ABSTRACT:In a series of reports the United Nations Special Representative on the issue of Human Rights and Transnational Corporations has emphasized a tripartite framework regarding business and human rights that includes the state “duty to protect,” the TNC “responsibility to respect,” and “appropriate remedies” for human rights violations. This article examines the recent history of UN initiatives regarding business and human rights and places the tripartite framework in historical context. Three approaches to human rights are distinguished: moral, political, and legal. (...) It is argued that the tripartite framework’s grounding of the responsibility of TNCs to respect human rights is properly understood as moral and not merely as a political or legal duty. A moral account of the duty of TNCs to respect basic human rights is defended and contrasted with a merely strategic approach. The main conclusion of the article is that only a moral account of the basic human rights duties of TNCs provides a sufficiently deep justification of “the corporate responsibility to respect human rights” feature of the tripartite framework. We review recent developments in ethical pluralism, ethical particularism, Kantian intuitionism, rights theory, and climate change ethics, and show the relevance of these developments in ethical theory to contemporary business ethics. This paper explains why pluralists think that ethical decisions should be guided by multiple standards and why particularists emphasize the crucial role of context in determining sound moral judgments. We explain why Kantian intuitionism emphasizes the discerning power of intuitive reason and seek to integrate that with the comprehensiveness of (...) Kant’s moral framework. And we show how human rights can be grounded in human agency, and explain the connections between human rights and climate change. (shrink)

In paradigm exercises of agency, individuals guide their activities toward some goal. A central challenge for action theory is to explain how individuals guide. This challenge is an instance of the more general problem of how to accommodate individuals and their actions in the natural world, as explained by natural science. Two dominant traditions–primitivism and the causal theory–fail to address the challenge in a satisfying way. Causal theorists appeal to causation by an intention, through a feedback mechanism, in explaining guidance. (...) Primitivists postulate primitive agential capacities in their explanations. The latter neglect to explain how primitive capacities integrate with findings from natural science. The former do not explain why some feedback mechanism’s activity amounts to the agent’s guidance. In this paper I argue that both traditions should acknowledge a capacity to guide, as actually constituted by the executive system. I argue that appeals to this empirically discovered psychological system explain how individuals guide in a way that integrates with explanations from cognitive science. Individuals’ capacity to guide is embedded in the natural world through the activity of its constituent (mechanistic) components. (shrink)

In their commentary on our paper Sollars and Englander challenge some of our conclusions. We argue here that several of their criticisms are based on an inaccurate reading of our paper, and that none of the (...) remaining criticisms successfully challenge our main arguments. By highlighting the shortcomings of their arguments we hope to advance discussion of the ethical treatment of workers in global supply chains. (shrink)

ABSTRACT:Little theoretical attention has been paid to the question of what obligations corporations and other business enterprises have to the four billion people living at the base of the global economic pyramid. This article makes several theoretical contributions to this topic. First, it is argued that corporations are properly understood as agents of global justice. Second, the legitimacy of global governance institutions and the legitimacy of corporations and other business enterprises are distinguished. Third, it is argued that a deliberative democracy (...) model of corporate legitimacy defended by theorists of political CSR is unsatisfactory. Fourth, it is argued that a Rawlsian theoretical framework fails to provide a satisfactory account of the obligations of corporations regarding global justice. Finally, an ethical conception of CSR grounded in an appropriately modest set of duties tied to corporate relationships is then defended. This position is cosmopolitan in scope and grounded in overlapping arguments for human rights. (shrink)

