There are countless circumstances under which random individuals COULD act together to prevent something morally bad from happening or to remedy a morally bad situation. But when OUGHT individuals to act together in order to bring about a morally important outcome? Building on Philip Pettit’s and David Schweikard’s account of joint action, I will put forward the notion of joint duties: duties to perform an action together that individuals in so-called random or unstructured groups can jointly hold. I will show (...) how this account of joint duties is preferable to one which defends individual duties to cooperate. I then discuss the limits of joint duties and the ways in which one can fail to comply with them. It will become apparent that the circumstances under which individuals in random collectives acquire such joint duties are rare. (shrink)

Our moral obligations can sometimes be collective in nature: They can jointly attach to two or more agents in that neither agent has that obligation on their own, but they – in some sense – share it or have it in common. In order for two or more agents to jointly hold an obligation to address some joint necessity problem they must have joint ability to address that problem. Joint ability is highly context-dependent and particularly sensitive to shared (or even (...) common) beliefs. As such, joint ability can be deliberately generated in a given collection of agents by providing information related to collective goals and contributory actions. As moral agents, we regularly face problems wherein the outcome of our actions depends on how others choose. There are two ways of deliberating about our own choices in such cases. We can either think of our choices as best responses to others’ choices (I-mode reasoning). Or we can think of our own choices as contributions to the collectively best option (even when we do not know how others are (likely) to choose) (we-mode reasoning). In deliberating about the right (individual) course of action vis-à-vis collective action problems, agents regularly we-frame the case at hand, that is, they include options in their deliberation that are only collectively available, and they we-reason with regard to their individual contributory actions. It is a necessary condition for collective obligations that potential collaborators facing a joint necessity case have grounds to privilege we-reasoning over reasoning in I-mode. (shrink)

Prison work creates ethical challenges for which a training program was initiated for Dutch prison staff to foster their Moral Craftsmanship (MCS). The concept of MCS is not yet defined and operationalized in literature. This explorative study aims to 1) define MCS, 2) identify conceptual elements of MCS, and 3) develop a measurement tool for MCS. A document and literature study provided input for the definition and selection of conceptual elements related within DCIA policy documents, identifying three conceptual levels of (...) MCS: individual (cognition, attitude, and actions), team, and leadership. This first MCSQ consists of seventy-one items distributed across the domains: values and norms, judgment and reasoning, consultation, implementation, looking back, interactions, and leadership. We tested its usability via ‘think-aloud interviews.’ Validation of the current version of the MCS-Questionnaire and consensus among experts about what to include or exclude in the concept of MCS are needed for further development. School-based education in England has undergone significant changes since 2010, with a huge expansion of academies, schools outside local authority control, funded directly by central government. Academies and local authority (LA) maintained schools are subject to different legislative and regulatory frameworks. This paper focuses on the governance of LA maintained schools, single academy trusts (SATs) and schools that are part of multi-academy trusts (MATs). The research involved analysing legislative provision, policy documents, and documents addressing the governance arrangements of a sample (...) of 23 secondary schools. Our findings reveal a fragmented state-funded secondary school system as regards overall governance, school admissions, the curriculum, and the use of funding. Significantly schools in MATs, which are governed by the trust board, lack the autonomy of either SATs or maintained schools and are instead under the ultimate control of the trust board. The paper argues that there is a need for greater consistency regarding the governance of state-funded schools. (shrink)

Avant et pendant la Première Guerre mondiale, en Occident, ont fleuri des mouvements qui, parce qu'ils ont conjointement revendiqué un renouvellement radical des pratiques artistiques et une remise en question sociale plus large, ont a posteriori été appelés «avant-gardes». Ce sont ces mouvements qui, du futurisme italien à dada en passant par le futurisme russe, l'imagisme et le vorticisme, sont au centre de cet ouvrage. Aucun, au moment de sa fondation, ne s'est pensé d'«avant-garde». Medicine, Power, and the Law demonstrates that criminal and civil justice interact with medicine and public health more than is presently understood. In this chapter I investigate the kinds of changes that psychiatric kinds undergo when they become explanatory targets of areas of sciences that are not “mature” and are in the early stages of discovering mechanisms. The two areas of science that are the targets of my analysis are cognitive neuroscience and cognitive neurobiology.

