This is the first collection of essays examining Paul Ricoeur's writings on law, bringing together eminent Ricoeur scholars from around the world to demonstrate the importance of Ricoeur's philosophy for the juridical field while offering new paths to extend and build on his work.

This chapter examines the nature and normative significance of taxation. In particular, it identifies and explores two central normative questions: (1) What tax arrangements should a state or society put into place? (2) How should a citizen or taxpayer relate to an existing system? In thinking through these and relate questions, the discussion also critically engages with the broadly Rawlsian view of taxation defended by Murphy and Nagel in The Myth of Ownership.

This article analyses Achille Mbembe’s theorization of necropolitics and surplus life in dialogue with three comparable theorizations: Agamben’s ‘bare life’, Marxist scholarship on ‘relative surplus populations’, and Afropessimist theorizations of ‘social death’. I argue that Mbembe’s work allows us to develop a critique of sacrifice that at the same time (contra Agamben) recognizes how it plays a structural role within necropolitics. Examining the influence of Georges Bataille’s writings on sacrifice allows me to clarify this argument. The second part of the (...) article examines the ‘surplus life’ of necropolitics in comparative analysis, tracing some of the limits of Mbembe’s reading through a dialogue with Marxist and Afropessimist readings. I characterize Mbembe’s work in terms of a poetics and politics of surplus: ‘reserves of life’ are affirmed against the excess of violence characterizing the present. However, this critique of violence relies upon abrupt leaps from politics to abstract ethical appeals in ways that obscure the implications of Mbembe’s own analysis. (shrink)

The recent publication of a new translation of On Nietzsche invites renewed consideration of one of Georges Bataille’s most intriguing and complex texts. This work was originally situated within La Somme athéologique, Bataille’s unfinished project for a set of texts exploring the paradoxes of religious atheism. These texts are often consumed with a religious fervour and seem far from the explicitly political considerations of Bataille’s anti-fascist texts in the 1930s, or from the more measured analytical tone of The Accursed Share. (...) However, as some critics have suggested, these texts have a political significance of their own. This review essay will thus consider the tensions between Bataillean perspectives which put more weight on either the ‘political’ or the ‘religious’ as modes of analysis. It begins with an analysis of On Nietzsche before moving to a broader thematic discussion of religion in several recently published texts related to Bataille. The central question posed in the latter half of the article is the following: how can Bataille’s thought be deployed to theorize the religiosity of contemporary capitalism? (shrink)

Heidegger's history of hermeneutics discovered nothing more than a “diluted” understanding of hermeneutics in Schleiermacher and Dilthey. In contrast, Gadamer's and Ricoeur's histories of hermeneutics placed little or no emphasis on the premodern period, focusing instead on the rise of the “hermeneutic problem” in Schleiermacher's work and the development of that problematic in works by Dilthey and Heidegger. Ricoeur added Gadamer to that list, recognizing that Gadamer was instrumental in the way he had received and perceived the problem in question. (...) Charles R. Bambach argues that it was, in fact, Karl Barth's “crisis theology” that had inspired Heidegger's “destructive” alternative to the conventional view of historical research. He revealed that he had followed Hegel when writing his history of hermeneutics, noting that his decision to do so had consequences for the way he depicted the rise of hermeneutics; and the way his history of hermeneutics ended. George Berkeley (1685-1753) is the superstar of Irish Philosophy. He entered Trinity College, Dublin, in 1700 and became a fellow in 1707. In 1724 he resigned his Fellowship to become Dean of Derry, and in 1734 he was made Bishop of Cloyne. He settled in Oxford in 1752 and died the following year. The work of George Berkeley is marked by its diversity and range. His writings take in such topics as mathematics, psychology, politics, health, economics, deism and (...) education, as well as that with which he is most associated - philosophy. Whatever topic he dealt with, his grasp of the subject matter was always impressive and his criticisms of his contemporaries often acute. Among the most noteable of the British Empiricists, he took his starting point from Locke's new 'way of ideas', but he rejected abstract ideas and the possibility of real existence outside perception. It is for this doctrine that he is most known - that there is no such thing as matter, and that things are collections of ideas which can exist only in our minds and only for so long as they are perceived. This philosophy, summed up in his phrase 'to be is to be perceived', he termed 'immaterialism'. A.C. Fraser's collection includes a series of what were previously unpublished notes by Berkeley on all the main topics of his philosophy. What follows from Noonan's and Wiggins's objections to such theories is that they need to be so formulated as not to deny the necessity of identity. The best metaphysics for best?candidate theories to adopt is one in which everyday objects are taken to transcend, in a certain sense, their life histories in given worlds. This metaphysics also (...) has the potential for solving problems about contingent identity, transworld identity, and the issue of haecceitism or individual essence. The paper mobilizes Adam Smith’s treatment of the division of labour in relation to the production, consumption and exchange of knowledge. One aspect of this mobilization deals with the epistemic demands that exchange makes on its participants. The other deals with increasing returns in the provision of knowledge itself, treating knowledge creation as just another example of specialization and exchange. These two aspects come together in relation to the epistemic demands associated with assessing knowledge quality. ABSTRACT The notion of consensus plays an important epistemological role in modern welfare economics, in that unanimous consent is a (unique) conceptual test for those changes that are ‘Pareto-desirable’ (that is, make someone better off and no-one else worse). In this paper, we seek to show that unanimous consent does not logically imply Pareto-desirability—that a rational individual may fail to veto policy changes that make him/her worse off. The central element in the proof of this proposition is the observation that (...) in social agreements involving a significant number of participants, any one individual's veto is decisive if it is the only veto. If the individual does not expect to be decisive, he will rationally exercise his vote ‘expressively’, and without sole regard to its consequences. George Herbert Mead (1863-1931) had a powerful influence on the development of American pragmatism in the twentieth century. He also had a strong impact on the social sciences. This classic book represents Mead's philosophy of experience, so central to his outlook. The present as unique experience is the focus of this deep analysis of the basic structure of temporality and consciousness. Mead emphasizes the novel character of both the present and the past. Though science is predicated on the assumption (...) that the present is predictable based on a thorough knowledge of the past, the experience of the present, says Mead, is an utterly unique moment comparable to no other, and when it is past the novel character of that unique experience is irrevocable. The emergence of novelty within the perceived rational order of reality is the crux of the problem that Mead explores. The present, in his words, is "the emergent event . . . something which is more than the processes that have led up to it and which by its change, continuance, or disappearance, adds to later passages a content they would not otherwise have possessed." The present as "the seat of reality" heavily conditions our retrospective view of the past as much as it helps to shape the future. The novelty of every present experience causes us to reconstruct our preceding experiences to make sense of the past, which is naturally assumed to be the main cause of what we presently experience. Our perspective on reality is thus relative to the conditioning of each new event and it changes continuously as the effects of the present shift our view of the past and future. This emphasis on the integrative, holistic nature of reality, in which everything past, present, and future is a condition of everything else, makes Mead's philosophy highly relevant to today's scientific picture of a quantum universe, where chance and probability play a role in the emergence of reality. Also of great interest is the way in which he extends his basic analysis of temporal-spatial reality to the emergence of mind and consciousness as a natural development of the evolutionary process. This stimulating and provocative work attests to John Dewey's praise of Mead as "the most original mind in philosophy in America" of his generation. (shrink)
