ZusammenfassungDurch eine Gesetzesänderung im Dezember 2019 ist im Rahmen von Strafermittlungsverfahren nunmehr der Einsatz des „Forensic DNA Phenotyping“, d. h. von Technologien zur Vorhersage von Haut-, Haar- und Augenfarbe sowie biologischem Alter, erlaubt. Dieser Beitrag diskutiert die Verlässlichkeit, Nützlichkeit und Legitimität von solchen Erweiterten DNATechnologien und damit die Rahmenbedingungen ihres Einsatzes in Deutschland. Dabei wird aufgezeigt wie kompliziert, fehleranfällig, voraussetzungsreich, anspruchsvoll und heikel der Einsatz dieser Technologien in Ermittlungen sein kann, wenn nicht entsprechende Vorkehrungen getroffen werden, und wenn sie nicht (...) auf umsichtig begleitete Einzelfälle beschränkt bleiben. Aufbauend auf dieser Analyse werden schließlich Maßnahmen für die Anwendung und Regulierung Erweiterter DNA-Technologien in Deutschland vorgeschlagen. (shrink)

Martin Heideggers Abendgespräch in einem russischen Kriegsgefangenenlager zwischen einem Jüngeren und einem Älteren ist datiert auf den 8. Mai 1945, den Tag, an dem der Nationalsozialismus besiegt wurde. Der Schlüssel zum Verständnis des Textes ist ein Zitat aus dem klassischen daoistischen Buch Zhuangzi. Warum wendet sich Heidegger an diesem Tag der chinesischen Philosophie zu? Für den Philosophen und Sinologen Fabian Heubel birgt das Abendgespräch die einzigartige Gelegenheit, Heideggers Öffnung für östliches Denken kritisch zu erörtern. Zugleich zeigt sich die Kommunikationsverweigerung (...) zwischen Heidegger und Adorno in neuem Licht, indem das Buch beide mit Hilfe daoistischen paradoxen Denkens ins Gespräch kommen lässt. Background Thorough information of the patient is an integral part of the process of shared decision making. We aimed to investigate if detailed information about medication may induce nocebo effects. Methods We conducted a randomized, single-blind, pilot-study including n = 51 psychiatric in-patients aged between 18 and 80 years with a depressive disorder and accompanying sleeping disorders. In the intervention group we provided thorough information about adverse effects, while the control group received only a simple consent procedure. In both groups, (...) patients received an open-label placebo pill instead of their sleeping medication. Results No statistically significant differences between the intervention group and the control group were found regarding the main outcome parameter. Conclusion In this study, we were not able detect an effect of informed consent vs. simple consent on the emergence of placebo or nocebo effects. I discuss a contemporary solution to the dynamic problem of old evidence (POE), as proposed by Sprenger. Sprenger’s solution combines the Garber–Jeffrey–Niiniluoto (GJN) approach with Howson’s suggestion of counterfactually removing the old evidence from scientists’ belief systems. I argue that in the dynamic POE, the challenge is to explain how an insight under beliefs in which the old evidence E is known increased the credence of a scientific hypothesis. Therefore, Sprenger’s counterfactual solution, in which E has been artificially removed, does (...) not resolve the problem. I consider several potential responses. (shrink)

