Der kürzlich verstorbene US-amerikanische Soziologe Robert K. Merton war der prominenteste und einflußreichste Anomie-Theoretiker nach Emile Durkheim. Seine Typologie der Arten individueller Anpassung an anomische gesellschaftliche Situationen bietet heute noch eine wertvolle Grundlage zur Analyse von Gesellschaften. Dieser Beitrag konzentriert sich auf einen dieser Anpassungstypen, den Ritualismus, der Merton zufolge beinhaltet, daß einerseits die kulturellen Ziele, allen voran das des wirtschaftlichen Wohlstands, heruntergeschraubt oder aufgegeben und andererseits die institutionellen Normen zur Erreichung dieser Ziele beinahe zwanghaft befolgt werden. Diese Definition (...) überdenkend versucht der vorliegende Beitrag herauszuarbeiten, daß innerhalb des Systems der Anpassungsformen das Herunterschrauben der kulturellen Ziele nicht das Hauptcharakteristikum ritualistischen, sondern konformen Verhaltens darstellt. Ritualisten haben den Prozeß des Herunterschraubens vielmehr bereits beendet, indem sie jegliche kulturellen Ziele aufgegeben haben, bis auf den einen Wert an sich, nämlich die institutionellen Regeln einzuhalten.Ritualistische Anpassung ist aus Merton`s Sicht für die Soziologie abweichenden Verhaltens, ganz zu schweigen von den Kriminalwissenschaften, nicht von Interesse. Im Gegensatz zu dieser Einschätzung versucht dieser Artikel die verschiedenen soziologischen und sogar kriminologischen Implikationen ritualistischen Verhaltens darzustellen, mit dem Ergebnis, daß Ritualismus sehr wohl ein soziales Problem darstellt. Der Ritualist unterwirft sich nicht nur selbst den institutionellen Normen, sondern fühlt sich auch dazu berufen, andere ständig an die Einhaltung der Regeln zu gemahnen und sie zu überwachen. Deshalb gibt es viele typisch ritualistische Formen abweichenden Verhaltens, wie Denunziation, erzieherischer Tadel oder Mobbing, die sogar in kriminelles Verhalten wie falsche Verdächtigung, Nötigung oder Beleidigung kulminieren können.Am schillerndsten ist die Rolle des Ritualisten in der Kriminalpolitik, nicht zuletzt heute in der Bundesrepublik. Repression jeglicher Art ist seine Antwort auf Regelverstöße und die Kriminalpolitik macht zunehmend Zugeständnisse an ritualistische Forderungen nach härterer und schnellerer Bestrafung oder umfassender Überwachung des öffentlichen Raumes. Ritualisten dominieren den sozialen Diskurs und die allgemeine Wahrnehmung von Kriminalität nicht nur, weil sie wichtige Nutzer und damit Zielgruppe gewisser Massenmedien sind und gerne Leserbriefe schreiben. Sie sind so dominant, weil ihre Art der Anpassung bei zunehmender wirtschaftlicher Krise die Konformität der Wirtschaftswunderzeit zurückgedrängt hat und heute die am weitesten verbreitete in der deutschen Gesellschaft ist. Daher ist auch die schon seit Jahrzehnten zu beobachtende Verschiebung der theoretischen Strafzweckbegründung hin zur Positiven Generalprävention alles andere als ein Zufall. The recently deceased US-sociologist Robert K. Merton has been the most prominent and influential anomie theorist since Emile Durkheim. His typology of modes of adaptation to anomic social situations still constitutes a valuable basis for analyzing society. This contribution focuses on one of these types of adaptation, ritualism, which according to Merton, involves the scaling down or abandoning of the cultural goals, above all economic wealth, on the one hand and to abide almost compulsively by institutional norms to attain these goals on the other. In reconsidering this definition, this contribution attempts to elaborate that within the system of adaptive modes scaling down does not describe the main characteristic of ritualistic behaviour, but first of all characterizes conformity. Ritualists, on the contrary, have already completed the process of scaling down by finally abandoning any cultural goal except the one end-in-itself, that is to comply with the institutional rules.Ritualistic adaptation, in Merton`s view, is of no interest to the sociology of deviant behaviour, not to mention criminal sciences. In contrast to this evaluation this contribution tries to delineate the various sociological and even criminological implications of ritualistic behaviour, leading to the conclusion that Ritualism does indeed present a social problem. The ritualist does not only surrender himself to the institutional means but feels competent to constantly reminding others of abiding by the institutional norms and supervising them. Hence there are many typically ritualistic forms of deviant behaviour like denunciation, disciplinary reproof or mobbing that may even culminate in criminal behaviour like false suspicion, duress or insult.Most ambiguous is the ritualist`s part in criminal policy, not at least in contemporary Germany. Repression of any kind is his answer to breaches of the rules and criminal policy more and more concedes to ritualistic demands for more severe and rapid punishment or extensive supervision of public facilities. Ritualists dominate the social discourse and general perception of criminality, not only because they are important users and therefore the target group of certain mass media, and like to write letters to the editor. They do dominate because in times of increasing economic crisis their mode of adaptation has forced back the conformity of the German economic miracle era and is now the most common one in contemporary German society. Thus, the shift in the theoretical justification of punishment towards a theory of positive general prevention, noticeable for decades, is anything but accidental. (shrink)

