Terrorist attacks throughout the world and particularly within the United States have given rise to a new chapter in the ongoing debate over liberty versus security. The most recent manifestation of this dispute focuses on whether Muslim refugees can be denied entry as a class into the United States, based on their religion alone, for fear they might be harboring potential terrorists. This Essay shows that such a policy cannot be justified under the First Amendment Establishment (...) class='Hi'>Clause, as well the United States’ expressed international commitments to preserving international human rights. What can be done is to engage a broader set of investigative approaches that are more likely to provide greater security than any policy focused on religion alone. (shrink)

Today’s globalized economy cannot be governed by legal strictures alone. A combination of self-interest and regulation is not enough to avoid the recurrence of its systemic crises. We also need virtues and a sense of corporate responsibility in order to assure the sustained success of the global economy. Yet whose virtues shall prevail in a pluralistic world? The moral theory of Thomas Aquinas meets the present need for a business ethics that transcends the legal realm by linking the ideas of (...) justice and virtue in an ingenious way. While allowing for, and incorporating, the specificities of region and religion, industry and culture, Thomas’s virtue theory coordinates private and public activities through a set of context-invariant, justice-oriented norms with conceptual appeal to contemporary questions of global business ethics.In our article, we first sketch how Aquinas’s theory can be also of relevance to a non-confessional audience through its appeal to the ‘natural light of reason.’ Then we explain how his theory of ‘natural law’ aligns his ideas of virtue and justice. From this vantage point, we address the tension between cultural diversity and moral uniformity in the economic sphere in general and in today’s globalized business world in particular. Throughout the article, we aim to show that by interpreting the virtue-dimension of business in light of the idea of social justice, Aquinas’s conception of virtuous business conduct gains inter-personal and inter-cultural validity that establishes social justice as the global virtue of business. This volume offers an integrated understanding of how the theory of general relativity gained momentum after Einstein had formulated it in 1915. Chapters focus on the early reception of the theory in physics and philosophy and on the systematic questions that emerged shortly after Einstein's momentous discovery. They are written by physicists, historians of science, and philosophers, and were originally presented at the conference titled Thinking About Space and Time: 100 Years of Applying and Interpreting General Relativity, held at the (...) Quakerism is the first Anglo-American religion that has gained ground in Germany, especially in the north, in the second half of the 17th century. Contrary to older church historiography, this was not a marginal phenomenon. Rather, stable congregations developed, as did a Europe-wide network of missionary work and a differentiated culture of polemic writings. These points of encounter allowed the Quakers to establish contact with supporters of Böhme and radical pietists while at the same time enabling an Antiquakeriana campaign (...) against them. At the center of this study lies the question for the religious-historical positioning of Quakerism. The author argues that due to impulses of extra-ecclesiastical pietism, positions arose that transgressed Christianity's frame of reference. Therefore the reference to the early modern understanding of esoterism has proven especially useful. (shrink)

