In this brief paper, offered as a policy viewpoint, I introduce what I believe to be a novel concept for supporting individual citizen interaction with the U.S. Federal government, termed the individual social account. I explore whether and how the concept might be implemented so as to strengthen the U.S. social safety net and further citizen trust and responsibility in e-government interactions. I illustrate and develop the concept as a platform for reform and suggest and discuss design criteria, surfacing various (...) issues. Increasing genetic knowledge over the last decade has enabled hundreds of genetic variants associated with inherited cardiac conditions to be identified, many of which cause increased risk of sudden cardiac death. While individually these conditions are rare, taken together they impose a significant burden. The severity of these conditions—the possibility that they might cause sudden unheralded death of a teenager or young adult—juxtaposed with uncertainty about the pathology linked with many of the genetic variants is significant in terms of professional (...) practice because, increasingly, clinicians have been encouraged to cascade out genetic testing from the proband or consultand to other family members who may be at risk of developing the same condition. This process often involves sharing human tissue samples, DNA or personal information. This paper reviews the legal and regulatory frameworks which may apply when tissue and DNA samples are collected, used and retained, both for the purpose of diagnosis and for benefiting other family members, when a suspected or definitive diagnosis of an inherited cardiovascular condition is made. Sometimes the interests of family members may conflict, and it may be difficult for practitioners to reconcile the interests of one family member with another, particularly if the balance of benefits and harms from testing is unclear. The paper then examines some of the ethical tensions which may arise in practice and concludes that all involved should be conversant with the legal and ethical frameworks that apply. (shrink)

Over the past 40 years, scholars and practitioners of public relations have often cast public relations workers in the role of the public relations-person-as-corporate-conscience. This work, however, maintains that this construct is so problematic that invoking it is of negligible use in addressing ethical issues that emerge during a crisis. In fact, a complex crisis, such as the Jahi McMath “brain death” case at Children’s Hospital Oakland, demonstrates the need to abandon the PRPaCC construct to better engage affected stakeholders, including (...) “outsiders” to the organization, who often determine whether an organization is facing a crisis. Through an examination of both the concept of the PRPaCC and the McMath crisis, this work makes the case for moving beyond the PRPaCC construct in favor of a more modest role for the public relations person: facilitating widespread ethical deliberation and discussion throughout an organization, potentially helping the organization alleviate concerns that contribute to crises. One of the most popular Asian classics for roughly two thousand years, the Vimalakirti Sutra stands out among the sacred texts of Mahayana Buddhism for its conciseness, its vivid and humorous episodes, its dramatic narratives, and its eloquent exposition of the key doctrine of emptiness or nondualism. Unlike most sutras, its central figure is not a Buddha but a wealthy townsman, who, in his mastery of doctrine and religious practice, epitomizes the ideal lay believer. For this reason, the sutra has (...) held particular significance for men and women of the laity in Buddhist countries of Asia, assuring them that they can reach levels of spiritual attainment fully comparable to those accessible to monks and nuns of the monastic order. Esteemed translator Burton Watson has rendered a beautiful English translation from the popular Chinese version produced in 406 C.E. by the Central Asian scholar-monk Kumarajiva, which is widely acknowledged to be the most felicitous of the various Chinese translations of the sutra and is the form in which it has had the greatest influence in China, Japan, and other countries of East Asia. Increased knowledge of the gene–disease associations contributing to common cancer development raises the prospect of population stratification by genotype and other risk factors. Individual risk assessments could be used to target interventions such as screening, treatment and health education. Genotyping neonates, infants or young children as part of a systematic programme would improve coverage and uptake, and facilitate a screening package that maximises potential benefits and minimises harms including overdiagnosis. This paper explores the potential justifications and risks of genotyping children (...) for genetic variants associated with common cancer development within a personalised screening programme. It identifies the ethical and legal principles that might guide population genotyping where the predictive value