English has become the first global language of international com- munication during the last decades. It is dominant in many fields as science, technology, transportation, business and tourism and diplomacy. The European Union with law applicable directly on individuals is officially multilingual. English is, however, preferred in internal communication and in communication with national experts. National laws are closely related with particular states. Related discourse is therefore realized mostly in national language. Legal education and research are thus less anglicized than (...) other university education and research. Nevertheless, increasing importance of international and supranational rules for harmonization and coordination, growing demand for comparison, pres- sure to publish in internationally recognized journals, Europe-wide research projects and rising numbers of exchange of students cause widespread resort to English also at schools of law. Unfortunately, English is language of countries with Anglo-American law which differs significantly from continental law existing in most European and other countries. Therefore, it is difficult to find adequate English words for phenomena of civil law and to stabilize their use in international discourse. (shrink)

Interaction between humans and cats in urban environments is subject to dynamic change. Based on the frequency and quality of relations with humans, we can distinguish several populations of domestic cats : pedigree, pet, semi-feral, feral, and pseudo-wild. Bringing together theoretical perspectives of the Tartu school of biosemiotics and ethological studies of animal societies, we distinguish two basic types of cat cultures: the culture of street cats and the humano-cat culture of pets. The difference between these cultures is documented on (...) the level of zoosemiotic interactions, ecological relations, and human representations. We introduce a threefold model of human-animal interactions in urban environments which steer a careful course between the Scylla of realistic ontology and the Charybdis of social constructivism. A case study on Estonian cat shelters illustrates the significance of cultural representations and institutionalized actions in human-cat cohabitation. (shrink)

In this paper I challenge the widespread assumption that the conditions for singular reference are more or less the same as the conditions for singular thought. I claim that we refer singularly to things without thinking singularly about them more often than it is usually believed. I first argue that we should take the idea that singular thought is non-descriptive thought very seriously. If we do that, it seems that we cannot be so liberal about what counts as acquaintance; only (...) perception will do. I also briefly discuss and reject semantic instrumentalism. Finally, I argue that while singular reference is cheap, singular thought comes only at a price. (shrink)

Because philosophical reflections on touch usually start from our ability to perceive properties of objects, they tend to overlook features of touch that are crucial to correct understanding of tactual perception. This paper brings out these features and uses them to develop a general reconception of the sense of touch. I start by taking a fresh look at our ability to feel, in order to reveal its vital role. This sheds a different light on the skin's perceptual potential. While it (...) is commonly observed that tactile experiences have two intentional objects, an external object and one's own body, I will advance a more accurate alternative: in tactile experiences, one becomes aware of what one's body undergoes. This alternative not only fits better with tactility's vital role; it is also key to explaining how active touching provides for a unique contribution to our perceptual relation to material objects. By thus connecting tactility's vital role to the way we rely on touch while manipulating objects, this essay offers a cross-sectional survey of our tactile powers that reveals the interplay between sensing and touching. In recent philosophy of mind, a series of challenging ideas have appeared about the relation between the body and the sense of touch. In certain respects, these ideas have a striking affinity with Husserl’s theory of the constitution of the body. Nevertheless, these two approaches lead to very different understandings of the role of the body in perception. Either the body is characterized as a perceptual “organ,” or the body is said to function as a “template.” Despite its focus on (...) the sense of touch, the latter conception, I will argue, nevertheless orients its understanding of tactual perception toward visual objects. This produces a distorted conception of touch. In this paper, I will formulate an alternative account, which is more faithful to what it is like to feel. (shrink)

In this brief discussion piece I try to offer some considerations in favor of the so-called Simple Intention Theory of demonstratives, which is rejected by Gómez-Torrente. I try to show that the main argument offered against the Simple Intention Theory appears to be based on false data.

Among other virtues, Mental Files Theory provides a straightforward explanation of de jure coreference, i.e. identity of referent guaranteed by meaning alone: de jure coreference holds between terms when these are associated with the same mental file from which they inherit their reference. In this paper, I discuss an objection that Angel Pinillos raises against Mental Files Theory and other similar theories: the theory predicts that de jure coreference should be transitive, just like identity. Yet there are cases, involving ‘slash-terms’, (...) in which transitivity fails, or so it seems. In his book Mental Files, Recanati replies that the mental files theorist can accommodate Pinillos’ exceptions by offering a refined model of merging files, the ‘partial merging’ model. While agreeing with Recanati on the need for such a model, I contend that, pace Recanati and Pinillos, de jure coreference is transitive even in the presence of slash-terms. I will first show that paradoxical consequences ensue if slash-terms are said to de jure corefer with several basic terms at once. Then, building on two different accounts Recanati gives of referential confusion, I will show that on both views, de jure coreference cannot hold because of the behaviour of confused slash-terms. I will conclude that, in Mental Files Theory, a slash-term can, at most, de jure corefer with only one basic term per context. (shrink)

In Liberating Oedipus?: Psychoanalysis as Critical Theory, Dr. Filip Kovacevic demonstrates how psychoanalytic theory can join political theory in designing alternative political norms and values. Kovacevic proves that political practice without an emancipatory psychology to guide it is potentially dangerous.

