Both context relativists and circumstance-of-evaluation relativists agree that the traditional semantic interpretation of some sentence-types fails to deliver the adequate truth-conditions for the corresponding tokens. But while the context relativists argue that the truth-conditions of each token depend on its context of utterance—each token being thus associated with a distinct intension—circumstance-of-evaluation relativists preserve a unique intension for all the tokens by placing circumstances of evaluations under the influence of a certain ‘point of view’. The main difference (...) between the two approaches is that only the former can operate locally. The social sciences playa variety of multifaceted roles in the policymaking process. So varied are these roles, indeed, that it is futile to talk in the singular about the use of social science in policymaking, as if there were one constant relationship between two fixed and stable entities. Instead, to address this issue sensibly one must talk in the plural about uses of dif ferent modes of social scientific inquiry for different kinds of policies under various circumstances. In some cases, (...) the influence of social scientific research is direct and tangible, and the connection between the find ings and the policy is easy to see. In other cases, perhaps most, its influence is indirect-one small piece in a larger mosaic of politics, bargaining, and compromise. Occasionally the findings of social scientific studies are explicitly drawn upon by policymakers in the formation, implementation, or evaluation of particular policies. More often, the categories and theoretical models of social science provide a general background orientation within which policymakers concep tualize problems and frame policy options. At times, the in fluence of social scientific work is cognitive and informational in nature; in other instances, policymakers use social science primarily for symbolic and political purposes in order to le gitimate preestablished goals and strategies. Nonetheless, amid this diversity and variety, troubling general questions persistently arise. (shrink)

There have been debates across the globe for a social and culturally sensitive ethics to meditate a catalyst of template for informed consent (IC) in the conduct of social researches and clinical trial. The study adopted ethical relativism theory to explore social and cultural contingencies on IC with descriptive research design and snowball sampling techniques with a pool of 23 participants randomly and purposively selected amongst the stakeholders including researchers. Seven lecturers and 5 medical practitioners from selected universities, 5 clergy (...) members of different genders and denominations with 2 Imams, 1 chief and 2 traditional health practitioners completing the pool. The data were compiled separately with pseudonym to maintain the anonymity of the participants and content analysed thematically to probe awareness, understanding, patriarchy and religious dimensions on IC. The paper argued that ethics and law regulations must be strengthened to leverage on different individual values, norms and social indices. The paper concluded and suggested that researchers can avoid and resolve ethical dilemmas and maintain research regularity when ethical obligations are well understood and strictly adhered to, and to develop the Informed Consent Evaluation Feedback Tool (ICEFbT) with oversight function from Institution Review Board (IRB) in the universities and research institutes before the commencement of research and/or medical procedures. The general mitigating and aggravating circumstances of criminal liability are elements attached to the crime that, when they occur, affect the punishment quantum. Cuban criminal legislation provides a catalog of such circumstances and some general conditions for their application. Such norms give judges broad discretion in assessing circumstances and adjusting punishment based on the intensity of those circumstances. In the interest of broad judicial discretion, the law does not establish specific ways for measuring circumstances’ intensity. This gives judges more freedom (...) and autonomy, but it also imposes on them more social responsibility and challenges them to manage the uncertainty and subjectivity inherent in this complex activity. This paper proposes a model to aid the linguistic assessment of circumstances’ intensity and to provide linguistic and numerical recommendations to determine an appropriate punishment interval. M-LAMAC determines the collective evaluation of circumstances of the same type, determines the prevalence of a type of circumstance by means of a compensation function, recommends the required modification in the input interval, and finally recommends a numerical interval adjusted to the judges’ initially expressed preferences. The model’s applicability is demonstrated by means of several experiments on a fictitious case of bank document forgery. (shrink)

The authors of this article use systemic, comparative and historical methods to review the most representative legal systems – rench, English and German – and analyse how these legal systems deal with the effects of change in circumstances on the performance of a contract. The authors also discuss solutions adopted by scholar groups working on supranational contract law (soft law) instruments, namely, UNIDROIT Principles of International Commercial Contracts and Principles of European Contract Law, stressing that these sets of principles have (...) significantly affected Lithuanian contract law provisions on changed circumstances. The authors concisely evaluate the case law of the Supreme Court of Lithuania on the application of the provisions on change in circumstances and their effect on the performance of a contract. BackgroundEvaluation of decision-making capacity to consent to medical treatment has proved to be difficult in patients with dementia. Studies showed that physicians are often insufficiently trained in the evaluation of decision-making capacity. In this study, we present findings from a secondary analysis of a qualitative interviews with physicians. These interviews were initially used to assess usability of an instrument for the evaluation of decision-making capacity. By looking at difficult cases of decision-making capacity evaluation in patients with dementia, (...) we provide recommendations for such evaluations in clinical practice.MethodsWe used thematic coding to analyse physicians’ narratives of problematic decision-making capacity evaluations in patients with dementia to uncover challenging issues of decision-making capacity evaluation.ResultsIn this study, decision-making capacity evaluations in patients with dementia were mainly perceived as challenging when they pertained to treatment refusals and treatment unrelated circumstances, such as psychiatric consultation, advance directives, and new living arrangements. Furthermore, the physicians reported training needs regarding situation-independent challenges with decision-making capacity evaluation.ConclusionsUpon further examining self-reported training needs and challenging cases, we have developed recommendations to improve decision-making capacity evaluations in clinical practice. In these recommendations, we argue that being able to evaluate decision-making capacity is an integral part of the informed consent process. (shrink)

Reports of children participating in hunger strikes while detained in offshore detention centres raise interrelated ethical issues and recognizable challenges for the medical decision-makers at these sites. A composite case study, informed by reports in the public domain, is employed to explore the unique challenges of consent and decision-making in these circumstances and the perennial issues inherent in adolescents’ developing capacity and autonomy. We present an amalgamated case of a fourteen-year-old adolescent who refused to consent to medical reversal of her (...) hunger strike protest. The medical team became the final arbiter when her parents, who were also in detention, could not agree with each other even after mediation. The case explores the complexity of evaluating the adolescent’s capacity to provide informed consent while influenced by the opinions of co-detainees in this extreme setting. We argue that the parents and the child had compromised decisional capacity due to the effects of detention. The challenges to the medical team are recognized and discussed. The team members faced a difficult dilemma and considered the competing values of the multiple cultural and ethical factors. Each team member integrated his or her own roles, duties, and discipline-specific professional guidelines with the primary goal of mitigating potential harms. (shrink)