of the testing is modest and associated risks might arise in the future, and considers the standards required by population screening programme validity measures . These are distinguished from the normative principles underpinning predictive genetic testing of children for adult-onset diseases—namely, to make best-interests judgements and to preserve autonomy. While the case for population-based genotyping of neonates or young children has not yet been made, the justifications for this approach are likely to become increasingly compelling. A modified evaluative and normative framework should be developed, capturing elements from individualistic and population-based approaches. This should emphasise proper communication and genuine parental consent or informed choice, while recognising the challenges associated with making unsolicited approaches to an asymptomatic group. Such a framework would be strengthened by complementary empirical research. (shrink)

There is much to admire in John Pittard’s recent book on the epistemology of disagreement. But here we develop one concern about the role that rational insight plays in his project. Pittard develops and defends a view on which a party to peer disagreement can show substantial partiality to his own view, so long as he enjoys even moderate rational insight into the truth of his view or the cogency of his reasoning for his view. Pittard argues that this may (...) happen in ordinary cases of religious disagreement—cases in which it’s a live skeptical possibility that one is misdescribing his insight, or not having insight at all—and therefore one need not be strongly conciliatory even in the face of peer disagreement. Yet Pittard agrees that one should be strongly conciliatory in cases of disagreement involving, e.g., visual perception and dim rational insight, since the sort of fallible, corrigible evidence involved in such cases may be counterbalanced by symmetrical evidence on the part of one’s disagreeing peer. We worry that there’s an inconsistency here. If it’s unreasonable to show partiality to one’s visual experience (or dim rational insight) in cases like “Horse Race” and “Restaurant Check,” it’s likewise unreasonable to show partiality in religious disagreements to one’s moderate rational insight, fallible and corrigible as it is. This article seeks to explain the variable implementation of gender mainstreaming as a `policy frame' over time and across various international organisations (I.O.s). In the years since the U.N. Fourth World Women's Conference in Beijing (1995),mainstreaming has been endorsed and adopted by a wide range of international organisations, and we compare the adoption and implementation of mainstreaming in four specific I.O.s: the World Bank, the United Nations Development Programme, the Organisation for Security and Cooperation in Europe, and the European Union. The rhetorical acceptance of mainstreaming by various international organisations, however, obscures considerable variation in both the timing and the nature of the mainstreaming process within and among organisations. This variation, in turn, can be explained in terms of the categories of political opportunity, mobilising structures and strategic framing, which have been put forward by social movement theorists. This paper opens with first‐hand accounts of critical care medical interventions in which detainees, in the custody of U.S. Immigration and Customs Enforcement (ICE), are brought to the emergency department for treatment. This case dramatizes the extent to which the provision of ethical and acceptable nursing care is jeopardized by federal law enforcement paradigms. Drawing on the scholarship of Michel Foucault and Giorgio Agamben, this paper offers a theoretical account of the power dynamics that inform the health care of patients (...) who find themselves caught in the custodial scaffolding of a vast immigration and detention apparatus. It offers an analysis of the display of sovereign and biopolitical power over the lives (and deaths) of detainees (Foucault), as well as the ways these individuals are reduced to “bare life” under the political pretext of an emergency or “state of exception” (Agamben). Our purpose here is both theoretical and practical: to better understand the often hidden agency or impersonal “will” exercised by the immigrant detention system, but also to equip clinicians in these and cognate facilities (e.g., prisons) with the critical tools by which they might better navigate incommensurable paradigms (i.e., care vs. custody) in order to deliver the best care while upholding their ethical duties as a care provider. This is all the more pressing because hospitals are not sanctuaries and given the incursion of federal law enforcement agents, nurses may find themselves conscripted as de facto agents of the state. Grelling's Paradox is the paradox which results from considering whether heterologicality, the word-property which a designator has when and only when the designator does not bear the word-property it designates, is had by 'heterologicality'. Although there