The paper offers a conceptual and phenomenological analysis of the language of depersonalization. The depersonalization syndrome or disorder has no known common pathogenesis and shows no characteristic behavioral manifestations. A conceptual analysis of the key terms in the subjective complaints would therefore have consequences for clinical research into the phenomenon of depersonalization.

This paper is a comparison of two structural theories of propositions: the theory proposed by Kazimierz Ajdukiewicz in the 1960s and the theory developed by Jeffrey King at the beginning of the 21st century. The first section of the paper is an overview of these theories. The second part is a detailed discussion of significant similarities shared by them. In this section, I also identify and analyze ways in which these theories differ and attempt to determine if these differences are (...) substantial or apparent. The last part is an attempt to determine if the discussed theories are capable of coping with the Benacerraf Problem. (shrink)

In this paper, we show that there are some strong philosophical and exegetical reasons to argue that according to the view developed in the first chapter of Aristotle’s De Memoria, the objects of memory are non-present, or absent, things and events rather than our past acts of awareness of them. We argue that on Aristotle’s account, the objects of memory can be particulars or universals, perceptibles or intelligibles, and that all these kinds of things are past in the same sense, (...) namely, in the sense of previously having been present to the perceiver or knower. In this paper we examine interactions of the reciprocal with distributive and collective operators, which are encoded by prefixes on verbs expressing the reciprocal relation: namely, the Czech distributive po and the collectivizing na-. The theoretical import of this study is two-fold. First, it contributes to our knowledge of how word-internal operators interact with phrasal syntax/semantics. Second, the prefixes po and na generate (a range of) readings of reciprocal sentences for which the Strongest Meaning Hypothesis (SMH) proposed by Dalrymple et (...) al. (1998) does not make the right predictions. The distributive prefix po prefers the Strong Reciprocity reading, although the SMH predicts that a weakening should take place, while with the prefix na we find cases where weaker reciprocal readings are preferable to the stronger ones predicted by the SMH. This behavior of po and na is, we propose, due to the way in which they modulate two factors that are crucial in the interpretation of reciprocal sentences: (i) the relevant subpluralities in the group denoted by the reciprocal's antecedent, and (ii) the strength of reciprocal relations. We provide a detailed analysis of the semantics of the prefixes po and na and their contribution to the meaning of reciprocal sentences within the general framework of event semantics with lattice structures. The nature of unconscious information processing is a heavily debated issue in cognitive science , and neuroscience . Traditionally, it has been thought that unconscious cognitive processing is restricted to knowledge that is strongly prepared by conscious processes . In three experiments, we show that the task that is performed consciously can also be applied unconsciously to items outside the current task set. We found that a same–different judgment of two target stimuli was also performed on two subliminally presented prime (...) stimuli. This was true for target and prime stimuli from entirely different categories, as well as for prime and target stimuli at different levels of abstraction. These results reveal that unconscious processing can generalize more widely than previously accepted. (shrink)

This paper focuses on the links between Jakob von Uexküll’s theoretical biology and Adolf Portmann’s conception of organic life. Its main purpose is to show that Uexküll and Portmann not only share a view of the living being as an autonomous and holistically organized entity, but also base this view on the seminal idea of the subjectivity of the organism. In other words, the respective holistic principles securing the autonomy of the living being—the Bauplan, for Uexküll; the Innerlichkeit, for Portmann—share (...) an essentially subjective character. Such principles, indeed, express themselves in a centrally directed and formative way; moreover, in organisms endowed with a central nervous system, they also extend their influence on the overt behavioral sphere and on the organism’s capacity to give meaning to the surrounding reality. The conclusion of the article will show how, though starting from this common background, the two authors develop divergent positions on the issue of the anthropological difference. If Portmann emphasizes the special status of the relationship between the human animal and the world, Uexküll tends to see a substantial continuity in the biosemiotic processes through which human and non-human animals constitute their species-specific worlds of experience. The article proposes to analyse whether the current configuration of national migration legislation from Arendt's perspective on the universalization of human rights and Agamben's reflections on bare life and the state of exception demonstrates its capacity to protect the human rights of people undergoing forced migration. To this end, a literature review of a bibliographical nature was used, using the historical procedure method. In order to interpret the effectiveness of the current configuration of the human rights of this vulnerable group, (...) an analysis of international and national legislation on migration was carried out, focusing mainly on the case of the New Brazilian Migration Law. To this end, a theoretical discussion was built to understand how human rights are framed considering the situation of migration and statelessness in the face of an increasingly prevalent state of exception. It was noted that the constitutive fragility of forced migrants is a perennial situation, aggravated by the political inaction of nation states. It has also been noted that there is a need for states and international organizations to adopt new practices to promote the human dignity of forced migrants. (shrink)