Eyewitnesses are susceptible to recollecting that they experienced an event in a way that is consistent with false information provided to them after the event. The effect is commonly called the misinformation effect. Because jurors tend to find eyewitness testimony compelling and persuasive, it is argued that jurors are likely to give inappropriate credence to eyewitness testimony, judging it to be reliable when it is not. It is argued that jurors should be informed about psychological findings on the misinformation effect, (...) to ensure that they lower the credence that they give to eyewitness testimony to reflect the unreliability of human memory that is demonstrated by the effect. Here I present a new argument, the overcritical juror argument, to support the conclusion that eyewitnesses are likely to make inappropriate credence assignments to eyewitness testimony. Whereas previously authors have argued that jurors will tend to give too much credence to eyewitness testimony, I identify circumstances in which jurors will give too little credence to some pieces of testimony. In my view jurors should be informed by psychological findings relating to the misinformation effect to ensure that they do not lower the credence that they give to eyewitness testimony when they should not. In this study, we investigated the relationships between judgments of intentionality and moral evaluation in individuals with High Functioning Autism (HFA) or Asperger Syndrome (AS). HFA or AS are neurodevelopmental disorders characterised by severe deficits in communication and social functioning. Impairments in Theory of Mind (ToM), i.e., the ability to attribute mental states to oneself and to others, are thought to be the core features of autism. Of all mental states, the concept of ‘intentional action’ is particularly important. People (...) normally distinguish between actions that are performed intentionally and those that are performed unintentionally and this distinction plays a crucial role in social understanding and moral judgment. Recently, Knobe (Analysis 63: 190–193, 2003a ), (Philosophical Psychology 16: 309–324, 2003b ) showed that people’s moral evaluations might serve as input to the process by which people intuitively arrive at the intentionality judgments. Here, by using two pairs of vignettes, the Knobe’s Harm/Help cases and Murder/Bull’s-eye cases, we showed that, as already observed in typical population, in individuals with HFA/AS judgment of intentional action is informed by the moral appreciation of the action outcome. However, the two groups differed on praise judgments and moral justifications, suggesting that these processes were poorly influenced by the agent’s psychological states. We concluded that, although under certain circumstances, individuals with HFA/AS and people with typical development have similar intuitive judgments of intentionality, over-assignment of praise judgments and the reduced use of folk-psychological concepts in moral judgment likely reflect difficulties using intentionality information for moral reasoning. In this article I propose to reframe debates about ideals of emotion in medicine, abandoning the current binary setup of this debate as one between ‘clinical detachment’ and empathy. Inspired by observations from my own field work and drawing on Sky Gross’ anthropological work on rituals of practice as well as Henri Lefebvre’s notion of rhythm, I propose that the normative drive of clinical practice can be better understood through the notion of attunement. In this framework individual types of emotions (...) are not, as such, appropriate or inappropriate, but are evaluated depending on their synchronicity with the specific rhythms of the practice. To set up this proposal, I show how typical arguments about emotions in medicine—what I call emotion-entity focused frameworks—are insufficient. I then draw on ethnographic observations from two orthopaedic departments and interviews with medical practitioners to show (1) how clinical practice is driven by rhythmicity, shaped in the case of orthopaedic surgery by a clinical aim of efficient, controlled intervention, and (2) how clinicians continuously refer to this drive and the flow of rhythms when evaluating inappropriate or problematic emotion. I argue that the use of a rhythm framework rather than ideals of detachment or empathy allows for a sensitivity to the complexity and situation-dependent elements of emotional ideals in clinical practice; and I end by proposing the term ‘attuned concern’—which stresses the importance of regulation and adjustment to circumstances rather than of maintaining a constant distance/involvement—as a more fitting alternative to ‘clinical detachment’. Sometimes medical errors should not be disclosed. We report a case of semen samples exchange, during a homologous artificial insemination procedure, where a bioethics consultation was required. The bioethics consultation addressed ethical and legal elements in play, supporting non-disclosure to some of the subjects involved. Through a proper methodology, gathering factual and juridical elements, a consultant can show when a moral dilemma between values and rights—privacy versus fatherhood, in our case—is unsubstantial, in a given context, because of the groundlessness of (...) the value or the right itself. However, being the error elicited by organizational factors, a broader ethical pronouncement was needed. Under such circumstances, ethical evaluation should engage in a sort of ‘ethical-based root-cause analysis’, linking ethical principles to quality aims and showing the opportunity to integrate ethical methodology in healthcare management. From this perspective, errors may become an incentive to promote high-quality organizations, attending to the central value of person even through the organizational process. (shrink)