In this dissertation I develop a general theory of coercion that allows one to distinguish cases of interpersonal coercion from cases of persuasion or manipulation, and cases of institutional coercion from cases of oppression. The general theory of coercion that I develop includes as one component a theory of second-order coercion. Second-order coercion takes place whenever one person intentionally impairs the formation of the second-order desires of another person, or constrains them after their formation, in a way that frustrates or (...) eliminates the possibility of the victim fulfilling certain of his or her first-order desires. The concept of second-order coercion is important because it suggests that a person's autonomy may be violated in ways that have not been previously recognized. In this dissertation I argue that the unique feature of all cases of coercion is that the alternatives available to the victim, with regard to the formation of his or her will, are intentionally constrained by another person in a way that violates the victim's autonomy. A general theory of coercion should be able to explain how institutions may be understood as coercive. I argue that if institutions are understood as social practices maintained for the purpose of achieving some end, then they may be properly understood as capable of coercion. ;This theory of coercion allows me to make two arguments concerning moral responsibility. First, I argue that current discussions of moral responsibility are inadequate because they fail to take seriously the claim that a person may be responsible, at least in part, for having the beliefs and desires that make a particular action a case of coercion. Second, I argue that discussions of moral responsibility are inadequate because they fail to recognize that an agent may not be responsible for the state of his or her will because he or she may have been coerced in a way that has not been previously recognized. Over the course of human history, the sciences, and biology in particular, have often been manipulated to cause immense human suffering. For example, biology has been used to justify eugenic programs, forced sterilization, human experimentation, and death camps—all in an attempt to support notions of racial superiority. Numbers bring together fourteen experts to examine the varied ways science has been used and abused for nonscientific purposes from the fifteenth century to the present day. Featuring an essay on eugenics from Edward J. Larson and an examination of the progress of evolution by Michael J. Ruse, _Biology and Ideology_ examines uses both benign and sinister, ultimately reminding us that ideological extrapolation continues today. An accessible survey, this collection will enlighten historians of science, their students, practicing scientists, and anyone interested in the relationship between science and culture. (shrink)

Most shoppers like bargains. Do bargains come at the expense of workers in sweatshops around the world? The authors argue that many large multinational corporations are running the moral equivalents of sweatshops and are not properly respecting the rights of persons. They list a set of minimum standards of safety and decency that they claim all corporations should meet (and that many are not). Finally, they defend their call for improved working conditions by replying to objections that meeting improved conditions (...) will cause greater harm than good, even to the workers themselves. They consider many specifi c corporations and name names and point the finger at various forms of disrespect for persons, along the way. (shrink)

Human suicide presents a fundamental problem for the scientific analysis of behavior. This problem has been neither appreciated nor confronted by research and theory. Almost all other behavior exhibited by humans and nonhumans can be viewed as supporting the behaving organism's biological fitness and advancing the welfare of its genes. Yet suicide acts against these ends, and does so more directly and unequivocally than any other form of maladaptive behavior. Four heuristic models are presented here to account for suicide in (...) an evolutionary and sociobiological framework. The first model attributes suicide to the extraordinary development of learning and cultural evolution in the human species. Learning may make human behavior so independent of biological constraints that it can occasionally assume a form entirely contrary to the principles of biological evolution. The second model attributes suicide to a breakdown of adaptive mechanisms in extremely stressful novel environments. The third model involves kin and group selection, arguing that in limited circumstances suicide may occur because of beneficial effects it has on other, surviving individuals who share the suicidal individual's genes. The last model suggests that suicide should be tolerated by evolution when it has no effect on the gene pool. This model holds particular promise in accounting for aspects of suicide not attributable to culture. The evidence indicates that suicide is most common in individuals who are unlikely to reproduce and unable to engage in productive activity; such individuals are least capable of promoting their genes. A complete explanation of suicide may derive only from an analysis of its biological significance. (shrink)

One of the most influential recent accounts of attention is Wayne Wu’s. According to Wu, attention is selection-for-action. I argue that this proposal faces a dilemma: either it denies clear cases of attention capture, or it acknowledges these cases but classifies many inattentive episodes as attentive.

Libertarian theories of the normative core of the corporation hold in common the view that is the responsibility of publicity held corporations to return profits to shareholders within the bounds of certain moral side-constraints. Side-constraints may be either weak (grounded in the rules of the game) or strong (grounded in rights). This essay considers libertarian arguments regarding the normative core of the corporation in the context of global capitalism and in the light of actual corporate behavior. First, it is argued (...) the weak side-constraints view is conceptually incoherent when applied in a global context. Second, it is argued that proponents of the libertarian strong side-constraints view lack an adequate theory of rights. Third, both the weak side-constraints view and the strong side-constraints view are shown to be unsatisfactory insofar as they fail to adequately address the coercive power of corporations. The main conclusion of this essay is that a viable libertarian theory of the corporation has yet to be articulated. (shrink)

The definition of token semantics, in particular, has been modified, both for the single- and the multi-agent case.