Purpose of the article is to provide support for the contention that two fundamental treatises representing the teaching of Madhyamaka, viz. the Mūlamadhyamakakārikās and the Vigrahavyāvartanī, were designed to establish and justify a metaphysical tenet claiming that no particulars of any kind can exist on some level of final analysis and that this was the only primary concern of those works. Whereas the former text is in the first place dedicated to providing proofs of the central metaphysical thesis the (...) major objective of the second treatise lies in a defense of the claim against possible objections. A correlate of this view regarding the content of those two works is on the one hand that the philosophy of the founder of the Madhyamaka-school essentially consists in a metaphysical teaching implying a radical rejection of a stance propagated in earlier Buddhist schools according to which objects of ordinary experience could be reduced to or explained by the existence of other sorts of particulars that can be theoretically postulated. On the other hand the exegesis advocated in the article implies that theorems pertaining to the nature of language or the relationship between language and non-linguistic reality are not at all a predominant issue in the pertinent texts and presumably were not a major matter of concern of early Madhyamaka in general. Accordingly matters pertaining to questions of semantics attain relevance at best in the form of objective consequences which the metaphysical doctrine might entail. The paper focuses on the second chapter of the Mūlamadhyamakakārikās as well as the segment of the Vigrahavyāvartanī which deals with the first major problem, represented by the verses 1–4 and 21–29. The reason is that a detailed and thoroughgoing investigation of these two textual passages is suited to disprove a contention voiced by Western scholars who suppose that the teaching of the founder of Madhyamaka embodies a particular claim pertaining to the relationship between language and non-linguistic reality. In light of the well-established international legal principle of non-use of force in international relations, Nigel Biggar’s In Defence of War may give rise to concern in the academy of international lawyers. But the gap between the book’s conclusions and the current international law on the use of force turns out to be less significant upon closer inspection than at first sight. This essay reviews Biggar’s concept of ‘just war as punishment’, his view on the legal status of the (...) ‘unjust warrior’, and his position on ‘humanitarian intervention’ from the perspective of international law. The essay is critical of the relevant passages in several more specific respects. At the same time, the essay reads the book as an elaborate general word of caution against an overarching presumption in favour of a maximalist interpretation of the principle of non-use of force in international relations—and it finds merit in that cautionary approach. The First Amendment’s Free Exercise and Establishment Clauses were meant to guarantee freedom of religion for all persons living in the United States. This was to be done by ensuring that government could not establish a state religion nor interfere with individual practices and beliefs so long as they did not violate public morals. The idea was to have the two clauses operate together to ensure state separation in matters of religion. However, recent caselaw involving government accommodations (...) to religious organizations has emphasized the Free Exercise Clause with little or no attention afforded the Establishment Clause. As a result, intermediate factors like entanglement, endorsement, general applicability, and neutrality, that previously were used to assist the separation of church and state, are now called into question. This Article attempts to rekindle these factors by attaching a public/private distinction to the way the two clauses are understood, to ensure a more certain and clearer basis for the separation of church and state. In summary, the creation and maintenance of the Wistar Rats as standardized animals can be attributed to the breeding work of Helen Dean King, coupled with the management and husbandry methods of Milton Greenman and Louise Duhring, and with supporting documentation provided by Henry Donaldson. The widespread use of the Wistar Rats, however, is a function of the ingenuity of Milton Greenman who saw in them a way for a small institution to provide service to science. Greenman's rhetoric, as captured (...) in his Director's Reports, prepared annually from 1905 until his death in 1937, shows that he was unusually sensitive to his times and to the economics of science and of society. In the era when biology was being defined, he recognized in the rat the potential to be a living analog to the pure chemicals that legitimated experimental science. From management literature he extracted the ideals of uniformity of product, standards of quality, and efficiency of production, applying them to scientific practice to generate an animal model that thrives as standard equipment in laboratories throughout the world today.I will close with a quote from Frederick W. Taylor that is a cogent statement of the contribution to science and scientific progress made by standardized tools and their creators. Equating the surgeon and the workman, Taylor wrote: [He is given] the finest implements, each one of which has been the subject of special study and development ... [and] the very best knowledge of his predecessors; and, provided with standard implements and methods which represent the best knowledge of the world up to date, he is able to use his own originality and ingenuity to make real additions to the world's knowledge, instead of reinventing things which are old.Standardized tools, whether surgeons' implements or laboratory-bred rats, are one of the vehicles for carrying scientific knowledge forward from generation to generation. In his Critique of Pure Reason, in the chapter on the antinomy of pure reason, Kant not only argues that aprioristic cosmology is doomed to failure; he also implies that empirical knowledge about the universe is impossible. Today, such a negative verdict about the possibility of cosmological knowledge seems implausible because physical cosmology has made substantial progress. In particular, the spatiotemporal extension of the universe now seems a matter of empirical investigation in which models figure centrally. But I think it (...) is worth considering the possibility that Kant got something right and that he offers insights that can help us to better understand problems in present-day cosmology. In this article, I explore a striking coincidence: according to both Kant and current wisdom, cosmology faces a serious underdetermination problem regarding the spatiotemporal extension of the world. As a closer analysis reveals, however, Kant and modern cosmology differ on the reasons why underdetermination arises. In current cosmology, underdetermination follows from laws that are knowable a posteriori, and not only from the very idea of cosmological knowledge, as Kant would have it. This suggests that the current underdetermination problem is not fully a Kantian one. (shrink)

This chapter uncovers a less investigated aspect of the relationship between the two most important scholastic schools of the Renaissance, Thomism and Scotism: the influence of Scotist literature on distinctions as seen in some sixteenth-century Thomists. The chapter has a primary focus on Chrysostomus Javelli’s engagement in his discussion of divine attributes with the Scotist doctrine of distinctions, but also considers other Thomist sources. First, the beginnings of the highly specialised Scotist literature on distinctions are traced back to the (...) start of the fourteenth century; I show how some early followers of Duns Scotus, in particular Francis of Meyronnes and Petrus Thomae, systematised Scotus’ ontology of the various grades of being by compiling lists of subtle distinctions to be applied to various levels of reality. I give some indications as to the later reception of these models of distinctions in the Scotist school. Special attention is paid to Étienne Brulefer, since his summary of Petrus Thomae’s model of seven distinctions was Javelli’s source for the Scotist doctrine. I then investigate how Javelli worked with Brulefer’s summary, and how he sought to integrate the Scotist doctrine into his own discussion of divine attributes. Thomists traditionally allowed only a rational or mental kind of distinction among divine attributes, and between them and the divine essence. Javelli, however, endeavours to show how the Thomist position may be reconciled with the Scotist doctrine of a formal or ex natura rei distinction. He did not always endorse this conciliatory approach; I hypothesise that he changed his mind on the subject over time. Finally, I show how other Renaissance Thomists reacted to the Scotist system of distinctions; in particular, I draw attention to the Thomists Andreas Bodenstein von Karlstadt, Bartolomeo Manzoli, and Mattia Gibboni da Aquario, who all wrote treatises on Thomist distinction theory modelled on the Scotist system of distinctions. In some of this literature, lists of distinctions based on Thomist metaphysics were compiled in order to replace the Scotist system. I argue that Javelli’s approach is more conciliatory and, in fact, has some overlap with the concordist thought of Giovanni Pico della Mirandola, who himself considered Scotus and Aquinas to be in fundamental agreement as regards the distinction between divine attributes. The ability to read emotions in faces helps humans efficiently assess social situations. We tested how this ability is affected by aspects of familiarization with face masks and personality, with a focus on emotional intelligence. To address aspects of the current pandemic situation, we used photos of not only faces per se but also of faces that were partially covered with face masks. The sample, the size of which was determined by an a priori power test, was recruited in Germany (...) and consisted of healthy individuals of different ages [M = 24.8 years]. Participants assessed the emotional expressions displayed by six different faces determined by a 2 × 3 design. Each person was presented with six different emotional displays with or without a face mask. Accuracy and confidence were lower with masks—in particular for the emotion disgust but also for happiness, anger, and sadness. When comparing the present data collected in July 2021 with data from a different sample collected in May 2020, when people first started to familiarize themselves with face masks in Western countries during the first wave of the COVID-19 pandemic, we did not detect an improvement in performance. There were no effects of participants’ emotional intelligence, sex, or age regarding their accuracy in assessing emotional states in faces for unmasked or masked faces. (shrink)

This volume is the first to provide a philosophical appraisal of probabilities in all of physics.