Sich dem Phänomen des Computerspielens aus der Perspektive der philosophischen Handlungstheorie zu nähern, kann einem zunächst nicht besonders vielversprechend vorkommen. Und dies aus zwei Gründen: Zum einen scheint sich der universalistische Anspruch der Handlungstheorie nicht besonders gut mit dem Studium eines Partikularbereichs menschlichen Tuns zu vertragen. Denn die Handlungstheorie ist jener Bereich der Philosophie, der zu erklären versucht, wie man das Phänomen des menschlichen Handelns als solches verstehen kann. Das heißt in der Philosophie des Handelns wird der Frage nachgegangen, auf (...) welche Weise wir am besten verstehen können, dass Handlungen sich von anders gearteten Bewegungen unseres Körpers einerseits aber auch von der Art des zielgerichteten Verhaltens, zu dem Tiere in der Lage sind, unterscheiden. Handlungstheorie, so kann man das auch beschreiben, ist eine Form der Anthropologie: Sie beschreibt eine spezielle Weise, in der sich unsere Charakteristik als vernünftiges Tier ausbuchstabieren lässt. Sequence learning is fundamental to a wide range of cognitive functions. Explaining how sequences—and the relations between the elements they comprise—are learned is a fundamental challenge to cognitive science. However, although hundreds of articles addressing this question are published each year, the actual learning mechanisms involved in the learning of sequences are rarely investigated. We present three experiments that seek to examine these mechanisms during a typing task. Experiments 1 and 2 tested learning during typing single letters on each trial. (...) Experiment 3 tested for “chunking” of these letters into “words.” The results of these experiments were used to examine the mechanisms that could best account for them, with a focus on two particular proposals: statistical transitional probability learning and discriminative error-driven learning. Experiments 1 and 2 showed that error-driven learning was a better predictor of response latencies than either n-gram frequencies or transitional probabilities. No evidence for chunking was found in Experiment 3, probably due to interspersing visual cues with the motor response. In addition, learning occurred across a greater distance in Experiment 1 than Experiment 2, suggesting that the greater predictability that comes with increased structure leads to greater learnability. These results shed new light on the mechanism responsible for sequence learning. Despite the widely held assumption that transitional probability learning is essential to this process, the present results suggest instead that the sequences are learned through a process of discriminative learning, involving prediction and feedback from prediction error. Our societies are marked not only by disagreements on the good life, but also by disagreements on justice. This motivates philosophers as divergent as John Gray and Chandran Kukathas to focus their normative political theories on peace instead of justice. In this article, I discuss how peace should be conceived if peace is to be a more realistic goal than justice, not presupposing any moral consensus. I distinguish two conceptions of peace to be found in the literature. One, ordinary peace, (...) conceives of peace as non-violent coexistence based on modus vivendi arrangements. Modus vivendi arrangements, in turn, are explained as a special kind of compromise. Ordinary peace does not presuppose any moral consensus and is therefore realistic, but at the same time it is too minimalist and undemanding to be satisfying. The other conception of peace, ambitious peace, can be found in Kukathas’s work. It is a conception of peace ‘beyond compromise’, not minimalist and undemanding, but, I will argue, not realistic because presupposing at least a second-order moral consensus. In the end, I advocate a division of labour between both conceptions of peace under the umbrella of an overarching ideal of peace. (shrink)

In this article, I present two objections against the view that aesthetic judgements – that is, judgemental ascriptions of aesthetic qualities like elegance or harmony – are justified non‐inferentially. The first is that this view cannot make sense of our practice to support our aesthetic judgements by reference to lower‐level features of the objects concerned. The second objection maintains that non‐inferentialism about the justification of aesthetic judgements cannot explain why our aesthetic interest in artworks and other objects is limited to (...) only some of their lower‐level features that realise their higher‐level aesthetic qualities. Although my concern with the view that aesthetic judgements are subject to non‐inferential justification is very general, my discussion is primarily structured around Sibley's well‐developed and influential version of this view. The problem of algorithmic fairness is typically framed as the problem of finding a unique formal criterion that guarantees that a given algorithmic decision-making procedure is morally permissible. In this paper, I argue that this is conceptually misguided and that we should replace the problem with two sub-problems. If we examine how most state-of-the-art machine learning systems work, we notice that there are two distinct stages in the decision-making process. First, a prediction of a relevant property is made. Secondly, a (...) decision is taken based (at least partly) on this prediction. These two stages have different aims: the prediction is aimed at accuracy, while the decision is aimed at allocating a given good in a way that maximizes some context-relative utility measure. Correspondingly, two different fairness issues can arise. First, predictions could be biased in discriminatory ways. This means that the predictions contain systematic errors for a specific group of individuals. Secondly, the system’s decisions could result in an allocation of goods that is in tension with the principles of distributive justice. These two fairness issues are distinct problems that require different types of solutions. I here provide a formal framework to address both issues and argue that this way of conceptualizing them resolves some of the paradoxes present in the discussion of algorithmic fairness. (shrink)