This paper offers a critique of an account of explanatory integration that claims that explanations of cognitive capacities by functional analyses and mechanistic explanations can be seamlessly integrated. It is shown that achieving such explanatory integration requires that the terms designating cognitive capacities in the two forms of explanation are stable but that experimental practice in the mind-brain sciences currently is not directed at achieving such stability. A positive proposal for changing experimental practice so as to promote such stability is (...) put forward and its implications for explanatory integration are briefly considered. (shrink)

Der von Anne Tilkorn herausgegebene Sammelband Kant und Spinoza. Motivationen fur das Selbst beschaftigt sich mit den verborgenen Gemeinsamkeiten der beiden Philosophen in ihren Letztbegrundungen fur moralisches Handeln. Im Mittelpunkt stehen dabei die Begriffe der Selbstreferenz und Freiheit. Die Beitrage gehen den Folgen der sowohl bei Kant als auch bei Spinoza anzutreffenden Grundannahme einer "Ent-Aristotelisierung" auf dem Gebiet der Motivationstheorien, also der praktischen Philosophie nach. Dass zum Handeln auch eine Motivation gehort, ist fur beide Denker klar. Spinoza wie Kant wussten (...) um die Relevanz des Gefuhls - nicht als Fundament einer Moral, aber als notwendiger Beweggrund fur den Vollzug des moralischen Tuns. Und sie haben des Ofteren dieselbe Einschatzung hinsichtlich des Stellenwerts bestimmter Gefuhle: So sehen sie beide im Mitleid eine Schwache und keine Tugend, von beiden Philosophen ist der Ausspruch "Die Tugend ist ihr eigener Lohn" bekannt. Doch wo begegnen sich ihre Theoriestrukturen? Trotz der auf den ersten Blick so grossen Differenzen - Spinozas Determinismus versus Kants freier Wille, Spinozas Ansatz einer Einheit von Theorie und Praxis versus Kants strikte Unterscheidung zwischen theoretischer und praktischer Vernunft - lassen sich viele kongruente Linien in ihren Argumenten entdecken, die nun in fundierten Einzelstudien herausgestellt werden. Immortalité de l'âme, intelligence, distinction des substances, vie éternelle: ces questions, qui sont au coeur de la réflexion sur la nature de l'être humain, ont passionné les philosophes et les lettrés du Grand Siècle et du Siècle des Lumières. Un débat animé, polémique, s'est noué dans toute l'Europe savante et, notamment, de part et d'autre de la Manche. Avec pour fil conducteur l'émergence d'une conception laïque et matérielle de l'être humain, Ann Thomson nous fait partager l'effervescence féconde de ces échanges (...) et de ces débats. Elle nous initie aux polémiques théologico-politiques qui ont nourri la "crise de la conscience européenne" et ses prolongements, jusqu'au milieu du XVIIIesiècle. Consacrée à l'Angleterre après la Glorieuse Révolution de 1688, la première partie analyse les luttes idéologiques et religieuses de la fin du XVIIe et du début du XVIIIe siècle, replacées dans leur contexte historique, philosophique et scientifique, avant d'étudier la controverse sur Dieu, sur l'âme et sur la nature humaine. La deuxième partie, centrée sur les "premières Lumières" françaises, suit le cheminement des échos de ces controverses anglaises transmis par les passeurs huguenots et les voies clandestines de la circulation philosophique, puis analyse la spéculation scientifique et philosophique dans la première moitié du XVIIIe siècle. Ces vifs débats ont fait naître de multiples courants qui ont permis l'éclosion et l'épanouissement d'une pensée matérialiste qui s'affirma à partir des années 1760, dans le cadre, notamment, dune réflexion sur la génération. En soulignant le rôle joué par les polémiques théologiques protestantes mais également par la recherche médicale, cet essai d'histoire intellectuelle, transnationale, nous transporte au coeur de la philosophie des Lumières, et des "Lumières radicales". En même temps, il s'inscrit clans une histoire de longue durée, car les questions soulevées par ce livre continuent aujourd'hui d'interpeller les théologiens, les philosophes, les anthropologues, les neurobiologistes. Les penseurs des Lumières furent aux avant-postes d'une vertigineuse interrogation sur l'identité et la nature de l'homme. This book collects a multidisciplinary range of contributions focusing on the prolific and seminal work of Willem Drees in the fields of philosophy of religion, philosophy of the humanities, and science and theology/religion. Trained in both theoretical physics and theology/philosophy of religion, Drees holds doctoral degrees in both theology and in philosophy and, amongst other distinguished positions, held professorships at the University of Leiden and at the University of Tilburg. Drees was also Editor-in-Chief of Zygon, Journal of Religion & Science, (...) between 2008 and 2018, and served as President of the European Society for the Study of Science and Theology (ESSSAT) between 2002 and 2008. In 2018, he was elected as member of the Royal Holland Society of Sciences and Humanities (KHMW). This contributed volume builds on Drees’ expansive and provocative scholarly contributions, notably around the concept and meaning of naturalism and the humanities to the fields of science and religion, as exemplified by his works Religion, Science and Naturalism (1996) and What Are the Humanities