If cosmology is to obtain knowledge about the whole universe, it faces an underdetermination problem: Alternative space-time models are compatible with our evidence. The problem can be avoided though, if there are good reasons to adopt the Cosmological Principle (CP), because, assuming the principle, one can confine oneself to the small class of homogeneous and isotropic space-time models. The aim of this paper is to ask whether there are good reasons to adopt the Cosmological Principle in order to avoid underdetermination (...) in cosmology. Various strategies to justify the CP are examined. For instance, arguments to the effect that the truth of the CP follows generically from a large set of initial conditions; an inference to the best explanation; and an inductive strategy are assessed. I conclude that a convincing justification of the CP has not yet been established, but this claim is contingent on a number of results that may have to be revised in the future. (shrink)

The year 2021 saw the publication of Sven K. Knebel’s new book on Middle Knowledge. It is an exceedingly important research publication which deserves scholarly attention. The book contains a long introduction (consisting of various studies) and an edition of the fourth book of the Irish Jesuit theologian Luke Wadding’s incomplete work on scholastic theology. This present review article first recapitulates the origins and historical significance of the doctrine of Middle Knowledge. Then Knebel’s book as well as the career (...) of Luke Wadding are introduced. I then discuss the place of Wadding’s work in the Jesuit discourse of ‘concordia’ and its relation to Molinism. In the subsequent sections, I investigate various doctrines defended by Wadding. These include his view of disjunctive necessity, his variant of the doctrine known as ‘connectionism’, and his use of various kinds of distinctions in theology. The study concludes with a critical assessment of Knebel’s publication. Despite all praise, I disagree with Knebel’s all too pessimistic view of the research landscape: We will soon be pondering over why Early Modern scholasticism has received so much attention in recent scholarship, rather than why it did not do so in the past. Terms loaded with informational connotations are often employed to refer to genes and their dynamics. Indeed, genes are usually perceived by biologists as basically ‘the carriers of hereditary information.’ Nevertheless, a number of researchers consider such talk as inadequate and ‘just metaphorical,’ thus expressing a skepticism about the use of the term ‘information’ and its derivatives in biology as a natural science. First, because the meaning of that term in biology is not as precise as it is, for instance, (...) in the mathematical theory of communication. Second, because it seems to refer to a purported semantic property of genes without theoretically clarifying if any genuinely intrinsic semantics is involved. Biosemiotics, a field that attempts to analyze biological systems as semiotic systems, makes it possible to advance in the understanding of the concept of information in biology. From the perspective of Peircean biosemiotics, we develop here an account of genes as signs, including a detailed analysis of two fundamental processes in the genetic information system (transcription and protein synthesis) that have not been made so far in this field of research. Furthermore, we propose here an account of information based on Peircean semiotics and apply it to our analysis of transcription and protein synthesis. (shrink)

Many results of modern physics—those of quantum mechanics, for instance—come in a probabilistic guise. But what do probabilistic statements in physics mean? Are probabilities matters of objective fact and part of the furniture of the world, as objectivists think? Or do they only express ignorance or belief, as Bayesians suggest? And how are probabilistic hypotheses justified and supported by empirical evidence? Finally, what does the probabilistic nature of physics imply for our understanding of the world? This volume is the (...) class='Hi'>first to provide a philosophical appraisal of probabilities in all of physics. Its main aim is to make sense of probabilistic statements as they occur in the various physical theories and models and to provide a plausible epistemology and metaphysics of probabilities. The essays collected here consider statistical physics, probabilistic modelling, and quantum mechanics, and critically assess the merits and disadvantages of objectivist and subjectivist views of probabilities in these fields. In particular, the Bayesian and Humean views of probabilities and the varieties of Boltzmann's typicality approach are examined. The contributions on quantum mechanics discuss the special character of quantum correlations, the justification of the famous Born Rule, and the role of probabilities in a quantum field theoretic framework. Finally, the connections between probabilities and foundational issues in physics are explored. The Reversibility Paradox, the notion of entropy, and the ontology of quantum mechanics are discussed. Computer simulations and experiments share many important features. One way of explaining the similarities is to say that computer simulations just are experiments. This claim is quite popular in the literature. The aim of this paper is to argue against the claim and to develop an alternative explanation of why computer simulations resemble experiments. To this purpose, experiment is characterized in terms of an intervention on a system and of the observation of the reaction. Thus, if computer simulations are experiments, (...) either the computer hardware or the target system must be intervened on and observed. I argue against the first option using the non-observation argument, among others. The second option is excluded by e.g. the over-control argument, which stresses epistemological differences between experiments and simulations. To account for the similarities between experiments and computer simulations, I propose to say that computer simulations can model possible experiments and do in fact often do so. (shrink)