Need-claims are ubiquitous within moral and political theory. However, need-based theories are often criticized for being too narrow in scope and too focused on the material preconditions for leading a decent life for grounding a substantial theory of social justice. The aim of this paper is threefold. Firstly, it will investigate the nature and scope of needs by analysing existing conceptualizations of the idea of needs. In so doing, we will get a better understanding of needs, which will help us (...) to carve out the importance and singularity of basic need claims. Secondly, on the basis of the analysis of needs, it will argue for the concept of a fundamental interest in free social agency, which is much better suited than the idea of basic needs actually to ground a theory of social justice, as it highlights the social and institutional conditions for free agency. Thirdly, using the distinction between basic needs and fundamental interests, it will clarify their respective role in and importance for grounding moral principles. Overall, the paper offers a friendly critique of need-based theories, while arguing for a shift of focus to the idea of fundamental interests. (shrink)

Within the debate on the epistemology of aesthetic appreciation, it has a long tradition, and is still very common, to endorse the sentimentalist view that our aesthetic evaluations are rationally grounded on, or even constituted by, certain of our emotional responses to the objects concerned. Such a view faces, however, the serious challenge to satisfactorily deal with the seeming possibility of faultless disagreement among emotionally based and epistemically appropriate verdicts. I will argue that the sentimentalist approach to aesthetic epistemology cannot (...) accept and accommodate this possibility without thereby undermining the assumed capacity of emotions to justify corresponding aesthetic evaluations – that is, without undermining the very sentimentalist idea at the core of its account. And I will also try to show that sentimentalists can hope to deny the possibility of faultless disagreement only by giving up the further view that aesthetic assessments are intersubjective – a view which is almost as traditional and widely held in aesthetics as sentimentalism, and which is indeed often enough combined with the latter. My ultimate conclusion is therefore that this popular combination of views should better be avoided: either sentimentalism or intersubjectivism has to make way. (shrink)

The main concern of this paper is the problem of method in De Caelo, which has been recently invigorated by the supposition of Aristotle’s acceptance of two standards of justification. Whereas the φυσικῶς argument comes close to demonstrative knowledge, the εὐλόγως argument relies on more general assumptions and allegedly points towards argumentative justification. With a view to better understanding how empirical criteria for theories, teleological principles, and the resolution of difficulties are laid down to provide as much causal explanations as (...) possible, we take side here in the debate about the very purpose of Aristotle’s using of justification by argument in scientific contexts. Our main claim is that although only reasonable proofs can be worked out in empirically underdetermined domains, this in no way amounts to endorsing an alternative to the norms of inquiry Aristotle upholds in natural science. Se sostendrá, en segundo lugar, que todo tratamiento temático es al mismo tiempo un tratamiento metodológico, esto es, que la fenomenología hermenéutica de la existencia humana desarrolla y oculta un particular discurso del método.

Consider the following objection of Bennett to Kant: The least swallowable part of Kant's whole theory of freedom is the claim that the causality of freedom is not in time. This follows from Kant's doctrine that time is an appearance, and anyway the theory of freedom needs it: it is because the noumenal cause of an event is not in time, and thus is not itself an event, that it escapes the causality of nature. Kant is unembarrassed: ‘Inasmuch as it (...) is noumenon, nothing happens in it; there can be no change requiring dynamical determination in time, and therefore no causal dependence upon appearances … No action begins in this active being itself; but we may yet quite correctly say that the active being of itself begins its effects in the sensible world’ [KrV, A541=B569]. The extent and mechanisms through which religion intertwines with decision-making processes in family firms remain inadequately understood. Family firm owners, driven by their commitment to ethical business practices and the safeguarding of their socioemotional wealth, actively seek cues to inform their decision-making processes. This research demonstrates that, among these guiding cues, top-level executives’ perceived religiosity emerges as a relevant factor. Building upon the socioemotional wealth perspective and conducting a longitudinal analysis based on listed family firms between 2009 and 2018, our (...) findings reveal a positive association between family voting rights and the presence of board members perceived to be religious. Furthermore, this relationship is less pronounced if family firms operate in industries with high research and development intensity. Our study confirms that boards with high shares of religiously perceived directors are positively associated with the appointment of chief executive officers perceived to be religious during succession events. We thereby present a unique perspective that acknowledges perceived religiosity as a micro-level constituent shaping board membership and successor selection. This investigation captures the intricate interplay between religion and family firms under a socioemotional wealth umbrella, offering important insights to the family business ethics discourse. Our research also offers practical implications for board and leadership diversity management in family firms. (shrink)

