A full account of the philosophy of the Greek and Roman worlds from the last days of Aristotle until 100 BC. Hellenistic philosophy, for long relatively neglected and unappreciated, has over the last decade been the object of a considerable amount of scholarly attention. Now available in paperback, this 1999 volume is a general reference work which pulls the subject together and presents an overview. Health care is transitioning from genetics to genomics, in which single-gene testing for diagnosis is being replaced by multi-gene panels, genome-wide sequencing, and other multi-genic tests for disease diagnosis, prediction, prognosis, and treatment. This health care transition is spurring a new set of increased or novel liability risks for health care providers and test laboratories. This article describes this transition in both medical care and liability, and addresses 11 areas of potential increased or novel liability risk, offering recommendations to both (...) health care and legal actors to address and manage those liability risks. Outlines of Scepticism, by the Greek philosopher Sextus Empiricus, is a work of major importance for the history of Greek philosophy. It is the fullest extant account of ancient scepticism, and it is also one of our most copious sources of information about the other Hellenistic philosophies. Its first part contains an elaborate exposition of the Pyrrhonian variety of scepticism; its second and third parts are critical and destructive, arguing against 'dogmatism' in logic, epistemology, science and ethics - an approach (...) that revolutionized the study of philosophy when Sextus' works were rediscovered and published in the sixteenth century. In this paper, I argue for a new way of characterizing ontological emergence. I appeal to recent discussions in meta-ontology regarding fundamentality and dependence, and show how emergence can be simply and straightforwardly characterized using these notions. I then argue that many of the standard problems for emergence do not apply to this account: given a clearly specified meta-ontological background, emergence becomes much easier to explicate. If my arguments are successful, they show both a helpful way of thinking about emergence (...) and the potential utility of discussions in meta-ontology when applied to first-order metaphysics. Although science was once seen as the product of individual great men working in isolation, we now realize that, like any other creative activity, science is a highly social enterprise, influenced in subtle as well as obvious ways by the wider culture and values of its time. Aristotle is one of the very greatest thinkers in the Western tradition, but also one of the most difficult. The contributors to this volume do not attempt to disguise the nature of that difficulty, but at the same time they offer a clear exposition of the central philosophical concerns in his work. Approaches and methods vary and the volume editor has not imposed any single interpretation, but has rather allowed legitimate differences of interpretation to stand. An introductory chapter provides an (...) account of Aristotle's life, and then guides the reader through the complex subject of what Aristotle actually wrote as a basis for characterising his philosophical development. Subsequent chapters cover Aristotle's writings on logic, metaphysics, science, psychology, ethics, politics, rhetoric, and poetics. Philip Kitcher has proposed a theory of explanation based on the notion of unification. Despite the genuine interest and power of the theory, I argue here that the theory suffers from a fatal deficiency: It is intrinsically unable to account for the asymmetric structure of explanation, and thus ultimately falls prey to a problem similar to the one which beset Hempel's D-N model. I conclude that Kitcher is wrong to claim that one can settle the issue of an argument's explanatory (...) force merely on the basis of considerations about the unifying power of the argument pattern the argument instantiates. The theory of explanatory unification was first proposed by Friedman (1974) and developed by Kitcher (1981, 1989). The primary motivation for this theory, it seems to me, is the argument that this account of explanation is the only account that correctly describes the genesis of scientific understanding. Despite the apparent plausibility of Friedman's argument to this effect, however, I argue here that the unificationist thesis of understanding is false. The theory of explanatory unification as articulated by Friedman and Kitcher thus (...) emerges as fundamentally misconceived. (shrink)

I aim to show that one way of testing the mettle of a theory of scientific explanation is to inquire what that theory entails about the status of brute facts. Here I consider the nature of brute facts, and survey several contemporary accounts of explanation vis a vis this subject. One problem with these accounts is that they seem to entail that brute facts represent a gap in scientific understanding. I argue that brute facts are non-mysterious and indeed are even (...) explainable by the lights of Salmon's ontic conception of explanation. The plausibility of various models of explanation, I suggest, depends to some extent on the tendency of their proponents to focus on certain examples of explananda - I ponder brute facts qua explananda here as a way of helping us to recognize this dependency. Sweatshop labour is sometimes defended from critics by arguments that stress the voluntariness of the worker’s choice, and the fact that sweatshops provide a source of income where