If we are to constrain our place in the world, two principles are often appealed to in science. According to the Copernican Principle, we do not occupy a privileged position within the Universe. The Cosmological Principle, on the other hand, says that our observations would roughly be the same, if we were located at any other place in the Universe. In our paper we analyze these principles from a logical and philosophical point of view. We show how they are related, (...) how they can be supported and what use is made of them. Our main results are: 1. There is a logical gap between both principles insofar as the Cosmological Principle is significantly stronger than the Copernican Principle. 2. A step that is often taken for establishing the Cosmological Principle on the base of the Copernican Principle and observations is not incontestable as it stands, but can be supplemented with a different argument. 3. The Cosmological Principle might be crucial for cosmology to the extent it is not supported by empirical evidence. (shrink)

We develop a utilitarian framework to assess different decision rules for the European Council of Ministers. The proposals to be decided on are conceptualized as utility vectors and a probability distribution is assumed over the utilities. We first show what decision rules yield the highest expected utilities for different means of the probability distri- bution. For proposals with high mean utility, simple bench- mark rules (such as majority voting with proportional weights) tend to outperform rules that have been proposed (...) in the political arena. For proposals with low mean utility, it is the other way round. We then compare the expected utilities for smaller and larger countries and look for Pareto- dominance relations. Finally, we provide an extension of the model, discuss its restrictions, and compare our approach with assessments of decision rules that are based on the Penrose measure of voting power. (shrink)

Healthcare organizations and workers are under pressure to produce increasingly complete and accurate data for multiple data-intensive endeavors. However, little research has examined the emerging occupations arising to carry out the data work necessary to produce “improved” data sets, or the specific work activities of these emerging data occupations. We describe the work of Clinical Documentation Integrity Specialists, an emerging occupation that focuses on improving clinical documentation to produce more detailed and accurate administrative datasets crucial for evolving data-intensive forms of (...) healthcare accountability, management, and research. Using ethnographic methods, we describe the core of CDIS’ work as a translation practice in which the language, interests, and concerns of clinicians and clinical documentation are translated via real-time “nudging” and ongoing education of clinicians into the language, interests, and concerns of medical coders, structured administrative datasets, and the various stakeholders of these datasets. Further, we show how the institutional context of CDIS’ work shapes the occupational virtues that guide CDIS’ translation practice, including financial reimbursement, quality measures, clinical accuracy, and protecting clinician’s time. Despite the existence of these multiple virtues, financial reimbursement is the most prominent virtue guiding CDIS’ limited attention. Thus, overall clinical documentation is “improved” in specific, partial ways. This research provides one of the first studies of the emergent data work occupations arising in the wake of digitization and big data opportunities, and shows how local data settings shape large scale data in specific ways and thus may influence outcomes of analyses based on such data. The Quaestio in particular explores Scotus's distinction between a science "in itself" and one "for us" and, going beyond Scotus's own doctrine, shows how this distinction is applicable to metaphysics.The book is divided into three parts. Part 1 offers a critical edition of the Quaestio de cognitione Dei, which has hitherto been available in a plain transcription published by C. R. S. Harris in 1927. Harris's text was based on a single manuscript from the fifteenth century (Oxford, Merton College, Ms. 90); Goris bases his edition on a manuscript from the early fourteenth century (Assisi, Biblioteca Comunale, Ms. 172), one that does not attribute the text to Scotus. Goris highlights that the text has significant parallels in the prologue of John of Reading's Scriptum on the first book of the Sentences; there is presently not sufficient evidence for claiming that Reading is the author of the De cognitione Dei, but it does seem clear that either Reading or some other Franciscan friar relying on Reading's Scriptum authored the text between 1316 and 1325. Two appendices to the edition document longer passages from Reading's Scriptum.Part 2 investigates the use of the distinction between a science in itself and one for us in Duns Scotus and some of the early Scotists. Scotus's doctrine developed over time. At Oxford Scotus taught that theology in se is about the divine essence in its particularity; theology for us is about the most perfect concept of God attainable for human beings by natural means, that is, the concept "infinite being." It falls to metaphysics to prove that there is such a kind of being. At Paris Scotus rather taught that both theology in se and theology for us are about the divine essence in its [End Page 549] particularity. The implication is that a strictly demonstrative science about God is possible for human beings in this present life, a knowledge of God that is completely independent of metaphysics. What is the status of a cat in a virtual reality environment? Is it a real object? Or part of a fiction? Virtual realism, as defended by D. J. Chalmers, takes it to be a virtual object that really exists, that has properties and is involved in real events. His preferred specification of virtual realism identifies the cat with a digital object. The project of this paper is to use a comparison between virtual reality environments and scientific computer simulations to (...) critically engage with Chalmers’s position. I first argue that, if it is sound, his virtual realism should also be applied to objects that figure in scientific computer simulations, e.g. to simulated galaxies. This leads to a slippery slope because it implies an unreasonable proliferation of digital objects. A philosophical analysis of scientific computer simulations suggests an alternative picture: The cat and the galaxies are parts of fictional models for which the computer provides model descriptions. This result motivates a deeper analysis of the way in which Chalmers builds up his realism. I argue that he buys realism too cheap. For instance, he does not really specify what virtual objects are supposed to be. As a result, rhetoric aside, his virtual realism isn’t far from a sort of fictionalism. (shrink)