Over the last two decades, Axel Honneth has written extensively on the notion of social pathology, presenting it as a distinctive critical resource of Frankfurt School Critical Theory, in which tradition he places himself, and as an alternative to the mainstream liberal approaches in political philosophy. In this paper, I review the developments of Honneth's writing on this notion and offer an immanent critique, with a particular focus on his recent major work "Freedom's Right". Tracing the use of, and problems (...) internal to, Honneth's concept of social pathology serves to demonstrate his increasing reformism. It also serves to catalogue some of the dead ends that Critical Theory should avoid in taking up the idea of social pathology. The implication is not that this idea should be dropped. Rather, the paper is undertaking the necessary step of clearing the ground for further progress to take place on the question of what role the idea of social pathology can and should play in Critical Theory. The paper is critical in nature (and relentlessly so), but ultimately serves a constructive purpose. (shrink)

This paper aims to explain the distinction between syllogisms and subsyllogisms in Stoic logic. Subsyllogisms replace at least one premise in a syllogism with a premise that is, according to Galen and Alexander, equipollent to the respective syllogistic premise. This equipollence is not synonymy of meaning between two linguistic expressions, but obtains between two propositions when they are true or false by the same standard. Subsyllogistic premises are simple propositions that are equipollent to the non-simple premises of the respective syllogisms. (...) For subsyllogistic premises that replace syllogistic premises consist of predicates combining with cases rather than of connectives or negations governing propositions. Because of this difference in their premises, subsyllogisms have a different logical form than syllogisms and are not formally valid. (shrink)

Adorno notoriously asserted that there is no 'right' life in our current social world. This assertion has contributed to the widespread perception that his philosophy has no practical import or coherent ethics, and he is often accused of being too negative. Fabian Freyenhagen reconstructs and defends Adorno's practical philosophy in response to these charges. He argues that Adorno's deep pessimism about the contemporary social world is coupled with a strong optimism about human potential, and that this optimism explains his (...) negative views about the social world, and his demand that we resist and change it. He shows that Adorno holds a substantive ethics, albeit one that is minimalist and based on a pluralist conception of the bad - a guide for living less wrongly. His incisive study does much to advance our understanding of Adorno, and is also an important intervention into current debates in moral philosophy. (shrink)

