Das Ziel, das Dux mit der Untersuchung zur Moral verfolgt, ist, einsichtig zu machen, dass und wie sich die Moral als eine Form sozialer Vernunft aus einer Bedingungskonstellation der evolutiv erworbenen Verfassung heraus zu bilden vermochte und immer wieder zu bilden vermag. Man muss, das ist die Kernthese Günter Dux‘, die Moral unter den erkenntniskritischen Vorgaben der Moderne neu verstehen – anders als sie in aller Vergangenheit verstanden wurde. Dux macht deutlich, dass es zum Verständnis der Moral einer anderen Logik (...) bedarf, nämlich einer prozessualen. Durch sie muss geklärt werden, dass und wie Moral sich mit der Vernunft in der Gesellschaft historisch-genetisch ausgebildet hat. Das erkenntniskritische Interesse an der Moral ist politisch motiviert. Wir sind mit den gesellschaftlichen Verhältnissen in eine Krise geraten. Das Problem ist der Markt. Er macht es unmöglich, der Gesellschaft eine von der Idee der Versöhnung bestimmte Welt als normatives Ideal zugrunde zu legen. Das Normative ist in die Strukturen der Gesellschaft eingelassen. Mit den Strukturen der Gesellschaft bedarf es deshalb der Kritik der Moral und einer trennscharfen Bestimmung der Gerechtigkeit. In “The logic of deep disagreements” (Informal Logic, 1985), Robert Fogelin claimed that there is a kind of disagreement – deep disagreement – which is, by its very nature, impervious to rational resolution. He further claimed that these two views are attributable to Wittgenstein. Following an exposition and discussion of that claim, we review and draw some lessons from existing responses in the literature to Fogelin’s claims. In the final two sections (6 and 7) we explore the role reason can, (...) and sometimes does, play in the resolution of deep disagreements. In doing this we discuss a series of cases, mainly drawn from Wittgenstein, which we take to illustrate the resolution of deep disagreements through the use of what we call “rational persuasion.” We conclude that, while the role of argumentation in “normal” versus “deep” disagreements is characteristically different, it plays a crucial role in the resolution of both. Despite an intractable judiciary, there is widespread consensus within the legal academy that jury nullification is compatible with the rule of law. This proposition is most strongly tested by where a jury nullifies simply because it disagrees with the law itself. While some substantive nullifications can comport with the rule of law, most commentatorsjustice,vely undifferentiated view of a morality (even though jurisdictional and vicinage morality can diverge). In doing so, a healthy vision of antityrannical nullifications is presented, but this leaves (...) out many problematic cases. Once these errors are rectified, a more nuanced picture emerges, and it becomes apparent that localism will often disrupt the congruence feature of the rule of law. (shrink)

While democracy is derided for a variety of reasons in Plato’s thought, his most damning critique of that regime type does not involve an observation about democracy qua democracy, but of the transition that it so easily engenders: the decline to tyranny. Regimes are composed of individuals and groups, though, and Plato is anxious to ascribe culpability for the degradation. Two actors are the primary focus of his analysis — the political leaders and the demos. At times he emphasizes the (...) puissance of the demos, but in other passages he suggests it is the leaders who are most authoritative. This paper discusses these apparently contradictory passages, and works towards a reconciliation. It argues that neither is assigned sole culpability, as both work in complex synrgy, and that the underlying cause of the decline—and the motivator behind both actors — is not simply freedom, but greed for material wealth. The encounter of amateur science with synthetic biology has led to the formation of several amateur/do‐it‐yourself biology (DIYBio) groups worldwide. Although media outlets covered DIYBio events, most seemed only to highlight the hope, hype, and horror of what DIYBio would do in the future. Here, we analyze the European amateur biology movement to find out who they are, what they aim for and how they differ from US groups. We found that all groups are driven by a core leadership of (...) (semi‐)professional people who struggle with finding lab space and equipment. Regulations on genetic modification limit what groups can do. Differences between Europe and the US are found in the distinct regulatory environments and the European emphasis on bio‐art. We conclude that DIYBio Europe has so far been a responsible and transparent citizen science movement with a solid user base that will continue to grow irrespective of media attention. (shrink)