This paper is an analysis of Aristotle's "Nicomachean Ethics 7.3." Aristotle's discussion in this chapter is motivated by the Socratic doctrine, elaborated in Plato's "Protagoras," according to which it is impossible to know what is good and act against this knowledge. Aristotle wants to rebut this doctrine and show that there is a sense of "know" such that this is possible. I argue that this is all that he wants to do in EN 7.3, and that his discussion is not (...) meant to provide an explanation of akrasia, as is usually supposed by commentators. Since the akratic knows that the action she is performing is not good for her, and actions are particulars, the akratic's knowledge is about a particular. I argue that Aristotle's discussion in EN 7.3 adds strength to the idea that knowledge of a particular is explainable only in terms of knowledge of a universal. More determinately, knowledge of a particular is explainable in terms of the actualization or use of knowledge of a universal, and such an actualization is in turn explainable by means of the syllogistic form. Thus, I argue that syllogisms in 7.3 (esp. at 1146 35-1147 10) are not "practical syllogisms", but that their function is epistemological: they are meant to reveal the structure and content of the akratic's knowledge, not to explain her actions. Although one of the criteria of (...) depersonalization syndrome is intact reality testing (APA 2000), it is nevertheless the case that patients with depersonalization complaints may at the same time be delusional, a fact that Modigh also points out: "The border between unreality feelings with largely intact reality-testing ability and psychotic disorders with grossly disturbed reality-testing is, however, not absolute and patients with psychotic disorders may of course experience feelings of unreality or depersonalization."Morris is also critical of the idea that feelings of unreality in the quasi-sensory sense (or in sense [a3]) may tempt patients to doubt the reality of the items experienced as unreal. We suggest that the experience of the self or the world as unreal may actually give rise to an impulse to believe that the self or the world does not exist. This, however, need not imply that a person who has such a belief is delusional. For example, consider the following cases, which include patients with intense unreality feelings but who exhibit largely intact reality testing. One of Sierra and Berrios' (2000) patients says: "I have to touch myself to make sure that I have a body and a real existence." Lindqvist (1966, p. 171) describes two cases of the "mirror syndrome," which he recognizes as a typical behavior seen in cases of severe depersonalization. The patients want to confirm that they are real by looking in a mirror. Such cases strongly indicate that a person with otherwise intact reality testing can be so overwhelmed by feelings of unreality that he or she can come to doubt his or her own existence. The reason we do not want to call this state delusional is that the patient constantly tries to compare the experience of reality with some other mark of reality (e.g., by using a mirror), thus indicating that, on a higher cognitive level, he or she still understands that his or her belief may be incorrect. The image in the mirror works as an assurance that the fear of not existing is, after all, just a fear.Merleau-Ponty's (1962) description of Stratton's inverting spectacles experiment is indeed relevant to our analysis. The experiment seems to indicate that the feeling of unreality corresponds to the degree of unfamiliarity with seeing the world upside down. Stratton's subjects report that after a couple of days objects still appear inverted but less unreal than they did before. This seems to suggest that unreal in this circumstance approximates not normal. An inverted world is after some time accepted as normal. Our methodological [End Page 287] approach is not equivalent with a classical ordinary language approach because our main concern is language use in psychiatric contexts. A classical ordinary language analysis aims to explicate how terms actually are used in everyday language; our primary concern is to try to understand the phenomenology underlying descriptions of felt unreality given by patients suffering from depersonalization. However, we do start by looking at the terms from an everyday angle, but this only gives us a coarse approximation of what the depersonalization patient may mean by such expressions. The strange and unpleasant phenomenology of the condition in combination with the variety of characteristic expressions make it likely that the role of unreal in connection with depersonalization complaints is quite different from its use in everyday language. When a person undergoes a depersonalization episode for the first time, he or she encounters a quite new and perhaps unexpected phenomenological reality. I argue that the adjective δαιμόνιος (‘daemonic’) and the substantivized adjective τὸ δαιμόνιον (‘the daemonic’) that occur in Aristotle’s dream treatises basically mean ‘divine-like,’ denoting an illusory appearance of divine intervention, typically in the form of an alleged god-sent prophetic dream. Yet the appearances to which the terms refer are, in fact, neither divine nor supernatural at all, but involve merely coincidental correlations between the dream and the fulfilling event. It is shown that Aristotle’s use of ‘daemonic’ is traditional and (...) reflects the endoxon that prophetic dreams are closely related to the divine. I propose a theory aimed at advancing scholarly research in social entrepreneurship. By highlighting the key trade-off between value creation and value capture and explaining when situations of simultaneous market and government failure may arise, I suggest that social entrepreneurship is the pursuit of sustainable solutions to neglected problems with positive externalities. I further discuss the situations in which problems with externalities are likely to be neglected and derive the central goal and logic of action of social entrepreneurs, in contrast (...) to commercial entrepreneurs. Overall, this article provides a conceptual framework that allows understanding the growing phenomena of social entrepreneurship and its role in the functioning of modern society. (shrink)

