This paper examines the ‘deep-end’ of the international justice process—the incarceration of persons convicted in specially constituted international criminal tribunals and courts for gross violations of human rights, genocide, crimes against humanity and war crimes with a focus on language rights of such prisoners who are commonly serving sentences in foreign prisons. The punishment phase of the international justice process and its effects are not easily quantifiable and have been largely hidden from view. Although international criminal law asserts that equal (...) treatment before the law requires that there be no significant disparity in punishment regimes from one sentence-enforcing country to another, comparative penology shows that there are considerable differences in the conditions of confinement and the nature of correctional services in the prison systems of different countries. This has a direct impact on post-sentence procedural and rehabilitation rights of which language rights from a key part. In this specific context, and drawing from existing literature, the paper therefore examines the extent to which enforcement practice conforms to the ideal of equal treatment espoused by the tribunals. In this paper certain parameters of ethical values and attitudes of students in economics from different countries are analysed (attitudes toward work and organisation; goals of work; readiness to work for common benefit, etc.). The basic question was whether, and to what extent, such attitudes differ in countries in transition (former communist countries of Central and Eastern Europe) compared with western countries with a developed market economy and Latin‐American countries. On the basis of empirical research we conclude that there are (...) significant differences, i.e., that students from countries in transition show more self‐oriented attitudes, less readiness to help others and tend to consider work in an organisation primarily as a means to achieve one's own goals (always compared with students from the other two groups of countries). The main explanation for this is found in the transition itself, i.e., conditions and processes in those countries in the 1990s, and less in the heritage of the previous (communist) system. This paper develops an argument against causal decision theory. I formulate a principle of preference, which I call the Guaranteed Principle. I argue that the preferences of rational agents satisfy the Guaranteed Principle, that the preferences of agents who embody causal decision theory do not, and hence that causal decision theory is false.

This paper concerns the ways in which one can/cannot combine extensive quantities. Given a particular theory of extensive measurement, there can be no alternative ways of combining extensive quantities, where 'alternative' means that one combining operation can be used instead of another causing only a change in the number assigned to the quantity. As a consequence, rectangular concatenation cannot be an alternative combining operation for length as was suggested by Ellis and agreed by Krantz, Luce, Suppes, and Tversky. This thesis concerns alternative concatenating operations in extensive measurements and the degree to which concatenating operations are matter of convention. My arguments are directed against Ellis' claim that what prevents us from choosing alternative ways of combining extensive quantities is only convenience and simplicity and that the choice is not based on empirical reasons. ;My first argument is that, given certain relational theories of measurement, there can be no more than one concatenating operation per quantity; because combining operations are the (...) only conclusive distinguishing characteristic among distinct extensive measurements and thus the only thing that can serve as an indicator for the identity of a quantity. Rectangular and collinear concatenation, for example, cannot both be used as a way of combining lengths. However, rectangular concatenation could be used to measure some other extensive quantity since it fulfills the necessary conditions for adequate numerical assignment. ;For those that adopt theories of measurement which can support the claim that dinches measure length, I demonstrate, in the second argument, that rectangular concatenation would be a bad alternative and thus no alternative at all. Implementation of rectangular concatenation requires a new science; a science compatible with dinches violates present invariance principles and a new set must be provided, if possible. It is not clear that there is a set of invariance principles compatible with dinches which also gives basis for a science that explains the phenomena as well as the old one. Moreover, new invariance principles would be unintuitive and would require that certain fundamental concepts change their meaning. For these reasons the choice between them is guided by a number of empirical reasons and is not only a matter of convention. (shrink)

