In the German intellectual context, the answer to this question could be as laconic (...) as it would be superfluous: it consists in a deictic reference to the name and, implicitly, to the work of Niklas Luhmann. American readers, in contrast, may need some introductory explanation in order to understand the epistemological triangle between contemporary pedagogical thought, Maturana's biology, and Luhmann's philosophy—and, above all, in order to assess and even to appreciate its intellectual potential.Niklas Luhmann is certainly difficult to read, at least for starters, and to those who met him during his lifetime he invariably appeared to be a dead-serious person. But today, more than five years after Luhmann's death, we begin to discover traces of a sometimes uncanny irony—one may want to call it a "practical irony"—in his writing. One of the discursive gestures that characterized Luhmann's texts were references to academic authors who nobody had ever heard of (let alone read), presented with the same seriousness and with the same attitude of intellectual reverence that we normally reserve for the classics: for example, to the logician Gotthart Guenter, the philosopher Fritz Heider, the biologist Humberto Maturana, or the mathematician George Spencer Brown. There is no doubt that, in each case, a specific concept or a specific thought developed by one of these authors had turned out to be truly important within Luhmann's own work, and yet the "effects of authority" that his very serious quotes produced were nothing short of hilarious. For Luhmann's readers, with that self-flagellating attitude in which we academics so like to indulge, quite regularly attributed the experience that they had never heard of those seeming "authorities" to their own lack of intellectual cosmopolitanism. This is why, until the present day, some departments of sociology or philosophy in Germany have Spencer Brown or Guenter specialists on their payrolls, and this also explains why some of those authors have had moments of intense reception [End Page 22] in the world of the humanities and social sciences at German universities. Among them, Humberto Maturana, together with his co-author the late Francisco Varela, seem to be the exception confirming the rule that none of those Luhmann references had the intellectual power to survive Luhmann himself.Now why should one trust Luhmann's trust in Maturana? The debate about the importance of Luhmann's thought (he labeled it a "theory of social systems") in the larger context of contemporary Western philosophy has barely begun to become serious, and we are certainly many years away from a definitive consensual evaluation. But there are two—very different—features about Luhmann's work that make him fascinating at first glance. One lies in the simple fact that, probably, no other thinker since Hegel has managed to develop a restrained set of basic concepts and premises into a systematically coherent philosophical edifice of similar proportions. In this sense, entering the dimension of Luhmann's thought offers the patient reader a possibility to view many familiar positions and questions from sometimes radically different innovative angles. Less obvious, however, and more intriguing is Luhmann's intellectual bet to develop his systemic thought under strict avoidance of notions such as "subject," "subjecthood," or "agency." It was this very bet (about whose existential and political motivations he only left some rather vague remarks) that explains Luhmann's fascination for much theoretical thinking emerging from biological research, above all for Humberto Maturana's work. For from a biological perspective, subjecthood and agency are highly marginal attributes in the realm of living organisms. I believe that this (almost hidden) component in Luhmann's thinking can explain the particularly strong affinity of contemporary pedagogical thought in Germany with his work. Although clinical trials of HIV vaccines began ten years ago in the US and Europe, an increasing number of trials are now being conducted or planned in other countries, including several that are considered “developing” countries. Safeguarding the rights and welfare of individuals participating as (...) research subjects in developing countries is a priority. In September, 1997, the Joint United Nations Programme on HIV/AIDS embarked on a process of international consultation; its purpose was further to define the important ethical issues and to formulate guidance that might facilitate the ethical design and conduct of HIV vaccine trials in international contexts. The