This paper sheds light on the role of digital platform labour in the development of today’s artificial intelligence, predicated on data-intensive machine learning algorithms. Focus is on the specific ways in which outsourcing of data tasks to myriad ‘micro-workers’, recruited and managed through specialized platforms, powers virtual assistants, self-driving vehicles and connected objects. Using qualitative data from multiple sources, we show that micro-work performs a variety of functions, between three poles that we label, respectively, ‘artificial intelligence preparation’, ‘artificial intelligence verification’ (...) and ‘artificial intelligence impersonation’. Because of the wide scope of application of micro-work, it is a structural component of contemporary artificial intelligence production processes – not an ephemeral form of support that may vanish once the technology reaches maturity stage. Through the lens of micro-work, we prefigure the policy implications of a future in which data technologies do not replace human workforce but imply its marginalization and precariousness. (shrink)

The development of symbolic logic is often presented in terms of a cumulative story of consecutive innovations that led to what is known as modern logic. This narrative hides the difficulties that this new logic faced at first, which shaped its history. Indeed, negative reactions to the emergence of the new logic in the second half of the nineteenth century were numerous and we study here one case, namely logic at Oxford, where one finds Lewis Carroll, a mathematical teacher who (...) promoted symbolic logic, and John Cook Wilson, the Wykeham Professor of Logic who notoriously opposed it. An analysis of their disputes on the topic of logical symbolism shows that their opposition was not as sharp as it might look at first, as Cook Wilson was not so much opposed to the « symbolic » character of logic, but the intrusion of mathematics and what he perceived to be the futility of some of its problems, for logicians and philosophers alike. In Professional Ethics and Civic Morals , Emile Durkheim outlined the core of his theory of morality and social rights which was to dominate his work throughout the course of his life. In Durkheim's view, sociology is a science of morals which are objective social facts, and these moral regulations form the basis of individual rights and obligations. This book is crucial to an understanding of Durkheim's sociology because it contains his much-neglected theory of the state as a moral (...) institution, and it provides an understanding of his critique of anomie and egoistic individualism. The growing interest in cultural revolution and moral regulation make this edition of Durkheim's classic work especially timely. The new preface by Bryan Turner sets the book in its intellectual and historical context, and illustrates the relevance of this work to present day debates on the state, society, and moral regulation. Feminist social theory and female body experience are the twin themes of Iris Marion Young's twelve outstanding essays written over the past decade and brought together here. Joint action is a growing field of research, spanning across the cognitive, behavioral, and brain sciences as well as receiving considerable attention amongst philosophers. I argue that there has been a significant oversight within this field concerning the possibility that many joint actions are driven, at least in part, by agents' social motivations rather than merely by their shared intentions. Social motivations are not directly related to the (joint) target goal of the action. Instead, when agents are mutually socially motivated (...) in joint action this is because they find acting with others rewarding in its own right. Moreover the involvement of social motivation in joint action typically enables individuals to achieve the long-term benefits associated with being part of a social bond. I argue that taking social motivations into account better prepares us for explaining a broader range of joint actions, including those that are of an antagonistic, competitive, or explorative character. Finally, I show that recognizing the importance of social motivations entails that joint actions (in general) should be understood as having the two primary functions of (1) achieving the intended target outcome of an action, and (2) attaining the benefits related to being part of a social bond. On the basis of an intensive examination of forms and principles of symbolic classification reported from the Australian aborigines, the Zuñi and traditional China, they