What distinguishes constraints on our actions that make us unfree (in the sociopolitical sense) from those that make us merely unable? I provide a new account: roughly, a constraint makes a person unfree, if and only if, first, someone else was morally responsible for the constraint and, second, it impedes an ability the person would have in the best available distribution of abilities. This new account is shown to overcome shortcomings of existing proposals. Moreover, by linking its account of unfreedom (...) to distributions of abilities, it offers an attractive combination of so-called positive and negative views of freedom. (shrink)

A well known paragraph in Mill's 'Utilitarianism' has standardly been misread. Mill does not claim that if some pleasure is of 'higher quality', then it will be (or ought to be) chosen over the pleasure of lower quality regardless of their respective quantities. Instead he says that if some pleasure will be chosen over another available in larger quantity, then we are justified in saying that the pleasure so chosen is of higher quality than the other. This assertion is unproblematic.

One of the perennially intriguing questions regarding Kant’s approach to the human sciences is the relation between his ‘transcendental psychology’ and empirical cognitive psychology. In this paper I compare his analysis of the a priori conditions of human cognition in the Critique of pure reason with his empirical account of the human cognitive faculties in his Anthropology from a pragmatic point of view. In comparing his approach to self-consciousness, sensibility, imagination, and understanding in these two works, I argue that Kant (...) distinguishes between the transcendental and empirical aspects of the human cognitive faculties, and regards the transcendental functions as configuring the empirical faculties of human consciousness, or as giving them the structure that they require to become faculties of cognition. I then show that the cognitive faculties of human beings may vary in their empirical operation, even while they are configured by the same transcendental structure. Finally, I characterize Kant’s transcendental psychology in the first Critique as an account of the faculties that are required for a mind to be an agent or subject of cognition, corresponding to his account of the conditions that are required universally and necessarily for something to be an object of cognition.Keywords: Immanuel Kant; Anthropology; Psychology; Cognition; Transcendental; Empirical. Recent discussions about the cognitive value of fiction either rely on a background theory of reference or a theory of imaginative pretense. I argue that this reliance produces a tension between the two central or defining claims of literary cognitivism that: (1) fiction can have cognitive value by revealing or supporting insights into the world that properly count as true, and (2) that the cognitive value of a work of fiction contributes directly to that work’s literary value. I address that (...) tension by looking at the formal devices present in a work of fiction that enable it to realize the fictional world described by a text. When we focus on those formal elements, we can identify a connection between a work of literary fiction and the insights we gain through an encounter with the fictional world that work realizes. The article examines the use made of hegel's dialectic of lordship and bondage in kojeve, sartre and merleau-ponty as a means of discussing the problem of merging a phenomenology of social life with a dialectical conception of philosophical narration. it is argued that neither sartre nor merleau-ponty can reconcile phenomenology and dialectic without an ontologizing of politics which ultimately provides a misleadingly abstract account of political life. while concentrating on the period 1945-1955, the article draws out certain implications for the (...) evaluation of sartre and merleau-ponty's later work. The eighteenth‐century controversy among Moses Mendelssohn, Friedrich Heinrich Jacobi, and Immanuel Kant undermines the tendency to equate liberalism with the Enlightenment. While the defender of the Enlightenment, Mendelssohn, championed defended such traditional liberal values as religious toleration, his arguments were often illiberal. In contrast, many of the views of his anti‐ Establishment opponent, Jacobi, are remarkably liberal. Kant's essays from the mid‐i78os advanced a liberal conception of politics but a view of Enlightenment that was quite distant from those of both (...) Mendelssohn and Jacobi. (shrink)

Como he señalado en otras oportunidades, la obra de Santo Tomás de Aquino, aunque extensa y omniabarcante, se estructura a partir de algunos conceptos claves que sirven de fundamentos a la totalidad del ordenamiento de su pensamiento, lo que no lo simplifica, sino lo funda, haciendo de él un paradigma de reflexión también para nuestro tiempo, si sabemos comprenderlo desde la íntima profundidad de su sentido. La filosofía tomista es una filosofía esencialmente inclusiva que, a través de esas mismas ideas (...) matrices, presenta una cosmovisión filosófica y teológica, al mismo tiempo que refleja en ella una experiencia de vida. Así logra una síntesis que estructura una arquitectura reflexiva. Ello se puede ver en ideas como sabiduría, hábito y virtud, participación, analogía y otras. La connaturalidad como forma de conocimiento es una de esas ideas que estructuran su síntesis, siendo expresión de la congénita simpatía con el bien y de su concepción sobre la participación, mirada desde la realización cognoscitiva y afectiva de lo humano. El conocimiento por connaturalidad se muestra como simpatía que acerca afectivamente a un bien. Es así como, a través de él, presenta una visión casi sinóptica al abrirse a una amplia región de la doctrina tomista sobre Dios, el hombre, las cosas, desde un contexto que, aunque se puede analizar filosóficamente, es fundamentalmente teológico. En Santo Tomás la naturaleza se encuentra compenetrada por la gracia; su inteligencia no es sólo la del cultivar el don recibido, sino una inteligencia iluminada por la fe y purificada por la caridad. Por eso, la nobleza intelectual que transparece en sus escritos es, ante todo, el fruto de la santidad, de una santidad que no podía menos de expresarse en el orden del pensamiento. (shrink)

This chapter contains the results of my discussion in the book. I first review the success of the respective arguments for nonconceptualism and defenses against conceptualist objections. Five of the six arguments presented in favor of nonconceptualism are successful, and three of them are strong enough to support the claim endorsed by Modest Nonconceptualism that every perceptual experience has at least some nonconceptual content. On the other hand, none of the conceptualist objections to nonconceptualism is fatal. So, nonconceptualism is victorious (...) against conceptualism. Finally, I provide a brief sketch of the Modest Nonconceptualist view that has emerged. (shrink)

The paper draws on a conceptual analysis of justice in discussing the power of rational choice justifications of conceptions of justice. It is argued that the concept of justice can be reduced to two independent moral dimensions. From this conceptual thesis a simple conceptional criterion is derived which any powerful theory of justice must satisfy. An attempt is made to use this fundamental criterion in evaluating a wide variety of rational choice theories of justice. Critics of John Rawls' conception of a reasonable pluralism have raised the question of whether it is justified to demand that religious individuals should 'bracket' their essential, identity-constituting convictions when they enter a political discourse. I will argue that the criterion for religious beliefs of being justified as grounds for political decisions should be their ability of being 'translatable' in secular reasons for the very same decisions. This translation would demand 'epistemic abstinence' from religious believers only on the basis of (...) a rigid distinction between the spheres of private opinions and public reasons. To give a more adequate account of the relation between religious beliefs and political reasons in a pluralistic society it seems to be helpful to make use of Niklas Luhmann's functionalistic theory of religion.