Executive functioning has been said to bear on a range of traditional philosophical topics, such as consciousness, thought, and action. Surprisingly, philosophers have not much engaged with the scientific literature on executive functioning. This lack of engagement may be due to several influential criticisms of that literature by Daniel Dennett, Alan Allport, and others. In this paper I argue that more recent research on executive functioning shows that these criticisms are no longer valid. The paper clears the way to a (...) more fruitful philosophical engagement with findings on the central executive system. (shrink)

We distinguish dynamical and statistical interpretations of evolutionary theory. We argue that only the statistical interpretation preserves the presumed relation between natural selection and drift. On these grounds we claim that the dynamical conception of evolutionary theory as a theory of forces is mistaken. Selection and drift are not forces. Nor do selection and drift explanations appeal to the (sub-population-level) causes of population level change. Instead they explain by appeal to the statistical structure of populations. We briefly discuss the implications (...) of the statistical interpretation of selection for various debates within the philosophy of biologythe `explananda of selection' debate and the `units of selection' debate. What is a logical constant? The question is addressed in the tradition of Tarski's definition of logical operations as operations which are invariant under permutation. The paper introduces a general setting in which invariance criteria for logical operations can be compared and argues for invariance under potential isomorphism as the most natural characterization of logical operations.

The standard semantic definition of consequence with respect to a selected set X of symbols, in terms of truth preservation under replacement (Bolzano) or reinterpretation (Tarski) of symbols outside X, yields a function mapping X to a consequence relation ⇒x. We investigate a function going in the other direction, thus extracting the constants of a given consequence relation, and we show that this function (a) retrieves the usual logical constants from the usual logical consequence relations, and (b) is an inverse (...) to—more precisely, forms a Galois connection with—the Bolzano-Tarski function. Most biographical and historical works agree on a common scheme and a few 'founding papers' for the 'discovery' of mRNA. However, a closer scrutiny of these 'founding papers' leads to several unresolved questions with respect to the origin of the notion of mRNA. This paper focuses on the analysis of a set of contributions made by the group of the Rouge-Cloître in order to fill in some of the remaining gaps in the 'standard history'.

Providing a principled characterization of the distinction between logical and non-logical expressions is a longstanding issue in the philosophy of logic. In the Logical Syntax of Language, Carnap proposes a syntactic solution to this problem, which aims at grounding the claim that logic and mathematics are analytic. Roughly speaking, his idea is that logic and mathematics correspond to the largest part of science for which it is possible to completely specify by "syntactic" means which sentences are valid and which are (...) not. Despite a renewed interest in the philosophical benefits of analyticity, both inside and outside of Carnap scholarship, Carnap's definition of logical expressions seems to have drawn too little attention. I shall argue that it is worth a second look. More precisely, my aim will be to defend this idea against some technical problems faced by Carnap's way of implementing it and against Quinean attacks on syntax-based conventionalism. Section 1 presents Carnap's definition in the context of Logical Syntax of Language, that is, how exactly the definition works, and why Carnap needs it. In section 2, I review three challenges that have been raised in the literature, and I propose to revise the definition accordingly. I argue that its modified version is immune to the previous challenges, and, to some extent, immune to new challenges as well. In the last section, I suggest that the definition has a philosophical interest of its own, because standard Quinean objections are not as conclusive as one might think when attention is paid to the fact that Carnap requires complete syntactic specification of validities. The Enchantment of Words is a study of Wittgenstein's early masterpiece, the Tractatus Logico-Philosophicus. Recent years have seen a great revival of interest in the Tractatus. McManus's study of the work offers novel readings of all its major themes and sheds light on issues in metaphysics, ethics and the philosophies of mind, language, and logic.

The primary concern of this paper is Hume's account of the moral difference between humans and other animals. In order to clarify this difference Hume's views regarding reason, sympathy, and human sentiment are examined. The purpose of this investigation is threefold. First, Hume's position on the moral difference between humans and other animals is clarified. It is argued that this difference is properly traced to Hume's account of the sentiment of humanity. Second, Hume is defended against the claim that his (...) position on this matter is inconsistent. Third, it is argued that Hume's theory of morality leaves open the possibility that some earthly species other than our own may be properly understood as moral. (shrink)

After providing a brief history of global climate change, we consider and reject the influential position that free markets and responsive democracies relieve corporations of obligations to protect the environment. Five main objections to the free market view are presented, focusing in particular on the roles of business organizations in the transportation and electricity generation sectors. Ethically grounded management and public policy recommendations are offered.