try to establish a formal correspondence between social and symbolic classification. From this they argue that the mode of classification is determined by (...) the form of society and that the notions of space, time, hierarchy, number, class and other such cognitive categories are products of society. Dr Needham’s introduction assesses the validity of Durkhiem and Mauss’s argument, traces its continued influence in various disciplines, and indicates its analytical value for future researches in social anthropology. Legal responses to battered women who kill have long animated scholarly debate and law reform activity. In September 2012 after 47 years of alleged abuse, Frenchwoman Jacqueline Sauvage fatally shot her abusive husband three times in the back. The subsequent contested trial, conviction for murder, unsuccessful appeal and later presidential pardon of Sauvage thrust the French law of self-defence into the spotlight. The Sauvage case raises important questions surrounding the adequacy of the French criminal law in this area, the ongoing (...) proliferation of gendered stereotypes in law and the need for reform. In the wake of the Sauvage case, this article provides a timely analysis of the gendered law of self-defence in France. Drawing from an in-depth analysis of the judgments imposed in the Sauvage case, this article examines the adequacy of French legal responses to battered women who kill and ignites an argument for further law reform. The question of ontological foundation has undergone a noteworthy revival in recent years: metaphysicians today quarrel about how exactly to understand the asymmetrical and hyperintensional relationship of grounding. One of the reasons for this revival is that the old quantificationalist meta-ontology inherited from Quine has been effectively criticised by leading philosophers favourable to a meta-ontology, the aim of which is to come to know “which facts/items ground (constitute the base of) which other facts/items”, thus to examine the relation of ontological (...) dependence between beings (e.g. chemical properties depend on physical properties, the economic situation on the behaviour of individuals etc.), i.e. to explore the hierarchical structure of reality. I shall not discuss here the relationship of grounding in itself, but make some historical-formal remarks on the properties of the ultimate ontological foundational item itself and its aporetic nature. To do so I explore various more or less exotic philosophical ecosystems in the following order: Heidegger (Seyn), Plato (ἕν), Wáng Bi (道, dào). On the way I shall propose a new interpretation both of certain hypotheses in the Parmenides and of the nature of the opposition between Wáng Bì and Guō Xiàng in regard to the logical grammar of the expression “nothing (無, wú)” (transl. Metaphysicians who are aware of modern physics usually follow Putnam (1967) in arguing that Special Theory of Relativity is incompatible with the view that what exists is only what exists now or presently. Partisans of presentism (the motto ‘only present things exist’) had very difficult times since, and no presentist theory of time seems to have been able to satisfactorily counter the objection raised from Special Relativity. One of the strategies offered to the presentist consists in relativizing existence to inertial (...) frames. This unfashionable strategy has been accused of counterfeiting, since the meaning of the concept of existence would be incompatible with its relativization. Therefore, existence could only be relativistically invariant. In this paper, I shall examine whether such an accusation hits its target, and I will do this by examining whether the different criteria of existence that have been suggested by the Philosophical Tradition from Plato onwards imply that existence cannot be relativized. In this article I examine some of the issues involved in taking psychiatric disorders as natural kinds. I begin by introducing a permissive model of natural kind-hood that at least prima facie seems to allow psychiatric disorders to be natural kinds. The model, however, hinges on there in principle being some grounding that is shared by all members of a kind, which explain all or most of the additional shared projectible properties. This leads us to the following question: what grounding (...) do psychiatric disorders qua natural kinds have? My principal method for examining the issue is a case study of a particular psychiatric disorder: the so-called “apathetic children.” I argue that there appear to be at least two competing models that both appeal to non-organic a grounding of the disorder. However, for other psychiatric disorders, such as Alzheimer’s disease, the evidence points toward an organic explanation of the disorder. I contend that what unites psychiatric disorders is not a distinctive type of grounding that all psychiatric disorders share, but the distinctive set of determinable properties that is shared by all psychiatric disorders. Attempts have been made to establish nanoethics as a new sub-discipline of applied ethics. The nature