In the era Islam emerged, Arabs were calling Jews and Christians as Ahl al-Kitāb, respecting them and affected by them in many ways. When they failed in their debates against the Prophet, they were referring to the scholars of Ahl al-Kitāb and relying on the information they got from them, they were trying to force and beat the Prophet intellectually by their questions. In the Meccan period, no clashes had happened between the Muslims and Ahl al-Kitāb. Jewish scholars had been (...) admitting that they knew the similarity in the topics of Qurʾān and Tawrāt, the Qurʾān were telling the truth and the Prophet was conveying the message of the truth. In some of the verses, these right attitudes of the scholars of Ahl al-Kitāb are used as a reference against Mus̲h̲riks. In the verses said, those scholars are praised and indicated as a source of information for the Prophet as well. The verses related with the topic were understood in parallel with the context and direct meaning of the Nass by some scholars, yet, they were explained not taking the Nuzul environment and process into consideration by some other scholars. It is mentioned that ʿAbdallāh b. Salām and his friends who became Muslims in Medina period have been told in these verses. In this study, level of validity for these interpretations will be evaluated based on Qurʾān –relationship and the fact that some of the asbab al-nuzul (circumstances of revelation) are known to be jurisprudential; and it will be argued that the true meaning of the naṣṣ is overshadowed.Summary: Tafsir is an effort to understand the divine address, and also to understand the relationship between Muslim, polytheist, and People of the Book (Ahl al-kitāb) in the revelation and experience in this context. Since these issues are not explained in a wide and clear manner in the Qur’ān, the hadīths, prophetic biography, narratives of asbâb al-nuzul and the opinions of the companions and the views of the Companions and Tābi‘īn gain importance in understanding the verses. As the narrations of asbâb al-nuzul contain some problems, it is proposed to evaluate this information based on sigas and hadīth method in classical Qur'ānic sciences studies. Although this approach is effective in solving many problems, it does not solve all problems.The question of whether the narrators of asbâb al-nuzul is the real reason for the verse has been discussed from the very beginning. According to Ibn Taymiyya (d. 728/1328) al-Zarkashī (d. 794/1392) and al-Dihlawī (d. 1176/1762), the expression that “This verse has been revealed on this particular event” does not mean that the verse is revealed particularly and only for this event but rather that it is revealed for an event which is similar to that event, and that, subject verse also covers this provision. A. Nedim Serinsu and A. Rıza Gül also drew attention to this fact and the narratives were divided into two as the real cause of nuzul and virtual cause of nuzul. When this issue is not known, it may become inexorable to analyze and make observations, and there may be problems regarding the interlocutors, date of births, being Meccan or Medinan.Those who want to learn the first-hand meaning of the verses, their interlocutors and the environment of nuzul are facing difficulties to choose between the contradictory narrations especially in narrative-weighted commentaries. It is necessary to pay attention to some points to evaluate the narrations correctly and make the right choice. These points are prophetic biography, the stages of nuzul, information about being Meccan or Medinan, the stages of development of relations between polytheists and Muslims, and tafsīr explanations about nuzul. One of the issues with contradictory narratives and interpretations is ʿAbdallāh b. Salām. As one of the notables of the Medina Jews, he came to him when the Prophet arrived in Kuba, he asked some questions, and when he got the right answers, he became a Muslim saying that they could only be known by a prophet. It is claimed that he believed in the period of Mecca and the eighth year of the Hijr, but this information was not well accepted.Although it was not very intense in Mecca, there were certain relations between Jews and Christians and Muslims. Since there was no conflict between Muslims and the People of the Book, these verses are often praised by their scholars, and they were also cited as a reference for the Prophet and idolaters Some Meccan verses mention the following: Jews who are righteous; the fulfilment of the requirements of the book, and the prayers of the Muslims that will not be wasted; the fact that the scholars of the Israelites know the truths in the Qur'an should be a proof for the idolaters; The Ahl al-kitāb know that the Qur'ān is a divine book; if he has doubts about the verses revealed to the Prophet, he should ask the Jewish scholars; Jews witnessed and believed the truth of the prophethood of the Prophet; the fact that Ahl al-kitāb were delighted with the Qur'ān. In the exegesis of these verses, it has been commented that the interlocutors are ʿAbdallāh b. Salām and his friends, Prophet Muhammad's companions, Selman al-Fârisî, Ali and the kitāb who believed in the Prophet.Since the commentators did not consider the process experienced with the Ahl al-kitāb sufficiently, the verses that were written before becoming Muslim were associated with ʿAbdallāh b. Salām. However, Masrūk (d. 63/683), Sha'bî (d. 104/722) and Said b. Jubayr (d. 94/713 [?]) refused to relate the Meccan verses to ʿAbdallāh b. Salām because they had considered the process of nuzul. When the revelations are evaluated on the basis of the Qur'ān and prophetic biography relationship and the process of nuzul, it is understood that the interlocutors are the scholars of Ahl al-kitāb who know and acknowledge that the Qur'ān and the prophethood are right, as some commentators have indicated. In this case, it is understood that the commentators make comments that are not appropriate to the context, wording and nuzul process of the verses based on the narratives that are not true and that they use the name of ʿAbdallāh b. Salām as a kind of filling material since the information about the interlocutors is limited. It is not acceptable to praise one of them in the revelations when we evaluate the Ahl al-kitāb by generalizing the truth, their hostility towards Islam and the wars. However, there were no clashes with Jews and Christians in Mecca and there were scholars who expressed the truth. They were praised when necessary, and also cited as a reference source for the Prophet and idolaters. In addition, in the verses that criticize the Ahl al-kitāb in the verses Medinan, those who make the mistakes in question are not criticized as a whole. As in these examples, we need to evaluate the verses in the context of the individual process, not with the influence of our established perceptions and with a wholesale mind. Otherwise, unintentional results can be reached. It can be claimed that the Predecessors fell to an anachronism in their explanations about ʿAbdallāh b. Salām which did not conform to the date and time. However, when we consider the views of Ibn Taymiyya, al-Zarkashī and al-Dihlawī, it is understood that the Predecessors expressed views in terms of exegesis, opinion-based sampling rather than an anachronism. These interpretations of the Predecessors also depict that the information available to the interlocutors of the verses is insufficient. The fact that the historical information errors in Predecessors’ illustrations and explanations show that the information transferred from them should be examined carefully and that one must not surrender him/her without investigation. It is a clear fact that those who accept interpretations based on ijtihâd as an actual asbâb al-nuzul fall into anachronism. In this respect, it is understood that asbâb al-nuzul narrations should be evaluated in accordance with the principles mentioned and it is necessary to distinguish between those who tell the real reason and those who do not and make a preference among them. In previous research, studies on motivated correction in the evaluation of branded products are rare. This experimental study with 246 participants examined how the motivation to correct the impact of brand knowledge influences the product evaluation of actual strong and weak brands in low and high involvement situations. As predicted, asymmetry between the strong and weak brands was observed. After the induction of the motivation to correction, the smaller brand effect occurred only in the cases of low involvement (...) and the weak brand. The effect of motivated correction was smaller than the effect of high involvement; therefore, the overall results suggest that conscious explicit motivation to correction evokes correction only in cases of weak brands under certain circumstances. However, this impact is not as strong as the influence of high motivation or a strong brand, even though explicit instructions are given to avoid the negative influence of the brand. (shrink)

The syntax of 2 John 1: 5 is problematic. Six manuscripts, Ψ 5. 81. 642*. 1852 l, try to solve this difficulty by emending the participle ‘γράφων’ to the indicative verb ‘γράφω’. Culy and Leedy on Greek NT diagrams, on the other hand, understand the participle ‘γράφων’ to modify ‘ἐρωτάω’. In the latter approach, the participle ‘γράφων’ serves to modify ‘εἴχομεν’. This last approach, however, is divided into two possibilities: either it functions as a participle of condition or of attendant (...) circumstance. Three English Bibles use a participle of condition. The other English translations, however, employ the function of attendant circumstance participle. Despite these syntactical discrepancies, this research offers a fresh reading of the puzzled syntax of 2 John 1: 5. (shrink)