This essay is based on the assumption that any ambition to ask how objects are actually able to appear is bound to a “speculative minimalism”. To be able to thematize “the intentional” as a form of our experience, our experience must not coincide with its intentional structure. The initial indication of this phenomenological finding is a constitutive and specific indeterminacy, which is co-realized in every determinacy within the intentional order. Marc Richir’s concept of a hyperbolic epoché is finally to be (...) brought into play as an approach to a contemporary, systematic integration of speculative minimalism and the transcendental ambition of phenomenology. In Metaphysics Z 5, Aristotle discusses definition by addition and comes to accept it for per se accidents. I aim to explain how Aristotle could allow here certain statements by addition as valid definitions without contravening some relevant rules about repetition he established in the Organon, and also how this definition succeeds in blocking the regress he pointed out at 1030b35–1031a1. I conclude that ‘snub nose’ can be defined by a non-superfluous repetition, which in turn contains an explication of the (...) quality (‘snub’) along the line of the specification of the general property (‘concavity’). Las prácticas de la lectura y la escritura han sufrido, en los últimos años, profundas transformaciones en respuesta al mundo post-industrial cambiante que nos enfrentamos como maestros. La ampliación del objeto literario a nuevos espacios de expresión cultural, está revisando conceptos como el canon, la belleza, el género, el papel del lector, así como la reformulación de lo que significa para leer y escribir literatura en un contexto universitario. En este sentido, consideramos que si la universidad se ha adaptado a (...) estos diversos escenarios culturales e históricos con el fin de ser capaz de formar lectores y escritores eficaces en el nuevo contexto cultural y más específicamente en el literario. Probablemente deberíamos revisar nuestro papel mediador en el aula para que podamos articular productivamente las expectativas de lectura y escritura a cada estudiante tiene y la oferta académica de la universidad. En este artículo vamos a tratar con los principales problemas relacionados con la lectura y la escritura de la literatura en la Universidad; y vamos a elaborar una propuesta para un taller curricular articulando estas dos actividades, mientras que la integración de las contribuciones específicas didácticas en la enseñanza de la literatura y disciplinas como la teoría literaria, la semiótica y la crítica. ZusammenfassungDie Geschichte der genetischen Pränataldiagnostik ist bislang als Teil der Geschichte der Humangenetik und deren Neuorientierung als klinisch-laborwissenschaftliche Disziplin in der zweiten Hälfte des 20. Jahrhunderts betrachtet worden. Anhand neuen Quellenmaterials soll in diesem Beitrag gezeigt werden, dass das Interesse an der Pränataldiagnostik in Westdeutschland auch im Kontext von Forschungen entstand, die sich mit Gefahren für den Menschen in der Umwelt befassten. Anhand der Debatten um die Einrichtung des DFG-Schwerpunktprogramms „Pränatale Diagnostik genetischer Defekte“ 1970 untersuchen wir, wie die Technik der (...) Amniozentese in Westdeutschland von einer interdisziplinären Forschungsgruppe eingeführt wurde, die sich mit Schädigungen des Organismus durch Strahlen, Arzneimittel und andere Gebrauchsstoffe und Konsumgüter befasste. In einer als ökologische Wende bezeichneten Zeit wachsenden Umweltbewusstseins, so unsere These, sollte durch die Förderung der Pränataldiagnostik eine wahrgenommene Lücke in der Prävention umweltbedingt auftretender genetischer Anomalien geschlossen werden. Für die Pränataldiagnostik als „Schutzmaßnahme“ sprach unter anderem ihre erwartete Finanzierung als Krankenkassenleistung im Zuge der Reform des Abtreibungsrechts. Erst in einem zweiten Schritt führten Veränderungen von Strukturen der Forschung, vor allem aber Erfahrungen in der gynäkologischen Praxis zu einer Neuausrichtung auf die Diagnostik und Prävention mehrheitlich erblicher oder spontan auftretender Anomalien. Die Pränataldiagnostik, so wie sie schließlich in Westdeutschland ab den frühen 1980er Jahren routinemäßig Einsatz fand, hatte mit Fragen der „Umwelt“ kaum noch zu tun. Diese Fallstudie zur Frühgeschichte der genetischen Pränataldiagnostik handelt von dem noch wenig untersuchten Verhältnis von humangenetischer Forschung, klinischer Praxis und Umweltforschung und hat zum weiteren Ziel, den bisher in anderen Kontexten beschriebenen Wandel von Perspektiven in der Vorsorge um 1970 zu beleuchten. In this paper, I describe and discuss two mental phenomena which are somewhat neglected in the philosophy of mind: focused daydreaming and mind-wandering. My aim is to show that their natures are rather distinct, despite the fact that we tend to classify both as instances of daydreaming. The first difference between the two, I argue, is that, while focused daydreaming is an instance of imaginative mental agency, mind-wandering is not—though this does not mean that mind-wandering cannot involve mental agency at (...) all. This personal-level difference in agency and purposiveness has, furthermore, the consequence that instances of mind-wandering do not constitute unified and self-contained segments of the stream of consciousness—in stark contrast to focused daydreams. Besides, the two kinds of mental phenomena differ in whether they possess a narrative structure, and in how we may make sense of the succession of mental episodes involved. (shrink)