Understanding the evolutionary role of environmentally induced phenotypic variation (i.e., plasticity) is an important issue in developmental evolution. A major physiological response to environmental change is cellular stress, which is counteracted by generic stress reactions detoxifying the cell. A model, stress‐induced evolutionary innovation (SIEI), whereby ancestral stress reactions and their corresponding pathways can be transformed into novel structural components of body plans, such as new cell types, is described. Previous findings suggest that the cell differentiation cascade of a cell type (...) critical to pregnancy in humans, the decidual stromal cell, evolved from a cellular stress reaction. It is hypothesized that the stress reaction in these cells was elicited ancestrally via inflammation caused by embryo attachment. The present study proposes that SIEI is a distinct form of plasticity‐based evolutionary change leading to the origin of novel structures rather than adaptive transformation of pre‐existing characters. Variegated phenotypes often result from chromosomal rearrangements that place euchromatic genes next to heterochromatin. In such rearrangements, the condensed structure of heterochromatin can spread into euchromatic regions, which then assume the morphology of heterochromatin and become transcriptionally inactive. In position‐effect variegation (PEV) therefore, gene inactivation results from a change in chromatin structure. PEV has been intensively investigated in the fruitfly Drosophila, where the phenomenon allows a genetic dissection of chromatin components. Consequently, many genes have been identified which, when mutated, act (...) as dominant modifiers (suppressors or enhancers) of PEV. Data available already demonstrate that genetic, molecular and developmental analysis of these genes provides an avenue to the identification of regulatory and structural chromatin components, and hence to fundamental aspects of chromosome structure and function. In this paper, we defend ontological disputes from the charge, with a special focus on disputes over the existence of composite objects. Disputes over the existence of composite objects, we argue, have a number of substantive implications across a variety of topics in metaphysics, science, philosophical theology, philosophy of mind, and ethics. Research on the effectiveness of case studies in teaching engineering ethics in higher education is underdeveloped. To add to our knowledge, we have systematically compared the outcomes of two case approaches to an undergraduate course on the ethics of technology: a detached approach using real-life cases and a challenge-based learning approach with students and stakeholders acting as co-creators. We first developed a practical typology of case-study approaches and subsequently tested an evaluation method to assess the students’ learning experiences and outcomes (...) and staff interpretations and operationalizations, seeking to answer three questions: Do students in the CBL approach report higher basic needs, motivation and competence development compared to their peers in the detached approach? What is the relationship between student-perceived co-creation and their basic needs, motivation and competence development? And what are the implications of CBL/CC for engineering-ethics teaching and learning? Our mixed methods analysis favored CBL as it best supported teaching and research goals while satisfying the students’ basic needs and promoting intrinsic motivation and communication competences. Competence progress in other areas did not differ between approaches, and motivation in terms of identified regulation was lower for CBL, with staff perceiving a higher workload. We propose that our case typology model is useful and that as a method to engage students as co-creators, CBL certainly merits further development and evaluation, as does our effectiveness analysis for engineering ethics instruction in general and for case-study approaches in particular. Two welcome extensions of evolutionary thinking have come to prominence over the last thirty years: the so-called ’extended evolutionary synthesis’ (EES) and debate about biological kinds and individuals. These two agendas have, however, remained orthogonal to one another. The EES has mostly restricted itself to widening the explanations of adaptation offered by the preceding ’modern evolutionary synthesis’ by including additional mechanisms of inheritance and variation; while discussion of biological kinds has turned toward philosophical questions of essential vs. contingent properties of (...) life forms and realist vs. epistemological approaches to categorization and classification. Here we attempt to broaden the explanatory scope of evolutionary theory by linking these two agendas. We expand on the mechanistic orientation of the EES, using new understandings of networked systems of components in order to engage the distinct intellectual challenge of the origination of “historical kinds”. With this phrase we designate a subset of natural kinds that acquires, through evolutionary processes, a quasi-independent lineage-history. Such kinds emerge in both biology and culture, and we enlarge the limited number of historical kinds that have thus far been recognized in evolutionary biology in a series of paradigmatic exemplars, from genes and cell types to rituals and music. For each exemplar we discern specific mechanisms by which it arose and persists; comparing these, we suggest a general unity in the ways in which diverse historical kinds originate. (shrink)