This paper proposes a novel method for identifying the public evaluative standards that contribute to the classification of certain conditions as mental disabilities. Public evaluative standards could contribute to ascertaining disabilities by outlining characteristics whose presence beyond a threshold is fundamentally important for the life of a person and whose absence or reduced occurrence constitutes a disability. Additionally, they can participate in determining disabilities by delineating particularly grave difficulties, impairments, or incapacities. Our method relies on a model of public justification (...) of evaluative standards that is inspired by Gerald Gaus’s theory of public reason. Thus, our approach recommends the justification of evaluative standards through sound deliberative routes from reasons accessible to all persons who participate in the process of justification and the convergence of what is justified in this way to each of them. We deem that disabilities could be caused both by problems in the internal characteristics of a person as well as by unfairness or a lack of hospitality in external circumstances. This is why the method of justification is applied to the assessment of those circumstances as well. If social or environmental circumstances cannot be justified through the convergence of reasons accessible to all persons involved in the process of justification, we have reasons to exclude the presence of a disability and ascertain the presence of inadequate external conditions. This paper examines a small-scale attempt to support collective evaluation of a transgenic potato variety. By mobilizing Laurent Thevénot’s ideas on the connectedness of the ontological and normative, it investigates how the controversial object was associated with coordinating perspectives or orders of worth in two focus groups. In these groups, the GM potato qualified for evaluation in relation to deterministic market forces. However, it was unclear whether the potato would operate as a beneficial market asset or merely as (...) an accelerator of ever tougher competition. The innovation also had a tendency to disappear out of sight or to receive capacities as a transgenic application of whatever kind. Hence, it was only with effort that the discussions delved into the specific realities and circumstances of the Finnish potato production. When they did, some particular demands posed by the blight resistant potato became visible and discussable. These scripts concerned the counterparts of contract production, possibly favoring the reorganization of producers into larger associations of highly specialized professionals. However, since practical implications and possibilities received little attention, the paper suggests that more attention needs to be put into organization and preparation of multi-stakeholder evaluations. The emergence of learning potential greatly depends on the abilities and willingness of the participants to engage with speculative experiments or reality tests. This is a risky strategy for anyone who hopes that a meeting will remain within a particular scope or that it will reach a particular conclusion. (shrink)

The main goal of concentration control and basic legal tests applied worldwide for the evaluation of concentrations, such as “dominance”, “significant impediment of competition” and “substantial lessening of competition” are analysed in this article. Every control, whatever its nature, is implemented in order to reach certain goals. In the first part of this article we analyse the goals of concentration control in different jurisdictions – mostly in the European Union, the USA and Lithuania. Four basic market security standards are (...) excluded: economic efficiency, protection of consumers, protection of competitors and protection of effective market competition. At the end we make a conclusion that the same standard, namely that of consumer protection, is applied in all those jurisdictions and that more attention should be paid for the protection of competitors and competition as a whole. Secondly, “dominance” test, applied in the EU under Regulation 4064/89, is analysed in detail. Moreover, the article discusses the meaning of a “dominant position”. We uphold the clarification of “dominance” provided by the Court of Justice, according to which dominance means the ability “to act to a considerable extent independently of their competitors, their customers and, ultimately, of consumers”. It is argued that “dominance” test is not sufficient for contemporary economics. The main disadvantage of this rule is that it is inapplicable for concentrations that do not create or strengthen dominant position. Furthermore, the new European Union rule of “significant impediment of competition” can be named as a smart European decision that tackled several problems: the practice of the Court of Justice remained applicable for future cases, because no serious changes to the wording of the rule were made. The detection of “dominant position” became only an alternative means to impede competition. In addition to this, the USA, the UK rule of “substantial lessening of competition” is compared to the two rules referred above. The concept of “monopoly” used in the wording of the rule, as well as the practice of the USA courts concerning the evaluation of market concentrations is analysed. We conclude that literally the phrases “significant impediment of competition” and “substantial lessening of competition” are different, but the content of these rules is the same. Different decisions taken in the same or similar cases on both sides of the Atlantic depend not on a certain rule but on the means of its application and some other circumstances (social, political factors, etc.). Finally, it is argued that practice of the evaluation of concentrations in the Republic of Lithuania is extremely poor. According to the present findings of the Competition Council of the Republic of Lithuania, it is hard to say the kind of approach the Council follows or, in other words, what kind of a rule the Council applies. Despite the fact that competition law in Lithuania was updated in conformity with the changes made in the EU competition law, we state that the test of “dominance” is further applied in certain concentration cases. In the academic world, peer review is one of the major processes in evaluating a scholars contribution. In this study, we are interested in quantifying the merits of different policies in a peer review process, such as single-blind review, double-blind review, and obtaining authors feedback. Currently, insufficient work has been undertaken to evaluate the benefits of different peer review policies. One of the major reasons for this situation is the inability to conduct any empirical study because data are presently unavailable. (...) In this case, a computer simulation is one of the best ways to conduct a study. We perform a series of simulations to study the effects of different policies on a peer review process. In this study, we focus on the peer review process of a typical computer science conference. Our results point to the crucial role of program chairs in determining the quality and diversity of the articles to be accepted for publication. We demonstrate the importance of discussion among reviewers, suggest circumstances in which the double-blind review policy should be adopted, and question the credibility of the authors feedback mechanism. Finally, we stress that randomness plays an important role in the peer review process, and this role cannot be eliminated. Although our model may not capture every component of a peer review process, it covers some of the most essential elements. Thus, even the simulation results clearly cannot be taken as literal descriptions of an actual peer review process. However, we can at least still use them to identify alternative directions for future study. (shrink)

Background U.S. federal regulations require that certain ethical elements be followed to protect human research subjects. The location and clinical circumstances of a proposed research study can differ substantially and can have significant implications for these ethical considerations. Both the location and clinical circumstances are particularly relevant for research in intensive care units (ICUs), where patients are often unable to provide informed consent to participate in a proposed research intervention. Food and Drug Administration (FDA) guidance document regarding an exemption from the requirement of obtaining informed consent from patients or their surrogates and to address certain elements within that document, thereby assisting clinicians in developing a framework for emergency research in accordance with the regulatory bodies at their own institutions and in the United States. Methods Review of the 2011 and updated FDA guidance document on exemption from informed consent. Results The current process of obtaining informed consent within ICUs needs to be revisited, especially for research in which timely informed consent is not likely. In particular, the process of obtaining informed consent may not be appropriate or even ethical for critically ill patients in extremis who require an intervention for which there is no current acceptable standard of care and clinical equipoise exists. We provide clinicians with a viewpoint that further elaborates on the FDA guidance document. Limitations The viewpoints provided herein are those of the authors and are therefore inherently limited by the personal views of a selected few. Other clinicians or researchers may not interpret the FDA guidelines in a similar manner. Moreover, the discussion of a guideline document is a limitation in and of itself. The guidelines set forth by the FDA are precisely that—guidelines. Therefore, they may not be followed as outlined in the guidance document within one’s own institution. Our goal is that, by elaborating on the guidelines for planned research involving human subjects in the ICU, institutional regulatory bodies may gain a better understanding in drafting their own document when faced with a clinician or a researcher who wishes to conduct planned research in an ICU. Conclusions We believe that the interpretations provided will allow clinicians to safely undertake planned research in ICUs without endangering the main tenets of ethical research involving human participants. Given that most of the adults’ life is spent in the workplace, and because the quality of working life has a significant effect on family life and community health, it is crucial to study the components involved in the improvement of the workplace and people’s health in the work environment. Therefore, by examining the common literature of Islamic values, spirituality and spiritual health, an attempt has been made in this research to explain organisational values and spiritual health in the management (...) of organisations and to analyse the relationship of these variables with each other in Iraq using an Islamic approach. Similar to any other community, an Islamic community requires management proportional to its specific circumstances. In fact, an Islamic community needs a type of management that intertwines with divine and Islamic values and ethical principles and prioritises Islamic ideals. Therefore, this study aims to evaluate the role of organisational values in the improvement of Islamic values of Iraqi Muslims. To this end, 2800 employees selected from 30 oil and chemical compound manufacturing organisations are examined. According to the results, the Islamic values governing the Iraqi organisations play an effective role in the improvement of employees’ spiritual health.Contribution: Divine and religious values and Islamic ethics have always been considered in Islamic communities, where formal and informal procedures are taken into consideration. An Islamic approach to management is combined with Islamic values, behaviours and ethics, and these values affect Islamic administration. Therefore, a proper understanding of Islamic values will help develop the right plan for human resource management, as well as the maintenance of organisational and community health. (shrink)