of this sub-discipline is discussed and some issues that should be subsumed under nanoethics are proposed. A distinction is made between those issue that may ensue once nanotechnology applications become available and procedural issues that should be integrated into the decision structure of the development. A second distinction relates to the central value of the ethical issue. The conditions for the ethical debate differ depending (...) on whether the value(s) in question is internal to the technological development (i.e. health and safety) or external to it (i.e. privacy, equity etc). In order to explore public views on nanobiotechnology (NBT), convergence seminars were held in four places in Europe; namely in Visby (Sweden), Sheffield (UK), Lublin (Poland), and Porto (Portugal). A convergence seminar is a new form of public participatory activity that can be used to deal systematically with the uncertainty associated for instance with the development of an emerging technology like nanobiotechnology. In its first phase, the participants are divided into three “scenario groups” that discuss different future scenarios. In the (...) second phase, the participants are regrouped into three “convergence groups”, each of which contains representatives from each of the three groups from the first phase. In the final third phase, all participants meet for a summary discussion. This pilot project had two aims: (1) to develop and assess the new methodology and (2) to gather advice and recommendations from the public that may be useful for future decisions on nanobiotechnology (NBT). Participants emphasized that they wanted the technology to focus on solutions to environmental and medical problems and to meet the needs of developing countries. The need for further public participation and deliberation on NBT issues seemed to be acknowledged by all participants. Many of them also raised equality concerns. Views on the means by which NBT should be steered into socially useful directions were more divided. In particular, different views were expressed on how much regulation of company activities is needed to curb unwanted developments. The participants’ responses in a questionnaire indicate that the methodology of the convergence seminars was successful for decision-making under uncertainty. In particular, the participants stated that their advice was influenced both by access to different possible future developments and by the points of view of their co-participants, which is what the method is specifically intended to achieve. That which we call “negative theology” inspires within us both fascination and unease. We can either challenge all “negative theology” as a language game that is both impractical and contradictory, as many contemporaries do, or we can explore the question in light of the recent arguments of Derrida. The primary thesis in this paper is that we should reject “negative theology” as a descriptor and replace it, following the nomenclature of the Dionysian corpus, with “mystical theology.” In doing this, we (...) will come to realize that “mystical theology” no longer has the ambition to make constative use of language; its ambition is rather to be freed from such use. Thus, we move from a constative (and predicative) use of language toward a strictly pragmatic usage. This movement has yet to be proved, and what follows is an attempt to do just that. (shrink)

This paper attempts to reintegrate the concept of plasticity into educational philosophy. Although John Dewey used the concept in Democracy and Education it has not generated much of a critical or practical legacy in educational thought. French philosopher, Catherine Malabou, is the first to think plasticity rigorously and seriously in a contemporary philosophical context and this paper outlines her thinking on it as well as considering its applicability to education. My argument is that her definition not only successfully reintroduces the (...) concept in a way which is generative for contemporary educational philosophy and practice but that it also significantly extends the remit of educational plasticity as previously conceived by Dewey. This paper will examine the concept of educational plasticity as providing an opportunity as well as ‘the feeling of a new responsibility’ towards the plastic subject in philosophical approaches to education. We report our efforts to assess the skill of contemplating and evaluating argumentation. An adaptive forced-choice instrument was developed and administered to 6th grade students, 7th grade students who had participated in a year-long intervention that successfully strengthened their argumentation production skills, and expert arguers. The instrument was sensitive enough to detect differences in skill level across these groups. Despite their gains in production skill, however, 7th graders showed only modest superiority over the untrained 6th graders and performance well below (...) that of experts. Meta-level demands involved in evaluation but not present in production, we propose, may make evaluation more difficult. (shrink)