has been some philosophical debate over its solution, Grelling's Paradox is nearly uniformly treated as a variant of either the Liar Paradox or Russell's Paradox, a paradox which does not present any philosophical challenges not already presented by the two better known paradoxes. The aims (...) of this paper are, first, to offer a precise formulation of Grelling's Paradox which is clearly distinguished from both the Liar Paradox and Russell's Paradox; second, to offer a solution to Grelling's Paradox which both resolves the paradoxical reasoning and accounts for unproblematic predications of heterologicality; and, third, to argue that there are two lessons to be drawn from Grelling's Paradox which have not yet been drawn from the Liar or Russell's Paradox. The first lesson is that it is possible for the semantic content of a predicate to be sensitive to the semantic context; i.e., it is possible for a predicate to be an indexical expression. The second lesson is that the semantic content of an indexical predicate, though unproblematic for many cases, can nevertheless be problematic in some cases. In Section 1, Grelling's Paradox is presented informally. After making some refinements, Grelling's Paradox is then presented formally. In Section 2, the formal version of Grelling's Paradox is evaluated, and several previously proposed solutions are discussed and argued to be inadequate. In Section 3, it is argued that the heterologicality predicate is an indexical expression. A semantics for the heterologicality predicate is given, and it is shown how this semantics accounts for the unproblematic predications of heterologicality, as well as the problematic cases, and therefore constitutes a satisfactory and complete solution to Grelling's Paradox. This article addresses shared themes in the writing of Saint Paul and the work of the science fiction writer Philip K. Dick. Much recent philosophical interest in Saint Paul focuses on his contemporary significance as a radical political thinker, following Jacob Taubes' influential late work, The Political Theology of Paul. Assessments of Paul's writing in this context (e.g. by Agamben, Badiou, Milbank) highlight the various ways in which he uses fictionalizing, for example in setting up the tension between the present (...) world and a messianic future, in the role he assigns to faith, and in the importance he assigns to the counter-factuality of resurrection. Yet the common thread of fictionalizing running through these themes has not been explicitly discussed. Meanwhile, the supposed `religious turn' in Dick's late writing has often been taken to have less political significance than his earlier science fiction. Considering Paul alongside Philip K. Dick, this article will attempt to bring out this central role of fictionalizing in the religious experiences of both. Like Paul, Dick experienced a visionary encounter with a God-like entity that shaped his interests and writing for the remainder of his life, and developed his own soteriology in response to what he perceived as the continued existence of (the Roman) Empire in modernity. Bringing out the mutual complementarity of Dick and Paul is facilitated by a framework derived from Henri Bergson's Two Sources of Religion, which theorizes the relation between mechanization as a human tendency characterizing both imperialism and industrialization, and fabulation as a human faculty for using fiction for the jointly immanent-transcendent purposes of survival/salvation. In this context, the diverse modes of fictionalizing employed by both Dick and Paul, including their unconsciously produced visions, may be understood as part of an ongoing, continually renewed strategy of revolutionary transformation of both self and world. Few studies have examined the influence of the food environment on obesity rates among very young, low-income consumers. This research contributes to this growing literature by examining the relationship between modifications to the retail environment and obesity rates for low-income, preschool-aged children. Based on data combined from various secondary sources, this study finds that changes in the retail environment are significantly related to obesity rates. More specifically, the authors find a positive relationship between the number of convenience stores in the (...) retail environment and obesity rates among low-income, preschool-aged children. Results also show that the percent change in grocery stores and supercenters and club stores in the retail environment is negatively related to the obesity rates of low-income, preschool-aged children [i.e., as grocery stores and supercenters/club stores increase, obesity decreases ].Further, the percent change in supercenters and club stores mediates the positive relationship between participation in the Supplemental Nutrition Assistance Program and obesity rates. Alterations to cognitive function are often reported with depression and anxiety symptoms, yet few studies have examined the same associations with mental well-being. This study examined the association between mental