Reflective equilibrium (RE) is often regarded as a powerful method in ethics, logic, and even philosophy in general. Despite this popularity, characterizations of the method have been fairly vague and unspecific so far. It thus may be doubted whether RE is more than a jumble of appealing but ultimately sketchy ideas that cannot be spelled out consistently. In this paper, we dispel such doubts by devising a formal model of RE. The model contains as components the agent’s commitments and a (...) theory that tries to systematize the commitments. It yields a precise picture of how the commitments and the theory are adjusted to each other. The model differentiates between equilibrium as a target state and the dynamic equilibration process. First solutions to the model, obtained by computer simulation, show that the method allows for consistent specification and that the model’s implications are plausible in view of expectations on RE. In particular, the mutual adjustment of commitments and theory can improve one’s commitments, as proponents of RE have suggested. We argue that our model is fruitful not only because it points to issues that need to be dealt with for a better understanding of RE, but also because it provides the means to address these issues. Ludwik Fleck is a pioneer of the contemporary social constructionist trend in scientific theory, where his central concept of thinking style has become standard fare. Yet the concept is too often misunderstood and simplified with serious consequences not only for Fleck studies. My essay situates Fleck’s concept of thinking style in the historical context of the 1920s and ‘30s, when the notion of style was first applied to the natural sciences, in order to illustrate the uniqueness of Fleck’s concept (...) among the uses of style by his contemporaries and, finally, to examine the epistemological, methodological, and political consequences of this distinction. Abstract What do we mean to say when we call some person a good business manager? And where do the criteria flow from by which we judge people good business managers? I answer these questions by drawing on von Wright's distinction between several varieties of goodness. We can then discriminate between instrumental, technical and moral senses of the expression ?to be a good business manager?. The first two senses presume that business managers have a characteristic task or that they (...) engage in typical activities. It is natural to specify this task and these activities by appealing to goods and to the good of a business. These goods may then be identified as goods for people. Insofar as the welfare of people is of moral value, we obtain a morally loaded account of business management. I argue against this account and plead for a more sober understanding of economic goods and of the good of a business. The latter can be understood in analogy to the good of an individual person, but is largely determined by the goals of the founders and owners. Economic goods are things that are wanted by some people and thus exchanged on markets. If this is so, then there is no direct conceptual path from instrumentally or technically good business managers to morality even though there are certain affinities. To conclude, I trace the consequences for our understanding of business ethics. (shrink)

The search for a quantum theory of the gravitational field is one of the great open problems in theoretical physics. This book presents a self-contained discussion of the concepts, methods and applications that can be expected in such a theory. The two main approaches to its construction - the direct quantisation of Einstein's general theory of relativity and string theory - are covered. Whereas the first attempts to construct a viable theory for the gravitational field alone, string theory assumes (...) that a quantum theory of gravity will be achieved only through a unification of all the interactions. However, both employ the general method of quantisation of constrained systems, which is described together with illustrative examples relevant for quantum gravity. There is a detailed presentation of the main approaches employed in quantum general relativity: path-integral quantisation, the background-field method and canonical quantum gravity in the metric, connection and loop formulations. The discussion of string theory centres around its quantum-gravitational aspects and the comparison with quantum general relativity. Physical applications discussed at length include the quantisation of black holes, quantum cosmology, the indications of a discrete structure of spacetime, and the origin of irreversibility. This book will be of interest to researchers and students working in relativity and gravitation, cosmology, quantum field theory and related topics. Starting from 2009, national courts of the EU Member States for the first time gained a “real” right to request the EU Court of Justice for preliminary rulings in asylum matters. First judgments of this Court demonstrate equivocal tendencies: some are blaming the Court for incompetence in asylum matters, others believe that the adoption of authoritative decisions at the European level will assist in developing consistent practice of applying asylum law in the European Union, something that failed at (...) international level due to absence of a single authoritative body to provide guidance on interpretation and application of the 1951 Refugee Convention. Considering that the judgments of the EU Court are part of the EU law, the Member States should develop their national asylum law with due regard being taken to those judgments. By the beginning of 2012, the Court has issued eight judgments on the interpretation of various problematic issues of EU asylum law. This Article analyses the jurisprudence of the EU Court in asylum cases, related to the granting of refugee status and subsidiary protection. It also provides a critical evaluation of those judgments. The main objective of the Article is to familiarise the relevant Lithuanian institutions and lawyers with the first judgments of the EU Court in asylum cases and encourage discussions concerning the application of rules established by the Court in the Lithuanian context. Due to limited size, this Article presents the analysis of two EU Court judgments adopted on interpretation of the 2004 Qualification Directive: Elgafaji v. The Netherlands (2009) dealing with granting of subsidiary protection, and Abdulla and others v. Bundesrepublik Deutschland (2010), dealing with cessation of refugee status. The value of those judgments first of all lies in the guidance they provided to the Member States on such concepts as: protection in a situation of an armed conflict, agents of protection, effectiveness of protection; as well as determination of a relationship between refugee status and subsidiary protection, relationship of the Qualification Directive with the European Convention on Human Rights and Fundamental Freedoms (ECHR), also cessation of protection. Elgafaji decision, while quite liberal with regard to persons seeking international protection, is not so liberally applied in the Member States’ practice and does not in itself guarantee positive outcome of the application of a concrete individual fleeing from an armed conflict, or a liberal approach to granting subsidiary protection in the Member States. Based on Elgafaji judgment it is clear that: Art. 15(b) of the Qualification Directive correspond to Art. 3 ECHR, while Art. 15(c) provides additional protection and in that it expands the Member States’ obligations beyond the ECHR to provide protection to persons fleeing in situations of armed conflict. While not every person arriving from an armed conflict situation would automatically fall under the granting of subsidiary protection, in certain exceptional situations indiscriminate violence may amount to individual threat without invoking personal circumstances. The EU Court departed from the individualisation requirement applied by the European Court of Human Rights in Art. 3 cases and did not also rely on international humanitarian law, by introducing a “sliding scale” formula for establishing an individual threat in armed conflict situation instead. This formula addressed the alleged internal discrepancy between “individual threat” and “indiscriminate violence”. The Abdulla decision brought in the human rights and law enforcement perspectives to the interpretation of cessation clauses, however it represents a rather superficial approach in the context of the analysed concepts (e.g. towards effectiveness of protection provided by the multinational armed forces) and is likely to be incompatible with the latest legislative trends in the EU asylum instruments (e.g. determination of refugee status and subsidiary protection by means of a single procedure) and the recent jurisprudence under the ECHR (e.g. failure to ensure a minimum standard of living may violate the ECHR). The Cistercian Jaume Janer († after 1506) was the most prolific student of Pere Daguí, the first professor in the Lullist Studium on Majorca, and became himself, by royal privilege from the Crown of Aragon, the leader of a similar institution in Valencia. Janer’s and Daguí’s brand of Lullism embraced elements from Scotism. In particular, Janer in three of his works discussed the system of distinctions put forward by Peter Thomae, one of Duns Scotus’s early followers. This preoccupation with (...) In business ethics journals, Kant’s ethics is often portrayed as overly formalistic, devoid of substantial content, and without regard for the consequences of actions or questions of character. Hence, virtue ethicists ride happily to the rescue, offering to replace or complement Kant’s theory with their own. Before such efforts are undertaken, however, one should recognize that Kant himself wrote a “virtue theory” (Tugendlehre), wherein he discussed the questions of character as well as the teleological nature of human action. Numerous Kant (...) scholars argue that Kant already erected precisely the kind of integrative moral architecture that some of his modern interpreters (while aiming to supersede him) wish to construct. For business ethics, this divergence of scholarly opinion is of crucial importance. It shows first that the standard portrayals of Kant’s ethics in business ethics textbooks—as rigidly deontological, narrowly individualistic, and hence unsuitable for the specific demands of corporate agency—might have to be revised. Second, discussions in the business ethics literature on stakeholder-engagement and managerial decision-making likewise stand to gain from a more nuanced picture of Kant’s moral philosophy. Third, a reassessment of Kant’s ethics with regard to questions of personal character and moral sentiments might also lead to a more favorable view of the relevance of his ethics for managerial practice. Last, but not least, the many current attempts to reconcile Kant’s freedom-oriented philosophy with virtue theories stand to benefit considerably from a better understanding of how Kant himself conceived of one such synthesis between the formal and substantial aspects of morality. This, ultimately, could lead to an important overlapping consensus in the academic literature as to the role and relevance of virtuous conduct in business. (shrink)

