuitions about them, because an argument-based methodology would be more transparent and philosophically fruitful than one that mainly relies on intuition. Synthetic biology can be understood as expanding the abilities and aspirations of genetic engineering. Nonetheless, whereas genetic engineering has been subject to criticism due to its endangering biodiversity, synthetic biology may actually appear to prove advantageous for biodiversity. After all, one might claim, synthesizing novel forms of life increases the numbers of species present in nature and thus ought to be ethically recommended. Two perspectives on how to spell out the conception of intrinsic value of biodiversity are examined in order (...) to assess this line of thought. At the cost of introducing two separate capacities of human knowledge acquisition, the ‘admiration stance’ turns out to reject outright the assumption of a synthetic species' intrinsic value and of an imperative to create novel species. The ‘kinship stance’ by contrast does ascribe value to both synthetic and natural species and organisms. Nonetheless, while from this perspective creating novel species may become an ethical demand under certain conditions, it favours changing organisms by getting in contact with them rather than synthesizing them. It is concluded that neither the admiration nor the kinship stance warrants a supposed general moral obligation to create novel species to increase biodiversity. (shrink)

A historical episode of evolutionary theory, which has lead to the Red Queen theory of the evolutionary maintenance of sex, includes two striking contingencies. These are used to explore alternative what-if scenarios, in order to test some common opinions about such counterfactuals. This sheds new light on the nature of science and its historiography. One counterfactual leads to an unexpected convergence of its result to that of the actual science but, nevertheless, differs in its causal structure. The other diverges towards (...) an incompatible alternative, but this requires further contingent choices that also diverge from actual science. -/- The convergence in the first counterfactual is due to a horizontal transfer of knowledge. Similar transfers of knowledge are typical for innovations of actual science. This suggests that contingent choices can merge as well as fork research traditions both in actual research and counterfactual history. Neither the paths of the actual history of science nor those of its counterfactual alternatives will form a tree of exclusively diverging bifurcations, but a network instead. Convergencies in counterfactuals may, therefore, be due to the web-structure of science as much as to the aims of the historians in question. Furthermore, the difference in causal structure between the actual science and its convergent counterfactual might become diagnostic for external factors rather than internal aims forcing a historian towards convergence. Current models of speech motor control rely on either trajectory-based control (DIVA, GEPPETO, ACT) or a dynamical systems approach based on feedback control (Task Dynamics, FACTS). While both approaches have provided insights into the speech motor system, it is difficult to connect these findings across models given the distinct theoretical and computational bases of the two approaches. We propose a new extension of the most widely used dynamical systems approach, Task Dynamics, that incorporates many of the strengths of trajectory-based approaches, (...) providing a way to bridge the theoretical divide between what have been two separate approaches to understanding speech motor control. The Task Dynamics (TD) model posits that speech gestures are governed by point attractor dynamics consistent with a critically damped harmonic oscillator. Kinematic trajectories associated with such gestures should therefore be consistent with a second-order dynamical system, possibly modified by blending with temporally overlapping gestures or altering oscillator parameters. This account of observed kinematics is powerful and theoretically appealing, but may be insufficient to account for deviations from predicted kinematics – i.e., changes produced in response to some external perturbations to the jaw, changes in control during acquisition and development, or effects of word/syllable frequency. Optimization, such as would be needed to minimize articulatory effort, is also incompatible with the current TD model, though the idea that the speech production systems economizes effort has a long history and, importantly, also plays a critical role in current theories of domain-general human motor control. To address these issues, we use Dynamic Movement Primitives (DMPs) to expand a dynamical systems framework for speech motor control to allow modification of kinematic trajectories by incorporating a simple, learnable forcing term into existing point attractor dynamics. We show that integration of DMPs with task- based point-attractor dynamics enhances the potential explanatory power of TD in a number of critical ways, including the ability to account for external forces in planning and optimizing both kinematic and dynamic movement costs. At the same time, this approach preserves the successes of Task Dynamics in handling multi-gesture planning and coordination. (shrink)

According to the ‘expertise defence’, experimental findings suggesting that intuitive judgments about hypothetical cases are influenced by philosophically irrelevant factors do not undermine their evidential use in (moral) philosophy. This defence assumes that philosophical experts are unlikely to be influenced by irrelevant factors. We discuss relevant findings from experimental metaphilosophy that largely tell against this assumption. To advance the debate, we present the most comprehensive experimental study of intuitive expertise in ethics to date, which tests five well- known biases of (...) judgment and decision-making among expert ethicists and laypeople. We found that even expert ethicists are affected by some of these biases, but also that they enjoy a slight advantage over laypeople in some cases. We discuss the implications of these results for the expertise defence, and conclude that they still do not support the defence as it is typically presented in (moral) philosophy. (shrink)

Since intelligent design (ID) advocates claimed the ubiquitous mouse trap as an example of systems that cannot have evolved, mouse trap history is doubly relevant to studying material culture. On the one hand, debunking ID claims about mouse traps and, by implication, also about other irreducibly complex systems has a high educational value. On the other hand, a case study of mouse trap history may contribute insights to the academic discussion about material culture evolution. Michael Behe argued that mouse traps (...) cannot trap mice with any part missing; therefore, they cannot have a precursor with one part less, therefore, cannot have a continuous history, and therefore, cannot have evolved. The patented and seminal precursor of current flat snap traps, however, had one part less, because spring and striker were formed of one wire. Secondly, historical records that reach back into the Bronze Age suggest that its history continued for a very long time. Thirdly, all prerequisites for evolution (variation, transmission, and selection) abound in mouse trap populations. Hence, Behe’s triple-jump conclusion about mouse traps is false each step. There is no, in principle, impossibility for mouse traps to evolve. An evolutionary account of mouse trap history also has academic merits beyond its educational value. Three important conclusions can be drawn: (1) reticulate phylogenies of artifact systems may be resolvable as overlapping, but branching, phylogenies of parts; (2) homologous ideas may be realized by analogous material, that is, phylogenies of information do not necessarily coincide with those of material parts; (3) recombination of parts between different artifact systems increases the cumulative nature of cultural evolution.
