_Legitimate Differences_ challenges the usual portrayal of current debates over thorny social issues including abortion, pornography, affirmative action, and surrogate mothering as _moral_ debates. How can it be said that our debates oppose principles of life to those of liberty, principles of liberty to those of equality, principles of equality to those of fairness, and principles of fairness to those of integrity, when we as Americans share all these principles? Debates over such issues are not, Georgia Warnke argues, moral (...) debates over which principles we should adopt. Rather, they are interpretive debates over the meanings of principles we already possess. Warnke traces the structure of these debates with reference to the work of Jane Austen, Hans-Georg Gadamer, Jürgen Habermas, and Bernard Williams. In separate chapters on surrogate mothering, affirmative action, abortion, and pornography she articulates new understandings of the meanings of some of our principles and shows the equal legitimacy of some different interpretations of the meanings of others. Finally, she suggests that the orientation of American public policy ought to be directed less at finding single canonical interpretations of our principles than at accommodating different legitimate understandings of them. The perspective offered by _Legitimate Differences_ should have a significantly beneficial effect on public discussions. (shrink)

Commentators have compared Hans-Georg Gadamer’s focus on tradition in Truth and Method to his focus on solidarity in his later work in order to suggest that the latter signals a move away from ontological toward ethical and political concerns. This paper, however, is guided by Gadamer’s own view that his work, both early, late, and in Truth and Method, was always concerned with ethical and political issues. I therefore want to challenge the idea that his so-called politics of solidarity marks (...) a new direction in his work. His politics of solidarity does mark a new direction in discussions of solidarity insofar as he disconnects it from any necessary grounding in preexisting affinities such as religion and nationality. Gadamer’s later work may also be more explicitly concerned with the question of differences and the other than is Truth and Method. Nevertheless, I want to argue that rather than signaling a new direction for Gadamer, both his politics of solidarity and his concern with otherness highlight important features already present in his earlier account of tradition. Indeed, I think attention to this earlier account discloses a political dimension to Gadamer’s thought that is more sophisticated than his remarks on solidarity. Attention to this dimension of his earlier account allows us to challenge the now standard objection that it undermines possibilities for critical reflection. (shrink)

Social and political theorists have traced in detail how individuals come to possess gender, sex and racial identities. This book examines the nature of these identities. Georgia Warnke argues that identities, in general, are interpretations and, as such, have more in common with textual understanding than we commonly acknowledge. A racial, sexed or gendered understanding of who we and others are is neither exhaustive of the 'meanings' we can be said to have nor uniquely correct. We are neither always, (...) or only, black or white, men or women or males or females. Rather, all identities have a restricted scope and can lead to injustices and contradictions when they are employed beyond that scope. In concluding her argument, Warnke considers the legal and policy implications that follow for affirmative action, childbearing leave, the position of gays in the military and marriage between same-sex partners. Scepticism has been one of the standard problems of epistemology in modern times. It takes various forms – the most general one being the thesis that knowledge is impossible; but equally prominent are such versions as the notorious doubt about the existence of an external world, inaugurated by Descartes'Meditations, or doubts about the existence of objective values. Philosophers who undertake to refute scepticism – still a very popular exercise – try to show that knowledge is possible after all, or to (...) prove the existence of an external world, and so on. Sceptics, generally speaking, are seen as radical doubters – philosophers who call into question assumptions that are usually taken for granted by ordinary people as well as by other philosophers. Historically, as well as more recently, women's emancipation has been seen in two ways: sometimes as the `right to be equal' and sometimes as the `right to be different'. These views have often overlapped and interacted: in a variety of guises they have played an important role in both the development of ideas about women and feminism, and the works of political thinkers by no means primarily concerned with women's liberation. Feminists often look to postmodern philosophy for a framework within which to treat difference. We might more productively look to a hermeneutic philosophy that emphasizes the interpretive dimensions of difference and allows us to acknowledge the partiality of our understanding. Hence, we might also recognize the importance of a hermeneutic conversation unconstrained by relations of power or ideology in which all nonexclusionary interpretive voices can be educated by one another.

Richard Rorty challenges the traditional use of hermeneutic understanding to defend the methodological autonomy of the social sciences, claiming that hermeneutics is part of both social and natural science and, moreover, that it exposes the limits of ?epistemologically centered philosophy?. Hermeneutics is interested in edification rather than truth, in finding new ways of speaking rather than adjudicating knowledge claims or securing the grounds of rational consensus. Although Rorty refers to Gadamer's ?philosophical hermeneutics? as support for this position, Gadamer's own analysis (...) points in a different direction. First, it distinguishes the social from the natural sciences as forms of practical, not theoretical, knowledge. As hermeneutic analyses, the social sciences participate in an on?going dialogue about values and forms of life. Second, the goal of this dialogue is cognitive and normative agreement. Indeed, hermeneutics is an act of integration which tries to expand consensus between different cultures and historical perspectives by mediating their claims to truth. (shrink)

The Prior Analytics marks the beginning of formal logic, and is one of the most influential works in the history of thought. It is here that Aristotle sets out his system of syllogistic reasoning. The first book, to which this volume is devoted, offers a coherent presentation of Aristotle's logic as a general theory of deductive argument.