well-being, depression and anxiety symptoms and cognitive function in 1502 healthy adult monozygotic and dizygotic twins, and the shared/unique contribution of genetic and environmental variance. Using linear mixed models, mental well-being was positively associated with sustained attention, inhibition, cognitive flexibility, motor coordination and working memory, whereas depression and anxiety symptoms were (...) associated with poorer sustained attention, inhibition, cognitive flexibility and executive function. Bivariate twin modelling showed well-being shared a small environmental correlation with motor coordination and a small genetic correlation with working memory. Trivariate twin modelling showed well-being shared a small genetic correlation with inhibition, whereas depression and anxiety symptoms shared a small environmental correlation with inhibition. The remaining variance was mostly driven by unique G and/or E variance. Overall, well-being and depression and anxiety symptoms show both independent and shared relationships with cognitive functions but this is largely attributable to unique G or E variance and small shared G/E variance between pairs of variables. Although a number of authors have used diagrams extensively in their studies of Navya-Nyāya, they have done so to explain and illustrate concepts, not with the goal of reasoning with the diagrams themselves. Adherents of diagrammatic reasoning have made claims for its potential by pointing to key structural correspondences between diagrams and logical concepts, arguably lacking in sentential representations, and describing these relations using concepts such as “well matchedness” and “iconicity”. A canonical example of this iconicity is the use of (...) Euler diagrams to depict categorical syllogisms. Since the meaning of expressions in Indian logic differs in so many important ways from logic in the Western tradition, the use or adaptation of diagrams developed in the latter would seem to preclude iconicity. Thus, the development of diagrams which reflect the nature of inference in Navya-Nyāya, which centres on the anumāna inference schema, is motivated. In this paper we extend Ganeri’s method of depicting the Vaiśeṣika ontology with graphs to include syntax intended to expose the nature of anumāna. The diagrams are given a formal basis: i.e. abstract syntax, inference rules defined abstractly and a graph-theoretic semantics. These are the first formalised logical diagrams that aim to reflect the nature of the anumāna inference. This paper lays the way for further work in extending the formalism to cover more of Navya-Nyāya, and in exploring a dialogue between properties of the formalism and of Navya-Nyāya. (shrink)

Recent neuroimaging studies of language processing are examining the neural substrate of phonology because of its critical role in mapping sound information onto higher levels of language processing (e.g., words) as well as providing codes in which verbal information can be temporarily stored in working memory. However, the precise role of the inferior frontal cortex in spoken and written phonological tasks has remained elusive. Although lesion studies have indicated the presence of selective deficits in phonological processing, the location of lesions (...) underlying these impairments has not revealed a consistent pattern. Despite efforts to refine methods and tasks, functional neuroimaging studies have also revealed variability in activation patterns. Reanalysis of evidence from these neuroimaging studies suggests that there are functional subregions within the inferior frontal gyrus that correspond to specific components of phonological processing (e.g., orthographic to phonological conversion in reading, and segmentation in speech). Sentencing practices in cases of domestic homicide have been the object of critical scrutiny on previous occasions across a number of jurisdictions. It has been suggested by some that these practices reveal judges to be taking a more lenient approach to women who kill their violent male partners than to men who kill allegedly unfaithful female partners. This note evaluates claims of gender bias in sentencing practices in UK cases of domestic homicide following the Court of Appeal sentencing decision in (...) R. v. Suratan, R. v.Humes and R.v. Wilkinson [2002]E.W.C.A. 2982 concerning three men who killed their female partners. It will argue that in the wake of this decision current proposals to review both the substantive law of provocation and sentencing practices are to be welcomed. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:166 HUME'S INTEREST IN NEWTON AND SCIENCE Many writers have been forced to examine — in their treatments of Hume's knowledge of and acquaintance with scientific theories of his day — the related questions of Hume's knowledge of and acquaintance with Isaac Newton and of the nature and extent of Newtonian influences upon Hume's thinking. Most have concluded that — in some sense — Hume was acquainted with and (...) influenced by Newton's thought in particular and scientific thought in general. The genesis of this paper is the recent point of view put forward by Peter Jones which challenges the many permutations of this almost ritualistic standard line by removing Hume entirely from the Newtonian and the scientific scenes of thought. Jones argues that Hume knew less about Newton and science, and needed to know less about Newton and 2 science, than he believes is required by the above interpretation. Indeed, Jones argues that Hume's fundamental assumptions, which, according to Jones, derive ultimately from a form of Ciceronian humanism, drive a "wedge" between Newton's thought and that of 3 Hume. Even Hume's introductory remarks in the Treatise about his universal "science of man" are, for Jones, a declaration of independence from the materialistic trend (as Jones sees it) of Newtonian 4 science and not, as so many commentators have maintained — however tenuously or strongly evidence for linkage of Hume's project with Newtonian or scientific thought. Jones baldly argues that Hume totally lacked interest in science in general and in Newton and Newtonian science in particular. Following J. H. Burton's observation that Hume's work is surprisingly free from the "opinions" of contemporary scientists, 167 Jones states there is no evidence that Hume ever studied science at the University of Edinburgh or that he "pursued" scientific studies of any formal sort. Regarding Newtonian scientific thought, he emphasizes the paucity of specifically Newtonian scientific textbooks in the early eighteenth century 7 which might have been available for Hume to study and argues that nowhere in Hume's writings is there evidence of precise and detailed knowledge of Newton's science beyond what is available in Q Chamber's Cyclopaedia. Jones acknowledges that, in the Introduction to the Treatise, Hume utilizes a "general version" of Newton's "Regulae Philosophandi" from the beginning of Book III of Newton's Principia. Nevertheless, in Jones' view, Hume's fundamentally humanistic orientation separates him completely from g any Newtonian influence. Finally, according to Jones, Hume does not betray the least bit of knowledge of Newton's mathematics and its role in Newton's experimental methodology. On this evidence Jones grounds his central claim of Hume's "total lack of interest in contemporary science." What references there are to Newton and to science in Hume's works Jones finds "traceable to essentially literary predecessors such as Fontenelle or Montesquieu, or to standard works of theologians ] 2 or free-thinkers." The absence of clearly direct references to what Jones feels are scientific works results both from Hume's "total lack of interest in science" and from his commitment to a form of Ciceronian humanism which is "inimical" to what Jones finds to be the obvious materialistic tendencies of 13 science in the early modern period. Jones' account of the Ciceronian and French contexts of Hume's thought is excellent. But his claim that Hume had no interest whatsoever in science 168 is simply too strong and finally forces us to view science in Hume's day as equivalent to science in our own time, a manifestly anachronistic point of view. Throughout this paper, my argument will be conditioned by my view that Hume's interest in science cannot be separated from his epistemology or his religious scepticism. Hume's interest in science was precisely that of a man of letters of the eighteenth century vitally engaged in determining the proper use of scientific methodology in establishing the limits of the secular science of man once it has 14 been freed from the fetters of theology. O presente artigo explora a attitude ambígua de Robert Burton face aos Jesuítas, centrando-se na sua leitura dos Commentarii Collegii Conimbricensis Societatis Iesu. Após uma contextualização da sua detecção da Companhia de Jesus nas peças teatrais de Burton, passo em revista as referências do académico à articulação da melancholia nos manuais do curso conimbricense ao longo da Anatomia da Melancolia. Por forma a identificar e compreender as especificidades da sua leitura, pautada por adaptações selectivas e imprecisões, empreenderei uma (...) apresentação da doutrina dos temperamentos dos Conimbricenses. Sustento que, apesar da sua riqueza, da qual os ecos na obra de Burton dão testemunho esmaecido, a abordagem de De Góis permaneceu como um episódio obliterado na história médica e intelectual da melancolia. Este percurso permitirá uma compreensão das perspectivas terapêutica e organizacional subjacentes ao ensino conimbricense. Trata-se, como se tornará evidente, de valências e aplicações dos Commentarii que Burton ignora. Ironicamente, uma parte significativa do seu conhecimento das terras distantes, as suas viagens por “mapa e carta” e as suas perspectivas socioeconómicas sobre a China, aspectos centrais da transição de uma observação da melancolia para uma observação melancólica, bem patente no recurso à sátira e à utopia como vias terapêuticas, está consideravelmente dependente da articulação entre as capacidade formativa e a organização das missões