The prevalence of dementia is increasing worldwide but there is still no hope of a cure. Huge resources go into biomedical research, whose reductive ‘enactment’ has severe consequences for women, who are predominantly affected by dementia. To challenge such tragic enactment, this article considers ‘multiple ontologies’ of the most common type of dementia – Alzheimer’s disease – in the popular fictional film adaptations Still Alice and A Song for Martin. Using a post-humanist account of feminist visual studies of technoscience, this (...) comparative film analysis reveals how gender supersedes AD oversteering the hierarchical dualisms between health and pathology, human and nonhuman, and biomedical and artistic modes of knowing about Alzheimer’s. The author argues that these films stress the potential of the arts, as a multisensorial post-humanist embodied state of becoming with AD, to challenge hierarchical dualisms and innovatively contribute to dementia care. Hume's Reception in Early America: Expanded Edition brings together the original American responses to one of Britain's greatest men of letters, David Hume. Now available as a single volume paperback, this new edition includes updated further readings suggestions and dozens of additional primary sources gathered together in a completely new concluding section. The aim of this paper is to give an account of what it is to internalize a rule. I claim that internalization is the process of redistributing the burden of instruction from the teacher to the student. The process is complete when instruction is no longer needed, and the rule has reshaped perceptual classification of the circumstances in which it applies. Teaching a rule is the initiation of this process. We internalize rules by simulating instruction coming from someone else. Running (...) these simulations enables us to toggle between the perspective of the instructor and our own perspective. By doing this we coordinate our perspectives with that of the teacher. The account given here provides a deeper explanation of why internalizing a rule involves the dispositions and reactive attitudes proponents of Rule Consequentialism often say it does, why moral reflection is variably demanding, how intergenerational moral progress is made possible by our cognitive architectures, and why the adoption of a rule should be understood in terms of teaching that rule. The Special Composition Question may be formulated as follows: for any xs whatsoever, what are the metaphysically necessary and jointly sufficient conditions in virtue of which there is a y such that those xs compose y? But what is the scope of the sought after explanation? Should an answer merely explain compositional facts, or should it explain certain ontological facts as well? On one natural reading, the question seeks an explanation of both the compositional facts and the ontological; the question (...) seeks to explain how composite objects exist; how there is a y such that the xs compose y. But it turns out that some answers to the Special Composition Question presuppose those ontological facts rather than explain those ontological facts. In this paper, I will indicate what I take to be the different explanatory demands met by the representative answers. I will argue that the wide scope explanatory demands can’t be satisfied. I will also show that this result has bearing on the current debate about composition. (shrink)

Along the way, it defends and explains the attractive asymmetry: the claim that although an impermissible option can be self-conditionally permissible, a permissible option cannot be self-conditionally impermissible.

Consequentialists often assume rational monism: the thesis that options are always made rationally permissible by the maximization of the selfsame quantity. This essay argues that consequentialists should reject rational monism and instead accept rational pluralism: the thesis that, on different occasions, options are made rationally permissible by the maximization of different quantities. The essay then develops a systematic form of rational pluralism which, unlike its rivals, is capable of handling both the Newcomb problems that challenge evidential decision theory and the (...) unstable problems that challenge causal decision theory. Herbert Spencer (1820–1903), Victorian philosopher, biologist, sociologist and political theorist, one of the founders of Social Darwinism and author of the phrase 'survival of the fittest', was nominated for the Nobel Prize for Literature in 1902, losing out to Theodor Mommsen. Spencer left his post at The Economist in 1857 to focus on writing his ten-volume System of Synthetic Philosophy, a work that offers an ethics-based guide to human conduct to replace that provided by conventional religious belief. Published (...) in 1879, this volume seeks to demonstrate that social evolution tends towards greater individualism, altruism and co-operation. Spencer argues that it is possible to establish rules of right conduct on a scientific basis, and declares that this work is the culmination of his life's study. He was anxious to publish it outside the planned order of the System, because he feared (wrongly) that his death would prevent its completion. (shrink)

Neo‐Aristotelian Plenitude is the thesis that, necessarily, any property that could be had essentially by something or other is had essentially by something or other if and only if and because it is instantiated; any essentializable property is essentialized iff and because it is instantiated. In this paper, I develop a partial nonmodal characterization of ‘essentializable' and show it cannot be transformed into a full characterization. There are several seemingly insurmountable obstacles that any full characterization of essentializability must overcome. “It's almost like putting salt in a wound, for this person who's already made a very difficult decision,” suggested Meghan Patterson, a licensed obstetrician-gynecologist whom we interviewed in our qualitative study of the experiences of North Carolina abortion providers practicing under the state's Woman's Right to Know Act. The act requires that women receive counseling with state-mandated information at least twenty-four hours prior to obtaining an abortion. After the law was passed, Patterson worked with clinic administrators, in consultation with a (...) lawyer, to write a script to be used in the state-mandated counseling procedure. She and her colleagues took particular steps to mitigate the effects of what she described as HB 854's “forced language”—such as referring to the “father of the child.” While HB 854 stipulated that patients must be informed of the medical risks associated with the particular abortion procedure as well as those of carrying the child to term, Patterson's script made explicit the magnitude of comparative risks, emphasizing that the risks of carrying a pregnancy to term are substantially greater than the risks of an early-term abortion. She felt that these contextualization strategies helped to facilitate trust and rapport in a clinical care situation that proved relationally and morally challenging. In this article, we take up and expand on this point by elucidating an empirically grounded approach to ethically justified care when health care providers face legal or institutional policy mandates that raise possible moral conflicts. Our approach builds on recent bioethics discourse addressing conscience in the practice of medicine. While the concept of conscience has broad philosophical underpinnings relating to moral judgment, agency, and discernments of right and wrong, debates in bioethics have tended to engage the concept primarily vis-à-vis rights of conscientious objection or refusal. Here, we suggest a broader frame for thinking about claims of conscience in health care. Our approach draws on the feminist bioethics and the ethics of care literatures to highlight how providers may be motivated by matters of conscience, including relational concerns, in the active provision of certain forms of care. What emerges are two possibilities: not only conscientious refusal to comply with a policy mandate but also conscientious compliance—working conscientiously within a mandate's confines. (shrink)