In this paper I would like to examine a conception of happiness that seems to have become popular after the time of Plato and Aristotle: tranquillity or, as one might also say, peace of mind. This conception is interesting for two reasons: first, because it seems to come from outside the tradition that began with Plato or Socrates, second, because it is the only conception of eudaimonia in Greek ethics that identifies happiness with a state of mind and makes it (...) depend entirely on a person’s attitude or beliefs. In this way it may be closer to more recent ideas about happiness, notably those of utilitarians who treat “happiness” as a synonym of “pleasure,” than to the classical Greek conceptions of the good life. For Plato and Aristotle the happy life certainly had to be pleasant or enjoyable, but they did not think that happiness itself consisted in being pleased with one’s life. As the Stoic Seneca puts it, “it is not that virtue is chosen because it pleases, but that, if chosen, it also pleases.” I will argue that tranquillity was in fact not a serious contender for the position of ultimate good in ancient times. Greek theories of happiness from Plato to Epicurus were attempts to spell out what sort of a life one would have to lead in order to have good reasons for feeling tranquil or contented; they were not recipes for reaching a certain state of mind. Looking at the case of tranquillity will show, I think, that modern philosophers interested in questions about the good life might be well advised to follow the lead of their ancient predecessors. The ideal of deliberative democracy grounds the legitimate use of state power in free public reasoning among equals. It does not conceive of democratic decision-making as a mere aggregate of individual preferences. Instead, in public debates over proposed policies and programs, citizens advance considerations they think can be compelling to others who may possess values and commitments different from their own. Decisions are collective, then, in the sense that they reflect a process of reasoning to which all citizens can agree. (...) At the start of his account of hermeneutic experience, Gadamer quotes Heidegger: “Our first, last and constant task is never to allow our fore-having, fore-sight and fore-conception to be presented to us by fancies and popular conceptions, but rather to make the scientific theme secure by working out these fore-structures in terms of the things themselves.” Heidegger’s “fore-structures” reflect our practical pre-understanding and ongoing engagement with our world or “the things themselves.” Yet, if so, how can we work these fore-structures (...) out in terms of them? Gadamer claims to take his answer to this question from Heidegger and to appeal, like him, to the hermeneutic circle. However, I argue that Gadamer takes the question more seriously than Heidegger does by supplementing recourse to the hermeneutic circle with an appeal to dialogue. I also explore concerns about this supplement. Gadamer conceives of understanding as a dialogue in which we test our fore-meanings against those of others and come to a consensus with others about a subject matter (Sache). Yet, dialogue can just as easily reinforce or even exaggerate our fore-meanings as test them For its part, consensus is as easily to be feared as sought. (shrink)

En la primera parte se resumen los puntos centrales de Honig sobre el tipo de complejización e impurificación de la teoría vigente que el drama Las Bacantes de Eurípides habilitaría, y sobre la importancia de esta nueva conceptualización para la práctica política feminista. A continuación se formulan algunos interrogantes respecto del proceso histórico en el cual (...) este concepto deviene protagónico para la teoría política crítica y se señalan posibles limitaciones del mismo a la hora de describir el tipo de desafíos que enfrentan las luchas emancipatorias e igualitarias emprendidas por el movimiento feminista en Argentina. The story of Medea has exerted a powerful influence on creative artists since the time of Euripides. It is a tale that has been told in many ways and in several genres. This article offers a discussion of Christa Wolf's 1996 novel, Medea.Stimmen (Medea. Voices), a modern retelling through the voices, and conflicting perspectives, of the major characters involved with Medea, including Jason, Agameda, Akamas, Leukon, Glauce and Medea herself.Medea's role within feminist literary reception and women's literature cannot be overlooked (...) because of the crucial archetype she represents. One task of Feminist criticism has been to expose, deconstruct and rectify prevalent male (mis) interpretations of female archetypes, such as Medea, Medusa and others, and the patriarchal distortions they introduced through 3 000 years of male literature. In the patriarchal realm, Medea represents the Witch, the black Sorceress, and the archetype of the Negative Mother. These negative interpretations or archetypes may be attributed to misogynist perceptions of Medea as the vilest of women, because she committed the most despicable of all crimes — killing her children, the patriarchy's heirs — to take revenge on Jason, the husband who abandons her in Corinth (her place of exile) to marry Glauce, King Creon of Corinth's daughter, for reasons of political expedience.As a writer with her roots in the former East-German regime, Wolf perceives the Medea story as an account of a woman with both extraordinary powers and human shortcomings, who is misunderstood by the Colchians and the Corinthians alike. Wolf explores the distorted patriarchal motives for their loathing of Medea and Medea's ultimate powerlessness to do anything more than accept her tragic destiny. In doing so, Wolf does not attempt to manipulate the Medea story to suit the one-sidedness of some more radical feminist ideologies. (shrink)

This paper discusses the myths regarding both the conceptualization and the expected effects that are implicitly or explicitly presented in analyses of the so-called ‘democratic innovations’, that is, the new institutions that aim to increase public participation beyond regular elections. It is argued that these myths, together with the (fictitious) confrontation between direct and indirect politics, have generated false oppositions and reductionisms that mask the debate and limit empirical approximations to democratic innovation. A research agenda based on the concept of (...) ‘participatory ecologies’ is suggested as a way to gain an understanding of the mechanisms of participation in a systematic way.Este artículo analiza los mitos que se han construido, tanto en un plano conceptual como de efectos esperados, en torno a las denominadas innovaciones democráticas, entendidas como instituciones destinadas a incrementar la participación ciudadana más allá de las elecciones. Argumentamos que tanto estos mitos como la (ficticia) confrontación entre política directa e indirecta ha generado falsas oposiciones y reduccionismos que enmascaran el debate y limitan el estudio empírico de la innovación democrática. Una agenda de investigación basada en el concepto de ecologías participativas se sugiere para el entendimiento de los mecanismos de participación en forma sistemática. (shrink)

In the past decade the work of Jurgen Habermas has sparked off a series of lively debates over modernity and post-modernity, the nature of language, the interplay of law and politics and the dilemmas of morality. Significantly, these debates unfold in the context of his particular reading of the modern philosophical tradition from the German enlightment to the present period.