One central fact about hallucinations is that they may be subjectively indistinguishable from perceptions. Indeed, it has been argued that the hallucinatory experiences concerned cannot— and need not—be characterized in any more positive general terms. This epistemic conception of hallucinations has been advocated as the best choice for proponents of experiential (or “naive realist”) disjunctivism—the view that perceptions and hallucinations differ essentially in their introspectible subjective characters. In this chapter, I aim to formulate and defend an intentional alternative to experiential (...) disjunctivism called experiential intentionalism. This view not only enjoys some advantages over its rival but is also compatible with the epistemic conception of hallucinations, as well as with the disjunctivist view that perceptions and hallucinations differ essentially in their third-personal structures (e.g., their causal, informational, or reason-providing links to reality). It also maintains that there are actually two aspects to the subjective indistinguishability of mental episodes: (i) we cannot distinguish their first-personal characters in introspective awareness; and (ii) we cannot distinguish their third-personal structures in experiential awareness—that is, in how they are given to consciousness. While experiential disjunctivism makes the mistake of ignoring (ii) and reducing subjective indiscriminability to (i), experiential intentionalism correctly identifies (ii) as the primary source of the subjective indistinguishability of perception-like hallucinations. Accordingly, the intentional error involved in such hallucinations is due to the fact that we consciously experience them as possessing a relational structure. (shrink)

My primary aim in this article is to provide a philosophical account of the unity of hallucinations, which can capture both perceptual hallucinations (which are subjectively indistinguishable from perceptions) and non-perceptual hallucinations (all others). Besides, I also mean to clarify further the division of labour and the nature of the collaboration between philosophy and the cognitive sciences. Assuming that the epistemic conception of hallucinations put forward by M. G. F. Martin and others is largely on the right track, I will (...) focus on two main tasks: (a) to provide a satisfactory phenomenology of the subjective character of perceptions and perceptual hallucinations and (b) to redress the philosophers’ neglect of non-perceptual hallucinations. More specifically, I intend to apply one of the central tenets of the epistemic conception—that hallucinations can and should be positively characterised in terms of their phenomenological connections to perceptions—to non-perceptual hallucinations as well. That is, I will try to show that we can positively specify the class of non-perceptual hallucinations by reference to the distinctive ways in which we first-personally experience them and perceptions in consciousness. The task of saying more about their underlying third-personal nature may then be left to the cognitive sciences. (shrink)

What is the scope of our conscious mental agency, and how do we acquire self-knowledge of it? Both questions are addressed through an investigation of what best explains our inability to form judgemental thoughts in direct response to practical reasons. Contrary to what Williams and others have argued, it cannot be their subjection to a truth norm, given that our failure to adhere to such a norm need not undermine their status as judgemental. Instead, it is argued that we cannot (...) form judgements at will because we subjectively experience them as responses to epistemic reasons, and because this is incompatible with our experiential awareness of direct mental actions, such as instances of imagining. However, this latter awareness does not extend to indirect agency, which relies on epistemic or causal processes as means. Judging may therefore still count as an indirect action - just like, say, breaking a window by throwing a stone. (shrink)

Philip Pettit’s republican conception of freedom is presented as an alternative both to negative and positive conceptions of freedom. The basic idea is to conceptualize freedom as non-domination, not as non-interference or self-mastery. When compared to negative freedom, Pettit’s republican conception comprises two controversial claims: the claim that we are unfree if we are dominated without actual interference, and the claim that we are free if we face interference without domination. Because the slave is a widely accepted paradigm of the (...) unfree person, the case of a slave with a non-interfering master is often cited as providing a good argument for the first republican claim and against a negative conception of freedom. One aim of this article is to raise doubts about whether this is true. The other aim of the article is to show that the prisoner—also a paradigm of the unfree person—presents a good argument against the second republican claim and in favour of a negative conception of freedom. This is called the ‘prisoner-argument’. It will be argued that neither Pettit’s distinction between free persons and free choices nor his distinction between compromising and conditioning factors of freedom can help to rebut the charge of the prisoner-argument. Justin Garson has recently argued that proper functions are proximal activities of traits selected by phylogenetic or ontogenetic selection processes, and that traits are dysfunctional only if they cannot perform their proper functions for constitutional reasons. We partially agree with Garson, but reject the view that functions are proximal activities, as well as his account of dysfunctions. Instead, we propose our own theory that biological functions are selected dispositions and that a trait is dysfunctional in virtue of not having the (...) dispositions for which it was selected. This account can explain both defects (or dysfunctions in Garson’s sense) and dysfunctions due to environmental factors. Moreover, it offers a neat way to explain the graduality of dysfunction.