Many philosophers have thought that aggregates of small, broadly dispersed evils don’t pose the same sort of challenge to theism that horrendous evils like the Nazi Holocaust do. But there are interesting arguments that purport to show that large enough aggregates of small evils are morally and axiologically equivalent to horrendous evils. Herein lies an intriguing and overlooked strategy for defending theism. In short: small evils, or aggregates of such evils, don’t provide decisive evidence against theism; there’s no relevant difference (...) between horrendous evils and aggregates of small evils; hence horrendous evils must not provide decisive evidence against theism, either. The issue of Holocaust tourism might be a quite sensitive, but nevertheless very important topic in the domain of the Holocaust remembrance. As tourism is often associated with leisure activities, it is quite challenging to put tourism into darker contexts of history and death. Also, different people coming to the Holocaust-related places with different motives make the issue of designing educational tours even more complex. This paper will try to expose questions related to dark tourism, Holocaust tourism, auratic memorial places, (...) and to discuss ethical approaches to the Holocaust memory in the beginning of the 21st century. The text argues for the tourist experience as a memorable and educational tool with an active transformational potential, which will turn the visitor into a witness who further contributes to survival of the legacy of the Holocaust in the future. What occurs in the mind of an expert who is performing at their very best? In this paper, I survey the history of debate concerning this question. I suggest that expertise is neither solely a mastery of the automatic nor solely a mastery of intelligence in skilled action control. Experts are also capable of performing automatic actions intelligently. Following this, I argue that unconscious-thought theory (UTT) is a powerful tool in coming to understand the role of executive, intelligent action control (...) in the fluidly automatic performance of expertise. Relying on a body of empirical evidence concerning the cognitive structures and perceptual strategies employed by experts, I show that the realm of skilled action is an ideal environment within which the powers of unconscious cognitive processing can have positive effects on action. I conclude that experts rely upon unconscious thinking in the production of intelligently automatic skilled actions. (shrink)

The word ‘extremist’ is often used pejoratively, but it’s not clear what, if anything, is wrong with extremism. My project is to give an account of moral extremism as a vice. It consists roughly in having moral convictions so intense that they cause a sort of moral tunnel vision, pushing salient competing considerations out of mind. We should be interested in moral extremism for several reasons: it’s consequential, it’s insidious – we don’t expect immorality to arise from excessive devotion to (...) morality – and it’s yet to attract much philosophical attention. I give several examples of moral extremism from history and explore their social-political implications. I also consider how we should evaluate people who miss the mark, being either too extreme in the service of a good cause or inconsistent with their righteous convictions. I compare John Brown and John Quincy Adams, who fell on either side of this spectrum, as examples. (shrink)

Normative pluralism is the view that practical reason consists in an irreducible plurality of normative domains, that these domains sometimes issue conflicting recommendations and that, when this happens, there is never any one thing that one ought simpliciter to do. Here I argue against this view, noting that normative pluralism must be either unrestricted or restricted. Unrestricted pluralism maintains that all coherent standards are reason-generating normative domains, whereas restricted pluralism maintains that only some are. Unrestricted pluralism, depending on how it (...) is cashed out, is either nihilism about practical reason or else it is subjectivism. Neither view is consistent with normative pluralism; hence, pluralism must be restricted. Restricted pluralism, however, faces two problems. The first stems from the question: “Why is it that some standards are normative domains while others are not?” The question seems to demand an answer, but it is hard to give any answer without appealing to considerations that imply facts about what we ought simpliciter to do. Second, restricted pluralism has difficulty accounting for our intuitions about cases in which one option is optimal in all domains, but not better than each alternative in any one domain. The unique option that is optimal in every domain seems better than its competitors, though it isn’t better within any domain. This is different than the widely discussed argument from notable-nominal comparisons. So I conclude that we have good reason to reject restricted pluralism, the only form of normative pluralism really worthy of that name. (shrink)

The long history of research and debate surrounding expertise has emphasized the importance of both automaticity and intelligent deliberation in the control of skilled, expert action – and often, their mutual exclusion of one another. To the contrary, recent developments in the cognitive science of skill implicate the likelihood of a third, hybrid line of interpretation and a new path forward. This paper surveys these recent developments, arguing that hybrid models of expertise and skill are the most fruitful way forward (...) in interpreting and conducting research on experts. I categorize a new set of interpretations of skill as ‘sophisticated hybrid models’ owing to the fact that they deny the mutual exclusion of automaticity from intelligent action control. I then argue that this interpretive strategy is the most fruitful way forward to making clear much of the complexity of skilled action and expertise. (shrink)