Most attempts at defining or elucidating ’weak’ or ’strong’ supervenience introduce various forms of _physical indiscernibility_. After glancing at some definitions, I argue that they must fail if mental events are supposed to be genuinely causally efficacious and non-epiphenomenal. Then I elucidate Davidson’s account of supervenience (’D-supervenience’), first as an abstract relation between a predicate and a set of predicates (to be illustrated by uncontroversial examples), and then as applied to the mental/physical relation. I argue that Davidson must defend that (...) if two events are physically indiscernible in the light of a complete physical theory of the world then they must be identical in the Leibnizian sense (‘L-identity’): physical indiscernibility collapses into L-identity. It follows that mental differences between two numerically different events logically entail physical differences between them. I conclude by demonstrating how the Davidsonian account of the concept can explain some counterexamples to Moore’s approach to supervenience of moral on natural properties. The central tenet in this paper is that supervenience principles based on duplication create, rather than solve, problems in this problem area. (shrink)

Using a prototype approach, we assessed people’s lay conceptions of intuition and analysis. Open-ended descriptions of intuition and analysis were generated by participants (Study 1) and resulting exemplars were sorted into features subsequently rated in centrality by independent participants (Study 2). Feature centrality was validated by showing that participants were quicker and more accurate in classifying central (as compared to peripheral) features (Study 3). Centrality ratings suggested a single-factor structure describing analysis but revealed that participants held lay conceptions of intuition (...) as involving two different types of processes: (1) as an automatic, affective, and non-logical processing, and (2) as a holistic processing that can assist in problem-solving. Additional analyses showed that the centrality ratings of intuition’s facets were predicted by participants’ self-reported intuitive style, suggesting intuition is differently perceived by intuitive and non-intuitive people. We discuss the implications of these results for the study of intuition and analysis. (shrink)

The aim of this article is to clarify the meaning of a naturalistic position within philosophy of biology, against the background of an alternative view, founded on the basic insights of transcendental philosophy. It is argued that the apparently minimal and neutral constraints naturalism imposes on philosophy of science turn out to involve a quite heavily constraining metaphysics, due to the naturalism’s fundamental neglect of its own perspective. Because of its intrinsic sensitivity to perspectivity and historicity, transcendental philosophy can avoid (...) this type of hidden metaphysics. (shrink)

Ordinary psychological predicates, and the phenomena we report to by means of them, can be grouped together into different categories. For instance, it is usual to group together phenomena such as belief and expectancy in a category of ‘propositional attitudes’, whereas sensations, like pain and itch, in a distinct one. Which taxonomy of the mental would be plausible to be adopted in contexts such as those of introductory books to the philosophy of mind, i.e., when we need to set out (...) only from minimal assumptions regarding these predicates and phenomena? This article suggests some desiderata and principles for such a taxonomy; exposes and critically assesses some taxonomies presented in introductory books to the philosophy of mind; and proposes the sketch of an alternative one. Contemporary theories of institutions as clusters of stable solutions to recurrent coordination problems can illuminate and explain some unresolved difficulties and problems adhering to institutional definitions of art initiated by George Dickie and Arthur Danto. Their account of what confers upon objects their institutional character does not fit well with current work on institutions and social ontology. The claim that “the artworld” confers the status of “art” onto objects remains utterly mysterious. The “artworld” is a generic notion that designates a (...) sphere of human activity that involves practices that create goals that have led to the emergence of formal and informal institutions. But those institutions, rather than magically “creating” objects subjected to esthetic appreciation, merely solve familiar and ubiquitous coordination problems created by artistic activity in ways other institutions in other areas solve similar and/or analogous coordination problems. In this paper I take a closer look at Sextus Empiricus’ arguments in his Outlines of Pyrrhonism I.25-30 and try to make sense of his account of Skepticism as a goal-directed philosophy. I argue that Sextus fails to mount a convincing case for the view that tranquility, rather than suspension of judgment, is the ultimate goal of his inquiries.