no other similar source exists. The idea is if it is exploitation—as their opponents charge—it is mutually beneficial and consensual exploitation. This defence appeals to the non-worseness claim (NWC), which says that if exploitation is better for the exploited party than neglect, it cannot be seriously wrong. The NWC renders otherwise exploitative—and therefore (...) morally wrong—transactions permissible, making the exploitation of the global poor a justifiable path to development. In this paper, I argue that the use of NWC for the case of sweatshops is misleading. After reviewing and strengthening the exploitation claims made concerning sweatshops, most importantly by refuting certain allegations that a micro-unfairness account of exploitation cannot evaluate sweatshop labour as exploitative, I then argue that even if this practice may seem permissible due to benefits otherwise unavailable to the global poor, there remains a duty to address the background conditions that make this form of wrong-doing possible, which the NWC cannot accommodate. I argue that the NWC denies this by unreasonably limiting its scope and is therefore incomplete, and ultimately unconvincing. (shrink)

We contend that empathy is best viewed as a kind of analogical thinking of the sort described in the multiconstraint theory of analogy proposed by Keith Holyoak and Paul Thagard (1995). Our account of empathy reveals the Theory-theory/Simulation theory debate to be based on a false assumption and formulated in terms too simple to capture the nature of mental state ascription. Empathy is always simulation, but may simultaneously include theory-application. By properly specifying the analogical processes of empathy and their constraints, (...) we are able to show how the amount of theory needed to empathize is determined. (shrink)

A novel Protocol Ethics Tool Kit (‘Ethics Tool Kit’) has been developed by a multi-stakeholder group of the Multi-Regional Clinical Trials Center of Brigham and Women9s Hospital and Harvard. The purpose of the Ethics Tool Kit is to facilitate effective recognition, consideration and deliberation of critical ethical issues in clinical trial protocols. The Ethics Tool Kit may be used by investigators and sponsors to develop a dedicated Ethics Section within a protocol to improve the consistency and transparency between clinical trial (...) protocols and research ethics committee reviews. It may also streamline ethics review and may facilitate and expedite the review process by anticipating the concerns of ethics committee reviewers. Specific attention was given to issues arising in multinational settings. With the use of this Tool Kit, researchers have the opportunity to address critical research ethics issues proactively, potentially speeding the time and easing the process to final protocol approval. In both academic literature and the media, financial conflicts of interest in human subjects research have come center-stage. The cover of a recent edition of Time magazine features a research subject in a cage with the caption human guinea pigs, signifying perhaps that human research subjects are no more protected from research abuses than are laboratory animals. That magazine issue highlights three well-publicized cases of human subjects research violations that occurred at the University of Oklahoma, the University of Pennsylvania, and (...) Johns Hopkins University.At St. John Medical Center in Tulsa, Oklahoma, a study that was co-sponsored by the University of Oklahoma Health Sciences Center investigated an experimental vaccine for malignant melanoma. In that case, the chair of the university's institutional review board — the committee within each medical institution charged with ethics review of human research projects undertaken at that institution — and the dean of the University's College of Medicine allegedly concealed from both the IRB and the United States Food and Drug Administration a report by an outside consulting firm that had found severe deficiencies with the melanoma vaccine study being conducted at the medical center. Predictivism holds that, where evidence E confirms theory T, E confirms T more strongly when E is predicted on the basis of T and subsequently confirmed than when E is known in advance of T's formulation and used, in some sense, in the formulation of T. Predictivism has lately enjoyed some strong supporting arguments from Maher (1988, 1990, 1993) and Kahn, Landsberg, and Stockman (1992). Despite the many virtues of the analyses these authors provide it is my view that they (...) (along with all other authors on this subject) have failed to understand a fundamental truth about predictivism: the existence of a scientist who predicted T prior to the establishment that E is true has epistemic import for T (once E is established) only in connection with information regarding the social milieu in which the T-predictor is located and information regarding how the T-predictor was located. The aim of this paper is to show that predictivism is ultimately a social phenomenon that requires a social level of analysis, a thesis I deem social predictivism. (shrink)