I will discuss a variety of cases such that the subject's believing truly is somewhat of an accident, but less so than in a Gettier case. In each case, this is because her reasons are not ultimately undefeated full stop, but they are ultimately undefeated with certain qualifications. For example, the subject's reasons might be ultimately defeated considered in themselves but ultimately undefeated considered as a proper part of an inference to the best explanation that is undefeated without qualification. In (...) each section of the paper, I consider different qualifications and show how in each case we get an epistemic standing I call “coach-class knowledge”. First-class knowledge requires justifying reasons that are undefeated without qualification. Coach-class knowledge only requires qualified lack of defeat. I will use this distinction to bring debates over knowledge from falsehood and fake barns to an ecumenical resolution. In both cases, the subject enjoys coach-class rather than first-class knowledge. I will also show that the defeasible reasoning tradition can better account for graded accidental truth than safety theories. (shrink)

Perhaps a part of what makes expertise so inspiring to the curious researcher is the possibility of appropriating the structural components of skilled action to draw a roadmap towards their achievement that anyone might be able to follow. Accordingly, the purpose of this essay is to shed light upon the role that creativity plays in the production and environment of skilled action to that foregoing end. In doing so, I suggest that the lessons to be learned from recent empirical research (...) on creativity has much to offer to the cognitive science of skill and expertise. Experts are able to bring their intelligence to bear in controlling fast and seemingly automatic actions by utilizing a form of control often called ‘intelligent automaticity.’ In this spirit, I argue that the environment of intelligently automatic action control curates a similarly ideal environment for the processes of creativity. Moreover, insofar as creativity is ideally operative within the environment of expert action control, I argue further that creativity functions as one representative form of ‘intelligence’ embedded within otherwise fluid, and automatic expert actions. Creativity is able to do so even without conscious representation through the powers of incubated cognition. (shrink)

Reasons rationalize beliefs. Reasons, when all goes well, turn true beliefs into knowledge. I am interested in the relationship between these aspects of reasons. Without a proper understanding of their relationship, the theory of knowledge will be less illuminating than it ought to be. I hope to show that previous accounts have failed to account for this relationship. This has resulted in a tendency to focus on justification rather than knowledge. It has also resulted in many becoming skeptical about the (...) prospects for an analysis of knowledge. The skepticism is misplaced and the tendency can be fixed without sacrificing any insights. The solution is to see how good reasons (in a sense to be articulated) are apparent (in a sense to be articulated) to the knowing subject. Once this claim is unpacked, we see that it is an illuminating analysis of knowledge in terms of distinct but intimately related aspects of epistemic assessment. It helps us see the value of knowledge (over and above true belief) and it affords us a unified, “reasons-first” metaepistemology. The resulting picture is neither a familiar kind of internalism or externalism. (shrink)

This paper is an effort toward conceptual transparency around toxic inclusivity in academic feminism and the kinds of care it lacks toward, what amounts to, bad knowledge production practices. In this paper, we claim that some of the forms of reductive inclusion that ought to be avoided are epistemologically unsound practices that propagate disempowering, false, and/or distortive messages about targets of inclusion. We take reductive inclusion to be inclusion that treats the targets of inclusion as plot devices and/or as means (...) to a narrative end. These practices should be avoided in order to work toward a range of coalitional possibilities between differently situated populations with social justice aims. Moreover, we are concerned with making clear that toxic inclusion is a type of bad scholarship. The reductive inclusions to avoid articulated in this paper are interpolation and ossification. Interpolation involves executing “inclusion” with formal, instead of substantive, overtures. Ossification, however, establishes parasitic relations of inclusion that present a skeleton of one’s targets for inclusion that reduces whole groups to serve the purpose of the narrator. Through a discussion of Audre Lorde’s “An Open Letter to Mary Daly”, we explain Lorde’s brilliant and succinct critique of Daly as exemplifying interpolation and ossification. Ultimately, this paper adds to diverse Black feminist literatures on effective coalitions and gestures toward potential rules for engagement across difference in our story telling. (shrink)

Though almost forgotten today, Herbert Spencer ranks as one of the foremost individualist philosophers. His influence in the latter half of the nineteenth century was immense. Spencer's name is usually linked with Darwin's, for it was he who penned the phrase: survival of the fittest. Today in America he is most often admired for his trenchant essays in 'The Man Versus the State'. But Spencer himself considered THE PRINCIPLES OF ETHICS to be his finest work. In the (...) second volume, under 'Justice', is his final statement on the role of the state. His formula for justice is summed up in these words: "Every man is free to do that which he wills, provided he infringes not the equal freedom of any other man.". (shrink)