Due to the innovative nature of the world economy and the continuity of scientific and technological progress, intellectualization becomes one of the world's leading trends. The article is aimed to evaluate the state of intellectualization of the national economy of Ukraine in the context of globalization. In the article the existing approaches are considered, which are used by international organizations and expert agencies to evaluate the intellectualization level of the countries around the world. The indicators of the state of intellectualization, (...) available in the publications of the State statistics service of Ukraine have been researched. The author's deductive description of the intellectualization state of the regions (on the basis of twenty four indicators) and of types of economic activity (three indicators) of the national economy has been presented. It has been determined, that in the today's circumstances, an increasing of intellectualization level of the Ukrainian economy could happen, on the one hand, by means of getting balanced the status of intellectualization of the regions, given their natural resource potential, the socio-economic situation and the international human resources movement. On the other hand, this can happen due to introduction of new forms of national economic policies for human resources development in the fields of IT-technologies, information services, sports, education, space industry, tourism. The scientific novelty and practical importance, as well as originality of the obtained results is represented by an elaborated methodological framework for evaluating the state of the intellectualization of the national economy plus a further projecting of mechanisms of intellectualization of Ukraine in the worldwide context. Deontological and teleological evaluations are widely utilized in the context of consumer decision-making. Despite their use, the differential effect of these distinct types of evaluations, and the conditions under which they hold, remains an unresolved issue. Thus, we conduct a meta-analysis of 316 effect sizes, from 53 research articles, to evaluate the extent to which deontological and teleological evaluations influence ethical judgments and intentions, and under what circumstances the influence occurs. The effect is explored across three categories of moderators: (1) (...) contextual elements of the ethical issue, (2) stakeholders, and (3) methodological characteristics of primary studies. We find that the overall effect of deontological evaluations on ethical judgments and intentions is stronger than for teleological evaluations; however, the magnitude of the effect is contingent on several moderators. Deontological evaluations are weaker in offline consumer contexts and stronger when there are financial implications of the ethical issue. Conversely, the effect of teleological evaluations is relatively stable across ethical consumer contexts. Teleological evaluations are stronger from a utilitarian perspective than from an egoist one. Furthermore, the effect of deontological evaluations is weaker, but the effect for teleological evaluations is stronger, when the decision-maker has a personal relationship (as compared to an organizational relationship) with the victim of the unethical act. Findings validate the effect of both deontological and teleological evaluations on ethical judgments and intentions and highlight their importance in consumers’ ethical decision-making. Implications for developing programs to prevent consumer unethical behavior are discussed. (shrink)

This paper provides a comparative analysis of the rules of conduct governing legal representatives in Australia, the United States of America and the United Kingdom as they apply to a range of ethical issues in mediation. The analysis has four main aims. First, it clarifies the position in Australia and the USA - the Australian and American mediation communities have not introduced separate codes for ?mediation advocates? as Mason recently suggested. But some provisions have been made for mediation practice. The (...) second aim is to tease out from these provisions learning points for policy makers and rule drafters. Amongst the points to consider is whether or not, and under what circumstances, mediators should be regarded as courts, or as third parties for the purpose of the rules. Third, the analysis provides some grounds for arguing that the current rules of conduct are appropriate for legal representatives in mediation. Fourth, it identifies challenges associated with proposals to introduce rules which require legal representatives to participate in mediation in good faith in a non-adversarial manner according to higher standards of honesty and candour. The article concludes by identifying a number of assumptions which permeate the literature on this topic. (shrink)

From which evaluative base should we develop public policies designed to promote wellbeing among different cultural groups in different circumstances? This article attempts to advance an objective, universal theory of cultural evaluation grounded in a eudaemonistic account of human wellbeing. The approach evaluates cultures on the success with which they enable societies to promote the wellbeing of individuals through provision of needs and capabilities within their given, determinate circumstances. Natural environments have a restorative effect from mental/attentional fatigue, prevent stress, and help to revitalize psychological and physical resources. These benefits are crucial for promoting active aging, which is particularly relevant given the phenomenon of population aging in recent decades. To be considered restorative, green spaces have to meet specific requirements in ecological and psychological terms that can be assessed through Post-Occupancy Evaluation, a multimethod approach commonly used by environmental psychologists and landscape architects after construction to evaluate the design (...) outcomes from the users’ perspective. Generally, POEs consist of surveys and/or interviews accompanied by more or less structured observations of onsite users’ behavior. Despite this, various practical constraints can prevent physical access to the renovated area. Exploiting digital tools for such an assessment can be a crucial support in such circumstances. The current study presents the visual POE of a restorative garden for older adults in Milan, Italy. We developed a web application, that includes the exp-EIA© patented method, which allows participants to virtually explore a visual simulation of the environment and provide their feedback. We identified 3 representative viewpoints in the redeveloped garden differing from each other for the functions and the design principles that inspired the transformation. For each point of view, we created 360° Virtual Reality photographs, that can be navigated by looking around, i.e., panning, from the standing point of each view. In connection to each virtual scene, a survey was conducted. The focus was the psychological experience related to each viewpoint, assessed with two psychometric scales investigating the constructs of emotions and restoration ; such information is integrated with behavioral aspects, including the main activities prefigured by participants and their visual exploration of the VR photography. The results of the virtual exploration show that the garden is perceived as restorative, with a more intense effect in a spot purposely designed. The emotions experienced in the garden are positive and a mild level of arousal is observed. The behavioral dimension is characterized by predominantly contemplative activities and contact with nature. A cartographic representation of the psychological and behavioral data is developed, to support the maintenance of the garden. (shrink)