paper is a critical discussion of scholarship on the "Critique of Pure Reason" published during the past ten years. The emphasis is on Anglo-American authors. I identify and discuss three main trends in the field: a shift from the general discussion of transcendental arguments to the analysis and evaluation of particular proofs in Kant; a renewed interest in the doctrine of transcendental idealism and the distinction between things in themselves and appearances; and the emergence of an entire body of (...) literature on Kant's philosophy of mind, centered around the idea of a "transcendental psychology." As Husserl already noticed, artworks themselves have a phenomenological character. This means, however, that to experience artworks as phenomena no “epoché” and no “phenomenological reduction” is necessary. The leading question of my essay is whether, and possibly how, this observation can be methodologically generalized for understanding phenomena. I discuss if, and possibly how, a phenomenological reflection on art allows and even demands a general conception of phenomenology that nevertheless does not confuse artworks with phenomena in general. My intention is to (...) show that and how phenomenality can be clarified with reference to its spatial character. Scientific exploration and thus our knowledge about the outside world is subject to the conditions of our experience.These conditions are condensed here into an interface model which,besides being physical,has an additional interface structure not reducible to physics. We suggest that this structure can dynamically be characterized by separate modes.Their selection and operation presupposes free will and a rudimentary concept of time and space. Dass Edmund Husserl am Problem der Intersubjektivität gescheitert ist, gilt als ausgemacht - und ebenso, welche Konsequenzen daraus zu ziehen sind. Entgegen dem allenthalben pauschal erklärten `Abschied vom Subjekt' spricht aber vieles dafür, dass es in der gegenwärtigen Sozialtheorie eher um eine Reformulierung transzendentaler Subjektivität geht. Diese Interpretationsthese wirft ein neues Licht auf den sozialtheoretischen Diskurs, der im deutschen Sprachraum in den vergangenen dreissig Jahren vom Gegensatz von Jürgen Habermas' und Niklas Luhmanns Theorien bestimmt war: `Diskurs' und `System' erscheinen als (...) gegensätzliche Versuche, `Subjektivität' und `Interität' in ein theoretisch befriedigendes Verhältnis zu setzen. Wenn aber - so die kritische These dieses Buches - weder die Reformulierung von Subjektivität als `Interität' noch die Reformulierung von Subjektivität ohne `Interität' das Problem der Intersubjektivität überzeugend löst, ist dies ein Grund, neuerlich in eine direkte Auseinandersetzung mit Husserls Theorie transzendentaler Subjektivität einzutreten. Dabei stellt sich heraus, dass Husserls vielkritisierter und -skandalisierter Versuch, den Sinn `Anderer' im `Eigenen' zu fundieren, in der transzendentalphänomenologischen Subjekttheorie durch ein umgekehrtes Begründungsverhältnis konterkariert wird. Bei aller Problematik dieser Theorieanlage - welche nur in Gegenwendung zu den Gewohnheiten der Husserl-Interpretation, vor allem aber auch zu Husserls Selbstinterpretation in den Blick kommt - zeigt sich, dass der phänomenologische Begriff des transzendentalen Subjekts seinen Reformulierungen als Diskurs und als System in mancher Hinsicht überlegen ist. This chapter investigates the idea of collective epistemic commonality suggested by Charles Taylor's example, and contrasts it with a distributive notion of epistemic commonality. It describes a number of accounts of collective epistemic commonality, and then argues that, contrary to what Taylor suggests, conversation is not constitutive of collective epistemic commonality as such, but rather presupposes basic forms of collective epistemic commonality. Taylor's remarks indicate that understanding the consensus is insufficient as whatever proposition people rationally and openly accept in conversation. (...) It is suggested that joint attitudes are irreducible, relational, and pre-reflective, and that such attitudes are joint, in the respect that the participants are aware of themselves as a ‘we’. Heidegger's Crisis shows not only how the Nazis exploited philosophical ideas and used philosophers to gain public acceptance, but also how German philosophers played into the hands of the Nazis. Hans Sluga describes the growth, from World War I onward, of a powerful right-wing movement in German philosophy, in which nationalistic, antisemitic, and antidemocratic ideas flourished.