jesuíticas. WRIGHT The publication of a new intellectual biography of George Cheyne1 provides a "propitious" occasion for "a thoroughly skeptical review"2 of the question which has long exercised Hume scholars, whether Cheyne was the intended recipient of David Hume's fascinating pie-Treatise Letter to a Physician,3 the letter (...) which describes his own hypochondriacal physical and mental symptoms and gives an account of his early philosophical development.4 Hume's nineteenth-century biographer, John Hill Burton, argued that Hume was probably writing to Cheyne,5 while Ernest Mossner claimed to definitively refute that hypothesis in an article entitled "Hume's Epistle to Dr. Arbuthnot," published in 1944.6 Anita Guerrini's intellectual biography does not discuss Cheyne as a possible recipient of Hume's letter, but she does present a well-rounded picture of this interesting eighteenth-century physician from which we can judge his appropriateness as its addressee. In the following discussion I will make use of the biographical material found in this new biography of Cheyne, as well as other sources, to show that Mossner's arguments are less than definitive, and that it would be wrong to dismiss the possibility that the letter was sent to George Cheyne.7 This is a possibility that, for reasons that I will make clear, makes good biographical and philosophical sense. At the same time, it is important to keep a proper suspense of judgment as Burton did, for the evidence that the letter was either intended for or actually sent to Cheyne is not definitive. John P. Wright Burton, who first published the autobiographical letter of the 22-yearold Hume in 1846, narrowed down the possible addressees of Hume's letter to either Cheyne or John Arbuthnot. He also pointed out that it is possible that the letter was never sent, and that the ten and a half page manuscript is only a neatly written draft, rather than a fair copy of an actual letter. Nevertheless, Burton thought he could identify the unnamed addressee on the basis of the internal evidence of the manuscript and the records of Scottish physicians practicing in England at the time. In the letter, Hume refers to the intended recipient as his "Countryman, a Scotchman [,]... a skilful Physician, a man of Letters, of Wit, of Good Sense, & of great Humanity."8 Further he writes that he is consulting him because he is a person "of great Learning beyond [his]... own Profession" who is acquainted with the "Motions of the Mind" he has described in his letter, and that "Fame pointed [him]... out as the properest person to resolve my Doubts..." about the cure of his disorder.9 Burton tells us that "the first name that suggested itself... was Arbuthnot, whose fine genius was just then flickering in the socket."10 (John Arbuthnot had been ill for some time, and died a year later.) But he then added that "a more full consideration showed to my satisfaction that it must have been destined for Dr. George Cheyne." His main reason for settling on Cheyne was that Cheyne's immensely popular The English Malady (1733) had recently been published, and that "there is a certain unison of tone between Hume's letter and this book." Burton quotes a portion of Cheyne's own long autobiographical account of his own disease in The English Malady. Cheyne's autobiography begins with the claim that "I passed my Youth in close study, and almost constant Application to the abstracted Sciences, (wherein my chief pleasure consisted) and consequently in great Temperance and a Sedentary Life"; it is followed by the reflection that any overindulgence in food or drink led to physical and psychological problems.11 He goes on to describe these in great detail for 39 pages, along with a history of his life. The own-age bias (OAB) refers to recognition memory being more accurate for people of our own-age than other-age groups (e.g., Wright and Stroud, 2002). This paper investigated whether the OAB effect is present during construction of human faces (also known as facial composites, often for forensic/police use). In doing so, it adds to our understanding of factors influencing both facial memory across the life span as well as performance of facial composites. Participant-witnesses were grouped into younger(19-35) and older(51-80) adults, and (...) each constructed a single composite from memory of an own- or cross-age target face using the feature-based composite system PRO-fit. They also completed the 40-item Glasgow Face Matching Test (GFMT; Burton, White and McNeill, 2010). A separate group of participants who were familiar with the relevant identities attempted to name the resulting composites. Correct naming of the composites revealed the presence of an OAB for older adults, who constructed more-identifiable composites of own-age than cross-age faces. For younger adults, age of target face did not influence correct naming and their composites we named at the same level as those constructed by older adults for younger targets. Also, there was no reliable correlation between face perception ability and composite construction. (shrink)