The recent exchange between Robert Brandom and Jürgen Habermas provides an opportunity to compare and contrast some aspects of their systems. Both present broadly inferential accounts of meaning, according to which the content of an expression is determined by its role in an inferential network. Several problems confront such theories of meaning - one of which threatens the possibility of communication because content is relative to an individual's set of beliefs. Brandom acknowledges this problem and provides a solution to it. (...) The point of this paper is to argue that it arises for Habermas's theory as well. I then present several solutions Habermas could adopt and evaluate their feasibility. The result is that Habermas must alter his theory of communicative action by contextualizing the standards for successful communication. (shrink)

A Kantian evaluation of Taylorism in the workplace requires a consideration of four problems; (1) the conditions of agency, (2) the relation of Taylorism to these conditions, (3) an explanation of the method given by the Typic for applying the Categorical Imperative, and (4) the actual application of the Categorical Imperative to Taylorism. An agent who views himself as a performer is distinguished from an agent who is a mere observer of his own actions, and it is argued that (...) Taylorism in effect attempts to remove the purposiveness of action from the workmen and to reduce them to the state of being mere observers of their own actions. Then it is argued that in order for one to attempt to think of a maxim as a universal law, one must posit a universal and necessary connection between the circumstances and the performances and then another such connection between the action and the purpose to be achieved. A model is constructed using heat-seeking machines, and it is argued that a principle analogous to Taylorism could not hold as a universal law for such machines. Thus, Taylorism is not an acceptable solution to the problem of coordinating the activities of self-directed agents within the workplace. (shrink)

This empirical research applies cointegration in the traditional measurement method first to build directed weighted networks in the context of stock market. Then, this method is used to design the indicators and the value simulation for measuring network fluctuation and studying the dynamic evolution mechanism of stock market transaction networks as affected by price fluctuations. Finally, the topological structure and robustness of the network are evaluated. The results show that network structure stability is strong in the bull market stage and (...) weak in the bear market stage. And the convergence rate of the dynamic evolution of network fluctuation is higher in the bull market stage than in the bear market stage. (shrink)

This is a reply to Tomas Marvan's paper "Obstacles to the Relativity of Truth", published in the same issue, in which I attempt to provide an interpretation of the relativist schema "x is true relative to y" by understanding x as ranging over propositions and y as ranging over circumstances of evaluation, as in the familiar Kaplanian picture of semantics. ObjectivesThis pilot study sought to develop and evaluate a novel online group-based intervention to help breast cancer survivors make healthy lifestyle changes intended to yield not only beneficial physical outcomes but also greater behavioral, and psychosocial well-being.MethodsAn exploratory single-arm, mixed-method triangulation design was employed to evaluate the feasibility and preliminary effectiveness of the HLM-ABC intervention for overweight BCSs. Fourteen women participated in the 10-week intervention and completed quantitative measures of the above-mentioned outcomes at baseline, post-treatment, 6-month, and 12-month follow-up time (...) points. Qualitative data were obtained post-treatment via semi-structured interviews and a treatment satisfaction questionnaire.ResultsParticipants lost an average of 2.83% of their baseline weight by 1-year follow-up, equal to a small effect size. Despite achieving only modest weight loss, participants achieved meaningful gains in the form of increased physical activity, discovery of gratifying movement, more intuitive eating habits, greater bodily and emotional awareness, and positive shifts in beliefs about being able to make healthy choices regarding food and physical activity. Furthermore, they demonstrated a slight improvement in body image and described feeling more self-compassionate, empowered, and acknowledging of variables beyond control that can present barriers to change.ConclusionAfter completing a 10-week online program, participants achieved meaningful and lasting changes on a number of healthful indicators, even when this did not correspond with a significant reduction in weight. Findings highlight the complex, multifaceted nature of “health” and lend support for promotion of healthier lifestyle following cancer treatment that encompasses not only physical weight, but also behavior, psychosocial well-being, and circumstances such as life-preserving hormonal treatments. ABSTRACT Reverse eikos (plausibility) arguments are notorious for reversing a reason that supports an accusation into a reason that denies this accusation. This article offers new insights on their analysis and evaluation, by reconstructing a reverse eikos argument’s line of reasoning as an argumentative pattern. The pattern reveals that this type of argument centers not only on the arguer’s claim that by doing the act of which they have been accused, they would risk becoming the likely suspect, but also (...) on the connected reasoning that they would not want to risk this since that would be stupid and they are not stupid. The proposed analysis, which is illustrated with classic and modern examples of reverse eikos arguments, shows that the evaluation of these arguments boils down to estimating the arguer’s calculation of the costs and benefits of taking the risk, while taking into account the arguer’s character, intellect, and circumstances. In the recent literature on contextualism and relativism, one often finds disputes as to which kind of consideration would be relevant for positing a feature of a context as a parameter in the ‘‘circumstance of evaluation’: via the presence of an operator in the language which shifts that feature (Stanley) or by being a feature of a context with respect to which the truth of ‘‘propositions’’ expressed in the context is relative (McFarlane). This kind of dispute arises from (...) two different independent roles that elements in ‘‘circumstances of evaluation’’ are sometimes assumed to have. There are indications that simple reaction time might have slowed in Western countries, based on both cohort- and multi-study comparisons. A possible limitation of the latter method in particular is measurement error stemming from methods variance, which results from the fact that instruments and experimental conditions change over time and between studies. We therefore set out to measure the simple auditory reaction time (SRT) of 7,081 individuals (2,997 males and 4,084 females) born in Sweden 1959-1985 (subjects were aged between 27 (...) and 54 years at time of measurement). Depending on cut-offs and adjustment for ageing related slowing on SRT, the data suggest that SRT has increased between 3 and 16 ms in the 27 birth years covered in the present sample. The slowing is unlikely to be explained by attrition, as evaluated by comparing the general intelligence × birth-year interactions and standard deviations for both male participants and dropouts, utilizing military conscript cognitive ability data. The present result is consistent with previous studies employing alternative methods, and may result from several synergistic factors, such as possible recent micro-evolutionary trends favouring lower g in Sweden and the effects of industrially produced neurotoxic substances on peripheral nerve conduction velocity. As the World Wide Web has grown in popularity, the propriety of linking to other web sites has achieved some prominence as an important moral and legal issue. Hyperlinks represent the essence of Web-based activity, since they facilitate navigation in a unique and efficient fashion. But the pervasive activity of linking has generated notable controversies. While most sites welcome and support incoming links, others block them or seek to license them in some way. Particularly problematic are so-called 'deep links,' which (...) bypass the home page along with the extensive advertising and promotional material that is usually found there. While some contend that a site's mere presence on the web is implicit permission for virtually any form of linking, others argue that at least in some circumstances deep linking is unfair and constitutes misappropriation of intellectual property.In this paper we will explore the issue of deep linking from a distinctly moral vantage point. While legal scholars have vigorously debated this issue, it has received little attention from moralists. But deep linking raises a plethora of complex property issues with subtle moral implications, and hence it deserves our careful scrutiny. The most fundamental question concerns the appropriate scope of property rights for a web site and how those rights can be properly balanced against the common good of free and open communications on the Web. It is our contention that there is no presumptive claim to the liberty of deep linking at will, since it may be disrespectful of property rights in certain situations. In order to defend this position we first make the case that a web site is a form of intellectual property, drawing support from the major theories that justify property ownership. Once we have established that a web site is really property, we consider the specific rights implied by such ownership. We conclude that on the basis of those rights, a prima facie case can be made that because of the potential for negative effects, users should not presume that deep linking is acceptable unless they first seek out the permission of the target web site.We also fully appreciate the dangers inherent in propertizing the web and the need to encourage the most flexible forms of linking. Therefore, we argue that any arbitrary or unnecessary restrictions against deep linking should be eschewed for the sake of the common good of open communications, flexibility, and maximum porosity in the Internet environment. While web site authors may indeed have a property right in their creative work they have a correlative obligation to promote the sharing and free flow of information when their specific ownership rights are not put in jeopardy by deep linking. Did Chinese mysticism vanish after its first appearance in ancient Taoist philosophy, to surface only after a thousand years had passed, when the Chinese had adapted Buddhism to their own culture? This first integrated survey of the mystical dimension of Taoism disputes the commonly accepted idea of such a hiatus. Covering the period from the Daode jing to the end of the Tang, Livia Kohn reveals an often misunderstood Chinese mystical tradition that continued through the ages. Influenced by but ultimately (...) independent of Buddhism, it took forms more various than the quietistic withdrawal of Laozi or the sudden enlightenment of the Chan Buddhists. On the basis of a new theoretical evaluation of mysticism, this study analyzes the relationship between philosophical and religious Taoism and between Buddhism and the native Chinese tradition. Kohn shows how the quietistic and socially oriented Daode jing was combined with the ecstatic and individualistic mysticism of the Zhuangzi, with immortality beliefs and practices, and with Buddhist insight meditation, mind analysis, and doctrines of karma and retribution. She goes on to demonstrate that Chinese mysticism, a complex synthesis by the late Six Dynasties, reached its zenith in the Tang, laying the foundations for later developments in the Song traditions of Inner Alchemy, Chan Buddhism, and Neo-Confucianism. Despite urgent calls for more research on the integration of business ethics and the meaning of work, to date, there have been few corresponding efforts, and we know surprisingly little about this relationship. In this study, we address this issue by examining when and for whom ethical leadership is more effective in promoting a sense of work meaningfulness among employees, and their subsequent work attitudes. Drawing on the contingency theories of leadership and work meaningfulness literature, we speculate that both employees’ (...) core self-evaluation and perceived organizational support moderate the relationship, but in different ways, and these associations carry over to employees’ subsequent work attitudes in terms of job satisfaction, organizational commitment and turnover intention. We test our hypotheses with two-wave survey data collected from 377 employees. Results indicate that ethical leadership is effective in eliciting work meaningfulness and attitudes for employees higher in CSE or when POS is lower, and ineffective for those lower in CSE or when POS is higher. A supplementary analysis reveals a three-way interaction between ethical leadership, CSE and POS in predicting a sense of work meaningfulness and subsequent work attitudes. Our research cautions that ethical leadership is not a universally positive practice; it can be ineffective or even have a negative impact under some circumstances. (shrink)