For? (2021). In a time where more and more young people across the globe are entering higher education such cross-disciplinary explorations and (re-)evaluations are vital to the field. Accordingly, by approaching his work from a variety of disciplines this collection illuminates the broad reach of Drees’ work and provides scholars from various fields with many new and rich opportunities avenues for research. In dialogue with the most famous myth for the origin of different languages - The Tower of Babel - A Psychoanalytic Exploration on Sameness and Otherness: Beyond Babel provides a series of timely reflections on the themes of sameness and otherness from a contemporary psychoanalytic perspective. How are we dealing with communication and its difficulties, the confusion of tongues and loss of common ground within a European context today? Can we move beyond Babel? Confusion and feared loss of shared values (...) and identity are a major part of the daily work of psychoanalytic psychotherapists. Bringing together an international range psychoanalytic practitioners and researchers, the book is divided into six parts and covers an array of resonant topics, including: language and translation; cultural identity; families and children; the cyber world; the psychotherapeutic process; and migration. Whereas the quest for unity, which underpins the myth of Babel, leads to mystification, simplification and the exclusion of people or things, multilingual communities necessitate mutual understanding through dialogue. This book examines those factors which further or threaten communication, aiming not to reduce but to gain complexity. It suggests that diversification enriches communication and that, by relating to others, we can create something new. As opposed to cultural and linguistic homogeneity, Babel is not only a metaphor for mangled communication, alienation, and distraction, it is also about the acceptance or rejection of differences between self and other. L'ouvrage publié réunit les actes d'une journée d'étude consacrée à L'imprévu et le droit, souhaitée par les doctorants et organisée par l'Ecole doctorale de droit comparé de l'Université Paris 1 Panthéon-Sorbonne. Le sujet est immédiatement apparu très riche. Si le terme d'imprévu n'est pas essentiellement juridique, il fait écho à des critères du droit tels que la prévisibilité d'une situation ou d'un texte, ou l'imprévisibilité d'un événement comme cause exonératoire de responsabilité. Il renvoie plus généralement à l'exigence de sécurité juridique (...) qui s'opposerait à l'imprévu juridique. En outre le contexte était des plus propices, quelle que soit la discipline concernée, droit public, droit privé et/ou droit pénal. L'imprévu est entendu comme tout ce qui n'a pas été prévu, tout ce qui arrive lorsqu'on ne s'y attend pas. Prévoir, c'est admettre comme probable. La question de l'imprévu confronté au droit est intéressante car les deux concepts semblent antinomiques. Le droit apparaît en effet comme quelque chose de figé, permettant de régler par anticipation les comportements humains. Il doit permettre à chacun de régler sa conduite puisque nul n'est censé ignorer la loi. Le droit doit donc être à la fois connu et prévisible dans ses effets même s'il n'en est pas toujours ainsi. La notion d'imprévu semble rencontrer le droit de deux manières. D'une part, il existe la norme imprévue : la norme nouvelle, la coutume en formation ou l'interprétation surprenante. Se posent alors les questions de la prévisibilité du droit, et corrélativement celle de la sécurité juridique. D'autre part, il y a le fait imprévu. La norme doit se saisir de comportements humains ou de situations de fait qui n'avaient pas été anticipés. L'appréhension du risque et de la survenance d'événements inattendus par des règles de droit préexistantes devient alors un enjeu essentiel. (shrink)

This book is the result of intensive and continued discussions about the social role of language and its conceptualisations in societies other than Northern (European-American) ones. Language as a means of expressing as well as evoking both interiority and community has been in the focus of these discussions, led among linguists, anthropologists, and Egyptologists, and leading to a collection of essays that provide studies that transcend previously considered approaches. Its contributions are in particular interested in understanding how the attitude of (...) the individual towards societal processes and strategies of norming is negotiated emotionally, and how individual interests and attitudes can be articulated. Discourses on public spaces are in the focus, in order to analyse those strategies that are employed to articulate dissent (for example, in the sense of face-threatening acts). This raises a number of questions on the spatial and public situatedness of emotions and language: How is the public space dealt with and reflected in language as property, heritage, and as a part of ascribed identities? Which role do emotions play in this space? How is emotion employed there as part of place making in relation to identity constructions? What is the connection between emotion, performance and emblematic spaces and places? Which opportunities of the violation of norms and transgression do such public spaces offer to actors and speakers?