The five hundred years from 300 B.C. to A.D. 200 were a period during which Greek science made spectacular advances and Greek philosophy underwent dramatic changes. How much did the scientists take note of the philosophical issues bearing on their pursuits? What progress did the philosophers make with methodological and theoretical issues arising out of developments in science? What influence did philosophical criticism or philosophical ideas have on specific theories in medicine or mechanics, mathematics or astronomy? These are some of (...) the questions discussed in this series of papers by the distinguished scholars who took part in the Confe;rence Hellenistique in Paris in 1980. The result is a broad-ranging and pioneering volume which will be of importance to scholars in the history and philosophy of science and to those whose interests lie in classical philosophy. : "Technoscience" is now most commonly used in academic work to refer to sets of activities wherein science and technology have become inextricably intermingled, or else have hybridized in some sense. What, though, do we understand by "science" and by "technology"? The use of these terms has varied greatly, but their current use presumes a society with extensive institutional and occupational differentiation. Only in that kind of context may science and technology be treated as "other" in relation to "the rest" (...) of the social order; whether as differentiated sets of practices or as specialized institutional forms. References to "technoscience" may then be taken to imply a reversal of earlier processes of cultural and institutional differentiation and/or a recombination of separate bodies of practice and skill. Either way a move back to a less differentiated state is implied, which makes it surprising that we appear to have very few memories of technoscience in periods less culturally and institutionally differentiated than our own and a lower level of technical and intellectual division of labor. However, the elusiveness of our memories of technoscience may be significant mainly for what it suggests about our ways of conceptualizing the past, rather than for any insight it offers into that past "itself." We tend to identify practices and networks of practices in terms of functions. And it may be because, at different times, different functions have been selected as constitutive of practices, that "technoscience" has come to be regarded as something especially characteristic of the present. Many of the reasons offered for outsourcing security involve costs and benefits – a consequentialist way of reasoning. Thus, I will explore a consequentialist argument against the use of private security contractors (PSCs) in counterinsurgencies. Discussing the benefits and costs of employing PSCs in these kinds of operations will demonstrate that the hiring of PSCs in many cases (perhaps in most) is consequentially unsound. More precisely, the overall negative consequences of hiring PSCs during counterinsurgencies should preclude their use unless in (...) extreme emergencies. Defenders of the use of PSCs readily point to their financial benefits and expected increase in efficiency as the starting point for their argumentation. On my account, if the benefits really do outweigh the foreseeable and expected costs, then hiring PSCs may, in that case, be a morally viable option. However, I contend that, unless we institute broad contractual control and oversight reform, unless we truly understand the costs and benefits, we should have a standing, prima facie prohibition against employing PSCs in counterinsurgencies. The commonly perceived tension between authentic moral and ethical action and action involving tolerance is held to be the illusory product of an unduly individualistic frame of thought. Moral and ethical actions are produced not by independent individuals but by participants in cultural traditions. And even the wholly routine continuation of a single homogeneous tradition must always and invariably involve mutual tolerance: participants must interact not as independent individuals but as tolerant members. Tolerance deserves recognition, accordingly, as a primary virtue, (...) not merely compatible with authentic moral and ethical action, but required by it. An explicit rhetoric enjoining tolerance needs to be understood as performative discourse employed to change, or else to sustain, the systems of tolerances in which all cultures, whether simple or differentiated, homogeneous or diverse, unified or fragmented, invariably consist. Any organised society needs some method for determining common policy: public decisions must be forged from private preferences, and particular interests must find a reconciliation in the general good. A society is tolerable only if its decisions are reached by a rational path; for, just as a reasonable man decides his private life on the basis of reasonable procedures, so a reasonable society must formulate its communal behaviour on the basis of reasonable principles. Numerous evaluations of the Bean/Cowpea Collaborative Research Support Program (CRSP) have documented CRSP contributions to food production and availability with impacts valued in the millions of dollars in developing countries as well as in the US. These reports emphasized collaboration as a critical factor in the success that emanated from CRSP research and training. Real collaboration among males and females across disciplinary, national, ethnic, cultural, and language differences is not easy. This review of CRSP experiences in building productive collaborations gives (...) actual case studies, including some failures, and discusses lessons learned in the process. The importance of wide participation, shared resources, and facilitated interpersonal relations to back up the dedication and commitment of the participants in emphasized. The program represents an investment of the US Agency for International Development with contributions in excess of 25 percent from participating US and Host Country institutions. (shrink)