Most donated organs in the United States come from brain dead donors, while a small percentage come from patients who die in “controlled,” or expected, circumstances, typically after the family or surrogate makes a decision to withdraw life support. The number of organs available for transplant could be substantially if donations were permitted in “uncontrolled” circumstances–that is, from people who die unexpectedly, often outside the hospital. According to projections from the Institute of Medicine, establishing programs permitting “uncontrolled donation after circulatory (...) determination of death,” or uDCDD, throughout the United States has the potential to provide 22,000 more donation opportunities annually. In contrast, U.S. controlled donation after circulatory determination of death, or cDCDD, cases have increased progressively over the past decade from 87 to 848 donors, but currently account for only 10.6 percent of all deceased donors. Following the IOM recommendations, several projects exploring the feasibility of uDCDD were funded by the federal government, including a grant from the Health Resources and Services Administration that supported a pilot project in New York City in which the authors of this article participated.A key feature of our protocol, and indeed of many uDCDD protocols, is the initiation of preservation methods such as chest compressions and extracorporeal membrane oxygenation shortly after death in order to perfuse and preserve the donor's organs. Critics of uDCDD argue that the means of determining death deviates from generally ascribed principles. They assert that reinstituting circulation in order to preserve organs has the effect of “undoing” the prior determination of death. The result is that cDCDD is widely accepted and practiced routinely even though it only marginally increases the number of organs available for transplantation, and uDCDD is widely considered unacceptable despite being ethically embraced and proven to significantly increase organ donation opportunities in other countries. This article explores the evolution of this counterintuitive state of affairs and calls for a policy that, in line with the IOM report, allows for both cDCDD and uDCDD protocols. (shrink)

According to indexical contextualism, the perspectival element of taste predicates and epistemic modals is part of the content expressed. According to nonindexicalism, the perspectival element must be conceived as a parameter in the circumstance of evaluation, which engenders “thin” or perspective-neutral semantic contents. Echoing Evans, thin contents have frequently been criticized. It is doubtful whether such coarse-grained quasi-propositions can do any meaningful work as objects of propositional attitudes. In this paper, I assess recent responses by Recanati, Kölbel, Lasersohn (...) and MacFarlane to the “incompleteness worry”. None of them manages to convince. Particular attention is devoted to an argument by John MacFarlane, which states that if perspectives must be part of the content, so must worlds, which would make intuitively contingent propositions necessary. I demonstrate that this attempt to defend thin content views such as nonindexical contextualism and relativism conflates two distinct notions of necessity, and that radical indexicalist accounts of semantics, such as Schaffer’s necessitarianism, are in fact quite plausible. As a growing number of embryos collect in fertility clinics, it is imperative to evaluate the permissibility of available options for genetic parents and fertility institutions. Much of the discussion on appropriate treatment of embryos has focused on the circumstances under which it is permissible to destroy embryos for instrumental purposes, and thus has little application to the fertility context. I aim to develop a new account of the value of embryos whereby embryos have final value in virtue of their (...) relationship to persons that could exist. I call this symbolic value. To establish this value, I first show that corpses have this same symbolic value in virtue of their relationship to prior persons, and then show that the cases of corpses and embryos are relevantly similar. Because of this value, we ought to treat embryos in particular respectful ways. It is currently common practice in the United States to simply discard extra embryos that exist as a result of in vitro fertilization. I argue it is generally impermissible to simply discard embryos because it is an act of disrespect and does not treat them in accordance with their value. (shrink)