We must find new and innovative ways of conceptualizing transboundary energy issues, of embedding concerns of ethics or justice into energy policy, and of operationalizing response to them. This book stems from the emergent gap; the need for comparative approaches to energy justice, and for those that consider ethical traditions that go beyond the classical Western approach. This edited volume unites the fields of energy justice and comparative philosophy to (...) provide an overarching global perspective and approach to applying energy ethics. We contribute to this purpose in four sections: setting the scene, practice, applying theory to practice, and theoretical approaches. Through the chapters featured in the volume, we position the book as one that contributes to energy justice scholarship across borders of nations, borders of ways of thinking and borders of disciplines. Metaphysicians frequently appeal to the idea that theoretical simplicity is truth conducive in metaphysics, in the sense that, all other things being equal, simpler metaphysical theories are more likely to be true. In this paper I defend the notion that theoretical simplicity is truth conducive in metaphysics, against several recent objections. I do not give any direct arguments for the thesis that simplicity is truth conducive in metaphysics, since I am aware of no such arguments. I do argue, however, that (...) there is no special problem with the notion that simplicity is truth conducive in metaphysics. More specifically, I argue that if you accept the idea that simplicity is truth conducive in science, then it would be objectionably arbitrary to reject the idea that simplicity is truth conducive in metaphysics. A macroscopic realization of the peculiar virtual particles is presented. The classical Helmholtz and the Schrödinger equations are differential equations of the same mathematical structure. The solutions with an imaginary wave number are called evanescent modes in the case of elastic and electromagnetic fields. In the case of non-relativistic quantum mechanical fields they are called tunneling solutions. The imaginary wave numbers point to strange consequences: The waves are non-local, they are not observable, and they are described as virtual particles. During (...) the last two decades QED calculations of the solutions with an imaginary wave number have been experimentally confirmed for phonons, photons, and electrons. The experimental proofs of the predictions of non-relativistic quantum mechanics and the Wigner phase time approach for the elastic, electromagnetic and Schrödinger fields will be presented in this article. The results are zero time in the barrier and an interaction time (i.e. a phase shift) at the barrier interfaces. The measured tunneling time scales approximately inversely with the particle energy. Actually, the tunneling time is given only by the barrier boundary interaction time, as zero time is spent inside a barrier. (shrink)

The concept of an operator is used in a variety of practical and theoretical areas. Operators, as both conceptual and physical entities, are found throughout the world as subsystems in nature, the human mind, and the manmade world. Operators, and what they operate, i.e., their substrates, targets, or operands, have a wide variety of forms, functions, and properties. Operators have explicit philosophical significance. On the one hand, they represent important ontological issues of reality. On the other hand, epistemological operators form (...) the basic mechanism of cognition. At the same time, there is no unified theory of the nature and functions of operators. In this work, we elaborate a detailed analysis of operators, which range from the most abstract formal structures and symbols in mathematics and logic to real entities, human and machine, and are responsible for effecting changes at both the individual and collective human levels. Our goal is to find what is common in physical objects called operators and abstract mathematical structures, with the name operator providing foundations for building a unified but flexible theory of operators. The paper concludes with some reflections on functionalism and other philosophical aspects of the ‘operation’ of operators. (shrink)

Both the capability and the recognition approach are influential and substantial theories in social philosophy. In this contribution, we outline their main assumptions in their assessment of poverty. The two approaches are set in relation to each other, focusing mainly on (a) their moral evaluation of poverty, (b) issues of justification of their central normative claims, and (c) the role that is attributed to subjective experiences, feelings and emotions in these theories. This comparison reveals that in spite of significant differences, (...) both lead to the claim that poverty can never be adequately assessed without putting it into the context of a comprehensive ethical theory about the nature and function of societies. Drawing on this result, we conclude that the critical function of social philosophy plays an irreducible role in the study and understanding of poverty. (shrink)

Mereological nihilism (henceforth just "nihilism") is the thesis that composition never occurs. Nihilism has often been defended on the basis of its theoretical simplicity, including its ontological simplicity and its ideological simplicity (roughly, nihilism's ability to do without primitive mereological predicates). In this paper I defend nihilism on the basis of the theoretical unification conferred by nihilism, which is, roughly, nihilism's capacity to allow us to take fewer phenomena as brute and inexplicable. This represents a respect in which nihilism enjoys (...) greater theoretical simplicity than its rivals which has not yet been explored, and which is immune to many of the objections which have been leveled against previous arguments for nihilism from nihilism's theoretical simplicity. Composition as identity might be thought to confer a similar degree of theoretical unification as nihilism. I end the paper by arguing that this is not the case. (shrink)