The preceding Preface, which Professor William Frankena had the great kindness to write as an introduction for the readers of the present English translation of my major work, still requires several supplementary com­ ments on my part. Professor Frankena rightly considered it to be an advan­ tage to introduce the English-speaking world to my moral philosophy through its presentation in this book. As an introduction to my moral philosophy, Professor Frankena provided a concise formulation of the fun­ damental ideas of (...) my ethics by quoting from an article I had just recently published. Several points worth mentioning remain. Firstly, it is necessary to distinguish the two editions of the text here translated. The first edition was published in 1951 by Anton Hain in Meisenheim am Glan, under the title Pflicht und Neigung (Duty and In­ clination), with the subtitle Die Grundlagen der Sittlichkeit, erOrtert und neu bestimmt mit besonderem Bezug auf Kant und Schiller (The Fun­ damentals of Morality, Discussed and Redefined with Special Regard to Kant and Schiller). In 1974, a revised and enlarged second edition was published by the same publisher and was entitled Die Grundlagen der Sitt­ Iichkeit (The Fundamentals of Morality). Von schrottiger und guter und der heute üblichen Abwertung aller Musik wissen die Co-Autoren versiert zu berichten. Sie kennen und belichten den an seiner Digitalisierung gescheiterten Musikmarkt und dessen Abgründe sehr genau. Genussvoll analysieren sie am Beispiel eines Generationenkonflikts den Müllstatus, den Popmusik 2012 eingenommen hat. „In ihrem Essay Musik = Müll beschreiben die beiden Co-Autoren, warum die absichtliche Produktion von Müll heute genauso zum Medienalltag gehört wie der achtlose Musikkonsum im Minutentakt. Und die beiden wissen, wovon sie schreiben. Der (...) Komponist, Autor und gelernte Elektroakustiker Hans Platzgumer spielte und produzierte unter anderem mit den Goldenen Zitronen, Tocotronic und HP Zinker. Außerdem sind House- und Technoplatten von ihm bei Labels wie Domino Records oder Playhouse erschienen. Didi Neidhart ist seit mehr als 30 Jahren DJ und Musikjournalist, außerdem popkultureller Forscher und Chefredakteur des österreichischen Musikmagazins Skug. Doch trotz der geballten Sachkenntnis der beiden wird das gut 130 Seiten starke Buch nie wichtigtuerisch oder professorenhaft, was hauptsächlich an einem erfrischenden Generationenkonflikt liegt: Hans Platzgumer hat nämlich einen schwer pubertierenden Sohn, der die allerschlimmste aktuelle Popmusik als Rebellionsgrundlage gegen seinen schwer im Underground verwurzelten Musikervater nimmt... Gegen Ende kommen beide zu einer allgemeinen Gesellschaftskritik, die stellenweise zu weit geht respektive zu kurz greift. Abgesehen davon ist Musik = Müll jedoch ein sehr unterhaltsames Plädoyer für eine musikalische Wertschätzungs- oder zumindest Aufmerksamkeitssteigerung. Denn: Soll doch ruhig jeder hören, was er will. Hauptsache, er hört es richtig an“ (Groove). (shrink)

Rethinking politics in a new vocabulary, Hans Sluga challenges the firmly held assumption that there exists a single common good which politics is meant to realize. He argues that politics is not a natural but a historical phenomenon, and not a single thing but a multiplicity of political forms and values only loosely related. He contrasts two traditions in political philosophy: a 'normative theorizing' that extends from Plato to John Rawls and a newer 'diagnostic practice' that emerged with Marx (...) and Nietzsche and has found its three most prominent twentieth-century practitioners in Carl Schmitt, Hannah Arendt, and Michel Foucault. He then examines the sources of diagnostic political thinking, analyzes its achievements, and offers a critical assessment of its limitations. This article compares Kant and Fichte from the double stand- point of identity and difference with regard to two thinkers who were at first united by a master-student relation but who later on drifted apart from each other due to mutual defamation. At the center of the present discussion stands the relationship between spirit of freedom and system’s form which binds Kant and Fichte beyond methodological divergences and doctrinal differ- ences. The critical comparison between Kant and Fichte will be developed (...) in four steps: it will start with the general positioning of Kant within German Idealism, and then move on to Kant’s double critical enterprise of grounding an aprioristic doctrine of principles of nature and freedom; it will later on address the conception championed by Fichte of having pre- sented the “first system of freedom”, and from there it will focus on the manifestations of freedom within Fichte’s philosophical system, with Kant’s position as contrast.