The phenomenology of emotions has traditionally been understood in terms of bodily sensations they involve. This is a mistake. We should instead understand their phenomenology in terms of their distinctively evaluative intentionality. Emotions are essentially affective modes of response to the ways our circumstances come to matter to us, and so they are ways of being pleased or pained by those circumstances. Making sense of the intentionality and phenomenology of emotions in this way requires rejecting traditional understandings of intentionality and (...) so coming to see emotions as a distinctive and irreducible class of mental states lying at the intersection of intentionality, phenomenology, and motivation. Epistemic evaluation is often appropriately prescriptive in character because believers are often capable of exercising some kind of control—call it doxastic control—over the way in which they regulate their beliefs. An intuitively appealing and widely endorsed account of doxastic control—the immediate causal impact account—maintains that a believer exercises doxastic control when her judgments about how she ought to regulate her beliefs in a particular set of circumstances can cause the believer actually to regulate her beliefs in those circumstances as (...) she judges she ought to. I show here that the immediate causal impact account is ultimately untenable. Nevertheless, the immediate causal impact account gets something important about the nature of doxastic control right: exercising doxastic control involves being such that one’s conception of ideal belief regulation somehow shapes the way in which one actually regulates one’s beliefs. Thus, I develop here an alternative account according to which, insofar as she exercises doxastic control, a believer’s conception of ideal belief regulation shapes the way in which she actually believes by exerting causal power directly on her dispositions to regulate her beliefs in certain ways. I defend this alternative against other competitors by showing that it can be extended to supply a unified account of rational control that explains why evaluation with respect to the various different norms of rationality that govern the way in which we form, revise and sustain not only our beliefs, but also our intention, hopes, fears, etc. is often appropriately prescriptive. Technology development and innovation are fundamentally different from scientific research. However, in many circumstances, they are evaluated jointly and by the same processes. In these cases, peer review—the most usual procedure for evaluating research—is also applied to the evaluation of technological products and innovation activities. This can lead to unfair results and end up discouraging the involvement of researchers in these fields. This paper analyzes the evaluation processes in Uruguay's National System of Researchers. In this system, all members' (...) activities, both scientific and technological, are evaluated by peer committees. Based on documentary analysis and semi-structured interviews, the difficulties faced by evaluators in assessing technology products are explored. The article highlights the persistence of a linear conception of the link between science and technology and describes the obstacles to assimilate the particularities of technological activities. Refereed publications are presented as the only uncontested product. Other types of output are reviewed with suspicion. This study emphasizes the need for specific mechanisms to evaluate technological production within academic careers. (shrink)

Physical activity can prevent and treat multiple diseases. Exercise referral schemes have been used extensively as one healthcare pathway. Schemes typically involve the referral of an inactive individual, with a long term condition, for a time limited exercise programme. Evidence has shown limited benefit, yet the exploration of implementation is under researched. National guidance, in the United Kingdom, recommends that exercise referral schemes should not be commissioned unless behaviour change practices are implemented. Nonetheless, novel evaluations, which are sensitive to the (...) complex nature of behaviour change implementation, have not been undertaken. Therefore, this research sought to answer how, why, and in which circumstances behaviour change practices are implemented by exercise referral practitioners. Realist evaluation, a form of theory driven evaluation, was adopted to address the research question. Programme theory, the envisaged causal workings of implementation, was developed and tested to advance knowledge on how behaviour change practice can be achieved by exercise referral practitioners. An 8-month focused ethnography was used to develop programme theory. Subsequently, a survey was validated to empirically test programme theory. Adjudication between theory required an assessment of the fidelity to behaviour change practices. Therefore, vignettes were created and validated, which acted as a proxy to observations. The survey was then completed through online, and facilitated interviews, using a ‘think aloud’ methodology. The analysis showed that practice frameworks augment motivation when there is congruent practitioner characteristics and practice monitoring is utilised, whereas frameworks improve capability when faced with challenging attendees. Supportive leadership improves motivation when there is an organisational commitment to behaviour change and practitioners are passionate to empower attendees. Supportive leadership improves capability for implementation when a learning climate is created. Partnerships with medical professionals enhance implementation, through changes to motivation, when medical professionals commit and recognise the value of schemes, and partnerships enhance capability where medical professionals reinforce practice via congruent communication. On-going support enhances capability where practitioners are cognizant of their role and have lower behaviour change competencies, conversely, motivation is enhanced as practitioners become more capable. Exercise referral schemes risk being labelled ineffective without considering the implementation climate and fidelity to best practice guidance. This thesis provides portable and actionable findings, which could lead to a greater translation of behaviour change practices to applied settings in exercise referral and in other medically led community based self-management interventions. The quality of doctoral-level biochemistry (N=139), botany (N=83), cellular/molecular biology (N=89), microbiology (N=134), physiology (N=101), and zoology (N=70) programs at United States universities was assessed, using 16 measures. These measures focused on variables related to: (1) program size; (2) characteristics of graduates; (3) reputational factors (scholarly quality of faculty, effectiveness of programs in educating research scholars/scientists, improvement in program quality during the last 5 years); (4) university library size; (5) research support; and (6) publication records. Chapter I discusses prior attempts (...) to assess quality in graduate education, development of the study plans, and the selection of disciplines and programs to be evaluated. Chapter II discusses the methodology used, focusing on each of the assessment measures. Chapters III to VIII present, respectively, findings from the analyses of the biochemistry, botany, cellular/molecular biology, microbiology, physiology, and zoology programs. Chapter IX includes a summary of results, correlations among measures, several additional analyses, and suggestions for future studies. Among the findings reported are those indicating that cellular/molecular biology programs had, on the average, the largest number of faculty and that students in cellular/molecular biology, biology, biochemistry, microbiology, and physiology received a relatively high fraction of financial support.