Over the past fifteen years there has been a considerable amount of debate concerning what theoretical population dynamic models tell us about the nature of natural selection and drift. On the causal interpretation, these models describe the causes of population change. On the statistical interpretation, the models of population dynamics models specify statistical parameters that explain, predict, and quantify changes in population structure, without identifying the causes of those changes. Selection and drift are part of a statistical description of population (...) change; they are not discrete, apportionable causes. Our objective here is to provide a definitive statement of the statistical position, so as to allay some confusions in the current literature. We outline four commitments that are central to statisticalism. They are: 1. Natural Selection is a higher order effect; 2. Trait fitness is primitive; 3. Modern Synthesis (MS)-models are substrate neutral; 4. MS-selection and drift are model-relative. (shrink)

Global climate change is one of the most daunting ethical and political challenges confronting humanity in the twenty-first century. The intergenerational and transnational ethical issues raised by climate change have been the focus of a significant body of scholarship. In this new collection of essays, leading scholars engage and respond to first-generation scholarship and argue for new ways of thinking about our ethical obligations to present and future generations. Topics addressed in these essays include moral accountability for energy consumption and (...) emissions, egalitarian and libertarian perspectives on mitigation, justice in relation to cap and trade schemes, the ethics of adaptation and the ethical dimensions of the impact of climate change on nature. It is commonly thought that evolution is a chance process, an idea found in popular writings on evolution, but also in academic writing in a broad range of scientific disciplines: scientific, philosophical and theological. One problem is that words such as ‘chance’ and ‘random’ are used with a range of different meanings according to context, and in evolutionary biology the word ‘chance’ is sometimes used in a way that is different from its use in mathematics and philosophy. The present article (...) aims to clarify the range of meanings and to argue the case that the evolutionary process is far from being a ‘theory of chance’ from biological, mathematical, or indeed philosophical and theological perspectives. Celle-ci ne devrait pas sa survie à la recherche d'unité bien-gérée, mais aux " trous " dans le collectif ; (...) à la résistance des corps vivants, et non à l'Esprit qui tente de les fondre en une mortelle idéalité commune. La théorie freudienne du " lien de masse " rend compte de cette dérive fatale des collectifs idéalisés. Sous- estimée par les sciences sociales, elle permet de lire ce qu'il advient aujourd'hui de nos sociétés saisies dans l'imago d'une " secte-monde ", et du péril majeur qui les y guette. Elle permet aussi, rétroactivement, d'analyser l'histoire occidentale comme une suite d'oscillations entre la capture fatale par l'Idéal et le retour à la pluralité vivante des Corps. There are two competing interpretations of the modern synthesis theory of evolution: the dynamical (also know as ‘traditional’) and the statistical. The dynamical interpretation maintains that explanations offered under the auspices of the modern synthesis theory articulate the causes of evolution. It interprets selection and drift as causes of population change. The statistical interpretation holds that modern synthesis explanations merely cite the statistical structure of populations. This paper offers a defense of statisticalism. It argues that a change in trait frequencies (...) in a population can be attributed only to selection or drift against the background of a particular statistical description of the population. The traditionalist supposition that selection and drift are description‐independent causes of population change leads the dynamical interpretation into a dilemma: it must face a contradiction or accept the loss of explanatory power. There has recently been much interest in the role of attention in controlling action. The role has been mischaracterized as an element in necessary and sufficient conditions on agential control. In this paper I attempt a new characterization of the role. I argue that we need to understand attentional control in order to fully understand agential control. To fully understand agential control we must understand paradigm exercises of agential control. Three important accounts of agential control—intentional, reflective, and goal-represented control—do not (...) fully explain such exercises. I argue that understanding them requires understanding how deployments of visual attention implement flexible occurrent control, or a capacity to flexibly adjust the degree of control that individuals exercise over their actions. While such deployments of attention are neither necessary nor sufficient for exercising agential control, they constitute an attentional skill for controlling action, understanding which is central to fully understanding agential control. We can appreciate its centrality if we appreciate that this attentional skill for controlling action is plausibly crucial to acting non-negligently. (shrink)