In this contribution, we draw on findings from a non-formal, community music project to elaborate on the relationship between the concept ofeudaimonia, as defined by Seligman, the interactive dimensions of collective free improvisation, and the concept of collaborative creativity. The project revolves around The Ostend Street Orkestra (TOSO), a music ensemble within which homeless adults and individuals with a psychiatric or alcohol/drug related background engage in collective musical improvisation. Between 2017 and 2019 data was collected through open interviews and video (...) recordings of rehearsals and performances. Participant data was analyzed through inductive analysis based on the principles of grounded theory. One interesting finding was the discrepancy in the participant interviews between social relationships indicative of a negative affect about social group interaction versus strong feelings of group coherence and belonging. Video recordings of performances and rehearsals showed clear enjoyment and pleasure while playing music. Alongside verbal reflection through one-on-one interviews video recordings and analysis of moment-to moment observations should be used, in order to capture the complexity of community music projects with homeless people. The initial open coding was aligned with the five elements of the PERMA model. Overall, we observed more focus on Relationship (sense of belonging), Engagement (flow in rehearsals and performances) and Meaning (belonging to something greater than yourself) and less on Positive Emotion and Accomplishment (goal setting). This book is the first anthology to provide a wide-ranging picture of how phenomenology relates to language.

Les termes d’espèce naturelle font débat : s’agit-il de termes descriptifs qui exprimeraient des caractéristiques des objets tombant dans leur extension, ou fonctionnent-ils plutôt comme des noms qui désigneraient directement leur espèce, sans l’intermédiaire d’une description? Selon la théorie causale de la référence (TCR), un terme comme « Tigre » nomme directement l’espèce du Tigre grâce à l’ostension d’un échantillon de tigres individuels qui constitue l’étalon de référence pour les usages ultérieurs du terme. Je me propose ici de confronter la (...) TCR à la pratique des noms de taxons telle qu’elle est réglée par le Code International de Nomenclature Zoologique. Je tâcherai de montrer qu’en dépit de contre-exemples avancés récemment, les prédictions de la TCR sont vérifiées par les noms scientifiques d’espèces et de sous-espèces. (shrink)

Mon but ici est de réconcilier deux conceptions relativement populaires dans leurs domaines respectifs : d’une part, la théorie des contreparties de David Lewis, en métaphysique modale, d’autre part, la thèse de la rigidité mise en avant par Saul Kripke en sémantique. De prime abord, le concept de rigidité ne semble pas pouvoir s’appliquer dans TC : un terme rigide est censé désigner le même objet au travers des mondes possibles, tandis que TC formule les conditions de vérité des énoncés (...) modaux de re en termes non pas d’identité transmonde mais de similarité comparative. Je soutiens néanmoins qu’il peut y avoir de la rigidité au travers des ressemblances. Partant d’une suggestion de Lewis, je montre qu’on peut définir un concept de rigidité, la rigidité lewisienne, qui est adapté à TC. Malheureusement, la thèse de la rigiditéL ainsi reformulée bute sur un obstacle de taille : l’extrême prodigalité de la relation de ressemblance qui prévaut dans TC entraîne une prolifération des relations de contrepartie, ce qui a pour effet de trivialiser la thèse de la rigiditéL, en faisant de tous les termes singuliers, sans discrimination, noms propres aussi bien que descriptions définies, des désignateurs rigidesL. Suivant une piste d’Allan Gibbard et de Lewis, je propose alors de relativiser la rigiditéL à un aspect de similarité variable selon le contexte conversationnel. De là, je forge un concept plus contraignant, celui d’hyper-rigiditéL, à l’aune duquel le contrepartiste peut enfin capturer la différence entre noms propres et descriptions définies. (shrink)