Um diese Frage zu beantworten, analysiert die vorliegende Arbeit das Metaphysikwerk des wichtigsten Repräsentanten des frühneuzeitlichen Scotismus, Bartholomaeus Mastrius (1602-1673); sie erschließt außerdem eine Vielzahl von kaum bis gar nicht erforschten Metaphysikwerken aus der Franziskanerscholastik des 17. und (...) 18. Jahrhunderts. Das eigenartige, erstaunliche Vielfalt einschließende Profil einer in Vergessenheit geratenen philosophischen Tradition wird deutlich. Durch den Fokus auf ein philosophiehistorisches Phänomen außerhalb des Mainstreams leistet die Arbeit einen Beitrag zu einer differenzierteren Sichtweise der intellektuellen Kultur der europäischen Frühmoderne. Baroque-age Scotist philosophy was, on the one hand, characterised by recourse to the Medieval thinker John Duns Scotus and, on the other hand, by an adaptation to trends in contemporary scholasticism, first of all that of the Jesuits. What kind of metaphysics did this particular constellation within the history of philosophy produce? In order to answer this question, the present book analyses the work on metaphysics by the most important representative of early modern Scotism, Bartolomeo Mastri (1602-1673). In addition, the book investigates a multitude of scarcely or never studied works on metaphysics from the Franciscan scholastic tradition of the 17th and 18th centuries. The peculiar profile of a forgotten philosophical tradition with its astonishing plurality becomes apparent. By focusing on a phenomenon from the history of philosophy outside the mainstream, this work contributes to a more differentiated view on the intellectual culture in early modern Europe. (shrink)

The following analysis of the Protagoras intends: contrary to the traditional tendency to consider the dialogue comparatively amorphous and polythematic, to clarify its argumentative architectonic; contrary to the scholarly view accompanying this tendency that of concern is an early dialogue, to make plausible the genesis of this dialogue after the Symposium; and to lay the groundwork for a more detailed discussion of the thesis that Plato, in his “middle” dialogues, makes the transition from Eleatic logic in its Megarian refraction, which (...) forms the basis of the early dialogues as well as the Gorgias and incidentally also of the first book of the Republic, to that logic of the middle which is to be regarded as the immediate historical forerunner of Aristotelian syllogistic. Particular emphasis is placed in this context on the Protagoras insofar as Plato here not so much makes the discovery of the middle as he reflects it, a discovery which has after more than two thousand years of “classical logic” become inconspicuous to us, but which shattered his relation to the Megarian school and was the first to bury the fifth century logically. In this paper, I develop a syntactic framework for the analysis ofstrategic form games that is based on a straightforward combination ofstandard systems of doxastic, probabilistic and conditionalpropositional logic. In particular, for the probabilistic part I makeuse of the axiomatization provided in Fagin and Halpern (1994). The use ofconditionals allows to represent a strategic form game by a logicalformula in a very natural way. Also expected utility maximization can benaturally captured. I use this framework to prove a version of a (...) resulton Nash equilibrium conjectures first presented in Aumann and Brandenburger (1995). (shrink)

In this regard, I focus on presentations of utilitarianism in relation to distributive principles and on the demanding nature of utilitarianism. Second, I will demonstrate that these (...) imprecise and faulty presentations result in a misguided critique of utilitarianism and dubious conclusions within the field of business ethics. Here, I will discuss and reject conclusions regarding utilitarianism and its relation to capitalism, theclaim that utilitarianism is not much more sophisticated than a simple majority vote and that utilitarianism is in accordance with harmful actions such as bribery and child labor. In West Germany, there is a good deal of disagreement among leading political groups, economic decision makers and scientific experts concerning both the future of the labor market and the role of labor in society. This disagreement bears on all of the three relevant points: the prognosis of the likely future development, the policy most suited to this development, and the criteria and objectives that determine whether, in fact, a development could be judged as positive or indeed desirable. Quite a number of contemporary publications in Germany feature the famous graph, developed in 1982 by the Federal Labor Agency's Institute for Labor Market and Vocational Research, which depicts labor market trends for the years 1965 to 2000. In July 1907 the Holy Office issued the decree „Lamentabili“, which has been regarded as the first important formulation of the antimodernism prevalent under Pope Pius X. This essay offers the first reconstruction of the internal history of „Lamentabili“ as a document, based on the archival material in the Roman Congregation for the Doctrine of the Faith. The history behind Lamentabili goes back to the censuring of Loisy's main works in 1903. The long and difficult process of drafting (...) and discussing the propositions of „Lamentabili“ reveals divergent opinions about Loisy and the entire „modernist“ problem within the Holy Office. Lamentabili bears traces of attenuation and compromise, and it seems probable that the necessity of drafting the papal Encylica „Pascendi“ against the errors of the „Modernists“ sprang from the dissatisfaction of leading antimodernists with the formalized and tedious process of conducting discussions within the Roman Inquisition. The paper focusses on various methods of preparing chemical compounds and on laboratory techniques used in that. It is based on different texts ascribed to „Basil Valentine”, an important author of alchemical writings whose real identity is not yet established beyond any doubt. Basil was a leading alchemical experimentator of his time and devised a number of preparation-processes for new substances, some of which are discussed here. The paper sheds also new light on some hitherto established notions of priority which (...) were attributed to Basil Valentine or other alchemists. (shrink)

This paper discusses recent attempts to solve the problem of induction. Two broad strategies to escape Hume's fork can be distinguished. The first tries to localize the justification of specific inductions in uncontroversial empirical knowledge, e.g.mundane scientific knowledge (J. D. Norton) or perception (M. Lange). I argue that related attempts to (dis)solve the problem fail. The second strategy tries to put forward an argument in favor of induction. As a discussion of work by R. White shows, this argument can (...) barely prove that induction is reliable or at least not unreliable. But D. Steel, F. Huber and G. Schurz could show that enumerative induction is necessary and sufficient for a certain epistemic goal or optimal in a certain sense. These proofs, however, only solve the problem of induction if the goal or a certain standard has priority over the avoidance of error. This suggests that the difficulties to justify induction do not so much derive from Hume's fork, but rather from a plurality of sensible epistemic goals that can conflict with each other. (shrink)

Der Beitrag von Claus Pias geht von zwei Beobachtungen aus: einem Zurücktreten des Medienbegriffs innerhalb medienwissenschaftlicher Forschung und eines Desinteresses sogenannter ›Digitalisierung‹ ihr gegenüber. Er untersucht, inwiefern Medientheorie (von McLuhan und Kittler bis zu den sogenannten Digital Humanities) durch einen starken Medienbegriff an der Herausbildung von Zeitsemantiken und Narrativen von ›Digitalisierung‹ beteiligt war und von ihnen profitiert hat. Als Konsequenz fordert Pias zu medienwissenschaftlicher Grundlagenforschung auf, die mit einer strategischen Revision und Aktualisierung von ›Medien‹ als Begriff und Gegenstand einhergeht. Der (...) Beitrag von Kathrin Peters stimmt mit dieser Lagebeschreibung nur teilweise überein. Die Skepsis gegenüber den Zukunfts- und Dringlichkeitsrhetoriken gegenwärtiger Digitalisierungsoffensiven wird von ihr geteilt, dass allerdings vor allem eine Medienwissenschaft des ›medientechnischen a priori‹ eine Antwort auf den gegenwarts- und an- wendungsfixierten Digitalisierungsdiskurs liefern könnte, erscheint Peters als zu kurz gegriffen. Andere medienwissenschaftliche Ausrichtungen sind dazu ebenso in der Lage: medienwissenschaftliche Analysen zu Kolonialität und Postkolonialität, feministische, gen- der- und queertheoretische Fragestellungen, eine medienwissenschaftlich informiert Wissenschaftsforschung und Affekttheorie – um nur einige zu nennen. Es geht um Konzepte von Medienwissenschaft als Fragestellung, die ihre Gegenstände in den verschiedensten Bereichen hervorbringen, dabei aber zugleich als Mittel und Mittler immer wieder unsichtbar werden. Debate: Media Studies without Media Claus Pias’ article starts out from two points of observation: a recession of the term media within the field of media studies and a dis- interest of the so-called digitalization in this particular term. Pias examines the impact media theory (ranging from McLuhan and Kittler to the so-called Digital Humanities) had on the development of time semantics and the narratives of ›digitalization‹ due to the use of a strong media term, and how media theory profited from it. mAs a result, Pias calls for establishing basis research in media studies, going hand in hand with a strategic revision and update of media, as a term as well as a subject. In her article, Kathrin Peters only partially agrees with this evaluation. She shares the scepticism concerning future-rhetoric as well as priority-rhetoric, both featuring heavily in current digital offensives; however, in her opinion it is not enough to hope for answers on today’s digitalization-discourse from media studies hailing the media-technical a priori. There are other approaches in media studies which are able to offer these answers: analysis of colonialism and post-colonialism, feministic, gender- and queer-theoretical questions, a media-informed science of knowledge and affect theory, just to name a few of them. It is all about concepts of media science being perceived as problems which bring forth their own subjects in various areas of research, yet as a tool as well as an intermediary, they are frequently overlooked. Abstract The first part argues that being an image is an (at least) four part relation between the image itself (x2), properties of recipients (B), the object (x3), and properties of the object (M). Referring to Grice, Schiffer, and Meggle, a distinction is made between communicativity and non-communicativity (manipulativity) of x2 regarding to B, x3, and M. The second part substitutes sign and image by explicates that denote properties relevant for x2 being an image regarding to B, x3, and (...) M, making thus clear why images are signs. Intentional relations and causal relations are the basis of this explication (influenced by Posner) that is also meant to give an idea of those properties that are typical of pieces of fine arts and of some other cultural practices. Additionally, it helps in understanding the difference between typical images and more abstract symbols. -/- Im ersten Abschnitt werden Gründe dafür genannt, Bildsein als mindestens vierstellige Beziehung aufzufassen: als Beziehung zwischen dem Bild (x2), Rezipienteneigenschaften (B), dem Bildgegenstand (x3) und Eigenschaften (M) des Bildgegenstandes. Debate: Media Studies without MediaClaus Pias’ article starts out from two points of observation: a recession of the term media within the field of media studies and a dis- interest of the so-called digitalization in this particular term. Pias examines the impact media theory (ranging from McLuhan and Kittler to the so-called Digital Humanities) had on the development of time semantics and the narratives of ›digitalization‹ due to the use of a strong media term, and how media theory profited from (...) it. mAs a result, Pias calls for establishing basis research in media studies, going hand in hand with a strategic revision and update of media, as a term as well as a subject. In her article, Kathrin Peters only partially agrees with this evaluation. She shares the scepticism concerning future-rhetoric as well as priority-rhetoric, both featuring heavily in current digital offensives; however, in her opinion it is not enough to hope for answers on today’s digitalization-discourse from media studies hailing the media-technical a priori. There are other approaches in media studies which are able to offer these answers: analysis of colonialism and post-colonialism, feministic, gender- and queer-theoretical questions, a media-informed science of knowledge and affect theory, just to name a few of them. It is all about concepts of media science being perceived as problems which bring forth their own subjects in various areas of research, yet as a tool as well as an intermediary, they are frequently overlooked. In the “Whirl of Being.” The Birth of The Birth of Tragedy from the Spirit of Friedrich Hebbel. As a result of dubious editorial policy, Nietzsche research has always dealt only with the text of the later editions of The Birth of Tragedy from 1874/78 and 1886, in the erroneous assumption that these largely resemble the first printing. Surprisingly, the 1872 edition is therefore virtually unknown. It does, however, show significant differences from the later editions, especially since it exhibits (...) a strong influence of Hebbel’s tragic worldview that is later obscured in favor of Wagner. The first edition is more nihilistic, poetic, and powerful; Nietzsche’s later revisions have rather diluted the Birth of Tragedy’s argument and given it a different direction. (shrink)

A significant voice in encouraging the theoretical development and practical implementation of humanistic management is Pope Benedict XVI. In his Encyclical Letter Caritas in Veritate, published in 2009, he proposed a new humanistic synthesis to realign the economy with its social purpose. The aim of this book is to interpret, comment, and develop aspects of this Encyclical Letter which are significant for economic and business activity and contribute to humanistic management. The authors, specialists in their different fields, provide an interdisciplinary (...) dialogue between their repsective areas and the Encyclical. The first, theoretical, part of the book focuses on the relationship between ethics and economics to advance toward a holistic view of business and managerial activity. The second part is oriented more toward the practical and managerial aspects, and discusses how the Encyclical can contribute to more humanistic ways of management. (shrink)

If you want to challenge or at least weaken the adhesion to a system of values, you can basically adopt two radically opposed rhetorical strategies. Either you will attack the system in a frontal way: for instance, fundamentalists or fascists deny any validity to democratic values and human rights. Or you will pretend to argue from within the system (by saying that you accept some of its basic premises), while subtly distorting the process of reasoning in order to get to (...) your conclusions. If the audience is naïve or poorly informed, you will be able to defend positions that are fundamentally at odds with liberal-democratic values while seeming to argue from inside the system. I would like to show how such a process of “perverse” translation works in the context of the Darwinism/Creationism “controversy”. The attacks on the teaching of evolutionary biology began approximately one century ago. The way Creationists have argued and changed several times their rhetorical strategies seems very interesting to me, in that it exemplifies an important contemporary phenomenon, which I call “perverse translation” or “the wolf in the sheepfold”.
